Representatives (H.R. 1044) entitled <quote>An Act to amend the Immigration and Nationality Act to eliminate the per-country numerical limitation for employment-based immigrants, to increase the per-country numerical limitation for family-sponsored immigrants, and for other purposes.</quote>, do pass with the following</text></section><amendment><amendment-instruction blank-lines-after="0"><text>Strike all after the enacting clause and insert the following:</text></amendment-instruction><amendment-block blank-lines-after="3" changed="added" reported-display-style="italic"><section id="H00F6B9ED63B143DE943BC28172537A21" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness for High-Skilled Immigrants Act of 2020</short-title></quote>.</text></section><section id="H328A06EE6AB74ABE8F4D26466A6E1A19"><enum>2.</enum><header>Numerical limitation to any single foreign state</header><subsection id="HE5737B6B569A4417B95FFD0194E11C5B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152(a)(2)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="idE614D7BE5BF24B27AE62708E05FD74B5" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="IDB26297BCDCD245F098D871974432898A"><enum>(2)</enum><header display-inline="yes-display-inline">Per country levels for family-sponsored immigrants</header><text display-inline="yes-display-inline">Subject to paragraphs (3) and (4), the total number of immigrant visas made available to natives of any single foreign state or dependent area under section 203(a) in any fiscal year may not exceed 15 percent (in the case of a single foreign state) or 2 percent (in the case of a dependent area) of the total number of such visas made available under such section in that fiscal year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9D9192DD8F4C48E9B43C4DD505749E6C"><enum>(b)</enum><header>Conforming amendments</header><text>Section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152</external-xref>) is amended—</text><paragraph id="H352C92586FFF439AAD05ED1057D3892D"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id9901237E75DF44C790C1D7A710A47C61"><enum>(A)</enum><text>in paragraph (3), by striking <quote>both subsections (a) and (b) of section 203</quote> and inserting <quote>section 203(a)</quote>; and</text></subparagraph><subparagraph id="H362BF84DB9AF4ADAA08A8D7CD29C8229"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (5); and</text></subparagraph></paragraph><paragraph id="H53CE22510D6C4C7291D2741CB78731A5"><enum>(2)</enum><text>by amending subsection (e) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H46D7DFDC006C430FB649199525A71E47" style="OLC"><subsection id="HA6BFB88626C749D1B614A0383AD59BBB"><enum>(e)</enum><header>Special rules for countries at ceiling</header><text display-inline="yes-display-inline">If the total number of immigrant visas made available under section 203(a) to natives of any single foreign state or dependent area will exceed the numerical limitation specified in subsection (a)(2) in any fiscal year, immigrant visas shall be allotted to such natives under section 203(a) (to the extent practicable and otherwise consistent with this section and section 203) in a manner so that, except as provided in subsection (a)(4), the proportion of the visas made available under each of paragraphs (1) through (4) of section 203(a) is equal to the ratio of the total visas made available under the respective paragraph to the total visas made available under section 203(a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB124E09CD81C4E5892FF6AF013B81E68"><enum>(c)</enum><header>Country-specific offset</header><text display-inline="yes-display-inline">Section 2 of the Chinese Student Protection Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref> note) is amended—</text><paragraph id="HC8B1B885E7A9403280F33A7C26C1AA0E"><enum>(1)</enum><text>in subsection (a), by striking <quote>(as defined in subsection (e))</quote>;</text></paragraph><paragraph id="HD3281C761F4B4EB1B7EC7E2212A00284"><enum>(2)</enum><text>by striking subsection (d); and</text></paragraph><paragraph id="id0A5239FE73D64A4BA4A672A5018F451B"><enum>(3)</enum><text>by redesignating subsection (e) as subsection (d).</text></paragraph></subsection><subsection id="id1a0d0cc5e2dd432b91bc0359f0065c3b"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the second fiscal year beginning after the date of enactment of this Act, and shall apply to that fiscal year and each subsequent fiscal year. </text></subsection><subsection id="H95A77ECCC18F47648B1AEDD040422507"><enum>(e)</enum><header>Transition rules for employment-based immigrants</header><paragraph id="H3DF96AB5702245DDAD4EC24EE37A342B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraphs (2) through (4), and notwithstanding title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref> et seq.), the following rules shall apply:</text><subparagraph id="id63d94ca72d144c70a3c224181b2eff27"><enum>(A)</enum><text>During the first nine fiscal years after the effective date, certain visas will be reserved within the immigrant visas made available under each of paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>).</text></subparagraph><subparagraph id="ide37d7e55459047ee904601fab8441167"><enum>(B)</enum><text>With regard to immigrant visas made available under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) for the first nine fiscal years after the effective date, visas will be reserved for immigrants native to countries other than the two states with the largest aggregate number of natives who are beneficiaries of approved but backlogged petitions for immigrant status under section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>), as follows:</text><clause id="ideddeed5c8faf434dbdae64f6cd5998f4"><enum>(i)</enum><text>For the first fiscal year after the effective date, 30 percent of the immigrant visas made available under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) shall be allotted to immigrants who are natives of a foreign state or dependent area that is not one of the two states with the largest aggregate numbers of natives waiting for immigrant status. </text></clause><clause id="id2447aa8838554f3eaa6aec8c16df07c0"><enum>(ii)</enum><text>For the second fiscal year after the effective date, 25 percent of the immigrant visas made available under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) shall be allotted to immigrants who are natives of a foreign state or dependent area that is not one of the two states with the largest aggregate numbers of natives waiting for immigrant status.</text></clause><clause id="id62a9f8c064ce49d7a9fb76e7131f5240"><enum>(iii)</enum><text>For the third fiscal year after the effective date, 20 percent of the immigrant visas made available under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) shall be allotted to immigrants who are natives of a foreign state or dependent area that is not one of the two states with the largest aggregate numbers of natives waiting for immigrant status.