		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Elder Poverty Relief Act</short-title></quote>.</text>
		</section><section id="id78E3B69C6E97424CB45FBB5C03CF112E"><enum>2.</enum><header>Poverty relief
		benefit</header>
			<subsection id="id3786CF732FA146F9A64F08D8CEDAD87F"><enum>(a)</enum><header>In
 general</header><text>Title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/201">42 U.S.C. 201</external-xref> et seq.) is amended by adding at the end the following new section:</text>
 <quoted-block act-name="" id="id742D51DFB8364F92A4077ECC682C7188" style="traditional"><section id="idE8AE9EF26828497B8231BAB14A40ABCB"><enum>235.</enum><header>Poverty relief benefit</header><subsection commented="no" display-inline="yes-display-inline" id="idA9F732CF4719406B800EFD8D0D21723A"><enum>(a)</enum><text>Subject to subsection (d), any eligible individual shall be entitled to a poverty relief benefit that shall be—</text>
 <paragraph id="id231BD957436C45D8A5E54DC7F0AE9A80" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">in addition to any other amounts to which the individual is entitled under this title;</text>
 </paragraph><paragraph id="idD7C5594807B048308A12FBE68A1F267D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">certified and paid monthly in such manner as the Commissioner of Social Security (referred to in this section as the <term>Commissioner</term>) considers appropriate; and</text>
 </paragraph><paragraph id="idC5246D5B3D9649EDB89C6CE3BA28DC74" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">equal to the monthly benefit amount determined under subsection (b).</text> </paragraph></subsection><subsection id="idBF66B3FF1DCA4409B4B0EC8F9ED87178"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idD9A2A65D23A447CB855E54D945F65233"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraph (4), the monthly benefit amount determined under this subsection for any calendar year shall be a dollar amount equal to <fraction>1/12</fraction>th of 2 percent of the national average wage index for the year (as defined in section 209(k)(1)).</text>
 </paragraph><paragraph id="id64337A786D844BB2847BA9212C00510C" indent="up1"><enum>(2)</enum><text>If the monthly benefit amount determined under paragraph (1) is not a whole dollar, such amount shall be rounded down to the next lower whole dollar.</text>
 </paragraph><paragraph id="idEA034BAF744F436D939DF5C3EBCB81EB" indent="up1"><enum>(3)</enum><text>The Commissioner shall determine the monthly benefit amount under this subsection for each calendar year not later than October 1 of the preceding calendar year, based on the most recent data that is available.</text>
 </paragraph><paragraph id="id6EDF181A13A743399381B644527CFC12" indent="up1"><enum>(4)</enum><text>If the monthly benefit amount determined for a calendar year under paragraph (1) is less than the monthly benefit amount determined for any previous calendar year, the highest monthly benefit amount determined for a previous year shall be the monthly benefit amount for the calendar year involved.</text>
 </paragraph><paragraph id="id819C11D1282547DF9273B4194B03E508" indent="up1"><enum>(5)</enum><text>For purposes of a monthly benefit amount payable to an eligible individual pursuant to this section, such amount shall be payable for each month during the 12-month period from the month of December of the applicable calendar year under such subsection through the month of November of the subsequent calendar year.</text>
 </paragraph></subsection><subsection id="id49A8206CB5F847F0A17861CFC58BF554"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id8CD17961EB904934981C25E030DF2453"><enum>(1)</enum><text>For purposes of this section, the term <term>eligible individual</term> means any of the following:</text> <subparagraph id="idEE9C74ADD9F344808CBFA981748E7283" indent="up2"><enum>(A)</enum><text>An individual who—</text>
 <clause id="id2630FEBA0F164799B1756E2B575019C5"><enum>(i)</enum><text>is entitled to a monthly benefit under subsections (a) through (h) of section 202 or section 223(a); and</text>
 </clause><clause id="id343277003460415C821D0C30797E9F43"><enum>(ii)</enum><text>attains 82 years of age or 240 benefit months (as defined in paragraph (3)) on the basis of the wages and self-employment income of 1 individual, whichever is earlier.</text>
 </clause></subparagraph><subparagraph id="id5F1FDFB52BEF467FBCBF0D6373E75133" indent="up2"><enum>(B)</enum><text>An individual who—</text> <clause id="idC598CF32B62149A8BD0F63551E65053E"><enum>(i)</enum><text>is eligible for supplemental security income benefits under title XVI; and</text>
 </clause><clause id="id1EC94102030A4FDF9E94E57D89E5DB93"><enum>(ii)</enum><text>attains retirement age (as defined in section 216(l)) or 240 benefit months (as defined in paragraph (3)), whichever is earlier.</text>
