Report consolidation and modification.</toc-entry></toc></subsection></section><title commented="no" id="HD6550117D0FD47EAB1E169FF956A2564" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Prevention of Access by Hizballah to International Financial and Other Institutions</header><section commented="no" display-inline="no-display-inline" id="H2824C1A66B2E40E4A955336CF5A4DD67" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Mandatory sanctions with respect to fundraising and recruitment activities for Hizballah</header><subsection commented="no" display-inline="no-display-inline" id="H494ACCF2A1C44197AA6793FF76C8E4E6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 101 of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HEC486B0CC25D462DBBC566C92FD76522" style="OLC"><section commented="no" display-inline="no-display-inline" id="H7D1CE56089AE4F8CBA1045E81E0CDBF5" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Mandatory sanctions with respect to fundraising and recruitment activities for Hizballah</header><subsection commented="no" display-inline="no-display-inline" id="H60B9CA5DF46E4115886C65B1AB1686C1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President shall, on or after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, impose the sanctions described in subsection (b) with respect to any foreign person that the President determines knowingly provides significant financial, material, or technological support for or to—</text><paragraph commented="no" display-inline="no-display-inline" id="H13219C8776C442DD9F1FF41DD030E2C3"><enum>(1)</enum><text display-inline="yes-display-inline">Bayt al-Mal, Jihad al-Bina, the Islamic Resistance Support Association, the Foreign Relations Department of Hizballah, the External Security Organization of Hizballah, or any successor or affiliate thereof as designated by the President;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H197AF219813543F5AD4C6D96E9858A6F"><enum>(2)</enum><text display-inline="yes-display-inline">al-Manar TV, al Nour Radio, or the Lebanese Media Group, or any successor or affiliate thereof as designated by the President;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC785036AF15F4DB5BF0D68698FA82130"><enum>(3)</enum><text display-inline="yes-display-inline">a foreign person determined by the President to be engaged in fundraising or recruitment activities for Hizballah; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2DC94E0CF9B145CAB88F0E437E134FC0"><enum>(4)</enum><text display-inline="yes-display-inline">a foreign person owned or controlled by a person described in paragraph (1), (2), or (3).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8E1E7AD8CF874701B68E5BFD48A7A6D0"><enum>(b)</enum><header display-inline="yes-display-inline">Sanctions described</header><text display-inline="yes-display-inline">The sanctions described in this subsection are the following:</text><paragraph commented="no" display-inline="no-display-inline" id="H804A48E7CDBC48289E344253E5E78AE0"><enum>(1)</enum><header display-inline="yes-display-inline">Asset blocking</header><text display-inline="yes-display-inline">The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of a foreign person determined by the President to be subject to subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9DCC4C8FD450409A8BC7D057542FF6F7"><enum>(2)</enum><header display-inline="yes-display-inline">Aliens ineligible for visas, admission, or parole</header><subparagraph commented="no" display-inline="no-display-inline" id="H2AB94171364F45DD9B0EB3786A981895"><enum>(A)</enum><header display-inline="yes-display-inline">Visas, admission, or parole</header><text display-inline="yes-display-inline">An alien who the Secretary of State or the Secretary of Homeland Security (or designee of one of such Secretaries) determines is subject to subsection (a) is—</text><clause commented="no" display-inline="no-display-inline" id="HC5039685BD5745C4B71063B29FDF5B63"><enum>(i)</enum><text display-inline="yes-display-inline">inadmissible to the United States;</text></clause><clause commented="no" display-inline="no-display-inline" id="H1821A646F1734143BC04E4DA779B679A"><enum>(ii)</enum><text display-inline="yes-display-inline">ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H759E845BCFDA4D888E4A22A1A5D7687B"><enum>(iii)</enum><text display-inline="yes-display-inline">otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB02FC0A6A52B4A5FAFE0CAC01437834D"><enum>(B)</enum><header display-inline="yes-display-inline">Current visas revoked</header><clause commented="no" display-inline="no-display-inline" id="H406825BFBC44487B9FC633A668F27489"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of State or the Secretary of Homeland Security (or designee of one of such Secretaries) shall revoke any visa or other entry documentation issued to an alien who the President determines is subject to subsection (a), regardless of when issued.</text></clause><clause commented="no" display-inline="no-display-inline" id="H973742D5FDD54B5E96FF51649DD758DE"><enum>(ii)</enum><header display-inline="yes-display-inline">Effect of revocation</header><text display-inline="yes-display-inline">A revocation under clause (i) shall take effect immediately and shall automatically cancel any other valid visa or entry documentation that is in the possession of the alien.