</text></clause><clause id="id705461b6d3934c178aa60761d2b48b93"><enum>(iv)</enum><text>For the fourth fiscal year after the effective date, 15 percent of the immigrant visas made available under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) shall be allotted to immigrants who are natives of a foreign state or dependent area that is not one of the two states with the largest aggregate numbers of natives waiting for immigrant status.</text></clause><clause id="id4a67a5bc808844a8aff834f30462d30b"><enum>(v)</enum><text>For the fifth and sixth fiscal years after the effective date, 10 percent of the immigrant visas made available under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) shall be allotted to immigrants who are natives of a foreign state or dependent area that is not one of the two states with the largest aggregate numbers of natives waiting for immigrant status.</text></clause><clause id="idad13faff26d34d9fa153d9912b182f25"><enum>(vi)</enum><text>For the seventh, eighth, and ninth fiscal years after the effective date, 5 percent of the immigrant visas made available under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) shall be allotted to immigrants who are natives of a foreign state or dependent area that is not one of the two states with the largest aggregate numbers of natives waiting for immigrant status. </text></clause></subparagraph><subparagraph id="ida7568abe8658470594ca56e14d6c9414"><enum>(C)</enum><text>5.75 percent of the immigrant visas made available under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) shall be reserved annually for the first nine fiscal years after the effective date for immigrants who are native to countries other than the two states with the largest aggregate number of natives who are beneficiaries of approved but backlogged petitions for immigrant status under such section. Such visas will be made available by the following priority ordering:</text><clause id="id1a0f96c02e5f4f2486866cd92751860e"><enum>(i)</enum><text>Derivative dependents described in section 203(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(d)</external-xref>) who seek to join a principal beneficiary of a petition for an immigrant visa under paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>).</text></clause><clause id="idfc91d5811b444e5b95739e9fc0f49a6a"><enum>(ii)</enum><text>Immigrants who seek to enter the United States as new arrivals and who have not resided or worked in the United States at any point in the four-year period immediately preceding the filing of their petition for an immigrant visa under section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>).</text></clause><clause id="id515c8602543a4d07a2493a07c605bab7"><enum>(iii)</enum><text>Other immigrants who meet the criteria of this subparagraph. </text></clause></subparagraph><subparagraph id="ide0dbf120548f43f0af18e22a10bcbbc3"><enum>(D)</enum><text>The two states with the largest aggregate numbers of natives who are beneficiaries of approved petitions referred to in subparagraphs (B) and (C) are the two states with the largest aggregate number of approved cases awaiting visa number availability for immigrant visas under section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>), as identified by adding the numbers associated with aliens awaiting employment-based immigrant status in the most recent and available Count Of Approved Employment-Based Immigrant Petitions With Priority Dates On Or After the State Department’s Visa Bulletin from the Department of Homeland Security and such numbers in the most recent Annual Report of Immigrant Visa Applicants in the Employment-Based Preferences Registered at the National Visa Center from the Department of State (or successor publications).</text></subparagraph><subparagraph id="idfba4b22f783f48b286c28a59a741b12b"><enum>(E)</enum><text>Notwithstanding subparagraphs (A) through (D), for each of the seven fiscal years after the effective date, not fewer than 4,400 of the immigrant visas made available under paragraph (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) and not reserved by subparagraphs (B) and (C) shall be allotted to immigrants who are described in section 656.5(a) of title 20, Code of Federal Regulations (or a successor regulation) and are seeking admission to the United States to work in an occupation described in that section.</text></subparagraph><subparagraph id="id07db879c0e7e42198633e6a54d8c053b"><enum>(F)</enum><text>Family members described in section 203(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(d)</external-xref>) who are accompanying or following to join a principal beneficiary seeking admission under subparagraph (E) shall be entitled to an unreserved visa in the same status and in the same order of consideration as such principal beneficiary, but shall not be counted against the 4,400 immigrant visas allotted under that subparagraph. </text></subparagraph></paragraph><paragraph id="HED46C3AA89684EAB82671264AAA96978"><enum>(2)</enum><header>Per-country levels</header><subparagraph id="H0B20A7CAA4954D1F8A5A86CC477B5119"><enum>(A)</enum><header>Reserved visas</header><text display-inline="yes-display-inline">The number of visas reserved under each of clauses (i) through (iv) of paragraph (1)(B) and each of clauses (i) through (iii) of paragraph (1)(C) made available to natives of any single foreign state or dependent area in the appropriate fiscal year may not exceed 25 percent (in the case of a single foreign state) or 2 percent (in the case of a dependent area) of the total number of such visas.</text></subparagraph><subparagraph id="HFEA8FD86A3CF45D1BEC42B6986BA1B88"><enum>(B)</enum><header>Unreserved visas</header><text display-inline="yes-display-inline">Not more than 85 percent of the immigrant visas made available under each of paragraphs (2) and (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) and not reserved under paragraph (1), for each of the first nine fiscal years after the effective date, may be allotted to immigrants who are natives of any single foreign state.</text></subparagraph></paragraph><paragraph id="H20AD0AEF114640F98A1C93D35870C03C"><enum>(3)</enum><header>Special rule to prevent unused visas</header><text display-inline="yes-display-inline">If, with respect to first nine fiscal years after the effective date, the application of paragraphs (1) and (2) would prevent the total number of immigrant visas made available under paragraph (2) or (3) of section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) from being issued, such visas may be issued during the remainder of such fiscal year without regard to paragraphs (1) and (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2C6788167D2F4B2EB01766BE24EB5A53"><enum>(4)</enum><header>Rules for chargeability and dependents</header><text display-inline="yes-display-inline">Section 202(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152(b)</external-xref>) shall apply in determining the foreign state to which an alien is chargeable, and section 203(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(d)</external-xref>) shall apply in allocating immigrant visas to dependents, for purposes of this subsection.