 <section changed="deleted" committee-id="SSJU00" id="H70955DC3EC2F4D4C8DB48A19E227DB77" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Anti-Terrorism Clarification Act of 2018</short-title></quote>.</text> </section><section changed="deleted" committee-id="SSJU00" id="HC90C683474D34C8ABA9890DECF204D66" reported-display-style="strikethrough"><enum>2.</enum><header>Clarification of the term <quote>act of war</quote></header> <subsection id="H53D2C30480354CEC86CD07EFB8E17F38"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2331 of title 18, United States Code, is amended—</text>
 <paragraph id="H57E7C7677105487FB0433A62F230CD37"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="HAB2EEBAB4E694ABC8CDE7B1E888644BE"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="H4EBBD95BD6F44FCFA0F9727C3159F105"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="H36B8FDB0D06B44CDA4796C874D46C06D" reported-display-style="strikethrough" style="USC"> <paragraph id="H2C1EBA46790D476EA5476CA3C7423DF5"><enum>(6)</enum><text display-inline="yes-display-inline">the term <quote>military force</quote> does not include any person that—</text>
 <subparagraph id="H842F42C82F184812A224E3A406C64E0F"><enum>(A)</enum><text>has been designated as a—</text> <clause id="H0F2B6284486C4CEFA4E38D19975BFCEA"><enum>(i)</enum><text display-inline="yes-display-inline">foreign terrorist organization by the Secretary of State under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); or</text>
 </clause><clause id="H719A4C0AD33245A491417B797C535B73"><enum>(ii)</enum><text>Specially Designated Global Terrorist (as such term is defined in section 594.310 of the Code of Federal Regulations) by the Secretary of State or the Secretary of the Treasury; or</text>
 </clause></subparagraph><subparagraph id="H977187C328AB4C11916F9E6713B90B1D"><enum>(B)</enum><text>has been determined by the court to not be a <quote>military force</quote>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H4AFFC1AE677C44DBB45732903ABACAD7"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to any civil action pending on or commenced after the date of the enactment of this Act.</text>
			</subsection></section><section changed="deleted" committee-id="SSJU00" id="H7313101F4A714FFAA1F1F7271CD0031E" reported-display-style="strikethrough"><enum>3.</enum><header>Satisfaction of judgments against terrorists</header>
 <subsection id="H951367527940406099A8974FA6F10BD0"><enum>(a)</enum><header>In general</header><text>Section 2333 of title 18, United States Code, is amended by inserting at the end following:</text> <quoted-block changed="deleted" committee-id="SSJU00" id="H7A1F857E87944A5899932A2107F71062" reported-display-style="strikethrough" style="OLC"> <subsection id="HA4953292C28641009DCC01ACD10FAE83"><enum>(e)</enum><header>Use of blocked assets To satisfy judgments of U.S. nationals</header><text>For purposes of section 201 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/28/1610">28 U.S.C. 1610</external-xref> note), in any action in which a national of the United States has obtained a judgment against a terrorist party pursuant to this section, the term <quote>blocked asset</quote> shall include any asset of that terrorist party (including the blocked assets of any agency or instrumentality of that party) seized or frozen by the United States under section 805(b) of the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1904">21 U.S.C. 1904(b)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H2C7B9E1D4751418FB983DF06A78CC7FE"><enum>(b)</enum><header>Applicability</header><text>The amendments made by this section shall apply to any judgment entered before, on, or after the date of enactment of this Act.</text>
			</subsection></section><section changed="deleted" committee-id="SSJU00" id="ide342e4d3fe7d48d9b0a82d15965b6f55" reported-display-style="strikethrough"><enum>4.</enum><header>Consent of certain parties to personal jurisdiction</header>
 <subsection id="idbce5a528372e41e0827913b491503653"><enum>(a)</enum><header>In general</header><text>Section 2334 of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="iddeca835f2c584521b0bfe4efcfb735bc" reported-display-style="strikethrough" style="OLC"> <subsection id="id41def594010440f783d43542c07ed9c2"><enum>(e)</enum><header>Consent of certain parties to personal jurisdiction</header><text>For purposes of any civil action under section 2333 of this title, a defendant shall be deemed to have consented to personal jurisdiction in such civil action if, regardless of the date of the occurrence of the act of international terrorism upon which such civil action was filed, the defendant—</text>
