<section id="H2824C1A66B2E40E4A955336CF5A4DD67"><enum>101.</enum><header>Mandatory sanctions with respect to fundraising and recruitment activities for Hizballah</header>
<subsection id="H494ACCF2A1C44197AA6793FF76C8E4E6"><enum>(a)</enum><header>In general</header><text>Section 101 of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text> <quoted-block id="HEC486B0CC25D462DBBC566C92FD76522" style="OLC"> <section id="H7D1CE56089AE4F8CBA1045E81E0CDBF5"><enum>101.</enum><header>Mandatory sanctions with respect to fundraising and recruitment activities for Hizballah</header> <subsection id="H60B9CA5DF46E4115886C65B1AB1686C1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall, on or after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, impose the sanctions described in subsection (b) with respect to any foreign person that the President determines knowingly provides significant financial, material, or technological support for or to—</text>
<paragraph id="H13219C8776C442DD9F1FF41DD030E2C3"><enum>(1)</enum><text>Bayt al-Mal, Jihad al-Bina, the Islamic Resistance Support Association, the Foreign Relations Department of Hizballah, the External Security Organization of Hizballah, or any successor or affiliate thereof as designated by the President;</text></paragraph> <paragraph id="H197AF219813543F5AD4C6D96E9858A6F"><enum>(2)</enum><text>al-Manar TV, al Nour Radio, or the Lebanese Media Group, or any successor or affiliate thereof as designated by the President;</text></paragraph>
<paragraph id="HC785036AF15F4DB5BF0D68698FA82130"><enum>(3)</enum><text>a foreign person determined by the President to be engaged in fundraising or recruitment activities for Hizballah; or</text></paragraph> <paragraph id="H2DC94E0CF9B145CAB88F0E437E134FC0"><enum>(4)</enum><text>a foreign person owned or controlled by a person described in paragraph (1), (2), or (3).</text></paragraph></subsection>
<subsection id="H8E1E7AD8CF874701B68E5BFD48A7A6D0"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text> <paragraph id="H804A48E7CDBC48289E344253E5E78AE0"><enum>(1)</enum><header>Asset blocking</header><text>The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of a foreign person determined by the President to be subject to subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph>
<paragraph id="H9DCC4C8FD450409A8BC7D057542FF6F7"><enum>(2)</enum><header>Aliens ineligible for visas, admission, or parole</header>
<subparagraph id="H2AB94171364F45DD9B0EB3786A981895"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien who the Secretary of State or the Secretary of Homeland Security (or designee of one of such Secretaries) determines is subject to subsection (a) is—</text> <clause id="HC5039685BD5745C4B71063B29FDF5B63"><enum>(i)</enum><text>inadmissible to the United States;</text></clause>
<clause id="H1821A646F1734143BC04E4DA779B679A"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause> <clause id="H759E845BCFDA4D888E4A22A1A5D7687B"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text></clause></subparagraph>
<subparagraph id="HB02FC0A6A52B4A5FAFE0CAC01437834D"><enum>(B)</enum><header>Current visas revoked</header>
<clause id="H406825BFBC44487B9FC633A668F27489"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State or the Secretary of Homeland Security (or designee of one of such Secretaries) shall revoke any visa or other entry documentation issued to an alien who the President determines is subject to subsection (a), regardless of when issued.</text></clause> <clause id="H973742D5FDD54B5E96FF51649DD758DE"><enum>(ii)</enum><header>Effect of revocation</header><text>A revocation under clause (i) shall take effect immediately and shall automatically cancel any other valid visa or entry documentation that is in the possession of the alien.</text></clause></subparagraph></paragraph></subsection>
<subsection id="HFDB298F08B574B3B9D73F74FADD7FE35"><enum>(c)</enum><header>Waiver</header>
<paragraph id="HDBB640D114D846E1BF16C3EEBF6D244F"><enum>(1)</enum><header>In general</header><text>The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section if the President certifies to the appropriate congressional committees that such waiver is in the national security interests of the United States.</text></paragraph> <paragraph id="H21085CA28DA54747A1431A6F1572D869"><enum>(2)</enum><header>Briefing</header><text>Not later than 30 days after the issuance of a waiver under paragraph (1) with respect to a foreign person, and every 180 days thereafter while the waiver remains in effect, the President shall brief the appropriate congressional committees on the status of the involvement of the foreign person in activities described in subsection (a).</text></paragraph></subsection>
