 <paragraph id="idf79d48a2ffbd428ab501e9dcc2b43d71"><enum>(1)</enum><text>Since 2006, the United Nations Security Council has approved 5 resolutions imposing sanctions against North Korea under chapter VII of the United Nations Charter, which—</text>
 <subparagraph id="id7a55e25ed9bd4b84af9799781b23cde9"><enum>(A)</enum><text>prohibit the use, development, and proliferation of weapons of mass destruction by the Government of North Korea;</text>
 </subparagraph><subparagraph id="iddfad444f8d2e447ca9ce5d9fa53b4ea8"><enum>(B)</enum><text>prohibit the transfer of arms and related materiel to or by the Government of North Korea;</text> </subparagraph><subparagraph id="id787295e4cd044e5da9250475eb15d894"><enum>(C)</enum><text>prohibit the transfer of luxury goods to North Korea;</text>
 </subparagraph><subparagraph id="id94d7f85c23ae4c33af5f62e779961248"><enum>(D)</enum><text>restrict access by the Government of North Korea to the financial system and require due diligence on the part of financial institutions to prevent the financing of proliferation involving the Government of North Korea;</text>
 </subparagraph><subparagraph id="id59ad93c0de1c49509abf67091b4fec36"><enum>(E)</enum><text>restrict North Korean shipping, including the reflagging of ships owned or controlled by the Government of North Korea;</text>
 </subparagraph><subparagraph id="id5a571406702e4980b758847df768309f"><enum>(F)</enum><text>limit the sale by the Government of North Korea of precious metals, iron, coal, vanadium, and rare earth minerals; and</text>
 </subparagraph><subparagraph id="id551f1805bbb6495f8f6bde1561027735"><enum>(G)</enum><text>prohibit the transfer to North Korea of rocket, aviation, or jet fuel.</text> </subparagraph></paragraph><paragraph id="id637d8e2cb7e145cca44f726c0542eec5"><enum>(2)</enum><text>The Government of North Korea has threatened to carry out nuclear attacks against the United States and South Korea and has sent clandestine agents to kidnap or murder the citizens of foreign countries and murder dissidents in exile.</text>
 </paragraph><paragraph id="id7866c56b035447ac89f0e65f38b0076d"><enum>(3)</enum><text>The Federal Bureau of Investigation has determined that the Government of North Korea was responsible for cyberattacks against the United States and South Korea.</text>
 </paragraph><paragraph id="id2fb8352fe6034ea49b1976e364ac3142"><enum>(4)</enum><text>In February 2016, the Director of National Intelligence reported that the Government of North Korea is <quote>committed to developing a long-range, nuclear-armed missile that is capable of posing a direct threat to the United States</quote> and some arms control experts have estimated that the Government of North Korea may acquire this capability by 2020.</text>
 </paragraph><paragraph id="idf7f660747a78445a8abf4b0563744603"><enum>(5)</enum><text>The Government of North Korea tested its 5th and largest nuclear device on September 9, 2016.</text> </paragraph><paragraph id="id38ab80c53f874ad6bd02bf26f48b1c37"><enum>(6)</enum><text>The Government of North Korea has increased the pace of its missile testing, including the test of a submarine-launched ballistic missile, potentially furthering the development of capability to attack the United States with a nuclear weapon.</text>
 </paragraph><paragraph id="id35be3832abcc430baf408c0ed3ed9c5a"><enum>(7)</enum><text>Financial transactions and investments that provide financial resources to the Government of North Korea, and that fail to incorporate adequate safeguards against the misuse of those financial resources, pose an undue risk of contributing to—</text>
 <subparagraph id="idF0644A8F466042728848C2C8219F3A9E"><enum>(A)</enum><text>weapons of mass destruction programs of that government; and</text> </subparagraph><subparagraph id="idDF2598376DF149FCAE1C3DFF69183E28"><enum>(B)</enum><text>prohibited imports or exports of arms and related materiel, services, or technology by that government.</text>
 </subparagraph></paragraph><paragraph id="id170156340c6741c6ab7130a2aca16729"><enum>(8)</enum><text>The strict enforcement of sanctions is essential to the efforts by the international community to achieve the peaceful, complete, verifiable, and irreversible dismantlement of weapons of mass destruction programs of the Government of North Korea.</text>
 </paragraph></section><section id="id50519d34f77a496b9d655d6404067b97"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="idf2bb24c7671942b1a11c645e4bdb751b"><enum>(1)</enum><header>Applicable Executive order; applicable United Nations Security Council resolution; Government of North Korea; North Korea</header><text>The terms <term>applicable Executive order</term>, <term>applicable United Nations Security Council resolution</term>, <term>Government of North Korea</term>, and <term>North Korea</term> have the meanings given those terms in section 3 of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9202">22 U.S.C. 9202</external-xref>).</text>
 </paragraph><paragraph id="idef87f63c7929403d95247f7942d60713"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="id8a2ffea7ce2e4297ade91f5acf2841b4"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs and the Committee on Foreign Relations of the Senate; and</text>
 </subparagraph><subparagraph id="id9f28b7bda22f44178c2ee3d3fde1ddb4"><enum>(B)</enum><text>the Committee on Financial Services and the Committee on Foreign Affairs of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1430E8D548B2470D8284478CD4C48EEB"><enum>(3)</enum><header display-inline="yes-display-inline">Knowingly</header><text display-inline="yes-display-inline">The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.</text>
			</paragraph><paragraph id="idd793b1c4c377459f989f1029f9e1b857"><enum>(4)</enum><header>North Korean covered property</header>
 <subparagraph id="id54136E8E01DD4C82A71B782008A8AE20"><enum>(A)</enum><header>In general</header><text>The term <term>North Korean covered property</term> includes any goods, services, or technology—</text>
 <clause id="id7bf3655e0429452caf1a452fb0db85a0"><enum>(i)</enum><text>that are in North Korea;</text> </clause><clause id="ide4c85d38ce25417cad7c606a96b64938"><enum>(ii)</enum><text>that are made with significant amounts of North Korean labor, materials, goods, or technology;</text>
 </clause><clause id="id280df3f8e0bc428d998bfeaf11f49a25"><enum>(iii)</enum><text>in which the Government of North Korea or a North Korean financial institution has a significant interest or exercises significant control; or</text>
 </clause><clause id="id34c09ecb8b6047de8750b18d270051b4"><enum>(iv)</enum><text>in which a designated person has a significant interest or exercises significant control.</text> </clause></subparagraph><subparagraph id="id3D39C2C2AB4F4223A7D2B235DA90D362"><enum>(B)</enum><header>Designated person</header><text>In this paragraph, the term designated person means a person who is designated under—</text>
 <clause id="id5b449b35ad494e77ad6aabb63598ca56"><enum>(i)</enum><text>an applicable Executive order;</text> </clause><clause id="id3bf37dd50b6e46e18afef9a2eb60493a"><enum>(ii)</enum><text>an applicable United Nations Security Council resolution; or</text>
 </clause><clause id="idd6555cfa37304b56823b62ab14bea097"><enum>(iii)</enum><text>section 104 of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9204">22 U.S.C. 9204</external-xref>).</text> </clause></subparagraph></paragraph><paragraph id="id6c6730b0c84342859ec2d7020b7449b2"><enum>(5)</enum><header>North Korean financial institution</header><text>The term <term>North Korean financial institution</term> includes—</text>
 <subparagraph id="id42b08035bd6d4b9295c06845d6017319"><enum>(A)</enum><text>any North Korean financial institution, as defined in section 3 of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9202">22 U.S.C. 9202</external-xref>);</text>
 </subparagraph><subparagraph id="idc5c183767da944bdb6bddceb9640fba1"><enum>(B)</enum><text>any financial agency, as defined in section 5312 of title 31, United States Code, that is owned or controlled by the Government of North Korea;</text>
 </subparagraph><subparagraph id="id46dd1aaec9184cc2b7196e13e793d0af"><enum>(C)</enum><text>any money transmitting business, as defined in section 5330(d) of title 31, United States Code, that is owned or controlled by the Government of North Korea; and</text>
 </subparagraph><subparagraph id="id051d96803b8b483c8804cb7cd8e475bc"><enum>(D)</enum><text>any financial institution that is a joint venture between any person and the Government of North Korea.</text>
 </subparagraph></paragraph><paragraph id="id06ff941c6c5747b49c1e16406a67ec6e"><enum>(6)</enum><header>Secretary</header><text>Unless otherwise specified, the term <term>Secretary</term> means the Secretary of the Treasury.</text> </paragraph><paragraph id="id9ddd6cd6eb3f4ac8a2b65109f2639aba"><enum>(7)</enum><header>United States financial institution</header><text>The term <term>United States financial institution</term> means a financial institution that—</text>
 <subparagraph id="id1B1D94CEDFC145278778C1AF9A7CA803"><enum>(A)</enum><text>is a United States person, regardless of where the person operates; or</text> </subparagraph><subparagraph id="id9BDFF01A7B0845B1BBE645525117BC7B"><enum>(B)</enum><text>operates or does business in the United States, including by conducting wire transfers through correspondent banks in the United States.</text>
 </subparagraph></paragraph><paragraph id="id85A365508C084BC3B049D864EA8F437F"><enum>(8)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text> <subparagraph id="IDF6815A6D794D4CF093A3D48E96058D2D"><enum>(A)</enum><text>a citizen or resident of the United States or a national of the United States (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)); and</text>
 </subparagraph><subparagraph id="ID277B11D5DD7548C7B1028D384A1D008A"><enum>(B)</enum><text>an entity that is organized under the laws of the United States or any jurisdiction within the United States, including a foreign subsidiary of such an entity.</text>
				</subparagraph></paragraph></section><title id="id1A0C72079C7943FEB59DFC0C1FD96B87" style="OLC"><enum>I</enum><header>Financial requirements and sanctions relating
			 to transactions involving North Korea</header>
			<section id="id2af42670b6cf4ecab782cda4ed044ff0"><enum>101.</enum><header>Sanctions with respect to financial institutions providing support to the Government of North Korea</header>
				<subsection id="id7d670b83ef2b4504b449b94b5437c7ec"><enum>(a)</enum><header>Report on noncompliant financial institutions</header>
