 <section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Agency Customer Experience Act of 2017</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="id4BFF1805584E4DC79C38443965D10240" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings; sense of Congress</header> <subsection commented="no" display-inline="no-display-inline" id="ide2cf5ea878bf42108eca2be12a70724c"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idbc1101b2e952464ebe9c54522b8fc0e8"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal Government serves the people of the United States and should seek to continually improve public services provided by the Federal Government based on customer feedback;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf18094d4538242e08069d9f9b4247ae1"><enum>(2)</enum><text display-inline="yes-display-inline">the people of the United States deserve a Federal Government that provides efficient, effective, and high-quality services across multiple channels;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7071693e97c748fa89ad57b43af57e13"><enum>(3)</enum><text display-inline="yes-display-inline">many agencies, offices, programs, and Federal employees provide excellent service to individuals, however many parts of the Federal Government still fall short on delivering the customer service experience that individuals have come to expect from the private sector;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97fdb53e5a4b4bfcaa32844bab7da632"><enum>(4)</enum><text display-inline="yes-display-inline">according to the 2016 American Customer Satisfaction Index, the Federal Government ranks among the bottom of all industries in the United States in customer satisfaction;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69b9a73ff825447ea68a1beed980f3f0"><enum>(5)</enum><text display-inline="yes-display-inline">providing quality services to individuals improves the confidence of the people of the United States in their government and helps agencies achieve greater impact and fulfill their missions; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69cd0c4554534a898233bf18aa569925"><enum>(6)</enum><text display-inline="yes-display-inline">improving service to individuals requires agencies to work across organizational boundaries, leverage technology, collect and share standardized data, and develop customer-centered mindsets and service strategies.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide83cc38374fd41e5bcffacd642b44aae"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that all agencies should strive to provide high-quality, courteous, effective, and efficient services to the people of the United States and seek to measure, collect, report, and utilize metrics relating to the experience of individuals interacting with agencies to continually improve services to the people of the United States.</text>
 </subsection></section><section commented="no" display-inline="no-display-inline" id="idC97BC8CF2CC748C0B709C40A19557576" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="id9FCF99BF9C0549A6A0BDB2EA2F64280D"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of General Services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57F6F3F501DB4F5DA17EB97C54702C25"><enum>(2)</enum><header display-inline="yes-display-inline">Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given the term in section 3502 of title 44, United States Code.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5F026355EF3444C9B315BF47CE46009B"><enum>(3)</enum><header display-inline="yes-display-inline">Covered agency</header><text display-inline="yes-display-inline">The term <term>covered agency</term> means an agency or component of an agency that is required by the Director to collect voluntary feedback for purposes of section 6, based on an assessment of the components and programs of the agency with the highest impact on or number of interactions with individuals or entities.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD6276D93BD024EB3883460959F937844"><enum>(4)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Management and Budget.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0070A92CB6174DF095AEE108914266E7"><enum>(5)</enum><header display-inline="yes-display-inline">Voluntary feedback</header><text display-inline="yes-display-inline">The term <term>voluntary feedback</term> has the meaning given the term in section 3502 of title 44, United States Code, as added by section 4 of this Act.</text>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="id4CAD2301001F4E468018C49F10E8A5E6" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Application of the Paperwork Reduction Act to collection of voluntary feedback</header><text display-inline="no-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>), is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id7CB9BFE4D6B549458EBB6C189620F14C"><enum>(1)</enum><text display-inline="yes-display-inline">in section 3502—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id874AC66BF171431F8CAD2A5177C04DE0"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (13)(D), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45128920B7E345CF8DFA4A3715B4D5A6"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63490FE1A21C46289539334CA03E72A3"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id09C04E1F53C84308B39C5026AC1E2373" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="id68874E96883D432882D00327FA09B74E"><enum>(15)</enum><text display-inline="yes-display-inline">the term <term>voluntary feedback</term> means any submission of information, opinion, or concern that is—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idC6201BB58A54496C8EA69F31DB81A7A8"><enum>(A)</enum><text display-inline="yes-display-inline">voluntarily made by a specific individual or other entity relating to a particular service of or transaction with an agency; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDF07926A19914D5591BE319F4B208CE3"><enum>(B)</enum><text display-inline="yes-display-inline">specifically solicited by that agency.