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFDB298F08B574B3B9D73F74FADD7FE35"><enum>(c)</enum><header display-inline="yes-display-inline">Waiver</header><paragraph commented="no" display-inline="no-display-inline" id="HDBB640D114D846E1BF16C3EEBF6D244F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section if the President certifies to the appropriate congressional committees that such waiver is in the national security interests of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H21085CA28DA54747A1431A6F1572D869"><enum>(2)</enum><header display-inline="yes-display-inline">Briefing</header><text display-inline="yes-display-inline">Not later than 30 days after the issuance of a waiver under paragraph (1) with respect to a foreign person, and every 180 days thereafter while the waiver remains in effect, the President shall brief the appropriate congressional committees on the status of the involvement of the foreign person in activities described in subsection (a).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDCD794C2C6224EEAA9E22C9F8378B1D5"><enum>(d)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H285986F9470B43AEB325AD9FCE9D27A1"><enum>(1)</enum><header display-inline="yes-display-inline">Admitted; alien</header><text display-inline="yes-display-inline">The terms <term>admitted</term> and <term>alien</term> have meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7F88F4ED14A24794BEC3C03993D1AD80"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HFFD61910728241B2A85AFEAA39781724"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Ways and Means, the Committee on the Judiciary, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11614E9A4FB7416797C5A3A950E80920"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Finance, the Committee on Banking, Housing, and Urban Affairs, the Committee on the Judiciary, and the Select Committee on Intelligence of the Senate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40C3510CB5E04221912DC2C1712EDF12"><enum>(3)</enum><header display-inline="yes-display-inline">Entity</header><text display-inline="yes-display-inline">The term <term>entity</term> means a partnership, association, corporation, or other organization, group, or subgroup.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H97E94097F1F94AA3A733D85411678FFE"><enum>(4)</enum><header display-inline="yes-display-inline">Foreign person</header><text display-inline="yes-display-inline">The term <quote>foreign person</quote> means any person that is not a United States person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H16F6C3319CC540BFAB4EE97EC853636A"><enum>(5)</enum><header display-inline="yes-display-inline">Hizballah</header><text display-inline="yes-display-inline">The term <term>Hizballah</term> has the meaning given such term in section 102(e).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF3E5E9D9B5F4A989DDFCC1A6C7A20D7"><enum>(6)</enum><header display-inline="yes-display-inline">Person</header><text display-inline="yes-display-inline">The term <term>person</term> means an individual or entity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF5BE4CA275BA4E619DA26387D301E7C5"><enum>(7)</enum><header display-inline="yes-display-inline">United states person</header><text display-inline="yes-display-inline">The term <term>United States person</term> means a United States citizen, an alien lawfully admitted for permanent residence, an entity organized under the laws of the United States (including foreign branches), or a person in the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HFB7F1C2C4BBD45F78B1CEC69A5094101"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Hizballah International Financing Prevention Act of 2015 is amended by striking the item relating to section 101 and inserting the following new item:</text><quoted-block display-inline="no-display-inline" id="H281D389C1147438980F8D0BD5CE8CBDC" style="OLC"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">Sec. 101. Mandatory sanctions with respect to fundraising and recruitment activities for Hizballah.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="H035622C5355249D1866B3E3511A4FAB0" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Modification of report with respect to financial institutions that engage in certain transactions</header><text display-inline="no-display-inline">Section 102(d) of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HCC2B89FDF00E404B839D5C405CF567E1" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H0DEB3DAC117F4D2B91EDA82F5C8ECDE7"><enum>(d)</enum><header display-inline="yes-display-inline">Report on financial institutions organized under the laws of state sponsors of terrorism</header><paragraph commented="no" display-inline="no-display-inline" id="H4609BBEF1BD64B36B4E8DBE056DBEFAF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the Hizballah International Financing Prevention Amendments Act of 2018, and every 2 years thereafter for a period not to exceed 4 years, the President shall submit to the appropriate congressional committees a report that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2D4F96FF1E81407AB78EB8A4AD971618"><enum>(A)</enum><text display-inline="yes-display-inline">identifies each foreign financial institution described in paragraph (2) that the President determines engages in one or more activities described in subsection (a)(2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1D4446E60D6640C095F27B4114EAFA69"><enum>(B)</enum><text display-inline="yes-display-inline">provides a detailed description of each such activity.