 <subsection id="id73D6F7D98389422F917FD5E59E091331"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Tax Extender Act of 2017</short-title></quote>.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id95c8b64a387a4019ac80079ae69495d3"><enum>(b)</enum><header display-inline="yes-display-inline">Amendment of 1986 Code</header><text display-inline="yes-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Internal Revenue Code of 1986.</text>
			</subsection></section><title id="H7AC048D8A5184425AEA1CA3BCBBFEAC0"><enum>I</enum><header>Tax relief for families and individuals</header>

			 residence indebtedness</header>
 <subsection id="HD1604B37EE7946DAB1D84F0207D61D79"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/108">Section 108(a)(1)(E)</external-xref> is amended by striking <quote>January 1, 2017</quote> each place it appears and inserting <quote>January 1, 2019</quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="HF9F9A5CA0D914EC2AC919A359B11D621"><enum>(b)</enum><header>Effective date</header> <text>The amendments made by this section shall apply to discharges of indebtedness after December 31, 2016.</text>

 <paragraph id="H6A5879D27CF440B2997B5EC93CA9D49C"><enum>(1)</enum><header>Extension</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/1391">Section 1391(d)(1)(A)(i)</external-xref> is amended by striking <quote>December 31, 2016</quote> and inserting <quote>December 31, 2018</quote>.</text> </paragraph><paragraph commented="no" id="HDFFA479AC5FC484783D1E43B3E37D058"><enum>(2)</enum><header>Treatment of certain termination dates specified in nominations</header><text>In the case of a designation of an empowerment zone the nomination for which included a termination date which is contemporaneous with the date specified in subparagraph (A)(i) of <external-xref legal-doc="usc" parsable-cite="usc/26/1391">section 1391(d)(1)</external-xref> of the Internal Revenue Code of 1986 (as in effect before the enactment of this Act), subparagraph (B) of such section shall not apply with respect to such designation if, after the date of the enactment of this section, the entity which made such nomination amends the nomination to provide for a new termination date in such manner as the Secretary of the Treasury (or the Secretary’s designee) may provide.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H06A9F9334F5D4A70BF922323264D71A5"><enum>(b)</enum><header>Effective date</header>
 <text>The amendment made by subsection (a)(1) shall apply to taxable years beginning after December 31, 2016.</text>

 <subsection commented="no" display-inline="no-display-inline" id="H5ADC5F20195A421397E6FA3B4EACBF2F"><enum>(a)</enum><header>In general</header><text>Section 119(d) of division A of the Tax Relief and Health Care Act of 2006 is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HBF02BCDA248841469DD83F106027BE85"><enum>(1)</enum><text>by striking <quote>January 1, 2017</quote> each place it appears and inserting <quote>January 1, 2018</quote>,</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7C40A6F1A30B462096A93714AD1E36D8"><enum>(2)</enum><text>by striking <quote>first 11 taxable years</quote> in paragraph (1) and inserting <quote>first 12 taxable years</quote>, and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H699AF5C0FE3043D2BBE4789BEC6F7C32"><enum>(3)</enum><text>by striking <quote>first 5 taxable years</quote> in paragraph (2) and inserting <quote>first 6 taxable years</quote>.</text>

Such Secretary shall issue guidance within 30 days after the date of the enactment of this Act providing for a one-time submission of claims covering periods described in the preceding sentence. Such guidance shall provide for a 180-day period for the submission of such claims (in such manner as prescribed by such Secretary) to begin not later than 30 days after such guidance is issued. Such claims shall be paid by such Secretary not later than 60 days after receipt. If such Secretary has not paid pursuant to a claim filed under this subsection within 60 days after the date of the filing of such claim, the claim shall be paid with interest from such date determined by using the overpayment rate and method under section 6621 of such Code.</text>

 <clause id="H2222D43F7C5943E69C4BC081D36B2B8E"><enum>(i)</enum><text>first to facilities placed in service on or before such date to the extent that such facilities did not receive an allocation equal to their full nameplate capacity, and</text>
 </clause><clause id="HAB599518B8E249F8BE8B5E5C6E0016A1"><enum>(ii)</enum><text>then to facilities placed in service after such date in the order in which such facilities are placed in service.</text>
 </clause></subparagraph><subparagraph id="H77A27A928A7F4E4EACE103D6D2D4C47F"><enum>(B)</enum><header>Unutilized national megawatt capacity limitation</header><text>The term <term>unutilized national megawatt capacity limitation</term> means the excess (if any) of—</text> <clause id="H40BFB5B8A9E045A28BB8945E032C6298"><enum>(i)</enum><text>6,000 megawatts, over</text>