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE71A6D0E42354E6B826264933892DB18"><enum>(2)</enum><text display-inline="yes-display-inline">in section 3518(c)(1)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id6E7BE97AE1D04DECB2E55EC23CF4FBB9"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>or</quote> at the end;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB1360A00A5BF40658C606380778062F1"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC1A061A1117042918E7C8E97BB29F0FC"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id700F6117E9974213A57C415D1F340BFD" style="OLC"> <subparagraph commented="no" display-inline="no-display-inline" id="id4EF948DA01B84777ABB9A699A7E9889D" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">by an agency that is voluntary feedback.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id094fb968c8754b45a0184a3930a90f52" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Guidelines for voluntary feedback</header><text display-inline="no-display-inline">Each agency that solicits voluntary feedback shall ensure that—</text> <paragraph commented="no" display-inline="no-display-inline" id="id3edca45ae4ea42e5a7ef5af6659b41af"><enum>(1)</enum><text display-inline="yes-display-inline">responses to the solicitation of voluntary feedback remain anonymous and shall not be traced to specific individuals or entities;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58031478d3ad4146b0d277cf620ef223"><enum>(2)</enum><text display-inline="yes-display-inline">individuals and entities who decline to participate in the solicitation of voluntary feedback shall not be treated differently by the agency for purposes of providing services or information;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0bae4c8e3e814d30a5b013229a3abe6d"><enum>(3)</enum><text display-inline="yes-display-inline">the solicitation does not include more than 10 questions;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide411bc2a67534675b663078562482299"><enum>(4)</enum><text display-inline="yes-display-inline">the voluntary nature of the solicitation is clear;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56dc13f1342846febf1c6abf742d4e52"><enum>(5)</enum><text display-inline="yes-display-inline">the proposed solicitation of voluntary feedback will contribute to improved customer service;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06a5d0e925c645858e42afeba66d339a"><enum>(6)</enum><text display-inline="yes-display-inline">solicitations of voluntary feedback are limited to 1 solicitation per interaction with an individual or entity;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4de28f0bf06d418fa126c50dfa9c1336"><enum>(7)</enum><text display-inline="yes-display-inline">to the extent practicable, the solicitation of voluntary feedback is made at the point of service with an individual or entity;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d4a5980795e4dc0ae11c7b77311c859"><enum>(8)</enum><text display-inline="yes-display-inline">instruments for collecting voluntary feedback are accessible to individuals with disabilities in accordance with section 508 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d</external-xref>); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ab57b5fde4240afb72ed8b9cdf8b803"><enum>(9)</enum><text display-inline="yes-display-inline">internal agency data governance policies remain in effect with respect to the collection of voluntary feedback from individuals and entities.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id8F3B249FA1074ED98A54379221E5F426" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Customer experience data collection</header>
 <subsection commented="no" display-inline="no-display-inline" id="id9D1EFD6D143D462A993F92D5C51513CB"><enum>(a)</enum><header display-inline="yes-display-inline">Collection of responses</header><text display-inline="yes-display-inline">The head of each covered agency (or a designee), assisted by and in coordination with the Performance Improvement Officer or other senior accountable official for customer service of the covered agency, shall collect voluntary feedback with respect to services of or transactions with the covered agency.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idffd3255c84b949f69dedb25aae09f4c7"><enum>(b)</enum><header display-inline="yes-display-inline">Content of questions</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id1B10237AEFD94A6895ACC12FD7CB6001"><enum>(1)</enum><header display-inline="yes-display-inline">Standardized questions</header><text display-inline="yes-display-inline">The Director, in coordination with the Administrator, shall develop a set of standardized questions for use by covered agencies in collecting voluntary feedback under this section that address—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="iddcfb70bf03a346b2b13fba43e524a0ca"><enum>(A)</enum><text display-inline="yes-display-inline">overall satisfaction of individuals or entities with the specific interaction or service received;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35d8b98c523c4295b8cb1fb1e54bd0bb"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which individuals or entities were able to accomplish their intended task or purpose;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39edaff08de64633b51c9e6f72ac4710"><enum>(C)</enum><text display-inline="yes-display-inline">whether the individual or entity was treated with respect and professionalism;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8acd12414f94461b822891abce978070"><enum>(D)</enum><text display-inline="yes-display-inline">whether the individual or entity believes they were served in a timely manner; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc9a69be7961d4a0fab5b3def96b97fff"><enum>(E)</enum><text display-inline="yes-display-inline">any additional metrics as determined by the Director, in coordination with the Administrator.