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDB9EFA381B14DFABC3E25BD2C1A4772"><enum>(2)</enum><header display-inline="yes-display-inline">Foreign financial institution described</header><subparagraph commented="no" display-inline="no-display-inline" id="HAB015DC2156240D18FE56D62CD036C68"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A foreign financial institution described in this paragraph is a foreign financial institution—</text><clause commented="no" display-inline="no-display-inline" id="HF09C6B56693143C798C308A4D2186EE9"><enum>(i)</enum><text display-inline="yes-display-inline">that, wherever located, is—</text><subclause commented="no" display-inline="no-display-inline" id="H2358C2C6823148119AE8519E30441A89"><enum>(I)</enum><text display-inline="yes-display-inline">organized under the laws of a state sponsor of terrorism or any jurisdiction within a state sponsor of terrorism;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H35BEE531035A4854922A5CF0962873E1"><enum>(II)</enum><text display-inline="yes-display-inline">owned or controlled by the government of a state sponsor of terrorism;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H9458895CA7FF49ADBBED81CA3DADAB24"><enum>(III)</enum><text display-inline="yes-display-inline">located in the territory of a state sponsor of terrorism; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3914157EE266412FA299B8C9C302AC26"><enum>(IV)</enum><text display-inline="yes-display-inline">owned or controlled by a foreign financial institution described in subclause (I), (II), or (III); and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H76EEB6F173FB45D3BA72F42E05CCEE6C"><enum>(ii)</enum><text display-inline="yes-display-inline">the capitalization of which exceeds $10,000,000.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71562A6ECEE94223A67CF1A7A3B87861"><enum>(B)</enum><header display-inline="yes-display-inline">State sponsor of terrorism defined</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>state sponsor of terrorism</quote> means a country the government of which the Secretary of State has determined is a government that has repeatedly provided support for acts of international terrorism for purposes of—</text><clause commented="no" display-inline="no-display-inline" id="H0CBB8B10769443CEB6466EA088EF4407"><enum>(i)</enum><text display-inline="yes-display-inline">section 1754(c) of the Export Control Reform Act of 2018;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC77FA8C4CBB04180976C6E7E9BF92DE4"><enum>(ii)</enum><text display-inline="yes-display-inline">section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="H7225036FA00C4E2D98F1BF246DC154B4"><enum>(iii)</enum><text display-inline="yes-display-inline">section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="H257C322D4C8B4B629627D95F71643CDE"><enum>(iv)</enum><text display-inline="yes-display-inline">any other provision of law.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="H8BD62EEDF36947D5B56C38318963565C" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Sanctions against certain agencies and instrumentalities of foreign states</header><subsection commented="no" display-inline="no-display-inline" id="H637072A1B52F42B089760115755CD521"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title I of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HC2A218F964C74016B1156FAE4D301E32" style="OLC"><section commented="no" display-inline="no-display-inline" id="HC802F405FC304C81988257707C276344" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Sanctions against certain agencies and instrumentalities of foreign states</header><subsection commented="no" display-inline="no-display-inline" id="H1EDA099D8A704CFDA9F471A04F0FB257"><enum>(a)</enum><header display-inline="yes-display-inline">Sanctions</header><paragraph commented="no" display-inline="no-display-inline" id="HD2160BEB30934C81A5C80ECB3D2FF2A2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, and as appropriate thereafter, the President shall impose the sanctions described in paragraph (3) with respect to an agency or instrumentality of a foreign state described in paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7C12B1328E504BF8AFD75F9B08554E84"><enum>(2)</enum><header display-inline="yes-display-inline">Agency or instrumentality of a foreign state described</header><text display-inline="yes-display-inline">An agency or instrumentality of a foreign state is described in this paragraph if the President determines that the agency or instrumentality has, on or after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, knowingly—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC4B1FF890D774AD08DA9F4CEA9016B7F"><enum>(A)</enum><text display-inline="yes-display-inline">conducted significant joint combat operations with, or significantly supported combat operations of, Hizballah; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H008F6B3C9EF34B97B9F6D0DE11275198"><enum>(B)</enum><text display-inline="yes-display-inline">provided significant financial support for or to, or significant arms or related materiel to, Hizballah.