			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require that certain funds provided by the Department of Transportation for high-speed rail
			 development in the State of California that are rescinded or otherwise
			 reimbursed be made available to the Secretary of the Interior for water
			 storage projects, and to the Secretary of Agriculture for nitrate
			 contamination reduction grants and new well construction grants.</official-title></form>
	<legis-body id="H73416120780D425087854437F341CC2F" style="OLC">
 <section id="H447051846B7C42468C75067E39203999" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Repurposing Assets to Increase Long-term Water Availability and Yield Act</short-title></quote> or the <quote>RAILWAY Act</quote>.</text> </section><section id="HE51EC55715C64EE48860FF99E0984C4F"><enum>2.</enum><header>Treatment of certain funds dedicated for high-speed rail development in the State of California</header> <subsection id="H52BDFBEF2F75484A8B7073FF7055650F"><enum>(a)</enum><header>Treatment of funds</header><text>Notwithstanding any other law, the covered funds described in subsection (b) shall be immediately deposited as follows:</text>
 <paragraph id="HB9E00814A08848EEA67C007DCE65E294"><enum>(1)</enum><text>90 percent of funds in the Reclamation Water Storage Account which shall be made available to the Secretary of the Interior for water storage projects authorized pursuant to section 4007 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>) (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note).</text>
 </paragraph><paragraph id="H3103549FD9E545EF84CFCE111089A970"><enum>(2)</enum><text>5 percent of funds in the Rural Water and Waste Disposal Program Account which shall be made available to the Secretary of Agriculture for grants under section 306F of the Consolidated Farm and Rural Development Act.</text>
 </paragraph><paragraph id="H24E1404B03D5455EB04A4481A9F0C0D8"><enum>(3)</enum><text display-inline="yes-display-inline">5 percent of funds in the Rural Water and Waste Disposal Program Account which shall be made available to the Secretary of Agriculture for grants under section 306G of the Consolidated Farm and Rural Development Act.</text>
 </paragraph></subsection><subsection id="H0489923758EB4026978EDDC94AAFE39D"><enum>(b)</enum><header>Covered funds</header><text>The covered funds are the following:</text> <paragraph id="HB5100150C54B479B86BE407203227EA0"><enum>(1)</enum><text>The Federal funds received by the Department of Transportation as a result of the Department of Transportation’s termination and de-obligation of Cooperative Agreement No. FR–HSR–0118–12–01–01 between the Federal Railroad Administration and the California High-Speed Rail Authority, notwithstanding the Omnibus Appropriations Act, 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/117">Public Law 111–117</external-xref>).</text>
 </paragraph><paragraph id="H49BE3FC356D24219900B97B409B1EECB"><enum>(2)</enum><text>The Federal funds that are recovered by the Department of Transportation relating to Cooperative Agreement No. FR–HSR–0009–10–01–06 between the Federal Railroad Administration and the California High-Speed Rail Authority, notwithstanding the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law 111–5</external-xref>).</text>
 </paragraph><paragraph id="H48B740E8ED104F16A76C63AFC5218F85"><enum>(3)</enum><text>Any funds determined to be offsets by the Federal Railroad Administration or the Department of Transportation, consistent with Cooperative Agreement No. FRA–HSR–0009–10–01–06.</text>
 </paragraph></subsection><subsection id="H200892DE4C9343188E7F83265B1D28ED"><enum>(c)</enum><header>Cost share for water storage projects</header><text>Funds made available pursuant this Act shall not count toward the cost-share provisions of section 4007 of the Water Infrastructure Improvements for the Nation Act.</text>
			</subsection></section><section id="H00F4D0C2E4B54097B6834F6EBC5D83CB" section-type="subsequent-section"><enum>3.</enum><header>Nitrate contamination reduction grants</header>
 <subsection id="H14A08302A5154B66A5B42E75CB6843F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle A of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922–1936c</external-xref>) is amended by inserting after section 306E the following:</text>
				<quoted-block display-inline="no-display-inline" id="H395782259DF44907BDB7C770594A9F80" style="OLC">
					<section id="H46CC364E7CA74A9D94BDD3F0466EE350"><enum>306F.</enum><header>Nitrate contamination reduction grants</header>
 <subsection id="HE478D4ECF73E4B7F9717CF309065C944"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide grants in accordance with this section to public or private nonprofit entities for projects designed to reduce the level of nitrates in, or remove nitrates from, drinking water in a rural community where the level of nitrates in drinking water exceeds applicable Federal or State standards.</text>
