			<section commented="no" display-inline="no-display-inline" id="ide03cda4b76c74897a3228e54010e00ee" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Mandatory sanctions with respect to fundraising and recruitment activities for Hizballah</header>
 <subsection commented="no" display-inline="no-display-inline" id="id2a0eb773030c49568cbc14546d90b0b9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 101 of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text>

						<section commented="no" display-inline="no-display-inline" id="id309e4179d5d64a8da65a2db2b259ae2b" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Mandatory sanctions with respect to fundraising and recruitment activities for Hizballah</header>
 <subsection commented="no" display-inline="no-display-inline" id="id8df74fe21e3c4b74901828482ab2b998"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President shall impose the sanctions described in subsection (b) with respect to any foreign person that the President determines knowingly provides significant financial, material, or technological support for—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id2943AD7C369D4587A3785AD35A87F939"><enum>(1)</enum><text display-inline="yes-display-inline">Bayt al-Mal, Jihad al-Bina, the Islamic Resistance Support Association, or any successor or affiliate thereof as designated by the President;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b06c81ae2eb4e6f97a6492e4c0a83a7"><enum>(2)</enum><text display-inline="yes-display-inline">al-Manar TV, al Nour Radio, or the Lebanese Media Group, or any successor or affiliate thereof as designated by the President;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c802a6df5c04805afbd0a95cc870063"><enum>(3)</enum><text display-inline="yes-display-inline">a foreign person determined by the President to be engaged in fundraising or recruitment activities for Hizballah; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id337712491a0f44caaccf2559c2508eaf"><enum>(4)</enum><text display-inline="yes-display-inline">a foreign person owned or controlled by a foreign person described in paragraph (1), (2), or (3).</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id94cebfdcc7bb477483bce5c8a82bbc27"><enum>(b)</enum><header display-inline="yes-display-inline">Sanctions described</header> <paragraph commented="no" display-inline="no-display-inline" id="id1d82bbe77a39413bb9450638fb21cb95"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The sanctions described in this subsection are the following:</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id53b2dfd078364f5cbb7a928b82bb6b71"><enum>(A)</enum><header display-inline="yes-display-inline">Asset blocking</header><text display-inline="yes-display-inline">The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of a foreign person determined by the President to be subject to subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71321d5caf994d158a91de25c14dc9b8"><enum>(B)</enum><header display-inline="yes-display-inline">Aliens ineligible for visas, admission, or parole</header>
 <clause commented="no" display-inline="no-display-inline" id="id4196217fd230481abeb333f193581edb"><enum>(i)</enum><header display-inline="yes-display-inline">Visas, admission, or parole</header><text display-inline="yes-display-inline">An alien who the President determines is subject to subsection (a) is—</text> <subclause commented="no" display-inline="no-display-inline" id="id2a0f37198a7f419f9e31343908e76877"><enum>(I)</enum><text display-inline="yes-display-inline">inadmissible to the United States;</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id3790c80282524547a66263ec49827e9e"><enum>(II)</enum><text display-inline="yes-display-inline">ineligible to receive a visa or other documentation to enter the United States; and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="id8b45b0e7fa7543b99106d9fcfec860ad"><enum>(III)</enum><text display-inline="yes-display-inline">otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7d80543238c6410dab484ca81a5f6b7b"><enum>(ii)</enum><header display-inline="yes-display-inline">Current visas revoked</header>
 <subclause commented="no" display-inline="no-display-inline" id="idd702319186ff4a3495f2903cc38eb515"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The issuing consular officer, the Secretary of State, or the Secretary of Homeland Security shall revoke any visa or other entry documentation issued to an alien who the President determines is subject to subsection (a), regardless of when issued.</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id81e5c3914b234774916cfdee404a8d88"><enum>(II)</enum><header display-inline="yes-display-inline">Effect of revocation</header><text display-inline="yes-display-inline">A revocation under subclause (I) shall take effect immediately and shall automatically cancel any other valid visa or entry documentation that is in the possession of the alien.</text>