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idFABE587DFB9444E5B028367105957FBC"><enum>(5)</enum><header>Effective date defined</header><text>In this subsection, the term <term>effective date</term> means the first day of the second fiscal year beginning after the date of enactment of this Act.</text></paragraph></subsection></section><section id="idF7F6FE2F1FAD464E9AFE624A3C93AFF1"><enum>3.</enum><header>Posting available positions through the Department of Labor</header><subsection id="id379bb31a97cf4e98828f57b971c517d7"><enum>(a)</enum><header>Department of Labor website</header><text>Section 212(n) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idec304bfb1c6546fa9a883dfea889d32a" style="OLC"><paragraph id="id38068cc32df5440e8c9842414cb6ac31"><enum>(6)</enum><text>For purposes of complying with paragraph (1)(C)—</text><subparagraph id="idab815eb52296403fbc59c24feb1a3b64"><enum>(A)</enum><text>Not later than 180 days after the date of the enactment of the <short-title>Fairness for High-Skilled Immigrants Act of 2020</short-title>, the Secretary of Labor shall establish a searchable internet website for posting positions in accordance with paragraph (1)(C) that is available to the public without charge, except that the Secretary may delay the launch of such website for a single period identified by the Secretary by notice in the Federal Register that shall not exceed 30 days.</text></subparagraph><subparagraph id="ided5f59e263154832a2f7e71b845d19c6"><enum>(B)</enum><text>The Secretary may work with private companies or nonprofit organizations to develop and operate the internet website described in subparagraph (A).</text></subparagraph><subparagraph id="id1fcb8317ab0b4b7aa209c07ca56a8e06"><enum>(C)</enum><text>The Secretary shall promulgate rules, after notice and a period for comment, to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idddeb198c963f4765b801077f7ea038fb"><enum>(b)</enum><header>Publication requirement</header><text>The Secretary of Labor shall submit to Congress, and publish in the Federal Register and in other appropriate media, a notice of the date on which the internet website required under section 212(n)(6) of the Immigration and Nationality Act, as established by subsection (a), will be operational.</text></subsection><subsection id="idf337ac37f30549bcbe360e74a2c01faf"><enum>(c)</enum><header>Application</header><text>The amendment made by subsection (a) shall apply to any application filed on or after the date that is 90 days after the date described in subsection (b).</text></subsection><subsection id="ide20e7168dcb64aa4895523f2c8ecabb2"><enum>(d)</enum><header>Internet posting requirement</header><text>Section 212(n)(1)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)(C)</external-xref>) is amended—</text><paragraph id="id362e4a06740d459e86337a9fd626fdbc"><enum>(1)</enum><text>by redesignating clause (ii) as subclause (II);</text></paragraph><paragraph id="idcfaf59dd328449e9954073cbc0e231e7"><enum>(2)</enum><text>by striking <quote>(i) has provided</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id06e114a6409640e08ed515c26a8c4b32" style="OLC"><clause id="idae7d3023ff0a49ffa4e1d7939226251b"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id8D9F25F711534FB88B0D700C340622E2"><enum>(I)</enum><text>has provided</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idcdf0570aa1dc46ca92da93ff9b7f019e"><enum>(3)</enum><text>by inserting before clause (ii), as redesignated by paragraph (2), the following:</text><quoted-block display-inline="no-display-inline" id="id5d4ffb4fb8cc4e47ace0450b292f3019" style="OLC"><clause id="id404ed6781fc341a5aaf3c5a336283e11"><enum>(i)</enum><text>except in the case of an employer filing a petition on behalf of an H–1B nonimmigrant who has already been counted against the numerical limitations and is not eligible for a full 6-year period, as described in section 214(g)(7), or on behalf of an H–1B nonimmigrant authorized to accept employment under section 214(n), has posted on the internet website described in paragraph (6), for at least 30 calendar days, a description of each position for which a nonimmigrant is sought, that includes—</text><subclause id="id231a007997084a6eafcfd28a1e98da9d"><enum>(I)</enum><text>the occupational classification, and if different the employer’s job title for the position, in which the nonimmigrant(s) will be employed;</text></subclause><subclause id="id17DC783E5557486A920D335E29D83AAE"><enum>(II)</enum><text>the education, training, or experience qualifications for the position;</text></subclause><subclause id="id17f1f5dc5b294bcf8510a83ddf3d2676"><enum>(III)</enum><text>the salary or wage range and employee benefits offered;</text></subclause><subclause id="id5191aab596b842efb2c3e46a8a938944"><enum>(IV)</enum><text>the location(s) at which the nonimmigrant(s) will be employed; and</text></subclause><subclause id="idfbb22daf5652435590c23afaa83cf801"><enum>(V)</enum><text>the process for applying for a position; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idCA165DCF56074448BDC54BD3E0EAE56D"><enum>4.</enum><header>H–1B employer petition requirements</header><subsection commented="no" display-inline="no-display-inline" id="id8b73a2bd3cc54ab9a69f067aa8e4c677"><enum>(a)</enum><header display-inline="yes-display-inline">Wage determination information</header><text display-inline="yes-display-inline">Section 212(n)(1)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)(D)</external-xref>) is amended by inserting <quote>the prevailing wage determination methodology used under subparagraph (A)(i)(II),</quote> after <quote>shall contain</quote>.</text></subsection><subsection id="id21afdb3567e54d81b239c60365569c85"><enum>(b)</enum><header>New application requirements</header><text display-inline="yes-display-inline">Section 212(n)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)</external-xref>) is amended by inserting after subparagraph (G)(ii) the following:</text><quoted-block display-inline="no-display-inline" id="id432d1cb9f7254df9abbbb041fabddd24" style="OLC"><subparagraph id="ide6d85f36c5924091b8111fab32599711" indent="up1"><enum>(H)</enum><clause commented="no" display-inline="yes-display-inline" id="id451E8788654B4735A31DD1E57DF01736"><enum>(i)</enum><text>The employer, or a person or entity acting on the employer’s behalf, has not advertised any available position specified in the application in an advertisement that states or indicates that—</text><subclause id="idf96f76f228e846389ba47eacbf0d8dca" indent="up1"><enum>(I)</enum><text>such position is only available to an individual who is or will be an H–1B nonimmigrant; or</text></subclause><subclause id="id1cdffede48314eea9e603c3076988d1f" indent="up1"><enum>(II)</enum><text>an individual who is or will be an H–1B nonimmigrant shall receive priority or a preference in the hiring process for such position.