			 President’s discretion in setting the number of refugees admitted annually
			 to the United States, to reduce the number of family-sponsored immigrants,
			 to create a new nonimmigrant classification for the parents of adult
			 United States citizens, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reforming American Immigration for Strong Employment Act</short-title></quote> or the <quote><short-title>RAISE Act</short-title></quote>.</text>
		</section><section id="idbdb83ded423149918d759c456455a641"><enum>2.</enum><header>Elimination of Diversity Visa Program</header>
 <subsection id="idca087fc2c5a14c0caa4aac9375d50d38"><enum>(a)</enum><header>In general</header><text>Section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) is amended by striking subsection (c).</text>
			</subsection><subsection id="id00510686e1ce4bd6a08908ac1d591166"><enum>(b)</enum><header>Technical and conforming amendments</header>
 <paragraph id="id00C3D25C95C64B3AA8C0E6139045FCB6"><enum>(1)</enum><header>Immigration and Nationality Act</header><text>The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.) is amended—</text> <subparagraph id="idcb7e32f06a4c4a87b2ba955fd59e9357"><enum>(A)</enum><text>in section 101(a)(15)(V), by striking <quote>section 203(d)</quote> and inserting <quote>section 203(c)</quote>;</text>
 </subparagraph><subparagraph id="idCEB43CB34F1B4B73B5DEAC49BA903806"><enum>(B)</enum><text>in section 201—</text> <clause id="id79b74f8b8ddc44b8b828e459bbe8c406"><enum>(i)</enum><text>in subsection (a)—</text>
 <subclause id="ide3a32de7a004411e989eb7cfa0ff4baa"><enum>(I)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end; and</text> </subclause><subclause id="id5129d2adcfd24b1f9c0bf35238f276c3"><enum>(II)</enum><text>in paragraph (2), by striking <quote>; and</quote> at the end and inserting a period; and</text>

 </subparagraph></paragraph><paragraph id="id030817998B8048BDB0293A5440EDB00C"><enum>(2)</enum><header>Immigrant investor pilot program</header><text>Section 610(d) of the Departments of Commerce, Justice, and State, the Judiciary, and Related Agencies Appropriations Act, 1993 (<external-xref legal-doc="public-law" parsable-cite="pl/102/395">Public Law 102–395</external-xref>) is amended by striking <quote>section 203(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(e)</external-xref>)</quote> and inserting <quote>section 203(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(d)</external-xref>)</quote>.</text>
 </paragraph></subsection><subsection id="id85bed53cb70e405aac931dfbe637ac0e"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first fiscal year beginning on or after the date of the enactment of this Act.</text>
			</subsection></section><section id="idF9075DB5B0E7453F842C1DCC966932FF"><enum>3.</enum><header>Annual admission of refugees</header>
 <text display-inline="no-display-inline">Section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) is amended—</text> <paragraph id="id777AED7A715E408586779A6D204E3DED"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsections (a) and (b);</text>
 </paragraph><paragraph id="idEE9842BD412C424EB5F133538C5C578F"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (a);</text> </paragraph><paragraph id="id3437C8A261A14ABFABCDD0B763C0D804"><enum>(3)</enum><text>by redesignating subsection (f) as subsection (e);</text>
 </paragraph><paragraph id="id4F4C66D503F241689127A04966489826"><enum>(4)</enum><text>by inserting after subsection (a), as redesignated, the following:</text> <quoted-block display-inline="no-display-inline" id="id70F3BA24E0A348F5B3D6D958AD26BD7D" style="OLC"> <subsection id="id2121434DAB5648548B21C4ED26FF74CE"><enum>(b)</enum><header>Maximum number of admissions</header> <paragraph id="id3101724B673F485F9ADF3A9C3D08248C"><enum>(1)</enum><header>In general</header><text>The number of refugees who may be admitted under this section in any fiscal year may not exceed 50,000.</text>
