 </subsection><subsection commented="no" display-inline="no-display-inline" id="id968ac7e321dc41b49294456ee76837b4"><enum>(c)</enum><header display-inline="yes-display-inline">References to the Magnuson-Stevens Fishery Conservation and Management Act</header><text display-inline="yes-display-inline">Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801</external-xref> et seq.).</text>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="id3eef8387cec845be9922273f7d7d399a" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Section 2(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801(a)</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id6bfaeeaf1348483ab015d17ded1c71d0" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="id732a1d352a294c2cb8b558286a8b3932"><enum>(13)</enum><text display-inline="yes-display-inline">While both provide significant cultural and economic benefits to the Nation, recreational fishing and commercial fishing are different activities. Therefore, science-based conservation and management approaches should be adapted to the characteristics of each sector.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" display-inline="no-display-inline" id="idcb99283cc90f4355a5723d8018ea59b2" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="id00b220e8acda4bac8ad7949c98e79a76"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id755ce193ef0240f6932690cafa5c0c5b"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida6b3914c7b424cf2b7204f115e1db85f"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71016da450804555b7dc9818ffc6f3b3"><enum>(2)</enum><header display-inline="yes-display-inline">Council</header><text display-inline="yes-display-inline">The term <term>Council</term> means any Regional Fishery Management Council established under section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5326886cd90046758c227df4fd432e8b"><enum>(3)</enum><header display-inline="yes-display-inline">Limited access privilege program</header><text display-inline="yes-display-inline">The term <term>limited access privilege program</term> means a program that meets the requirements of section 303A of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1853a">16 U.S.C. 1853a</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id441d64f1e5b34ee88a255d5cf9419747"><enum>(4)</enum><header display-inline="yes-display-inline">Mixed-use fishery</header><text display-inline="yes-display-inline">The term <term>mixed-use fishery</term> means a Federal fishery in which 2 or more of the following occur:</text> <subparagraph commented="no" display-inline="no-display-inline" id="id412638F86E044C53AEBEA6DA25844E19"><enum>(A)</enum><text display-inline="yes-display-inline">Recreational fishing.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5704CEDBAB65490BA60E99B28630B78D"><enum>(B)</enum><text display-inline="yes-display-inline">Charter fishing.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id371FCAA955B24EFDAA35C76715C7B789"><enum>(C)</enum><text display-inline="yes-display-inline">Commercial fishing.</text>
				</subparagraph></paragraph></section><title commented="no" id="id8eef7de372124396a2a61135b3dfda6f" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Conservation and management</header>
			<section commented="no" display-inline="no-display-inline" id="idb992b06dc7c846a9b709aa7ef309fb2b" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Process for allocation review for South Atlantic and Gulf of Mexico mixed-use fisheries</header>
 <subsection commented="no" display-inline="no-display-inline" id="id891c7b8dd4484e818eeec38ae6c7d7f3"><enum>(a)</enum><header display-inline="yes-display-inline">Study of allocations in mixed-use fisheries</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to the appropriate committees of Congress a report on mixed-use fisheries in each applicable Council’s jurisdiction, which shall include—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idebef0ac7521a4aea8d01ff07b559b984"><enum>(1)</enum><text display-inline="yes-display-inline">recommendations on criteria that could be used by such Councils for allocating or reallocating fishing privileges in the preparation of a fishery management plan or plan amendment, including consideration of the ecological, conservation, economic, and social factors of each component of a mixed-use fishery;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11cb26d582694f36adf4753f60fc8b8e"><enum>(2)</enum><text display-inline="yes-display-inline">identification of the sources of information that could reasonably support the use of such criteria in allocation decisions;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id254AD8AD46CD4DAE9938E376EE0E4B73"><enum>(3)</enum><text display-inline="yes-display-inline">an assessment of the budgetary requirements for performing periodic allocation reviews for each applicable Council; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e7b17dadd3643fa9677db0bffd4a887"><enum>(4)</enum><text display-inline="yes-display-inline">developing recommendations of procedures for allocation reviews and potential adjustments in allocation.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb4f6fa407358417981dcbc393e2a5b1d"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation with stakeholders</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall consult with the National Oceanic and Atmospheric Administration, the applicable Councils, the Science and Statistical Committees of such Councils, the applicable State fisheries management commissions, the recreational fishing sector, the commercial fishing sector, the charter fishing sector, and other stakeholders, to the extent practicable, in conducting the study required under subsection (a).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id97103cfaa9154373910abc755438a7d9"><enum>(c)</enum><header display-inline="yes-display-inline">Definition of applicable council</header><text display-inline="yes-display-inline">In this section, the term <term>applicable Council</term> means—</text> <paragraph commented="no" display-inline="no-display-inline" id="id9171b67ebc9e496bb7515accd8cd3731"><enum>(1)</enum><text display-inline="yes-display-inline">the South Atlantic Fishery Management Council; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id723b46352b3c4938abc4bf70e3472411"><enum>(2)</enum><text display-inline="yes-display-inline">the Gulf of Mexico Fishery Management Council.