 </subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id782733f0d39c461289c7b5fe7ea2e443"><enum>(2)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed under paragraph (1)(A) to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of such section 206.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id866d60df3a234685bc8419d38b6c66f7"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to carry out this section.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id76fd0e09225d4c30bddff4a611d81ead"><enum>(d)</enum><header display-inline="yes-display-inline">Procedures for judicial review of classified information</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id8e202aaed0f54fe2a7bf052763e17352"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a finding under this section, or a prohibition, condition, or penalty imposed as a result of any such finding, is based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (18 U.S.C. App.)) and a court reviews the finding or the imposition of the prohibition, condition, or penalty, the President may submit such information to the court ex parte and in camera.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90a6a90f0998401985eb8a2afd3baf69"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to confer or imply any right to judicial review of any finding under this section or any prohibition, condition, or penalty imposed as a result of any such finding.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7db1286563434073bae93a2b1ca312b7"><enum>(e)</enum><header display-inline="yes-display-inline">Waiver</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id90e130472ce4427590cbe1ef8a9a2ed3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section if the President certifies to the appropriate congressional committees that such waiver is in the national security interests of the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB6C8A7E8CBC24FFFA0335E031B7C3FD4"><enum>(2)</enum><header display-inline="yes-display-inline">Briefing</header><text display-inline="yes-display-inline">Not later than 30 days after the issuance of a waiver under paragraph (1) with respect to a foreign person, and every 180 days thereafter while the waiver remains in effect, the President shall brief the appropriate congressional committees on the status of the involvement of the foreign person in activities described in subsection (a).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idab08d187aaa44ba281ade693429c9d8b"><enum>(f)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2017</short-title>, and every 180 days thereafter for the following 5 years, the President shall submit to the appropriate congressional committees a report that lists the foreign persons that the President determines are described in subsection (a).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id3cd630ae2ca340d98d33b3cf30cc0fd8"><enum>(g)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id3f734a1ebd56486c81508850c8ad8f9d"><enum>(1)</enum><header display-inline="yes-display-inline">Admitted; alien</header><text display-inline="yes-display-inline">The terms <term>admitted</term> and <term>alien</term> have meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id47d431a3f4c54f479aad7517780b0612"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id6c65d416c9ff4fc1983e13a76ccf5f77"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Ways and Means, the Committee on the Judiciary, and the Committee on Financial Services of the House of Representatives; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idac148b52cc834032967f18be2547c507"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Finance, the Committee on Banking, Housing, and Urban Affairs, and the Committee on the Judiciary of the Senate.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1af4ceb241b2488aab3bdeae915b2d47"><enum>(3)</enum><header display-inline="yes-display-inline">Entity</header><text display-inline="yes-display-inline">The term <term>entity</term> means a partnership, association, corporation, or other organization, group, or subgroup.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbdf0888cd4154697b2f1110ee86fa3ef"><enum>(4)</enum><header display-inline="yes-display-inline">Hizballah</header><text display-inline="yes-display-inline">The term <term>Hizballah</term> has the meaning given such term in section 102(f).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4548ded7f75497c96a03bb68ed224ff"><enum>(5)</enum><header display-inline="yes-display-inline">Person</header><text display-inline="yes-display-inline">The term <term>person</term> means an individual or entity.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6147AADE61474BB481D5AD5C171B8907"><enum>(6)</enum><header display-inline="yes-display-inline">United States person</header><text display-inline="yes-display-inline">The term <term>United States person</term> means a United States citizen, permanent resident alien, entity organized under the laws of the United States (including foreign branches), or a person in the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id33cfdc15670a49d697866999dbe214ba"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Hizballah International Financing Prevention Act of 2015 is amended by striking the item relating to section 101 and inserting the following new item:</text>