 </clause><clause id="HBCF6AC62F7B6409F9201FDF9E13B40EF"><enum>(ii)</enum><text>the aggregate amount of national megawatt capacity limitation allocated by the Secretary before January 1, 2021, reduced by any amount of such limitation which was allocated to a facility which was not placed in service before such date.</text>
 </clause></subparagraph><subparagraph id="H6EB7A604D45B4C14A40CE9448BB7745A"><enum>(C)</enum><header>Coordination with other provisions</header><text>In the case of any unutilized national megawatt capacity limitation allocated by the Secretary pursuant to this paragraph—</text>
 <clause id="HB462A9EC813A41FE844F9CB42625B846"><enum>(i)</enum><text>such allocation shall be treated for purposes of this section in the same manner as an allocation of national megawatt capacity limitation, and</text>
 </clause><clause id="HCEAD0F57D52941FDB6BE580EEE709C9C"><enum>(ii)</enum><text>subsection (d)(1)(B) shall not apply to any facility which receives such allocation.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H67E3BA27B35A4CA8A3D11484AB52C3A1"><enum>(b)</enum><header>Transfer of credit by certain public entities</header> <paragraph id="HBA3903C2CA794E18BC59AC6CA6A67554"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/45J">Section 45J</external-xref> is amended—</text>
 <subparagraph id="H18CA66E351254AD690EBB274739321C0"><enum>(A)</enum><text>by redesignating subsection (e) as subsection (f), and</text> </subparagraph><subparagraph id="H2FDF95091A1646AEA76EE17DD6839F6D"><enum>(B)</enum><text>by inserting after subsection (d) the following new subsection:</text>
							<quoted-block id="HEAB2B13112EC4368A14508FD625FDCE6" style="OLC">
								<subsection id="HC0AC7B2DDA3942319B4475171DAAC8B0"><enum>(e)</enum><header>Transfer of credit by certain public entities</header>
 <paragraph id="H69753C421F04477E8354701ED1C7692D"><enum>(1)</enum><header>In general</header><text>If, with respect to a credit under subsection (a) for any taxable year—</text> <subparagraph id="H286E340E622648F39A57FB1AEDDF1B08"><enum>(A)</enum><text>a qualified public entity would be the taxpayer (but for this paragraph), and</text>
 </subparagraph><subparagraph id="H86254D4C5A9641EDA368DF2CE6897E25"><enum>(B)</enum><text>such entity elects the application of this paragraph for such taxable year with respect to all (or any portion specified in such election) of such credit,</text>
										</subparagraph><continuation-text continuation-text-level="paragraph">the eligible project partner specified in such election, and not the qualified public entity, shall
			 be treated as the taxpayer for purposes of this title with respect to such
 credit (or such portion thereof).</continuation-text></paragraph><paragraph id="H32026B055ECB461C9CC1D7E21A0D0E28"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection—</text> <subparagraph id="H4B00AE2F2DDF4627824141475BDC8915"><enum>(A)</enum><header>Qualified public entity</header><text>The term <term>qualified public entity</term> means—</text>
 <clause id="HF6A6FD00B0884D838C40ECFB49913110"><enum>(i)</enum><text>a Federal, State, or local government entity, or any political subdivision, agency, or instrumentality thereof,</text>
 </clause><clause id="H0152F0E7F4144F319730A3CDB795C2C0"><enum>(ii)</enum><text>a mutual or cooperative electric company described in section 501(c)(12) or 1381(a)(2), or</text> </clause><clause id="H83826D520CE34B3683909C7627024043"><enum>(iii)</enum><text>a not-for-profit electric utility which had or has received a loan or loan guarantee under the Rural Electrification Act of 1936.</text>
 </clause></subparagraph><subparagraph id="H81864EF6592B4529ADEBDA37ED18AB97"><enum>(B)</enum><header>Eligible project partner</header><text>The term <term>eligible project partner</term> means any person who—</text> <clause id="HAC2DE1A08A3B41F6B164027D62933CC2"><enum>(i)</enum><text>is responsible for, or participates in, the design or construction of the advanced nuclear power facility to which the credit under subsection (a) relates,</text>
 </clause><clause id="H6E047A7C22904B169DD810AD99CC5BE2"><enum>(ii)</enum><text>participates in the provision of the nuclear steam supply system to such facility,</text> </clause><clause id="HD93EA71CE5D64F53A2B9A7962C743509"><enum>(iii)</enum><text>participates in the provision of nuclear fuel to such facility,</text>
 </clause><clause id="idAF082B0B0E9D42868627791FE996FFE9"><enum>(iv)</enum><text>is a financial institution providing financing for the construction or operation of such facility, or</text>
 </clause><clause id="H99505CC4908E442DB366C67248B7774C"><enum>(v)</enum><text>has an ownership interest in such facility.</text> </clause></subparagraph></paragraph><paragraph id="HC864E31C30A24B518476521E5CCBD69B"><enum>(3)</enum><header>Special rules</header> <subparagraph id="H0A9C486B9F484CFDB7A09AC0CEFE2AF1"><enum>(A)</enum><header>Application to partnerships</header><text>In the case of a credit under subsection (a) which is determined at the partnership level—</text>
 <clause id="H8BCA1407415E4930936862A1D3E21DDF"><enum>(i)</enum><text>for purposes of paragraph (1)(A), a qualified public entity shall be treated as the taxpayer with respect to such entity’s distributive share of such credit, and</text>