 <paragraph id="id13B9132E3F714EF7B43B5163EB16CB5D"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, and every 180 days thereafter, the President shall submit to the appropriate congressional committees and publish in the Federal Register a report that contains a list of any financial institutions that the President has identified as having engaged in, during the one-year period preceding the submission of the report, the following conduct:</text>
 <subparagraph id="iddd333c495c214ce39ec3d72027430ee2"><enum>(A)</enum><text>Dealing in North Korean covered property.</text> </subparagraph><subparagraph id="id14b3c3508d4645c3ac556e73a4ab4c12"><enum>(B)</enum><text>Providing correspondent or interbank services to one or more North Korean financial institutions.</text>
 </subparagraph><subparagraph id="id39afea3a21c846ec8646c062d9fb01c9"><enum>(C)</enum><text>Failing to apply enhanced due diligence to prevent North Korean financial institutions from gaining access to correspondent or interbank services in the United States or provided by United States persons.</text>
 </subparagraph><subparagraph id="idaf309dffbcf74e5d9349d6a7773c29db"><enum>(D)</enum><text>Knowingly operating or participating with or on behalf of an offshore United States dollar clearing system that conducts transactions involving the Government of North Korea or North Korean covered property.</text>
 </subparagraph><subparagraph id="id4f4359f59d6e49219ea9df28e72c9de3"><enum>(E)</enum><text>Conducting or facilitating one or more significant transactions in North Korean covered property involving covered goods (as that term is defined in section 1027.100 of title 31, Code of Federal Regulations, or any successor regulation) or the currency of a country other than the country in which the person is operating at the time of the transaction.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2E79BA78614F4373BBC480552A3BDDCE"><enum>(2)</enum><header display-inline="yes-display-inline">Form of report</header><text display-inline="yes-display-inline">Each report required under paragraph (1) shall be submitted in unclassified form but may contain a classified annex.</text>
					</paragraph></subsection><subsection id="ide119163fe57044f895d2b015f0f4d054"><enum>(b)</enum><header>Imposition of sanctions</header>
 <paragraph id="idebfb7b2e4883415b9379bb4d7e385259"><enum>(1)</enum><header>In general</header><text>If the President determines that a financial institution identified under subsection (a) has knowingly engaged in conduct described in that subsection, the President shall apply the following sanctions with respect to that financial institution:</text>
 <subparagraph id="id9C372EDE3E9E4D53AD98E2496736C5A6"><enum>(A)</enum><text>Prohibit the designation of the financial institution, or the continuation of any prior designation of the financial institution, as a primary dealer in United States Government debt instruments.</text>
 </subparagraph><subparagraph id="idc4c6428e73504fa6936acf72ae41fb54"><enum>(B)</enum><text>Prohibit the financial institution from serving as agent of the United States Government or as a repository for funds of the United States Government.</text>
 </subparagraph><subparagraph id="id81BDCA676E9544BBBFAC59E15E530175"><enum>(C)</enum><text>One or more of the following:</text> <clause id="id7caf1478853f42dc8221884483c629a9"><enum>(i)</enum><text>Prohibit the opening, and prohibit or impose strict conditions on the maintaining, in the United States of any correspondent account or payable-through account by the financial institution if the financial institution is a foreign financial institution.</text>
 </clause><clause id="idef8aefcea0a742cba654f99063838997"><enum>(ii)</enum><text>Prohibit any transactions in foreign exchange that are subject to the jurisdiction of the United States and in which the financial institution has any interest.</text>
 </clause><clause id="id0929e58086554ab19bb7ce5f5d0da318"><enum>(iii)</enum><text>In accordance with the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.), block and prohibit all transactions in all property and interests in property of the financial institution if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
 </clause></subparagraph></paragraph><paragraph id="id0BCD4A5D27C34D3D888DD391DA6C3075"><enum>(2)</enum><header>Civil penalties</header><text>If the President determines that a financial institution identified under subsection (a) that is a United States financial institution has knowingly engaged in conduct described in that subsection—</text>
 <subparagraph id="ida367185315814a229faa60bf824f333c"><enum>(A)</enum><text>if the financial institution has taken reasonable steps to prevent a recurrence of conduct described in that subsection and is cooperating fully with the efforts of the President to enforce the provisions of this Act—</text>
 <clause id="idad5162d9c49545fd9607212a8d62ea23"><enum>(i)</enum><text>unless the financial institution is described in clause (ii), the President shall impose a civil penalty not to exceed $100,000 for each reportable act described in subparagraphs (A) through (E) of subsection (a)(1) that is knowingly conducted; or</text>
 </clause><clause id="id56b674d9e9cb44c2aec4314c935752f6"><enum>(ii)</enum><text>if the financial institution has not previously been reported for similar conduct under subsection (a), the President shall issue a cautionary letter to that financial institution; or</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3394ddecec7c4d4ba897fd57e9683b66"><enum>(B)</enum><text>if the financial institution is not a financial institution described in subparagraph (A), the President shall impose a civil penalty not to exceed $250,000 for each reportable act described in subparagraphs (A) through (E) of subsection (a)(1) that is knowingly conducted.</text>
 </subparagraph></paragraph></subsection><subsection id="id186f3be901b0412681eb7334816b538c"><enum>(c)</enum><header>Suspension for law enforcement purposes</header><text>The President may suspend the submission of the reports described in subsection (a) and the application of sanctions and penalties described in subsection (b) for a one-year period if—</text>
 <paragraph id="id0101656035974b709990bba91c3c2fa6"><enum>(1)</enum><text>such reporting and application of sanctions and penalties could compromise an ongoing law enforcement investigation or prosecution; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida29dd8d4bba2409c9d74bad5100b28dd"><enum>(2)</enum><text>a criminal prosecution is pending, or a criminal or civil fine or penalty has been imposed or conditionally deferred, for the conduct reported pursuant to subsection (a).</text>
					</paragraph></subsection><subsection id="id4c5f67eacce04584bf7547e63e87fc7c"><enum>(d)</enum><header>Suspension and termination of sanctions and penalties</header>
 <paragraph id="idD00A28D80DDB462F80612755E98D51D6"><enum>(1)</enum><header>Suspension</header><text>The President may suspend the application of any sanctions or penalties under subsection (b) for a period of not more than one year if the President certifies to the appropriate congressional committees that the Government of North Korea is taking steps toward—</text>
 <subparagraph id="idf38bcfbb234345bb943bc1e4b81e16ac"><enum>(A)</enum><text>the verification of its compliance with applicable United Nations Security Council Resolutions; and</text> </subparagraph><subparagraph id="id42696bb6bca543c5b1a61bbaed7b7573"><enum>(B)</enum><text>fully accounting for and repatriating United States citizens and permanent residents (including deceased United States citizens and permanent residents)—</text>
 <clause id="idf2ecd02bb9514e89acda7ad6fa7ab9c9"><enum>(i)</enum><text>abducted or unlawfully held captive by the Government of North Korea; or</text> </clause><clause id="id85e5c23144664039ad9129a613d210f9"><enum>(ii)</enum><text>detained in violation of the Agreement Concerning a Military Armistice in Korea, signed at Panmunjom July 27, 1953 (commonly referred to as the <quote>Korean War Armistice Agreement</quote>).</text>
 </clause></subparagraph></paragraph><paragraph id="idF8E8E9A9028D4E82BCEDF1E9E24B3FCC"><enum>(2)</enum><header>Renewal of suspension</header><text>The President may renew a suspension described in paragraph (1) for additional periods of not more than 180 days if the President certifies to the appropriate congressional committees that the Government of North Korea continues to take steps as described in paragraph (1).</text>
 </paragraph><paragraph id="idfb6261bc43f5478082676dac66600cb9"><enum>(3)</enum><header>Termination of sanctions</header><text>Subject to subsection (f), the President may terminate the application of any sanctions or penalties under subsection (b) if the President certifies that the Government of North Korea has made significant progress towards—</text>
 <subparagraph id="id103a5bf33697488da035613d3c4374fa"><enum>(A)</enum><text>completely, verifiably, and irreversibly dismantling all of its nuclear, chemical, biological, and radiological weapons programs, including all programs for the development of systems designed in whole or in part for the delivery of such weapons; and</text>
 </subparagraph><subparagraph id="id77e5f31ab6d64fa284c309d20b6f2b13"><enum>(B)</enum><text>fully accounting for and repatriating United States citizens and permanent residents (including deceased United States citizens and permanent residents)—</text>
 <clause id="ide80a9f244a294236ac66afeebf5c8d99"><enum>(i)</enum><text>abducted or unlawfully held captive by the Government of North Korea; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="id0582622B8A7D48D09CF682B9F68568B6"><enum>(ii)</enum><text display-inline="yes-display-inline">detained in violation of the Agreement Concerning a Military Armistice in Korea, signed at Panmunjom July 27, 1953 (commonly referred to as the <quote>Korean War Armistice Agreement</quote>).</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id99e183868fa04d4ebeb85f26146f7352"><enum>(e)</enum><header>Waiver</header><text>Subject to subsection (f), the President may waive the application of sanctions or penalties under subsection (b) with respect to a financial institution if the President determines that the waiver is in the national security interest of the United States.</text>
				</subsection><subsection id="id1B4E560CFDEA407B9AA6760F1338E3AC"><enum>(f)</enum><header>Congressional review of proposed actions To waive or terminate sanctions</header>
					<paragraph id="id37b7ae4e7e6844b7af57887c97f0bdd8"><enum>(1)</enum><header>Submission to Congress of proposed action</header>
 <subparagraph id="id3e96bdcebbcb4229aa1910529f42fb0a"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, before taking any action described in subparagraph (B), the President shall submit to the appropriate congressional committees and leadership a report that describes the proposed action and the reasons for that action.</text>