 </paragraph><paragraph id="idF95C0858D3404C9BBDC2971B1AF0DF4A"><enum>(2)</enum><header>Asylees</header><text>The President shall annually enumerate the number of aliens who were granted asylum in the previous fiscal year.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idBF8FC66266E446EEBA1E59A362B5C76C"><enum>(5)</enum><text>by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>.</text> </paragraph></section><section id="id0d36093621dc4b1c8ee0adf60d70622d"><enum>4.</enum><header>Family-sponsored immigration priorities</header> <subsection id="id8E1E7E821FEA4D77AC3986B9CC540FA6"><enum>(a)</enum><header>Immediate relative redefined</header><text display-inline="yes-display-inline">Section 201 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>) is amended—</text>
 <paragraph id="id42C336C27C064C74861129810CD6CB39"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(A)—</text> <subparagraph id="idEBD6344883994CC89BE9EC08C1005BFF"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>children, spouses, and parents of a citizen of the United States, except that, in the case of parents, such citizens shall be at least 21 years of age.</quote> and inserting <quote>children and spouse of a citizen of the United States.</quote>; and</text>
 </subparagraph><subparagraph id="id8DB7F778DB2249E18DD5D37F4390AA1E"><enum>(B)</enum><text>in clause (ii), by striking <quote>such an immediate relative</quote> and inserting <quote>the immediate relative spouse of a United States citizen</quote>;</text> </subparagraph></paragraph><paragraph id="id0188BDCB22304FD280C230ADF7D5CA0C"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD9CABBE545E0467F8121374DB028A84C" style="OLC">
 <subsection commented="no" display-inline="no-display-inline" id="ID40983A0F044D4CF8ADCB96969F6CFD80"><enum>(c)</enum><header display-inline="yes-display-inline">Worldwide level of family-Sponsored immigrants</header><paragraph commented="no" display-inline="yes-display-inline" id="ID4A1A624B9BDC40CE94AE56CB90EA60BD"><enum>(1)</enum><text>The worldwide level of family-sponsored immigrants under this subsection for a fiscal year is equal to 88,000 minus the number computed under paragraph (2).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60A6CCA9161D4A08A626AEC37DF31C60" indent="up1"><enum>(2)</enum><text>The number computed under this paragraph for a fiscal year is the number of aliens who were paroled into the United States under section 212(d)(5) in the second preceding fiscal year who—</text>
 <subparagraph id="ID1D5BE348D0BB4536AA490F3A63799793"><enum>(A)</enum><text>did not depart from the United States (without advance parole) within 365 days; and</text> </subparagraph><subparagraph id="ID51FE9451F46D4F508BF42B848378AE7F"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idCAE38EA7AEF443AB8A02825D7117CACA"><enum>(i)</enum><text>did not acquire the status of an alien lawfully admitted to the United States for permanent residence during the two preceding fiscal years; or</text>
 </clause><clause id="id210C82531CEA48539BE98EC15B58A19F" indent="up1"><enum>(ii)</enum><text>acquired such status during such period under a provision of law (other than subsection (b)) that exempts adjustment to such status from the numerical limitation on the worldwide level of immigration under this section.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idFDEB1EBBAB034593AAEE44A015B190C6"><enum>(3)</enum><text>in subsection (f)—</text> <subparagraph id="idF9E2E499826C4270A0F1C4276C7169F4"><enum>(A)</enum><text>in paragraph (2), by striking <quote>section 203(a)(2)(A)</quote> and inserting <quote>section 203(a)</quote>;</text>
 </subparagraph><subparagraph id="id28B7D321CD1646FF8F8BC5AE814F0FFA"><enum>(B)</enum><text>by striking paragraph (3);</text> </subparagraph><subparagraph id="idD3F16C49AD934E32B559BE6F4B491CA2"><enum>(C)</enum><text>by redesignating paragraph (4) as paragraph (3); and</text>
