			 documentation, to amend the Consolidated Farm and Rural Development Act to
			 include qualified intermediaries as recipients of farm ownership loans, to
			 provide for a study of farmland tenure, and for other purposes.</official-title></form>
	<legis-body id="H2246692D12A142469D0CB682580FB853" style="OLC">
 <section id="HEC2CA29AC225427986D4CCC959AAEE93" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Access for Farmers and Ranchers Act of 2018</short-title></quote>.</text> </section><section id="HB90664055291414C8C928847D47214F0"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Agriculture.</text>
		</section><section id="HEB80268CBCDA47DFAE58942D37C4548F"><enum>3.</enum><header>Eligibility for operators on heirs property land to obtain a farm number</header>
 <subsection id="H2386D37AEB4F431B96A78C08B19CB6D5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H0F7305421DC945F284870D2BF0630E2F"><enum>(1)</enum><header>Eligible documentation</header><text>The term <term>eligible documentation</term>, with respect to land for which a farm operator seeks assignment of a farm number under subsection (b)(1), includes—</text>
 <subparagraph id="HB0B466B4C87E49989146BCD558E5C9B3"><enum>(A)</enum><text>in States that have adopted a statute consisting of an enactment or adoption of the Uniform Partition of Heirs Property Act, as approved and recommended for enactment in all States by the National Conference of Commissioners on Uniform State Laws in 2010—</text>
 <clause id="HF7356AEC7ECB4E7DB9DB262610043353"><enum>(i)</enum><text>a court order verifying the land meets the definition of heirs property (as defined in that Act); or</text>
 </clause><clause id="HAD9228FF2631495D99509FA02DD47BB4"><enum>(ii)</enum><text>a certification from the local recorder of deeds that the recorded owner of the land is deceased and not less than 1 heir of the recorded owner of the land has initiated a procedure to retitle the land in the name of the rightful heir;</text>
 </clause></subparagraph><subparagraph id="H9C8876EBD24845DA80C459AA95ECE4E7"><enum>(B)</enum><text>a fully executed, unrecorded tenancy-in-common agreement that sets out ownership rights and responsibilities among all of the owners of the land that—</text>
 <clause id="HBD7C39DC79E5419199D91E007689A0D1"><enum>(i)</enum><text>has been approved by a majority of the ownership interests in that property;</text> </clause><clause id="HAB58824FDA684CE3A602C676AEF7A69A"><enum>(ii)</enum><text>has given a particular owner the right to manage and control any portion or all of the land for purposes of operating a farm or ranch; and</text>
 </clause><clause id="H1E7BC8B8C40C433DB964487C50312BD6"><enum>(iii)</enum><text>was validly entered into under the authority of the jurisdiction in which the land is located;</text> </clause></subparagraph><subparagraph id="HD6D5DD5333634C2AAD51BDAD2AF0F87D"><enum>(C)</enum><text>the tax return of a farm operator farming a property with undivided interests for each of the 5 years preceding the date on which the farm operator submits the tax returns as eligible documentation under subsection (b);</text>
 </subparagraph><subparagraph id="H09776DB927CE4193AC4B99B3F852212D"><enum>(D)</enum><text>self-certification that the farm operator has control of the land for purposes of operating a farm or ranch; and</text>
 </subparagraph><subparagraph id="H3BF5BCFBF835448D9CE34180E1CD87D5"><enum>(E)</enum><text>any other documentation identified by the Secretary under subsection (c).</text> </subparagraph></paragraph><paragraph id="HA5F1C4A26EE94837BDB6D49FEDF84D1D"><enum>(2)</enum><header>Farm number</header><text>The term <term>farm number</term> has the meaning given the term in section 718.2 of title 7, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text>
				</paragraph></subsection><subsection id="HDA73D13D203841328CA90721704CB2A5"><enum>(b)</enum><header>Farm number</header>