 </clause></subparagraph><subparagraph id="id9D086A11E8334005A026BF2BC2FD2825" indent="up2"><enum>(C)</enum><text>An individual who—</text> <clause id="idDD4CF61237A0425F8800E46369EF2D3B"><enum>(i)</enum><text>is entitled to a monthly benefit under subsections (a) through (h) of section 202;</text>
 </clause><clause id="idC2C7B5872D13486094F79D7B97E84015"><enum>(ii)</enum><text>attains retirement age (as defined in section 216(l));</text> </clause><clause id="idC5C92CD07CFC45D2BD5DC99AED6A391E"><enum>(iii)</enum><text>has average indexed monthly earnings which do not exceed the amount specified in subparagraph (B) of section 215(a)(1) for the purposes of clause (i) of subparagraph (A) of such section 215(a); and</text>
 </clause><clause commented="no" id="idBFBCBA27CA0B48378B8FCEC98D83748E"><enum>(iv)</enum><text>has not less than 11 years of coverage (as defined for purposes of section 215(a)(7)(D)).</text> </clause></subparagraph></paragraph><paragraph id="id820ADF5D90074CB4B2382F69D05C596E" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA17BD1E96BDB42BFB6F07A12A473E596"><enum>(A)</enum><text>An individual’s entitlement to a poverty relief benefit under this section shall be suspended if, during any month, the individual ceases to be an eligible individual.</text>
 </subparagraph><subparagraph id="idCA672B0E546945DBB21FA2FBBB853520" indent="up1"><enum>(B)</enum><text>In the case of an individual described in subparagraph (A) who subsequently satisfies the requirements under paragraph (1), such individual shall be reentitled to a poverty relief benefit under this section.</text>
 </subparagraph></paragraph><paragraph id="id8482AB0090C6419D9CFFF4C82719F082" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1C6FCED5C2EF465581E920693E2457E1"><enum>(A)</enum><text>Subject to subparagraphs (B) and (C), for purposes of this subsection, the term <term>benefit month</term> means a month for which an individual has—</text>
 <clause id="id0998B9ED5A8F4290A04DA0F17D01C0C9" indent="up1"><enum>(i)</enum><text>attained age 19; and</text> </clause><clause id="idDD5AC353953E42BFA2891AC06D1F8BC2" indent="up1"><enum>(ii)</enum><text>been—</text>
 <subclause id="idD10D1AE6AB86438A9DE75087C0840542"><enum>(I)</enum><text>entitled to a monthly benefit under subsections (a) through (h) of section 202 or section 223(a); or</text>
 </subclause><subclause id="idED6185B2735F42509B1D57ECC8CB391E"><enum>(II)</enum><text>eligible for supplemental security income benefits under title XVI.</text>
 </subclause></clause></subparagraph><subparagraph id="id45988EC319D44B8D82859D8DC4448D83" indent="up1"><enum>(B)</enum><text>The term <term>benefit month</term> shall not include any month in which an individual is—</text> <clause id="id0297A42205CD4BF4AB88136B2CE029F6"><enum>(i)</enum><text>entitled to a benefit under section 202 that is not payable or reduced to zero by application of subsection (k), (n), (t), (u), (v), or (x) of such section and is not eligible for a benefit under title XVI (or is eligible for a benefit under such title but the benefit is not payable or reduced to zero);</text>
 </clause><clause id="id015A59D7069F44ADB5F3E215C328E99C"><enum>(ii)</enum><text>eligible for a benefit under title XVI that is not payable or reduced to zero and is not entitled to a benefit under sections 202 or 223 (or is entitled to a benefit under such section 202 but the benefit is not payable or reduced to zero); or</text>
 </clause><clause id="id26D92C30402D483E91397401EBC0B604"><enum>(iii)</enum><text>subject to a penalty under section 1129A.</text> </clause></subparagraph><subparagraph commented="no" id="id613F3C11326A4B1285CD95C514ADCEF2" indent="up1"><enum>(C)</enum><text>In the case of an individual who is entitled to a monthly insurance benefit described in subclause (I) of subparagraph (A)(ii) on the basis of the wages and self-employment income of more than 1 individual, a benefit month shall be determined based on the wages and self-employment income that are the basis of the largest benefit to which such individual is entitled for such month.</text>
 </subparagraph></paragraph></subsection><subsection id="id4E58E816716B4BD38B93DF6A6E4E8790"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idD1F2E79134D24971A2812EE3CA8F350C"><enum>(1)</enum><text display-inline="yes-display-inline">In no case shall an eligible individual be entitled to more than 1 poverty relief benefit under this section for any month.</text>
 </paragraph><paragraph id="id13D21149224E43058048D393351EA349" indent="up1"><enum>(2)</enum><text>For any month in which an eligible individual is entitled to a monthly benefit described in subsection (c)(1)(A)(i) on the basis of the wages and self-employment income of more than 1 individual, a poverty relief benefit under this section may only be paid for such month on the basis of the wages and self-employment that are the basis for the largest monthly benefit to which such individual is entitled for such month.</text>