</text> </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9286b964c8394f25895cfc69d86946b1" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Fishery management measures</header> <subsection commented="no" display-inline="no-display-inline" id="idaa505cf96e694c01a005492a8f474eb3"><enum>(a)</enum><header display-inline="yes-display-inline">Management</header><text display-inline="yes-display-inline">Section 302(h) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(h)</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="ida39c9ac1fdb549e98674d4811ef33754"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (7)(C), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5dc8644f0519478587fef851120fee7c"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (8) as paragraph (9); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd934e1d63fed48b492d6199e6da79a51"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (7) the following:</text> <quoted-block display-inline="no-display-inline" id="id8605c275b2584f5cabf68037e0918c96" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="iddc3c331acb9046eaa96f3dec0b5f8963"><enum>(8)</enum><text display-inline="yes-display-inline">in addition to complying with the standards and requirements under paragraph (6), sections 301(a), 303(a)(15), and 304(e), and other applicable provisions of this Act, have the authority to use fishery management measures in a recreational fishery (or the recreational component of a mixed-use fishery) in developing a fishery management plan, plan amendment, or proposed regulations, such as extraction rates, fishing mortality targets, harvest control rules, or traditional or cultural practices of native communities in such fishery or fishery component; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5d2b5274fbaf47a88a02608dda566a8b"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Commerce shall submit to the appropriate committees of Congress a report that describes any actions pursuant to paragraph (8) of section 302(h) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(h)</external-xref>), as added by subsection (a).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idB96F02B3C3F44D1C9878AEBD1BDD6446"><enum>(c)</enum><header display-inline="yes-display-inline">Other fisheries</header><text display-inline="yes-display-inline">Nothing in paragraph (8) of section 302(h) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(h)</external-xref>), as added by subsection (a), shall be construed to affect management of any fishery not described in such paragraph (8).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id499f9c96c0cd440d8a0f061bbfe07b49" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Study of limited access privilege programs for mixed-use fisheries</header>
 <subsection commented="no" display-inline="no-display-inline" id="id016fc6c3d4cc4df6863babdf1bdb0315"><enum>(a)</enum><header display-inline="yes-display-inline">Study on limited access privilege programs</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Ocean Studies Board of the National Academies of Sciences, Engineering, and Medicine shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id3bcac470e32f47ad8811074a47bd21f0"><enum>(1)</enum><text display-inline="yes-display-inline">complete a study on the use of limited access privilege programs in mixed-use fisheries, including—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id0c5b2836efd24c5eab3af48c096255e9"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of progress in meeting the goals of the program and this Act;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idabe8271baac34b9fa9786299e55953f4"><enum>(B)</enum><text display-inline="yes-display-inline">an assessment of the social, economic, and ecological effects of the program, considering each sector of a mixed-use fishery and related businesses, coastal communities, and the environment;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide1684582763946e9bb3142f094bbbfe5"><enum>(C)</enum><text display-inline="yes-display-inline">an assessment of any impacts to stakeholders in a mixed-use fishery caused by a limited access privilege program;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id685e64f08d564e02955b590d72920769"><enum>(D)</enum><text display-inline="yes-display-inline">recommendations of policies to address any impacts identified under subparagraph (C);</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id590d39a8b8934ad5a56a94be1510469a"><enum>(E)</enum><text display-inline="yes-display-inline">identification of and recommendation of the different factors and information that should be considered when designing, establishing, or maintaining a limited access privilege program in a mixed-use fishery to mitigate any impacts identified in subparagraph (C), to the extent practicable; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32dc862e22794903bb399faccf2f1e4d"><enum>(F)</enum><text display-inline="yes-display-inline">a review of best practices and challenges faced in the design and implementation of limited access privilege programs under the jurisdiction of each of the 8 Regional Fishery Management Councils; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd6a6729f77fa4d8c86a219b3388cf4a7"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the appropriate committees of Congress a report on the study under paragraph (1), including the recommendations under subparagraphs (D) and (E) of paragraph (1).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6C0A25EAD7D24E108BBB91213E6B1A3F"><enum>(b)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">Except as provided in subsection (a)(1)(F), the study described in this section shall not include the areas covered by the Pacific Fishery Management Council and the North Pacific Fishery Management Council.</text>
				</subsection></section></title><title commented="no" id="id807daa13ffe74d3fb1efb0e5034c3e61" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Recreation fishery information, research, and development</header>
			<section commented="no" display-inline="no-display-inline" id="id93e5ca7cc91847a3beb8b7c93f11d8c3" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Cooperative data collection</header>