<subsection id="HDCD794C2C6224EEAA9E22C9F8378B1D5"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H285986F9470B43AEB325AD9FCE9D27A1"><enum>(1)</enum><header>Admitted; alien</header><text>The terms <term>admitted</term> and <term>alien</term> have meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph>
<paragraph id="H7F88F4ED14A24794BEC3C03993D1AD80"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="HFFD61910728241B2A85AFEAA39781724"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs, the Committee on Ways and Means, the Committee on the Judiciary, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives; and</text></subparagraph>
<subparagraph id="H11614E9A4FB7416797C5A3A950E80920"><enum>(B)</enum><text>the Committee on Foreign Relations, the Committee on Finance, the Committee on Banking, Housing, and Urban Affairs, the Committee on the Judiciary, and the Select Committee on Intelligence of the Senate.</text></subparagraph></paragraph> <paragraph id="H40C3510CB5E04221912DC2C1712EDF12"><enum>(3)</enum><header>Entity</header><text>The term <term>entity</term> means a partnership, association, corporation, or other organization, group, or subgroup.</text></paragraph>
<paragraph id="H97E94097F1F94AA3A733D85411678FFE"><enum>(4)</enum><header>Foreign person</header><text display-inline="yes-display-inline">The term <quote>foreign person</quote> means any person that is not a United States person.</text></paragraph> <paragraph id="H16F6C3319CC540BFAB4EE97EC853636A"><enum>(5)</enum><header>Hizballah</header><text>The term <term>Hizballah</term> has the meaning given such term in section 102(e).</text></paragraph>
<paragraph id="HDF3E5E9D9B5F4A989DDFCC1A6C7A20D7"><enum>(6)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph> <paragraph id="HF5BE4CA275BA4E619DA26387D301E7C5"><enum>(7)</enum><header>United states person</header><text>The term <term>United States person</term> means a United States citizen, an alien lawfully admitted for permanent residence, an entity organized under the laws of the United States (including foreign branches), or a person in the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HFB7F1C2C4BBD45F78B1CEC69A5094101"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Hizballah International Financing Prevention Act of 2015 is amended by striking the item relating to section 101 and inserting the following new item:</text> <quoted-block style="OLC" id="H281D389C1147438980F8D0BD5CE8CBDC" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 101. Mandatory sanctions with respect to fundraising and recruitment activities for Hizballah.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H035622C5355249D1866B3E3511A4FAB0"><enum>102.</enum><header>Modification of report with respect to financial institutions that engage in certain transactions</header><text display-inline="no-display-inline">Section 102(d) of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text>

<subsection id="H0DEB3DAC117F4D2B91EDA82F5C8ECDE7"><enum>(d)</enum><header>Report on financial institutions organized under the laws of state sponsors of terrorism</header>
<paragraph id="H4609BBEF1BD64B36B4E8DBE056DBEFAF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the Hizballah International Financing Prevention Amendments Act of 2018, and every 2 years thereafter for a period not to exceed 4 years, the President shall submit to the appropriate congressional committees a report that—</text> <subparagraph id="H2D4F96FF1E81407AB78EB8A4AD971618"><enum>(A)</enum><text>identifies each foreign financial institution described in paragraph (2) that the President determines engages in one or more activities described in subsection (a)(2); and</text></subparagraph>
<subparagraph id="H1D4446E60D6640C095F27B4114EAFA69"><enum>(B)</enum><text>provides a detailed description of each such activity.</text></subparagraph></paragraph> <paragraph id="HFDB9EFA381B14DFABC3E25BD2C1A4772"><enum>(2)</enum><header>Foreign financial institution described</header> <subparagraph id="HAB015DC2156240D18FE56D62CD036C68"><enum>(A)</enum><header>In general</header><text>A foreign financial institution described in this paragraph is a foreign financial institution—</text>