 </subparagraph><subparagraph id="idBCAB6A8903B8474FB774E79A3DA36BBF"><enum>(D)</enum><text>in paragraph (3), as redesignated, by striking <quote>(1) through (3)</quote> and inserting <quote>(1) and (2)</quote>.</text> </subparagraph></paragraph></subsection><subsection id="idf9cf793c7d1040eb8b4499570040cd9f"><enum>(b)</enum><header>Family-Based visa preferences</header><text display-inline="yes-display-inline">Section 203(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id3954084DD060400AA32E39B76877C6D6" style="OLC">
 <subsection id="idE048A089CC064228B17C30D944941BD7"><enum>(a)</enum><header>Spouses and minor children of permanent resident aliens</header><text display-inline="yes-display-inline">Family-sponsored immigrants described in this subsection are qualified immigrants who are the spouse or a child of an alien lawfully admitted for permanent residence.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idaaa002ce1ecd44108a0ec4921405147b"><enum>(c)</enum><header>Conforming amendments</header>
 <paragraph id="id110d42eb8fe64e43ba3536236df7af5d"><enum>(1)</enum><header>Definition of V nonimmigrant</header><text>Section 101(a)(15)(V) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(V)</external-xref>) is amended by striking <quote>section 203(a)(2)(A)</quote> each place such term appears and inserting <quote>section 203(a)</quote>.</text>
 </paragraph><paragraph id="idB024A624C5B64E8DB3FB4DDD3F3FEDED"><enum>(2)</enum><header>Numerical limitation to any single foreign state</header><text>Section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152</external-xref>) is amended—</text> <subparagraph id="ide093f3e7d88342e5a23d537eca41ec9e"><enum>(A)</enum><text>in subsection (a)(4)—</text>
 <clause id="id7393b7560ce248c6b0b6a32c0d01e61c"><enum>(i)</enum><text>by striking subparagraphs (A) and (B) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id5b681b03f50c4163b1e4d03cc0a114b2" style="OLC"> <subparagraph id="id2a8dcb468341421aa5997994c0c9d478"><enum>(A)</enum><header>75 percent of family-sponsored immigrants not subject to per country limitation</header><text>Of the visa numbers made available under section 203(a) in any fiscal year, 75 percent shall be issued without regard to the numerical limitation under paragraph (2).</text>
								</subparagraph><subparagraph id="ida8d4e01f1cd44334be850dfa08af1c5f"><enum>(B)</enum><header>Treatment of remaining 25 percent for countries subject to subsection <enum-in-header>(e)</enum-in-header></header>
 <clause id="idd9fbe151c8c14106a2c1974f01512571"><enum>(i)</enum><header>In general</header><text>Of the visa numbers made available under section 203(a) in any fiscal year, 25 percent shall be available, in the case of a foreign state or dependent area that is subject to subsection (e) only to the extent that the total number of visas issued in accordance with subparagraph (A) to natives of the foreign state or dependent area is less than the subsection (e) ceiling.</text>
 </clause><clause id="idf25d7122044d4c9caef4e47f866c0ea4"><enum>(ii)</enum><header>Subsection <enum-in-header>(e)</enum-in-header> ceiling defined</header><text>In clause (i), the term <term>subsection (e) ceiling</term> means, for a foreign state or dependent area, 77 percent of the maximum number of visas that may be made available under section 203(a) to immigrants who are natives of the state or area, consistent with subsection (e).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="idf3e0e737e83948d187d01ab1a42c854d"><enum>(ii)</enum><text>by striking subparagraphs (C) and (D); and</text> </clause></subparagraph><subparagraph id="idc962d032b294404fb4b753cde9b830c7"><enum>(B)</enum><text>in subsection (e)—</text>
 <clause id="idf5bc022d60af4276b721085665897c8c"><enum>(i)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end;</text> </clause><clause id="id73ff885249ec43a9a132e0eac08e82a5"><enum>(ii)</enum><text>by striking paragraph (2);</text>