 <paragraph id="H53306F67EE094073990F859AF6CD2775"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide for the assignment of a farm number to any farm operator who provides any form of eligible documentation for purposes of demonstrating that the farm operator has control of the land for purposes of defining that land as a farm.</text>
 </paragraph><paragraph id="HC2ED87B693C447B9861AD475323D76AC"><enum>(2)</enum><header>Eligibility</header><text>Any farm number provided under paragraph (1) shall be sufficient to satisfy any requirement of the Secretary to have a farm number to participate in a program of the Secretary.</text>
 </paragraph></subsection><subsection id="H4C28CAC6D27D411B9F92B402A3B5100A"><enum>(c)</enum><header>Eligible documentation</header><text>The Secretary shall identify alternative forms of eligible documentation that a farm operator may provide in seeking the assignment of a farm number under subsection (b)(1).</text>
			</subsection></section><section id="HACEFF5D54EE54304982B44EBF37C4DDC"><enum>4.</enum><header>Loans to purchasers of land with undivided interest and no administrative authority</header>
 <subsection id="HB9C0D61329E447F58934798BFC40F58B"><enum>(a)</enum><header>Reauthorization of beginning farmer and rancher individual development accounts pilot program</header><text>Section 333B(h) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1983b">7 U.S.C. 1983b(h)</external-xref>) is amended by striking <quote>2018</quote> and inserting <quote>2024</quote>.</text>
 </subsection><subsection id="HD3279A594F3345CBB8E814CE3FE0A61A"><enum>(b)</enum><header>Pilot program</header><text>Subtitle D of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1981">7 U.S.C. 1981</external-xref> et seq.) is amended by inserting after section 333D the following:</text>
				<quoted-block act-name="" id="HB9224E57B91F4700B3329C0284CBDA23" style="OLC">
					<section id="HEA36BF59DA5C4D5BAA453DFC0B0BE5E6"><enum>333E.</enum><header>Farmer loan pilot projects</header>
 <subsection id="H58B1CC994EEC44B680B6A106447F77FC"><enum>(a)</enum><header>In general</header><text>The Secretary may conduct pilot projects of limited scope and duration that are consistent with subtitles A, B, C, and this subtitle to evaluate processes and techniques that may improve the efficiency and effectiveness of the programs carried out under subtitle A, B, C, and this subtitle.</text>
 </subsection><subsection id="H1B6F8C16CBDB4E9997A60B6303E12D37"><enum>(b)</enum><header>Notification</header><text>The Secretary shall—</text> <paragraph id="HC121560EDDB747E7A2CC02FD3DE6721F"><enum>(1)</enum><text>not less than 60 days before the date on which the Secretary initiates a pilot project under subsection (a), submit notice of the proposed pilot project to the <committee-name committee-id="">Committee on Agriculture of the House of Representatives</committee-name> and the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry of the Senate</committee-name>; and</text>
 </paragraph><paragraph id="H0BD0D17DD6514DAFB3370E4107487F28"><enum>(2)</enum><text>consider any recommendations or feedback provided to the Secretary in response to the notice provided under paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H6F312C95B57A4229B0C1138084D66B4E"><enum>(c)</enum><header>Relending program</header><text>Subtitle A of title III of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block act-name="" id="H4DAD432059B549DE8AD172C140037EC6" style="OLC">
					<section id="HBE6590C46EF047C6BF6C95CDA85BA32A"><enum>310I.</enum><header>Relending program to resolve ownership and succession on farmland</header>
 <subsection id="H75670C3167DC481BAA938EC69F0D7068"><enum>(a)</enum><header>In general</header><text>The Secretary may make or guarantee loans to eligible entities described in subsection (b) using amounts made available for farm ownership loans under this subtitle so that the eligible entities may relend the funds to individuals and entities for the purposes described in subsection (c).</text>
