 <section id="H8D2619FB19BB47C3AE13AA1E14917048" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dog and Cat Meat Trade Prohibition Act of 2018</short-title></quote>.</text> </section><section id="H71D526B9C0594A7C807122F1E418E608"><enum>2.</enum><header>Prohibition on slaughter of dogs and cats for human consumption</header> <subsection id="H5ADF8C31BF6E453C824AC06F54BDD423"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (c), no person may—</text>
 <paragraph id="HB0EA13F563B14943BFDBFE21498E68EB"><enum>(1)</enum><text>knowingly slaughter a dog or cat for human consumption; or</text> </paragraph><paragraph id="H9C48DF2D2BB6456E99644AB31261EBEB"><enum>(2)</enum><text>knowingly ship, transport, move, deliver, receive, possess, purchase, sell, or donate—</text>
 <subparagraph id="HCD0BC02D6C1D46D1B99468B985F38A5D"><enum>(A)</enum><text>a dog or cat to be slaughtered for human consumption; or</text> </subparagraph><subparagraph id="H737540AE618643249477DA9B326651E8"><enum>(B)</enum><text>a dog or cat part for human consumption.</text>
 </subparagraph></paragraph></subsection><subsection id="H6617B6C42B614EDFAE13F96F66111856"><enum>(b)</enum><header>Scope</header><text display-inline="yes-display-inline">Subsection (a) shall apply only with respect to conduct—</text> <paragraph id="HF132FB569A9A41D4B1745F2D26DCF9A8"><enum>(1)</enum><text>in interstate commerce or foreign commerce; or</text>
 </paragraph><paragraph id="H63F419C3D01F478E9C3A3D1DFB9E0137"><enum>(2)</enum><text>within the special maritime and territorial jurisdiction of the United States.</text> </paragraph></subsection><subsection id="H1427408761344DF99776265F73293BDA"><enum>(c)</enum><header>Exception for Indian Tribes</header><text>The prohibition in subsection (a) shall not apply to an Indian (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) carrying out any activity described in subsection (a) for the purpose of a religious ceremony.</text>
 </subsection><subsection id="H6902DACAC507405B904B091F73DD3AA3"><enum>(d)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be subject to a fine in an amount not greater than $5,000 for each violation.</text>
 </subsection><subsection id="HC0733D06C1E24777837D3611CAC74651"><enum>(e)</enum><header>Effect On State law</header><text>Nothing in this section—</text> <paragraph id="H17F82227A1C14AD197B4B58004590FD5"><enum>(1)</enum><text>limits any State or local law or regulation protecting the welfare of animals; or</text>
 </paragraph><paragraph id="HFE2F1AD13DFB4326BA9EC545FF65C5D6"><enum>(2)</enum><text>prevents a State or unit of local government from adopting and enforcing an animal welfare law or regulation that is more stringent than this section.</text>
