<legis-type>AN ACT</legis-type> 
<official-title display="yes">To extend authorization for the September 11th Victim Compensation Fund of 2001 through fiscal year 2092, and for other purposes.</official-title>

<section id="H501FE23466484AEFAB87B6AB229FF848" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act</short-title></quote>.</text></section> <section id="H69E4F975FFFF4AB4816A882C3256D1FF"><enum>2.</enum><header>September 11th Victim Compensation Fund of 2001</header> <subsection id="H9CCBBC5DCAC845E58284900338668A11"><enum>(a)</enum><header>Authorization and funding</header><text>Section 410 of the Air Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended—</text> 
<paragraph id="H33FA4E7F9C0F44BA9C34B1C72E417296"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>$4,600,000,000</quote> and all that follows through <quote>expended</quote> and inserting <quote>such sums as may be necessary for fiscal year 2019 and each fiscal year thereafter through fiscal year 2092, to remain available until expended</quote>; and</text></paragraph> <paragraph id="H9B891A4B95DA42AA82050093AAF22743"><enum>(2)</enum><text>in subsection (e), by striking <quote>Upon completion of all payments under this title</quote> and inserting <quote>On October 1, 2092, or at such time thereafter as all funds are expended</quote>.</text></paragraph></subsection> 
<subsection id="H4699449E464A4CF08873CA2AD2E23B3E"><enum>(b)</enum><header>Extension of limitation on claim filing</header><text>Section 405(a)(3)(B) of the Air Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/40/401010">40 U.S.C. 401010</external-xref> note) is amended by striking <quote>the date that is 5 years after the date of enactment of the James Zadroga 9/11 Victim Compensation Fund Reauthorization Act</quote> and inserting <quote>October 1, 2090</quote>.</text></subsection> <subsection id="HA340FA10435240E1951EB3160241B248"><enum>(c)</enum><header>Compensation reduced by Special Master due to lack of funding</header><text>Section 406(d)(2) of the Air Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended by adding at the end the following:</text>

<subparagraph id="HBCE325337E0D4434871A8EBC99AAAAC4"><enum>(D)</enum><header>Compensation reduced by Special Master due to insufficient funding</header> 
<clause id="H2D2D4F60AD0448A89AF244B115BE694E"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In any claim in Group B as described in section 405(a)(3)(C)(iii) in which, prior to the enactment of the <short-title>Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act</short-title>, the Special Master had advised the claimant that the amount of compensation has been reduced on the basis of insufficient funding, the Special Master shall, in the first fiscal year beginning after sufficient funding becomes available under such Act, pay to the claimant an amount that is, as determined by the Special Master, equal to the difference between—</text> <subclause id="H6AE76E79971E494D9E8E2C40E4FF1D60"><enum>(I)</enum><text>the amount the claimant would have been paid under this title if sufficient funding was available to the Special Master at the time the Special Master determined the amount due the claimant under this title; and</text></subclause> 
<subclause id="H00B4929856B54A518BA475560FD35D69"><enum>(II)</enum><text>the amount the claimant was paid under this title.</text></subclause></clause> <clause commented="no" id="H9B377262C68F41DEAFE64AC9C755A8B7"><enum>(ii)</enum><header>Definitions</header><text>For purposes of this subparagraph:</text> 
<subclause commented="no" id="H020F9F4C11944BB2AB424D6D0ECF3805"><enum>(I)</enum><header>Insufficient funding</header><text>The term <term>insufficient funding</term> means funding—</text> <item commented="no" id="HFF13175FD4EE4FD8A6CF5B9157CD0926"><enum>(aa)</enum><text>that is available to the Special Master under section 410(c) on the day before the date of enactment of the <short-title>Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act</short-title> for purposes of compensating claims in Group B as described in section 405(a)(3)(C)(iii); and</text></item> 
<item commented="no" id="H1DF14B52164C4C6A8897D59B38CCD31B"><enum>(bb)</enum><text>that the Special Master determines is insufficient for purposes of compensating all such claims and complying with subparagraph (A).</text></item></subclause> <subclause commented="no" id="HD167D779D239464789D112666204D356"><enum>(II)</enum><header>Sufficient funding</header><text>The term <term>sufficient funding</term> means funding—</text> 