</text></subclause></clause><clause id="id3364836044784b9cb58ea1e6680a78a7" indent="up1"><enum>(ii)</enum><text>The employer has not primarily recruited individuals who are or who will be H–1B nonimmigrants to fill such position.</text></clause></subparagraph><subparagraph id="id131749c42c614e92ab2746ff6b4fc9c5" indent="up1"><enum>(I)</enum><text>If the employer, in a previous period specified by the Secretary, employed one or more H–1B nonimmigrants, the employer shall submit to the Secretary the Internal Revenue Service Form W–2 Wage and Tax Statements filed by the employer with respect to the H–1B nonimmigrants for such period.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id347033A4F1024F9FA3B221786616D607"><enum>(c)</enum><header>Additional requirement for new H–1B petitions</header><paragraph id="id36779F34102C402589F3934A9766EEF6"><enum>(1)</enum><header>In general</header><text>Section 212(n)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)</external-xref>), as amended by subsection (b), is further amended by inserting after subparagraph (I), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAD3CEB6B3650454794F7C1745F255B8C"><subparagraph id="id582b2cbdd8fd46b7b057724e80d2f162" indent="up1"><enum>(J)</enum><clause commented="no" display-inline="yes-display-inline" id="idba4d000a20fd4625a253f6277d7e17b0"><enum>(i)</enum><text>If the employer employs 50 or more employees in the United States, the sum of the number of such employees who are H–1B nonimmigrants plus the number of such employees who are nonimmigrants described in section 101(a)(15)(L) does not exceed 50 percent of the total number of employees.</text></clause><clause id="id5d09f3e49d4040d8abe4d8a503351517" indent="up1"><enum>(ii)</enum><text>Any group treated as a single employer under subsection (b), (c), (m), or (o) of <external-xref legal-doc="usc" parsable-cite="usc/26/414">section 414</external-xref> of the Internal Revenue Code of 1986 shall be treated as a single employer for purposes of clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id7AB994972B064769B50FEC7BCD5E23FA"><enum>(2)</enum><header>Rule of Construction</header><text>Nothing in subparagraph (J) of section 212(n)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)</external-xref>), as added by paragraph (1), may be construed to prohibit renewal applications or change of employer applications for H–1B nonimmigrants employed by an employer on the date of enactment of this Act.</text></paragraph><paragraph id="idDF23A30AA78E434C8FD7E4C7792483D0"><enum>(3)</enum><header>Effective date</header><text>The amendment made by this subsection shall take effect on the date that is 180 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="id4EC316470C7B4BEF97D6064B0F98578A"><enum>(d)</enum><header>Labor condition application fee</header><text>Section 212(n) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)</external-xref>), as amended by section 3(a), is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id74A43EAE5008403A99C4133F8BDF0010" style="OLC"><paragraph id="id2387258ffb7f4495bbaef73aedd254c7" indent="up1"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idFD488471521E4F92AE95D16EB02289B0"><enum>(A)</enum><text>The Secretary of Labor shall promulgate a regulation that requires applicants under this subsection to pay an administrative fee to cover the average paperwork processing costs and other administrative costs.</text></subparagraph><subparagraph id="id9E4EE55EB86C40E993DE191637699A62" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idBD912D86171641CC98ED229339E36EF4"><enum>(i)</enum><text>Fees collected under this paragraph shall be deposited as offsetting receipts within the general fund of the Treasury in a separate account, which shall be known as the <quote>H–1B Administration, Oversight, Investigation, and Enforcement Account</quote> and shall remain available until expended.</text></clause><clause id="idE4A5281A4EB448DC8D59BE82AFB2AB0F" indent="up1"><enum>(ii)</enum><text>The Secretary of the Treasury shall refund amounts in such account to the Secretary of Labor for salaries and related expenses associated with the administration, oversight, investigation, and enforcement of the H–1B nonimmigrant visa program.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1842E275C4E64564A7E2BF065CC42AFD"><enum>(e)</enum><header>Elimination of B–1 in lieu of H–1</header><text>Section 214(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id9FF1A4783B7C44898FCC7169D13AD8A3" style="OLC"><paragraph id="idBB4722B5404F4ACBBF2EE0FA6E2491AD" indent="up1"><enum>(12)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id34792EEAF14C483BABFA6D0FDE8DD623"><enum>(A)</enum><text display-inline="yes-display-inline">Unless otherwise authorized by law, an alien normally classifiable under section 101(a)(15)(H)(i) who seeks admission to the United States to provide services in a specialty occupation described in paragraph (1) or (3) of subsection (i) may not be issued a visa or admitted under section 101(a)(15)(B) for such purpose.</text></subparagraph><subparagraph id="idAB15E7DAF3114C7498D25A51292D802C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Nothing in this paragraph may be construed to authorize the admission of an alien under section 101(a)(15)(B) who is coming to the United States for the purpose of performing skilled or unskilled labor if such admission is not otherwise authorized by law.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id13163F6DC74B4781B4BE1A3C3F560080"><enum>5.</enum><header>Investigation and disposition of complaints against H–1B employers</header><subsection id="id7aa60732835748d68c614d76410d3deb"><enum>(a)</enum><header>Investigation, working conditions, and penalties</header><text display-inline="yes-display-inline">Section 212(n)(2)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)(C)</external-xref>) is amended by striking clause (iv) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id46ddec864c064a499547fbb8d965283e" style="OLC"><clause id="idfdd70ea8d2e94f4b93537fa043621954" indent="up3"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="id9CD49687258144DBB7256BA9D6F858D4"><enum>(I)</enum><text>An employer that has filed an application under this subsection violates this clause by taking, failing to take, or threatening to take or fail to take a personnel action, or intimidating, threatening, restraining, coercing, blacklisting, discharging, or discriminating in any other manner against an employee because the employee—</text><item id="id3CCC9AD5C54440C9A2743F5DAB914F5D" indent="up1"><enum>(aa)</enum><text>disclosed information that the employee reasonably believes evidences a violation of this subsection or any rule or regulation pertaining to this subsection; or</text></item><item id="idFDD792796C8F4AF4B29C62F10C4A4413" indent="up1"><enum>(bb)</enum><text>cooperated or sought to cooperate with the requirements under this subsection or any rule or regulation pertaining to this subsection.