 <paragraph id="id53e2e57041ff4ae0984d5560282d1c31"><enum>(1)</enum><text>after the date of enactment of this subsection, accepts—</text> <subparagraph id="idB1862BDCADB642A88D1E539FA7773FC1"><enum>(A)</enum><text>assistance under chapter 4 of part II of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2346">22 U.S.C. 2346</external-xref> et seq.); or</text>
 </subparagraph><subparagraph id="id120c87d95d184b17b4c3453192b49f37"><enum>(B)</enum><text>assistance under section 481 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291">22 U.S.C. 2291</external-xref>) for international narcotics control and law enforcement; or</text>
 </subparagraph></paragraph><paragraph id="ida049fd130cbc4ec295841938acef5144"><enum>(2)</enum><text>in the case of a defendant benefiting from a waiver or suspension of section 1003 of the Anti-Terrorism Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/22/5202">22 U.S.C. 5202</external-xref>)—</text>
 <subparagraph id="id928d46cab3c94ef4ba80afcd14823937"><enum>(A)</enum><text>after the date that is 120 days after the date of enactment of this subsection, continues to maintain any office, headquarters, premises, or other facilities or establishments within the jurisdiction of the United States; or</text>
 </subparagraph><subparagraph id="idfdcb7237f4bc4a5e80c297de7468de5d"><enum>(B)</enum><text>after the date of enactment of this subsection, establishes or procures any office, headquarters, premises, or other facilities or establishments within the jurisdiction of the United States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id509041085bd74f018fa850759aa63e10"><enum>(b)</enum><header>Applicability</header><text>The amendments made by this section shall apply to any civil action filed after the date of enactment of this Act.</text></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause" style="OLC">
 <section changed="added" committee-id="SSJU00" id="id3d091274-5191-4b75-acc5-06f73760bd32" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Anti-Terrorism Clarification Act of 2018</short-title></quote>.</text> </section><section changed="added" committee-id="SSJU00" id="idf8c3bb8d-c711-4dd5-a89a-962735f649d8" reported-display-style="italic"><enum>2.</enum><header>Clarification of the term <quote>act of war</quote></header> <subsection id="id084abc11-c52b-4501-9b55-f9d497fd3774"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2331 of title 18, United States Code, is amended—</text>
 <paragraph id="id6fae3142-7339-4bf0-890f-2db03d531878"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="id9a334e1a-8ab0-4b6f-90b9-1c3185891ff8"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id5fe67410-08bd-42bb-af0d-146a4bc991fb"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idaaee49b8-f34c-4cfc-ad03-f95cfa261eb2" reported-display-style="italic" style="USC"> <paragraph id="idc3b0ef7a-b733-40dd-a9b6-d962907a7c77"><enum>(6)</enum><text display-inline="yes-display-inline">the term <quote>military force</quote> does not include any person that—</text>
 <subparagraph id="id0f8d1959-506c-4580-a941-56e201a2b7c1"><enum>(A)</enum><text>has been designated as a—</text> <clause id="id445ece8f-015a-481c-b93f-1d0799e8649c"><enum>(i)</enum><text display-inline="yes-display-inline">foreign terrorist organization by the Secretary of State under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); or</text>
 </clause><clause id="id5b70e068-7025-4297-9f37-8c38e2ceca74"><enum>(ii)</enum><text>specially designated global terrorist (as such term is defined in section 594.310 of title 31, Code of Federal Regulations) by the Secretary of State or the Secretary of the Treasury; or</text>
 </clause></subparagraph><subparagraph id="idb9d45944-39f5-4f64-a4c4-e12a43ae53b5"><enum>(B)</enum><text>has been determined by the court to not be a <quote>military force</quote>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id088e14db-fbcd-4b71-9e2a-c19c7435b6bf"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to any civil action pending on or commenced after the date of the enactment of this Act.</text>
			</subsection></section><section changed="added" committee-id="SSJU00" id="id1bea2f0d-dab3-4259-a3e6-75a3e1d8cc1d" reported-display-style="italic"><enum>3.</enum><header>Satisfaction of judgments against terrorists</header>