 </subsection><subsection id="HBF71F975AED84811B8AA2F76229E8427"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Grants made under this section may be used—</text> <paragraph id="H174A990D06A444F8AF7C5DCF59E901C6"><enum>(1)</enum><text>for waterline extensions from existing systems, laying of new waterlines, repairs or maintenance to an existing system, digging of new wells or development of other sources of water designed to replace sources of drinking water with high levels of nitrates, equipment replacement, and hook-up fees; and</text>
 </paragraph><paragraph id="H08DA208194D14284A52083754DE608FB"><enum>(2)</enum><text>in the case of a project designed to benefit a rural community outside the jurisdiction of the grantee, to maintain existing water supplies of the grantee that will be reduced as a result of the project.</text>
 </paragraph></subsection><subsection id="H2CE9EEF9D6504F5E8258105419EEC160"><enum>(c)</enum><header>Rural community</header><text display-inline="yes-display-inline">In this section, the term <quote>rural community</quote> does not include—</text> <paragraph id="HA36BCF42AB6444E590760CC9CB3E8018"><enum>(1)</enum><text>any area in any city or town with a population in excess of 10,000 inhabitants according to the most recent decennial census of the United States; or</text>
 </paragraph><paragraph id="H02D1446EE389427AB4E1210293A61F2C"><enum>(2)</enum><text>any area with a median household income in excess of the State nonmetropolitan median household income.</text>
 </paragraph></subsection><subsection id="H372DA8493E764D57A57D70D3A3DC2A9C"><enum>(d)</enum><header>Full Funding</header><text display-inline="yes-display-inline">Grants under this section shall be made in an amount equal to 100 percent of the costs of the projects conducted under this section.</text>
 </subsection><subsection id="HC28CD38349C64F2B8132818B33903FE3"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">Subsection (h) of section 306A shall apply with respect to the administration of applications for grants under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HE985F55AF2484001B0DB98B6E9F636C0"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Effective 5 years after the date of the enactment of this Act, section 306F of the Consolidated Farm and Rural Development Act, as added by the amendment made by subsection (a), is repealed.</text>
			</subsection></section><section id="H870B6876A2EA440B9A0B4D447C433354" section-type="subsequent-section"><enum>4.</enum><header>New well construction grants</header>
 <subsection id="HF1635B6D1EED4B64B20083D7ED937C6D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle A of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922–1936c</external-xref>) is further amended by inserting after section 306F the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC8E4081889674E3390613E6CD4792743" style="OLC">
					<section id="H58E3A2D73F9147208D53B74A8499AB47"><enum>306G.</enum><header>New well construction grants</header>
 <subsection id="H6C1E0AB18F1C4317ABEB1087E47CE078"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide grants in accordance with this section to public or private nonprofit entities for projects designed to supply drinking water to rural communities in which a significant number of dwellings with private drinking water wells have wells that are not producing water.</text>
 </subsection><subsection id="HCCF35F9A61BC4058BA091544AEAF9149"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Grants made under this section may be used—</text> <paragraph id="HA2B6B05321AD483C9927491D2F9AB577"><enum>(1)</enum><text>for waterline extensions from existing systems, laying of new waterlines, repairs or maintenance to an existing system, digging of new wells or development of other sources of water designed to replace sources of drinking water with high levels of nitrates, equipment replacement, and hook-up fees; and</text>
 </paragraph><paragraph id="H04622C888240488887FD610591408540"><enum>(2)</enum><text>in the case of a project designed to benefit a rural community outside the jurisdiction of the grantee, to maintain existing water supplies of the grantee that will be reduced as a result of the project.</text>
 </paragraph></subsection><subsection id="H42449C85E4694524902CC1D4A73821DF"><enum>(c)</enum><header>Rural community</header><text display-inline="yes-display-inline">In this section, the term <quote>rural community</quote> does not include—</text> <paragraph id="H3675449A523546919428543E3F601ABB"><enum>(1)</enum><text>any area in any city or town with a population in excess of 10,000 inhabitants according to the most recent decennial census of the United States; or</text>

 </subsection><subsection id="H7732687CD0854E47802AF59CBBE2F9EB"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Effective 5 years after the date of the enactment of this Act, section 306G of the Consolidated Farm and Rural Development Act, as added by the amendment made by subsection (a), is repealed.</text>