</text></item></subclause><subclause id="idAA18E4B8C063475DB7A2252C4A618A99" indent="up1"><enum>(II)</enum><text>An employer that violates this clause shall be liable to the employee harmed by such violation for lost wages and benefits.</text></subclause><subclause id="id30D7212C5D9A4CC2A4636E7EAF279091" indent="up1"><enum>(III)</enum><text>In this clause, the term <term>employee</term> includes—</text><item id="id80AB2E8E96ED4F3A85B1A108E980BEC3"><enum>(aa)</enum><text>a current employee;</text></item><item id="id257220CB2841420194D1934F5584B0CC"><enum>(bb)</enum><text>a former employee; and</text></item><item id="id539BCD90D3274C66875E9A3C454DB050"><enum>(cc)</enum><text>an applicant for employment.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id36E41CC1DF484BC1A88F87F6789614BE"><enum>(b)</enum><header>Information sharing</header><text display-inline="yes-display-inline">Section 212(n)(2)(H) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)(H)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="id122c1c34fbbb405fb15f158595d6f51d" style="OLC"><subparagraph id="id1bd0df13770345ff923fe934cbe876f9" indent="up2"><enum>(H)</enum><clause commented="no" display-inline="yes-display-inline" id="id40D906A626CE4E26A306C4DBE7D28A92"><enum>(i)</enum><text>The Director of U.S. Citizenship and Immigration Services shall provide the Secretary of Labor with any information contained in the materials submitted by employers of H–1B nonimmigrants as part of the petition adjudication process that indicates that the employer is not complying with visa program requirements for H–1B nonimmigrants.</text></clause><clause id="id5582BCD688034C4C86DE3F80A0B7A305" indent="up1"><enum>(ii)</enum><text>The Secretary may initiate and conduct an investigation and hearing under this paragraph after receiving information of noncompliance under this subparagraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id72f83b6d07114d2084465c3138f37a5e"><enum>6.</enum><header>Labor condition applications</header><subsection id="idc4fc5ae8661647e7a0ef88d0989d850a"><enum>(a)</enum><header>Application review requirements</header><text>Section 212(n)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)</external-xref>) is amended, in the undesignated matter following subparagraph (I), as added by section 4(b)—</text><paragraph id="id3cbc61ef0a684196b802320b0c84d0e3"><enum>(1)</enum><text>in the fourth sentence, by inserting <quote>, and through the internet website of the Department of Labor, without charge.</quote> after <quote>Washington, D.C.</quote>;</text></paragraph><paragraph id="ida5d586a1632e441bb7ecc9f2a06659c6"><enum>(2)</enum><text>in the fifth sentence, by striking <quote>only for completeness</quote> and inserting <quote>for completeness, clear indicators of fraud or misrepresentation of material fact,</quote>;</text></paragraph><paragraph id="id2657a9cbf78b4c2e972c9716b3f3ff37"><enum>(3)</enum><text>in the sixth sentence, by striking <quote>or obviously inaccurate</quote> and inserting <quote>, presents clear indicators of fraud or misrepresentation of material fact, or is obviously inaccurate</quote>; and</text></paragraph><paragraph id="id3ce5fb04a5a2476fa22a1fcbe32ada06"><enum>(4)</enum><text>by adding at the end the following: <quote>If the Secretary’s review of an application identifies clear indicators of fraud or misrepresentation of material fact, the Secretary may conduct an investigation and hearing in accordance with paragraph (2).</quote>.</text></paragraph></subsection><subsection id="idb556236191d54a368aaf99112d5f1e46"><enum>(b)</enum><header>Ensuring prevailing wages are for area of employment and actual wages are for similarly employed</header><text>Section 212(n)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)(A)</external-xref>) is amended—</text><paragraph id="idBA4A6A43BB54441ABB64BC985B2CD56E"><enum>(1)</enum><text>in clause (i), in the undesignated matter following subclause (II), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="idC896D9C365B74C2FAC832EF3B965B412"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>, and</quote>; and</text></paragraph><paragraph id="id857F5EB6D0DF4CBCA9E7B31168710A80"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id189C9F5564464A48B0C5D0398673F71B" style="OLC"><clause id="id071609A7AC7C42B88E7A648DF30EE72E"><enum>(iii)</enum><text>will ensure that—</text><subclause id="id09aaa800f3e34055aff1e0c863345f42"><enum>(I)</enum><text>the actual wages or range identified in clause (i) relate solely to employees having substantially the same duties and responsibilities as the H–1B nonimmigrant in the geographical area of intended employment, considering experience, qualifications, education, job responsibility and function, specialized knowledge, and other legitimate business factors, except in a geographical area there are no such employees, and</text></subclause><subclause id="id9f59d89de3aa4046be93448d28d80ba9"><enum>(II)</enum><text>the prevailing wages identified in clause (ii) reflect the best available information for the geographical area within normal commuting distance of the actual address of employment at which the H–1B nonimmigrant is or will be employed.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0cff44b648e243f1b9cbd6810f7e9250"><enum>(c)</enum><header>Procedures for investigation and disposition</header><text>Section 212(n)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)(A)</external-xref>) is amended—</text><paragraph id="id686f1427ee4d40b9a77df573fd043121"><enum>(1)</enum><text>by striking <quote>(2)(A) Subject</quote> and inserting <quote>(2)(A)(i) Subject</quote>;</text></paragraph><paragraph id="idb7289e4c1e4142ec8df4315ecbe9a7e6"><enum>(2)</enum><text>by striking the fourth sentence; and</text></paragraph><paragraph id="ide5c36786bbc94b1c8ee890d023dcba20"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id3D77431316B34C2D9FA00176B86B775E" style="OLC"><clause id="idbbe9a103ab1842758ec198c8f638c27f" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id33438A6D98524FAA87B3F60D259C93A5"><enum>(I)</enum><text>Upon receipt of a complaint under clause (i), the Secretary may initiate an investigation to determine whether such a failure or misrepresentation has occurred.</text></subclause><subclause id="idC0020F7E601044E9A4AC2C13F4408CCA" indent="up1"><enum>(II)</enum><text>The Secretary may conduct—</text><item id="idAB4F302401C1487EBE42954F268D2680"><enum>(aa)</enum><text>surveys of the degree to which employers comply with the requirements under this subsection; and</text></item><item id="idCEEE414C90994C5FBBB7F2B0958A99BE"><enum>(bb)</enum><text>subject to subclause (IV), annual compliance audits of any employer that employs H–1B nonimmigrants during the applicable calendar year.