 </clause><clause id="H2D51099E8E87449D94A2EEF0CFB0EF50"><enum>(ii)</enum><text>the term <term>eligible project partner</term> shall include any partner of the partnership.</text> </clause></subparagraph><subparagraph id="H19E2964E5F264015A6482AD0151557DA"><enum>(B)</enum><header>Taxable year in which credit taken into account</header><text>In the case of any credit (or portion thereof) with respect to which an election is made under paragraph (1), such credit shall be taken into account in the first taxable year of the eligible project partner ending with, or after, the qualified public entity’s taxable year with respect to which the credit was determined.</text>
 </subparagraph><subparagraph id="H9C2A2AD79CE54D70A1A228AC2ABDD419"><enum>(C)</enum><header>Treatment of transfer under private use rules</header><text>For purposes of section 141(b)(1), any benefit derived by an eligible project partner in connection with an election under this subsection shall not be taken into account as a private business use.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HA7C93D008AC740E6A2BC85C4B2204DD9"><enum>(2)</enum><header>Special rule for proceeds of transfers for mutual or cooperative electric companies</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/501">Section 501(c)(12)</external-xref> is amended by adding at the end the following new subparagraph:</text> <quoted-block id="H46F90068F67A4A379F150206EAEF953B" style="OLC"> <subparagraph id="H0E9DDC223D4F43868C6B1FC30D4E1F30"><enum>(I)</enum><text>In the case of a mutual or cooperative electric company described in this paragraph or an organization described in section 1381(a)(2), income received or accrued in connection with an election under section 45J(e)(1) shall be treated as an amount collected from members for the sole purpose of meeting losses and expenses.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HEB03120797EF4A039A438EEC0EBE28B8"><enum>(c)</enum><header>Effective dates</header>
 <paragraph id="H58E4A8C660AC4140BCCD048A22F1B917"><enum>(1)</enum><header>Treatment of unutilized limitation amounts</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H906D7EFFAF694F7E9BCC867B7FC45B43"><enum>(2)</enum><header>Transfer of credit by certain public entities</header><text>The amendments made by subsection (b) shall apply to taxable years beginning after the date of the enactment of this Act.</text>
					</paragraph></subsection></section><section id="idC75EC943E0894E9B9FEF1B5B1203265F"><enum>402.</enum><header>Enhancement  of carbon dioxide sequestration credit</header>
 <subsection id="idD645458217664367BBDAF5C553C4AB24"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/45Q">Section 45Q</external-xref> is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="idDF6A15FFBBA14327A11A3274183218C5" style="OLC"> <section id="id4DA7A4867A86475F9D081A4D15EBFE06"><enum>45Q.</enum><header>Credit for carbon oxide sequestration</header> <subsection id="id26C763F71C164F84B71FB0BA8363F140"><enum>(a)</enum><header>General rule</header><text>For purposes of section 38, the carbon oxide sequestration credit for any taxable year is an amount equal to the sum of—</text>
 <paragraph id="id824448444C9B4B03B02D841BD4A0F35F"><enum>(1)</enum><text>$20 per metric ton of qualified carbon oxide which is—</text> <subparagraph id="id91F8A777D476441BBA1B72A46E3A730B"><enum>(A)</enum><text>captured by the taxpayer using carbon capture equipment which is originally placed in service at a qualified facility before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, and</text>
 </subparagraph><subparagraph id="id33EFC8A6B27C4622B45B68A136C43CCE"><enum>(B)</enum><text>disposed of by the taxpayer in secure geological storage and not used by the taxpayer as described in paragraph (2)(B),</text>
 </subparagraph></paragraph><paragraph id="id52C3C1B801D44B8F92B3F7E10E2E3336"><enum>(2)</enum><text>$10 per metric ton of qualified carbon oxide which is—</text> <subparagraph id="id51AB9A2408084CB0BA11EEEE05D0F761"><enum>(A)</enum><text>captured by the taxpayer using carbon capture equipment which is originally placed in service at a qualified facility before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, and</text>
 </subparagraph><subparagraph id="id301A042D95904003B079D935A8198CE2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id6F2CDBD19CE84630A6AE3CDC98C214F0"><enum>(i)</enum><text>used by the taxpayer as a tertiary injectant in a qualified enhanced oil or natural gas recovery project and disposed of by the taxpayer in secure geological storage, or</text>
 </clause><clause id="id83DA8E978F914516B873ACD18B80F26C" indent="up1"><enum>(ii)</enum><text>utilized by the taxpayer in a manner described in subsection (f)(5),</text> </clause></subparagraph></paragraph><paragraph id="id4B3CAACA7CBD4C56A2E8151A083C028F"><enum>(3)</enum><text>the applicable dollar amount per metric ton of qualified carbon oxide which is—</text>
 <subparagraph id="idFFD82F2A422941F78A8DBC9E6ABF3C18"><enum>(A)</enum><text>captured by the taxpayer using carbon capture equipment which is originally placed in service at a qualified facility on or after the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, during the 12-year period beginning on the date the equipment was originally placed in service, and</text>