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA81943ED5805406AB3A21604F7DC2AEB"><enum>(3)</enum><header display-inline="yes-display-inline">Sanctions described</header><text display-inline="yes-display-inline">The sanctions described in this paragraph are the exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of an agency or instrumentality of a foreign state if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC339C8455A424A31956ECDDE1304BC5B"><enum>(b)</enum><header display-inline="yes-display-inline">Waiver</header><paragraph commented="no" display-inline="no-display-inline" id="HC252097A2F014AFE86EBB1104B7DEF6D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section with respect to an agency or instrumentality of a foreign state if the President certifies to the appropriate congressional committees that such waiver is vital to the national security interests of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD87909FF295247C79381D20079A72088"><enum>(2)</enum><header display-inline="yes-display-inline">Briefing</header><text display-inline="yes-display-inline">Not later than 30 days after the issuance of a waiver under paragraph (1) with respect to an agency or instrumentality of a foreign state, and every 180 days thereafter while the waiver remains in effect, the President shall brief the appropriate congressional committees on the status of the involvement of the agency or instrumentality in activities described in subsection (a)(2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB1405DF5576141A7B5F2965EA056DD20"><enum>(c)</enum><header display-inline="yes-display-inline">Special rule</header><text display-inline="yes-display-inline">The President shall not be required to impose sanctions under this section with respect to an agency or instrumentality of a foreign state if the Secretary certifies in writing to the appropriate congressional committees that—</text><paragraph commented="no" display-inline="no-display-inline" id="H4BC0894DDBCF49458162C8A56B0ABF7B"><enum>(1)</enum><text display-inline="yes-display-inline">the agency or instrumentality—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF33F6951397A468C903F7BC7D0848DAD"><enum>(A)</enum><text display-inline="yes-display-inline">is no longer engaging in activities described in subsection (a)(2); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF636A2D0351E460896DA32C3E0F143FA"><enum>(B)</enum><text display-inline="yes-display-inline">has taken and is continuing to take significant verifiable steps toward terminating such activities; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H682BFBB7481A4B60B6334521FD4EE7D5"><enum>(2)</enum><text display-inline="yes-display-inline">the President has received reliable assurances from the government of the foreign state that the agency or instrumentality will not engage in any activity described in subsection (a)(2) in the future.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE0CD99970740498DBD9399E96C3409BE"><enum>(d)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H2CEF1D09A39245729A2A03C01F8A13AF"><enum>(1)</enum><header display-inline="yes-display-inline">Agency or instrumentality of a foreign state</header><text display-inline="yes-display-inline">The term <quote>agency or instrumentality of a foreign state</quote> has the meaning given the term in section 1603(b) of title 28, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBC692FCC4AD8422DA7F2D2D5F0614DE3"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <quote>appropriate congressional committees</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H1AE341460E994870B26DD545C344FAFE"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Financial Services, the Committee on Ways and Means, the Committee on the Judiciary, the Committee on Appropriations, and the Permanent Select Committee on Intelligence of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD574DE12F4E04FDE9120348FF6CDD535"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, the Committee on the Judiciary, Committee on Finance, Committee on Appropriations, and the Select Committee on Intelligence of the Senate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDBBE933629974950840494A001AC3EC6"><enum>(3)</enum><header display-inline="yes-display-inline">Arms or related materiel</header><text display-inline="yes-display-inline">The term <quote>arms or related materiel</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5AACCE1584BC4631AED972D90B542CBA"><enum>(A)</enum><text display-inline="yes-display-inline">nuclear, biological, chemical, or radiological weapons or materials or components of such weapons;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC390DE5B2E4749D3927EF229464AE800"><enum>(B)</enum><text display-inline="yes-display-inline">ballistic or cruise missile weapons or materials or components of such weapons;  illicit networks</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, the President