<clause id="HF09C6B56693143C798C308A4D2186EE9"><enum>(i)</enum><text>that, wherever located, is—</text> <subclause id="H2358C2C6823148119AE8519E30441A89"><enum>(I)</enum><text>organized under the laws of a state sponsor of terrorism or any jurisdiction within a state sponsor of terrorism;</text></subclause>
<subclause id="H35BEE531035A4854922A5CF0962873E1"><enum>(II)</enum><text>owned or controlled by the government of a state sponsor of terrorism;</text></subclause> <subclause id="H9458895CA7FF49ADBBED81CA3DADAB24"><enum>(III)</enum><text>located in the territory of a state sponsor of terrorism; or</text></subclause>
<subclause id="H3914157EE266412FA299B8C9C302AC26"><enum>(IV)</enum><text>owned or controlled by a foreign financial institution described in subclause (I), (II), or (III); and</text></subclause></clause> <clause id="H76EEB6F173FB45D3BA72F42E05CCEE6C"><enum>(ii)</enum><text>the capitalization of which exceeds $10,000,000.</text></clause></subparagraph>
<subparagraph id="H71562A6ECEE94223A67CF1A7A3B87861"><enum>(B)</enum><header>State sponsor of terrorism defined</header><text>In this paragraph, the term <quote>state sponsor of terrorism</quote> means a country the government of which the Secretary of State has determined is a government that has repeatedly provided support for acts of international terrorism for purposes of—</text> <clause id="H0CBB8B10769443CEB6466EA088EF4407"><enum>(i)</enum><text>section 1754(c) of the Export Control Reform Act of 2018;</text></clause>
<clause id="HC77FA8C4CBB04180976C6E7E9BF92DE4"><enum>(ii)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></clause> <clause id="H7225036FA00C4E2D98F1BF246DC154B4"><enum>(iii)</enum><text>section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>); or</text></clause>
<clause id="H257C322D4C8B4B629627D95F71643CDE"><enum>(iv)</enum><text>any other provision of law.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H8BD62EEDF36947D5B56C38318963565C"><enum>103.</enum><header>Sanctions against certain agencies and instrumentalities of foreign states</header> <subsection id="H637072A1B52F42B089760115755CD521"><enum>(a)</enum><header>In general</header><text>Title I of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by adding at the end the following:</text>

<section id="HC802F405FC304C81988257707C276344"><enum>103.</enum><header>Sanctions against certain agencies and instrumentalities of foreign states</header>
<subsection id="H1EDA099D8A704CFDA9F471A04F0FB257" commented="no"><enum>(a)</enum><header>Sanctions</header>
<paragraph id="HD2160BEB30934C81A5C80ECB3D2FF2A2" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, and as appropriate thereafter, the President shall impose the sanctions described in paragraph (3) with respect to an agency or instrumentality of a foreign state described in paragraph (2).</text></paragraph> <paragraph id="H7C12B1328E504BF8AFD75F9B08554E84" commented="no"><enum>(2)</enum><header>Agency or instrumentality of a foreign state described</header><text display-inline="yes-display-inline">An agency or instrumentality of a foreign state is described in this paragraph if the President determines that the agency or instrumentality has, on or after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, knowingly—</text>
<subparagraph id="HC4B1FF890D774AD08DA9F4CEA9016B7F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">conducted significant joint combat operations with, or significantly supported combat operations of, Hizballah; or</text></subparagraph> <subparagraph id="H008F6B3C9EF34B97B9F6D0DE11275198" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">provided significant financial support for or to, or significant arms or related materiel to, Hizballah.</text></subparagraph></paragraph>
<paragraph id="HA81943ED5805406AB3A21604F7DC2AEB" commented="no"><enum>(3)</enum><header>Sanctions described</header><text display-inline="yes-display-inline">The sanctions described in this paragraph are the exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of an agency or instrumentality of a foreign state if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph></subsection> <subsection id="HC339C8455A424A31956ECDDE1304BC5B" commented="no"><enum>(b)</enum><header>Waiver</header> <paragraph id="HC252097A2F014AFE86EBB1104B7DEF6D" commented="no"><enum>(1)</enum><header>In general</header><text>The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section with respect to an agency or instrumentality of a foreign state if the President certifies to the appropriate congressional committees that such waiver is vital to the national security interests of the United States.</text></paragraph>
