			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize disaster recovery assistance for areas affected by wildfires on Federal Lands, and for
			 other purposes.</official-title></form>
	<legis-body id="HA8C58E36AA50488BA653789D64093C4B" style="OLC">
 <section id="H0326A76F356C448397A60B05690BDA30" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Lands Fire-Related Incidents Recovery and Economic Stimulus Act of 2018</short-title></quote> or the <quote><short-title>Federal Lands FIRES Act of 2018</short-title></quote>.</text> </section><section id="H4900039F8C3D4CB992BC4D9F5C1B469C"><enum>2.</enum><header>Federal lands wildfire disaster declaration</header> <subsection id="HB20EC4B9DDD44E3F8D4D8F07F25422C8"><enum>(a)</enum><header>Eligible wildfires</header><text display-inline="yes-display-inline">The President may declare a Federal lands wildfire disaster under this section for any wildfire—</text>
 <paragraph id="H79A7F49B7A1E49DAA9270E5F5EB349E5"><enum>(1)</enum><text display-inline="yes-display-inline">for which a request for a declaration under this section has been made pursuant to subsection (b);</text> </paragraph><paragraph id="HB4C64F9A93424D62AA6BACCCB6A697F8"><enum>(2)</enum><text>that has burned an area 40 percent or more of which consists of Federal lands; and</text>
 </paragraph><paragraph id="H5D7EC0B5F7D643499B8359F76E5F47A8"><enum>(3)</enum><text>that in the determination of the President causes damage of sufficient severity and magnitude to warrant assistance under this Act to supplement the efforts and available resources of States, local governments, Indian tribes, and disaster relief organizations in alleviating the damage, loss, hardship, or suffering caused thereby.</text>
				</paragraph><continuation-text continuation-text-level="subsection">In making such a declaration, the President shall specify the area for which assistance under
			 section 3 may be provided for secondary and tertiary damages described in
			 section 3(d)(1)(B), which may include only areas included in the request
			 for the declaration pursuant to subsection (b)(3) of this section.</continuation-text></subsection><subsection id="H88C18E815DFD41D99133654A509B0E9B"><enum>(b)</enum><header>Request for declaration</header>
 <paragraph id="H8AC24219CF264C069D2CD4FDF6CD2DCB"><enum>(1)</enum><header>Making</header><text display-inline="yes-display-inline">A request for a declaration of a Federal lands wildfire disaster may be made by—</text> <subparagraph id="H20EF14490CAC4E7C8E89B117C2A08FD3"><enum>(A)</enum><text>the Governor of a State affected by a wildfire; or</text>
 </subparagraph><subparagraph id="H16F3E67FDCC54D70B9F000A3B217D088"><enum>(B)</enum><text display-inline="yes-display-inline">the Chief Executive of an Indian tribal government affected by a wildfire.</text> </subparagraph></paragraph><paragraph id="H45F0323EE8EC41B38D914557FEDBAF4A"><enum>(2)</enum><header>Basis</header><text display-inline="yes-display-inline">A request for a declaration of a Federal lands wildfire disaster shall be based on a finding that the wildfire is of such severity and magnitude that effective response is beyond the capabilities of the State and the affected local governments and that Federal assistance is necessary. As part of such request, and as a prerequisite to assistance under this Act, the Governor or Chief Executive of the Indian tribal government making the request shall take appropriate response action under State or tribal law and direct execution of the State’s or tribe’s emergency plan. The Governor or Chief Executive shall furnish to the President and the Secretary of Housing and Urban Development information on the nature and amount of State, local, and tribal resources which have been or will be committed to alleviating the results of the wildfire, and shall certify that, for the current wildfire, State, local, or tribal government obligations and expenditures, as applicable (of which State or tribal commitments shall be a significant proportion) will comply with all applicable cost-sharing requirements of this Act.</text>
 </paragraph><paragraph id="H6DD5D6384AEF457F91FC41ACBD17C3B0"><enum>(3)</enum><header>Area of secondary and tertiary damage</header><text display-inline="yes-display-inline">In making a request for a declaration under this section of a Federal lands wildfire disaster, the Governor or Chief Executive of an Indian tribal government shall include a designation of an area within which assistance under section 3 may be provided for secondary and tertiary damages described in section 3(d)(1)(B), which may not include any area more than 100 miles from the area directly subject to the wildfire involved.</text>
 </paragraph></subsection><subsection id="H4C94251D4D244EE08C0D57AB1E0301FD"><enum>(c)</enum><header>Savings provision</header><text display-inline="yes-display-inline">Nothing in this section may be construed to prohibit an Indian tribal government from receiving assistance under this Act through a declaration made by the President at the request under subsection (a) of a State if the President does not make a declaration for the tribal government for the same wildfire.</text>