 </subparagraph><subparagraph id="id4ba45a6fe1fa44f9b6828893be728a77"><enum>(B)</enum><header>Actions described</header><text>An action described in this subparagraph is—</text> <clause id="id9bbf4aca7ef64827a584931f35d7e8d8"><enum>(i)</enum><text>an action to suspend, renew a suspension, or terminate under subsection (d) the application of sanctions or penalties under subsection (b); or</text>
 </clause><clause id="id6b2e3b49efa24369b00e54b109aac3dd"><enum>(ii)</enum><text>with respect to sanctions or penalties under subsection (b) imposed by the President with respect to a person, an action to waive under subsection (e) the application of those sanctions or penalties with respect to that person.</text>
 </clause></subparagraph><subparagraph id="idf9d0f567617b4a88bb1a3d9447ee1df6"><enum>(C)</enum><header>Description of type of action</header><text>Each report submitted under subparagraph (A) with respect to an action described in subparagraph (B) shall include a description of whether the action—</text>
 <clause id="ida75fd0e9922f469b8433d53e5a1ab569"><enum>(i)</enum><text>is not intended to significantly alter United States foreign policy with regard to North Korea; or</text> </clause><clause id="id90282a82171147ea820bb2b09bef2776"><enum>(ii)</enum><text>is intended to significantly alter United States foreign policy with regard to North Korea.</text>
							</clause></subparagraph><subparagraph id="id2c04b6750c3c41c7a2051661b43de33e"><enum>(D)</enum><header>Inclusion of additional matter</header>
 <clause id="ide6732a2e49784698816cf20533db8440"><enum>(i)</enum><header>In general</header><text>Each report submitted under subparagraph (A) that relates to an action that is intended to significantly alter United States foreign policy with regard to North Korea shall include a description of—</text>
 <subclause id="id4883c5de10ab41b8b4b90b5e3d803739"><enum>(I)</enum><text>the significant alteration to United States foreign policy with regard to North Korea;</text> </subclause><subclause id="ida7e175ecb9924bd9abe364f0de68821b"><enum>(II)</enum><text>the anticipated effect of the action on the national security interests of the United States; and</text>
 </subclause><subclause id="idc4c945368fb4490fb771d3e727f41deb"><enum>(III)</enum><text>the policy objectives for which the sanctions affected by the action were initially imposed.</text> </subclause></clause><clause id="id6a86ea67f281488ba630d1ac3e7eb1ae"><enum>(ii)</enum><header>Requests from Banking and Financial Services committees</header><text>The Committee on Banking, Housing, and Urban Affairs of the Senate or the Committee on Financial Services of the House of Representatives may request the submission to the Committee of the matter described in subclauses (II) and (III) of clause (i) with respect to a report submitted under subparagraph (A) that relates to an action that is not intended to significantly alter United States foreign policy with regard to North Korea.</text>
							</clause></subparagraph></paragraph><paragraph id="id6f1445fbe9d841288f0c153d87c2e2b2"><enum>(2)</enum><header>Period for review by Congress</header>
 <subparagraph id="id13be81cf1bb4440886c989b3f94868a4"><enum>(A)</enum><header>In general</header><text>During the period of 30 calendar days beginning on the date on which the President submits a report under paragraph (1)(A)—</text>
 <clause id="id04c780b6f0ca497f9c1bf5badd38c851"><enum>(i)</enum><text>in the case of a report that relates to an action that is not intended to significantly alter United States foreign policy with regard to North Korea, the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives should, as appropriate, hold hearings and briefings and otherwise obtain information in order to fully review the report; and</text>
 </clause><clause id="id740c809714d1442494d20188bcc46987"><enum>(ii)</enum><text>in the case of a report that relates to an action that is intended to significantly alter United States foreign policy with regard to North Korea, the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives should, as appropriate, hold hearings and briefings and otherwise obtain information in order to fully review the report.</text>
 </clause></subparagraph><subparagraph id="id8ef79e9d643f44879c9be1238bfb8351"><enum>(B)</enum><header>Exception</header><text>The period for congressional review under subparagraph (A) of a report required to be submitted under paragraph (1)(A) shall be 60 calendar days if the report is submitted on or after July 10 and on or before September 7 in any calendar year.</text>
 </subparagraph><subparagraph id="idb7af41836f96484f9bff56686dca899d"><enum>(C)</enum><header>Limitation on actions during initial congressional review period</header><text>Notwithstanding any other provision of law, during the period for congressional review provided for under subparagraph (A) of a report submitted under paragraph (1)(A) proposing an action described in paragraph (1)(B), including any additional period for such review as applicable under the exception provided in subparagraph (B), the President may not take that action unless a joint resolution of approval with respect to that action is enacted in accordance with paragraph (3).</text>
 </subparagraph><subparagraph id="idca049be080c24d9085f05707a1667964"><enum>(D)</enum><header>Limitation on actions during presidential consideration of a joint resolution of disapproval</header><text>Notwithstanding any other provision of law, if a joint resolution of disapproval relating to a report submitted under paragraph (1)(A) proposing an action described in paragraph (1)(B) passes both Houses of Congress in accordance with paragraph (3), the President may not take that action for a period of 12 calendar days after the date of passage of the joint resolution of disapproval.</text>
 </subparagraph><subparagraph id="ida660b4fc85a64dd48b2f6d7fe1b60707"><enum>(E)</enum><header>Limitation on actions during congressional reconsideration of a joint resolution of disapproval</header><text>Notwithstanding any other provision of law, if a joint resolution of disapproval relating to a report submitted under paragraph (1)(A) proposing an action described in paragraph (1)(B) passes both Houses of Congress in accordance with paragraph (3), and the President vetoes the joint resolution, the President may not take that action for a period of 10 calendar days after the date of the President’s veto.</text>
 </subparagraph><subparagraph id="idcc42ddb3e2a04de2bb1beb9f6d8f70e0"><enum>(F)</enum><header>Effect of enactment of a joint resolution of disapproval</header><text>Notwithstanding any other provision of law, if a joint resolution of disapproval relating to a report submitted under paragraph (1)(A) proposing an action described in paragraph (1)(B) is enacted in accordance with paragraph (3), the President may not take that action.</text>
						</subparagraph></paragraph><paragraph id="id75afe0cb2f3c44fdb63fdbe4cacf7ac2"><enum>(3)</enum><header>Joint resolutions of disapproval or approval</header>
 <subparagraph id="id2234EADEFB684EE1A6EF53CEF56793EC"><enum>(A)</enum><header>Joint resolutions of disapproval or approval defined</header><text>In this paragraph:</text> <clause id="ideec12a27de874fc3993f0804e06f2966"><enum>(i)</enum><header>Joint resolution of approval</header><text>The term <term>joint resolution of approval</term> means only a joint resolution of either House of Congress—</text>
 <subclause id="iddf503316f5d34376b334e8714e114371"><enum>(I)</enum><text>the title of which is as follows: <quote>A joint resolution approving the President's proposal to take an action relating to the application of certain sanctions with respect to North Korea.</quote>; and</text>
 </subclause><subclause id="idba3ad081d63c409aac532ae7518dd32a"><enum>(II)</enum><text>the sole matter after the resolving clause of which is the following: <quote>Congress approves of the action relating to the application of sanctions imposed with respect to North Korea proposed by the President in the report submitted to Congress under section 101(f)(1)(A) of the <short-title>Banking Restrictions Involving North Korea (BRINK) Act of 2017</short-title> on _______ relating to ________.</quote>, with the first blank space being filled with the appropriate date and the second blank space being filled with a short description of the proposed action.</text>
 </subclause></clause><clause id="ida2a12251dfba4453b3110908eab86864"><enum>(ii)</enum><header>Joint resolution of disapproval</header><text>The term <term>joint resolution of disapproval</term> means only a joint resolution of either House of Congress—</text> <subclause id="id9b5bb1c377854d779acf028f90ee0319"><enum>(I)</enum><text>the title of which is as follows: <quote>A joint resolution disapproving the President's proposal to take an action relating to the application of certain sanctions with respect to North Korea.</quote>; and</text>
 </subclause><subclause id="id5048020bfaa34fdcbb30a2c6402061da"><enum>(II)</enum><text>the sole matter after the resolving clause of which is the following: <quote>Congress disapproves of the action relating to the application of sanctions imposed with respect to North Korea proposed by the President in the report submitted to Congress under section 101(f)(1)(A) of the <short-title>Banking Restrictions Involving North Korea (BRINK) Act of 2017</short-title> on _______ relating to ________.</quote>, with the first blank space being filled with the appropriate date and the second blank space being filled with a short description of the proposed action.</text>
 </subclause></clause></subparagraph><subparagraph id="ida7461089df044a8a912eed015a567cfd"><enum>(B)</enum><header>Introduction</header><text>During the period of 30 calendar days provided for under paragraph (2)(A), including any additional period as applicable under the exception provided in paragraph (2)(B), a joint resolution of approval or joint resolution of disapproval may be introduced—</text>
 <clause id="idfb07dfc055ea4718a499aab348fcbd55"><enum>(i)</enum><text>in the House of Representatives, by the majority leader or the minority leader; and</text> </clause><clause id="ida32e79f77b5a45358b69df28ba1d785e"><enum>(ii)</enum><text>in the Senate, by the majority leader (or the majority leader's designee) or the minority leader (or the minority leader's designee).</text>
							</clause></subparagraph><subparagraph id="id7cd1f971ba584e92a3f800cf6191d1f9"><enum>(C)</enum><header>Floor consideration in House of Representatives</header>