<paragraph id="HD87909FF295247C79381D20079A72088" commented="no"><enum>(2)</enum><header>Briefing</header><text>Not later than 30 days after the issuance of a waiver under paragraph (1) with respect to an agency or instrumentality of a foreign state, and every 180 days thereafter while the waiver remains in effect, the President shall brief the appropriate congressional committees on the status of the involvement of the agency or instrumentality in activities described in subsection (a)(2).</text></paragraph></subsection> <subsection id="HB1405DF5576141A7B5F2965EA056DD20"><enum>(c)</enum><header>Special rule</header><text display-inline="yes-display-inline">The President shall not be required to impose sanctions under this section with respect to an agency or instrumentality of a foreign state if the Secretary certifies in writing to the appropriate congressional committees that—</text>
<paragraph id="H4BC0894DDBCF49458162C8A56B0ABF7B" commented="no"><enum>(1)</enum><text>the agency or instrumentality—</text> <subparagraph id="HF33F6951397A468C903F7BC7D0848DAD" commented="no"><enum>(A)</enum><text>is no longer engaging in activities described in subsection (a)(2); or</text></subparagraph>
<subparagraph id="HF636A2D0351E460896DA32C3E0F143FA" commented="no"><enum>(B)</enum><text>has taken and is continuing to take significant verifiable steps toward terminating such activities; and</text></subparagraph></paragraph> <paragraph id="H682BFBB7481A4B60B6334521FD4EE7D5" commented="no"><enum>(2)</enum><text>the President has received reliable assurances from the government of the foreign state that the agency or instrumentality will not engage in any activity described in subsection (a)(2) in the future.</text></paragraph></subsection>

<paragraph id="H01715C6376344ED28B86CA4EAC0962D4" commented="no"><enum>(1)</enum><text>efforts to target and expose illicit finance networks, arrest perpetrators, freeze assets, and address Iran and Hizballah’s use of illicit financial networks using international trade and banking systems;</text></paragraph> <paragraph id="H4E553D247B3A427DB24EDE1E84FFBA93" commented="no"><enum>(2)</enum><text>efforts to assist willing governments with the development of counter-organized crime legislation, the strengthening of financial investigative capacity, and a fully-vetted counter-organized crime judicial model in jurisdictions plagued with corruption; and</text></paragraph>

<section id="H5F8C9B98E1D845EB86B0E9E1F3D7B537"><enum>201.</enum><header>Imposition of sanctions with respect to affiliated networks of Hizballah for transnational criminal activities</header>
<subsection id="HC97C3BCFB61F434BA72E31BBB291E321" commented="no"><enum>(a)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It is the policy of the United States to determine if individuals and entities that are designated by the United States Government on or after the date of the enactment of this Act as being associated with Hizballah are engaged in transnational organized crime or related activities on or after such date of enactment. </text></subsection> <subsection id="H95B6216011324DB9AA11CB1F970B3DFB"><enum>(b)</enum><header>In general</header><text>Section 201 of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text>

<subsection id="H8652CBEFCFF14281822AFC0B782B85D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall, on or after the date of the enactment of the Hizballah International Financing Prevention Amendments Act of 2018, impose the sanctions described in subsection (b) with respect to affiliated networks of Hizballah, including, as appropriate, by reason of significant transnational criminal activities engaged in by such networks.</text></subsection> <subsection id="H59A3F9D94A6945F1A14C103AD094ACE8"><enum>(b)</enum><header>Sanctions described</header><text display-inline="yes-display-inline">The sanctions described in this subsection are sanctions applicable with respect to Hizballah pursuant to any provision of law, including Executive Order 13581 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of transnational criminal organizations) (as such Executive Order was in effect on the day before the date of the enactment of the Hizballah International Financing Prevention Amendments Act of 2018).</text></subsection>
