<section display-inline="yes-display-inline" section-type="undesignated-section" id="HC3567C80AC6B4ED4957CA61EC9A6A7BC"></section> 
<section display-inline="no-display-inline" section-type="section-one" id="H1B71AEF0F662495CBA9B58A9C2299654"><enum>1.</enum><text display-inline="yes-display-inline">The Continuing Appropriations Act, 2019 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/115/245">Public Law 115–245</external-xref>) is further amended—</text> <paragraph id="H7C2FB3D29631442DBC6B9EDF1D11ACD7"><enum>(1)</enum><text>in section 105—</text> 
<subparagraph id="H835572FD1B4B492E8FAECB87B43BB7B3"><enum>(A)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text></subparagraph> <subparagraph id="H4FB2E6E4F6A0461C86D97777A6479589"><enum>(B)</enum><text>in paragraph (3)—</text> 
<clause id="H1C0E0C2F14E84A20A37EAC50F9C14312"><enum>(i)</enum><text>by inserting <quote>except as provided in paragraph (4),</quote> before <quote>December</quote>; and</text></clause> <clause id="HF5C8BB183E9B44D689F068224958C679"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and </text></clause></subparagraph> 
<subparagraph id="H57815BABA18E4CFBA0DB371915637FDD"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H69AC3835C69F4B4EA7101E6995B53310" display-inline="no-display-inline"> <paragraph id="H4CCF604A0A1F46DE803915481502EFEF"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to appropriations and funds made available, and other authorities granted, pursuant to section 101(5) of this joint resolution for the Department of Homeland Security, February 28, 2019.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H18BDA61E52CC4A89A4C2125B08B58D76"><enum>(2)</enum><text>in section 110, by adding at the end the following:</text> <quoted-block style="OLC" id="HE351091F37754E6498DADD856A98D65C" display-inline="no-display-inline"> <subsection id="HE60C63C06B1143D98AC8390984C1CCCF"><enum>(c)</enum><text display-inline="yes-display-inline">With respect to mandatory payments whose budget authority was provided in the Department of Homeland Security Appropriations Act, 2018 (division F of <external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>), subsections (a) and (b) shall be applied by substituting <quote>section 105(4)</quote> for <quote>section 105(3)</quote> each place it appears.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H9CAF293DFC6444EDA838345584D663BC"><enum>2.</enum> 
<subsection id="H22848EE0B6B84BC2A9F35E97A436B1F9" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">Amounts appropriated by operation of the amendments made by section 1 for the salaries and expenses of employees shall be available for payment of salaries in accordance with section 1341(c) of title 31, United States Code (as added by the Government Employee Fair Treatment Act of 2019).</text></subsection> <subsection id="H078429FF19B9493E97914D07D0928F5F"><enum>(b)</enum><text display-inline="yes-display-inline">All obligations incurred in anticipation of the appropriations made and authority granted by this joint resolution for the purposes of maintaining the essential level of activity to protect life and property and bringing about orderly termination of Government functions, and for purposes as otherwise authorized by law, are hereby ratified and approved if otherwise in accord with the provisions of this joint resolution, and for purposes of such obligations the time period covered by this joint resolution shall be considered to include the period beginning on or about December 22, 2018, during which there occurred a lapse in appropriations.</text></subsection></section> 
<section id="H2844E9700DD64477BC655FFA9A805B78"><enum>3.</enum> 
<subsection id="HCF3FD115FD314472815838E42B10DB92" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">If a State (or another Federal grantee) used State funds (or the grantee’s non-Federal funds) to continue carrying out a Federal program or furloughed State employees (or the grantee’s employees) whose compensation is advanced or reimbursed in whole or in part by the Federal Government—</text> <paragraph id="HFEEDB205F1CB4051A69BC0AA8BE822A7" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">such furloughed employees shall be compensated at their standard rate of compensation for such period;</text></paragraph> 
<paragraph id="H6F0A6A6D582E4343A82BFE23B94B8B2F"><enum>(2)</enum><text display-inline="yes-display-inline">the State (or such other grantee) shall be reimbursed for expenses that would have been paid by the Federal Government during such period had appropriations been available, including the cost of compensating such furloughed employees, together with interest thereon calculated under section 6503(d) of title 31, United States Code; and</text></paragraph> <paragraph id="H76A3A7E7BA294C7E9EA6F3BA68B7FF62"><enum>(3)</enum><text display-inline="yes-display-inline">the State (or such other grantee) may use funds available to the State (or the grantee) under such Federal program to reimburse such State (or the grantee), together with interest thereon calculated under section 6503(d) of title 31, United States Code.</text></paragraph></subsection> 
<subsection id="HE54FB028E4B1494DA7790811460422DA"><enum>(b)</enum><text display-inline="yes-display-inline">For purposes of this section, the term <term>State</term> and the term <term>grantee</term>, including United States territories and possessions, shall have the meaning given such terms under the applicable Federal program under subsection (a). In addition, <quote>to continue carrying out a Federal program</quote> means the continued performance by a State or other Federal grantee, during the period of a lapse in appropriations, of a Federal program that the State or such other grantee had been carrying out prior to the period of the lapse in appropriations.</text></subsection> <subsection id="H3E9FD427563E4C1182B6DD52FC42AFB1"><enum>(c)</enum><text display-inline="yes-display-inline">The authority under this section applies with respect to the period of a lapse in appropriations beginning on or about December 22, 2018, and ending on the date of enactment of this joint resolution with respect to the Department of Homeland Security which, but for such lapse in appropriations, would have paid, or made reimbursement relating to, any of the expenses referred to in this section with respect to the program involved. Payments and reimbursements under this authority shall be made only to the extent and in amounts provided in advance in appropriations Acts.</text></subsection></section>