 <subsection commented="no" display-inline="no-display-inline" id="idf52a14a00088496f8947ed183d28e696"><enum>(a)</enum><header display-inline="yes-display-inline">Improving data collection and analysis</header><text display-inline="yes-display-inline">Section 404 (<external-xref legal-doc="usc" parsable-cite="usc/16/1881c">16 U.S.C. 1881c</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id213471540C8C4B3FAA5F88E1844338D4" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="id59b257b974854795979273d442f79f5b"><enum>(e)</enum><header display-inline="yes-display-inline">Improving data collection and analysis</header> <paragraph commented="no" display-inline="no-display-inline" id="id49bf4d35360f40c4891d1eb240748850"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the Modernizing Recreational Fisheries Management Act of 2017, the Secretary shall develop, in consultation with the science and statistical committees of the Councils established under section 302(g) and the Marine Fisheries Commissions, and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives a report on facilitating greater incorporation of data, analysis, stock assessments, and surveys from State agencies and nongovernmental sources described in paragraph (2), to the extent such information is consistent with section 301(a)(2), into fisheries management decisions.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3287bd68a9ac4e1088c07e3a88ed40c2"><enum>(2)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">In developing the report under paragraph (1), the Secretary shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idac47d93659254395bba4b9cad7f4d287"><enum>(A)</enum><text display-inline="yes-display-inline">identify types of data and analysis, especially concerning recreational fishing, that can be used for purposes of this Act as the basis for establishing conservation and management measures as required by section 303(a)(1), including setting standards for the collection and use of that data and analysis in stock assessments and surveys and for other purposes;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf0cee9f8ee8493ca022283b94544d6c"><enum>(B)</enum><text display-inline="yes-display-inline">provide specific recommendations for collecting data and performing analyses identified as necessary to reduce uncertainty in and improve the accuracy of future stock assessments, including whether such data and analysis could be provided by nongovernmental sources; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3dfd6e6a2aef4258837df414a9962119"><enum>(C)</enum><text display-inline="yes-display-inline">consider the extent to which the acceptance and use of data and analyses identified in the report in fishery management decisions is practicable and compatible with the requirements of section 301(a)(2).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id93ee739d18f74d7fa915443942df18b9"><enum>(b)</enum><header display-inline="yes-display-inline">NAS report recommendations</header><text display-inline="yes-display-inline">The Secretary of Commerce shall take into consideration and, to the extent feasible, implement the recommendations of the National Academy of Sciences in the report entitled <quote>Review of the Marine Recreational Information Program (2017)</quote>, and shall submit, every 2 years following the date of enactment of this Act, a report to the appropriate committees of Congress detailing progress made implementing those recommendations. Recommendations considered shall include—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id84a4d2b13f9b418eb8b63dd14175fcc3"><enum>(1)</enum><text display-inline="yes-display-inline">prioritizing the evaluation of electronic data collection, including smartphone applications, electronic diaries for prospective data collection, and an internet website option for panel members or for the public;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4bbf1c732b5a4d1a9fb9f5edb38c0fa6"><enum>(2)</enum><text display-inline="yes-display-inline">evaluating whether the design of the Marine Recreational Information Program for the purposes of stock assessment and the determination of stock management reference points is compatible with the needs of in-season management of annual catch limits; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04bf5717406b43f2ba383bdcb1fac5f3"><enum>(3)</enum><text display-inline="yes-display-inline">if the Marine Recreational Information Program is incompatible with the needs of in-season management of annual catch limits, determining an alternative method for in-season management.</text>
 </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idef570239d08a40849d52c0841b63375b" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Recreational data collection</header><text display-inline="no-display-inline">Section 401 (<external-xref legal-doc="usc" parsable-cite="usc/16/1881">16 U.S.C. 1881</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id6D57BAAF1F85445BB109B858DF26E15F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (g)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8fc0ceb9a731498a83f8758112831af2"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph (5); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id67b3691e8676419388c9855df3676ed5"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idd3585479ca4843208adf563e6d244285" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="id1074a1533de44db4b58aebc4d010e068"><enum>(4)</enum><header display-inline="yes-display-inline">Federal-State partnerships</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id97cb76c2cb044cbba094f16c40e01cd3"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a partnership with a State to develop best practices for implementing the State program established under paragraph (2).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida4c39904a43f4939b2384607d81ec210"><enum>(B)</enum><header display-inline="yes-display-inline">Guidance</header><text display-inline="yes-display-inline">The Secretary shall develop guidance, in cooperation with the States, that details best practices for administering State programs pursuant to paragraph (2), and provide such guidance to the States.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id244dfbe2fd0d45d8bababaa61f52e1b0"><enum>(C)</enum><header display-inline="yes-display-inline">Biennial report</header><text display-inline="yes-display-inline">The Secretary shall submit to the appropriate committees of Congress and publish biennial reports that include—</text>