<subsection id="H357DFEBD2814496B9DE6577EBCD9B31A"><enum>(c)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section if the President certifies to the appropriate congressional committees that such waiver is in the national security interests of the United States.</text></subsection> <subsection id="H5BD879B95B484FF0932D58DB53225530"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>

<subparagraph id="HE9A121FB94204A789E8C6DA4BA98B8F2"><enum>(G)</enum><text>a description of the total aggregate revenues and remittances that Hizballah receives from the global logistics networks of Hizballah;</text></subparagraph> <subparagraph id="H07A1751B5D664DFC83EBB6113543C2D7" commented="no"><enum>(H)</enum><text display-inline="yes-display-inline">a list of Hizballah’s sources of revenue, including sources of revenue based on illicit activity, revenues from Iran, charities, and other business activities;</text></subparagraph>
<subparagraph id="H3668719C84FD4C0E80971BFEA86EA793"><enum>(I)</enum><text display-inline="yes-display-inline">a list of Hizballah’s expenditures, including expenditures for ongoing military operations, social networks, and external operations;</text></subparagraph> <subparagraph id="H2A6306E97C7948458FDA9BC5495621E5" commented="no"><enum>(J)</enum><text display-inline="yes-display-inline">a description of steps to be taken by Federal agencies to combat the illicit tobacco trafficking networks used by Hizballah;</text></subparagraph>
<subparagraph id="H0A3BD9CA54334E57B36B8ADDCEA56ED8"><enum>(K)</enum><text display-inline="yes-display-inline">an assessment of Hizballah’s financial operations in areas under its operational or political control in Lebanon and Syria and available measures to target Hizballah’s financial operations in those areas;</text></subparagraph> <subparagraph id="H7C80724439404D8799A87E1F0CE8EEFE"><enum>(L)</enum><text display-inline="yes-display-inline">a review of Hizballah’s international operational capabilities, including in the United States;</text></subparagraph>
<subparagraph id="HA1FB9A11B5B8449DA7E01CE0391EA2BF"><enum>(M)</enum><text>a review of—</text> <clause id="H2C947F7464094F0B9693C9C828B225A9"><enum>(i)</enum><text display-inline="yes-display-inline">the total number and value of Hizballah-related assets seized and forfeited; and</text></clause>
<clause id="H5E50AD65D66449B5BCD6E91A5A1F4EE0"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of indictments, prosecutions, and extraditions of Hizballah members or affiliates; and</text></clause></subparagraph> <subparagraph id="HE96DD88447864BB1A988B277B196571A"><enum>(N)</enum><text display-inline="yes-display-inline">a review of efforts by the United States to prevent hostile activities by Iran and disrupt and degrade Hizballah’s illicit networks in the Western Hemisphere, including interagency coordination to ensure that information-sharing, interdictions, arrests, investigations, indictments, sanctions, and designations related to Hizballah individuals or networks in the Western Hemisphere are integrated, coordinated, and publicly communicated by the United States in a manner that supports United States interests.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>

<paragraph id="HDC4EC9E763D1498EAE5A2958487A7172" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President is authorized to require each financial institution in the United States that knowingly maintains a correspondent account or a payable-through account in the United States for a foreign financial institution described in paragraph (2) to establish enhanced due diligence policies, procedures, and controls in accordance with section 5318(i)(2)(B) of title 31, United States Code, and regulations to implement such section with respect to such accounts.</text></paragraph> <paragraph id="HC4E218ACDB4944009A27130CD36E028A"><enum>(2)</enum><header>Foreign financial institution described</header><text>A foreign financial institution described in this paragraph is a foreign financial institution that the President determines provides significant financial services to persons operating in a jurisdiction identified in unclassified form in the list required under subsection (a)(1)(F).</text></paragraph>

<paragraph id="H7DDF07EC9E0B44879619756E10655930"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report that contains—</text> <subparagraph id="HBC453C15721D4B5EB4545F66FCE4CFC1"><enum>(A)</enum><text>the estimated total net worth of each individual described in paragraph (2); and</text></subparagraph>