 </subsection></section><section commented="no" display-inline="no-display-inline" id="idbe35ef4dd68c4469a131edb574a9ec28" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Modification of report with respect to financial institutions that engage in certain transactions</header><text display-inline="no-display-inline">Subsection (d) of section 102 of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id23cd08bb1267472a8a7b7ddf46b20c2f" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id8a4d2b1043704e38b8cf4d54afda9f79"><enum>(d)</enum><header display-inline="yes-display-inline">Report on financial institutions organized under the laws of state sponsors of terrorism</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idf8b7f3f7c03a49f4b2c2bc7d319904a3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2017</short-title>, and every 180 days thereafter for the following 5 years, the President shall submit to the appropriate congressional committees a report that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id3c195dd11fe04a9c8aa2d3f137f33c23"><enum>(A)</enum><text display-inline="yes-display-inline">identifies each foreign financial institution described in paragraph (2) that the President determines engages in one or more activities described in subsection (a)(2);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4cd43dff53414015951200d1babad62a"><enum>(B)</enum><text display-inline="yes-display-inline">provides a detailed description of each such activity; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9818f317cb2a4c5187166805747ab80e"><enum>(C)</enum><text display-inline="yes-display-inline">contains a determination with respect to each such foreign financial institution that is identified under subparagraph (A) as engaging in one or more activities described in subsection (a)(2) as to whether such foreign financial institution is in violation of Executive Order 13224 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism) by reason of engaging in one or more such activities.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87FFBBEF6F6C4DE0A7D9CC4C2C1B2CE4"><enum>(2)</enum><header display-inline="yes-display-inline">Foreign financial institution described</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8963f3b4109e41fdb091573660fe7eeb"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A foreign financial institution described in this paragraph is a foreign financial institution—</text> <clause commented="no" display-inline="no-display-inline" id="id792cb8792bb04e6ca02062cbd8b5361c"><enum>(i)</enum><text display-inline="yes-display-inline">that, wherever located, is—</text>
 <subclause commented="no" display-inline="no-display-inline" id="id7fa197de3ea44a65ba4f7229ff4f9d91"><enum>(I)</enum><text display-inline="yes-display-inline">organized under the laws of a state sponsor of terrorism or any jurisdiction within a state sponsor of terrorism;</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="idfe42ee34b8cd449cb5d7b64152b0ca83"><enum>(II)</enum><text display-inline="yes-display-inline">owned or controlled by the government of a state sponsor of terrorism;</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="id57a1f44e9a2e48209fbc0cb426a1f2d3"><enum>(III)</enum><text display-inline="yes-display-inline">located in the territory of a state sponsor of terrorism; or</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id9cc743c0b6034600ac6bd799fa28b98c"><enum>(IV)</enum><text display-inline="yes-display-inline">owned or controlled by a foreign financial institution described in subclause (I), (II), or (III); and</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="id071ed52fd8964621906e8bd31ec7e73f"><enum>(ii)</enum><text display-inline="yes-display-inline">the capitalization of which exceeds $10,000,000.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8605bf314a3c4a218690f8c3e21c0567"><enum>(B)</enum><header display-inline="yes-display-inline">State sponsor of terrorism</header><text display-inline="yes-display-inline">In this paragraph, the term <term>state sponsor of terrorism</term> means a country the government of which the Secretary of State has determined is a government that has repeatedly provided support for acts of international terrorism for purposes of—</text>
 <clause commented="no" display-inline="no-display-inline" id="ida8d4d66e2e634309a139dce752a779f0"><enum>(i)</enum><text display-inline="yes-display-inline">section 6(j) of the Export Administration Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/50/4605">50 U.S.C. 4605(j)</external-xref>) (as continued in effect pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.));</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idf642ee2ae9eb40509fb8373b8312bf63"><enum>(ii)</enum><text display-inline="yes-display-inline">section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text> </clause><clause commented="no" display-inline="no-display-inline" id="idd1420c2c9c864f10bfae7ca171d6492b"><enum>(iii)</enum><text display-inline="yes-display-inline">section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>); or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id024aa6609e704f258400d1b6b7e63a8e"><enum>(iv)</enum><text display-inline="yes-display-inline">any other provision of law.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section commented="no" display-inline="no-display-inline" id="iddbb166508bea473596750d816668cd30" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Sanctions against agencies and instrumentalities of foreign states that support Hizballah</header> <subsection commented="no" display-inline="no-display-inline" id="id17f997bfce864e4d8befb918bb854562"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title I of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by adding at the end the following:</text>

