		<official-title>To amend title 17, United States Code, to implement the Marrakesh Treaty, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marrakesh Treaty Implementation Act</short-title></quote>.</text>
		</section><section id="id17052AE07D4241928BC712F528AFCEC6"><enum>2.</enum><header>Implementation amendments</header>
 <subsection id="idCD30FC5C4CD542C892805D9415F19601"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/17/1">Chapter 1</external-xref> of title 17, United States Code, is amended—</text> <paragraph id="id4A7CBE93309B4D6C8D93F5B53D83C93A"><enum>(1)</enum><text>in section 121—</text>
 <subparagraph id="id8CB521C1D0B04424BC31441FD7A0FD2E"><enum>(A)</enum><text>in subsection (a)—</text> <clause id="id93D8176E31F04F20A89A29F75626BBF3"><enum>(i)</enum><text>by inserting <quote>in the United States</quote> after <quote>distribute</quote>;</text>
 </clause><clause id="id02F54DFA8B1C4CD19C52D88FC8F3C465"><enum>(ii)</enum><text>by striking <quote>, nondramatic</quote>;</text> </clause><clause id="id2A1E1B2B2F714571BAF2BB9A465FE6E1"><enum>(iii)</enum><text>by inserting <quote>or of a previously published musical work that has been fixed in the form of text or notation</quote> after <quote>literary work</quote>;</text>
 </clause><clause id="id564A4E0B4F9A4334AF70EAF51B6F8661"><enum>(iv)</enum><text>by striking <quote>specialized formats</quote> and inserting <quote>accessible formats</quote>; and</text> </clause><clause id="id0177697FC56146C88F1711659D9081E8"><enum>(v)</enum><text>by striking <quote>blind or other persons with disabilities</quote> and inserting <quote>eligible persons</quote>;</text>
 </clause></subparagraph><subparagraph id="id7186E07B20364146A928AF74E9E687EC"><enum>(B)</enum><text>in subsection (b)(1)—</text> <clause id="id4080ADCFFB824CA899BDE18DE83283F1"><enum>(i)</enum><text>in subparagraph (A)—</text>
 <subclause id="id1C31B44507AE44469AC45F52D4C79AB7"><enum>(I)</enum><text>by inserting <quote>in the United States</quote> after <quote>distributed</quote>;</text> </subclause><subclause id="idB2CBE5F6CC8A4532B59915197D16BB19"><enum>(II)</enum><text>by striking <quote>a specialized format</quote> and inserting <quote>an accessible format</quote>; and</text>
 </subclause><subclause id="id57FE21E671114688B1533583D067E654"><enum>(III)</enum><text>by striking <quote>blind or other persons with disabilities</quote> and inserting <quote>eligible persons</quote>; and</text> </subclause></clause><clause id="id133AFFE22F34402F968CB6D216878D14"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>a specialized format</quote> and inserting <quote>an accessible format</quote>;</text>
 </clause></subparagraph><subparagraph id="idD0C47F88131F4B84B17D85F98374A0F3"><enum>(C)</enum><text>in subsection (c)(3), by striking <quote>specialized formats</quote> and inserting <quote>accessible formats</quote>; and</text> </subparagraph><subparagraph id="id9744A640F10544D6A1D3A782E7541B82"><enum>(D)</enum><text>in subsection (d)—</text>
 <clause id="id64238CEA0F8C4CAAB56145609BA16F26"><enum>(i)</enum><text>by striking paragraphs (2) and (4);</text> </clause><clause id="idD1FC2340EC034A6BBB302EC0E860B457"><enum>(ii)</enum><text>by redesignating paragraph (1) as paragraph (2);</text>
 </clause><clause id="id2C59E8F968E74959ABC75FB9C9DF7988"><enum>(iii)</enum><text>by redesignating paragraph (3) as paragraph (4);</text> </clause><clause id="idCD27306472814EB0B7A98638F47B83A5"><enum>(iv)</enum><text>by inserting before paragraph (2), as so redesignated, the following:</text>
							<quoted-block display-inline="no-display-inline" id="id2B8C01ACE16A4CAD977FE9E1C8893159" style="OLC">
 <paragraph id="id4D155311B9CF463F990FC0D58C0CBD06"><enum>(1)</enum><text><term>accessible format</term> means an alternative manner or form that gives an eligible person access to the work when the copy or phonorecord in the accessible format is used exclusively by the eligible person to permit him or her to have access as feasibly and comfortably as a person without such disability as described in paragraph (3);</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </clause><clause id="id4E960B937A44400B95CDC78207D9F637"><enum>(v)</enum><text>by inserting after paragraph (2), as so redesignated, the following:</text> <quoted-block display-inline="no-display-inline" id="id6FD5595E18424EB7A0E373E64A605626" style="OLC"> <paragraph id="idD257FA6916B84C4F9EBE56963A03197E"><enum>(3)</enum><text><term>eligible person</term> means an individual who, regardless of any other disability—</text>
 <subparagraph id="id06B63776DD6B4A1BB3B42B2E614247B8"><enum>(A)</enum><text>is blind;</text> </subparagraph><subparagraph id="id6D72E0C1C2624F4BB6310BCD805B0FE0"><enum>(B)</enum><text>has a visual impairment or perceptual or reading disability that cannot be improved to give visual function substantially equivalent to that of a person who has no such impairment or disability and so is unable to read printed works to substantially the same degree as a person without an impairment or disability; or</text>
 </subparagraph><subparagraph id="idb09420bc61104defb89e2bed9cf1dd38"><enum>(C)</enum><text>is otherwise unable, through physical disability, to hold or manipulate a book or to focus or move the eyes to the extent that would be normally acceptable for reading; and</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="idD79E50162B254DBB8011983D7F7CE1B8"><enum>(vi)</enum><text>in paragraph (4), as so redesignated, by striking <quote>; and</quote> at the end and inserting a period; and</text> </clause></subparagraph></paragraph><paragraph id="idF452D4EED9054E01B39F08FAC45DD7B9"><enum>(2)</enum><text>by inserting after section 121 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id797E9DBAFA0D4B6CBEAF9DA168CB4F5B" style="USC">
