		<official-title>To preserve State, local, and tribal authorities and private property rights with respect to
			 unmanned aircraft systems, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drone Federalism Act of 2017</short-title></quote>.</text>
		</section><section id="id86fde39d81b141c99b4a6e39f9617d90"><enum>2.</enum><header>Preservation of State, local, and tribal authorities with respect to unmanned aircraft systems</header>
 <subsection id="id8e00b797eb4f43b3b40760f86bcc14bd"><enum>(a)</enum><header>Scope of preemption for civil unmanned aircraft regulations</header><text>In prescribing regulations or standards related to civil unmanned aircraft systems, the Administrator shall—</text>
 <paragraph id="idE7254713EE8F427FBF0CD22F47B5042A"><enum>(1)</enum><text>define the scope of the preemptive effect of such regulations or standards pursuant to section 40103 or 41713 of title 49, United States Code, which shall be limited to the extent necessary to ensure the safety and efficiency of the national airspace system for interstate commerce; and</text>
 </paragraph><paragraph id="idc2693204f7654aff8ebff037537335c7"><enum>(2)</enum><text>preserve, to the greatest extent practicable, legitimate interests of State, local, and tribal governments, including—</text>
 <subparagraph id="idb45afb65eb4344b692b0f32b744544e1"><enum>(A)</enum><text>protecting public safety;</text> </subparagraph><subparagraph id="idca52870aa9bf4bd999f8cd2cbcfe6999"><enum>(B)</enum><text>protecting personal privacy;</text>
 </subparagraph><subparagraph id="id660f66ea401c4d95a94bfeaa6bc5864b"><enum>(C)</enum><text>protecting property rights;</text> </subparagraph><subparagraph id="idf7d7abcfa50e4dea839b3731922c380e"><enum>(D)</enum><text>managing land use; and</text>
 </subparagraph><subparagraph id="id8c45435095264e748b8e96a4a6e78320"><enum>(E)</enum><text>restricting nuisances and noise pollution.</text> </subparagraph></paragraph></subsection><subsection id="id4a48977c7c9a43bab7e368e2c464a6e3"><enum>(b)</enum><header>Reserved powers</header> <paragraph id="id8aff394b15974377985323eac20ce83e"><enum>(1)</enum><header>In general</header><text>In prescribing regulations or standards related to civil unmanned aircraft systems, the Administrator shall ensure that the authority of a State, local, or tribal government to issue reasonable restrictions on the time, manner, and place of operation of a civil unmanned aircraft system that is operated below 200 feet above ground level or within 200 feet of a structure is not preempted.</text>
 </paragraph><paragraph id="idac2b70007b2748a2a364d273b3cc6531"><enum>(2)</enum><header>Reasonable restrictions</header><text>For purposes of paragraph (1), reasonable restrictions on the time, manner, and place of operation of a civil unmanned aircraft system include the following:</text>
 <subparagraph id="id396b5ed4e61b4872a488dcbb6db9f72b"><enum>(A)</enum><text>Limitations on speed.</text> </subparagraph><subparagraph commented="no" id="idb7542b44e0964dd6bc93ac38b2c4fad2"><enum>(B)</enum><text>Prohibitions or limitations on operations in the vicinity of schools, parks, roadways, bridges, or other public or private property.</text>
 </subparagraph><subparagraph id="id129764a96149491f859ebd40efd1e53a"><enum>(C)</enum><text>Restrictions on operations at certain times of the day or week or on specific occasions such as during parades or sporting events.</text>
 </subparagraph><subparagraph id="id0a515ff10a304863b57d0d9930081e76"><enum>(D)</enum><text>Prohibitions on operations while the operator is under the influence of drugs or alcohol.</text> </subparagraph><subparagraph id="id3974bb6ef48c49ab811b2780ea3907db"><enum>(E)</enum><text>Prohibitions on careless or reckless operations.</text>
 </subparagraph><subparagraph id="id3183083a05334f5ea466f68fa4728faf"><enum>(F)</enum><text>Other prohibitions that protect public safety, personal privacy, or property rights, or that manage land use or restrict noise pollution.</text>
					</subparagraph></paragraph></subsection></section><section id="id8ac4921f2ac04de49495697644d96d6d"><enum>3.</enum><header>Preservation of private property rights</header>
			<subsection id="id073f53826f9f41e2ba31a4085e2d28c6"><enum>(a)</enum><header>Affirmation of applicability of constitutional takings clause to Federal Aviation Administration
 regulations</header><text>In prescribing regulations or standards related to civil unmanned aircraft systems, the Administrator shall not authorize the operation of a civil unmanned aircraft in the immediate reaches of the airspace above property without permission of the property owner.</text>
			</subsection><subsection id="id2171d7cb38e74ffb912496bead39a687"><enum>(b)</enum><header>Affirmation of applicability of constitutional takings clause absent Federal Aviation
 Administration regulations</header><text>Section 336(a) of the FAA Modernization and Reform Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/95">Public Law 112–95</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended—</text>
 <paragraph id="id91139F0FDCCF4791A1043179010AA1E2"><enum>(1)</enum><text>in paragraph (4), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph id="idE54D01194CD0402B89E2832C89C2389C"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id7E4A4036B5C34A869B315982C9E1A2B3"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idba0bb87a422849e7b37392fcd68bcc3c" style="OLC">
 <paragraph id="idb8157c40943c4d96970714143f0393ef"><enum>(6)</enum><text>when flown in the immediate reaches of the airspace above property (as defined in section 3(c) of the <short-title>Drone Federalism Act of 2017</short-title>), the operator has the permission of the property owner.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id3154a3ef5f8d4090b322829772517e64"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>immediate reaches of the airspace above property</term>, with respect to the operation of a civil unmanned aircraft system, includes—</text> <paragraph id="id1c7ed1b2d5914a4087ca73a4ca2ed320"><enum>(1)</enum><text>any area within 200 feet above the ground level of the property;</text>