 <subsection commented="no" display-inline="no-display-inline" id="id35cf66baa58b429a89afee4c09c34890"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, and as appropriate thereafter, the President shall block and prohibit all transactions in all property and interests in property of any agency or instrumentality of a foreign state described in subsection (b) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id43755d794470498d8f291e49e5db4b02"><enum>(b)</enum><header display-inline="yes-display-inline">Agency or instrumentality of a foreign state described</header><text display-inline="yes-display-inline">An agency or instrumentality of a foreign state described in this subsection is an agency or instrumentality of a foreign state that the President determines knowingly provides significant financial, material, or technological support for, goods or services to or in support of, or arms or related material to—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idBAA8259E7AE644BE839EFACB49172E18"><enum>(1)</enum><text display-inline="yes-display-inline">Hizballah;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBBFC8F8B9EFF451E95598F1D795E5C0D"><enum>(2)</enum><text display-inline="yes-display-inline">an entity owned or controlled by Hizballah; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1F7184E3B06B4277B6673A15354DB8C5"><enum>(3)</enum><text display-inline="yes-display-inline">an entity that the President determines has acted for or on behalf of Hizballah.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9291926D620645698011E2CAB80F8C76"><enum>(c)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed under subsection (a) to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of such section 206.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idAB36C015762A45B4A1E45A87B30773C2"><enum>(d)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to carry out this section.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idD9664BD16B6B4B12AFD47E7B9E62DF68"><enum>(e)</enum><header display-inline="yes-display-inline">Procedures for judicial review of classified information</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idBA626D5D33EA4044A39D5E1B1D37EAB3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a finding under this section, or a prohibition, condition, or penalty imposed as a result of any such finding, is based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (18 U.S.C. App.)) and a court reviews the finding or the imposition of the prohibition, condition, or penalty, the President may submit such information to the court ex parte and in camera.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6D33A2BFF5F34E4284D380BE0FF8C5C4"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to confer or imply any right to judicial review of any finding under this section or any prohibition, condition, or penalty imposed as a result of any such finding.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5424D263131C41389E6E2EFB577B722D"><enum>(f)</enum><header display-inline="yes-display-inline">Waiver</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id1CB765D5C15A410681487B396CBB9DCF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section with respect to an agency or instrumentality of a foreign state if the President certifies to the appropriate congressional committees that such waiver is in the national security interests of the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD741DC00908D4CC0AB4B9E59F98DE33B"><enum>(2)</enum><header display-inline="yes-display-inline">Briefing</header><text display-inline="yes-display-inline">Not later than 30 days after the issuance of a waiver under paragraph (1) with respect to an agency or instrumentality of a foreign state, and every 180 days thereafter while the waiver remains in effect, the President shall brief the appropriate congressional committees on the status of the involvement of the agency or instrumentality in activities described in subsection (b).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide811e5460c234482b47e84d95de489da"><enum>(g)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="idB6FB8CA02B594B82A2361849C9BA7D31"><enum>(1)</enum><header display-inline="yes-display-inline">Agency or instrumentality of a foreign state; foreign state</header><text display-inline="yes-display-inline">The terms <term>agency or instrumentality of a foreign state</term> and <term>foreign state</term> have the meanings given those terms in section 1603 of title 28, United States Code.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79995feb762247fd95aee7780efe73f9"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id73DAF043322F499FA9D6DE88CE3F237A"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Financial Services, the Committee on Ways and Means, and the Committee on the Judiciary of the House of Representatives; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id813657A79E724E809B9A50460F6B18AF"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Committee on the Judiciary of the Senate.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id226bd0902dbf4125bc7eacbb48e4a16e"><enum>(3)</enum><header display-inline="yes-display-inline">Arms or related material</header><text display-inline="yes-display-inline">The term <term>arms or related material</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ida8e4d61aa456417ca9a72f542e1b8d88"><enum>(A)</enum><text display-inline="yes-display-inline">nuclear, biological, chemical, or radiological weapons or materials or components of such weapons;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd7f779f3a376457c98dec2399988b50a"><enum>(B)</enum><text display-inline="yes-display-inline">ballistic or cruise missile weapons or materials or components of such weapons;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida2224cc8068045c094ff89046b33b179"><enum>(C)</enum><text display-inline="yes-display-inline">destabilizing