No additional funds authorized.</toc-entry></toc></subsection></section><section id="id10f1feac737f4baa892a3c8b50feb28a"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text><paragraph id="id8f9ca9c7d35a4287a9857ec079169d78"><enum>(1)</enum><text>modernize reporting by recipients of Federal grants and cooperative agreements by creating and imposing data standards for the information that those recipients are required by law to report to the Federal Government;</text></paragraph><paragraph id="id1ced5f95159648bfa12be013bfd35439"><enum>(2)</enum><text>implement the recommendation by the Director of the Office of Management and Budget contained in the report submitted under section 5(b)(6) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note) relating to the development of a <quote>comprehensive taxonomy of standard definitions for core data elements required for managing Federal financial assistance awards</quote>;</text></paragraph><paragraph id="id4123e0d0b1bd4e3c93067173d243bcc3"><enum>(3)</enum><text>reduce burden and compliance costs of recipients of Federal grants and cooperative agreements by enabling technology solutions, existing or yet to be developed, for use in both the public and private sectors to better manage the data that recipients already provide to the Federal Government; and</text></paragraph><paragraph id="idbd940e15d01f4e93a290448fc0b03f67"><enum>(4)</enum><text>strengthen oversight and management of Federal grants and cooperative agreements by agencies by consolidating the collection and display of and access to open data that has been standardized and, where appropriate, increasing transparency to the public.</text></paragraph></section><section id="id51E41C4A0E9941FA9BB2043DC011FB9F"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the terms <term>agency</term>, <term>Director</term>, <term>Federal award</term>, and <term>Secretary</term> have the meanings given those terms in section 6401 of title 31, United States Code, as added by section 4(a) of this Act.</text></section><section id="id7d39f0b273954a87849bd82f883a6c09"><enum>4.</enum><header>Data standards for grant reporting</header><subsection id="idbbb492f024db4e5d8c49450a0f72974c"><enum>(a)</enum><header>Amendment</header><text>Subtitle V of title 31, United States Code, is amended by inserting after chapter 63 the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id494d8d36a8fa431cada119b95cda6cce" reported-display-style="italic" style="USC"><chapter id="id41a9587f9b86492ab4809df6fbd5a23c"><enum>64</enum><header>Data standards for grant reporting</header><toc><toc-entry level="section">Sec.</toc-entry><toc-entry level="section">6401. Definitions.</toc-entry><toc-entry level="section">6402. Data standards for grant reporting.</toc-entry><toc-entry level="section">6403. Guidance applying data standards for grant reporting.</toc-entry><toc-entry level="section">6404. Agency requirements.</toc-entry></toc><section id="id5a9709a128e64e80a847717c7a337561"><enum>6401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text><paragraph id="ide91d5afc2cfa46709eee444660078365"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 552(f) of title 5.</text></paragraph><paragraph id="idda3b95bbd940425181d768e4944d9cd1"><enum>(2)</enum><header>Core data elements</header><text>The term <term>core data elements</term> means data elements relating to financial management, administration, or management that—</text><subparagraph id="id1147490A08E64618B0DA9462C2972A7A"><enum>(A)</enum><text>are not program-specific in nature or program-specific outcome measures, as defined in section 1115(h) of this title; and</text></subparagraph><subparagraph id="id19F8D83A90C64573BD9C51B72E5591F9"><enum>(B)</enum><text>are required by agencies for all or the vast majority of recipients of Federal awards for purposes of reporting.</text></subparagraph></paragraph><paragraph id="ideb8cb74029e9462396334c3f1bd56c3b"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="id521c76555e994c2c8c959dc04bca17d1"><enum>(4)</enum><header>Executive department</header><text>The term <term>Executive department</term> has the meaning given the term in section 101 of title 5.</text></paragraph><paragraph id="idC15CA03B26E44853B52F15A2F6F5B466"><enum>(5)</enum><header>Federal award</header><text>The term <term>Federal award</term>—</text><subparagraph id="id8131f1a0a9d04f9b9f61a4a9db1829a5"><enum>(A)</enum><text>means the transfer of anything of value for a public purpose of support or stimulation authorized by a law of the United States, including financial assistance and Government facilities, services, and property;</text></subparagraph><subparagraph id="idd94f9af17c0b49fbb92e9ff5761d5b64"><enum>(B)</enum><text>includes a grant, a subgrant, a cooperative agreement, or any other transaction; and</text></subparagraph><subparagraph id="ida230e211f7da4dc68b73b7aa50a5c553"><enum>(C)</enum><text>does not include a transaction or agreement—</text><clause id="id8a7888b805694164b51cc91ee61cdc82"><enum>(i)</enum><text>that provides for conventional public information services or procurement of property or services for the direct benefit or use of the Government; or</text></clause><clause id="id77d4d71150684664b053fe60b9bc82d4"><enum>(ii)</enum><text>that provides only—</text><subclause id="id12b77dc6440348a098332e2db0a4ea03"><enum>(I)</enum><text>direct Government cash assistance to an individual;</text></subclause><subclause id="idb3a8e51147224d2681d690bd36b40396"><enum>(II)</enum><text>a subsidy;</text></subclause><subclause id="idbfbb48e6a5194d30b07e996c2fcdade9"><enum>(III)</enum><text>a loan;</text></subclause><subclause id="idee1b96c207434e17a1cd91cf9d4f9c32"><enum>(IV)</enum><text>a loan guarantee; or</text></subclause><subclause id="ide2184afdedf541c59c7b99fb1b495200"><enum>(V)</enum><text>insurance.