</longTitle>
<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d32283e62" identifier="/us/bill/115/s/791/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Small Business Innovation Protection Act of 2017</shortTitle>”.</content></section>
<section id="d32283e72" identifier="/us/bill/115/s/791/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  In this Act—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e78" identifier="/us/bill/115/s/791/s2/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>the term “<term>Administrator</term>” means the Administrator of the SBA;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e82" identifier="/us/bill/115/s/791/s2/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>the term “<term>Director</term>” means the Under Secretary of Commerce for Intellectual Property and Director of the USPTO;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e86" identifier="/us/bill/115/s/791/s2/3" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>the term “<term>SBA</term>” means the Small Business Administration;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e90" identifier="/us/bill/115/s/791/s2/4" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>the term “<term>small business concern</term>” has the meaning given the term in section 3(a) of the Small Business Act (<ref href="/us/usc/t15/s632/a">15 U.S.C. 632(a)</ref>);</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e98" identifier="/us/bill/115/s/791/s2/5" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><content>the term “<term>small business development center</term>” means a center described in section 21 of the Small Business Act (<ref href="/us/usc/t15/s648">15 U.S.C. 648</ref>); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e106" identifier="/us/bill/115/s/791/s2/6" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="6">(6) </num><content>the term “<term>USPTO</term>” means the United States Patent and Trademark Office.</content></paragraph></section>
<section id="d32283e111" identifier="/us/bill/115/s/791/s3" style="-uslm-lc:I650141"><num value="3">SEC. 3. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Congress finds that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e117" identifier="/us/bill/115/s/791/s3/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the USPTO and the SBA are positioned to—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32283e121" identifier="/us/bill/115/s/791/s3/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>build upon several successful intellectual property and training programs aimed at small business concerns; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32283e125" identifier="/us/bill/115/s/791/s3/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>increase the availability of and the participation in the programs described in subparagraph (A) across the United States; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e129" identifier="/us/bill/115/s/791/s3/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>any education and training program administered by the USPTO and the SBA should be scalable so that the program is able to reach more small business concerns.</content></paragraph></section>
<section id="d32283e135" identifier="/us/bill/115/s/791/s4" style="-uslm-lc:I650141"><num value="4">SEC. 4. </num><heading>SBA AND USPTO PARTNERSHIPS.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32283e139" identifier="/us/bill/115/s/791/s4/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Beginning not later than 180 days after the date of enactment of this Act, the Administrator, in consultation with the Director, shall develop partnership agreements that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e147" identifier="/us/bill/115/s/791/s4/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>provide for the—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32283e151" identifier="/us/bill/115/s/791/s4/a/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>development of high-quality training, including in-person or modular training sessions, for small business concerns relating to domestic and international protection of intellectual property;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32283e155" identifier="/us/bill/115/s/791/s4/a/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>leveraging of training materials already developed for the education of inventors and small business concerns; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32283e159" identifier="/us/bill/115/s/791/s4/a/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>participation of a nongovernmental organization; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e163" identifier="/us/bill/115/s/791/s4/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>provide training—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32283e167" identifier="/us/bill/115/s/791/s4/a/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>through electronic resources, including Internet-based webinars; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32283e171" identifier="/us/bill/115/s/791/s4/a/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>at physical locations, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d32283e175" identifier="/us/bill/115/s/791/s4/a/2/B/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>a small business development center; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d32283e179" identifier="/us/bill/115/s/791/s4/a/2/B/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the headquarters or a regional office of the USPTO.</content></clause></subparagraph></paragraph></subsection></section>
<section id="d32283e184" identifier="/us/bill/115/s/791/s5" role="instruction" style="-uslm-lc:I650141"><num value="5">SEC. 5. </num><heading>SMALL BUSINESS DEVELOPMENT CENTERS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 21(c)(3) of the Small Business Act (<ref href="/us/usc/t15/s648/c/3">15 U.S.C. 648(c)(3)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e196" identifier="/us/bill/115/s/791/s5/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (S), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e204" identifier="/us/bill/115/s/791/s5/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraph (T), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32283e215" identifier="/us/bill/115/s/791/s5/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="U">“(U) </num><chapeau>in conjunction with the United States Patent and Trademark Office, providing training—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>to small business concerns relating to—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>domestic and international intellectual property protections; and</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>how the protections described in subclause (I) should be considered in the business plans and growth strategies of the small business concerns; and</content></subclause></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>that may be delivered—</chapeau><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="I">“(I) </num><content>in person; or</content></subclause><subclause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="II">“(II) </num><content>through a website.”</content></subclause></clause></subparagraph></quotedContent>.</content></paragraph></section>