 </subparagraph><subparagraph id="idFE46A0F93F1E43878CE65D1E566B0853"><enum>(B)</enum><text>disposed of by the taxpayer in secure geological storage and not used by the taxpayer as described in paragraph (4)(B), and</text>
 </subparagraph></paragraph><paragraph id="id267F9C70B483427B833B0C58641FAE17"><enum>(4)</enum><text>the applicable dollar amount per metric ton of qualified carbon oxide which is—</text>
 <subparagraph id="id15BF0A68FDCC45918B241FCB9E23F4E9"><enum>(A)</enum><text>captured by the taxpayer using carbon capture equipment which is originally placed in service at a qualified facility on or after the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, during the 12-year period beginning on the date the equipment was originally placed in service, and</text>
 </subparagraph><subparagraph id="id5865A69539AA463399F47E9EF348C922"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id004BE4C207434FD2AE60E6651EE17F2A"><enum>(i)</enum><text>used by the taxpayer as a tertiary injectant in a qualified enhanced oil or natural gas recovery project and disposed of by the taxpayer in secure geological storage, or</text>
 </clause><clause id="idF60C01538A0D46098A2AB428982326FD" indent="up1"><enum>(ii)</enum><text>utilized by the taxpayer in a manner described in subsection (f)(5).</text> </clause></subparagraph></paragraph></subsection><subsection id="id448FD18569B34A448FA87D66AEE7FF40"><enum>(b)</enum><header>Applicable dollar amount; additional equipment; election</header> <paragraph id="id9A2F9AAE46C3447E970BCAA5A3DF502D"><enum>(1)</enum><header>Applicable dollar amount</header> <subparagraph id="id251F892D7ABC48D1A8FC51314A9C269B"><enum>(A)</enum><header>In general</header><text>For purposes of this section, the applicable dollar amount shall be an amount equal to—</text>
 <clause id="idDED1E0F3F532479088013B475D2C4E51"><enum>(i)</enum><text>for any taxable year beginning in a calendar year after 2016 and ending before 2027—</text> <subclause id="id13D86BDDD99A4ABABA88ACDA91759765"><enum>(I)</enum><text>for purposes of paragraph (3) of subsection (a), the dollar amount established by linear interpolation between $22.66 and $50 for each calendar year during such period, and</text>
 </subclause><subclause id="idD79CC1E1D9FD4D9BB31F8631BAD68E64"><enum>(II)</enum><text>for purposes of paragraph (4) of such subsection, the dollar amount established by linear interpolation between $12.83 and $35 for each calendar year during such period, and</text>
 </subclause></clause><clause id="id8B3F5DFF46D3407D8F4418EF1654FD16"><enum>(ii)</enum><text>for any taxable year beginning in a calendar year after 2026—</text> <subclause id="id957AA3D714584227B78DACF8561CCADD"><enum>(I)</enum><text>for purposes of paragraph (3) of subsection (a), an amount equal to the product of $50 and the inflation adjustment factor for such calendar year determined under section 43(b)(3)(B) for such calendar year, determined by substituting <quote>2025</quote> for <quote>1990</quote>, and</text>
 </subclause><subclause id="idFFC69D4BA3F04E7BB01E08D4F8AACF03"><enum>(II)</enum><text>for purposes of paragraph (4) of such subsection, an amount equal to the product of $35 and the inflation adjustment factor for such calendar year determined under section 43(b)(3)(B) for such calendar year, determined by substituting <quote>2025</quote> for <quote>1990</quote>.</text>
 </subclause></clause></subparagraph><subparagraph id="id33989C7C7E324641B2FD76EDA44B47C3"><enum>(B)</enum><header>Rounding</header><text>The applicable dollar amount determined under subparagraph (A) shall be rounded to the nearest cent.</text>
 </subparagraph></paragraph><paragraph id="idB0ADDE8035CF4132BBE1892A58214174"><enum>(2)</enum><header>Installation of additional carbon capture equipment on existing qualified facility</header><text>In the case of a qualified facility placed in service before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, for which additional carbon capture equipment is placed in service on or after the date of the enactment of such Act, the amount of qualified carbon oxide which is captured by the taxpayer shall be equal to—</text>
 <subparagraph id="id63B315C70D1241488878F41F3030E563"><enum>(A)</enum><text>for purposes of paragraphs (1)(A) and (2)(A) of subsection (a), the lesser of—</text> <clause id="id57186A606F904FE08680CA117B7BFE51"><enum>(i)</enum><text>the total amount of qualified carbon oxide captured at such facility for the taxable year, or</text>
 </clause><clause id="id35163F8002AA4634A0E1FC72B59CEC6C"><enum>(ii)</enum><text>the total amount of the carbon dioxide capture capacity of the carbon capture equipment in service at such facility on the day before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, and</text>
 </clause></subparagraph><subparagraph id="id0CDD6EF10F004F808ADAAD4D966A2729"><enum>(B)</enum><text>for purposes of paragraphs (3)(A) and (4)(A) of such subsection, an amount (not less than zero) equal to the excess of—</text>
