 <subsection id="id7b42ba4650504120a35e4a1b171b98b8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" id="idd4d26b1a02744837880f4278f316849a"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means Stutsman County Park Board in Jamestown, North Dakota (or a successor in interest to that entity).</text>
 </paragraph><paragraph id="id86372f2197d549748c3acb38b8548044"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the approximately 4,494.30 acres of Federal land—</text> <subparagraph id="id54CD681EB5C741AD9DF9EACE4AE7E098"><enum>(A)</enum><text>associated with the Jamestown Reservoir;</text>
 </subparagraph><subparagraph id="idBAC4129DAF234829BAEBD4DB70149911"><enum>(B)</enum><text>managed by, or subject to a permit of—</text> <clause id="idD0B949B0460A47B29AC5F574D51C3A5A"><enum>(i)</enum><text>the Board;</text>
 </clause><clause id="id3178C40D4960462F9462C3C9637F31ED"><enum>(ii)</enum><text>the State; or</text> </clause><clause id="id651938D8690E4538AD559BB6C9A515C7"><enum>(iii)</enum><text>a permittee; and</text>
 </clause></subparagraph><subparagraph id="idB4162BC7DECF48019A2DC257B75B34B3"><enum>(C)</enum><text>as generally described in the management agreement numbered 15–LM–60–2255 and entitled <quote>Management Agreement between the Bureau of Reclamation, et al., and the Stutsman County Park Board for the Development, Management, Operation, and Maintenance of Lands and Recreation Facilities at Jamestown Reservoir</quote>.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idddfd1a7a901d41d09a425e59d486ef5c"><enum>(3)</enum><header display-inline="yes-display-inline">Jamestown Reservoir</header><text display-inline="yes-display-inline">The term <term>Jamestown Reservoir</term> means the Jamestown Reservoir constructed as a unit of the Missouri-Souris Division, Pick-Sloan Missouri Basin Program, as authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665).</text>
 </paragraph><paragraph id="idddbcb1b91f2845cda233b1a720ede675"><enum>(4)</enum><header>Permittee</header><text>The term <term>permittee</term> means the holder (or any successor in interest to the holder) of a permit for a property.</text> </paragraph><paragraph id="id8832f93d40d74afdbbca9ee50a763396"><enum>(5)</enum><header>Property</header><text>The term <term>property</term> means any cabin site located on Federal land for which a permit is in effect on the date of enactment of this Act.</text>
 </paragraph><paragraph id="id72f6ab9b8d10458a83644de197bf1449"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text> </paragraph><paragraph id="idbc8091cdda574bd6a3c8b1844c64967d"><enum>(7)</enum><header>State</header><text>The term <term>State</term> means the State of North Dakota, acting through the North Dakota Game and Fish Department.</text>
				</paragraph></subsection><subsection id="id9d6e32226cc44d829581ba75be1ad407"><enum>(b)</enum><header>Purchase of property by permittee; transfers to Board and State</header>
 <paragraph id="id0ca8d60c84f845c792ecab4abdd19f2f"><enum>(1)</enum><header>Option</header><text>The Secretary shall provide to the permittee of a property the first option to purchase that property in accordance with paragraph (3) for fair market value, subject to the condition that the permittee shall pay to the Board any outstanding permit fees before the permittee may exercise the option to purchase.</text>
				</paragraph><paragraph id="id4c03ff0d5f8d487a88d87cc76513ec9f"><enum>(2)</enum><header>Determination of fair market value</header>
 <subparagraph id="idaf3ec8d5e664499fad154a6b8771ca3a"><enum>(A)</enum><header>In general</header><text>For purposes of this subsection, the fair market value of a property shall be determined by the Secretary—</text>
 <clause id="id0A7A740A42F943C6B517649DC8B0814D"><enum>(i)</enum><text>using a local, third-party appraiser;</text>
 </clause><clause id="idF8F9D1590EEB46C58159BBC54CA67255"><enum>(ii)</enum><text>in accordance with—</text> <subclause id="idAF8F24F2E64A470CB1A59C3DC958D861"><enum>(I)</enum><text>the Uniform Standards of Professional Appraisal Practice; and</text>
 </subclause><subclause id="idADE8C1A19DC64696AE81E60452AB2880"><enum>(II)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisition;</text> </subclause></clause><clause id="id05CC9BC454284400A4DA0C611059CFAD"><enum>(iii)</enum><text>to the extent appropriate in accordance with the valuation policy of the Department of the Interior; and</text>
 </clause><clause id="id3E34868CAF224A8984E93E80E7227538"><enum>(iv)</enum><text>valuing the property as unimproved residential property, excluding all improvements.</text>