numbers and types of advanced conventional weapons;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f5b839c691a4ad5b065d10c7e8a0b74"><enum>(D)</enum><text display-inline="yes-display-inline">defense articles or defense services, as those terms are defined in paragraphs (3) and (4), respectively, of section 47 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2794">22 U.S.C. 2794</external-xref>);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD5498B402F7C4B0A98C1CE88DBDDC0CE"><enum>(E)</enum><text display-inline="yes-display-inline">defense information, as that term is defined in section 644 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2403">22 U.S.C. 2403</external-xref>); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfefa66b3bf9b49d78f39b66ceaade353"><enum>(F)</enum><text display-inline="yes-display-inline">items designated by the President for purposes of the United States Munitions List under section 38(a)(1) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778(a)(1)</external-xref>).</text>

 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idafb74e7c0de0479ea80c857d58aa7ac0"><enum>(2)</enum><text display-inline="yes-display-inline">The extent to which Hizballah, and agents and affiliates of Hizballah, engage in a pattern of such racketeering activities.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDD03137EC288408B9F688C0DCAD00CF6"><enum>(b)</enum><header display-inline="yes-display-inline">Form of report</header><text display-inline="yes-display-inline">Each report required under subsection (a) shall be submitted in an unclassified form but may contain a classified annex.</text>

 <subsection commented="no" display-inline="no-display-inline" id="idf9861e91ddb44be0b47d5eded45b91a0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 204 of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idfb0372ef8d404928980d89a3d14e1a73"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id83fbc6f64e75479984c82a75f7a9ea1f"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>this Act</quote> and inserting <quote>the <short-title>Hizballah International Financing Prevention Amendments Act of 2017</short-title>, and annually thereafter for the following 5 years</quote>;</text>

 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11078712f3394282ba8d164a3a16deb2"><enum>(G)</enum><text display-inline="yes-display-inline">a description of the total aggregate revenues and remittances that Hizballah receives from the global logistics networks of Hizballah.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd6216930d5e4e0e838fff1c3d991174"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) and (c) as subsections (c) and (d), respectively;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4bbd46cfe9440499cd0a46bfd027b93"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text>

 <paragraph commented="no" display-inline="no-display-inline" id="idF24C63ACC9FD40F7AA529BC817E0B03B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President shall prescribe, as necessary, enhanced due diligence policies, procedures, and controls for United States financial institutions, and foreign financial institutions maintaining correspondent accounts or payable-through accounts with United States financial institutions, that the President determines provide significant financial services for persons and entities operating in a jurisdiction included in the list required under subsection (a)(1)(F) if the President determines and reports to the appropriate congressional committees that it is in the national security interest of the United States to do so.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide5a9f0d39a644794ae7622519d765d2b"><enum>(2)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection, the terms <term>correspondent account</term> and <term>payable-through account</term> have the meanings given those terms in section 5318A of title 31, United States Code.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8e620e9c087d4758a5162eade0eae61b"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (c), as redesignated by paragraph (2) by adding before the period at the end the following: <quote>and on any requirements for enhanced due diligence prescribed under subsection (b)</quote>.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3cd311d283f94f3ea7a1a230a9d7ee36"><enum>(b)</enum><header display-inline="yes-display-inline">Report on estimated net worth of senior Hizballah members</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id291a14872b2c44d695fc6511bb0c5f06"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and not less frequently than annually thereafter for the following 2 years, the President shall submit to the appropriate congressional committees a report that contains—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="ided49a3519215458e98a400d16e97d765"><enum>(A)</enum><text display-inline="yes-display-inline">the estimated total net worth of each individual described in paragraph (2); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24657bc65a29408fb9771c42750cd0d3"><enum>(B)</enum><text display-inline="yes-display-inline">a description of how funds of each individual described in paragraph (2) were acquired, and how such funds have been used or employed.