			 Bureau of Reclamation to manage its infrastructure assets.</official-title></form>

 <section commented="no" display-inline="no-display-inline" id="H261DAD6744A344EE95AF94684F9C45FD" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bureau of Reclamation Transparency Act</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="HD63963311C92464491FAD76D4FC4FE3C" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HDCCCFFA8EC8A42849D979E9CC79968C2"><enum>(1)</enum><text display-inline="yes-display-inline">the water resources infrastructure of the Bureau of Reclamation provides important benefits related to irrigated agriculture, municipal and industrial water, hydropower, flood control, fish and wildlife, and recreation in the 17 Reclamation States;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H025448257A6C498991140ADB5D9F6A88"><enum>(2)</enum><text display-inline="yes-display-inline">as of 2013, the combined replacement value of the infrastructure assets of the Bureau of Reclamation was $94,500,000,000;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC94E885B147946E9A1B6D5F58502B479"><enum>(3)</enum><text display-inline="yes-display-inline">the majority of the water resources infrastructure facilities of the Bureau of Reclamation are at least 60 years old;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4B1FB0C09B134663A62699C85BDF0380"><enum>(4)</enum><text display-inline="yes-display-inline">the Bureau of Reclamation has previously undertaken efforts to better manage the assets of the Bureau of Reclamation, including an annual review of asset maintenance activities of the Bureau of Reclamation known as the <quote>Asset Management Plan</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H32170E6C8AE64631A86DAE225275E95B"><enum>(5)</enum><text display-inline="yes-display-inline">actionable information on infrastructure conditions at the asset level, including information on maintenance needs at individual assets due to aging infrastructure, is needed for Congress to conduct oversight of Reclamation facilities and meet the needs of the public.</text>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="HC128421E9BF141D3A3403D152C5931B3" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="H5526E5BC4BB045CF906729AA74B2A3DF"><enum>(1)</enum><header display-inline="yes-display-inline">Asset</header> <subparagraph commented="no" display-inline="no-display-inline" id="H5C5D0CD885434CF088C1FE282843102A"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>asset</term> means any of the following assets that are used to achieve the mission of the Bureau of Reclamation to manage, develop, and protect water and related resources in an environmentally and economically sound manner in the interest of the people of the United States:</text>
 <clause commented="no" display-inline="no-display-inline" id="HF2C71647C2B043568CC0CCE56D7D2982"><enum>(i)</enum><text display-inline="yes-display-inline">Capitalized facilities, buildings, structures, project features, power production equipment, recreation facilities, or quarters.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H911255F0C484449CAA45D6FA89DDAC8B"><enum>(ii)</enum><text display-inline="yes-display-inline">Capitalized and noncapitalized heavy equipment and other installed equipment.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7F1A966661A2449A960B170CD1A6A70F"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>asset</term> includes assets described in subparagraph (A) that are considered to be mission critical.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBC573D6188CE4DD8A9107B7463A530A6"><enum>(2)</enum><header display-inline="yes-display-inline">Asset Management Report</header><text display-inline="yes-display-inline">The term <term>Asset Management Report</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HB24426E3073843BA9CA94AFF730C7B4D"><enum>(A)</enum><text display-inline="yes-display-inline">the annual plan prepared by the Bureau of Reclamation known as the <quote>Asset Management Plan</quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD5C6B18F66C4F2E81DE445EA54B4741"><enum>(B)</enum><text display-inline="yes-display-inline">any publicly available information relating to the plan described in subparagraph (A) that summarizes the efforts of the Bureau of Reclamation to evaluate and manage infrastructure assets of the Bureau of Reclamation.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42B1B5223BED4A1794B4B12CD0F7D3FA"><enum>(3)</enum><header display-inline="yes-display-inline">Major repair and rehabilitation need</header><text display-inline="yes-display-inline">The term <term>major repair and rehabilitation need</term> means major nonrecurring maintenance at a Reclamation facility, including maintenance related to the safety of dams, extraordinary maintenance of dams, deferred major maintenance activities, and all other significant repairs and extraordinary maintenance.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA61B8AE6052849AAA8F4E1C99ED3E7C3"><enum>(4)</enum><header display-inline="yes-display-inline">Reclamation facility</header><text display-inline="yes-display-inline">The term <term>Reclamation facility</term> means each of the infrastructure assets that are owned by the Bureau of Reclamation at a Reclamation project.