 </clause></subparagraph><subparagraph id="id3009ee47409840bdbbf0d71be65a5380"><enum>(B)</enum><header>Disputes</header><text>Any dispute regarding the fair market value of a property shall be resolved in accordance with section 2201.4 of title 43, Code of Federal Regulations (or successor regulations).</text>
					</subparagraph></paragraph><paragraph id="id50f01426b1fb4d818fc742a56a2e9a53"><enum>(3)</enum><header>Purchase</header>
 <subparagraph id="idaf9b73b453a94303aa9d60edce6923d5"><enum>(A)</enum><header>In general</header><text>On an election by a permittee to exercise the option to purchase a property pursuant to paragraph (1), the Secretary shall convey to the permittee, for fair market value—</text>
 <clause id="ida50408b8f30042b7998dadabd9dec095"><enum>(i)</enum><text>all right, title, and interest of the United States in and to the property, subject to valid existing rights and the operational requirements of the Jamestown Reservoir; and</text>
 </clause><clause id="ide5f01f91a9104f4aac6ef197b06c2c72"><enum>(ii)</enum><text>sole use, perpetual easements for—</text> <subclause id="id94f5d28404324c2c913d68c38744890a"><enum>(I)</enum><text>vehicular access to the property;</text>
 </subclause><subclause id="id93738e60a93341e8a8c62d75b9f5f51f"><enum>(II)</enum><text>access to, and use of, one or more docks for the property;</text> </subclause><subclause id="idb9a04e30746243099f55296a59e5f8a8"><enum>(III)</enum><text>access to, and use of, all boathouses, ramps, retaining walls, and other improvements for which access is provided in the permit for use of the property as of the date of enactment of this Act; and</text>
 </subclause><subclause id="idD4DC297DBFAF4A2AB8B462DD799B13BC"><enum>(IV)</enum><text>access to water for irrigation with a water service contract.</text> </subclause></clause></subparagraph><subparagraph id="id1ddad55e2a8545e3bea1a5a6314ac42f"><enum>(B)</enum><header>Period for conveyance</header><text>The Secretary shall convey to a permittee a property pursuant to subparagraph (A) during the period—</text>
 <clause id="id779758228ec94f168baab09f0a5a0145"><enum>(i)</enum><text>beginning on the date of enactment of this Act; and</text> </clause><clause id="id94beda939e2b48d49499ead8cf763d0b"><enum>(ii)</enum><text>ending on the date that is 5 years after that date of enactment.</text>
						</clause></subparagraph></paragraph><paragraph id="id57649df17d694681a2c93b6d7afad9e0"><enum>(4)</enum><header>Transfers to Board and State</header>
					<subparagraph id="idd108765bf1c0497f94cb22dab213e85c"><enum>(A)</enum><header>Failure to purchase</header>
 <clause id="idB16F7AA7BBED4CAAA0A834C9E2207477"><enum>(i)</enum><header>In general</header><text>If a permittee fails to exercise the option to purchase a property under paragraph (3) by the date that is 5 years after the date of enactment of this Act, the Secretary shall transfer the property to the Board, subject to clause (ii), without cost.</text>
 </clause><clause id="idAB8379DC1C074BDF9E09E3A5C418A7C8"><enum>(ii)</enum><header>Sale by Board of transferred property</header><text>If the Board sells or enters into one or more agreements to sell a property transferred under clause (i) during the 3-year period beginning on the date of the transfer, the Board shall pay to the Secretary all proceeds of the sale that are in excess of the costs of the Board.</text>
 </clause></subparagraph><subparagraph id="id3b34932311bd4382950aec46cf88f86d"><enum>(B)</enum><header>Certain other land</header><text>Effective beginning on the date that is 5 years after the date of enactment of this Act, the Secretary shall transfer—</text>
 <clause id="id13d8107d48d248c8a0629974a0df8cde"><enum>(i)</enum><text>to the Board, without cost, Federal land managed by the Board as of that date of enactment, on which no cabin is located; and</text>
 </clause><clause id="id06c73fff117d49519dc5ef0c50d0193d"><enum>(ii)</enum><text>to the State, without cost, land leased by the State as of that date of enactment.</text> </clause></subparagraph></paragraph></subsection><subsection id="ide2a71f12c9124f5eb7480bb92b49341c"><enum>(c)</enum><header>Oil, gas, mineral, and other outstanding rights</header><text>Each conveyance to a permittee, and each transfer to the Board or State, pursuant to subsection (b) shall be made subject to—</text>
 <paragraph id="id4bfa392b117f4b3c8b436180a1054c67"><enum>(1)</enum><text>oil, gas, and other mineral rights reserved of record, as of the date of enactment of this Act, by, or in favor of, the United States or a third party;</text>