<subparagraph id="H66B91B8BF71E4E0099EC50FAB9C01DC4"><enum>(B)</enum><text>to the extent feasible, a description of how funds of each individual described in paragraph (2) were acquired, and how such funds have been used or employed.</text></subparagraph></paragraph> <paragraph id="HC7665AD4760D4BFB8AC9D4C914AF0B30"><enum>(2)</enum><header>Individuals described</header><text>The individuals described in this paragraph are the following:</text>
<subparagraph id="H9F8E8779428D48CAA17A88EA12797704"><enum>(A)</enum><text>The Secretary General of Hizballah.</text></subparagraph> <subparagraph id="H143D916BCF02402CB436AF67F6C140C7"><enum>(B)</enum><text display-inline="yes-display-inline">Members of Hizballah’s senior leadership or senior associates of Hizballah that the President determines materially assist or support Hizballah.</text></subparagraph>
<subparagraph id="HD54EC3F3F1C2430A98E4920BF53A22F1"><enum>(C)</enum><text display-inline="yes-display-inline">Any other individual that the President determines is a senior foreign political figure of Hizballah.</text></subparagraph></paragraph> <paragraph id="H9D65A7364F3B4CEA964809A4B8F29301"><enum>(3)</enum><header>Form of report; public availability</header> <subparagraph id="H202D245BD8B442A9A99EF66E8BFC7F72"><enum>(A)</enum><header>Form</header><text>The report required under paragraph (1) shall be submitted in unclassified form but may contain a classified annex.</text></subparagraph>
<subparagraph id="H7DD64D19A1184199AC6715E32D814D50"><enum>(B)</enum><header>Public availability</header><text>The unclassified portion of the report required under paragraph (1) shall be made available to the public in precompressed, easily downloadable versions that are made available in all appropriate formats.</text></subparagraph></paragraph> <paragraph id="H2727C2DC34464AE0B17BFE37561FA9EE"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="H71EE84897EE14AE9ACE47EBB06041141"><enum>(A)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text> <clause id="H2532FECE9018470088FCE2FA724670D7"><enum>(i)</enum><text>the Committee on Foreign Affairs, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives; and</text></clause>
<clause id="H2E9E81DA890F439C91365EDCD82F696B"><enum>(ii)</enum><text>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Select Committee on Intelligence of the Senate.</text></clause></subparagraph> <subparagraph id="H62FCC6E314A34D1C8C2DA0E29BF83786"><enum>(B)</enum><header>Funds</header><text>The term <quote>funds</quote> means—</text>
<clause id="H77BD4FE9A6F04B0397030F52356B678C"><enum>(i)</enum><text>cash;</text></clause> <clause id="H56AC89FE382548CAAC7DD58766FC1095"><enum>(ii)</enum><text>equity;</text></clause>
<clause id="HF7D781377DFA4C16AB1B575EE684881F"><enum>(iii)</enum><text>any other intangible asset the value of which is derived from a contractual claim, including bank deposits, bonds, stocks, a security (as defined in section 2(a) of the Securities Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/15/77b">15 U.S.C. 77b(a)</external-xref>)), or a security or an equity security (as those terms are defined in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>)); and</text></clause> <clause id="H2AADCF29D52A47958BD9516D4D153ABE"><enum>(iv)</enum><text>anything else of value that the Secretary of the Treasury determines to be appropriate.</text></clause></subparagraph>
<subparagraph id="HEC5563FADC5547C4ABFEB1D104167643"><enum>(C)</enum><header>Senior foreign political figure</header><text>The term <quote>senior foreign political figure</quote> has the meaning given that term in section 1010.605 of title 31, Code of Federal Regulations (or any successor regulation).</text></subparagraph></paragraph></subsection> <subsection id="H9F49248B65E842E0B9002A79CC28B4C8" commented="no"><enum>(c)</enum><header>Report on individuals who are members of the Lebanese Parliament and who identify as members of Hizballah</header><text display-inline="yes-display-inline"></text>
<paragraph id="H33895D0753D2452C97CBC70AAE55B48D" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall transmit to the appropriate congressional committees a report that contains the following:</text> <subparagraph id="H735B40D44D424DC1B1302E4E5FDBBBB1" commented="no"><enum>(A)</enum><text>A list of individuals who are members of the Lebanese Parliament and who identify as members of Hizballah.</text></subparagraph>