 <clause id="iddc1a8bd3a8034a878308f30d181817e3"><enum>(i)</enum><header>Reporting and discharge</header><text>If a committee of the House of Representatives to which a joint resolution of approval or joint resolution of disapproval has been referred has not reported the joint resolution within 10 calendar days after the date of referral, that committee shall be discharged from further consideration of the joint resolution.</text>
 </clause><clause id="id5231a111358a4fff9746a2e0ae59132d"><enum>(ii)</enum><header>Proceeding to consideration</header><text>Beginning on the third legislative day after each committee to which a joint resolution of approval or joint resolution of disapproval has been referred reports the joint resolution to the House or has been discharged from further consideration of the joint resolution, it shall be in order to move to proceed to consider the joint resolution in the House. All points of order against the motion are waived. Such a motion shall not be in order after the House has disposed of a motion to proceed on the joint resolution. The previous question shall be considered as ordered on the motion to its adoption without intervening motion. The motion shall not be debatable. A motion to reconsider the vote by which the motion is disposed of shall not be in order.</text>
 </clause><clause id="idd02a04af168d4c7192f1067769b39f45"><enum>(iii)</enum><header>Consideration</header><text>The joint resolution of approval or joint resolution of disapproval shall be considered as read. All points of order against the joint resolution and against its consideration are waived. The previous question shall be considered as ordered on the joint resolution to final passage without intervening motion except 2 hours of debate equally divided and controlled by the sponsor of the joint resolution (or a designee) and an opponent. A motion to reconsider the vote on passage of the joint resolution shall not be in order.</text>
							</clause></subparagraph><subparagraph id="id40daa6cde1ec46a495ea673186cebe71"><enum>(D)</enum><header>Consideration in the senate</header>
 <clause id="idca7ebfd6990e4571a05dff67fee64253"><enum>(i)</enum><header>Committee referral</header><text>A joint resolution of approval or joint resolution of disapproval introduced in the Senate shall be—</text>
 <subclause id="id662cb42cb22d42b6bfb345de802254ae"><enum>(I)</enum><text>referred to the Committee on Banking, Housing, and Urban Affairs if the joint resolution relates to a report submitted under paragraph (1)(A) with respect to an action that is not intended to significantly alter United States foreign policy with regard to North Korea; and</text>
 </subclause><subclause id="idf9984c934733418cbee316b41bef2058"><enum>(II)</enum><text>referred to the Committee on Foreign Relations if the joint resolution relates to a report submitted under paragraph (1)(A) with respect to an action that is intended to significantly alter United States foreign policy with respect to North Korea.</text>
 </subclause></clause><clause id="id89d53b27626249b88c5cb19557e5637a"><enum>(ii)</enum><header>Reporting and discharge</header><text>If the committee to which a joint resolution of approval or joint resolution of disapproval was referred has not reported the joint resolution within 10 calendar days after the date of referral of the joint resolution, that committee shall be discharged from further consideration of the joint resolution and the joint resolution shall be placed on the appropriate calendar.</text>
 </clause><clause id="idebfe6d89a68e4f48881e5f3a594a1b6a"><enum>(iii)</enum><header>Proceeding to consideration</header><text>Notwithstanding Rule XXII of the Standing Rules of the Senate, it is in order at any time after the Committee on Banking, Housing, and Urban Affairs or the Committee on Foreign Relations, as the case may be, reports a joint resolution of approval or joint resolution of disapproval to the Senate or has been discharged from consideration of such a joint resolution (even though a previous motion to the same effect has been disagreed to) to move to proceed to the consideration of the joint resolution, and all points of order against the joint resolution (and against consideration of the joint resolution) are waived. The motion to proceed is not debatable. The motion is not subject to a motion to postpone. A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order.</text>
 </clause><clause id="id0209ba49872a4f2f8b48b5d8c825297e"><enum>(iv)</enum><header>Rulings of the chair on procedure</header><text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate, as the case may be, to the procedure relating to a joint resolution of approval or joint resolution of disapproval shall be decided without debate.</text>
 </clause><clause id="idf8970df004524485bd217b890c4051c2"><enum>(v)</enum><header>Consideration of veto messages</header><text>Debate in the Senate of any veto message with respect to a joint resolution of approval or joint resolution of disapproval, including all debatable motions and appeals in connection with the joint resolution, shall be limited to 10 hours, to be equally divided between, and controlled by, the majority leader and the minority leader or their designees.</text>
							</clause></subparagraph><subparagraph id="id508cf7fbbbc240ff831a47b478986cd9"><enum>(E)</enum><header>Rules relating to senate and House of Representatives</header>
 <clause id="id2b391fb0445c43449b36ad89bd90dcb8"><enum>(i)</enum><header>Coordination with action by other House</header><text>If, before the passage by one House of a joint resolution of approval or joint resolution of disapproval of that House, that House receives an identical joint resolution from the other House, the following procedures shall apply:</text>
 <subclause id="iddcc3159c1cb94af18e771b0e04328972"><enum>(I)</enum><text>The joint resolution of the other House shall not be referred to a committee.</text> </subclause><subclause id="id0d8d22d311e549afbd669b34daab3284"><enum>(II)</enum><text>With respect to the joint resolution of the House receiving the joint resolution from the other House—</text>
 <item id="id23710bf38b3148b596e98cdb5436106b"><enum>(aa)</enum><text>the procedure in that House shall be the same as if no joint resolution had been received from the other House; but</text>
 </item><item id="ida4348f37168c414aba20b6ded7994ddb"><enum>(bb)</enum><text>the vote on passage shall be on the joint resolution of the other House.</text> </item></subclause></clause><clause id="iddfffa678a9e44c0da3e694c840d0cb73"><enum>(ii)</enum><header>Treatment of a joint resolution of other House</header><text>If one House fails to introduce a joint resolution of approval or joint resolution of disapproval, a joint resolution of approval or joint resolution of disapproval of the other House shall be entitled to expedited procedures in that House under this subsection.</text>
 </clause><clause id="ide04d11809d2c42909ff5483a28d4672e"><enum>(iii)</enum><header>Treatment of House joint resolution in Senate</header><text>If, following passage of a joint resolution of approval or joint resolution of disapproval in the Senate, the Senate receives an identical joint resolution from the House of Representatives, that joint resolution shall be placed on the appropriate Senate calendar.</text>
 </clause><clause id="ided3354a541c142968661ba74791e81cc"><enum>(iv)</enum><header>Application to revenue measures</header><text>The provisions of this subparagraph shall not apply in the House of Representatives to a joint resolution of approval or joint resolution of disapproval that is a revenue measure.</text>
 </clause></subparagraph><subparagraph id="ide8c04aac5b1b4b359a78124bc8cee339"><enum>(F)</enum><header>Rules of house of representatives and senate</header><text>This paragraph is enacted by Congress—</text> <clause id="idbdb723456f91448ba0f9461569218889"><enum>(i)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, but applicable only with respect to the procedure to be followed in that House in the case of a joint resolution of approval or joint resolution of disapproval, and supersedes other rules only to the extent that it is inconsistent with such rules; and</text>
 </clause><clause id="id3ce13780e1434efc8596ba9f99706995"><enum>(ii)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id89b3576f121145b9aa31400f77297a36"><enum>(g)</enum><header>Briefing required</header><text>Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the President shall brief the appropriate congressional committees on the status of efforts by the President to prevent conduct described in subparagraphs (A) through (E) of subsection (a)(1).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idfc5813c89fa348f996e161c341563eaf"><enum>(h)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to prohibit any person from, or authorize or require the imposition of sanctions with respect to any person for, conducting or facilitating any transaction for the sale or donation of agricultural commodities, food, medicine, or medical devices.</text>
 </subsection><subsection id="id007eda7a807b4c89980b6a4bab807c55"><enum>(i)</enum><header>Appropriate congressional committees and leadership defined</header><text>In this section, the term <term>appropriate congressional committees and leadership</term> means—</text> <paragraph id="idcfe9d4d1c9e540b4988f3a18eca74cfd"><enum>(1)</enum><text>the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, and the majority and minority leaders of the Senate; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6163479450cd478797f60707660fb1f6"><enum>(2)</enum><text>the Committee on Financial Services, the Committee on Foreign Affairs, and the Speaker, the majority leader, and the minority leader of the House of Representatives.</text>
					</paragraph></subsection></section><section id="idb4545994555e4198b0c68e30e4923660"><enum>102.</enum><header>Expansion of licensing requirements for transactions in North Korean covered property</header>
				<subsection id="id343228ed564d48809197a14f0b7b547d"><enum>(a)</enum><header>License required</header>
 <paragraph id="id4facb6fc3aed4b669a7690276cf9c6c5"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), not later than 180 days after the date of the enactment of this Act, the President shall prescribe regulations prohibiting any transaction involving the manufacture, sale, purchase, transfer, import, or export of North Korean covered property by a United States person or conducted in the United States.</text>
					</paragraph><paragraph id="id3d576bd573c840d6820e872d7fd03bec"><enum>(2)</enum><header>Exception</header>
 <subparagraph id="idD18DAFE8902841E889BF7F9DA9017EBE"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary may grant licenses and permits for the following purposes:</text>