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18e6cc854b5a42e79683fac99700b92d"><enum>(2)</enum><header display-inline="yes-display-inline">Individuals described</header><text display-inline="yes-display-inline">The individuals described in this paragraph are the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="id6a3ebaeb09cd44aca3f3bde24e51aa15"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary General of Hizballah.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf7d2d2fecba74dc5988ff0bbd4cb5268"><enum>(B)</enum><text display-inline="yes-display-inline">Any other individual that the President determines is a senior foreign political figure of Hizballah.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2017389ebfe4410af34200dcbba0b7c"><enum>(3)</enum><header display-inline="yes-display-inline">Form of report; public availability</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="idb6ff1f8da2604bf3bdeea84e40132b08"><enum>(A)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall be submitted in unclassified form but may contain a classified annex.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24c55292729c4155ad317db4a8e7ecc4"><enum>(B)</enum><header display-inline="yes-display-inline">Public availability</header><text display-inline="yes-display-inline">The unclassified portion of the report required under paragraph (1) shall be made available to the public in precompressed, easily downloadable versions that are made available in all appropriate formats.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06facb17ca3542da9447c6b8ecc31f5b"><enum>(4)</enum><header display-inline="yes-display-inline">Sources of information</header><text display-inline="yes-display-inline">In preparing the report required under paragraph (1), the President may use any credible publication, database, or web-based resource, and any credible information compiled by any government agency, nongovernmental organization, or other entity provided to or made available to the President.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id133ca7ac336c42d79c2e4772e9ce42ce"><enum>(5)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2cb5aa69749741b69f777047517ce183"><enum>(A)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text>
 <clause commented="no" display-inline="no-display-inline" id="idaa16a5609a23496ba9f384b85c7c3cbe"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id0134d68c9c4f40ceba0236eaac707915"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d302277e81745ecbf2aff6f9f111284"><enum>(B)</enum><header display-inline="yes-display-inline">Funds</header><text display-inline="yes-display-inline">The term <term>funds</term> means—</text> <clause commented="no" display-inline="no-display-inline" id="idd963b70426dd40db908db901a8ff7609"><enum>(i)</enum><text display-inline="yes-display-inline">cash;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id12cc0532263742a5b4af91746614f2e9"><enum>(ii)</enum><text display-inline="yes-display-inline">equity;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id9d21c24c02a74c259aa820160984cbc6"><enum>(iii)</enum><text display-inline="yes-display-inline">any other intangible asset the value of which is derived from a contractual claim, including bank deposits, bonds, stocks, a security (as defined in section 2(a) of the Securities Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/15/77b">15 U.S.C. 77b(a)</external-xref>)), or a security or an equity security (as those terms are defined in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>)); and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id0cebdc749bf840cf962dbe6c3db482ba"><enum>(iv)</enum><text display-inline="yes-display-inline">anything else of value that the Secretary of the Treasury determines to be appropriate.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1d5fbe69177e4529b48c5d82eaec0d66"><enum>(C)</enum><header display-inline="yes-display-inline">Senior foreign political figure</header><text display-inline="yes-display-inline">The term <term>senior foreign political figure</term> has the meaning given that term in section 1010.605 of title 31, Code of Federal Regulations (or any successor regulation).</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idf9b51f3af7ad40a88fa46ce2538d9a15" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Report on combating the illicit tobacco trafficking networks used by Hizballah</header>
 <subsection commented="no" display-inline="no-display-inline" id="id7e101b4bdcc2496f9a580ab247dcd973"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report on combating the illicit tobacco trafficking networks used by Hizballah to finance their operations, as described in the report submitted to Congress in December 2015 by the Department of State, the Department of Justice, the Department of the Treasury, the Department of Homeland Security, and the Department of Health and Human Services entitled, <quote>The Global Illicit Trade in Tobacco: A Threat to National Security.</quote>.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id11213f4a347044f99e1308e0fd539569"><enum>(b)</enum><header display-inline="yes-display-inline">Matters To be addressed</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include the following:</text> <paragraph commented="no" display-inline="no-display-inline" id="idff42ebea7dc249f69b5f0d3ec50f46bd"><enum>(1)</enum><text display-inline="yes-display-inline">A description of the steps to be taken by Federal agencies to combat the illicit tobacco trafficking networks used by Hizballah.