			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose sanctions with respect to the Government of Georgia if the President determines that the
			 Government of Georgia is taking actions to undermine commitments or
			 contractual agreements with United States persons engaging in business
			 operations in the country of Georgia, and for other purposes.</official-title></form>
	<legis-body id="H93DF51FB69384AB99AE2DA30B5951CC5" style="OLC">
 <section id="H4A153422D10947C8A703AEA6001B1C6E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Georgian Fair Business Practices Sanctions Act of 2019</short-title></quote>.</text> </section><section id="H733A96D13D274E2ABF10F974FF4054EE"><enum>2.</enum><header>Report on actions of the Government of Georgia to undermine commitments or contractual agreements made with United States persons engaging in business operations in the country of Georgia</header> <subsection display-inline="no-display-inline" id="HCB86840852474E3EBDC92ADC3BD1C556"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and not less frequently than once every 180 days thereafter, the President shall submit to the appropriate congressional committees a report that—</text>
 <paragraph id="H3A099CBFAE624B01AEBCC0B40E3FD789"><enum>(1)</enum><text>includes a determination of the President of whether or not the Government of Georgia is taking actions to undermine the commitments or contractual agreements made with United States persons engaging in business operations in the country of Georgia; and</text>
 </paragraph><paragraph commented="no" id="H6B3811376DD24309B127FE6E97B6F22A"><enum>(2)</enum><text display-inline="yes-display-inline">identifies foreign persons who are current or former officials of the Government of Georgia who are responsible for any actions described in paragraph (1).</text>
 </paragraph></subsection><subsection id="H19B69AEB09964D27A8776114C479F09C"><enum>(b)</enum><header>Information</header><text>The report required under subsection (a) shall include—</text> <paragraph id="H4B72250E326B4038B13A108E41AC64B0"><enum>(1)</enum><text display-inline="yes-display-inline">a summary of United States Government and nongovernment investment in Georgia; and</text>
 </paragraph><paragraph id="HA5124D93A1D84A89A5718F87310D9CBB"><enum>(2)</enum><text>an assessment of the impact of actions described in subsection (a)(1) on the future of United States investment in Georgia.</text>
 </paragraph></subsection><subsection id="HD773FCECEBB1479D9C8E342B34EDAC3E"><enum>(c)</enum><header>Form</header><text>The report required under subsection (a) shall be submitted in unclassified form but may include a classified annex.</text>
			</subsection></section><section id="H7F769DF829064C87A22D6BFE87E7F88E"><enum>3.</enum><header>Imposition of sanctions with respect to the Government of Georgia and responsible officials of the
			 Government of Georgia</header>
 <subsection id="H3C528C2BD1FB484989192696C696F7FD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If the President submits to the appropriate congressional committees a report under section 2 that contains an affirmative determination of the President as described in subsection (a)(1) of such section—</text>
 <paragraph id="H3EEABED09ED24A9DB46F6F1A015C94BF"><enum>(1)</enum><text>the President shall impose the sanctions described in subsection (b) with respect to the Government of Georgia; and</text>
 </paragraph><paragraph id="H44F43FF1475D47169D7F4D07231B2602"><enum>(2)</enum><text display-inline="yes-display-inline">the President shall impose the sanctions described in subsection (c) with respect to current or former officials of the Government of Georgia who are identified in subsection (a)(2) of such section.</text>
 </paragraph></subsection><subsection id="H816B6C8AC86A4DD482A02D4235DA0B0F"><enum>(b)</enum><header>Sanctions with respect to Government of Georgia described</header><text>The sanctions described in this subsection are the following:</text> <paragraph id="H393419617D3D490E808DF02AAE8EE223"><enum>(1)</enum><text>No loan, credit guarantee, insurance, financing, or other similar financial assistance be extended by any agency of the Government of the United States (including the Export-Import Bank of the United States or the Overseas Private Investment Corporation) to the Government of Georgia, except with respect to the provision of humanitarian goods and agricultural or medical products.</text>
 </paragraph><paragraph id="HA469EFB0728841B1A1EE8A6AAB22A054"><enum>(2)</enum><text>No funds available to the Trade and Development Agency should be available for activities of the Agency in or for Georgia.</text>
				</paragraph></subsection><subsection id="H0C498F8DD074475DBFCE0888B2D5E678"><enum>(c)</enum><header>Sanctions with respect to responsible officials described</header>
