 <subsection commented="no" display-inline="no-display-inline" id="id70A1C5E16A214D9AA5EB57F08540CC0E"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text>Section 211 of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20301">34 U.S.C. 20301</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id3F2A55C25DD74C278FE10C81C134B8D2"><enum>(1)</enum><text>in paragraph (1), by striking <quote>2,000,000</quote> and inserting <quote>3,300,000</quote>;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5D04B7C473414E13A056E35547ADD116"><enum>(2)</enum><text>in paragraph (6)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idB522AD34D785465D8B10172270FF8B60"><enum>(A)</enum><text>by inserting <quote>improve positive outcomes for the child,</quote> before <quote>and increase</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9A30F6474BC042A4B3CEF9DBFCFBE286"><enum>(B)</enum><text>by striking <quote>; and</quote> and inserting a semicolon;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7D5C0C88E2BE4FACB8DC9C719A1134E9"><enum>(3)</enum><text>in paragraph (7), by striking <quote>could be duplicated in many jurisdictions throughout the country.</quote> and inserting <quote>have expanded dramatically throughout the United States; and</quote>; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCACC78820905457C8E48CBBD3B9C13E7"><enum>(4)</enum><text>by adding at the end the following:</text>

 <paragraph commented="no" id="id37fd33f58c784803a0637415244d6b26"><enum>(8)</enum><text>State chapters of children’s advocacy center networks are needed to—</text> <subparagraph commented="no" id="idFB918459DFF640C1A9E48819D936809D"><enum>(A)</enum><text>assist local communities in coordinating their multidisciplinary child abuse investigation, prosecution, and intervention services; and</text>
 </subparagraph><subparagraph commented="no" id="id434E78AD3098418498EFAB3F4EB9E3D2"><enum>(B)</enum><text>provide oversight of, and training and technical assistance in, the effective delivery of evidence-informed programming.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF20925611B7D43059E9761FFBE92AFA6"><enum>(b)</enum><header>Definitions</header><text>Section 212 of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20302">34 U.S.C. 20302</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idEC9206CF3A7A4C3AB3D6D6424D55BB26"><enum>(1)</enum><text>by striking paragraphs (3) and (6);</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC9550D149E01481C9058F0D37D174705"><enum>(2)</enum><text>by redesignating paragraphs (4), (5), (7), (8), and (9) as paragraphs (3), (4), (5), (6), and (7), respectively;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54BA17367F9E4DFCAD8DF1FF8DE4A112"><enum>(3)</enum><text>in paragraph (6), as so redesignated, by striking <quote>and</quote> at the end;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39517F67A6344682AE8811E8A1FE2ADA"><enum>(4)</enum><text>in paragraph (7), as so redesignated, by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84B0EAB66CE747959BE5EB676796B745"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id3f24d65dbf224e0ca7e323bd71710771" reported-display-style="strikethrough" style="OLC"> <paragraph id="id4fdc7b7ff54c40e3a385bfefb519dff2"><enum>(8)</enum><text>the term <term>State chapter</term> means a membership organization that provides technical assistance, training, coordination, grant administration, oversight, and support to local children's advocacy centers, multidisciplinary teams, and communities working to implement a multidisciplinary response to child abuse in the provision of evidence-informed initiatives, including mental health counseling, forensic interviewing, multidisciplinary team coordination, and victim advocacy.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCD46C10D120D41358C0F31EDD05E61E4"><enum>(c)</enum><header>Regional children's advocacy centers</header><text>Section 213 of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20303">34 U.S.C. 20303</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idCB296A5DB7A14FDC990B7DBF4B3AEFB6"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id30B8BD442A57402B8046A8D862F9956D"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>with the Director and</quote></text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF4EC9F28457F4C72A3709C6B8E3B88A3"><enum>(B)</enum><text>by striking paragraph (2);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFB7DC7EA4CEC4118BE1B4AFE611B06E4"><enum>(C)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively;</text>

 <subparagraph id="idE2F90B082A69405195BAE6566D6DCC90"><enum>(A)</enum><text>local children’s advocacy centers; and</text> </subparagraph><subparagraph id="id5CFFC646DD9C48C4BA26C358E798A1B3"><enum>(B)</enum><text>communities that want to develop local children's advocacy centers.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id70AED538959F41C59E337299746BDBBA"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2B591F4E5EED4305A73FC1827B26FB01"><enum>(A)</enum><text>in paragraph (1)—</text>