</text></item></subclause><subclause id="id1963D52818FB45E8B9D94ED826F2CC8C" indent="up1"><enum>(III)</enum><text>Subject to subclause (IV), the Secretary shall—</text><item id="idDECD839BEBFA4268BACEA49D2C4BD3C8"><enum>(aa)</enum><text>conduct annual compliance audits of each employer that employs more than 100 full-time equivalent employees who are employed in the United States if more than 15 percent of such full-time employees are H–1B nonimmigrants; and</text></item><item id="id482D3ACB6AA6404F8ED3B4379C6B6739"><enum>(bb)</enum><text>make available to the public an executive summary or report describing the general findings of the audits conducted under this subclause.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id43F70C7DBE7543C3B4308BCEA7500A14" indent="up1"><enum>(IV)</enum><text>In the case of an employer subject to an annual compliance audit in which there was no finding of a willful failure to meet a condition under subparagraph (C)(ii), no further annual compliance audit shall be conducted with respect to such employer for a period of not less than 4 years, absent evidence of misrepresentation or fraud.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idF27066DD79F64D8C94E7178328A82D5C"><enum>(d)</enum><header>Penalties for violations</header><text>Section 212(n)(2)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)(C)</external-xref>) is amended –</text><paragraph id="idb69a7c7444244f888498c7250c0f282a"><enum>(1)</enum><text>in clause (i)—</text><subparagraph id="id076e353806f740d88d638641497e2e21"><enum>(A)</enum><text>in the matter preceding subclause (I), by striking <quote>a condition of paragraph (1)(B), (1)(E), or (1)(F)</quote> and inserting <quote>a condition of paragraph (1)(B), (1)(E), (1)(F), (1)(H), or 1(I)</quote>; and</text></subparagraph><subparagraph id="idd02ba6139f854e6780d9b92472494a0a"><enum>(B)</enum><text>in subclause (I), by striking <quote>$1,000</quote> and inserting <quote>$3,000</quote>;</text></subparagraph></paragraph><paragraph id="id3a02e4a6be5c4d5ea7aa71b73765595e"><enum>(2)</enum><text>in clause (ii)(I), by striking <quote>$5,000</quote> and inserting <quote>$15,000</quote>;</text></paragraph><paragraph id="ida7e41be0e92d4af5827dbba1f0a5438f"><enum>(3)</enum><text>in clause (iii)(I), by striking <quote>$35,000</quote> and inserting <quote>$100,000</quote>; and</text></paragraph><paragraph id="id0447b826f24e41608e16912438c90853"><enum>(4)</enum><text>in clause (vi)(III), by striking <quote>$1,000</quote> and inserting <quote>$3,000</quote>.</text></paragraph></subsection><subsection id="idD47F8BE65E5C41EC9C1989BBACBCD867"><enum>(e)</enum><header>Initiation of investigations</header><text>Section 212(n)(2)(G) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)(G)</external-xref>) is amended—</text><paragraph id="idf144dffa009a4d31bf0b65dfa02c4de5"><enum>(1)</enum><text>in clause (i), by striking <quote>In the case of an investigation</quote> in the second sentence and all that follows through the period at the end of the clause;</text></paragraph><paragraph id="idcaafba6b1dca4964bbadaf7eca2d8ddc"><enum>(2)</enum><text>in clause (ii), in the first sentence, by striking <quote>and whose identity</quote> and all that follows through <quote>failure or failures.</quote> and inserting <quote>the Secretary of Labor may conduct an investigation into the employer’s compliance with the requirements under this subsection.</quote>;</text></paragraph><paragraph id="ida2b17a977dbf48a4939a546f9c866e6c"><enum>(3)</enum><text>in clause (iii), by striking the second sentence;</text></paragraph><paragraph id="id6f708cc942f147199541296bb2eebdc7"><enum>(4)</enum><text>by striking clauses (iv) and (v);</text></paragraph><paragraph id="id6f7b1b75494c411fbc5c34d31b19db1a"><enum>(5)</enum><text>by redesignating clauses (vi), (vii), and (viii) as clauses (iv), (v), and (vi), respectively;</text></paragraph><paragraph id="id9d0414a97f804454a4090e06a80cf0ef"><enum>(6)</enum><text>in clause (iv), as so redesignated—</text><subparagraph id="idABAA20701F644958B099BC6692ACA49C"><enum>(A)</enum><text>by striking<quote>clause (viii)</quote> and inserting <quote>clause (vi)</quote>; and</text></subparagraph><subparagraph id="idBF420F2EB41D4592B11A3C7079C780BA"><enum>(B)</enum><text>by striking <quote>meet a condition described in clause (ii)</quote> and inserting <quote>comply with the requirements under this subsection</quote>;</text></subparagraph></paragraph><paragraph id="idffd46621821a4a8d8626005d936359e5"><enum>(7)</enum><text>by amending clause (v), as so redesignated, to read as follows:</text><quoted-block display-inline="no-display-inline" id="id0d03d5952b0a4bdea312521f1821b8e0" style="OLC"><clause id="idd525892a983c44c18d69d3c165cd2021" indent="up1"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="id55E5C1E2638749FF838A5AAB893C0C56"><enum>(I)</enum><text>The Secretary of Labor shall provide notice to an employer of the intent to conduct an investigation under clause (i) or (ii).</text></subclause><subclause id="id28686FAD87454289BC7390F3CB070687" indent="up1"><enum>(II)</enum><text>The notice shall be provided in such a manner, and shall contain sufficient detail, to permit the employer to respond to the allegations before an investigation is commenced.</text></subclause><subclause id="idC6DDC09A4F424C7E9ABEE14E1FB37637" indent="up1"><enum>(III)</enum><text>The Secretary is not required to comply with this clause if the Secretary determines that such compliance would interfere with an effort by the Secretary to investigate or secure compliance by the employer with the requirements of this subsection.</text></subclause><subclause id="id473D5E63EDCB47869A320823F6353712" indent="up1"><enum>(IV)</enum><text>A determination by the Secretary under this clause shall not be subject to judicial review.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id4f3d7304d07c4d8b98deeebaf4febe16"><enum>(8)</enum><text>in clause (vi), as so redesignated, by striking <quote>An investigation</quote> in the first sentence and all that follows through <quote>the determination.</quote> in the second sentence and inserting <quote>If the Secretary of Labor, after an investigation under clause (i) or (ii), determines that a reasonable basis exists to make a finding that the employer has failed to comply with the requirements under this subsection, the Secretary shall provide interested parties with notice of such determination and an opportunity for a hearing in accordance with section 556 of title 5, United States Code, not later than 60 days after the date of such determination.</quote>; and</text></paragraph><paragraph id="ida490dd7ceeca489db369fdccb599b43d"><enum>(9)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idd2c00cac049b4fe5b694f566e1798923" style="OLC"><clause commented="no" display-inline="no-display-inline" id="id07f770f223f84831aae31d3d8f69d092" indent="up1"><enum>(vii)</enum><text>If the Secretary of Labor, after a hearing, finds that the employer has violated a requirement under this subsection, the Secretary may impose a penalty pursuant to subparagraph (C).