<subparagraph id="H3E6485CEBB344A8FBFD18E8EB73311CA" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">A description of any significant conduct of individuals on the list required under subparagraph (A) that the President determines may be grounds for designation pursuant to Executive Order 13224 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism).</text></subparagraph></paragraph> <paragraph id="H39EE9C85D9994171B64A1807999D3243" commented="no"><enum>(2)</enum><header>Form</header><text>The report required under paragraph (1) shall be transmitted in unclassified form, but may include a classified annex.</text></paragraph>
<paragraph id="HA9B50BD231784B48B1B3CB1C0E99E7BB"><enum>(3)</enum><header>Appropriate congressional committees defined</header><text>In this subsection, the term <quote>appropriate congressional committees</quote> means—</text> <subparagraph id="H5C2DD77805C7491DBD34BCC7E21DE7E1"><enum>(A)</enum><text>the Committee on Foreign Affairs, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives; and</text></subparagraph>
<subparagraph id="H779C324447F7431BB5BF257C3AD33AE1"><enum>(B)</enum><text>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Select Committee on Intelligence of the Senate.</text></subparagraph></paragraph></subsection></section></title> <title id="HBF36ED3504DF45289C76FD33C660750D"><enum>III</enum><header>General provisions</header> <section id="H6B4FFBA6E0E3498FA68D8F061EE6840F"><enum>301.</enum><header>Regulatory authority</header> <subsection id="H8F56F6FAFF5348BB992789496E2A6EEF"><enum>(a)</enum><header>In general</header><text>The President shall, not later than 180 days after the date of the enactment of this Act, prescribe regulations as necessary for the implementation of this Act and the amendments made by this Act.</text></subsection>
<subsection id="HF0DEDA49B7A44DEFAB34ACA283932604"><enum>(b)</enum><header>Notification to Congress</header><text>Not later than 10 days before the prescription of regulations under subsection (a), the President shall notify the appropriate congressional committees regarding the proposed regulations and the provisions of this Act and the amendments made by this Act that the regulations are implementing.</text></subsection> <subsection id="H19956C6369044ADE9776DBF1B2A1884E"><enum>(c)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <quote>appropriate congressional committees</quote> means—</text>
<paragraph id="H03B7A1F21D624B8DA013E2572D7F5F92"><enum>(1)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives; and</text></paragraph> <paragraph id="HE0253759340D444EA5D1290CE8285C38"><enum>(2)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate.</text></paragraph></subsection></section>
<section id="H98D67536E2A640CDB12EFCB6D91F85B7"><enum>302.</enum><header>Implementation; penalties; judicial review; exemptions; rule of construction; exception relating to importation of goods</header>
<subsection id="HA8CB2409FBB2490A864527BBFE948074"><enum>(a)</enum><header>In general</header><text>Title I of the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note), as amended by sections 103 and 104 of this Act, is further amended by adding at the end the following:</text> <quoted-block id="H7B12195F8EEB400E96875E8DAA701A0C" style="OLC"> <section id="H807224F056BA48B48CD38A83351ECEE9"><enum>105.</enum><header>Implementation; penalties; judicial review; exemptions; rule of construction</header> <subsection id="H821DDCD32BB04ED0A2C796FEFD8A00B3"><enum>(a)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to carry out sections 101, 102, 103, and 201 of this Act.</text></subsection>
<subsection id="H23174AF3E5C0473F93418F84B27B9539"><enum>(b)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed to carry out section 101, 102, 103, or 201 of this Act to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of such section 206.</text></subsection> <subsection id="H61F1B28E488B4303822B68297633ED87"><enum>(c)</enum><header>Procedures for judicial review of classified information</header> <paragraph id="HDC95FE9F52344C24A25F11C427B9E42C"><enum>(1)</enum><header>In general</header><text>If a finding under section 101, 102, 103, or 201 of this Act, or a prohibition, condition, or penalty imposed as a result of any such finding, is based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (18 U.S.C. App.)) and a court reviews the finding or the imposition of the prohibition, condition, or penalty, the President may submit such information to the court ex parte and in camera.</text></paragraph>