 <clause commented="no" display-inline="no-display-inline" id="idA42F876B934C4461ADAE6F347AAAD4EE"><enum>(i)</enum><text>in subparagraph (A)—</text> <subclause commented="no" display-inline="no-display-inline" id="id7822E2967CD94C83A3C1A2FA9E5BC4C7"><enum>(I)</enum><text>in the matter preceding clause (i), by striking <quote>communities</quote> and inserting <quote>communities, local children's advocacy centers, multidisciplinary teams, and State chapters</quote>;</text>

 <subclause id="id59229A6541E14C2099BACA49E42EED11"><enum>(I)</enum><text>organizational support and development;</text> </subclause><subclause id="id9EF376030DBE467799A34677099BF15C"><enum>(II)</enum><text>programmatic evaluation; and</text>
 </subclause><subclause id="idC06705CE91604F2FA5A3CDA1CFE80B1F"><enum>(III)</enum><text>financial oversight of Federal funding;</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id24DD99220B1A48F987872A1BB77C1770"><enum>(V)</enum><text>in clause (iii), as so redesignated, by striking <quote>a freestanding facility where interviews of and services for abused children can be provided</quote> and inserting <quote>child-friendly facilities for the investigation of, assessment of, and intervention in abuse</quote>; and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="idA5FD0E6B1F754E9C9EDF0CB48D8F3F2C"><enum>(VI)</enum><text>in clause (iv), as so redesignated, by striking <quote>multiple</quote> and inserting <quote>duplicative</quote>; and</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="id341997267F544228896CD9A5930C3A61"><enum>(ii)</enum><text>in subparagraph (B), by inserting <quote>and interested communities</quote> after <quote>advocacy centers</quote>;</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25A5FF8D048B4D898B8AF05083B5E904"><enum>(3)</enum><text>in subsection (c)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id6E091D89EABB4F43904973A895EE8BC3"><enum>(A)</enum><text>in paragraph (2)(C), by striking <quote>remedial counseling to</quote> and inserting <quote>evidence-informed services for</quote>;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id543AC24164D240AEA55297498D3332A4"><enum>(B)</enum><text>in paragraph (3)(A)(ii), by striking <quote>multidisciplinary child abuse program</quote> and inserting <quote>children's advocacy center</quote>; and</text>

 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7FF3FFB1052D487E82542402DF8D2097"><enum>(d)</enum><header>Local children's advocacy centers</header><text>Section 214 of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20304">34 U.S.C. 20304</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idBF636717F83B46D5B0083167E9CD0E2D"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id251F9A49C099467B8BE295E7F09AC2D6" reported-display-style="strikethrough" style="OLC"> <subsection id="id117524304934446C9DBB9016858D837F"><enum>(a)</enum><header>In general</header><text>The Administrator, in coordination with the Director of the Office of Victims of Crime, shall make grants to—</text>
 <paragraph id="id649AC667666645198DC638BB113357AA"><enum>(1)</enum><text>develop and enhance multidisciplinary child abuse investigations, intervention, and prosecution; and</text>
 </paragraph><paragraph id="idC18252632E944E4D8374DACED80C128F"><enum>(2)</enum><text>promote the effective delivery of the evidence-informed Children’s Advocacy Model and the multidisciplinary response to child abuse, including best practices in programmatic evaluation and financial oversight of Federal funding.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD67F7FE74A794DF095C73AB65A404F5A"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id0DB52EB3D9F54B27A190BA4E8D69B1F8"><enum>(A)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">human trafficking and</header-in-text></quote> before <quote><header-in-text level="subsection" style="OLC">child pornography</header-in-text></quote>;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8E399DA4F652494E940EA8E89A8A67A5"><enum>(B)</enum><text>by striking <quote>with the Director and</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2AFCBDE71B6B4256B0D4CA1E4E4B124F"><enum>(C)</enum><text>by inserting <quote>human trafficking and</quote> before <quote>child pornography</quote>;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75C55945BE82471CA21A70D6DF86C3CE"><enum>(3)</enum><text>in subsection (c)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id5988EC06BC1B4149A00E137E2F8ADA8F"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause commented="no" display-inline="no-display-inline" id="id12B03B51F5B64D4B8C2ED59AEC7A509D"><enum>(i)</enum><text>by striking <quote>Director</quote> and inserting <quote>Administrator</quote>; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id717132A1272C4D8DBF08477E4DD52DD0"><enum>(ii)</enum><text>by striking <quote>this section</quote> and inserting <quote>subsections (a) and (b)</quote>; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1544AAD0455541218EDC19F3977BC051"><enum>(B)</enum><text>in paragraph (2)—</text> <clause commented="no" display-inline="no-display-inline" id="idA72E045CEC1D49FDACF3FB05442FC1F7"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>social service</quote> and inserting <quote>child protective service</quote>;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idCA2F926980A2434FB44AE7684138B9D1"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>the <quote>counseling center</quote></quote> and inserting <quote>a <quote>children's advocacy center</quote></quote>;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id79190CEF6BA74F3D92A566A6294C5382"><enum>(iii)</enum><text>in subparagraph (C), by striking <quote>sexual and serious physical abuse and neglect cases to the counseling center</quote> and inserting <quote>child abuse cases that meet designated referral criteria to the children's advocacy center</quote>;</text>