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9338AB73E20248A1AB3E8FFC83FA0E8F"><enum>(5)</enum><header display-inline="yes-display-inline">Reclamation project</header><text display-inline="yes-display-inline">The term <term>Reclamation project</term> means a project that is owned by the Bureau of Reclamation, including all reserved works and transferred works owned by the Bureau of Reclamation.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB1D1C93A9A8F4F52BD000E17F4D6E13B"><enum>(6)</enum><header display-inline="yes-display-inline">Reserved works</header><text display-inline="yes-display-inline">The term <term>reserved works</term> means buildings, structures, facilities, or equipment that are owned by the Bureau of Reclamation for which operations and maintenance are performed by employees of the Bureau of Reclamation or through a contract entered into by the Bureau of Reclamation, regardless of the source of funding for the operations and maintenance.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC21774C5AC24D8085A8997BAF31044E"><enum>(7)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF8CCC9D5EC1949A18BA56289EE0E4391"><enum>(8)</enum><header display-inline="yes-display-inline">Transferred works</header><text display-inline="yes-display-inline">The term <term>transferred works</term> means a Reclamation facility at which operations and maintenance of the facility is carried out by a non-Federal entity under the provisions of a formal operations and maintenance transfer contract or other legal agreement with the Bureau of Reclamation.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H997C33F849954E69AA0B75645930418E" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Asset management report enhancements for reserved works</header>
 <subsection commented="no" display-inline="no-display-inline" id="H11871AE5B2554950976FE7ED5AF794DD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to Congress an Asset Management Report that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HF9CB07AF82A740848A296894DA43606B"><enum>(1)</enum><text display-inline="yes-display-inline">describes the efforts of the Bureau of Reclamation—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE03347A4684B4F57BAE62712DFEFAB96"><enum>(A)</enum><text display-inline="yes-display-inline">to maintain in a reliable manner all reserved works at Reclamation facilities; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B23137D786249DD9D579B9A47B8729F"><enum>(B)</enum><text display-inline="yes-display-inline">to standardize and streamline data reporting and processes across regions and areas for the purpose of maintaining reserved works at Reclamation facilities; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E80800E199A44E488B2E88A2A278ED5"><enum>(2)</enum><text display-inline="yes-display-inline">expands on the information otherwise provided in an Asset Management Report, in accordance with subsection (b).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD41D6E13DF9E49D5A74B69D043BA5150"><enum>(b)</enum><header display-inline="yes-display-inline">Infrastructure Maintenance Needs Assessment</header>
 <paragraph commented="no" display-inline="no-display-inline" id="HDF9887D37783455D9B15AFFAA689893E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Asset Management Report submitted under subsection (a) shall include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H98803221375F40178114886FF9DF3F47"><enum>(A)</enum><text display-inline="yes-display-inline">a detailed assessment of major repair and rehabilitation needs for all reserved works at all Reclamation projects; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBDF9B8BB53FC41B9BD3AE7ADA4987FDE"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent practicable, an itemized list of major repair and rehabilitation needs of individual Reclamation facilities at each Reclamation project.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40C5537A93EF4D72B99133456146087F"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">To the extent practicable, the itemized list of major repair and rehabilitation needs under paragraph (1)(B) shall include—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H692E06A375CB452DAD3F1D80DF88BF32"><enum>(A)</enum><text display-inline="yes-display-inline">a budget level cost estimate of the appropriations needed to complete each item; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFAF7683C63694B42BC39BF926B89D870"><enum>(B)</enum><text display-inline="yes-display-inline">an assignment of a categorical rating for each item, consistent with paragraph (3).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC06F0A7C63BD4B5A94BE83F3274E8022"><enum>(3)</enum><header display-inline="yes-display-inline">Rating requirements</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="HC4111490C9E8474789723C8B5AE23EAA"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The system for assigning ratings under paragraph (2)(B) shall be—</text> <clause commented="no" display-inline="no-display-inline" id="HB500B2EE24D24CB8BEB032B37CEC3555"><enum>(i)</enum><text display-inline="yes-display-inline">consistent with existing uniform categorization systems to inform the annual budget process and agency requirements; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HE697BCBE8F934FB6AA5DFD98A79ADFD4"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the guidance and instructions issued under subparagraph (B).