</text></subclause></clause></subparagraph></paragraph><paragraph id="idc92f1f1015684ad0baab01c895feae16"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the head of the standard-setting agency.</text></paragraph><paragraph id="id4e1a1a80f9974b3cb6a38bc415d8579b"><enum>(7)</enum><header>Standard-setting agency</header><text>The term <term>standard-setting agency</term> means the Executive department designated under section 6402(a)(1).</text></paragraph><paragraph id="ide8bc34bf551d440498791a1a01855518"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph></section><section id="idf14be2845be74e63b157af6c3a41dd16"><enum>6402.</enum><header>Data standards for grant reporting</header><subsection id="ida49dc6ec7d3947bbadf1c52623ba8f65"><enum>(a)</enum><header>In general</header><paragraph id="id152cf8d4d70242c4bcd9db0c1d5ebc3e"><enum>(1)</enum><header>Designation of standard-setting agency</header><text>The Director shall designate the Executive department that administers the greatest number of programs under which Federal awards are issued in a calendar year as the standard-setting agency.</text></paragraph><paragraph id="id6355281cb0954afca68889f03f371cc7"><enum>(2)</enum><header>Establishment of standards</header><text>Not later than 2 years after the date of enactment of this chapter, the Secretary and the Director shall establish Governmentwide data standards for information reported by recipients of Federal awards.</text></paragraph><paragraph id="ida1aa52c15f07484f8eb75dbb1d279214"><enum>(3)</enum><header>Data elements</header><text>The data standards established under paragraph (2) shall include, at a minimum—</text><subparagraph id="ida6b5d716733a406d8a45640109d0e63e"><enum>(A)</enum><text>standard definitions for data elements required for managing Federal awards; and</text></subparagraph><subparagraph id="idbd3e703c71d14722af64ec3c344c6172"><enum>(B)</enum><text>unique identifiers for Federal awards and recipients of Federal awards that can be consistently applied Governmentwide.</text></subparagraph></paragraph></subsection><subsection id="id277b0d609b7e4c439fefeb837950d997"><enum>(b)</enum><header>Scope</header><text>The data standards established under subsection (a)—</text><paragraph commented="no" id="idD697258EA0484301899D0640DFB8785C"><enum>(1)</enum><text>shall include core data elements;</text></paragraph><paragraph commented="no" id="id223638236D85434C9AD645752721FF51"><enum>(2)</enum><text>may cover information required by law to be reported to any agency by recipients of Federal awards, including audit-related information reported under chapter 75 of this title; and</text></paragraph><paragraph commented="no" id="ideae24e4f3122497c8f62ae2cb4f1246a"><enum>(3)</enum><text>may not be used by the Director or any agency to require the collection of any data not otherwise required under Federal law.</text></paragraph></subsection><subsection id="id1d7de5e6bb5d44b48c412566afbaf443"><enum>(c)</enum><header>Requirements</header><text>The data standards established under subsection (a) shall, to the extent reasonable and practicable—</text><paragraph id="id768ea907d5914494992f2ba2733c24f4"><enum>(1)</enum><text>render information reported by recipients of Federal awards fully searchable and machine-readable;</text></paragraph><paragraph id="id278a28de85e1483e923dfb52352956c7"><enum>(2)</enum><text>be nonproprietary;</text></paragraph><paragraph id="id18959a17673a4afeadd8d77eef66441d"><enum>(3)</enum><text>incorporate standards developed and maintained by voluntary consensus standards bodies;</text></paragraph><paragraph id="id9f5e09cd418a4a6f9dc39374aff77731"><enum>(4)</enum><text>be consistent with and implement applicable accounting and reporting principles; and</text></paragraph><paragraph id="idd253adda6b3040b0815eb2bc215a2b13"><enum>(5)</enum><text>incorporate the data standards established under the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note).</text></paragraph></subsection><subsection id="idf0ce52ba9bb04fb1943edb04c4cdb9d2"><enum>(d)</enum><header>Consultation</header><text>In establishing the data standards under subsection (a), the Secretary and the Director shall consult with—</text><paragraph id="idd865705aa4024c3689f42cb427bd321c"><enum>(1)</enum><text>the Secretary of the Treasury to ensure that the data standards established under subsection (a) incorporate the data standards established under the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note);</text></paragraph><paragraph id="id8492735787fd4de4886747e31c946d0d"><enum>(2)</enum><text>the head of each agency that issues Federal awards;</text></paragraph><paragraph id="id4d1abe5b3d504b20bd96ef54426c74f3"><enum>(3)</enum><text>recipients of Federal awards and organizations representing recipients of Federal awards;</text></paragraph><paragraph id="idac5e400e74604260b0e5f688a758c509"><enum>(4)</enum><text>private sector experts;</text></paragraph><paragraph id="id2230efb36e33497a969943b2d4adca81"><enum>(5)</enum><text>members of the public, including privacy experts, privacy advocates, auditors, and industry stakeholders; and</text></paragraph><paragraph id="idc8a040bf36ba44018f1e093be1fef0aa"><enum>(6)</enum><text>State and local governments.