<item commented="no" id="H6E3BDCDF5A82447F9ADFEF519A4E1ADF"><enum>(aa)</enum><text>made available to the Special Master for purposes of compensating claims in Group B as described in section 405(a)(3)(C)(iii) through an Act of Congress that is enacted after the date on which the amount of the claim described in clause (i) has been reduced; and</text></item> <item commented="no" id="H35EC190D0D37405ABC33320BCB8CFBE2"><enum>(bb)</enum><text>that the Special Master determines is sufficient for purposes of compensating all claims in such Group B.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3D3FBA16D7C64C67B00FF78993F32578"><enum>(d)</enum><header>Limitations on noneconomic loss</header><text>Section 405(b)(7)(A) of the of the Air Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended—</text> <paragraph id="H393F87DC57B748FDB9B432691FB81955"><enum>(1)</enum><text>by redesignating clauses (i) and (ii) as subclauses (I) and (II) respectively, and adjusting the margins accordingly;</text></paragraph> 
<paragraph id="H80296531F94B4C12BACB0235AB9CC59E"><enum>(2)</enum><text>by striking <quote>With respect to</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H55CA1FC5A7754F75AEFC25FBD060A21F" style="OLC"> <clause id="H1D6EEB58E3C94BAEBE730CAA11667863"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), with respect to</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC19AA179448A40DD986BADE026A8EEC4"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="H1AB3E2C640304AFCA0520E91F51965D6" style="OLC"> <clause id="H3B48D2BE3E2E4003AE0CEF6698034855"><enum>(ii)</enum><header>Exception</header><text>The Special Master may exceed the applicable limitation in clause (i) for a claim in Group B as described in subsection (a)(3)(C)(iii) if the Special Master determines that the claim presents special circumstances.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA0E6570E9F4C4FC2BE731A2070FDF1FA"><enum>(e)</enum><header>Adjustment of annual gross income limitation</header><text>Section 405(b)(7)(B)(ii) of the Air Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/40/40101">40 U.S.C. 40101</external-xref> note) is amended by striking <quote>$200,000.</quote> and inserting <quote>the annual gross income limitation. The annual gross income limitation in effect on the date of enactment of the <short-title>Never Forget the Heroes: James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act</short-title> is $200,000. The Special Master shall periodically adjust that annual gross income limitation to account for inflation.</quote>.</text></subsection></section> <section id="H951E5F64E42D450FA68E07614FD2A733"><enum>3.</enum><header>Appointment of special master and deputy special masters</header><text display-inline="no-display-inline">Section 404 of the Air Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended—</text> 
<paragraph id="H4FC360CABEF84D64A66471252DC57DE1"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph> <paragraph id="H15D22B36932B49F194E9F74874A7C4AB"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text> 
<quoted-block style="OLC" id="H61684DDC9136424DBF09432F37C06DDB" display-inline="no-display-inline"> 
<subsection id="H61FFF0C9F628489897BB585A76A9189D"><enum>(b)</enum><header>Appointment of Special Master and Deputy Special Masters</header><text display-inline="yes-display-inline">The Attorney General may appoint a Special Master and no more than two Deputy Special Masters without regard to the provisions of title 5, United States Code, governing appointments in the competitive service. Any such employee shall serve at the pleasure of the Attorney General. The Attorney General shall fix the annual salary of the Special Master and the Deputy Special Masters.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H978D97BDF55A493FB0017D7CA0F683B3"><enum>4.</enum><header>Budgetary effects</header> <subsection id="HCEAFB300ED2443C993F9AFE1A669C12E"><enum>(a)</enum><header>Statutory PAYGO scorecards</header><text>The budgetary effects of this Act shall not be entered on either PAYGO scorecard maintained pursuant to section 4(d) of the Statutory Pay-As-You-Go Act of 2010.</text></subsection> 
<subsection id="H6C1CDD9A799D4F86B54DA133E2EF57FE"><enum>(b)</enum><header>Senate PAYGO scorecards</header><text>The budgetary effects of this Act shall not be entered on any PAYGO scorecard maintained for purposes of section 4106 of House Concurrent Resolution 71 (115th Congress).</text></subsection></section> </legis-body> <attestation><attestation-group><role>Speaker of the House of Representatives.</role></attestation-group><attestation-group><role>Vice President of the United States and President of the Senate.</role></attestation-group></attestation> </bill>