</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H74018890AB5642858438E757F31FB6F5"><enum>(B)</enum><header display-inline="yes-display-inline">Guidance</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall issue guidance that describes the applicability of the rating system applicable under paragraph (2)(B) to Reclamation facilities.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3800B676D7F245A1A967FEC21A225511"><enum>(4)</enum><header display-inline="yes-display-inline">Public availability</header><text display-inline="yes-display-inline">Except as provided in paragraph (5), the Secretary shall make publicly available, including on the Internet, the Asset Management Report required under subsection (a).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFEE73AC2D39649709AD85E9A4598BC12"><enum>(5)</enum><header display-inline="yes-display-inline">Confidentiality</header><text display-inline="yes-display-inline">The Secretary may exclude from the public version of the Asset Management Report made available under paragraph (4) any information that the Secretary identifies as sensitive or classified, but shall make available to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a version of the report containing the sensitive or classified information.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6C27E4B12B5D4A08B8FA6F66277CB36E"><enum>(c)</enum><header display-inline="yes-display-inline">Updates</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the Asset Management Report is submitted under subsection (a) and biennially thereafter, the Secretary shall update the Asset Management Report, subject to the requirements of section 5(b)(2).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H1D4281FDD0714830906A596169F7969B"><enum>(d)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">To the extent that such consultation would assist the Secretary in preparing the Asset Management Report under subsection (a) and updates to the Asset Management Report under subsection (c), the Secretary shall consult with—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HC042662FF1B8405D9355F158FC124664"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of the Army (acting through the Chief of Engineers); and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEA164C3D16474839B7691B8AB09327DF"><enum>(2)</enum><text display-inline="yes-display-inline">water and power contractors.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7E6011BAFE5B47EBA2BEDEBA01E32A74" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Asset management report enhancements for transferred works</header>
 <subsection commented="no" display-inline="no-display-inline" id="H6648CD04A5DE41DA95B00CE541504DFA"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall coordinate with the non-Federal entities responsible for the operation and maintenance of transferred works in developing reporting requirements for Asset Management Reports with respect to major repair and rehabilitation needs for transferred works that are similar to the reporting requirements described in section 4(b).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H0FDF690B8C1B49F08ED5E2268D3CAC1B"><enum>(b)</enum><header display-inline="yes-display-inline">Guidance</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H450E5EE61A50439BA7D84C954053D997"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">After considering input from water and power contractors of the Bureau of Reclamation, the Secretary shall develop and implement a rating system for transferred works that incorporates, to the maximum extent practicable, the rating system for major repair and rehabilitation needs for reserved works developed under section 4(b)(3).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H83028668A9EE4DDEBEE14632A05357C1"><enum>(2)</enum><header display-inline="yes-display-inline">Updates</header><text display-inline="yes-display-inline">The ratings system developed under paragraph (1) shall be included in the updated Asset Management Reports under section 4(c).</text>
 </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H918B5E35264C4AB5A24E4EB92E90D31A" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Offset</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, in the case of the project authorized by section 1617 of the Reclamation Projects Authorization and Adjustment Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/43/390h-12c">43 U.S.C. 390h–12c</external-xref>), the maximum amount of the Federal share of the cost of the project under section 1631(d)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h-13">43 U.S.C. 390h–13(d)(1)</external-xref>) otherwise available as of the date of enactment of this Act shall be reduced by $2,000,000.</text>