						<section id="idCA3F05708110456488ED7D73F4BA17C3"><enum>121A.</enum><header>Limitations on exclusive rights: reproduction for blind or other people with disabilities in
			 Marrakesh Treaty countries</header>
 <subsection id="idF8A4802EBD3B4169B4758304167CE364"><enum>(a)</enum><text>Notwithstanding the provisions of sections 106 and 602, it is not an infringement of copyright for an authorized entity, acting pursuant to this section, to export copies or phonorecords of a previously published literary work or of a previously published musical work that has been fixed in the form of text or notation in accessible formats to another country when the exportation is made either to—</text>
 <paragraph id="id68e1c29c97e9409d89df048220653773"><enum>(1)</enum><text>an authorized entity located in a country that is a Party to the Marrakesh Treaty; or</text> </paragraph><paragraph id="id8db3cf3c72a74dd0acd79d36090953d0"><enum>(2)</enum><text>an eligible person in a country that is a Party to the Marrakesh Treaty,</text>
								</paragraph><continuation-text continuation-text-level="subsection">if prior to the exportation of such copies or phonorecords, the authorized entity engaged in the
			 exportation did not know or have reasonable grounds to know that the
 copies or phonorecords would be used other than by eligible persons.</continuation-text></subsection><subsection id="id9B644CF9C96F487DBB69D8312A8B5B85"><enum>(b)</enum><text>Notwithstanding the provisions of sections 106 and 602, it is not an infringement of copyright for an authorized entity or an eligible person, or someone acting on behalf of an eligible person, acting pursuant to this section, to import copies or phonorecords of a previously published literary work or of a previously published musical work that has been fixed in the form of text or notation in accessible formats.</text>
 </subsection><subsection id="id5edc7c2cf8184b3daeeea999b0378fc3"><enum>(c)</enum><text>In conducting activities under subsection (a) or (b), an authorized entity shall establish and follow its own practices, in keeping with its particular circumstances, to—</text>
 <paragraph id="id23b0fd15d2b2401cae1650f31e365bc6"><enum>(1)</enum><text>establish that the persons the authorized entity serves are eligible persons;</text> </paragraph><paragraph id="id8ba0e2b0ec704ed1a71f3265d6ef4dce"><enum>(2)</enum><text>limit to eligible persons and authorized entities the distribution of accessible format copies by the authorized entity;</text>
 </paragraph><paragraph id="id17bdc8fd06414302b1b96dfd9f24f29f"><enum>(3)</enum><text>discourage the reproduction and distribution of unauthorized copies;</text> </paragraph><paragraph id="id16a148cd09d24b9ab16c0a5b3fa176d6"><enum>(4)</enum><text>maintain due care in, and records of, the handling of copies of works by the authorized entity, while respecting the privacy of eligible persons on an equal basis with others; and</text>
 </paragraph><paragraph id="id3df8c8c9516f42b680a1d12e36fdfbb1"><enum>(5)</enum><text>facilitate effective cross-border exchange of accessible format copies by making publicly available—</text>
 <subparagraph id="id341a782e984a4cfba2f5ddec78857cba"><enum>(A)</enum><text>the titles of works for which the authorized entity has accessible format copies or phonorecords and the specific accessible formats in which they are available; and</text>
 </subparagraph><subparagraph id="idd43573dc1ac949ca9c7429806811eaea"><enum>(B)</enum><text>information on the policies, practices, and authorized entity partners of the authorized entity for the cross-border exchange of accessible format copies.</text>
 </subparagraph></paragraph></subsection><subsection id="id25203d9b0f004310921d842196e225df"><enum>(d)</enum><text>Nothing in this section shall be construed to establish—</text> <paragraph id="id93EF46C674474067B3460F82D7E49F6C"><enum>(1)</enum><text>a cause of action under this title; or</text>
 </paragraph><paragraph id="id457D1CE0235442BDB34122F986A5A637"><enum>(2)</enum><text>a basis for regulation by any Federal agency.</text> </paragraph></subsection><subsection id="id3add78f3173942abacdb968444a4ff27"><enum>(e)</enum><text>Nothing in this section shall be construed to limit the ability to engage in any activity otherwise permitted under this title.</text>
 </subsection><subsection id="id5DFFF3631E7E49F1A1CB9E06EF2F1C6B"><enum>(f)</enum><text>For purposes of this section—</text> <paragraph id="id9558710d275d47e6ae7f0cbbc2e081e2"><enum>(1)</enum><text>the terms <term>accessible format</term>, <term>authorized entity</term>, and <term>eligible person</term> have the meanings given those terms in section 121; and</text>
 </paragraph><paragraph id="id3a83afb5ef9445159b0f062cd2180488"><enum>(2)</enum><text>the term <term>Marrakesh Treaty</term> means the Marrakesh Treaty to Facilitate Access to Published Works by Visually Impaired Persons and Persons with Print Disabilities concluded at Marrakesh, Morocco, on June 28, 2013.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idC9E9DA0D57CF4FD194627C4AF34A7B3F"><enum>(b)</enum><header>Table of sections amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/17/1">chapter 1</external-xref> of title 17, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/17/121">section 121</external-xref> the following:</text>