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id602181d87a864f03aa362eba444068ee"><enum>7.</enum><header>Adjustment of status for employment-based immigrants</header><subsection id="id09bee8ed7ae54e0d8d32eb141f2a123c"><enum>(a)</enum><header>Adjustment of status for employment-based immigrants</header><paragraph id="id3DAFFFCF95FE4B878D98334C4FFBF37F"><enum>(1)</enum><header>In general</header><text>Section 245 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC53509F304494A72A55A1C2AE6BBE6EF"><subsection id="id6ddcd562a1b7481fa639ddef9a104ac3"><enum>(n)</enum><header>Adjustment of status for employment-based immigrants</header><paragraph id="id27b93f60107240a88522e5d10a54e72c"><enum>(1)</enum><header>In general</header><text>An alien who has status under section 214, other than an alien described in subsection (c) (as remedied by subsection (k), as amended by the <short-title>Fairness for High-Skilled Immigrants Act of 2020</short-title>) or subparagraph (B) or (C) of section 101(a)(15), and any eligible dependents of such alien, who has filed a petition or on whose behalf a petition has been filed for immigrant status pursuant to subparagraph (E) or (F) of section 204(a)(1), may file an application with the Secretary of Homeland Security for adjustment of status if such petition was approved not less than two years before the date on which the application for adjustment of status is filed, regardless of whether an immigrant visa is immediately available on that date. For any dependent child who files an application under this subsection, that individual may continue to qualify as a dependent child for purposes of the application regardless of the individual’s age or whether the principal beneficiary is deceased at the time an immigrant visa becomes available. Except as otherwise provided in paragraphs (3), (4), and (5), an alien who files an application under this subsection shall be eligible for work authorization and travel permission on the same terms as an alien who files an application under subsection (a).</text></paragraph><paragraph id="id42576f5a6b5444a181e9a6dc9b7d4b3f"><enum>(2)</enum><header>Availability</header><text>An adjustment of status application filed pursuant to paragraph (1) may not be approved until the date on which an immigrant visa becomes available. An admissible alien who has properly filed such an application shall have the same status as an alien who files under subsection (a).</text></paragraph><paragraph id="idc499e061162d403884d591b8604ff7ef"><enum>(3)</enum><header>Duties, hours, and compensation</header><text>The terms and conditions of a qualifying employment position offered to an alien who has filed a petition or on whose behalf a petition has been filed, for immigrant status pursuant to subparagraph (E) or (F) of section 204(a)(1), including duties, hours, and compensation, during the period following the filing of an application for adjustment under paragraph (1) and before a visa becomes immediately available, must be commensurate with the terms and conditions applicable to the employer's similarly situated United States workers in the area of employment. If the employer does not employ and has not recently employed more than two similarly situated U.S. workers in the area of employment, the employer nevertheless remains obligated to attest that the terms and conditions of the alien’s employment are commensurate with the terms and conditions of employment for other similarly situated United States workers in the area of employment. <quote>Similarly situated United States workers</quote> includes United States workers performing similar duties, subject to similar supervision, and with similar educational backgrounds, industry expertise, employment experience, levels of responsibility, and skill sets as the alien in the same geographic area of employment as the alien. The duties, hours, and compensation of such aliens are <quote>commensurate</quote> with those offered to United States workers employed by the employer in the same area of employment when the employer can show that the duties, hours, and compensation are consistent with the range of such terms and conditions the employer has offered or would offer to similarly situated United States employees.</text></paragraph><paragraph id="id86a15c8a3e814f5399e0c6c5f4abc919"><enum>(4)</enum><header>Enforcement</header><text>A principal applicant applying for adjustment pursuant to paragraph (1) shall file a Confirmation of Bona Fide Job Offer or Portability with any request for an employment authorization document. Any employment authorization document issued to such a principal applicant shall expire after three years, and another Confirmation of Bona Fide Offer or Portability shall be filed with any request for a renewal of employment authorization. No final decision on an application under paragraph (1) may be issued without a filing of a Confirmation of Bona Fide Job Offer or Portability by the principal applicant received within 12 months of such decision. A principal applicant shall provide sufficient information to verify compliance with paragraph (3), and an indication that the filing is to ensure compliance for an adjustment applicant under this subsection, when the applicant files a Confirmation. A principal applicant shall also provide a signed letter from his or her current or prospective employer attesting that the terms and conditions of the alien’s employment are commensurate with the terms and conditions of employment for other similarly situated United States workers in the area of employment. If a required Confirmation is not timely received by United States Citizenship and Immigration Services, the underlying Application to Adjust Status filed under paragraph (1), including the applications for eligible dependents, shall be denied. In adjudicating the Application to Adjust Status, when an immigrant visa becomes available, United States Citizenship and Immigration Services shall request the filing of a Confirmation of Bona Fide Job Offer or Portability if a Confirmation of Bona Fide Job Offer or Portability has not been filed within the previous 12 months and may consider the validity of any Confirmation filing that has not already been reviewed and found satisfactory. If the most recent Confirmation filing or prior filings not previously found satisfactory do not warrant a finding of compliance with section 204(j) or paragraph (3), United States Citizenship and Immigration Services shall issue a Notice of Intent to Deny the underlying Application to Adjust Status providing an opportunity for further evidence to be submitted on such deficiency after which any applicant that does not meet his or her burden of proof shall receive a denial of the underlying Application to Adjust Status and the applications of eligible dependents. </text></paragraph><paragraph id="id00d8f4a2bae641bd99dce859506b696c"><enum>(5)</enum><header>Limitation on work authorization</header><text>An alien who was neither authorized to work nor eligible to request work authorization at the time an application was filed under paragraph (1) shall not be eligible to receive work authorization pursuant to paragraph (1) or section 274a.12(c)(9) of title 8, Code of Federal Regulations.