 <clause id="id440c13d58dab4e63ab2b54a431fa01b0"><enum>(i)</enum><text>For any purpose covered by an exemption or waiver under section 208 of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9228">22 U.S.C. 9228</external-xref>), including humanitarian, diplomatic, consular, law enforcement, and other purposes.</text>
 </clause><clause id="idadde3015bfa34e1bad8db46609fe6e69"><enum>(ii)</enum><text>To import food products into North Korea if such food products are not defined as luxury goods.</text> </clause><clause id="id696BDB6C9D344AC996C4E140A59CC5F9"><enum>(iii)</enum><text>To meet an urgent and compelling humanitarian need.</text>
 </clause><clause id="id9b4dc3ea8e87458a87fe3ff8cd300848"><enum>(iv)</enum><text>For activities to promote human rights in North Korea, the development of private agriculture and markets in North Korea, and the free flow of information to, from, and within North Korea.</text>
 </clause><clause id="id2514978e29b041e2ae54bf3c2d402d2e"><enum>(v)</enum><text>To import agricultural products, medicine, or medical devices into North Korea if such products, medicine, or devices are classified as designated <quote>EAR 99</quote> under subchapter C of chapter VII of title 15, Code of Federal Regulations, or any successor regulations (commonly known as the <quote>Export Administration Regulations</quote>), and not controlled under—</text>
 <subclause id="idaee4e93e1aa7434d9d843eb736fc2bd9"><enum>(I)</enum><text>the Export Administration Act of 1979 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2401">50 U.S.C. App. 2401</external-xref> et seq.), as continued in effect under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.);</text>
 </subclause><subclause id="id4f386c435c8b45728acd4f214c0d2e7d"><enum>(II)</enum><text>the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751</external-xref> et seq.);</text> </subclause><subclause id="id4d6694dfcd9f426098107898a46b1224"><enum>(III)</enum><text>part B of title VIII of the Nuclear Proliferation Prevention Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/22/6301">22 U.S.C. 6301</external-xref> et seq.); or</text>
 </subclause><subclause id="id9b9455726248421d9986c0c483c8fe10"><enum>(IV)</enum><text>the Chemical and Biological Weapons Control and Warfare Elimination Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/22/5601">22 U.S.C. 5601</external-xref> et seq.).</text>
 </subclause></clause></subparagraph><subparagraph id="id276637dbf47e48768d6f8318a10fa6d7"><enum>(B)</enum><header>Exception</header><text>The Secretary may not grant a license or permit under subparagraph (A) for an activity described in section 104(a) of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9214">22 U.S.C. 9214(a)</external-xref>).</text>
						</subparagraph></paragraph></subsection><subsection id="id5cdbb613987d4a3c9eb1a2c768a085c4"><enum>(b)</enum><header>Penalties</header>
 <paragraph id="id52327fee03be4f629739a4798192d994"><enum>(1)</enum><header>In general</header><text>A person shall be fined not more than $5,000,000, imprisoned for not more than 20 years, or both, if the person knowingly—</text>
 <subparagraph id="idd8be977c10ac44e280abf642d73393bb"><enum>(A)</enum><text>engages in a transaction described in subsection (a)(1), except pursuant to a license or permit granted under this section or regulations prescribed pursuant to this section; or</text>
 </subparagraph><subparagraph id="iddaca9778015d497697d599a5cb055f29"><enum>(B)</enum><text>evades a requirement to obtain a license or permit under this section or a regulations prescribed pursuant to this section.</text>
 </subparagraph></paragraph><paragraph id="ide77a3f0f829a4c6dbe0865ba501c6aa4"><enum>(2)</enum><header>Forfeiture of property</header><text>Any property, real or personal, that is involved in a transaction that is a violation of subsection (a)(1), is involved in an attempt to conduct such a transaction, or constitutes or is derived from proceeds traceable to such a transaction, is subject to forfeiture to the United States.</text>
					</paragraph></subsection><subsection id="idcef0384eabcc4bed9ae312562fa599ab"><enum>(c)</enum><header>Report required</header>
 <paragraph id="id0da2bf36396c4d24bad41a09b86e4bee"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the President shall submit to the appropriate congressional committees a report listing any licenses or permits granted under subsection (a).</text>
 </paragraph><paragraph id="id1f39736e063742d98ca1d1c8be7263b4"><enum>(2)</enum><header>Form</header><text>Each report required under paragraph (1) shall be submitted in unclassified form but may include a classified annex.</text>
 </paragraph><paragraph id="id2ccfb249f8434680842cdcbe00e4e263"><enum>(3)</enum><header>Public availability</header><text>Not later than 30 days after the submission of a report under paragraph (1), the Secretary of the Treasury and the Secretary of State shall each publish the unclassified part of the report on a publicly available Internet website of the Department of the Treasury and the Department of State, as the case may be.</text>
 </paragraph></subsection><subsection id="idca2c8963df034108b71d0b41673bb2db"><enum>(d)</enum><header>Termination of requirements</header><text>The President may terminate the prohibition on transactions described in subsection (a) and the imposition of penalties under subsection (b) if the President submits to the appropriate congressional committees the certification described in section 402 of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9252">22 U.S.C. 9252</external-xref>).</text>
 </subsection><subsection id="id888365f749e14f2ab7b425c4c571d06d"><enum>(e)</enum><header>Modification of definition of specified unlawful activity for money laundering purposes</header><text>Section 1956(c)(7)(D) of title 18, United States Code, is amended—</text> <paragraph id="idac6a673a844d4cfcbb229e197b71d96f"><enum>(1)</enum><text>by striking <quote>or section 104(a) of</quote> and inserting <quote>section 104(a) of</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id12e51b6391b04f2ba878df1ba96ff029"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>, or section 102(b) of the <short-title>Banking Restrictions Involving North Korea (BRINK) Act of 2017</short-title> (relating to transactions in certain North Korean property)</quote>.</text> </paragraph></subsection></section><section id="iddc3d307212184aed96ac5a7f238ed73b"><enum>103.</enum><header>Authorization of imposition of sanctions with respect to the provision of specialized financial messaging services to North Korean financial institutions and sanctioned persons</header> <subsection id="id08fd39dd89054c3dbfa2eeaf9b6acdd5"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text>
 <paragraph id="idcadf07c59a2245a29f1e19467277dc9e"><enum>(1)</enum><text>providers of specialized financial messaging services have been used as a critical link between the Government of North Korea and the international financial system;</text>
 </paragraph><paragraph id="id0b7ddde6ac6443f2b65672b77f5fda19"><enum>(2)</enum><text>the Financial Action Task Force has repeatedly called for jurisdictions to apply countermeasures to protect the financial system from the risks of money laundering and proliferation financing emanating from North Korea;</text>
 </paragraph><paragraph id="id64ac31c18cbf40b194ac63c16c6f3a9e"><enum>(3)</enum><text>credible published reports have implicated the Government of North Korea in stealing approximately $81,000,000 from the Bangladesh Bank and attempting to steal another $951,000,000 from other banks using a financial messaging service; and</text>
 </paragraph><paragraph id="id6ef6192a54ab4a99ae29d4d49d65cb6d"><enum>(4)</enum><text>directly providing specialized financial messaging services to, or enabling or facilitating direct or indirect access to such messaging services for, any financial institution designated by the United Nations Security Council is inconsistent with applicable United Nations Security Council resolutions.</text>
 </paragraph></subsection><subsection id="id9430ddf18c1142b78d539b72504fc577"><enum>(b)</enum><header>Authorization of imposition of sanctions</header><text>The President may impose sanctions pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) with respect to a person if, on or after the date that is 90 days after the date of the enactment of this Act, the person knowingly and directly provides specialized financial messaging services to, or knowingly enables or facilitates direct or indirect access to such messaging services for—</text>
 <paragraph id="id979b498704fe4ecd802fe14f3af68520"><enum>(1)</enum><text>a North Korean financial institution;</text> </paragraph><paragraph id="idb1a9337136a14baca26853159dd76555"><enum>(2)</enum><text>a person, including a financial institution, that is designated pursuant to—</text>
 <subparagraph id="ide2f9e172680c44c093d5cc5e100a1963"><enum>(A)</enum><text>an applicable Executive order;</text> </subparagraph><subparagraph id="id68aff088ddc44afea4e2769014ed3109"><enum>(B)</enum><text>an applicable United Nations Security Council resolution; or</text>
 </subparagraph><subparagraph id="id6c1477f117c64bfe96f0e28784773da2"><enum>(C)</enum><text>section 104 of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9214">22 U.S.C. 9214</external-xref>); or</text> </subparagraph></paragraph><paragraph id="id2ABDDA5C156A475AA9650552F568DF44"><enum>(3)</enum><text>a person subject to sanctions under this Act.</text>
 </paragraph></subsection><subsection id="idb9ee1ec8897e4d21bf02b13f7230a3b2"><enum>(c)</enum><header>Enabling or facilitating access to specialized financial messaging services</header><text>For purposes of this section, enabling or facilitating direct or indirect access to specialized financial messaging services to a person described in paragraph (1) or (2) of subsection (b) includes doing so by serving as an intermediary financial institution with access to such messaging services.</text>
				</subsection><subsection id="id44209DF593C64E0EA532237701468859"><enum>(d)</enum><header>Suspension and termination of sanctions</header>
 <paragraph id="id2F955842F92F4EB5826CC2B6717B72C7"><enum>(1)</enum><header>Suspension</header><text>The President may suspend the application of any sanctions under subsection (b) for a period of not more than one year if the President certifies to the appropriate congressional committees that the Government of North Korea is taking steps toward—</text>