 </subsection><subsection id="H57F45C82635744868C930E9659F542D0"><enum>(b)</enum><header>Eligible entities</header><text>Entities eligible for loans and loan guarantees described in subsection (a) are cooperatives, credit unions, and nonprofit organizations with—</text>
 <paragraph id="HE203336124B747F6A9DBD13940DC6D8C"><enum>(1)</enum><text>certification under section 1805.201 of title 12, Code of Federal Regulations (or successor regulations) to operate as a lender;</text>
 </paragraph><paragraph id="H3EF7AD0DF37C4AF3970B0F2068266801"><enum>(2)</enum><text>experience assisting socially disadvantaged farmers and ranchers (as defined in section 2501(e) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(e)</external-xref>)) or limited resource or new and beginning farmers and ranchers, rural businesses, cooperatives, or credit unions, including experience in making and servicing agricultural and commercial loans; and</text>
 </paragraph><paragraph id="HDACF807E2B3449F6A88506ADB8DE7A28"><enum>(3)</enum><text>the ability to provide adequate assurance of the repayment of a loan.</text> </paragraph></subsection><subsection id="HE04E41E23F83420EB93D2DF260091D25"><enum>(c)</enum><header>Eligible purposes</header><text>The proceeds from loans made or guaranteed by the Secretary pursuant to subsection (a) shall be relent by eligible entities for projects that assist heirs with undivided ownership interests to resolve ownership and succession on farmland that has multiple owners.</text>
 </subsection><subsection id="HEA216BD4778A4047AC718C3932247957"><enum>(d)</enum><header>Preference</header><text>In making loans under subsection (a), the Secretary shall give preference to eligible entities—</text> <paragraph id="HAF3201C36DCD4426A8C3E73D9CD8684C"><enum>(1)</enum><text>with not less than 10 years of experience serving socially disadvantaged farmers and ranchers; and</text>
 </paragraph><paragraph id="H5E7CEEE0F484477BAE1D8DA4F7A93153"><enum>(2)</enum><text>in States that have adopted a statute consisting of an enactment or adoption of the Uniform Partition of Heirs Property Act, as approved and recommended for enactment in all States by the National Conference of Commissioners on Uniform State Laws in 2010, that relend to owners of heirs property (as defined in that Act).</text>
 </paragraph></subsection><subsection id="H26776EE37870422A86A5273F1628D09C"><enum>(e)</enum><header>Loan terms and conditions</header><text>The following terms and conditions shall apply to loans made or guaranteed under this section:</text> <paragraph id="HC2F8A49058EE436C95EB824212203124"><enum>(1)</enum><text>The interest rate at which intermediaries may borrow funds under this section shall be equal to the rate at which farm ownership loans under this subtitle are made.</text>
 </paragraph><paragraph id="HF168E38B816C46BCB26042CF033B8EB1"><enum>(2)</enum><text>The rates, terms, and payment structure for borrowers to which intermediaries lend shall be—</text> <subparagraph id="H2902BE7DB15F4D71AACB70342ECA243A"><enum>(A)</enum><text>determined by the intermediary in an amount sufficient to cover the cost of operating and sustaining the revolving loan fund; and</text>
 </subparagraph><subparagraph id="HAAE2E45C4E57454A94E6083298D0DC3E"><enum>(B)</enum><text>clearly and publicly disclosed to qualified ultimate borrowers.</text> </subparagraph></paragraph><paragraph id="H8BED97B2D855407E92F0B065EC9928B1"><enum>(3)</enum><text>Borrowers to which intermediaries lend shall be—</text>
 <subparagraph id="H62D29E9C20ED4E7AAC5277FBF36E06B2"><enum>(A)</enum><text>required to complete a succession plan as a condition of the loan; and</text> </subparagraph><subparagraph id="HA6CC344C528C4EBBBC61A27794C3291F"><enum>(B)</enum><text>be offered the opportunity to borrow sufficient funds to cover costs associated with the succession plan under subparagraph (A) and other associated legal and closing costs.</text>