 <clause id="id18095A17217243D8827E693014F946C5"><enum>(i)</enum><text>the amount described in clause (i) of subparagraph (A), over</text> </clause><clause id="idA74FB6A28F904D0FAD96373AA07A3DAB"><enum>(ii)</enum><text>the amount described in clause (ii) of such subparagraph.</text>
 </clause></subparagraph></paragraph><paragraph id="idF88518F720CA4921932B6AF9796A9846"><enum>(3)</enum><header>Election</header><text>For purposes of determining the carbon oxide sequestration credit under this section, a taxpayer may elect to have the dollar amounts applicable under paragraph (1) or (2) of subsection (a) apply in lieu of the dollar amounts applicable under paragraph (3) or (4) of such subsection for each metric ton of qualified carbon oxide which is captured by the taxpayer using carbon capture equipment which is originally placed in service at a qualified facility on or after the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>.</text>
 </paragraph></subsection><subsection id="id4DD97177FD494CF78C5D0C4A6DC6D2C1"><enum>(c)</enum><header>Qualified carbon oxide</header><text>For purposes of this section—</text> <paragraph id="idF1271331728D425884212E8EBB54F7D0"><enum>(1)</enum><header>In general</header><text>The term <term>qualified carbon oxide</term> means—</text>
 <subparagraph id="id5E9261FB9D4D41E5BCCCF9468E8DB7E6"><enum>(A)</enum><text>any carbon dioxide which—</text> <clause id="idAADD4830B7FF4570A9841D4015FEF4AF"><enum>(i)</enum><text>is captured from an industrial source by carbon capture equipment which is originally placed in service before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>,</text>
 </clause><clause id="id2833AEBB26F34D3892910EF9E64C8A3B"><enum>(ii)</enum><text>would otherwise be released into the atmosphere as industrial emission of greenhouse gas or lead to such release, and</text>
 </clause><clause id="idA05D5F8780C9460FAAFAF0162906D1A7"><enum>(iii)</enum><text>is measured at the source of capture and verified at the point of disposal, injection, or utilization,</text>
 </clause></subparagraph><subparagraph id="id8692EDF9177E40B196C8C1B2116E62A1"><enum>(B)</enum><text>any carbon dioxide or other carbon oxide which—</text> <clause id="idA90FF9D7168E42C0953D53AC9A131109"><enum>(i)</enum><text>is captured from an industrial source by carbon capture equipment which is originally placed in service on or after the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>,</text>
 </clause><clause id="id0C785FD6C7E8447DB506BF76A5EFA019"><enum>(ii)</enum><text>would otherwise be released into the atmosphere as industrial emission of greenhouse gas or lead to such release, and</text>
 </clause><clause id="idCB7D85CB9FBC40ED90B533E61ADB9726"><enum>(iii)</enum><text>is measured at the source of capture and verified at the point of disposal, injection, or utilization, or</text>
 </clause></subparagraph><subparagraph id="id9AAE72DFD64742EEA4827E2ADF54933E"><enum>(C)</enum><text>in the case of a direct air capture facility, any carbon dioxide which—</text> <clause id="idA2A22E45D9E0499D9AC03C469AEF4C89"><enum>(i)</enum><text>is captured directly from the ambient air, and</text>
 </clause><clause id="id917CFC7B2E2848A6903FFAA8B613D3C1"><enum>(ii)</enum><text>is measured at the source of capture and verified at the point of disposal, injection, or utilization.</text>
 </clause></subparagraph></paragraph><paragraph id="idF374108569304741BB3E6B70369CFCAE"><enum>(2)</enum><header>Recycled carbon oxide</header><text>The term <term>qualified carbon oxide</term> includes the initial deposit of captured carbon oxide used as a tertiary injectant. Such term does not include carbon oxide that is recaptured, recycled, and re-injected as part of the enhanced oil and natural gas recovery process.</text>
								</paragraph></subsection><subsection id="idDCAFAF722E08428993A7A3C00316B3D6"><enum>(d)</enum><header>Qualified facility</header>
 <text>For purposes of this section, the term <term>qualified facility</term> means any industrial facility or direct air capture facility—</text> <paragraph id="id61D2C3E5D0DA47D8BB75E6682E97EABB"><enum>(1)</enum><text>the construction of which begins before January 1, 2024, and—</text>
 <subparagraph id="id91BD84333D54420BB6B9521C9123B6EE"><enum>(A)</enum><text>construction of carbon capture equipment begins before such date, or</text> </subparagraph><subparagraph id="idC62FF8E8205D465B98395B3913A6F045"><enum>(B)</enum><text>the original planning and design for such facility includes installation of carbon capture equipment, and</text>
 </subparagraph></paragraph><paragraph id="id29EBC6A572774BDBBA8741D24E96D607"><enum>(2)</enum><text>which captures—</text> <subparagraph id="id9184EEF882594CF4B3C7DEDC8FE42F34"><enum>(A)</enum><text>in the case of a facility which emits not more than 500,000 metric tons of carbon oxide into the atmosphere during the taxable year, not less than 25,000 metric tons of qualified carbon oxide during the taxable year which is utilized in a manner described in subsection (f)(5),</text>
 </subparagraph><subparagraph id="id43C53CD715864E3889F0ACD7C955CECB"><enum>(B)</enum><text>in the case of an electricity generating facility which is not described in subparagraph (A), not less than 500,000 metric tons of qualified carbon oxide during the taxable year, or</text>