 </clause><clause id="id3E98E6356B7A414296D57F6959F12C66"><enum>(iii)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text> </clause><clause id="ide2f7bc04926b43b3a9be0a54a09f5f09"><enum>(iv)</enum><text>in the undesignated matter after paragraph (2), as redesignated, by striking <quote>, respectively,</quote> and all that follows and inserting a period.</text>
 </clause></subparagraph></paragraph><paragraph id="ide382dd84cae94e9c8785f59af6d59cbe"><enum>(3)</enum><header>Rules for determining whether certain aliens are children</header><text>Section 203(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(h)</external-xref>) is amended by striking <quote>(a)(2)(A)</quote> each place such term appears and inserting <quote>(a)(2)</quote>.</text> </paragraph><paragraph id="id93be70d1edf04423a41472cdcfa79bd2"><enum>(4)</enum><header>Procedure for granting immigrant status</header><text>Section 204 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) is amended—</text>
 <subparagraph id="id6f378d9e9ad348159151c0be34000071"><enum>(A)</enum><text>in subsection (a)(1)—</text> <clause id="id686eb40af3b540899a794298482dce1c"><enum>(i)</enum><text>in subparagraph (A)(i), by striking <quote>to classification by reason of a relationship described in paragraph (1), (3), or (4) of section 203(a) or</quote>;</text>
 </clause><clause id="id7452eccdf02f41568751780078a3e0d7"><enum>(ii)</enum><text>in subparagraph (B)—</text> <subclause id="idDF277D344E714135BCA9F4BA8D3C4F7D"><enum>(I)</enum><text>in clause (i), by redesignating the second subclause (I) as subclause (II); and</text>
 </subclause><subclause id="idD486983BD0E94F21936BDCB32F3E716B"><enum>(II)</enum><text>by striking <quote>203(a)(2)(A)</quote> each place such terms appear and inserting <quote>203(a)</quote>; and</text> </subclause></clause><clause id="id14a41d2112094a8e817759b3bdd7fb8b"><enum>(iii)</enum><text>in subparagraph (D)(i)(I), by striking <quote>a petitioner</quote> and all that follows through <quote>(a)(1)(B)(iii).</quote> and inserting <quote>an individual younger than 21 years of age for purposes of adjudicating such petition and for purposes of admission as an immediate relative under section 201(b)(2)(A)(i) or a family-sponsored immigrant under section 203(a), as appropriate, notwithstanding the actual age of the individual.</quote>;</text>
 </clause></subparagraph><subparagraph id="id9aeb628ad7244f1cb58690b8c57357df"><enum>(B)</enum><text>in subsection (f)(1), by striking <quote>, 203(a)(1), or 203(a)(3), as appropriate</quote>; and</text> </subparagraph><subparagraph id="id9bdc52fac0ec45488e72545f7a8fb99c"><enum>(C)</enum><text>by striking subsection (k).</text>
 </subparagraph></paragraph><paragraph id="id038bcf5b04fe4db3bed827d277fa1213"><enum>(5)</enum><header>Waivers of inadmissibility</header><text>Section 212 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended—</text> <subparagraph id="idBA4B5740B8764F6982FE38DCFE454E5E"><enum>(A)</enum><text>in subsection (a)(6)(E)(ii), by striking <quote>section 203(a)(2)</quote> and inserting <quote>section 203(a)</quote>; and</text>

 </paragraph><paragraph id="id184899CECC6240D3AED16D5946525D67"><enum>(7)</enum><header>Definition of alien spouse</header><text>Section 216(h)(1)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a(h)(1)(C)</external-xref>) is amended by striking <quote>section 203(a)(2)</quote> and inserting <quote>section 203(a)</quote>.</text> </paragraph><paragraph id="id42D169CE497D4DF2B39DD6BA12A91147"><enum>(8)</enum><header>Classes of deportable aliens</header><text>Section 237(a)(1)(E)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(1)(E)(ii)</external-xref>) is amended by striking <quote>section 203(a)(2)</quote> and inserting <quote>section 203(a)</quote>.</text>
				</paragraph></subsection><subsection id="idfc81ad63d9b947609b8b03a4e45cbef4"><enum>(d)</enum><header>Creation of nonimmigrant classification for alien parents of adult United States citizens</header>