shall instruct the Secretary of State, in consultation with the Secretary of the Treasury, to increase cooperation with foreign governments to assist in strengthening the capacity of such governments to prevent hostile activity by Iran and disrupt and degrade Hizballah’s illicit activities, including diplomatic engagement that involves—</text><paragraph commented="no" display-inline="no-display-inline" id="H01715C6376344ED28B86CA4EAC0962D4"><enum>(1)</enum><text display-inline="yes-display-inline">efforts to target and expose illicit finance networks, arrest perpetrators, freeze assets, and address Iran and Hizballah’s use of illicit financial networks using international trade and banking systems;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4E553D247B3A427DB24EDE1E84FFBA93"><enum>(2)</enum><text display-inline="yes-display-inline">efforts to assist willing governments with the development of counter-organized crime legislation, the strengthening of financial investigative capacity, and a fully-vetted counter-organized crime judicial model in jurisdictions plagued with corruption; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H916F8684BAEB4ABB83302B7818391283"><enum>(3)</enum><text display-inline="yes-display-inline">efforts to persuade governments to list Hizballah as a terrorist organization.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H96F32C1BBED0434791FF94F7B25D3E00"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Hizballah International Financing Prevention Act of 2015 is amended by inserting after the item related to section 103, as added by section 103(b) of this Act, the following new item:</text><quoted-block display-inline="no-display-inline" id="H22727746F3E94C969993AF0DEC83B36B" style="OLC"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">Sec. 104. and</text></clause><clause commented="no" display-inline="no-display-inline" id="H5E50AD65D66449B5BCD6E91A5A1F4EE0"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of indictments, prosecutions, and extraditions of Hizballah members or affiliates; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H2E9E81DA890F439C91365EDCD82F696B"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Select Committee on Intelligence of the Senate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H62FCC6E314A34D1C8C2DA0E29BF83786"><enum>(B)</enum><header display-inline="yes-display-inline">Funds</header><text display-inline="yes-display-inline">The term <quote>funds</quote> means—</text><clause commented="no" display-inline="no-display-inline" id="H77BD4FE9A6F04B0397030F52356B678C"><enum>(i)</enum><text display-inline="yes-display-inline">cash;</text></clause><clause commented="no" display-inline="no-display-inline" id="H56AC89FE382548CAAC7DD58766FC1095"><enum>(ii)</enum><text display-inline="yes-display-inline">equity;</text></clause><clause commented="no" display-inline="no-display-inline" id="HF7D781377DFA4C16AB1B575EE684881F"><enum>(iii)</enum><text display-inline="yes-display-inline">any other intangible asset the value of which is derived from a contractual claim, including bank deposits, bonds, stocks, a security (as defined in section 2(a) of the Securities Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/15/77b">15 U.S.C. 77b(a)</external-xref>)), or a security or an equity security (as those terms are defined in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>)); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H2AADCF29D52A47958BD9516D4D153ABE"><enum>(iv)</enum><text display-inline="yes-display-inline">anything else of value that the Secretary of the Treasury determines to be appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEC5563FADC5547C4ABFEB1D104167643"><enum>(C)</enum><header display-inline="yes-display-inline">Senior foreign political figure</header><text display-inline="yes-display-inline">The term <quote>senior foreign political figure</quote> has the meaning given that term in section 1010.605 of title 31, Code of Federal Regulations (or any successor regulation).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9F49248B65E842E0B9002A79CC28B4C8"><enum>(c)</enum><header display-inline="yes-display-inline">Report on individuals who are members of the Lebanese Parliament and who identify as members of
 Hizballah</header><paragraph commented="no" display-inline="no-display-inline" id="H33895D0753D2452C97CBC70AAE55B48D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall transmit to the appropriate congressional committees a report that contains the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="H735B40D44D424DC1B1302E4E5FDBBBB1"><enum>(A)</enum><text display-inline="yes-display-inline">A list of individuals who are members of the Lebanese Parliament and who identify as members of Hizballah.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3E6485CEBB344A8FBFD18E8EB73311CA"><enum>(B)</enum><text display-inline="yes-display-inline">A description of any significant conduct of individuals on the list required under subparagraph (A) that the President determines may be grounds for designation pursuant to Executive Order 13224 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H39EE9C85D9994171B64A1807999D3243"><enum>(2)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall be transmitted in unclassified form, but may include a classified annex.