</text></paragraph><paragraph id="id5B5F5A1285EF4AE69A9E16F908176485"><enum>(6)</enum><header>Confirmations of Bona Fide Job Offer or Portability Fee</header><subparagraph id="id3b41403b1fbb447cb36a55705232c946"><enum>(A)</enum><header>In general</header><text> Notwithstanding any other provision of law, the Secretary of Homeland Security shall charge and collect a fee in the amount of $2,000 for each Confirmation of Bona Fide Job Offer or Portability filed under this subsection.</text></subparagraph><subparagraph id="idd8f6e3e0b4dd4634a0f8528d2a0003b9"><enum>(B)</enum><header>Deposits</header><text>The fees collected under subparagraph (A) shall be deposited and used as follows:</text><clause id="id2b33aa7e79614109af594299bb9343ca"><enum>(i)</enum><text>Fifty percent of such fees shall be deposited into the Immigration Examinations Fee Account established by section 286(m) and available as provided in this subsection.</text></clause><clause id="id98aed5ba5a95487788d073fb0d360015"><enum>(ii)</enum><text>Fifty percent of such fees shall be deposited into the Treasury as miscellaneous receipts.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4a3f0520c8364a8b9fc329a1a177b1b3"><enum>(b)</enum><header>Conforming amendment</header><text> Section 245(k) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(k)</external-xref>) is amended by adding <quote>or (n)</quote> after <quote>pursuant to subsection (a)</quote>.</text></subsection><subsection id="iddef9529c655840eab9affd977bbe3874"><enum>(c)</enum><header>Effective date</header><paragraph id="id11814e35cfb74245a945fdd26ed9ce9a"><enum>(1)</enum><text>This section and the amendments made by this section—</text><subparagraph id="id3025c89267194259a87c8d4c9f9b5757" commented="no"><enum>(A)</enum><text>shall take effect one year after the date of enactment of this Act; and</text></subparagraph><subparagraph id="id32ae30eb9b3447db91a268a8cc88b258" commented="no"><enum>(B)</enum><text>except as provided in paragraph (2), shall cease to have effect as of the date that is nine years after that date of enactment.</text></subparagraph></paragraph><paragraph id="id9068a562085743bc95155a3f01230210"><enum>(2)</enum><text>This section shall continue in effect with respect to any alien who has filed an application under this section any time prior to the date on which this section otherwise ceases to have effect.</text></paragraph></subsection></section><section id="idDC16A821E5664E52A3EE8D310AD08BFF"><enum>8.</enum><header>Limit on adjustment of status from H–1B nonimmigrant or H–4 nonimmigrant to EB immigrant</header><subsection id="id66DA93C1ACE242DE927C095F0EF88737"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1235">8 U.S.C. 1235</external-xref>), as amended by section 7, is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id447FBA3B4DEA48FFBC3CC5EEB1185506"><subsection id="id9DB9CC2F2AC44E20BA9E303243BA9804"><enum>(o)</enum><header>Limit on adjustment of status from H–1B nonimmigrant or H–4 nonimmigrant to EB immigrant</header><paragraph id="idA87418B11D3743868AF54BF65ABE4ABC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In applying this section to an alien who is (or has been during the most recent 2-year period) a nonimmigrant described in section 101(a)(15)(H)(i)(b), or to the spouse or any minor children of such alien who is (or has been during the most recent 2-year period) an H–4 nonimmigrant—</text><subparagraph id="id05B20C3352EF411697AF9DAB11B53DB9"><enum>(A)</enum><text display-inline="yes-display-inline">the number of such aliens (including the spouses and children of such aliens) granted an adjustment of status to that of an immigrant described in section 203(b) or otherwise issued an immigrant visa under this Act in a fiscal year—</text><clause id="idAE787594171E488FAEE6B839A3DE72C6"><enum>(i)</enum><text display-inline="yes-display-inline">during the period beginning on the date of enactment of this subsection and ending on the date on which the ninth fiscal year after the effective date ends, may not exceed 70 percent of the total number of employment-based immigrants admitted in such fiscal year; and</text></clause><clause id="id460466506FC543CE8E965B1DF2B058C1"><enum>(ii)</enum><text>after the date on which the ninth fiscal year after the effective date ends, may not exceed 50 percent of the total number of employment-based immigrants admitted in such fiscal year; and</text></clause></subparagraph><subparagraph id="id81A9AE3631084DD48926CD4D802CE6BC"><enum>(B)</enum><text display-inline="yes-display-inline">the limitations set forth in subparagraph (A) shall not apply to any such alien (or the spouse or children of such alien) if such alien—</text><clause id="idA2AD78C00575421BAE12AC5DBD8299B4"><enum>(i)</enum><text display-inline="yes-display-inline">has graduated from medical school and will be performing services in the United States as a member of the medical profession; or</text></clause><clause id="idEAC5C6381D2A4D5C927274580E5A81AE"><enum>(ii)</enum><text display-inline="yes-display-inline">has been granted a national interest waiver by U.S. Citizenship and Immigration Services under section 203(b)(2)(B).</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idCB082B9CAF4F46BB8D9E4A6541B1904E"><enum>(2)</enum><header>Effective date defined</header><text>In this subsection, the term <term>effective date</term> means the first day of the second fiscal year beginning after the date of enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE6351D7563D54AA681145CF3A9DD11E0" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Unused employment-based immigrant visas</header><text display-inline="yes-display-inline">Any immigrant visas reserved under section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) for employment-based immigrants that are not needed for an employment-based immigrant may be issued to aliens described in subparagraph in section 101(a)(15)(H)(i)(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(b)</external-xref>).</text></subsection></section><section id="id21F9D2C63B9C459794791EDC629028D0"><enum>9.</enum><header>Prohibition on admission or adjustment of status of aliens affiliated with the military forces of the People's Republic of China or the Chinese Communist Party</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall not adjust status of any alien affiliated with the military forces of the People's Republic of China or the Chinese Communist Party, as determined by the Secretary of Homeland Security, in consultation with the Secretary of State, the Secretary of Defense, the Attorney General, the Secretary of the Treasury, and the Director of National Intelligence. </text></section></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
