 purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="id0083168CE0E14C238C9762EE1634E8FE" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Safety Officers’ Benefits Improvement Act of 2017</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idA4045F7C17394ACD995E2CFA8C663912" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="no-display-inline">Section 1205 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796c">42 U.S.C. 3796c</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idC55BE05BDC8E437DA804968C30F97A74"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>Rules, regulations, and procedures issued under this part may include regulations based on standards developed by another Federal agency for programs related to public safety officer death or disability claims.</quote> before the last sentence;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90B77D4AFC614084B74EC3853DBB05CA"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id241982339B19421EB4A91F4B44327490"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> before <quote>In making</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id49DDF60ABAF847CF98D87C14DBA2D5BE"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id75AB6DC82D1F4ADCBD60E521CBA5EEF3" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id085DE57263F24C27A7983D68D5D1969B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In making a determination under section 1201, the Bureau shall give substantial weight to the evidence and all findings of fact presented by a State, local, or Federal administrative or investigative agency regarding eligibility for death or disability benefits.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8A5CD3176FE94EC48E0CB5644CE82CB7" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If the head of a State, local, or Federal administrative or investigative agency, in consultation with the principal legal officer of the agency, provides a certification of facts regarding eligibility for death or disability benefits, the Bureau shall adopt the factual findings, if the factual findings are supported by substantial evidence.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFDEBAF727A1A4BE9BA39A9C1A1371438"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idF32B74B7E7D24A9AB529BA802410B848" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id5206B3AEA2524E6DBB4485DD1D399ACE"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id7B1968D8EBB7459CA5A5EB4A7A921BE1"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id64CE2140284D4D158F3F9631B1958FAA"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this subsection, the Bureau shall make available on the public website of the Bureau information on all death, disability, and educational assistance claims submitted under this part that are pending as of the date on which the information is made available.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc715d0724bbd48f2b4eb5d69067d8d90" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">Not less frequently than once per week, the Bureau shall make available on the public website of the Bureau updated information with respect to all death, disability, and educational assistance claims submitted under this part that are pending as of the date on which the information is made available.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31fae903f8bf4f0790221da5be4c3af5" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The information made available under this paragraph shall include—</text><clause commented="no" display-inline="no-display-inline" id="id59f22c31626a46f0a2276da9755317f4"><enum>(i)</enum><text display-inline="yes-display-inline">for each pending claim—</text><subclause commented="no" display-inline="no-display-inline" id="id0C4FB82AD6DD4EA791E4F7CBF53CD60F"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which the claim was submitted to the Bureau;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id801d44624d1a471c91b501b5822cbd33"><enum>(II)</enum><text display-inline="yes-display-inline">the State of residence of the claimant;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc42665e02d2b41c8a3be7887f80b9f42"><enum>(III)</enum><text display-inline="yes-display-inline">an anonymized, identifying claim number; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id31ab7a78a92c4192acb542b8d1c7b679"><enum>(IV)</enum><text display-inline="yes-display-inline">the nature of the claim; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="iddc773440204a438d90820880c205f0d6"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of pending claims that were submitted to the Bureau more than 1 year before the date on which the information is made available.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31E99EFE7F734BB49EEC87C0D94D06FE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, the Bureau shall publish on the public website of the Bureau a report, and shall update such report on such website not less than once every 180 days thereafter, containing—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5ABFC83513114698A0217B177053CE8D"><enum>(A)</enum><text display-inline="yes-display-inline">the total number of claims for which a final determination has been made during the 180-day period preceding the report;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDB9DDF1135D9429CA40BA782FE95C767"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of time required to process each claim for which a final determination has been made during the 180-day period preceding the report;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id829871728EAD4CDB8D9A0A3BF43CE98D"><enum>(C)</enum><text display-inline="yes-display-inline">as of the last day of the 180-day period preceding the report, the total number of claims submitted to the Bureau on or before that date for which a final determination has not been made;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDE88CE47FF0D42E7A8DD68962B7AFCAC"><enum>(D)</enum><text display-inline="yes-display-inline">as of the last day of the 180-day period preceding the report, the total number of claims submitted to the Bureau on or before the date that is 1 year before that date for which a final determination has not been made;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id686E1C4A1AC94E0BB90398B4A3A511D5"><enum>(E)</enum><text display-inline="yes-display-inline">for each claim described in subparagraph (D), a detailed description of the basis for delay;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAC850DE4BC70490BA4917DFABDF68655"><enum>(F)</enum><text display-inline="yes-display-inline">as of the last day of the 180-day period preceding the report, the total number