			</subsection></section><section id="HA3D672911C384CC8B9DD223E9142EDC1"><enum>3.</enum><header>Disaster recovery assistance for Federal lands wildfire disasters</header>
 <subsection id="HF949FF452C8F4C0F8F95C0AF391A7EF1"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development (in this section referred to as the <quote>Secretary</quote>) may provide assistance under this section to States, units of general local government, and Indian tribes for necessary expenses for activities authorized under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> et seq.) related to disaster relief, long-term recovery, restoration of infrastructure and housing, and economic revitalization in the most impacted and distressed areas resulting from a Federal lands wildfire disaster declared pursuant to section 2 of this Act.</text>
 </subsection><subsection id="H541A3995DF9A4C56884310A0985B9000"><enum>(b)</enum><header>Direct award of assistance</header><text>Funds for assistance under this section shall be awarded directly to the State, unit of general local government, or Indian tribe at the discretion of the Secretary.</text>
 </subsection><subsection id="H03315CB505AE4371A6F811322B42B3FB"><enum>(c)</enum><header>Plan for use</header><text>Prior to the obligation of funds a grantee shall submit a plan to the Secretary for approval detailing the proposed use of all funds, including criteria for eligibility and how the use of such funds will address long-term recovery and restoration of infrastructure and housing and economic revitalization in the most impacted and distressed areas.</text>
			</subsection><subsection id="H37A4CC7CC26A4E9F9056EA9B9F22248C"><enum>(d)</enum><header>Eligible use</header>
 <paragraph id="H80E6574216564E198A605C9F2367BBCD"><enum>(1)</enum><header>Qualifying business</header><text display-inline="yes-display-inline">Businesses eligible for assistance under this section shall include—</text> <subparagraph id="H85B6F282648447E2B0A152ECE2FD9D21"><enum>(A)</enum><text>businesses operating on federally owned property, including camps, resorts, and recreational businesses; and</text>
 </subparagraph><subparagraph id="HE38D7D1B320540FFB7F0A7FAE635B3D0"><enum>(B)</enum><text>businesses impacted by the secondary and tertiary damage in connection with the wildfire for which the Federal lands wildfire disaster was declared, including mudslides, rockslides, falling trees, and other events causing damage that is not directly caused by fire.</text>
 </subparagraph></paragraph><paragraph id="HF6A01C7E005045FE801BFB34430C568F"><enum>(2)</enum><header>Limitation</header><text>Notwithstanding any other provision of this section, assistance under this section in connection with a Federal lands wildfire disaster may not be provided for any business that, during the last calendar year ending before the declaration of such disaster, had gross revenues exceeding $3,000,000.</text>
 </paragraph></subsection><subsection id="HE104FA97C7B74A42BC3D6C17CF008AC4"><enum>(e)</enum><header>Financial controls</header><text>As a condition of making any grant under this section, the Secretary shall certify in advance that such grantee has in place proficient financial controls and procurement processes and has established adequate procedures to prevent any duplication of benefits as defined by section 312 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5155">42 U.S.C. 5155</external-xref>), to ensure timely expenditure of funds, to maintain comprehensive websites regarding all disaster recovery activities assisted with such funds, and to detect and prevent waste, fraud, and abuse of funds.</text>
 </subsection><subsection id="H6F52301C1B9E42319DB3C2DACA576748"><enum>(f)</enum><header>Prohibition</header><text>Funds provided under this section may not be used for activities reimbursable by, or for which funds are made available by, the Federal Emergency Management Agency or the Army Corps of Engineers.</text>
 </subsection><subsection id="H17614F9F0F9B4BD38736F05096ED75A8"><enum>(g)</enum><header>Treatment</header><text>Funds made available under this section shall not be considered relevant to the non-disaster formula allocations made pursuant to section 106 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306</external-xref>).</text>
 </subsection><subsection id="HDEC59B7CAE164813B796FB4F8D1E05BE"><enum>(h)</enum><header>Administrative costs</header><text>A State, unit of general local government, Indian tribe, or subdivision thereof may use up to 5 percent of amounts received under this section for administrative costs.</text>
			</subsection><subsection id="H32D1EED72C2D48E5ABD6FB9F54E7383B"><enum>(i)</enum><header>Waivers</header>