 <subparagraph id="id585B8863898645269FD6127F245CA948"><enum>(A)</enum><text>the verification of its compliance with applicable United Nations Security Council Resolutions; and</text> </subparagraph><subparagraph id="id152FA3C7020F4EA099991EE62BA70100"><enum>(B)</enum><text>fully accounting for and repatriating United States citizens and permanent residents (including deceased United States citizens and permanent residents)—</text>
 <clause id="idE25F64C1243D4A2FAC09EDAA09E989C5"><enum>(i)</enum><text>abducted or unlawfully held captive by the Government of North Korea; or</text> </clause><clause id="id287E2202733D4867A18BEDDCBA42C61B"><enum>(ii)</enum><text>detained in violation of the Agreement Concerning a Military Armistice in Korea, signed at Panmunjom July 27, 1953 (commonly referred to as the <quote>Korean War Armistice Agreement</quote>).</text>
 </clause></subparagraph></paragraph><paragraph id="idAA994F9CB9D144EA8FF14C0F94C1F7F9"><enum>(2)</enum><header>Renewal of suspension</header><text>The President may renew a suspension described in paragraph (1) for additional periods of not more than 180 days if the President certifies to the appropriate congressional committees that the Government of North Korea continues to take steps as described in paragraph (1).</text>
 </paragraph><paragraph id="id2DFFAE36124D41DE95C336F11E2E227B"><enum>(3)</enum><header>Termination of sanctions</header><text>The President may terminate the application of any sanctions under subsection (b) if the President certifies that the Government of North Korea has made significant progress towards—</text>
 <subparagraph id="id1E6C0500C15D44969DC8FD79A38C3CA4"><enum>(A)</enum><text>completely, verifiably, and irreversibly dismantling all of its nuclear, chemical, biological, and radiological weapons programs, including all programs for the development of systems designed in whole or in part for the delivery of such weapons; and</text>
 </subparagraph><subparagraph id="idE34A16E5CA6A4C44A6A8EB8326DCD4A7"><enum>(B)</enum><text>fully accounting for and repatriating United States citizens and permanent residents (including deceased United States citizens and permanent residents)—</text>
 <clause id="idCC261D1CFB3F4DD7A10D58F2650D1FA6"><enum>(i)</enum><text>abducted or unlawfully held captive by the Government of North Korea; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="idCE5D0DDBCBB440A69F8175627526EBB8"><enum>(ii)</enum><text display-inline="yes-display-inline">detained in violation of the Agreement Concerning a Military Armistice in Korea, signed at Panmunjom July 27, 1953 (commonly referred to as the <quote>Korean War Armistice Agreement</quote>).</text>
							</clause></subparagraph></paragraph></subsection></section><section id="id205b99f43a914f1b8efd2ceb4e05551a"><enum>104.</enum><header>Authorization of imposition of sanctions with respect to governments that fail to comply with
			 United Nations Security
			 Council sanctions against North Korea</header>
 <subsection id="id9be8dae463de47c6b733bcd37617e33a"><enum>(a)</enum><header>Briefing required</header><text>Not later than 90 days after the date of the enactment of this Act, the President shall brief the appropriate congressional committees regarding each government of a foreign country that the President has identified as failing to—</text>
 <paragraph id="id18d27d462fb14170a09f8ecf66196dd3"><enum>(1)</enum><text>close the branches, subsidiaries, or representative offices of North Korean financial institutions in that country;</text>
 </paragraph><paragraph id="ide58811074af74ed5bf5ba1fd79349007"><enum>(2)</enum><text>expel representatives of North Korean financial institutions;</text> </paragraph><paragraph id="id6c5cc96e91e049fcb62a1bd4e01e2816"><enum>(3)</enum><text>close the representative offices and expel the representatives of persons designated under applicable United Nations Security Council resolutions;</text>
 </paragraph><paragraph id="idd0ba3e35dce346658b9e95a15257a32d"><enum>(4)</enum><text>prohibit joint ventures with North Korean financial institutions;</text> </paragraph><paragraph id="idbd3e393e781a4345b6b550bb36fc133e"><enum>(5)</enum><text>deregister any vessel that constitutes North Korean covered property; or</text>
 </paragraph><paragraph id="id4dff7cc56a0e4f72b92ae36d1d39104e"><enum>(6)</enum><text>expel North Korean nationals, including diplomats, working on behalf of persons designated under applicable United Nations Security Council resolutions.</text>
 </paragraph></subsection><subsection id="id90A0AD8E23094AB8B54CC06602B91FE3"><enum>(b)</enum><header>Publication</header><text>The Secretary of the Treasury shall publish in the Federal Register the names of each foreign country that has failed to carry out the activities described in paragraphs (1) through (6) of subsection (a).</text>
 </subsection><subsection id="idd9bae44d4247413f83fc2f9423d05512"><enum>(c)</enum><header>Sanctions authorized</header><text>With respect to any government of a foreign country included in the briefing under subsection (a), the President may, until such time as the President determines that the government has taken substantial steps to terminate conduct described in that subsection, impose one or more of the following sanctions with respect to that government:</text>
 <paragraph id="idea0afaf15dd54db9997b542458b3a322"><enum>(1)</enum><text>Prohibit or curtail the export of any goods or technology to that foreign country pursuant to the authorities provided in section 6 of the Export Administration Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/50/4605">50 U.S.C. 4605</external-xref>) (as continued in effect pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.)).</text>
 </paragraph><paragraph id="id45c3847f3afa4c22ba7fd867a7bb304f"><enum>(2)</enum><text>Withhold assistance under the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151</external-xref> et seq.) to that government.</text>
 </paragraph><paragraph id="idf32d88f4093f4076a967fc8ff6200e86"><enum>(3)</enum><text>Instruct the United States executive director at each international financial institution (as defined in section 1701(c) of the International Financial Institutions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/262r">22 U.S.C. 262r(c)</external-xref>)) to use the voice and vote of the United States to oppose the provision of loans, benefits, or other use of the funds of the institution to that government.</text>
 </paragraph></subsection><subsection id="id76ff757b7b7049c695abba3b8711de50"><enum>(d)</enum><header>Rule of construction</header><text>This section shall not be construed to limit the use of other sanctions authorities available to the President in response to conduct described in subsection (a).</text>
				</subsection></section><section id="id5576ee2c63894ec7bb2c03e3b9d36024"><enum>105.</enum><header>Grants to conduct research on financial networks and financial methods of the Government of North
			 Korea</header>
				<subsection id="ida72a3d52d4474aa185733d51f6c0e027"><enum>(a)</enum><header>Grants authorized</header>
 <paragraph id="id0EE21A14C0364934B11CCB57639F1CA2"><enum>(1)</enum><header>In general</header><text>The President, acting through the Attorney General, the Secretary of State, the Secretary of the Treasury, or the Director of National Intelligence, may award grants to, and enter into cooperative agreements with, States, units of local government, nongovernmental organizations, and relevant international organizations to further the purposes of this title and provide data to address the issues identified in section 2.</text>
 </paragraph><paragraph id="id2A8C6F29D2864F65AAAB1AB5DDCD7803"><enum>(2)</enum><header>Research initiatives</header><text>Grants awarded and cooperative agreements entered into under paragraph (1) shall include grants and agreements for the purpose of conducting research initiatives on the following:</text>
 <subparagraph id="ide407116b495e419bb8756e65aee7cd08"><enum>(A)</enum><text>The methods used by the Government of North Korea to deal in, transact in, or conceal the ownership, control, or origin of North Korean covered property.</text>
 </subparagraph><subparagraph id="id27d9de39d1874980a3899218e37f5d94"><enum>(B)</enum><text>The relationship between proliferation by the Government of North Korea and the financial industry or financial institutions.</text>
 </subparagraph><subparagraph id="id6797c8b29dc9439fa189443cea6d5856"><enum>(C)</enum><text>The export by any person to the United States of North Korean covered property.</text> </subparagraph><subparagraph id="id55363268343c473cb121c92a7242ee35"><enum>(D)</enum><text>The involvement of any person in human trafficking involving citizens or nationals of North Korea.</text>
 </subparagraph><subparagraph id="idcd37d4653bcf44da8d02adc35a5ed95e"><enum>(E)</enum><text>Information relating to transactions described in section 102(a).</text> </subparagraph><subparagraph id="id79f26af943ce44eba8099d360a43c8d2"><enum>(F)</enum><text>Information relating to activities described in section 104(a).</text>
 </subparagraph><subparagraph id="idf6f008dd0f7c429fb532dfc99df6f955"><enum>(G)</enum><text>Information relating to the identification, blocking, and release of property or proceeds described in section 107(a).</text>
 </subparagraph><subparagraph id="idaa8619e16a7c40da892bb75b60c7d818"><enum>(H)</enum><text>The effectiveness of law enforcement and diplomatic initiatives of Federal, State, and foreign governments to comply with the provisions of applicable United Nations Security Council resolutions.</text>
 </subparagraph><subparagraph id="id7711c1274d1f48ba9791145c0c594be1"><enum>(I)</enum><text>The effectiveness of compliance programs within the financial industry to ensure compliance with applicable United Nations Security Council resolutions.</text>
 </subparagraph></paragraph></subsection><subsection id="id77b0e2a8210c469eb8d72423ca2fac98"><enum>(b)</enum><header>Interagency coordination</header><text>The President shall ensure that any information collected pursuant to subsection (a) is shared among the agencies involved in investigations described in section 102(b) of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9212">22 U.S.C. 9212</external-xref>).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id4dd13d0d1ccc44e883ec1d41105431f2"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated for each of fiscal years 2018 through 2021 such sums as may be necessary to carry out this section.</text>
				</subsection></section><section id="id6d59b675d99345a98fca09e97ca5341c"><enum>106.</enum><header>Report on use by the Government of North Korea of beneficial ownership rules  to access the
			 international financial system</header>