</text></paragraph></subsection></section><section id="id45e0362620d0402bb3d65eb031928e2a"><enum>6403.</enum><header>Guidance applying data standards for grant reporting</header><subsection id="id30d71f5095374aff93134bd1e4a189a7"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this chapter—</text><paragraph id="id4515fb7e84654a47805ab8fa2ca51835"><enum>(1)</enum><text>the Secretary and the Director shall jointly issue guidance to all agencies directing the agencies to apply the data standards established under section 6402(a) to all applicable reporting by recipients of Federal awards; and</text></paragraph><paragraph id="id129684a32cc34856a49d4efb9273992c"><enum>(2)</enum><text>the Director shall prescribe guidance applying the data standards established under section 6402(a) to audit-related information reported under chapter 75 of this title.</text></paragraph></subsection><subsection id="id4495168817e64faebb0b541ba8cf2476"><enum>(b)</enum><header>Guidance</header><text>The guidance issued under subsection (a) shall—</text><paragraph id="idbc0a18315890489f963cc586cccdaf66"><enum>(1)</enum><text>to the extent reasonable and practicable—</text><subparagraph id="ida065f9c9a7e143dfbfb321bff62bc91b"><enum>(A)</enum><text>minimize the disruption of existing reporting practices of, and not increase the reporting burden on, agencies or recipients of Federal awards; and</text></subparagraph><subparagraph id="id1c8e1fd7628e4554b4b372e567ea2754"><enum>(B)</enum><text>explore opportunities to implement modern technologies in reporting relating to Federal awards;</text></subparagraph></paragraph><paragraph id="idd1a9efac2cbe4a10a124d5af675524c6"><enum>(2)</enum><text>allow the Director to permit exceptions for classes of Federal awards, including exceptions for Federal awards granted to Indian Tribes and Tribal organizations consistent with the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> et seq.), if the Director publishes a list of those exceptions and submits the list to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives; and</text></paragraph><paragraph id="idb6f08a4eaac34623a9a6a9b3c206bb1c"><enum>(3)</enum><text>take into consideration the consultation required under section 6402(d).</text></paragraph></subsection><subsection id="id814f284bde2f494f8088cbf2a1b26182"><enum>(c)</enum><header>Updating guidance</header><paragraph id="id0E6B297E64C84F41AF121CD7249BA44B"><enum>(1)</enum><header>In general</header><text>Not less frequently than once every 10 years, the Director shall update the guidance issued under subsection (a).</text></paragraph><paragraph id="idA4798721DE5D4C34870314B38D58336F"><enum>(2)</enum><header>Procedures</header><text>In updating guidance under paragraph (1), the Director shall, to the maximum extent practicable, follow the procedures for the development of the data standards and guidance prescribed under this section and section 6402.</text></paragraph></subsection></section><section id="id05536008d4994330bb9479d88ddc9905"><enum>6404.</enum><header>Agency requirements</header><text display-inline="no-display-inline">Not later than 1 year after the date on which guidance is issued or updated under subsection (b) or (c), respectively, of section 6403, the head of each agency shall—</text><paragraph id="id2828EACC922D42258734D15234BF19E6"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that all of the Federal awards that the agency issues use data standards for all future information collection requests; and</text></paragraph><paragraph id="idF1D4012EEA3B493DBF2A2B589BE2AFD7"><enum>(2)</enum><text display-inline="yes-display-inline">amend existing information collection requests under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44 (commonly known as the <quote>Paperwork Reduction Act</quote>) to comply with the data standards established under section 6402 of this chapter, in accordance with the guidance issued by the Secretary and the Director under section 6403 of this chapter.</text></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idebb701f0240d4a1ebc032f79ec092d62"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of chapters for subtitle V of title 31, United States Code, is amended by inserting after the item relating to chapter 63 the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id4d4ded7ba5854a0a8f1afded011832ac" reported-display-style="italic" style="USC"><toc changed="added" reported-display-style="italic"><multi-column-toc-entry bold="on" level="section"><toc-enum>64.</toc-enum><level-header bold="on" level="section">Data standards for grant reporting</level-header><target>6401</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2f8625909aa640058ed7ada7ad9bf2fd"><enum>5.