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA9B50BD231784B48B1B3CB1C0E99E7BB"><enum>(3)</enum><header display-inline="yes-display-inline">Appropriate congressional committees defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>appropriate congressional committees</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5C2DD77805C7491DBD34BCC7E21DE7E1"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H779C324447F7431BB5BF257C3AD33AE1"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Select Committee on Intelligence of the Senate.</text></subparagraph></paragraph></subsection></section></title><title commented="no" id="HBF36ED3504DF45289C76FD33C660750D" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">General provisions</header><section commented="no" display-inline="no-display-inline" id="H6B4FFBA6E0E3498FA68D8F061EE6840F" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Regulatory authority</header><subsection commented="no" display-inline="no-display-inline" id="H8F56F6FAFF5348BB992789496E2A6EEF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President shall, not later than 180 days after the date of the enactment of this Act, prescribe regulations as necessary for the implementation of this Act and the amendments made by this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HF0DEDA49B7A44DEFAB34ACA283932604"><enum>(b)</enum><header display-inline="yes-display-inline">Notification to Congress</header><text display-inline="yes-display-inline">Not later than 10 days before the prescription of regulations under subsection (a), the President shall notify the appropriate congressional committees regarding the proposed regulations and the provisions of this Act and the amendments made by this Act that the regulations are implementing.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H19956C6369044ADE9776DBF1B2A1884E"><enum>(c)</enum><header display-inline="yes-display-inline">Appropriate congressional committees defined</header><text display-inline="yes-display-inline">In this section, the term <quote>appropriate congressional committees</quote> means—</text><paragraph commented="no" display-inline="no-display-inline" id="H03B7A1F21D624B8DA013E2572D7F5F92"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives;  importation of goods</header><subsection commented="no" display-inline="no-display-inline" id="HA8CB2409FBB2490A864527BBFE948074"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title I of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note), as amended by sections 103 and 104 of this Act, is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7B12195F8EEB400E96875E8DAA701A0C" style="OLC"><section commented="no" display-inline="no-display-inline" id="H807224F056BA48B48CD38A83351ECEE9" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Implementation; penalties; judicial review; exemptions; rule of construction</header><subsection commented="no" display-inline="no-display-inline" id="H821DDCD32BB04ED0A2C796FEFD8A00B3"><enum>(a)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to carry out sections 101, 102, 103, and 201 of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H23174AF3E5C0473F93418F84B27B9539"><enum>(b)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed to carry out section 101, 102, 103, or 201 of this Act to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of such section 206.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H61F1B28E488B4303822B68297633ED87"><enum>(c)</enum><header display-inline="yes-display-inline">Procedures for judicial review of classified information</header><paragraph commented="no" display-inline="no-display-inline" id="HDC95FE9F52344C24A25F11C427B9E42C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a finding under section 101, 102, 103, or 201 of this Act, or a prohibition, condition, or penalty imposed as a result of any such finding, is based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (18 U.S.C. App.)) and a court reviews the finding or the imposition of the prohibition, condition, or penalty, the President may submit such information to the court ex parte and in camera.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9B345B22C013419E8C8C65DAC29EE673"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to confer or imply any right to judicial review of any finding under section 101, 102, 103, or 201 of this Act, or any prohibition, condition, or penalty imposed as a result of any such finding.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6A149BABE8ED4AACAFFEFE981A583C5D"><enum>(d)</enum><header display-inline="yes-display-inline">Exemptions</header><text display-inline="yes-display-inline">The following activities shall be exempt from sections 101, 102, 103, and 201 of this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="HB9EACF3B8CB14464BE3583148CAA352D"><enum>(1)</enum><text display-inline="yes-display-inline">Any authorized intelligence, law enforcement, or national security activities of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE9A05092C5F40AF80874635B4938D84"><enum>(2)</enum><text display-inline="yes-display-inline">Any transaction necessary to comply with United States obligations under the Agreement between the United Nations and the United States of America regarding the Headquarters of the United States, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, or the Convention on Consular Relations, done at Vienna April 24, 1963, and entered into force March 19, 1967, or any other United States international agreement.