 </paragraph><paragraph id="id2c4672cce6584b7cb861db548b8b6975"><enum>(2)</enum><text>any permit, license, lease, right-of-use, flowage easement, or right-of-way of record in, on, over, or across the applicable property or Federal land, whether owned by the United States or a third party, as of the date of enactment of this Act;</text>
 </paragraph><paragraph id="id89ae5ec4b7994d6786b8c1048af59efa"><enum>(3)</enum><text>any reversion back to the United States of land (other than land described in subsection (b)(4)(A)(i) or land transferred under subsection (b)(4)(B)(i) that is designated by the Secretary as a recreation area as of the date of enactment of this Act) transferred to the Board or State under subsection (b), if the applicable property is no longer used for the purpose of public access or recreation; and</text>
 </paragraph><paragraph id="id613b89d2b4ae4e108472689d796d282f"><enum>(4)</enum><text>any flowage easement reserved by the United States to allow full operation of Jamestown Reservoir for authorized purposes.</text>
				</paragraph></subsection><subsection id="id2b95f247d04f4ada97e9ce92eefd7825"><enum>(d)</enum><header>Liability; taking</header>
 <paragraph id="idcfb9085ee7d54a85bc1783c7a68519a6"><enum>(1)</enum><header>Liability</header><text>The United States shall not be liable for flood damage to the property of a permittee, the Board, or the State, or for damages arising out of any act, omission, or occurrence relating to a lot to which a permit applies, other than for damages caused by an act or omission of the United States or an employee, agent, or contractor of the United States before the date of enactment of this Act.</text>
 </paragraph><paragraph id="id75f686513a7343ec8365f1e423acd42a"><enum>(2)</enum><header>Taking</header><text>Any temporary flooding or flood damage to the property of a permittee, the Board, or the State, shall not be considered to be a taking by the United States.</text>
				</paragraph></subsection><subsection id="id94f83775232f4bba98bf13bfadff3ff4"><enum>(e)</enum><header>Requirements relating to conveyances and transfers</header>
 <paragraph id="id480ebfdd64484842b1c21d44ce828851"><enum>(1)</enum><header>Interim requirements</header><text>During the period beginning on the date of enactment of this Act and ending on the date of conveyance or transfer of a property or land, the provisions of the management agreement referred to in subsection (a)(2)(C) that are applicable to the property or land, or to leases between the State and the Secretary, shall remain in force and effect.</text>
 </paragraph><paragraph id="id6bb4a015a4eb4c4d8d88f90fc7d0a142"><enum>(2)</enum><header>Legal descriptions</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary, in consultation with the Board and the State, shall provide to the Board, the State, and each applicable permittee a legal description of all properties and land that may be conveyed or transferred pursuant to this section.</text>
 </paragraph><paragraph id="id723eaa83b2544b70bc91e8f1b10dfb30"><enum>(3)</enum><header>Restriction on conveyance</header><text>Effective beginning on the date of enactment of this Act—</text> <subparagraph id="id516cf16f7cd74a1fbbaad09f6ebc9a6f"><enum>(A)</enum><text>a permittee may not build any new permanent structure below a flood pool elevation of 1,454 feet; and</text>
 </subparagraph><subparagraph id="ida3768fd90d9d4ee58bba815329aea202"><enum>(B)</enum><text>if a permittee builds a structure described in subparagraph (A), the property of the permittee shall revert to the Board.</text>
 </subparagraph></paragraph></subsection><subsection id="idf2242de50fcc465e8c68ad6bb620a8f9"><enum>(f)</enum><header>Proceeds from sales of Federal land</header><text>Any revenues from a sale of Federal land pursuant to this section shall be made available to the Secretary, without further appropriation, for—</text>
 <paragraph id="idaf09a3896d504e64a3f3b498e9313f69"><enum>(1)</enum><text>the costs to the Secretary of carrying out this section, including any costs of carrying out subsections (b)(2)(A) and (e)(2); and</text>