 <subsection id="ida0d78316-8bcb-493c-a78d-a4e5ace8deb6"><enum>(a)</enum><header>In general</header><text>Section 2333 of title 18, United States Code, is amended by inserting at the end following:</text> <quoted-block changed="added" committee-id="SSJU00" id="idc3f57ca7-7cff-4acf-997f-c17089cbccae" reported-display-style="italic" style="OLC"> <subsection id="id00d1a761-52d5-40e5-b4c0-2f62166c6476"><enum>(e)</enum><header>Use of blocked assets to satisfy judgments of U.S. nationals</header><text>For purposes of section 201 of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/28/1610">28 U.S.C. 1610</external-xref> note), in any action in which a national of the United States has obtained a judgment against a terrorist party pursuant to this section, the term <quote>blocked asset</quote> shall include any asset of that terrorist party (including the blocked assets of any agency or instrumentality of that party) seized or frozen by the United States under section 805(b) of the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1904">21 U.S.C. 1904(b)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section changed="added" committee-id="SSJU00" id="id37cc4bc0-c84b-46cb-8b2a-30281902a323" reported-display-style="italic"><enum>4.</enum><header>Consent of certain parties to personal jurisdiction</header>
 <subsection id="id937de8d3-c4ed-42ca-a3c3-7decabb8d306"><enum>(a)</enum><header>In general</header><text>Section 2334 of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id93a6bb10497a40b6af422029dd5765db" reported-display-style="italic" style="OLC"> <subsection id="id69ff312580844a5c90a70d1f0779799e"><enum>(e)</enum><header>Consent of certain parties to personal jurisdiction</header> <paragraph id="idb8106cfb9f084171aac73c7eac625e35"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), for purposes of any civil action under section 2333 of this title, a defendant shall be deemed to have consented to personal jurisdiction in such civil action if, regardless of the date of the occurrence of the act of international terrorism upon which such civil action was filed, the defendant—</text>
 <subparagraph id="idbcdd6a6d55ed418b927b89c00650ae3a"><enum>(A)</enum><text>after the date that is 120 days after the date of enactment of this subsection, accepts—</text> <clause id="idfb7052f29dd04d279cc871c0bf9dbabc"><enum>(i)</enum><text>any form of assistance, however provided, under chapter 4 of part II of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2346">22 U.S.C. 2346</external-xref> et seq.);</text>
 </clause><clause id="idf3407ab9fe064bc3a0a6797c16da78d6"><enum>(ii)</enum><text>any form of assistance, however provided, under section 481 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291">22 U.S.C. 2291</external-xref>) for international narcotics control and law enforcement; or</text>
 </clause><clause id="id73beb439e63b4b638fc332131da0c903"><enum>(iii)</enum><text>any form of assistance, however provided, under chapter 9 of part II of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2349bb">22 U.S.C. 2349bb</external-xref> et seq.); or</text>
 </clause></subparagraph><subparagraph id="id989a2019e1494d30bf9c4aabfa4371a9"><enum>(B)</enum><text>in the case of a defendant benefiting from a waiver or suspension of section 1003 of the Anti-Terrorism Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/22/5202">22 U.S.C. 5202</external-xref>) after the date that is 120 days after the date of enactment of this subsection—</text>
 <clause id="idcc3948942a71494791223ec670693773"><enum>(i)</enum><text>continues to maintain any office, headquarters, premises, or other facilities or establishments within the jurisdiction of the United States; or</text>
 </clause><clause id="id878a9fc050dc427c88244721bab3face"><enum>(ii)</enum><text>establishes or procures any office, headquarters, premises, or other facilities or establishments within the jurisdiction of the United States.</text>
 </clause></subparagraph></paragraph><paragraph id="id23396ce413354e998c57cbd5553b51d6"><enum>(2)</enum><header>Applicability</header><text>Paragraph (1) shall not apply to any defendant who ceases to engage in the conduct described in paragraphs (1)(A) and (1)(B) for 5 consecutive calendar years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id963f63c2-aec1-4072-9333-53c4295c60b5"><enum>(b)</enum><header>Applicability</header><text>The amendments made by this section shall take effect on the date of enactment of this Act.</text></subsection></section></legis-body><endorsement><action-date>July 12, 2018</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