 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5C9AD0C7EF764391921F2D9FBE1EE63C"><enum>(e)</enum><header>Grants for specialized technical assistance and training programs</header><text>Section 214A of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20305">34 U.S.C. 20305</external-xref>) is amended—</text>

 <subparagraph id="id3CC24815BC3B49D383B8E9E5AF79B13B"><enum>(A)</enum><text>a diverse portfolio of training and technical resources for the diverse professionals responding to child abuse, including a digital library to promote evidence-informed practice; and</text>
 </subparagraph><subparagraph id="id58E28567F2B043608C0BAC7DA82B8B77"><enum>(B)</enum><text>demonstrated experience in providing training and technical assistance for child abuse professionals, especially law enforcement officers, child protective service workers, prosecutors, forensic interviewers, medical professionals, victim advocates, and mental health professionals.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>

 </clause><clause commented="no" display-inline="no-display-inline" id="id43a576e6-f62d-4315-8f30-ceb745646272"><enum>(vi)</enum><text>by redesignating subparagraphs (F) through (J) as subparagraphs (E) through (I), respectively;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id4d20a3f3-8807-4f3d-8b62-76d2e0ffa905"><enum>(vii)</enum><text>in subparagraph (E), as so redesignated, by striking <quote>counseling center</quote> and inserting <quote>children’s advocacy center or an agency with which there is a linkage agreement regarding the delivery of multidisciplinary child abuse investigation, prosecution, and intervention services</quote>;</text>

 <subsection id="id8eab437f-0551-447b-af97-2372007b309c"><enum>(f)</enum><header>Grants to State chapters for assistance to local children's advocacy centers</header><text>In awarding grants under this section, the Administrator shall ensure that a portion of the grants is distributed to State chapters to enable State chapters to provide technical assistance, training, coordination, and oversight to other recipients of grants under this section in providing evidence-informed initiatives, including mental health counseling, forensic interviewing, multidisciplinary team coordination, and victim advocacy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id847a30b0-3874-40a7-9497-36aab3132953"><enum>(e)</enum><header>Grants for specialized technical assistance and training programs</header><text>Section 214A of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20305">34 U.S.C. 20305</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="ide1371315-331d-407f-abe0-003f3b67873e"><enum>(1)</enum><text>in subsection (a), by striking <quote>to attorneys</quote> and all that follows and inserting the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="yes-display-inline" id="id445ead8a-f990-4e17-969d-85fee9bc8c0d" reported-display-style="italic" style="OLC"> <text>to—</text><paragraph commented="no" display-inline="no-display-inline" id="idbdb86bbe-5cbc-4996-b32a-76e7a034d6da"><enum>(1)</enum><text>attorneys and other allied professionals instrumental to the criminal prosecution of child abuse cases in State or Federal courts, for the purpose of improving the quality of criminal prosecution of such cases; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01ac85b0-f7bd-47e0-89d4-921f6711e957"><enum>(2)</enum><text>child abuse professionals instrumental to the protection of children, intervention in child abuse cases, and treatment of victims of child abuse, for the purpose of—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id6e6e74ed-96cb-4585-9d14-be9017fdfd76"><enum>(A)</enum><text>improving the quality of such protection, intervention, and treatment; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3eb71b0f-97d3-4c92-8b26-689612232407"><enum>(B)</enum><text>promoting the effective delivery of the evidence-informed Children’s Advocacy Model and the multidisciplinary response to child abuse, including best practices in programmatic evaluation and financial oversight of Federal funding.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56eedc6d-f913-474f-95af-52a9b9580fe1"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id4a7884d9-e904-4b1d-a28d-ef57b5467845" reported-display-style="italic" style="OLC"> <subsection id="id2f64474c-2e29-4eaf-bc83-091d462b7106"><enum>(b)</enum><header>Grantee organizations</header> <paragraph commented="no" display-inline="no-display-inline" id="idb40e7d0b-0f72-40be-8425-2608d29a8559"><enum>(1)</enum><header>Prosecutors</header><text>An organization to which a grant is made for specific training and technical assistance for prosecutors under subsection (a)(1) shall be one that has—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id0ebb17a1-8087-457d-87cd-9901c87e8f7a"><enum>(A)</enum><text>a broad representation of attorneys who prosecute criminal cases in State courts; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0c41301e-ec1d-41de-9db5-878bb8c5609b"><enum>(B)</enum><text>demonstrated experience in providing training and technical assistance for prosecutors.</text> </subparagraph></paragraph><paragraph id="idea8f9573-f393-4a12-ab9b-095aac460a78"><enum>(2)</enum><header>Child abuse professionals</header><text>An organization to which a grant is made for specific training and technical assistance for child abuse professionals under subsection (a)(2) shall be one that has—</text>
 <subparagraph id="id578bbde7-a955-44b5-9749-5eb2f2f6b686"><enum>(A)</enum><text>a diverse portfolio of training and technical resources for the diverse professionals responding to child abuse, including a digital library to promote evidence-informed practice; and</text>
 </subparagraph><subparagraph id="idb59fcaff-33e9-4a21-91f4-42e3c684760e"><enum>(B)</enum><text>demonstrated experience in providing training and technical assistance for child abuse professionals, especially law enforcement officers, child protective service workers, prosecutors, forensic interviewers, medical professionals, victim advocates, and mental health professionals.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba678e9e-ac6d-4369-8f2a-c8082ba38ea4"><enum>(3)</enum><text>in subsection (c)(2), by inserting after <quote>shall require</quote> the following: <quote>, in the case of a grant made under subsection (a)(1),</quote>.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id088c613d2ed84d96a297e0346aa626ec"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">Section 214B of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/34/20306">34 U.S.C. 20306</external-xref>) is amended—</text>