<paragraph id="H9B345B22C013419E8C8C65DAC29EE673"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to confer or imply any right to judicial review of any finding under section 101, 102, 103, or 201 of this Act, or any prohibition, condition, or penalty imposed as a result of any such finding.</text></paragraph></subsection> <subsection id="H6A149BABE8ED4AACAFFEFE981A583C5D"><enum>(d)</enum><header>Exemptions</header><text>The following activities shall be exempt from sections 101, 102, 103, and 201 of this Act:</text>
<paragraph id="HB9EACF3B8CB14464BE3583148CAA352D"><enum>(1)</enum><text>Any authorized intelligence, law enforcement, or national security activities of the United States.</text></paragraph> <paragraph id="HBE9A05092C5F40AF80874635B4938D84"><enum>(2)</enum><text>Any transaction necessary to comply with United States obligations under the Agreement between the United Nations and the United States of America regarding the Headquarters of the United States, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, or the Convention on Consular Relations, done at Vienna April 24, 1963, and entered into force March 19, 1967, or any other United States international agreement.</text></paragraph></subsection>
<subsection id="HCFA0A7DDA1404344A1E3DF9B48A3CE44"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in section 101, 102, 103, or 201 of this Act shall be construed to limit the authority of the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) or under any other provision of law.</text></subsection> <subsection id="H7D40BE687ED84FE6B849529CCC8EA788"><enum>(f)</enum><header>Exception relating to importation of goods</header> <paragraph id="H76F68AB462574A118ADC84A55EA6D027"><enum>(1)</enum><header>In general</header><text>The authorities and requirements to impose sanctions under this Act shall not include the authority or requirement to impose sanctions on the importation of goods.</text></paragraph>
<paragraph id="H13569BAA5087403489041BAEBEAF0F24"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>good</quote> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2ADE511CF883460098AC17A9C4997E70"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Hizballah International Financing Prevention Act of 2015, as amended by this Act, is further amended by inserting after the item relating to section 104, as added by section 104(b) of this Act, the following new item:</text>

<paragraph id="H6ED195AEF6E0469D9E67481110160281" commented="no"><enum>(2)</enum><text>by striking subsection (e); and</text></paragraph> <paragraph id="H236EB57B29BC4A17BD6909FB3EF4D936" commented="no"><enum>(3)</enum><text>by redesignating subsection (f) as subsection (e).</text></paragraph></subsection></section>
<section id="H592335AB3FAD4682A2C0B140DF4E62A8"><enum>303.</enum><header>Report consolidation and modification</header>
<subsection id="H5F5494246BF5430FBF8E05D586F63427"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any and all reports required to be submitted to Congress under this Act or the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) that are subject to a deadline for submission consisting of the same unit of time may be consolidated into a single report that is submitted to Congress pursuant to such deadline.</text></subsection> <subsection id="HA2ED47925CFA4CE8A667B604D09E4897"><enum>(b)</enum><header>Matters to be included</header><text display-inline="yes-display-inline">Any report that is consolidated into a single report as described in subsection (a) shall contain all information required under this Act or the Hizballah International Financing Prevention Act of 2015 in addition to all other elements required by previous law.</text></subsection>
<subsection id="H999F5C673775402EBFC012026A37ADB2"><enum>(c)</enum><header>Reports modification</header><text display-inline="yes-display-inline">The North Korea Sanctions and Policy Enhancement Act of 2016 is amended as follows:</text> <paragraph id="HA43F8BA7AD8B43B1B5DC47FAA3F6C798"><enum>(1)</enum><text>In section 209(a)(3)(A) (<external-xref legal-doc="usc" parsable-cite="usc/22/9229">22 U.S.C. 9229(a)(3)(A)</external-xref>), by striking <quote>not later than 90 days after the date of the enactment of this Act, and every 180 days thereafter</quote> and inserting <quote>not later than 90 days after the date of the enactment of the <short-title>Hizballah International Financing Prevention Amendments Act of 2018</short-title>, and every 180 days thereafter for 5 years</quote>.</text></paragraph>