 <subsection id="id4c9c76a7be324337a8d6a508bf3603d3"><enum>(a)</enum><header>In general</header><text>Not later than November 11, 2018, the Director of the Financial Crimes Enforcement Network of the Department of the Treasury shall submit to the appropriate congressional committees and publish in the Federal Register a report setting forth the findings of the Director regarding how the Government of North Korea is using laws regarding beneficial ownership of property to access the international financial system.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id9FFBFBFE954042D2B842CF246F634DD5"><enum>(b)</enum><header>Elements</header><text>The Director shall include in the report required under subsection (a) proposals for such legislative and administrative action as the Director considers appropriate.</text>
				</subsection></section><section id="idD57DF949C11348CC96E8D7916286892F"><enum>107.</enum><header>Sense of Congress on identification and blocking of property of North Korean officials</header>
 <subsection id="id90fd9a0c103e471880967f28fc8d027a"><enum>(a)</enum><header>In general</header><text>It is the sense of Congress that the President should collaborate with the Stolen Asset Recovery Initiative of the World Bank Group and the United Nations Office on Drugs and Crime to prioritize the identification, blocking, and release for humanitarian purposes of—</text>
 <paragraph id="id96dc64a8f7894601a64b458332760122"><enum>(1)</enum><text>any property owned or controlled by a North Korean official; or</text> </paragraph><paragraph id="id102da9543ca54e72a26b979e95939639"><enum>(2)</enum><text>any significant proceeds of kleptocracy by the Government of North Korea or a North Korean official.</text>
 </paragraph></subsection><subsection id="id178b5b5d73454c2fa4fa656824a50297"><enum>(b)</enum><header>North Korean official defined</header><text>In this section, the term <term>North Korean official</term> includes—</text>
 <paragraph id="id88159bb5123443138e13cc854bf4f3a7"><enum>(1)</enum><text>the individuals described in section 304(a)(2)(B) of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9243">22 U.S.C. 9243(a)(2)(B)</external-xref>); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idccc4f1b384a44c6089f67d4f395b1029"><enum>(2)</enum><text>such additional officials as the President may determine to be officials of the Government of North Korea.</text>
					</paragraph></subsection></section><section id="id30cd7176b269412e8cc36e8565b72d58"><enum>108.</enum><header>Sense of Congress regarding the Kaesong Industrial Complex</header>
 <subsection id="idebd5dbcdc1784e279cc428fbd49e09c3"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="idf041492a06354716a800fef5d16af8c5"><enum>(1)</enum><text>On October 14, 2006, the United Nations Security Council adopted Resolution 1718, paragraph 8(d) of which requires member states of the United Nations to ensure that persons under their jurisdiction prevent any funds, financial assets, and economic resources from being used by persons or entities engaged in or proving support for the nuclear, chemical, or biological weapons programs of North Korea or the ballistic missile programs of North Korea.</text>
 </paragraph><paragraph id="id791bd4dacdd74bc9bc02bfa2c5ea085f"><enum>(2)</enum><text>On April 11, 2011, the President signed Executive Order 13570 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to prohibiting certain transactions with respect to North Korea), which prohibits the importation into the United States, directly or indirectly, of any goods, services, or technology from North Korea, except as provided in statute or in licenses, regulations, orders, or directives that may be issued pursuant to that Executive order.</text>
 </paragraph><paragraph id="id53b1c7412ddd484382a8d3844f0a4158"><enum>(3)</enum><text>In April 2013, the Under Secretary of the Treasury for Terrorism and Financial Intelligence said, in reference to the Kaesong Industrial Complex, <quote>Precisely what North Koreans do with earnings from Kaesong, I think, is something that we are concerned about.</quote>.</text>
 </paragraph><paragraph id="id1e0672bc452c4c5b939c5ac12cc2f7ac"><enum>(4)</enum><text>In February 2016, on announcing the suspension of operations at the Kaesong Industrial Complex, the Unification Ministry of the Republic of Korea stated that the Government of North Korea may have used the proceeds from the Kaesong Industrial Complex to finance its nuclear weapons program.</text>
 </paragraph><paragraph id="id2868672ae13a4f2d97020e5e2c82dde2"><enum>(5)</enum><text>On November 30, 2016, the United States Security Council approved Resolution 2321, paragraph 32 of which requires member states of the United Nations to prohibit public and private financial support for trade with North Korea from within their territories or by persons subject to their jurisdiction, including the granting of export credits, guarantees, or insurance to persons involved in such trade, except as approved in advance by a committee appointed by the Security Council on a case-by-case basis.</text>
 </paragraph></subsection><subsection id="idea98d50e2f1446328d118006cd0402b3"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> <paragraph id="id7dc13e0fd7e94a9b95ff82e99f4f5c88"><enum>(1)</enum><text>the United States stands in solidarity with its ally in the Republic of Korea, and has expressed that solidarity with the sacrifice of 36,914 people of the United States and with the continued presence of 29,500 members of the Armed Forces of the United States in the Republic of Korea;</text>
 </paragraph><paragraph id="id84797732430b4d7ea128cd221cc5624d"><enum>(2)</enum><text>the nuclear weapons program of North Korea poses a grave and imminent threat to the freedom and security of both the United States and the Republic of Korea;</text>
 </paragraph><paragraph id="id7e5d5936a088482fbd55a629f0120541"><enum>(3)</enum><text>the Kaesong Industrial Complex yielded few, if any, apparent benefits with regard to the reform, liberalization, or disarmament of North Korea;</text>
 </paragraph><paragraph id="id396a82ea94fb4c5aaa9948e5ae31a258"><enum>(4)</enum><text>the unconditional provision of revenue from the Kaesong Industrial Complex to the Government of North Korea undermines the financial pressure necessary to strict and effective enforcement of United Nations Security Council sanctions;</text>
 </paragraph><paragraph id="idaa680f8f8a864ccc82bd3f611fa802bc"><enum>(5)</enum><text>the strict and effective enforcement of United Nations Security Council sanctions is the last plausible option to achieve the complete, verifiable, irreversible, and peaceful nuclear disarmament of North Korea; and</text>
 </paragraph><paragraph id="id2b1ee5dc5e9d470e9e00022cfa8e084d"><enum>(6)</enum><text>the Kaesong Industrial Complex should not be reopened until the Government of North Korea has completely, verifiably, and irreversibly dismantled all of its nuclear, chemical, biological, and radiological weapons programs, including all programs for the development of systems designed in whole or in part for the delivery of such weapons.</text>
					</paragraph></subsection></section></title><title id="idE719D7DB0F814FD48F6106983E08225C" style="OLC"><enum>II</enum><header>Divestment from North Korea</header>
			<section id="id3DFF05E4DEA547FABBD099BFC816CF40"><enum>201.</enum><header>Authority of State and local governments to divest from companies that invest in North Korea</header>
 <subsection id="id06aa661998b1461c83c0bf8b10b624fa"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the United States should support the decision of any State or local government, for moral, prudential, or reputational reasons, to divest from, or prohibit the investment of assets of the State or local government in, a person that engages in investment activities involving North Korean covered property if North Korea is subject to economic sanctions imposed by the United States or the United Nations Security Council.</text>
 </subsection><subsection id="idf90d3254e25149d3a82ae241be6d5146"><enum>(b)</enum><header>Authority To Divest</header><text>Notwithstanding any other provision of law, a State or local government may adopt and enforce measures that meet the requirements of subsection (c) to divest the assets of the State or local government from, or prohibit investment of the assets of the State or local government in, any person that the State or local government determines, using credible information available to the public, engages in investment activities involving North Korean covered property of a value of more than $10,000.</text>
 </subsection><subsection id="ide769c0c5780b4a7381f321d75657f42f"><enum>(c)</enum><header>Requirements</header><text>Any measure taken by a State or local government under subsection (b) shall meet the following requirements:</text>
 <paragraph id="idda934b7b66c9461d890d35a1321f0600"><enum>(1)</enum><header>Notice</header><text>The State or local government shall provide written notice to each person with respect to which a measure under this section is to be applied.</text>
 </paragraph><paragraph id="idbd43d9bf3bb14df8a7f10fa56f705d22"><enum>(2)</enum><header>Timing</header><text>The measure applied under this section shall apply to a person not earlier than the date that is 90 days after the date on which written notice under paragraph (1) is provided to the person.</text>
					</paragraph><paragraph id="idfb40d81dc6014cd69cdd255eed743ee7"><enum>(3)</enum><header>Opportunity to demonstrate compliance</header>
 <subparagraph id="id25B216527F8C4A288DDDDE2E89C1983E"><enum>(A)</enum><header>In general</header><text>The State or local government shall provide to each person with respect to which a measure is to be applied under this section an opportunity to demonstrate to the State or local government that the person does not engage in investment activities in North Korean covered property.</text>
 </subparagraph><subparagraph id="idBEB865CEA9D44ADA9F2E54A3DAF8BCCB"><enum>(B)</enum><header>Nonapplication</header><text>If a person with respect to which a measure is to be applied under this section demonstrates to the State or local government under subparagraph (A) that the person does not engage in investment activities in North Korean covered property, the measure shall not apply to that person.</text>
 </subparagraph></paragraph><paragraph id="id748c6bda847746c7ae4fa24560aa8108"><enum>(4)</enum><header>Sense of Congress on avoiding erroneous targeting</header><text>It is the sense of Congress that a State or local government should not adopt a measure under subsection (b) with respect to a person unless the State or local government has—</text>
 <subparagraph id="id4BABACCB4DD64751AE9F37FDBB7EADB0"><enum>(A)</enum><text>made every effort to avoid erroneously targeting the person; and</text>