</enum><header>Single Audit Act</header><subsection id="id406de24afc7843178d2f2b182110e1ca"><enum>(a)</enum><header>Amendments</header><paragraph id="id35343446e36646189a37f3a4be0266e7"><enum>(1)</enum><header>Audit requirements</header><text>Section 7502(h) of title 31, United States Code, is amended, in the matter preceding paragraph (1), by inserting <quote>in an electronic form in accordance with the data standards established under chapter 64 and</quote> after <quote>the reporting package,</quote>.</text></paragraph><paragraph id="id1e3b000d16e04cd79c5f19537ad062be"><enum>(2)</enum><header>Regulations</header><text>Section 7505 of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id5e80f807c8974891a1768f6dcc6a7687" reported-display-style="italic" style="USC"><subsection id="id8d810d6f4a4648f6807969365b18e058"><enum>(d)</enum><text>Such guidance shall require audit-related information reported under this chapter to be reported in an electronic form in accordance with the data standards established under chapter 64.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7b57493f649b48e78c9db2cfbd488f8d"><enum>(b)</enum><header>Guidance</header><text>Not later than 3 years after the date of enactment of this Act, the Director shall issue guidance requiring audit-related information reported under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/75">chapter 75</external-xref> of title 31, United States Code, to be reported in an electronic form consistent with the data standards established under chapter 64 of that title, as added by section 4(a) of this Act.</text></subsection></section><section id="id11e2a59a273a48738b2300dbf123f300"><enum>6.</enum><header>Consolidation of assistance-related information; publication of public information as open data</header><subsection id="id903794cd96274b76bfa88bfefdb50c93"><enum>(a)</enum><header>Collection of information</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary and the Director shall, using the data standards established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/64">chapter 64</external-xref> of title 31, United States Code, as added by section 4(a) of this Act, enable the collection, public display, and maintenance of Federal award information as a Governmentwide data set, subject to reasonable restrictions established by the Director to ensure protection of personally identifiable information and otherwise sensitive information.</text></subsection><subsection id="ide26931abce35431eb2b65250af5492f2"><enum>(b)</enum><header>Publication of information</header><text>The Secretary and the Director shall require the publication of data reported by recipients of Federal awards that is collected from all agencies on a single public portal, which may be an existing Governmentwide website, as determined appropriate by the Director.</text></subsection><subsection id="idb29b93a4694447e3b55893c6445f7c28"><enum>(c)</enum><header>FOIA</header><text>Nothing in this section shall require the disclosure to the public of information that would be exempt from disclosure under section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>).</text></subsection></section><section id="id8342d8d3077c4e87b9f916e834650fd1"><enum>7.</enum><header>Evaluation of nonproprietary identifiers</header><subsection id="idca630d7f611544f4ab90a726c9aeb40f"><enum>(a)</enum><header>Determination required</header><text>The Director and the Secretary shall determine whether to use nonproprietary identifiers described in section 6402(a)(3)(B) of title 31, United States Code, as added by section 4(a) of this Act.</text></subsection><subsection id="id69effbaafd6244f6a06bb682a5dde7c4"><enum>(b)</enum><header>Factors to be considered</header><text>In making the determination under subsection (a), the Director and the Secretary shall consider factors such as accessibility and cost to recipients of Federal awards, agencies that issue Federal awards, private sector experts, and members of the public, including privacy experts, privacy advocates, transparency experts, and transparency advocates.</text></subsection><subsection id="id342ffd13b57545af98f368779add1770"><enum>(c)</enum><header>Publication and report on determination</header><text>Not later than the earlier of 1 year after the date of enactment of this Act or the date on which the Director and the Secretary establish data standards under section 6402(a)(2) of title 31, United States Code, as added by section 4(a) of this Act, the Director and the Secretary shall publish and submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives a report explaining the reasoning for the determination made under subsection (a).</text></subsection></section><section id="id2d0ba71ce7b944afac01e13b02d6065d"><enum>8.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, shall be construed to require the collection of data that is not otherwise required under any Federal law, rule, or regulation.</text></section><section commented="no" display-inline="no-display-inline" id="id69cbefdaee064e00bea6aa571a792252" section-type="subsequent-section"><enum>9.</enum><header>No additional funds authorized</header><text display-inline="no-display-inline">No additional funds are authorized to carry out the requirements of this Act and the amendments made by this Act. Such requirements shall be carried out using amounts otherwise authorized.</text></section></legis-body></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