 <paragraph id="idFDE9FF7D764847EAB97816C2A56C02A7"><enum>(1)</enum><text>summarizes the efforts of the Administrator to monitor and evaluate the regional children's advocacy program activities under section 213(d);</text>
 </paragraph><paragraph id="idF125EFEB1445407D9C04E45E6A949C79"><enum>(2)</enum><text>describes—</text> <subparagraph id="idE6B65DB4AE5F4E448BDA5ADA6D06E5F6"><enum>(A)</enum><text>the method by which amounts are allocated to grantees and subgrantees under this subtitle, including to local children’s advocacy centers, State chapters, and regional children’s advocacy program centers; and</text>
 </subparagraph><subparagraph id="idB72910038E494280A76F931020D1EC09"><enum>(B)</enum><text>steps the Attorney General has taken to minimize duplication and overlap in the awarding of amounts under this subtitle; and</text>

 <subsection id="ida5dbc26b458847899a584d5fc068a2e0"><enum>(a)</enum><header>State plans</header><text>Section 106(b)(2)(B)(vii) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106a">42 U.S.C. 5106a(b)(2)(B)(vii)</external-xref>) is amended to read as follows:</text>

			</subsection><subsection id="id40e14d9a1ae24118b70d062b8e834047"><enum>(b)</enum><header>Federal immunity</header>
 <paragraph id="idA21D2BDD4F2B4E7680A92E61FC16B552"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, any individual making a good faith report to appropriate authorities of a suspected or known instance of child abuse or neglect, or who otherwise, in good faith, provides information or assistance, including medical evaluations or consultations, in connection with a report, investigation, or legal intervention pursuant to a good faith report of child abuse or neglect shall not be subject to civil liability or criminal prosecution, under any Federal law, rising from making such report or providing such information or assistance.</text>
 </paragraph><paragraph id="idB19E9697167C403094D65FDC5946B0BB"><enum>(2)</enum><header>Presumption of good faith</header><text>In a Federal civil action or criminal prosecution brought against a person based on the person's reporting a suspected or known instance of child abuse or neglect, or providing information or assistance with respect to such a report, as described in paragraph (1), there shall be a presumption that the person acted in good faith.</text>
 </paragraph><paragraph id="id323674F613DB4EC0BBFF7A3495A0ED1A"><enum>(3)</enum><header>Costs</header><text>If the defendant prevails in a Federal civil action described in paragraph (2), the court may award costs and reasonable attorney's fees incurred by the defendant.</text></paragraph></subsection></section></legis-body><endorsement><action-date>September 18, 2018</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