 </paragraph><paragraph id="idEDCF0DBB26784571AB88AC2F327F2B5D" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Any amounts provided to an eligible individual pursuant to this section shall not be regarded as income or earnings for purposes of determining the eligibility of the recipient for benefits or assistance, or the amount or extent of benefits or assistance, under any Federal program or under any State or local program financed in whole or in part with Federal funds, or the eligibility for or extent of benefits or assistance under such programs of any individual for whom the income of the recipient is counted.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id1694C0777C1D4A769DABF4B53F72F42A"><enum>(b)</enum><header>Railroad Retirement Act</header><text>Section 19 of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231r">45 U.S.C. 231r</external-xref>) is amended—</text> <paragraph id="idAD774B64723B422A805E1125A467DF78"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e);</text>
 </paragraph><paragraph id="idDAFF9FB7567046198EC32ECA41CEA6E3"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text> <quoted-block act-name="" id="idF2848376E02F48EFBD353F8922DFA280" style="traditional"> <subsection commented="no" id="id2D2C50859F104050B4CE2832C40E6AF4"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idE6454F4A270B46678397C5BA724E35F5"><enum>(1)</enum><text display-inline="yes-display-inline">An individual entitled to an annuity component computed under section 3(a)(1), 4(a)(1), or 4(f)(1) of this Act shall be entitled to the benefit described in section 235 of the Social Security Act, subject to the requirements and conditions set forth therein.</text>
							</paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idD71CB9E0E6D540E7BDA9EFB30887E72E"><enum>(3)</enum><text>in subsection (e), as so redesignated, by striking <quote>subsection (a), (b), or (c)</quote> each place it appears and inserting <quote>subsection (a), (b), (c), or (d)</quote>.</text> </paragraph></subsection><subsection id="id1F22048263CE49AB9A429FD0588810A6"><enum>(c)</enum><header>Source of funds</header><text>Subsection (h) of section 201 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref>) is amended to read as follows:</text>
				<quoted-block act-name="" id="id7E50F6E2CE804BAFB91C05B39F2DA09C" other-style="archaic" style="other">
 <subsection id="id3F8A7EC7565C4115AE59DB70F707BDAC"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idFC654D5524594E628274F22C74CBCB42"><enum>(1)</enum><text>Benefit payments required to be made under section 223, and benefit payments required to be made under subsection (b), (c), or (d) of section 202 to individuals entitled to benefits on the basis of the wages and self-employment income of an individual entitled to disability insurance benefits, shall be made only from the Federal Disability Insurance Trust Fund. All other benefit payments required to be made under this title (other than sections 226 and 235) shall be made only from the Federal Old-Age and Survivors Insurance Trust Fund.</text>
 </paragraph><paragraph id="idE5B49F581FE44A3485F4BD972C8B479F" indent="up1"><enum>(2)</enum><text>Any benefit payment required to made under section 235 to an individual entitled to a poverty relief benefit under such section shall be made—</text>
 <subparagraph id="id4CC3B18AC2FC45FB83928B3B7642274B"><enum>(A)</enum><text>in the case of an individual who is also entitled to a benefit under section 202 or 223, from the same trust fund from which the individual's benefit under section 202 or 223 is made; and</text>
 </subparagraph><subparagraph id="id9143AED9C1E24AF493A425766293955A"><enum>(B)</enum><text>in the case of an individual who is not entitled to a benefit under section 202 or 223, from funds appropriated for such purpose pursuant to the authorization of appropriations in section 1601.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="id1DFE1568A18A43C5BB2045BF03363922"><enum>(d)</enum><header>Authorization of appropriations</header><text>Section 1601 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381</external-xref>) is amended by striking <quote>there are authorized</quote> and all that follows through the period and inserting the following: <quote>and to make poverty relief benefit payments under section 235 to individuals who are described in section 201(h)(2)(B), there are authorized to be appropriated sums sufficient to carry out this title and make such payments.</quote>.</text>
			</subsection><subsection id="idEFE03EA3729947A3B12BBC0949B0D4CD"><enum>(e)</enum><header>Effective
 date</header><text>The amendments made by this section shall apply to benefits payable for months beginning after November 2018.</text>