 </paragraph><paragraph id="id6ac4c67225764bcdb4ba04cae79a1d6f"><enum>(2)</enum><text>deferred maintenance activities relating to the operation of the dam in the Jamestown Reservoir.</text></paragraph></subsection></section></legis-body> <legis-body display-enacting-clause="no-display-enacting-clause"> <section changed="added" committee-id="SSEG00" id="id8028229b-aa13-4e95-854d-a5a0cfee2f72" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph commented="no" id="id2ad2f5ff-cba1-4c23-bb18-d7d85545f7de"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the Stutsman County Park Board in Jamestown, North Dakota.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d6ad74007c74dec9babc235d12b0f4e"><enum>(2)</enum><header display-inline="yes-display-inline">Game and fish headquarters</header><text display-inline="yes-display-inline">The term <term>game and fish headquarters</term> means the land depicted as <quote>Game and Fish Headquarters</quote> on the Map.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0240c9af-3be1-4278-8aac-2582931a431f"><enum>(3)</enum><header display-inline="yes-display-inline">Jamestown Reservoir</header><text display-inline="yes-display-inline">The term <term>Jamestown Reservoir</term> means the Jamestown Reservoir constructed as a unit of the Missouri-Souris Division, Pick-Sloan Missouri Basin Program, as authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6BD3DB050CA948CD882E762F8F7F06B2"><enum>(4)</enum><header>Management Agreement</header><text>The term <term>Management Agreement</term> means the management agreement entitled <quote>Management Agreement between the United States of America and Stutsman County Park Board for the Management, Development, Operation and Maintenance of Recreation and Related Improvements and Facilities at Jamestown Reservoir Stutsman County, North Dakota</quote>, numbered 15–LM–60–2255, and dated February 17, 2015.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8C0BF94816BB49B18BE7E6FDAC8FC8AA"><enum>(5)</enum><header display-inline="yes-display-inline">Map</header><text display-inline="yes-display-inline">The term <term>Map</term> means the map prepared by the Bureau of Reclamation, entitled <quote>Jamestown Reservoir</quote>, and dated May 2018.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27a60a1050d6437c9b7ceffab0380fe7"><enum>(6)</enum><header display-inline="yes-display-inline">Permitted cabin land</header><text display-inline="yes-display-inline">The term <term>permitted cabin land</term> means the land depicted as <quote>Permitted Cabin Lands</quote> on the Map.</text>
 </paragraph><paragraph id="id2cfc5fa6-ab32-41dc-ad38-7155aa862563"><enum>(7)</enum><header>Property</header><text>The term <term>property</term> means any cabin site located on permitted cabin land for which a permit is in effect on the date of enactment of this Act.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7ca0ad6703494e959606ec7ad6bb3764"><enum>(8)</enum><header display-inline="yes-display-inline">Recreation land</header><text display-inline="yes-display-inline">The term <term>recreation land</term> means the land depicted as <quote>Recreation and Public Purpose Lands</quote> on the Map.</text> </paragraph><paragraph id="ide07c78a4-aad5-400b-a7a7-500ffc097077"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text>
 </paragraph><paragraph id="id0d063a26-d0e6-4e95-a85e-24719b5aa879"><enum>(10)</enum><header>State</header><text>The term <term>State</term> means the State of North Dakota, acting through the North Dakota Game and Fish Department.</text> </paragraph></section><section changed="added" committee-id="SSEG00" id="id22a6b6df544a46c08ef07299f6eaa754" reported-display-style="italic"><enum>2.</enum><header>Conveyances to Stutsman County Park Board</header> <subsection id="id8392635e29744f18a5f0e6c75a473e9b"><enum>(a)</enum><header>Conveyances to Stutsman County Park Board</header> <paragraph id="id2f94de7e7a5d48b8903195ff97eccc45"><enum>(1)</enum><header>In general</header><text>Subject to the management requirements of paragraph (3) and the easements and reservations under section 4, not later than 5 years after the date of enactment of this Act, the Secretary shall convey to the Board all right, title, and interest of the United States in and to—</text>
 <subparagraph id="idc9bef01ee13b425a9cffb78df51fd4b7"><enum>(A)</enum><text>the recreation land; and</text> </subparagraph><subparagraph id="idc1a75fdb314d406693d1818a04eadf63"><enum>(B)</enum><text>the permitted cabin land.</text>
					</subparagraph></paragraph><paragraph id="ideac369cdca224f9a9afef8156c43ef01"><enum>(2)</enum><header>Costs</header>
 <subparagraph id="id30bd6f53e923454084d793325b85caf8"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary shall convey the land described in paragraph (1) at no cost.</text>
 </subparagraph><subparagraph id="id4f86e4658e814c9dad93f76599572dd8"><enum>(B)</enum><header>Title transfer; land surveys</header><text>As a condition of the conveyances under paragraph (1), the Board shall agree to pay all survey and other administrative costs necessary for the preparation and completion of any patents for, and transfers of title to, the land described in paragraph (1).</text>
