 <section id="H3AF2727549664FBE80E0D2A95FF4B082" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unpaid Intern Protection Act of 2017</short-title></quote>.</text> </section><section id="H0879D9B4D4EA48B7BEF05537C046F2D1"><enum>2.</enum><header>Unlawful discrimination against interns</header><text display-inline="no-display-inline">It shall be unlawful for an employer to discriminate against an intern on the basis of—</text>
 <paragraph id="H95FCCEB5B46C449D9B9D4E306F5CAF23"><enum>(1)</enum><text>race, color, religion, sex, national origin, or age, or</text> </paragraph><paragraph id="HAD803EA949B848E9AE4F4FB052043FDC"><enum>(2)</enum><text>disability if such intern is a qualified individual with a disability.</text>
 </paragraph></section><section id="HD64786C1C42947D0BBD168617D5A3423"><enum>3.</enum><header>Procedures</header><text display-inline="no-display-inline">The procedures applicable to a claim for a violation of this Act are—</text> <paragraph id="HE58659B7B09540BCAA6D4F68826CE546"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to alleged discrimination based on race, color, religion, sex, or national origin, the procedures applicable for a claim for a violation of title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> et seq.),</text>
 </paragraph><paragraph id="HF1903FE768FD46CBA4B34A0D023C4AA9"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to alleged discrimination based on age, the procedures applicable for a violation of Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/621">29 U.S.C. 621</external-xref> et seq.), and</text>
 </paragraph><paragraph id="H0C18CB35569D49F0A7C9E0ECDD4FD909"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to alleged discrimination based on a disability, the procedures applicable for a violation of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111</external-xref> et seq.).</text>
 </paragraph></section><section id="H2A69CA2137174C54A753B594DDEA1A9A"><enum>4.</enum><header>Remedies</header><text display-inline="no-display-inline">The district courts of the United States shall have jurisdiction to grant such legal and equitable relief as may be appropriate for a violation of this Act.</text>
 </section><section id="H111FF9E02CFB40BFB62AC7052BA72EB0"><enum>5.</enum><header>State Immunity</header><text display-inline="no-display-inline">A State shall not be immune under the eleventh article of amendment to the Constitution of the United States from an action in a court of the United States for a violation of this Act. In an action against a State for a violation of this Act, remedies (including remedies at law and in equity) are available for the violation to the same extent as such remedies are available in an action against any public or private entity other than a State.</text>
 </section><section id="HA8CC7DC198D74277BE6A1E9322AFAE9F"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text> <paragraph id="H833A3B9F0AC04727A9C49144D4AFEBCB"><enum>(1)</enum><header>Disability</header><text>The term <quote>disability</quote> has the meaning given such term as applied in the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref> et seq.).</text>
 </paragraph><paragraph id="H7DDCBFB4B9354EA78FDD77220C02C838"><enum>(2)</enum><header>Employer</header><text>The term <quote>employer</quote> has the meaning given such term in—</text> <subparagraph id="HD0B3575CC87A45AABC9E141B9CE47C76"><enum>(A)</enum><text display-inline="yes-display-inline">section 701 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref>) with respect to discrimination based on race, color, religion, sex, or national origin,</text>
 </subparagraph><subparagraph id="HC9F6748630E4417D8596EDAB674D99FC"><enum>(B)</enum><text display-inline="yes-display-inline">section 11 of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/630">29 U.S.C. 630</external-xref>) with respect to discrimination based on age, and</text>
 </subparagraph><subparagraph id="H625C1D9EB651499EB25ADABBC1090A9B"><enum>(C)</enum><text display-inline="yes-display-inline">section 101 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111</external-xref>) with respect to discrimination based on disability.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HAE5CAF8F3839499196A989CAE33EEF19"><enum>(3)</enum><header>Intern</header><text display-inline="yes-display-inline">The term <quote>intern</quote> means an individual who performs uncompensated voluntary service for an employer, to earn credit awarded by an educational institution or to learn a trade or occupation.</text>
 </paragraph><paragraph id="HE9FDCA9337674CCBB117E7926F105A05"><enum>(4)</enum><header>qualified individual with a disability</header><text display-inline="yes-display-inline">The term <quote>qualified individual with a disability</quote> has the meaning given such term in section 101 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111</external-xref>).</text>
 </paragraph><paragraph id="H38B9538DF8E24BB8AA82058CBF15FB12"><enum>(5)</enum><header>State</header><text>The term <quote>State</quote> has the meaning given such term in—</text> <subparagraph id="H3D1E14A8B5AF48F1868890B07B71B330"><enum>(A)</enum><text display-inline="yes-display-inline">section 701 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref>) with respect to discrimination based on race, color, religion, sex, or national origin,</text>
 </subparagraph><subparagraph id="H3311A45DA4F349D9B34F4E1921B44B52"><enum>(B)</enum><text display-inline="yes-display-inline">section 11 of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/630">29 U.S.C. 630</external-xref>) with respect to discrimination based on age, or</text>
 </subparagraph><subparagraph id="H63BEC2137D55448D9E4F0A5B1E5410D5"><enum>(C)</enum><text display-inline="yes-display-inline">section 4 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12103">42 U.S.C. 12103</external-xref>) with respect to discrimination based on disability.</text>