 </paragraph><paragraph id="idd9953946ec4d466e9d22731fcfab1c89"><enum>(2)</enum><text>any area within 200 feet above any structure on the property; and</text> </paragraph><paragraph id="id9d819a86b23b48c789465e80340321fb"><enum>(3)</enum><text>any area where operation of the aircraft system could interfere with the enjoyment or use of the property.</text>
				</paragraph></subsection></section><section id="ideeb86a1644184ae7ac60ab37275a76de"><enum>4.</enum><header>Pilot program on Federal partnerships</header>
 <subsection id="id4da84fdcc246475c982643b06aabe565"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Administrator shall enter into agreements with not more than 10 State, local, or tribal governments to establish pilot programs under which—</text>
 <paragraph id="id2933017f71df42cd9dbf3e4d5d851fac"><enum>(1)</enum><text>the Administrator shall provide technical assistance to such governments in regulating the operation of civil unmanned aircraft systems, including through the use of the latest available technologies; and</text>
 </paragraph><paragraph id="idb61fa7837b874ea999ec6380c6f1cf85"><enum>(2)</enum><text>the Administrator and such governments shall coordinate efforts with respect to the enforcement of regulations relating to the operation of civil unmanned aircraft systems.</text>
 </paragraph></subsection><subsection id="id5e81d6e532c142b3bb32da061f90b091"><enum>(b)</enum><header>Selection</header><text>In selecting among State, local, and tribal governments for purposes of establishing pilot programs under subsection (a), the Administrator shall seek to enter into agreements with—</text>
 <paragraph id="idE3B893C710FE4E888E2AE41558612EF0"><enum>(1)</enum><text>governments that vary in their size and intended approach to regulation of civil unmanned aircraft systems; and</text>
 </paragraph><paragraph id="id0E3C1E8680BE4B5CA09568E67ECD9436"><enum>(2)</enum><text>not less than one State government, not less than one county government, not less than one city government, and not less than one tribal government.</text>
 </paragraph></subsection><subsection id="id6f8d15b2522d4e54a19f9480b9bbac4a"><enum>(c)</enum><header>Unmanned aircraft systems traffic management system</header><text>The Administrator shall coordinate with Administrator of the National Aeronautics and Space Administration to ensure that participants in pilot programs established under subsection (a) are consulted in the development of the unmanned aircraft systems traffic management system under subsection (a) section 2208 of the FAA Extension, Safety, and Security Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/190">Public Law 114–190</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) and the pilot program under subsection (b) of that section.</text>
 </subsection><subsection id="ide3e5294476a84433b253825d037f1724"><enum>(d)</enum><header>Report required</header><text>Not later than 2 years after establishing the pilot programs required by subsection (a), the Administrator shall submit to Congress, and make available to the public, a report identifying best practices for State, local, and tribal governments to regulate the operation of civil unmanned aircraft systems and to collaborate with the Federal Aviation Administration with respect to the regulation of such systems.</text>
 </subsection></section><section id="id04a9c23e99d74698809c0cb9530f9eec"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed—</text> <paragraph id="id34CA3108E4D84791ABAF7935C4F01EEE"><enum>(1)</enum><text display-inline="yes-display-inline">to diminish or expand the preemptive effect of the authority of the Federal Aviation Administration with respect to manned aviation; or</text>
 </paragraph><paragraph id="id447ce25a728d4db4a288d38d3692d662"><enum>(2)</enum><text>to affect the civil or criminal jurisdiction of—</text> <subparagraph id="idd80ec66359284c5eaff6a56d8f3e0663"><enum>(A)</enum><text>any Indian tribe relative to any State or local government; or</text>
 </subparagraph><subparagraph id="id803f8ada650149ba86c0ee46c48f7fcc"><enum>(B)</enum><text>any State or local government relative to any Indian tribe.</text> </subparagraph></paragraph></section><section id="id7824fcc571a64e66883345a17c5b58b8"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="id8bd139d1227041eda3718d31d5df5386"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Aviation Administration.</text> </paragraph><paragraph id="idcec71bc12884408baabd29a62ba59694"><enum>(2)</enum><header>Civil</header><text>The term <term>civil</term>, with respect to an unmanned aircraft system, means that the unmanned aircraft is not a public aircraft (as defined in section 40102 of title 49, United States Code).</text>
 </paragraph><paragraph id="id072FC511868A466D90B703B8BDDEBA51"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text>
 </paragraph><paragraph commented="no" id="id54ADE3F74796491A8242A472A674C59F"><enum>(4)</enum><header>Local government</header><text>The term <term>local</term>, with respect to a government, means the government of a subdivision of a State.</text> </paragraph><paragraph commented="no" id="idFF45DC7CD1414CA6BC25F7B40D18F37F"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and the territories and possessions of the United States.</text>
 </paragraph><paragraph commented="no" id="id93C022A0C5BF443D863ACFE5C4131E13"><enum>(6)</enum><header>Tribal government</header><text>The term <term>tribal</term>, with respect to a government, means the governing body of an Indian tribe.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5CECBCDC476E4C75960DB7AE0A653DC0"><enum>(7)</enum><header>Unmanned aircraft; unmanned aircraft system</header><text>The terms <term>unmanned aircraft</term> and <term>unmanned aircraft system</term> have the meanings given those terms in section 331 of the FAA Modernization and Reform Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/95">Public Law 112–95</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note).</text></paragraph></section></legis-body>
