			 prevent unjust or unreasonable discrimination among areas of the United
			 States in the delivery of such communications.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="id7e7346c7-b6e0-491c-84c4-2959f227cac2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Rural Call Quality and Reliability Act of 2017</short-title></quote>.</text>
		</section><section id="id753ef0ff-d064-459f-9a6c-7def4e69a76e" section-type="subsequent-section"><enum>2.</enum><header>Ensuring the integrity
 of voice communications</header><text display-inline="no-display-inline">Part II of title II of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251</external-xref> et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id69f32a6a-9e94-4ddb-8e51-3f499faa245e" style="OLC">
				<section id="ide1afacbd-0c53-4be7-887c-d877566b6875"><enum>262.</enum><header>Ensuring the
				integrity of voice communications</header>
					<subsection id="id491de403-259d-4379-9bc0-53ce486376bf"><enum>(a)</enum><header>Registration and
 compliance by intermediate providers</header><text display-inline="yes-display-inline">An intermediate provider that offers or holds itself out as offering the capability to transmit covered voice communications from one destination to another and that charges any rate to any other entity (including an affiliated entity) for the transmission shall—</text>
 <paragraph id="idb7836895-b2d5-43c2-a50f-c7a940fb4938"><enum>(1)</enum><text display-inline="yes-display-inline">register with the Commission; and</text> </paragraph><paragraph id="id8a94b141-4b38-46fb-b545-6be96b227bae"><enum>(2)</enum><text display-inline="yes-display-inline">comply with the service quality standards for such transmission to be established by the Commission under subsection (c)(1)(B).</text>
						</paragraph></subsection><subsection id="id73a460ac-b0cb-4d11-b123-d90728b11388"><enum>(b)</enum><header>Required use of
 registered intermediate providers</header><text display-inline="yes-display-inline">A covered provider may not use an intermediate provider to transmit covered voice communications unless such intermediate provider is registered under subsection (a)(1).</text>
					</subsection><subsection id="id4721a258-d793-453c-a103-919c91f4ab91"><enum>(c)</enum><header>Commission
				rules</header>
						<paragraph id="idd207335a-1e01-46ec-848c-bea17791e3cd"><enum>(1)</enum><header>In
				general</header>
 <subparagraph id="id3B136E762EA9481D83B9597D6C05AEBB"><enum>(A)</enum><header>Registry</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Commission shall promulgate rules to establish a registry to record registrations under subsection (a)(1).</text>
 </subparagraph><subparagraph id="id42c06da2-86e1-4e4a-990e-209542240ed2"><enum>(B)</enum><header>Service quality standards</header><text>Not later than 1 year after the date of enactment of this section, the Commission shall promulgate rules to establish service quality standards for the transmission of covered voice communications by intermediate providers.</text>
 </subparagraph></paragraph><paragraph id="ide69b5938-c12b-43a8-86aa-b2b8e5ff8e13"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">In promulgating the rules required by paragraph (1), the Commission shall—</text>
 <subparagraph id="idf49fa352-5638-4270-b993-78d941054dab"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the integrity of the transmission of covered voice communications to all customers in the United States; and</text>
 </subparagraph><subparagraph id="id253936f0-c78e-4cf3-a64b-fe95fee67732"><enum>(B)</enum><text display-inline="yes-display-inline">prevent unjust or unreasonable discrimination among areas of the United States in the delivery of covered voice communications.</text>
							</subparagraph></paragraph></subsection><subsection id="idecbd5ed6-b440-4a79-a7ad-629ba6e711c5"><enum>(d)</enum><header>Public
 availability of registry</header><text>The Commission shall make the registry established under subsection (c)(1)(A) publicly available on the website of the Commission.</text>
					</subsection><subsection id="ideb72ba1e-ad2f-4b83-bbc5-b7dbb3aad360"><enum>(e)</enum><header>Scope of
 application</header><text display-inline="yes-display-inline">The requirements of this section shall apply regardless of the format by which any communication or service is provided, the protocol or format by which the transmission of such communication or service is achieved, or the regulatory classification of such communication or service.</text>
					</subsection><subsection id="id8f41f935-b3d2-49d8-9e4b-e6eef890b52f"><enum>(f)</enum><header>Rule of
 construction</header><text>Nothing in this section shall be construed to affect the regulatory classification of any communication or service.</text>
 </subsection><subsection id="idecb44df6-9044-45d8-bccb-e2aa73ed9804"><enum>(g)</enum><header>Effect on other laws</header><text>Nothing in this section shall be construed to preempt or expand the authority of a State public utility commission or other relevant State agency to collect data, or investigate and enforce State law and regulations, regarding the completion of intrastate voice communications, regardless of the format by which any communication or service is provided, the protocol or format by which the transmission of such communication or service is achieved, or the regulatory classification of such communication or service.</text>
 </subsection><subsection id="id8f266394202e4775bc77d40fdcf62ca1"><enum>(h)</enum><header>Exception</header><text>The requirement under subsection (a)(2) to comply with the service quality standards established under subsection (c)(1)(B) shall not apply to a covered provider that—</text>
 <paragraph id="idD65983579FE74B488E82E1687DF31271"><enum>(1)</enum><text>on or before the date that is 1 year after the date of enactment of this section, has certified as a Safe Harbor provider under section 64.2107(a) of title 47, Code of Federal Regulations, or any successor regulation; and</text>
 </paragraph><paragraph id="id3725DC0756C4480B96B79E42B324D3D1"><enum>(2)</enum><text>continues to meet the requirements under such section 64.2107(a).</text> </paragraph></subsection><subsection id="idad95e77f-4d3e-45c7-96d4-58cfc6ef936f"><enum>(i)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="iddc4a3038-99a6-431b-9e6a-a62698a399dd"><enum>(1)</enum><header>Covered provider</header><text>The term <term>covered provider</term> has the meaning given the term in section 64.2101 of title 47, Code of Federal Regulations, or any successor thereto.</text>
						</paragraph><paragraph id="id4740274c-db7e-4608-bd46-cdc615cd4a9c"><enum>(2)</enum><header>Covered voice
 communication</header><text>The term <term>covered voice communication</term> means a voice communication (including any related signaling information) that is generated—</text>
 <subparagraph id="iddd071da5-9c47-40a7-925a-3df74fb7beba"><enum>(A)</enum><text>from the placement of a call from a connection using a North American Numbering Plan resource or a call placed to a connection using such a numbering resource; and</text>
 </subparagraph><subparagraph id="idf78c163f-5634-4c09-8a8f-9f1b4200979e"><enum>(B)</enum><text>through any service provided by a covered provider.</text>
							</subparagraph></paragraph><paragraph id="idd7324646-e39c-4a61-bc28-ceafdcccc560"><enum>(3)</enum><header>Intermediate
 provider</header><text>The term <term>intermediate provider</term> means any entity that—</text>
 <subparagraph id="idb72495ae5de44e259a65df585713edd0"><enum>(A)</enum><text>enters into a business arrangement with a covered provider or other intermediate provider for the specific purpose of carrying, routing, or transmitting voice traffic that is generated from the placement of a call placed—</text>
 <clause id="id503B4780F5534F798A88F4A701A07901"><enum>(i)</enum><text>from an end user connection using a North American Numbering Plan resource; or</text> </clause><clause id="id5C77069A8BE545E99F2B0D0243980BF2"><enum>(ii)</enum><text>to an end user connection using such a numbering resource; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3b1339bba9045618f3d1dee02e86722"><enum>(B)</enum><text>does not itself, either directly or in conjunction with an affiliate, serve as a covered provider in the context of originating or terminating a given call.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement><action-date>March 21, 2017</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