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCFA0A7DDA1404344A1E3DF9B48A3CE44"><enum>(e)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in section 101, 102, 103, or 201 of this Act shall be construed to limit the authority of the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) or under any other provision of law.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H7D40BE687ED84FE6B849529CCC8EA788"><enum>(f)</enum><header display-inline="yes-display-inline">Exception relating to importation of goods</header><paragraph commented="no" display-inline="no-display-inline" id="H76F68AB462574A118ADC84A55EA6D027"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The authorities and requirements to impose sanctions under this Act shall not include the authority or requirement to impose sanctions on the importation of goods.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H13569BAA5087403489041BAEBEAF0F24"><enum>(2)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>good</quote> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H2ADE511CF883460098AC17A9C4997E70"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Hizballah International Financing Prevention Act of 2015, as amended by this Act, is further amended by inserting after the item relating to section 104, as added by section 104(b) of this Act, the following new item:</text><quoted-block display-inline="no-display-inline" id="H1B677DB6844940BABE8FA397B427D57E" style="OLC"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">Sec. 105. Implementation; penalties; judicial review; exemptions; rule of construction.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H1A57A8F7474A4396949382BE93C4CB31"><enum>(c)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Section 102 of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H8182944BDD8D4943B9DF30E6231C34B8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking paragraphs (3) and (4);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6ED195AEF6E0469D9E67481110160281"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (e); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H236EB57B29BC4A17BD6909FB3EF4D936"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsection (f) as subsection (e).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H592335AB3FAD4682A2C0B140DF4E62A8" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Report consolidation and modification</header><subsection commented="no" display-inline="no-display-inline" id="H5F5494246BF5430FBF8E05D586F63427"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any and all reports required to be submitted to Congress under this Act or the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) that are subject to a deadline for submission consisting of the same unit of time may be consolidated into a single report that is submitted to Congress pursuant to such deadline.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HA2ED47925CFA4CE8A667B604D09E4897"><enum>(b)</enum><header display-inline="yes-display-inline">Matters to be included</header><text display-inline="yes-display-inline">Any report that is consolidated into a single report as described in subsection (a) shall contain all information required under this Act or the Hizballah International Financing Prevention Act of 2015 in addition to all other elements required by previous law.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H999F5C673775402EBFC012026A37ADB2"><enum>(c)</enum><header display-inline="yes-display-inline">Reports modification</header><text display-inline="yes-display-inline">The North Korea Sanctions and Policy Enhancement Act of 2016 is amended as follows:</text><paragraph commented="no" display-inline="no-display-inline" id="HA43F8BA7AD8B43B1B5DC47FAA3F6C798"><enum>(1)</enum><text display-inline="yes-display-inline">In section 209(a)(3)(A) (<external-xref legal-doc="usc" parsable-cite="usc/22/9229">22 U.S.C. 9229(a)(3)(A)</external-xref>), by striking <quote>not later than 90 days after the date of the enactment of this Act, and every 180 days thereafter</quote> and inserting <quote>not later than 90 days after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, and every 180 days thereafter for 5 years</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H739793280C36496CB64116AEFBA8D1B4"><enum>(2)</enum><text display-inline="yes-display-inline">In section 302(a) (<external-xref legal-doc="usc" parsable-cite="usc/22/9241">22 U.S.C. 9241(a)</external-xref>), by striking <quote>Not later than 180 days after the date of the enactment of this Act</quote> and inserting <quote>Not later than 120 days after the date of the enactment of the Hizballah International Financing Prevention Amendments Act of 2018, and periodically thereafter</quote>.</text></paragraph></subsection></section></title></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