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id369c3f26790049b8a5bc88892b2338d8"><enum>(2)</enum><text display-inline="yes-display-inline">A description of the steps to be taken to engage State and local law enforcement authorities in efforts to combat illicit tobacco trafficking networks used by Hizballah operating within the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id203a851049334b26b6df066e634a3d82"><enum>(3)</enum><text display-inline="yes-display-inline">A description of the steps to be taken to engage foreign government law enforcement and intelligence authorities in efforts to combat illicit tobacco trafficking networks used by Hizballah operating outside the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17fbf6b0167c44278780ad6cb9bb7a90"><enum>(4)</enum><text display-inline="yes-display-inline">Recommendations for legislative or administrative action, as appropriate, to address the threat of illicit tobacco trafficking networks.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id74ac2a4cfa574618965b658545822c28"><enum>(c)</enum><header display-inline="yes-display-inline">Appropriate congressional committees defined</header><text display-inline="yes-display-inline">In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph commented="no" display-inline="no-display-inline" id="id67B785B6128146949A5B16F51A576FC8"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Armed Services, the Committee on Homeland Security, the Committee on the Judiciary, the Committee on Financial Services, and the Committee on Ways and Means of the House of Representatives; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbfd2de40d02342d1a3939f017f61a9d7"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Armed Services, the Committee on Homeland Security and Governmental Affairs, the Committee on the Judiciary, the Committee on Banking, Housing, and Urban Affairs, and the Committee on Finance of the Senate.</text>
					</paragraph></subsection></section></title><title commented="no" id="id2A8FFE547EC446ABA6D83C80AB33D649" level-type="subsequent" style="OLC"><enum>III</enum><header display-inline="yes-display-inline">General provisions</header>
			<section commented="no" display-inline="no-display-inline" id="id4a582da3f9094ee6baaa741b9aff771c" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Regulatory authority</header>
 <subsection commented="no" display-inline="no-display-inline" id="idf72007a6c2a74e0abdc96dfbc8eec885"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President shall, not later than 180 days after the date of the enactment of this Act, prescribe regulations as necessary for the implementation of this Act and the amendments made by this Act.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id52410acfddc7416c9095366e50d0adb5"><enum>(b)</enum><header display-inline="yes-display-inline">Notification to Congress</header><text display-inline="yes-display-inline">Not later than 10 days before the prescription of regulations under subsection (a), the President shall notify the appropriate congressional committees regarding the proposed regulations and the provisions of this Act and the amendments made by this Act that the regulations are implementing.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id2d018c56969742c0948b34a16272a95f"><enum>(c)</enum><header display-inline="yes-display-inline">Appropriate congressional committees defined</header><text display-inline="yes-display-inline">In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph commented="no" display-inline="no-display-inline" id="id4c240d8a8c964a66a9903a2a0f6ad80b"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf41fbc91936d4d6a892d8fcec989069b"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id3da301ab93b24c2087f2f50b7cba2bc0" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Exceptions</header>
 <subsection commented="no" display-inline="no-display-inline" id="id3002BCE19428418D96D26994321CF5F1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">This Act and the amendments made by this Act shall not apply to the following:</text> <paragraph commented="no" display-inline="no-display-inline" id="idd781f7daa99c4ba3a6677a31dac8e903"><enum>(1)</enum><text display-inline="yes-display-inline">Any authorized intelligence, law enforcement, or national security activities of the United States.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f19a85172ad4319a2e14b7f16d65668"><enum>(2)</enum><text display-inline="yes-display-inline">Any transaction necessary to comply with United States obligations under—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idF7BCE8D9EA0D4AF89BCEC4B05C19FF89"><enum>(A)</enum><text display-inline="yes-display-inline">the Agreement between the United Nations and the United States of America regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB90FDB6A6B0549338C57C1262BDA99C3"><enum>(B)</enum><text display-inline="yes-display-inline">the Convention on Consular Relations, done at Vienna April 24, 1963, and entered into force March 19, 1967; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6B05E5F5864F497A941243AF690BFF2C"><enum>(C)</enum><text display-inline="yes-display-inline">any other international treaty.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id17179A462327431B9201F404289B31BA"><enum>(b)</enum><header display-inline="yes-display-inline">Exception relating to importation of goods</header><text display-inline="yes-display-inline">The authorities and requirements to impose sanctions under this Act and the amendments made by<pagebreak></pagebreak> this Act shall not include the authority or requirement to impose sanctions on the importation of goods.</text>