of claims submitted to the Bureau on or before that date relating to exposure due to the September 11th, 2001, terrorism attacks for which a final determination has not been made;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFBCDC2A9E376497495561E4B23C881F3"><enum>(G)</enum><text display-inline="yes-display-inline">as of the last day of the 180-day period preceding the report, the total number of claims submitted to the Bureau on or before the date that is 1 year before that date relating to exposure due to the September 11th, 2001, terrorism attacks for which a final determination has not been made;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC7CE9392C3894674B8255E084D280106"><enum>(H)</enum><text display-inline="yes-display-inline">for each claim described in subparagraph (G), a detailed description of the basis for delay;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC949068D0CC444E49C0B4200C2943BBA"><enum>(I)</enum><text display-inline="yes-display-inline">the total number of claims submitted to the Bureau relating to exposure due to the September 11th, 2001, terrorism attacks for which a final determination was made during the 180-day period preceding the report, and the average award amount for any such claims that were approved;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE8B69DAFF0444C1B80237A346E345BD8"><enum>(J)</enum><text display-inline="yes-display-inline">the result of each claim for which a final determination was made during the 180-day period preceding the report, including the number of claims rejected and the basis for any denial of benefits;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5B71BA223EE94460838D7D8FD838F22F"><enum>(K)</enum><text display-inline="yes-display-inline">the number of final determinations which were appealed during the 180-day period preceding the report, regardless of when the final determination was first made;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22D2018DFDC6497881591E5A665614EE"><enum>(L)</enum><text display-inline="yes-display-inline">the average number of claims processed per reviewer of the Bureau during the 180-day period preceding the report;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFDEC001D32804F35B4A06D65BA4B6076"><enum>(M)</enum><text display-inline="yes-display-inline">for any claim submitted to the Bureau that required the submission of additional information from a public agency, and for which the public agency completed providing all of the required information during the 180-day period preceding the report, the average length of the period beginning on the date the public agency was contacted by the Bureau and ending on the date on which the public agency submitted all required information to the Bureau;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id04FB1037CFBC4A67B2EED554F2E151A4"><enum>(N)</enum><text display-inline="yes-display-inline">for any claim submitted to the Bureau for which the Bureau issued a subpoena to a public agency during the 180-day period preceding the report in order to obtain information or documentation necessary to determine the claim, the name of the public agency, the date on which the subpoena was issued, and the dates on which the public agency was contacted by the Bureau before the issuance of the subpoena; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id15EE700BD4FF47CC9D8B8EB0568626D1"><enum>(O)</enum><text display-inline="yes-display-inline">information on the compliance of the Bureau with the obligation to offset award amounts under section 1201(f)(3), including—</text><clause commented="no" display-inline="no-display-inline" id="idA44FDA61838A4B258F5346A7CB6BC6B8"><enum>(i)</enum><text display-inline="yes-display-inline">the number of claims that are eligible for compensation under both this part and the September 11th Victim Compensation Fund of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/42">Public Law 107–42</external-xref>) (commonly referred to as the <quote>VCF</quote>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id61A1532F75044AF88B46E206DF018878"><enum>(ii)</enum><text display-inline="yes-display-inline">for each claim described in clause (i) for which compensation has been paid under the VCF, the amount of compensation paid under the VCF;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2C724CC97A3243CAA12ABB485AF9C86D"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of claims described in clause (i) for which the Bureau has made a final determination; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idFF76BBBDD43F4458A7061E00DD1C91E1"><enum>(iv)</enum><text display-inline="yes-display-inline">the number of claims described in clause (i) for which the Bureau has not made a final determination.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id665A8383C04F457494CFA8CCDF742865" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this subsection, and 2 years thereafter, the Comptroller General of the United States shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id69B0B6831E5B4A7FA06702280E6B308F"><enum>(A)</enum><text display-inline="yes-display-inline">conduct a study on the compliance of the Bureau with the obligation to offset award amounts under section 1201(f)(3); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51912C94FAC64634AA2F918C9201B6FA"><enum>(B)</enum><text display-inline="yes-display-inline">submit to Congress a report on the study conducted under subparagraph (A) that includes an assessment of whether the Bureau has provided the information required under subparagraph (B)(ix) of paragraph (2) of this subsection in each report required under that paragraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id284ED278CF064C499E5CA761ED9B2F5A" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>nature of the claim</term> means whether the claim is a claim for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id245D48C61EEC4479A26D13977EB9CB46"><enum>(A)</enum><text display-inline="yes-display-inline">benefits under this subpart with respect to the death of a public safety officer;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4ABCB31C0F6B4D5690F167A9E987C47D"><enum>(B)</enum><text display-inline="yes-display-inline">benefits under this subpart with respect to the disability of a public safety officer; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id365971E034624EE79C56B7367FBD1F17"><enum>(C)</enum><text display-inline="yes-display-inline">education assistance under subpart 2.