 </subparagraph></paragraph></subsection><subsection id="HE9340BDC47CA448D8C7D41EF37E3121C"><enum>(f)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall submit to the <committee-name committee-id="">Committee on Agriculture of the House of Representatives</committee-name> and the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry of the Senate</committee-name> a report describing the operation and outcomes of the program under this section, with recommendations on how to strengthen the program.</text>
 </subsection><subsection id="H73ADFC69C1AF41BD92DC13A387DEF10B"><enum>(g)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall carry out this section using funds otherwise made available to the Secretary.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="HECCC3C3126894C388CAABC9B9BA1D4CC"><enum>5.</enum><header>Farmland ownership data collection</header> <subsection id="H7633842B23E949C18C0BCD72EDE7A9F6"><enum>(a)</enum><header>In general</header><text>The Secretary shall collect and, not less frequently than once every 5 years report, data and analysis on farmland ownership, tenure, transition, and entry of beginning farmers and ranchers (as defined in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>)) and socially disadvantaged farmers and ranchers (as defined in section 2501(e) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(e)</external-xref>)).</text>
 </subsection><subsection id="H79084FD12322416B81217D1A4182FC10"><enum>(b)</enum><header>Requirements</header><text>In carrying out subsection (a), the Secretary shall, at a minimum—</text> <paragraph id="H803171F3BD6847AAB6F3EAAE6661A34B"><enum>(1)</enum><text>collect and distribute comprehensive reporting of trends in farmland ownership, tenure, transition, barriers to entry, profitability, and viability of beginning farmers and ranchers and socially disadvantaged farmers and ranchers;</text>
 </paragraph><paragraph id="H136911796220461C830BD8EEB2467888"><enum>(2)</enum><text>develop surveys and report statistical and economic analysis on farmland ownership, tenure, transition, barriers to entry, profitability, and viability of beginning farmers and ranchers, including a regular follow-on survey to each Census of Agriculture with results of the follow-on survey made public not later than 3 years after the previous Census of Agriculture; and</text>
 </paragraph><paragraph id="H148E584BA4D04050A98252F92259CDC3"><enum>(3)</enum><text>require the National Agricultural Statistics Service—</text> <subparagraph id="H1178258CEF8342D1AB7017F881C40D55"><enum>(A)</enum><text>to include in the Tenure, Ownership, and Transition of Agricultural Land survey questions relating to—</text>
 <clause id="H061C29F23907457BAA8A0E1E7130313C"><enum>(i)</enum><text>the extent to which non-farming landowners are purchasing and holding onto farmland for the sole purpose of real estate investment;</text>
 </clause><clause id="H862B9B2EE4414C8DBB4F583EF0A472D6"><enum>(ii)</enum><text>the impact of these farmland ownership trends on the successful entry and viability of beginning farmers and ranchers and socially disadvantaged farmers and ranchers;</text>
 </clause><clause id="H8E9CA6C5555A43918F36B5F280386400"><enum>(iii)</enum><text>the extent to which farm and ranch land with undivided interests and no administrative authority identified have farms or ranches operating on that land; and</text>
 </clause><clause id="HC7E5252DCCEA4658AA0685C40862BC8F"><enum>(iv)</enum><text>the impact of land tenure patterns, categorized by—</text> <subclause id="H682CC2FFFD3C44888D14D4692893AACD"><enum>(I)</enum><text>race, gender, and ethnicity; and</text>
 </subclause><subclause id="HFBB3D7F006F9448B967FF886097F3E9F"><enum>(II)</enum><text>region; and</text> </subclause></clause></subparagraph><subparagraph id="HABDDFE2B3D8C493C80F780CAE76F2204"><enum>(B)</enum><text>to include in the report of each Tenure, Ownership, and Transition of Agricultural Land survey the results of the questions under subparagraph (A).</text>
					</subparagraph></paragraph></subsection></section></legis-body></bill>
