<section id="H85E1314727A143D8AAE6C44A6B117604" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Birthright Citizenship Act of 2019</short-title></quote>.</text></section> <section id="HB6D5C4FD28B9429980F1218272CDCDC9"><enum>2.</enum><header>Citizenship at birth for certain persons born in the United States</header> <subsection id="H4D77997FEF6D4A7199E4CD85743E7060"><enum>(a)</enum><header>In general</header><text>Section 301 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1401">8 U.S.C. 1401</external-xref>) is amended—</text> 
<paragraph id="H4351CFA619464B35A40B7647793D1716"><enum>(1)</enum><text>by inserting <quote><header-in-text level="subsection" style="traditional"><enum-in-header>(a) </enum-in-header>In general.—</header-in-text></quote> before <quote>The following</quote>;</text></paragraph> <paragraph id="H3CA640E187CE480D9AC8763DBD6F8FF2"><enum>(2)</enum><text>by redesignating subsections (a) through (h) as paragraphs (1) through (8), respectively; and</text></paragraph> 
<paragraph id="HD388D3A7E8A8402BBD53CB8264BFC823"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H1989C7ECFEBD44338547CFD83D5054B8" style="OLC"> <subsection id="H1B1B140089A94BDF998DA07ACB9BD2D2"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">Acknowledging the right of birthright citizenship established by section 1 of the 14th amendment to the Constitution, a person born in the United States shall be considered ‘subject to the jurisdiction’ of the United States for purposes of subsection (a)(1) if the person is born in the United States of parents, one of whom is—</text> 
<paragraph id="H143B30EBBC3246258EC2AC14A1969D09"><enum>(1)</enum><text>a citizen or national of the United States;</text></paragraph> <paragraph id="HBBC8B5226EA049829C66958AB16F905B"><enum>(2)</enum><text>an alien lawfully admitted for permanent residence in the United States whose residence is in the United States; or</text></paragraph> 
<paragraph id="HF3963FFD0C3B422CAB3997EA75DEAF34"><enum>(3)</enum><text>an alien performing active service in the armed forces (as defined in section 101 of title 10, United States Code).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HA4500104D37E4500A3555629798733F8"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a)(3) shall not be construed to affect the citizenship or nationality status of any person born before the date of the enactment of this Act.</text></subsection></section>