 </subparagraph><subparagraph id="id074E28AABCBF44898FA3069382564D13"><enum>(C)</enum><text>in the case of a direct air capture facility or any facility not described in subparagraph (A) or (B), not less than 100,000 metric tons of qualified carbon oxide during the taxable year.</text>
 </subparagraph></paragraph></subsection><subsection id="idD6D2EA4A3DA9445FAA0874C5B4D7DEE3"><enum>(e)</enum><header>Definitions</header><text>For purposes of this section—</text> <paragraph id="id789C6F3BDE2F42B29EECC91F36F4B92D"><enum>(1)</enum><header>Direct air capture facility</header> <subparagraph id="idF8C5B2E7828A44A0A5C868DC7FF98386"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <term>direct air capture facility</term> means any facility which uses carbon capture equipment to capture carbon dioxide directly from the ambient air.</text>
 </subparagraph><subparagraph id="id447A95D8BA8749218BFA5839E5507C72"><enum>(B)</enum><header>Exception</header><text>The term <term>direct air capture facility</term> shall not include any facility which captures carbon dioxide—</text> <clause id="idAFFC2FDCD36A47A79337A3B2BF22295E"><enum>(i)</enum><text>which is deliberately released from naturally occurring subsurface springs, or</text>
 </clause><clause id="id02EF655CE73A49D2B1D9BBC483BD0DB9"><enum>(ii)</enum><text>using natural photosynthesis.</text> </clause></subparagraph></paragraph><paragraph id="id9F3B0C1311764A3B823B5D0ED817E145"><enum>(2)</enum><header>Qualified enhanced oil or natural gas recovery project</header><text>The term <term>qualified enhanced oil or natural gas recovery project</term> has the meaning given the term <quote>qualified enhanced oil recovery project</quote> by section 43(c)(2), determined—</text>
 <subparagraph id="id4AE9206849E64DF39E57AC706CBB7662"><enum>(A)</enum><text>by substituting <quote>crude oil or natural gas</quote> for <quote>crude oil</quote> in subparagraph (A)(i) thereof, and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA4252BC8C2CD40338AB8FD20283664F3"><enum>(B)</enum><text display-inline="yes-display-inline">without regard to subparagraph (A)(iii) thereof.</text>
 </subparagraph></paragraph><paragraph id="id7E0477DEC6994BE08DABCE75CEA702DF"><enum>(3)</enum><header>Tertiary injectant</header><text>The term <term>tertiary injectant</term> has the same meaning as when used within section 193(b)(1).</text> </paragraph></subsection><subsection id="id2417F643D0FD4D868676622725D86449"><enum>(f)</enum><header>Special rules</header> <paragraph id="idACF52CCD1719423C8C61DB3954CF9F6E"><enum>(1)</enum><header>Only qualified carbon oxide captured and disposed of or used within the United States taken into account</header><text>The credit under this section shall apply only with respect to qualified carbon oxide the capture and disposal, use, or utilization of which is within—</text>
 <subparagraph id="idB75FC76EA894464C97A4F78BC65AED80"><enum>(A)</enum><text>the United States (within the meaning of section 638(1)), or</text> </subparagraph><subparagraph id="id525155CD5B4E4B30B0098F912AE14EB6"><enum>(B)</enum><text>a possession of the United States (within the meaning of section 638(2)).</text>
									</subparagraph></paragraph><paragraph id="idE0786822DB0D4816AF7DC0B85C029882"><enum>(2)</enum><header>Secure geological storage</header>
 <subparagraph id="idEAFC3A692B6E4CD4A193FF4E5492A367"><enum>(A)</enum><header>In general</header><text>Not later than December 31, 2018, the Secretary, in consultation with the Administrator of the Environmental Protection Agency, the Secretary of Energy, and the Secretary of the Interior, shall establish regulations for determining adequate security measures for the geological storage of carbon dioxide under subsection (a) such that the carbon dioxide does not escape into the atmosphere. Such term shall include storage at deep saline formations, oil and gas reservoirs, and unmineable coal seams under such conditions as the Secretary may determine under such regulations.</text>
 </subparagraph><subparagraph id="id6BA63D7851004D4FA25A6A56551B3C91"><enum>(B)</enum><header>Requirements</header><text>The regulations established pursuant to subparagraph (A) shall provide that—</text> <clause id="idD96AEED192C24BA4B48858D87A459599"><enum>(i)</enum><text>for purposes of paragraph (1)(B) or (3)(B) of subsection (a), carbon dioxide shall be considered disposed of in secure geological storage if such carbon dioxide is stored in compliance with rules promulgated by the Environmental Protection Agency under subpart RR of part 98 of title 40, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph), under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.) and rules under the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref> et seq.) which are applicable to carbon dioxide disposed of in secure geological storage and not used as a tertiary injectant in a qualified enhanced oil or natural gas recovery project, and</text>