 <paragraph id="H5D4EECFA4F8E40099C6A37E41FD756B4"><enum>(1)</enum><header>In general</header><text>The sanctions described in this subsection are the following:</text> <subparagraph id="H4FBDE7E538B34CEBB2BC04E626EC6D41"><enum>(A)</enum><header>Asset blocking</header><text>The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of an individual who is subject to subsection (a)(2) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
					</subparagraph><subparagraph id="H629D1BBC3A724F898E56C9FF3661BBDD"><enum>(B)</enum><header>Aliens ineligible for visas, admission, or parole</header>
 <clause id="H3B148350342D4266B962A856687AD857"><enum>(i)</enum><header>Visas, admission, or parole</header><text>An alien who is subject to subsection (a)(2) is—</text> <subclause id="H922D099D98A347448E580F04626551DB"><enum>(I)</enum><text>inadmissible to the United States;</text>
 </subclause><subclause id="HC83A7F6B239E46439FDDF5FC27A3FCCF"><enum>(II)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text> </subclause><subclause id="H6D28AA018B0E4D0891106B34D238AF91"><enum>(III)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text>
							</subclause></clause><clause id="H240EF2CA9F904099ACC0052B9D24BFA6"><enum>(ii)</enum><header>Current visas revoked</header>
 <subclause id="H75DDA4DA2EF84F049136568F12E849E7"><enum>(I)</enum><header>In general</header><text>The issuing consular officer, the Secretary of State, or the Secretary of Homeland Security shall revoke any visa or other entry documentation issued to an alien who is subject to subsection (a)(2), regardless of when issued.</text>
 </subclause><subclause id="H51EBDF56B432482E92DEAD8A0437E3BA"><enum>(II)</enum><header>Effect of revocation</header><text>A revocation under subclause (I) shall take effect immediately and shall automatically cancel any other valid visa or entry documentation that is in the possession of the alien.</text>
 </subclause></clause></subparagraph></paragraph><paragraph id="H8D088BDB9F5E427EB915439F864D47B5"><enum>(2)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed under paragraph (1)(A) to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of such section 206.</text>
 </paragraph></subsection></section><section id="H0D8BE07BA97A40C6AE33F2D6FA30E275"><enum>4.</enum><header>Termination of sanctions</header><text display-inline="no-display-inline">The sanctions described in section 3 shall cease to have effect beginning on the day after the date on which the President submits to the appropriate congressional committees a report under section 2 that contains a negative determination of the President as described in subsection (a)(1) of such section.</text>
 </section><section id="HCD0DBACDF2BD44038FE649EEE5F950CE"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph display-inline="no-display-inline" id="H81CD8D274DDF464CB16BA1A5C274A0A1"><enum>(1)</enum><header>Admitted; alien</header><text>The terms <term>admitted</term> and <term>alien</term> have meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text>
 </paragraph><paragraph id="HF0C70AC84F66465F9E8C06B29DED160D"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="HDE1ED15BB9FE4143A13415835F5601EC"><enum>(A)</enum><text>the Committee on Foreign Affairs, the Committee on Armed Services, the Committee on Homeland Security, the Committee on Financial Services, and the Committee on Ways and Means of the House of Representatives; and</text>
 </subparagraph><subparagraph id="H810556AE1C88489597545391E537C2BC"><enum>(B)</enum><text>the Committee on Foreign Relations, the Committee on Armed Services, the Committee on Homeland Security and Governmental Affairs, and the Committee on Banking, Housing, and Urban Affairs of the Senate.</text>
 </subparagraph></paragraph><paragraph id="H63BB6A5F435A44038CADE8D6D2435544"><enum>(3)</enum><header>Entity</header><text>The term <term>entity</term>—</text> <subparagraph id="HE5C1D9E8F29C44EDA20AE601EED38EE7"><enum>(A)</enum><text>means a partnership, association, corporation, or other organization, group, or subgroup; and</text>
 </subparagraph><subparagraph id="HAA508DE314814B5CBFAA71A0BB6920B6"><enum>(B)</enum><text>includes a governmental entity.</text> </subparagraph></paragraph><paragraph id="H2EA18A92EEB5414387E686DCBA5C412C"><enum>(4)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text>
 </paragraph><paragraph id="H2DB4EDD8E73F4B4CBD4729D99E72615F"><enum>(5)</enum><header>United States person</header><text>The term <term>United States person</term> means a United States citizen, permanent resident alien, entity organized under the laws of the United States (including foreign branches), or a person in the United States.</text>