 <paragraph id="HCB7C68E8DA5941658E7556EDD564E1A7"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">In administering funds made available for assistance in accordance with this section, the Secretary may waive, or specify alternative requirements for, any provision of any statute or regulation that the Secretary administers in connection with the obligation by the Secretary or the use by the recipient of such funds (except for requirements related to fair housing, nondiscrimination, labor standards, and the environment), if the Secretary finds that good cause exists for the waiver or alternative requirement and such waiver or alternative requirement would not be inconsistent with the overall purpose of title I of the Housing and Community Development Act of 1974.</text>
 </paragraph><paragraph id="HECD0EBE96F4B43168FFB6660B77B97D0"><enum>(2)</enum><header>Notice</header><text display-inline="yes-display-inline">The Secretary shall publish via notice in the Federal Register any waiver, or alternative requirement, to any statute or regulation that the Secretary administers pursuant to title I of the Housing and Community Development Act of 1974 no later than 5 days before the effective date of such waiver or alternative requirement.</text>
 </paragraph></subsection><subsection id="H03EC281205B4410583A6C4561CC99FD8"><enum>(j)</enum><header>Exemption from environmental review requirements</header><text display-inline="yes-display-inline">An action that is taken or assistance that is provided pursuant to this section that has the effect of restoring a facility substantially to its condition prior to the Federal lands wildfire disaster that affected such facility shall not be deemed a major Federal action significantly affecting the quality of the human environment within the meaning of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
 </subsection><subsection id="HEEE1FC93EC934D7193F9D55023D94442"><enum>(k)</enum><header>Oversight costs</header><text>Of any amounts made available for assistance in accordance with this section, up to 0.1 percent may be transferred, in aggregate, to the Department of Housing and Urban Development account for Program Office Salaries and Expenses—Community Planning and Development for necessary costs, including information technology costs, of administering and overseeing the obligation and expenditure of amounts for assistance under this section.</text>
 </subsection><subsection id="HE0E5229A55464162AABE8058442F1311"><enum>(l)</enum><header>Reports</header><text>The Secretary shall require each State, unit of general local government, and Indian tribe for which assistance amounts under this section are provided to report annually during the 5-year period beginning upon the provision of such funds regarding the use of such funds and compliance with the plan for such use under subsection (c).</text>
 </subsection><subsection id="H9EF0510D989B4ABD87A1214E569547E8"><enum>(m)</enum><header>Recapture of unused funds</header><text display-inline="yes-display-inline">If any amounts made available for assistance under this section to a grantee in connection with a Federal lands wildfire disaster remain unexpended upon the expiration of the 5-year period beginning upon the Secretary obligating such amounts to the grantee, the Secretary shall recapture such unexpended amounts and transfer such amounts to the Secretary of the Treasury for deposit into the General Fund of the Treasury.</text>
 </subsection><subsection id="H84CC8737B6AD438F8987C32E049A26F6"><enum>(n)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to provide assistance under this section in connection with each Federal lands wildfire disaster declared under section 2.</text>
 </subsection></section><section id="HAD49212CCED243F68E5667E174D1AC96"><enum>4.</enum><header>Eligibility for SBA Economic Injury Disaster Loans</header><text display-inline="no-display-inline">Section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>) is amended—</text> <paragraph id="HFD2B39E2023844B1BA1DCFBFEFE31F93"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>or</quote> at the end;</text>
 </paragraph><paragraph id="HFEB6B3D591174DFBAA287E63AC662CE6"><enum>(2)</enum><text>by redesignating subparagraph (D) as subparagraph (E);</text> </paragraph><paragraph id="H583DE7160FF64E759DC28AE86308005B"><enum>(3)</enum><text>by inserting after subparagraph (C) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBF5990A814B340C8A8F475BC95A9563F" style="OLC">
 <subparagraph id="HDE30199D51BC4370915FEBF9C8CDD942"><enum>(D)</enum><text display-inline="yes-display-inline">a Federal lands wildfire disaster, as declared by the President under section 2 of the Federal Lands FIRES Act of 2018; or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H001F76BA439C4562ACB9D7350F4E8774"><enum>(4)</enum><text>in subparagraph (E), as so redesignated, by striking <quote>subparagraph (A), (B), or (C)</quote> and inserting <quote>subparagraph (A), (B), (C), or (D)</quote>.</text> </paragraph></section></legis-body></bill>