 </clause><clause id="idA36887A2B4A647E7BA59D93F49936AD4"><enum>(ii)</enum><text>for purposes of paragraph (2)(B)(i) or (4)(B)(i) of subsection (a), carbon dioxide shall be considered disposed of in secure geological storage if such carbon dioxide is stored in compliance with rules promulgated by the Environmental Protection Agency which are applicable to carbon dioxide used as a tertiary injectant in a qualified enhanced oil or natural gas recovery project under—</text>
 <subclause id="idE29E9618C51D4713887E154E61204340"><enum>(I)</enum><text>subpart UU of part 98 of title 40, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph), under the Clean Air Act, and</text>
 </subclause><subclause id="id3064E6EB783242C38A326FAF2733CA14"><enum>(II)</enum><text>subpart C of part 146 of title 40, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph), under the Safe Drinking Water Act, to the extent such rules are applicable to Class II wells.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="id44F810EC6FF44B5A926E633E529D59DC"><enum>(3)</enum><header>Credit attributable to taxpayer</header>
 <subparagraph id="id8FE5E2C238324AAB81E19BDA4C99EC1F"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B) or in any regulations prescribed by the Secretary, any credit under this section shall be attributable to—</text>
 <clause id="id884ED14CBF1745FA909082908CA3EC34"><enum>(i)</enum><text>in the case of qualified carbon oxide captured using carbon capture equipment which is originally placed in service at a qualified facility before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, the person that captures and physically or contractually ensures the disposal, utilization, or use as a tertiary injectant of such qualified carbon oxide, and</text>
 </clause><clause id="id351AD5F8FF4A4EF4BE5D681178DD5863"><enum>(ii)</enum><text>in the case of qualified carbon oxide captured using carbon capture equipment which is originally placed in service at a qualified facility on or after the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, the person that owns the carbon capture equipment and physically or contractually ensures the capture and disposal, utilization, or use as a tertiary injectant of such qualified carbon oxide.</text>
 </clause></subparagraph><subparagraph id="idCA0569C8D51E49C38E89D3C1E9B87382"><enum>(B)</enum><header>Election</header><text>If the person described in subparagraph (A) makes an election under this subparagraph in such time and manner as the Secretary may prescribe by regulations, the credit under this section—</text>
 <clause id="idDA28C227363C485996D39B3C9EB3A67C"><enum>(i)</enum><text>shall be allowable to the person that disposes of the qualified carbon oxide, utilizes the qualified carbon oxide, or uses the qualified carbon oxide as a tertiary injectant, and</text>
 </clause><clause id="id572AEE0405BF4D19A7008F5402B6D395"><enum>(ii)</enum><text>shall not be allowable to the person described in subparagraph (A).</text> </clause></subparagraph></paragraph><paragraph id="idC71B1AE445F44E4A9F37A65274BB9E5F"><enum>(4)</enum><header>Recapture</header><text>The Secretary shall, by regulations, provide for recapturing the benefit of any credit allowable under subsection (a) with respect to any qualified carbon oxide which ceases to be captured, disposed of, or used as a tertiary injectant in a manner consistent with the requirements of this section.</text>
								</paragraph><paragraph id="id97E696ED930B4FDF86551B4583884DFB"><enum>(5)</enum><header>Utilization of qualified carbon oxide</header>
 <subparagraph id="id3467CD252E9B4CFE83F8C259ECC8653A"><enum>(A)</enum><header>In general</header><text>For purposes of this section, utilization of qualified carbon oxide means—</text> <clause id="id4121882FEFE34A3F966098C86FB09ED2"><enum>(i)</enum><text>the fixation of such qualified carbon oxide through photosynthesis or chemosynthesis, such as through the growing of algae or bacteria,</text>
 </clause><clause id="idC946ED2EA9444CF092B322BF7CDF87FE"><enum>(ii)</enum><text>the chemical conversion of such qualified carbon oxide to a material or chemical compound in which such qualified carbon oxide is securely stored, or</text>
 </clause><clause id="idC1EE5F3CEFB0426FB0E3CE66C94FA107"><enum>(iii)</enum><text>the use of such qualified carbon oxide for any other purpose for which a commercial market exists (with the exception of use as a tertiary injectant in a qualified enhanced oil or natural gas recovery project), as determined by the Secretary.</text>
										</clause></subparagraph><subparagraph id="idE13ED77935E34BBCB5217D4DE416AA59"><enum>(B)</enum><header>Measurement</header>
 <clause id="id07D7EE5A42924A7D8996FD64803F536E"><enum>(i)</enum><header>In general</header><text>For purposes of determining the amount of qualified carbon oxide utilized by the taxpayer under paragraph (2)(B)(ii) or (4)(B)(ii) of subsection (a), such amount shall be equal to the metric tons of qualified carbon oxide which the taxpayer demonstrates, based upon an analysis of lifecycle greenhouse gas emissions and subject to such requirements as the Secretary, in consultation with the Secretary of Energy and the Administrator of the Environmental Protection Agency, determines appropriate, were—</text>