 <clause commented="no" display-inline="no-display-inline" id="id4426dacb53e24a2fb6ced585efa52060"><enum>(i)</enum><text display-inline="yes-display-inline">the estimated accuracy of—</text> <subclause commented="no" display-inline="no-display-inline" id="id0132630f6da845ecb55434bf52373a8c"><enum>(I)</enum><text display-inline="yes-display-inline">the information provided under subparagraphs (A) and (B) of paragraph (1) for each registry program established under that paragraph; and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id0c602e1c511e4abb8e70541bc6ecd288"><enum>(II)</enum><text display-inline="yes-display-inline">the information from each State program that is used to assist in completing surveys or evaluating effects of conservation and management measures under paragraph (2);</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="id45d2317014034007ba37429b46a4c121"><enum>(ii)</enum><text display-inline="yes-display-inline">priorities for improving recreational fishing data collection; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="idd1681b74f8d54a03a85010daf4a5439c"><enum>(iii)</enum><text display-inline="yes-display-inline">an explanation of any use of information collected by such State programs and by the Secretary.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida69de4dcfc95447eb0b9498467a0e682"><enum>(D)</enum><header display-inline="yes-display-inline">States grant program</header>
 <clause commented="no" display-inline="no-display-inline" id="id5049C4EA5B2345C3832ACA13C362C27E"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may make grants to States to—</text> <subclause commented="no" display-inline="no-display-inline" id="idE37E9D4517954391A8B3365D892BC226"><enum>(I)</enum><text display-inline="yes-display-inline">improve implementation of State programs consistent with this subsection; and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id4DB9F495A187402FBA93CF287A5E5AA3"><enum>(II)</enum><text display-inline="yes-display-inline">assist such programs in complying with requirements related to changes in recreational data collection under paragraph (3).</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="idD50E60DBAA874800B69316900C990D6E"><enum>(ii)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">Any funds awarded through such grants shall be used to support data collection, quality assurance, and outreach to entities submitting such data. The Secretary shall prioritize such grants based on the ability of the grant to improve the quality and accuracy of such programs.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAAA1C2084AD3446BBD39A191843B985B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idB59B44A19CC1495599FBC143296681C6" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="idefba90c1342747d4ab827652f56bbd1b"><enum>(h)</enum><header display-inline="yes-display-inline">Action by Secretary</header><text display-inline="yes-display-inline">The Secretary shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id11319181c13c449bb2fe56476e4f3fa5"><enum>(1)</enum><text display-inline="yes-display-inline">within 90 days after the date of the enactment of the <short-title>Modernizing Recreational Fisheries Management Act of 2018</short-title>, enter into an agreement with the National Academy of Sciences to evaluate, in the form of a report—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id60f10c0155284d3eae604584095883c0"><enum>(A)</enum><text display-inline="yes-display-inline">how the design of the Marine Recreational Information Program, for the purposes of stock assessment and the determination of stock management reference points, can be improved to better meet the needs of in-season management of annual catch limits under section 303(a)(15); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9a49051c56d6470da07fb5a3f62ae046"><enum>(B)</enum><text display-inline="yes-display-inline">what actions the Secretary, Councils, and States could take to improve the accuracy and timeliness of data collection and analysis to improve the Marine Recreational Information Program and facilitate in-season management; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddaa47970a7324032a9468283033c1405"><enum>(2)</enum><text display-inline="yes-display-inline">within 6 months after receiving the report under paragraph (1), submit to Congress recommendations regarding—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idd26fa77936134867a8c3c6513ab7b146"><enum>(A)</enum><text display-inline="yes-display-inline">changes to be made to the Marine Recreational Information Program to make the program better meet the needs of in-season management of annual catch limits and other requirements under such section; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ae5db7d7afe49ecb371542a1935d0bc"><enum>(B)</enum><text display-inline="yes-display-inline">alternative management approaches that could be applied to recreational fisheries for which the Marine Recreational Information Program is not meeting the needs of in-season management of annual catch limits, consistent with other requirements of this Act, until such time as the changes in subparagraph (A) are implemented.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title commented="no" id="id0751639F74CB474E96FDB98FC3738559" level-type="subsequent" style="OLC"><enum>III</enum><header display-inline="yes-display-inline">Rule of construction</header>
 <section commented="no" display-inline="no-display-inline" id="id204B33B098AF454B896EE06E1FAAF86F" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed as modifying the requirements of sections 301(a), 302(h)(6), 303(a)(15), or 304(e) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851(a)</external-xref>, 1852(h)(6), 1853(a)(15), and 1854(e)), or the equal application of such requirements and other standards and requirements under the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801</external-xref> et seq.) to commercial, charter, and recreational fisheries, including each component of mixed-use fisheries.</text></section></title></legis-body><attestation><attestation-group><attestation-date chamber="Senate" date="20181217">Passed the Senate December 17, 2018.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