					</subparagraph></paragraph><paragraph id="idf88abbbdb47541248dd2fb8a9546dd77"><enum>(3)</enum><header>Management</header>
 <subparagraph id="idc5a4f9c904aa4bd78b0b5e4798fb5769"><enum>(A)</enum><header>Recreation land</header><text>The Board shall manage the recreation land conveyed under paragraph (1)—</text> <clause id="ided61ecf4a428422bb739bb84034453cb"><enum>(i)</enum><text>for recreation and public purposes consistent with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (44 Stat. 741, chapter 578; <external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.);</text>
 </clause><clause id="id1fdd3b75aa2a47ea9e42ab522f47771e"><enum>(ii)</enum><text>for public access;</text> </clause><clause id="id55b777170d594f7c96edfd4e95fb9c8f"><enum>(iii)</enum><text>for fish and wildlife habitat; or</text>
 </clause><clause id="id846834bd0dd145ba902107ccdc2821af"><enum>(iv)</enum><text>to preserve the natural character of the recreation land.</text> </clause></subparagraph><subparagraph id="id548a422eda514dd7bc91d5e3568a9668"><enum>(B)</enum><header>Permitted cabin land</header><text>The Board shall manage the permitted cabin land conveyed under paragraph (1)—</text>
 <clause id="id61a366ffc79345f6a0facc6e964a22db"><enum>(i)</enum><text>for cabins or recreational residences in existence as of the date of enactment of this Act; or</text> </clause><clause id="id4a21f17abc1641009748599458822f1f"><enum>(ii)</enum><text>for any of the recreation land management purposes described in subparagraph (A).</text>
 </clause></subparagraph></paragraph><paragraph id="idfd935621b2c54338b6ef3db11bb1b521"><enum>(4)</enum><header>Haying and grazing</header><text>With respect to recreation land conveyed under paragraph (1) that is used for haying or grazing authorized by the Management Agreement as of the date of enactment of this Act, the Board may continue to permit haying and grazing in a manner that is permissible under the 1 or more haying or grazing contracts in effect as of the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="id3692f84bac964ea79af0b41645e6a198"><enum>(b)</enum><header>Reversion</header><text>If a parcel of land conveyed under subparagraph (A) or (B) of subsection (a)(1) is used in a manner that is inconsistent with the requirements described in subparagraph (A) or (B), respectively, of subsection (a)(3), the parcel of land shall, at the discretion of the Secretary, revert to the United States.</text>
			</subsection><subsection id="idea7265807f8f40ad84573873cca62753"><enum>(c)</enum><header>Sale of permitted cabin land by board</header>
 <paragraph id="id665928edfd7649b1a5962f8a08abbf89"><enum>(1)</enum><header>In General</header><text>If the Board sells any parcel of permitted cabin land conveyed under subsection (a)(1)(B), the parcel shall be sold at fair market value, as determined by a third-party appraiser in accordance with the Uniform Standards of Professional Appraisal Practice, subject to paragraph (2).</text>
 </paragraph><paragraph id="idce887a17fb1e4652b5b9027bf6d02649"><enum>(2)</enum><header>Improvements</header><text>For purposes of an appraisal conducted under paragraph (1), any improvements on the permitted cabin land made by a permit holder shall not be included in the appraised value of the land.</text>
 </paragraph><paragraph id="idfeac7d556eb644bf9c30ee5b98c323a1"><enum>(3)</enum><header>Proceeds from the Sale of Land by the Board</header><text>If the Board sells a parcel of permitted cabin land conveyed under subsection (a)(1)(B), the Board shall pay to the Secretary the amount of any proceeds of the sale that exceed the costs of preparing the sale by the Board.</text>
 </paragraph></subsection><subsection id="idd1a789068e87445e9ff29daa3b45b301"><enum>(d)</enum><header>Availability of funds to the Secretary</header><text>Any amounts paid to the Secretary for land conveyed by the Secretary under this Act shall be made available to the Secretary, without further appropriation, for activities relating to the operation of the Jamestown Dam and Reservoir.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="id9e8fe174f4124007b53e4cade76cbf5b" reported-display-style="italic"><enum>3.</enum><header>Conveyance of game and fish headquarters to the  State</header>
 <subsection id="idf799c6c9b4194efbb02c278dd348efee"><enum>(a)</enum><header>Conveyance of game and fish headquarters</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary shall convey to the State all right, title, and interest of the United States in and to the game and fish headquarters, on the condition that the game and fish headquarters continue to be used as a game and fish headquarters or substantially similar purposes.</text>