 <paragraph id="id36D0216F36DA42BFA9C3A99DF3B509D1"><enum>(1)</enum><header>In general</header><text>Section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) is amended—</text> <subparagraph id="idB21C52204B3141C8BE6ECF0414799014"><enum>(A)</enum><text>in subparagraph (T)(ii)(III), by striking the period at the end and inserting a semicolon;</text>
 </subparagraph><subparagraph id="id60E3D6A417A14313B371ABF3A326749D"><enum>(B)</enum><text>in subparagraph (U)(iii), by striking <quote>or</quote> at the end;</text> </subparagraph><subparagraph id="id4F01703297BF498EA963886F67412E36"><enum>(C)</enum><text>in subparagraph (V)(ii)(II), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </subparagraph><subparagraph id="id2E1B812D5337403C9C1EAA7EF7750973"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idce8a75a758b842c284e30c5e97135544" style="OLC"> <subparagraph id="id1f36f2dd1f34424f975f12308106b63b" indent="up1"><enum>(W)</enum><text>Subject to section 214(s), an alien who is a parent of a citizen of the United States, if the citizen is at least 21 years of age.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id0E4AA1D3FB084CE2ABCA9B16FC5F35D1"><enum>(2)</enum><header>Conditions on admission</header><text>Section 214 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD4B997D9F0DA44ABAC96A9DBBA9D3A10">
 <subsection id="idb610c223103a41d3afe22dbbf254ba10"><enum>(s)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id7CD9CA03F6834C37BF93577B0DBCE046"><enum>(1)</enum><text>The initial period of authorized admission for a nonimmigrant described in section 101(a)(15)(W) shall be five years, but may be extended by the Secretary of Homeland Security for additional five-year periods if the United States citizen son or daughter of the nonimmigrant is still residing in the United States.</text>
 </paragraph><paragraph id="id033E6C4D24134D2D887DD36B1C014798" indent="up1"><enum>(2)</enum><text>A nonimmigrant described in section 101(a)(15)(W)—</text> <subparagraph id="id54D3367B609D4A5FA57B6783C74B9B92"><enum>(A)</enum><text>is not authorized to be employed in the United States; and</text>
 </subparagraph><subparagraph id="idB5EA7D71A41E4094AF886E2848DEFC4E"><enum>(B)</enum><text>is not eligible for any Federal, State, or local public benefit.</text>
 </subparagraph></paragraph><paragraph id="id18AF05F3DD4743588EBF8EA4AB6AAFB5" indent="up1"><enum>(3)</enum><text>Regardless of the resources of a nonimmigrant described in section 101(a)(15)(W), the United States citizen son or daughter who sponsored the nonimmigrant parent shall be responsible for the nonimmigrant’s support while the nonimmigrant resides in the United States.</text>
 </paragraph><paragraph id="id38EC1B0C8CD945F18BE9E688B7B0C3B2" indent="up1"><enum>(4)</enum><text>An alien is ineligible to receive a visa or to be admitted into the United States as a nonimmigrant described in section 101(a)(15)(W) unless the alien provides satisfactory proof that the United States citizen son or daughter has arranged for health insurance coverage for the alien, at no cost to the alien, during the anticipated period of the alien’s residence in the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idCE96FE0C08B547388E39189A423F732A"><enum>(e)</enum><header>Effective date; applicability</header>
 <paragraph id="id6F4DD10A698E4F75A8725CE94446F28C"><enum>(1)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the first day of the first fiscal year that begins after the date of the enactment of this Act.</text>
 </paragraph><paragraph id="id7B30E77EC8F943A597212DB2F4FE28DD"><enum>(2)</enum><header>Invalidity of certain petitions and applications</header><text display-inline="yes-display-inline">Any petition under section 204 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) seeking classification of an alien under a family-sponsored immigrant category that was eliminated by the amendments made by this section and filed after the date on which this Act was introduced and any application for an immigrant visa based on such a petition shall be considered invalid.</text>