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="idD0287F61597D479FAA3C4C5FA0B764A9" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Age limitation for children</header><text display-inline="no-display-inline">Section 1212(c) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-1">42 U.S.C. 3796d–1(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id75D92004F14F424AABDDD984F934CFCF"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>No child</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id286B5DC8101B4BA5A72FB8F2BC89F537" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id518B4732FED44BD483936BA228ABD2D4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), no child</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id892FBBE67F794E4FA4581D334F7FC46B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id8BEEAE09D5544739A46B9E2EC10C2928" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idA93E6B33A49E4888901BB3811B47431A"><enum>(2)</enum><header display-inline="yes-display-inline">Delayed approvals</header><subparagraph commented="no" display-inline="no-display-inline" id="idC890D6DC4EA444B79416AE685FEDEBDA"><enum>(A)</enum><header display-inline="yes-display-inline">Educational assistance application</header><text display-inline="yes-display-inline">If a claim for assistance under this subpart is approved more than 1 year after the date on which the application for such assistance is filed with the Attorney General, the age limitation under this subsection shall be extended by the length of the period—</text><clause commented="no" display-inline="no-display-inline" id="id8E64B0666CEB42569938D2A5A632E9A0"><enum>(i)</enum><text display-inline="yes-display-inline">beginning on the day after the date that is 1 year after the date on which the application is filed; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id27CC55A4D3C94666BB87E1D9A8078A55"><enum>(ii)</enum><text display-inline="yes-display-inline">ending on the date on which the application is approved.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3D58CFD735CF46C28D5C67D962A2691A"><enum>(B)</enum><header display-inline="yes-display-inline">Claim for benefits for death or permanent and total disability</header><text display-inline="yes-display-inline">In addition to an extension under subparagraph (A), if any, for an application for assistance under this subpart that relates to a claim for benefits under subpart 1 that was approved more than 1 year after the date on which the claim was filed with the Attorney General, the age limitation under this subsection shall be extended by the length of the period—</text><clause commented="no" display-inline="no-display-inline" id="id892877b0461640eb83db89614a35fdb4"><enum>(i)</enum><text display-inline="yes-display-inline">beginning on the day after the date that is 1 year after the date on which the claim for benefits is submitted; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ided89d9ae92184757b2cd4c2c9ed1eab6"><enum>(ii)</enum><text display-inline="yes-display-inline">ending on the date on which the claim for benefits is approved.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="idA617C46BEC734767B783B0FB839381BC" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Due diligence in paying benefit claims</header><text display-inline="no-display-inline">Subpart 1 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796">42 U.S.C. 3796</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id7E91FA63CD2E49869E17BF83A4DC2C73" style="OLC"><section commented="no" display-inline="no-display-inline" id="idFABA6F3B58F146ACA4A5ED1F06CE2DD2" section-type="subsequent-section"><enum>1206.</enum><header display-inline="yes-display-inline">Due diligence in paying benefit claims</header><subsection commented="no" display-inline="no-display-inline" id="idA4BF5926D36A4D0CAB4F6C6E9B6A3008"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Bureau, with all due diligence, shall expeditiously attempt to obtain the information and documentation necessary to adjudicate a benefit claim filed under this part, including a claim for financial assistance under subpart 2.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id27F8573C97E94F638A75147F641565DF"><enum>(b)</enum><header display-inline="yes-display-inline">Sufficient information unavailable</header><text display-inline="yes-display-inline">If a benefit claim filed under this part, including a claim for financial assistance under subpart 2, is unable to be adjudicated by the Bureau because of a lack of information or documentation from a third party, such as a public agency, and such information is not readily available to the claimant, the Bureau may not abandon the benefit claim unless the Bureau has utilized the investigative tools available to the Bureau to obtain the necessary information or documentation, including subpoenas.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id1c64b572a4464f85819c9397097b9885" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Presumption that officer acted properly</header><text display-inline="no-display-inline">Section 1202 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796a">42 U.S.C. 3796a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id67582493d571422ca7b3b91932178e4c"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>No benefit</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idc9bd60be0b67485bae2691b4a7cfdb0f" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id926F2C976AED446A80C0FA30467D5784"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No benefit</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89c047cf2c1540728a349db82c4cd06e"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id6af6e40434e7472eab3e7bfe0608f338" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id3183459dccbd4155b720791e074faeee"><enum>(b)</enum><header display-inline="yes-display-inline">Presumption</header><text display-inline="yes-display-inline">In determining whether a benefit is payable under this part, the Bureau—</text><paragraph commented="no" display-inline="no-display-inline" id="id9AF346F1F2514EB19D0917A2E7AE340F"><enum>(1)</enum><text display-inline="yes-display-inline">shall presume that none of the limitations described in subsection (a) apply; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b57413afd7642a58a9bd0c8762e5a0a"><enum>(2)</enum><text display-inline="yes-display-inline">shall not determine that a limitation described in subsection (a) applies, absent clear and convincing evidence.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="idB45807BDCD0B4D8AA3775D739CFE12AB" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Effective date; applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id1BFEB14FBF744FD4858C314580755B32"><enum>(1)</enum><text display-inline="yes-display-inline">take effect on the date of enactment of this Act; and</text></paragraph><paragraph commented="no"