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3f1651b545954857baec80d7f26d0965"><enum>(2)</enum><header display-inline="yes-display-inline">Additional questions</header><text display-inline="yes-display-inline">In addition to the questions developed under paragraph (1), the Performance Improvement Officer or other senior accountable official for customer service at a covered agency may develop questions relevant to the specific operations or programs of the covered agency.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb3a3d69e21ac43929bf66dee9e5233f7"><enum>(c)</enum><header display-inline="yes-display-inline">Additional requirements</header><text display-inline="yes-display-inline">To the extent practicable—</text> <paragraph commented="no" display-inline="no-display-inline" id="id27D20848AD004A7A9D9D51430523761A"><enum>(1)</enum><text display-inline="yes-display-inline">each covered agency shall collect voluntary feedback across all platforms or channels through which the covered agency interacts with individuals or other entities to deliver information or services; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF46929488BD54CD293F95FB9C83BE1E1"><enum>(2)</enum><text display-inline="yes-display-inline">voluntary feedback collected under this section shall be tied to specific transactions or interactions with customers of the covered agency.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCCADC0C0AF4F4BE3B6DCA2CD9AADE7F3"><enum>(d)</enum><header display-inline="yes-display-inline">Reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id58FF988A30114799B8BC55B10F6D7F03"><enum>(1)</enum><header display-inline="yes-display-inline">Annual report to the Director</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id50A09068077343C0ABC98D0A323333F8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and not less frequently than annually thereafter, each covered agency shall publish on the website of the covered agency and submit to the Director, in a manner determined by the Director, a report that includes the voluntary feedback required to be collected under this section.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4FAFF8F45B514C1A92CB72B291B95B10"><enum>(B)</enum><header display-inline="yes-display-inline">Centralized website</header><text display-inline="yes-display-inline">The Director shall—</text> <clause commented="no" display-inline="no-display-inline" id="id9D2436073B88442484237B22135566C8"><enum>(i)</enum><text display-inline="yes-display-inline">include and maintain on a publicly available website links to the information provided on the websites of covered agencies under subparagraph (A); and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id48450CCAD2AA45AFA6E527F8E94668C6"><enum>(ii)</enum><text display-inline="yes-display-inline">for purposes of clause (i), establish a website or make use of an existing website, such as the website required under section 1122 of title 31, United States Code.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id386D424D641E4341980D35602E2862C6"><enum>(2)</enum><header display-inline="yes-display-inline">Aggregated report</header><text display-inline="yes-display-inline">Each covered agency shall publish, on a regular basis, an aggregated report on the solicitation of voluntary feedback sent to individuals or entities, which shall include—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idC32EBEF447CF418B8F9946A3334ACDEB"><enum>(A)</enum><text display-inline="yes-display-inline">the intended purpose of each solicitation of voluntary feedback conducted by the covered agency;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3EA157F5493749C1B7CC9F562721AF14"><enum>(B)</enum><text display-inline="yes-display-inline">the appropriate point of contact within each covered agency for each solicitation of voluntary feedback conducted;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7B63F6B4257F46A4AF1F8D30445A2B8F"><enum>(C)</enum><text display-inline="yes-display-inline">the questions or survey instrument submitted to members of the public as part of the solicitation of voluntary information; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9A9F812E761141C6A8429A556372A4A8"><enum>(D)</enum><text display-inline="yes-display-inline">a description of how the covered agency uses the voluntary feedback received by the covered agency to improve the customer service of the covered agency.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id36da1125ecd1446abe40ffd7b762f405" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Customer experience scorecard report</header>
 <subsection commented="no" display-inline="no-display-inline" id="idB4AC71A2ED0E42088B33DCD3B7F8F0C6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 15 months after the date on which all covered agencies have submitted the first annual reports to the Director required under section 6(d)(1), and every 2 years thereafter until the date that is 10 years after such date, the Comptroller General of the United States shall make publicly available and submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a scorecard report assessing the data collected and reported by the covered agencies.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id235f9170a9db48e8b74bac20660cd358"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report required under subsection (a) shall include—</text> <paragraph commented="no" display-inline="no-display-inline" id="idF63314BBD2E9447889704455DE37781B"><enum>(1)</enum><text display-inline="yes-display-inline">a summary of the information required to be published by covered agencies under section 6(d); and</text>
 <pagebreak></pagebreak></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8608AD3B5B842DF8BB166BED59D6CD0"><enum>(2)</enum><text display-inline="yes-display-inline">a description of how each covered agency will use the voluntary feedback received by the covered agency to improve service delivery.</text>
