			 eighteen</enrolled-dateline><legis-num display="yes">S. 1869</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To reauthorize and rename the position of Whistleblower Ombudsman to be the Whistleblower
 Protection Coordinator. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Whistleblower Protection Coordination Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idE885B29CF14B4F39919D67EC1D32964E" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Reauthorization</header><subsection commented="no" display-inline="no-display-inline" id="id54F8050CC8434134A39B479D95F2BEF5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 3(d) of the Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idA4CD924FF3DD47C190C7B15EFCE6E100"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(C)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id222A9B5132224214915B9848FEFA2EFD"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and adjusting the margins accordingly;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCAB5EABFE12244FCBAFDAC905B0E7F95"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>Ombudsman who shall educate agency employees—</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="id3C8F052813944DDDB80FF3544ECDF0E8" style="OLC"><text>Coordinator who shall—</text><clause commented="no" display-inline="no-display-inline" id="id3DB79B6C3930406B9B1670398B9DFCFB" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">educate agency employees—</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id849EE13DF94D401C9B14C858BABD112C"><enum>(C)</enum><text display-inline="yes-display-inline">in subclause (I), as so redesignated, by striking <quote>on retaliation</quote> and inserting <quote>against retaliation</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id860D146F389E4BFDA0C474E15554011D"><enum>(D)</enum><text display-inline="yes-display-inline">in subclause (II), as so redesignated, by striking the period at the end and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="id79E51EF11A7942D39A914A94A0844C13" style="OLC"><text>, including—</text><item commented="no" display-inline="no-display-inline" id="id9CC99CCD498A4C4CA7054D2C1B828986" indent="up1"><enum>(aa)</enum><text display-inline="yes-display-inline">the means by which employees may seek review of any allegation of reprisal, including the roles of the Office of the Inspector General, the Office of Special Counsel, the Merit Systems Protection Board, and any other relevant entities; and</text></item><item commented="no" display-inline="no-display-inline" id="id158142691FFD43F29149C8E63C10CAC2" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">general information about the timeliness of such cases, the availability of any alternative dispute mechanisms, and avenues for potential relief.</text></item><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7DC68090CD8F4043BB8F2F815DFE6688"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idBD243F5407374788923A0BA4A5D96355" style="OLC"><clause commented="no" display-inline="no-display-inline" id="idF1E3505CE3DE4CB5A080CC5A76AF144F" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">assist the Inspector General in promoting the timely and appropriate handling and consideration of protected disclosures and allegations of reprisal, to the extent practicable, by the Inspector General; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idCE62651BBEF54BBD94D56A7B930AA0E7" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">assist the Inspector General in facilitating communication and coordination with the Special Counsel, the Council of the Inspectors General on Integrity and Efficiency, the establishment, Congress, and any other relevant entity regarding the timely and appropriate handling and consideration of protected disclosures, allegations of reprisal, and general matters regarding the implementation and administration of whistleblower protection laws, rules, and regulations.</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5096DE511B324855830ED10397A6EC6B"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>Ombudsman</quote> and inserting <quote>Coordinator</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE7B6D4E2C13B433FB469F82B986FF612"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD096594264714EC8B1F198917C033048"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the following:</text><quoted-block display-inline="no-display-inline" id="idBD18F76A83B049AEAB642ADA552DFE50" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id093BCEA369C148CDB2861925872D8284"><enum>(3)</enum><text display-inline="yes-display-inline">The Whistleblower Protection Coordinator shall have direct access to the Inspector General as needed to accomplish the requirements of this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id78498A8E9F2A4F7380C6CB2C15D14B8C"><enum>(b)</enum><header display-inline="yes-display-inline">Responsibilities of CIGIE</header><text display-inline="yes-display-inline">Section 11(c) of the Inspector General Act of 1978 (5 U.S.C. App.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idBA54C21DE6B945F6BF35769E524E34EE" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id9D1CE8AB9055400B8798019A8EC94A97"><enum>(5)</enum><header display-inline="yes-display-inline">Additional responsibilities relating to whistleblower protection</header><text display-inline="yes-display-inline">The Council shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idEA6758FFE25B4CA99F45EA8BEB52F9CE"><enum>(A)</enum><text display-inline="yes-display-inline">facilitate the work of the Whistleblower Protection Coordinators designated under section 3(d)(C); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3a6b35c5f00d4b0590dd49db797fe42b"><enum>(B)</enum><text display-inline="yes-display-inline">in consultation with the Office of Special Counsel and Whistleblower Protection Coordinators from the member offices of the Inspector General, develop best practices for coordination and communication in promoting the timely and appropriate handling and consideration of protected disclosures, allegations of reprisal, and general matters regarding the implementation and administration of whistleblower protection laws, in accordance with Federal law.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id04127A92210B4840B0E66B9E75CB2E37"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Section 5 of the Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id74E8CEAC3C434AF49FBDBA341F195D9A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by amending paragraph (20) to read as follows:</text><quoted-block display-inline="no-display-inline" id="id362E9FEB3E3846DDA80E3D91CA5E6E84" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idECB4CB2EF41542D4B7B94E0785D4FC2F"><enum>(20)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7E3EB79D48A44D5286E7C1C697272072"><enum>(A)</enum><text display-inline="yes-display-inline">a detailed description of any instance of whistleblower retaliation, including information about the official found to have engaged in retaliation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id129F55D58A0841A0A3E1B4B5E6ED8F94" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">what, if any, consequences the establishment actually imposed to hold the official described in subparagraph (A) accountable;</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1F3A985582AF4A56AF269DAF3904F05F"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idBDDFBDA792C24D599F8C15668A979652"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3)(D), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id967A2EBCCC1249D182B779572E074117"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph (5); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id308FF51E1FC64BCBAC2C68B4CB2E0BEE"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the following:</text><quoted-block display-inline="no-display-inline" id="id4077A8494D0B4630BE535E7A53E9ABB6" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id1517BCE438764FAEABAEAF44798165AC"><enum>(4)</enum><text display-inline="yes-display-inline">whether the establishment entered into a settlement agreement with the official described in subsection (a)(20)(A), which shall be reported regardless of any confidentiality agreement relating to the settlement agreement; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1249BB4EDC314F819CFD0B5A23734F8E"><enum>(d)</enum><header display-inline="yes-display-inline">Repeal of sunset</header><paragraph commented="no" display-inline="no-display-inline" id="idBC8543F5B9924B76B2AA91B5AADA283F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (c) of section 117 of the Whistleblower Protection Enhancement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/199">Public Law 112–199</external-xref>; 126 Stat. 1475) is repealed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C989EB2CEFB44A09B7E6EEF2678D358"><enum>(2)</enum><header display-inline="yes-display-inline">Retroactive effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall take effect on November 26, 2017.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