 <subclause id="idE82E75E581884176B88ED4DE92F69AC3"><enum>(I)</enum><text>captured and permanently isolated from the atmosphere, or</text> </subclause><subclause id="id5FE34B82B4794A78AE49D729FBEEACFF"><enum>(II)</enum><text>displaced from being emitted into the atmosphere,</text>
											</subclause><continuation-text continuation-text-level="clause">through use of a process described in
 subparagraph (A).</continuation-text></clause><clause id="id974F2EE12250487AA1B8E2626852C0B7"><enum>(ii)</enum><header>Lifecycle greenhouse gas emissions</header><text>For purposes of clause (i), the term <term>lifecycle greenhouse gas emissions</term> has the same meaning given such term under subparagraph (H) of section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>), as in effect on the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, except that <quote>product</quote> shall be substituted for <quote>fuel</quote> each place it appears in such subparagraph.</text>
										</clause></subparagraph></paragraph><paragraph id="idE653A2EBD7C747F48E7A00B352785ACC"><enum>(6)</enum><header>Election for applicable facilities</header>
 <subparagraph id="idF7A4BA493C864061818C389E5E2E9E63"><enum>(A)</enum><header>In general</header><text>For purposes of this section, in the case of an applicable facility, for any taxable year in which such facility captures not less than 500,000 metric tons of qualified carbon oxide during the taxable year, the person described in paragraph (3)(A)(ii) may elect to have such facility, and any carbon capture equipment placed in service at such facility, deemed as having been placed in service on the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>.</text>
 </subparagraph><subparagraph id="idDA275CBB91E54110B2BA0896331D9815"><enum>(B)</enum><header>Applicable facility</header><text>For purposes of this paragraph, the term <term>applicable facility</term> means a qualified facility—</text> <clause id="id3C993AA3E3964B118B9DD630B4839F08"><enum>(i)</enum><text>which was placed in service before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, and</text>
 </clause><clause id="idDA11507D75954FC68A959F6158A6819D"><enum>(ii)</enum><text>for which no taxpayer claimed a credit under this section in regards to such facility for any taxable year ending before the date of the enactment of such Act.</text>
 </clause></subparagraph></paragraph><paragraph id="id441194AD3FC64EB8A5A7FE13F01B42E3"><enum>(7)</enum><header>Inflation adjustment</header><text>In the case of any taxable year beginning in a calendar year after 2009, there shall be substituted for each dollar amount contained in paragraphs (1) and (2) of subsection (a) an amount equal to the product of—</text>
 <subparagraph id="id43D7C3B68BB44D968A54062CF1B711CF"><enum>(A)</enum><text>such dollar amount, multiplied by</text> </subparagraph><subparagraph id="id05078144C7884AFB87164CF8DD2D8C83"><enum>(B)</enum><text>the inflation adjustment factor for such calendar year determined under section 43(b)(3)(B) for such calendar year, determined by substituting <quote>2008</quote> for <quote>1990</quote>.</text>
 </subparagraph></paragraph></subsection><subsection id="idBB268C70771D48F4A4B16FFD4F4524F0"><enum>(g)</enum><header>Application of section for certain carbon capture equipment</header><text>In the case of any carbon capture equipment placed in service before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, the credit under this section shall apply with respect to qualified carbon oxide captured using such equipment before the end of the calendar year in which the Secretary, in consultation with the Administrator of the Environmental Protection Agency, certifies that, during the period beginning after October 3, 2008, a total of 75,000,000 metric tons of qualified carbon oxide have been taken into account in accordance with—</text>
 <paragraph id="id05E1C3E4664B48DD9F45E5DD0D0FCE1E"><enum>(1)</enum><text>subsection (a) of this section, as in effect on the day before the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, and</text> </paragraph><paragraph id="id66618DD35FBE48A5A7DCABBAE20BD128"><enum>(2)</enum><text>paragraphs (1) and (2) of subsection (a) of this section.</text>
 </paragraph></subsection><subsection id="id7E337D89D4014102B9702D979B5E2D13"><enum>(h)</enum><header>Regulations</header><text>The Secretary may prescribe such regulations and other guidance as may be necessary or appropriate to carry out this section, including regulations or other guidance to—</text>
 <paragraph id="id0935E3F2184D438592C40BBE72C94B77"><enum>(1)</enum><text>ensure proper allocation under subsection (a) for qualified carbon oxide captured by a taxpayer during the taxable year ending after the date of the enactment of the <short-title>Tax Extender Act of 2017</short-title>, and</text>
 </paragraph><paragraph id="id7DF0A5FC9E7343759BC8F1E2CFEE7E52"><enum>(2)</enum><text>determine whether a facility satisfies the requirements under subsection (d)(1) during such taxable year.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id335A5B99811E4653B28E10B679F0201C"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act.</text> </subsection></section></title></legis-body> </bill>