 </subsection><subsection id="id48773dcf5ca140a3997db874b84ab255"><enum>(b)</enum><header>Reversion</header><text>If land conveyed under subsection (a) is used in a manner that is inconsistent with the requirements described in that subsection, the land shall, at the discretion of the Secretary, revert to the United States.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="id562e774caa964aa7b91a2313e3e1549c" reported-display-style="italic"><enum>4.</enum><header>Reservations, easements, and other outstanding rights</header>
 <subsection id="id38a11195214d47ae83e304030181daad"><enum>(a)</enum><header>In general</header><text>Each conveyance to the Board or the State pursuant to this Act shall be made subject to—</text> <paragraph id="id2d2002a5689d4c9a9ef4feb2274dcebc"><enum>(1)</enum><text>valid existing rights;</text>
 </paragraph><paragraph id="id2f5842f4088949ceb09e476e08be882b"><enum>(2)</enum><text>operational requirements of the Pick-Sloan Missouri River Basin Program, as authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665), including the Jamestown Reservoir;</text>
 </paragraph><paragraph id="idb2cbe3ff3af14dec8a398b98d353ce1a"><enum>(3)</enum><text>any flowage easement reserved by the United States to allow full operation of the Jamestown Reservoir for authorized purposes;</text>
 </paragraph><paragraph id="id1b835345ee51470f9fae16496b8e9ca2"><enum>(4)</enum><text>reservations described in the Management Agreement;</text> </paragraph><paragraph id="id8829a3c5d9814b389b475b4cdbbbf16d"><enum>(5)</enum><text>oil, gas, and other mineral rights reserved of record, as of the date of enactment of this Act, by, or in favor of, the United States or a third party;</text>
 </paragraph><paragraph id="idc77d626fe29243559c13b38ec5961e77"><enum>(6)</enum><text>any permit, license, lease, right-of-use, flowage easement, or right-of-way of record in, on, over, or across the applicable property or Federal land, whether owned by the United States or a third party, as of the date of enactment of this Act;</text>
 </paragraph><paragraph id="idf4d89ab69b574d898b97096ee190ad58"><enum>(7)</enum><text>a deed restriction that prohibits building any new permanent structure on property below an elevation of 1,454 feet; and</text>
 </paragraph><paragraph id="idc740dedd0b4b42998afc7b3787d4063e"><enum>(8)</enum><text>the granting of applicable easements for—</text> <subparagraph id="idfdd6f9d973f7449f9a3fe554ea54e507"><enum>(A)</enum><text>vehicular access to the property; and</text>
 </subparagraph><subparagraph id="id81fab52dd5ae4387bdf423d9d65931c5"><enum>(B)</enum><text>access to, and use of, all docks, boathouses, ramps, retaining walls, and other improvements for which access is provided in the permit for use of the property as of the date of enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="idc8c682e147bb4fc9a1fa11fdd29ecd62"><enum>(b)</enum><header>Liability; taking</header>
 <paragraph id="idce48a332c30b411597dc8250dc99336f"><enum>(1)</enum><header>Liability</header><text>The United States shall not be liable for flood damage to a property subject to a permit, the Board, or the State, or for damages arising out of any act, omission, or occurrence relating to a permit holder, the Board, or the State, other than for damages caused by an act or omission of the United States or an employee, agent, or contractor of the United States before the date of enactment of this Act.</text>
 </paragraph><paragraph id="ida06191de836b4056a3abb1530ab9732a"><enum>(2)</enum><header>Taking</header><text>Any temporary flooding or flood damage to the property of a permit holder, the Board, or the State, shall not be considered to be a taking by the United States.</text>
 </paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="id45c8a5554b594902b3f96f5ba1584f02" reported-display-style="italic"><enum>5.</enum><header>Interim requirements</header><text display-inline="no-display-inline">During the period beginning on the date of enactment of this Act and ending on the date of conveyance of a property or parcel of land under this Act, the provisions of the Management Agreement that are applicable to the property or land, or to leases between the State and the Secretary, and any applicable permits, shall remain in force and effect.</text></section></legis-body><endorsement><action-date>July 30, 2018</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