 </subparagraph><subparagraph id="id4A14EDCD2980449BAABACFE6A7D153E4"><enum>(B)</enum><text>verified that the person engages in investment activities in North Korean covered property.</text>
 </subparagraph></paragraph></subsection><subsection id="id7dc1e703b7a947acb79a70fbce8a88f3"><enum>(d)</enum><header>Notice to Department of Justice</header><text>Not later than 30 days after a State or local government applies a measure under this section, the State or local government shall notify the Attorney General of that measure.</text>
				</subsection><subsection id="id033b34c37696427eb232b490f86cd026"><enum>(e)</enum><header>Authorization for prior applied measures</header>
 <paragraph id="ide255e505ff55451eb20c15e0ec03bea4"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this section or any other provision of law, a State or local government may enforce a measure (without regard to the requirements of subsection (c), except as provided in paragraph (2)) applied by the State or local government before the date of the enactment of this Act that provides for the divestment of assets of the State or local government from, or prohibits the investment of the assets of the State or local government in, any person that the State or local government determines, using credible information available to the public, engages in investment activities in North Korean covered property that are identified in that measure.</text>
 </paragraph><paragraph id="id02607bc3b2f1493baeb33292063ac219"><enum>(2)</enum><header>Application of notice requirements</header><text>A measure described in paragraph (1) shall be subject to the requirements of paragraphs (1), (2), and (3)(A) of subsection (c) on and after the date that is two years after the date of the enactment of this Act.</text>
 </paragraph></subsection><subsection id="id0F7EAD29A1494447BBAC42F9DE901EED"><enum>(f)</enum><header>No preemption</header><text>A measure applied by a State or local government authorized under subsection (b) or (e) is not preempted by any Federal law.</text>
 </subsection><subsection id="iddcb456bd89544ca1b55cd5d1db5a4f4c"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idd3fe1f35013746babec8df41cc3be8ed"><enum>(1)</enum><header>Asset</header> <subparagraph id="ida5119d759f544055a66cd95ca1bf47a9"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term <term>asset</term> means public monies, and includes any pension, retirement, annuity, endowment fund, or similar instrument, that is controlled by a State or local government.</text>
 </subparagraph><subparagraph id="id289677cb9668463997773af99fe8fe07"><enum>(B)</enum><header>Exception</header><text>The term <term>asset</term> does not include employee benefit plans covered by title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1001">29 U.S.C. 1001</external-xref> et seq.).</text>
 </subparagraph></paragraph><paragraph id="ideda55351d0d64e189fb30e2d131cda7d"><enum>(2)</enum><header>Investment</header><text>The term <term>investment</term> includes—</text>
 <subparagraph id="id81588d4da2b345f5976d0a00f89482bb"><enum>(A)</enum><text>a commitment or contribution of funds or property;</text> </subparagraph><subparagraph id="id58770d8d4a2f4e1dad7d60f4911dcd83"><enum>(B)</enum><text>a loan or other extension of credit; and</text>
 </subparagraph><subparagraph id="id42785a86a94345a8ba59629a76470923"><enum>(C)</enum><text>the entry into or renewal of a contract for goods or services.</text> </subparagraph></paragraph></subsection><subsection id="id59260510024e4cc68fd2b2054fc97d07"><enum>(h)</enum><header>Effective date</header> <paragraph id="id356491b81af641b6b1136a6bf7e7aafb"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2) and subsection (e), this section applies to measures applied by a State or local government before, on, or after the date of the enactment of this Act.</text>
 </paragraph><paragraph id="id0883cfa5b4e6484ca6c38311d551fbce"><enum>(2)</enum><header>Notice requirements</header><text>Except as provided in subsection (h), subsections (c) and (d) apply to measures applied by a State or local government on or after the date of the enactment of this Act.</text>
					</paragraph></subsection></section><section id="id76eb4c732daa4ec8a8dba8bb34f8bcb3"><enum>202.</enum><header>Safe harbor for changes of investment policies by asset managers</header>
 <subsection id="idf56babf495984e1f81031c46717feec0"><enum>(a)</enum><header>In general</header><text>Section 13(c)(1) of the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-13">15 U.S.C. 80a–13(c)(1)</external-xref>) is amended—</text> <paragraph id="idf8c10cc9677643fca4b442ebf7e5fcea"><enum>(1)</enum><text>in subparagraph (A) by striking <quote>or</quote> at the end;</text>
 </paragraph><paragraph id="idd2fce7aeccb84cfd8d1f88feabca282e"><enum>(2)</enum><text>in subparagraph (B) by striking the period and inserting <quote>; or</quote>; and</text> </paragraph><paragraph id="id08cf4484741242cf926673d4cec781cf"><enum>(3)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id78860b88737a4cdaa547be5b57da05f3" style="OLC">
 <subparagraph id="id3698947ee5364cb88b5cb6c004edfc95"><enum>(C)</enum><text>engage in investment activities involving North Korean covered property, as defined in section 3 of the <short-title>Banking Restrictions Involving North Korea (BRINK) Act of 2017</short-title>.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id3a0158da3fdf4db9a40ba676d39dcfe0"><enum>(b)</enum><header>Securities and Exchange Commission regulations</header><text>Not later than 120 days after the date of the enactment of this Act, the Securities and Exchange Commission shall issue any revisions the Securities and Exchange Commission determines to be necessary to the regulations requiring disclosure by each registered investment company that divests itself of securities in accordance with section 13(c) of the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-13">15 U.S.C. 80a–13(c)</external-xref>), including in accordance with paragraph (1)(C) of that section, as added by subsection (a)(3).</text>
 </subsection></section><section id="id49548b36d32d4d58b3c6f94c7e830884"><enum>203.</enum><header>Sense of Congress regarding certain ERISA plan investments</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="id07B08E49221E4C17A9C669C34B58A23D"><enum>(1)</enum><text>a fiduciary of an employee benefit plan, as defined in section 3(3) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(3)</external-xref>), may divest plan assets from, or avoid investing plan assets in, any person the fiduciary determines engages in investment activities involving North Korean covered property, if—</text>
 <subparagraph id="idf00d30d7a1fd4c77b8f615e3ccf5471b"><enum>(A)</enum><text>the fiduciary makes that determination using credible information that is available to the public; and</text>
 </subparagraph><subparagraph id="id24c15fa196374405af88537370c96de4"><enum>(B)</enum><text>the fiduciary prudently determines that the result of that divestment or avoidance of investment would not be expected to provide the employee benefit plan with—</text>
 <clause id="idddca6984969044aabebd78fbe1c4760b"><enum>(i)</enum><text>a lower rate of return than alternative investments with commensurate degrees of risk; or</text> </clause><clause id="ide439e113c33b438bb47cee67d14d797f"><enum>(ii)</enum><text>a higher degree of risk than alternative investments with commensurate rates of return; and</text>
 </clause></subparagraph></paragraph><paragraph id="id2C13D564F5A147F1AA8511875A3E86DC"><enum>(2)</enum><text>by divesting assets or avoiding the investment of assets as described in paragraph (1), the fiduciary is not breaching the responsibilities, obligations, or duties imposed upon the fiduciary by subparagraph (A) or (B) of section 404(a)(1) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1104">29 U.S.C. 1104(a)(1)</external-xref>).</text>
 </paragraph></section><section id="id45D200655DED48E8A4363944C35B7F7F"><enum>204.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or any other provision of law authorizing sanctions with respect to North Korea shall be construed to affect or displace—</text>
 <paragraph id="id246DB24A2DF14D29B564D50C88EE0834"><enum>(1)</enum><text>the authority of a State or local government to issue and enforce rules governing the safety, soundness, and solvency of a financial institution subject to its jurisdiction; or</text>
 </paragraph><paragraph id="id6348BC340EAD4B54B5593FE5619BE499"><enum>(2)</enum><text>the regulation and taxation by the several States of the business of insurance, pursuant to the Act of March 9, 1945 (59 Stat. 34, chapter 20; <external-xref legal-doc="usc" parsable-cite="usc/15/1011">15 U.S.C. 1011</external-xref> et seq.) (commonly known as the <quote>McCarran-Ferguson Act</quote>).</text>
				</paragraph></section></title><title id="id41ed4e3b0e844bf9a62e5d83d46f23ed"><enum>III</enum><header>General authorities</header>
 <section id="idb0ee3e7e1e974bc3b2685a03865016a3"><enum>301.</enum><header>Rulemaking</header><text display-inline="no-display-inline">The President may prescribe such rules and regulations as may be necessary to carry out this Act.</text>
			</section><section id="id1efc2f0820cc4b96a6bdc1c41cb8a9e1"><enum>302.</enum><header>Authority to consolidate reports</header>
 <subsection id="id7E7492CA1374470C9E7B822D77EBB60A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any and all reports required to be submitted to the appropriate congressional committees under this Act that are subject to a deadline for submission consisting of the same unit of time may be consolidated into a single report that is submitted pursuant to that deadline.</text>
 </subsection><subsection id="id7FDD31450DC547958A5D3E6F03E04CAB"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">Any reports consolidated under subsection (a) shall contain all information required under this Act and any other elements that may be required by existing law.</text>
 </subsection></section><section id="id97da4a2fdeaa497fa4e1b8c9ad435946"><enum>303.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to limit the authority or obligation of the President—</text> <paragraph id="id246B2CEB333B434398BD80F1B3C1AB06"><enum>(1)</enum><text display-inline="yes-display-inline">to apply the sanctions described in section 104 of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9214">22 U.S.C. 9214</external-xref>) with regard to persons that meet the criteria for designation under such section; or</text>
 </paragraph><paragraph id="idB420DD9F469946EABB9356FFD94EB65E"><enum>(2)</enum><text display-inline="yes-display-inline">to exercise any other law enforcement authorities available to the President.</text>
