 <section id="HFEC3A3263D7445C0B6F59E7DF398D387" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Chance for Youth Act of 2017</short-title></quote>.</text> </section><section id="HD8743682E67B4D3F904D047569331875"><enum>2.</enum><header>Youth sealing and expungement</header> <subsection id="H47CD7BAECC134950A1F6EB211F1DD3CA"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/229">Chapter 229</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

						<section id="HAFE236BAC1514B7EBB7183F2DB648851"><enum>3631.</enum><header>Youth Offense Expungement and Sealing Review Board</header>
 <subsection id="H63DB85FE62D245A5A2AFDA224604DD8E"><enum>(a)</enum><header>In general</header><text>The Chief Judge for each Federal District shall establish—</text> <paragraph id="H4A8CF361B01B40E7AB016671BFCE9B91"><enum>(1)</enum><text>a Youth Offense Expungement and Sealing Review Board (hereinafter in this section referred to as the <quote>Review Board</quote>) to review petitions for discretionary expungement and sealing of youth offenses; and</text>
 </paragraph><paragraph id="H50631DC599BF41918BC63E59FD4CEB77"><enum>(2)</enum><text>the rules and procedures governing the operation of the Review Board in the exercise of its powers under subsection (c).</text>
 </paragraph></subsection><subsection id="H89FB0CCDAE4840E98E5E2DDBD0FE0C17"><enum>(b)</enum><header>Composition</header><text>The Review Board shall include one representative, selected by the Chief Judge to serve without compensation, from each of the following:</text>
 <paragraph id="HA62FCE06C87A4E868291ADF60E49B3FB"><enum>(1)</enum><text>The Department of Justice.</text> </paragraph><paragraph id="H827DA7E0D9034C07A246C1979E212224"><enum>(2)</enum><text>The United States Probation and Pretrial Services System.</text>
 </paragraph><paragraph id="HD567423B60094688A9B7A22018447BF9"><enum>(3)</enum><text>The Office of the Federal Defender or a designated Criminal Justice Act panel attorney or private criminal defense attorney.</text>
 </paragraph></subsection><subsection id="HB1A01E9D60C749D195138B9AB8DC6B3B"><enum>(c)</enum><header>Powers</header><text>The Review Board shall—</text> <paragraph id="HCFF0F31BD1E44FE7AEC0EFCD21DFD967"><enum>(1)</enum><text>review petitions under this subchapter to determine whether the youth, and the offense on which the petition is based, meet the eligibility requirements for expungement or sealing consideration;</text>
 </paragraph><paragraph id="H642CFC71C771444FAA42CB8E5D8F5D09"><enum>(2)</enum><text>for petitions meeting the eligibility requirements, evaluate those petitions on the merits in order to make a recommendation on the advisability of granting the petition; and</text>
 </paragraph><paragraph id="H0E8C24A0BAA94E138E3E4F8F00E0AAB0"><enum>(3)</enum><text>convey its recommendation, with a written explanation, to the Chief Judge in each Federal District, or a designee of the Chief Judge, for consideration.</text>
 </paragraph></subsection><subsection id="HAA098BE45EBC4E18B907C0C3A7C38D18"><enum>(d)</enum><header>Recommendation</header><text>In making its recommendation, the Review Board—</text> <paragraph id="HFAF8B63F451540579DF53EAC3C8F2877"><enum>(1)</enum><text>shall consider all the evidence and testimony presented in the petition and any hearings held on the petition;</text>
 </paragraph><paragraph id="HFD6201DF48EC47519479DDC9331D3855"><enum>(2)</enum><text>may not consider any arrest or prosecution that did not result in a conviction and that took place prior to the conviction or arrest the petitioner is seeking to expunge or seal; and</text>
 </paragraph><paragraph id="H68EE2EB6FD314201B99BA5EC33889673"><enum>(3)</enum><text>shall balance—</text> <subparagraph id="H72D5003FF9204D3DA228F5799848ACED"><enum>(A)</enum><text>the public safety, the interest of public knowledge, and any legitimate interest of the Government in maintaining the accessibility of the protected information; against</text>
 </subparagraph><subparagraph id="HA7823CF1C1EA40DC8B957602102E6951"><enum>(B)</enum><text>the interest of the petitioner in having the petition granted, including the benefit to the petition’s ability to positively contribute to the community, and the petitioner’s conduct and demonstrated desire to be rehabilitated.</text>
 </subparagraph></paragraph></subsection><subsection id="HF54887591D0B4AF7BA4307F6665ED559"><enum>(e)</enum><header>Court To consider and decide upon petitions</header><text display-inline="yes-display-inline">The Court shall consider and decide upon each petition for which the court receives a recommendation from the Review Board. The Court’s decision to grant or deny the petition shall give significant weight to the Review Board recommendation. The Court shall grant the petition unless the Government shows the interests described in subsection (d)(3)(A) outweigh the interests of the petitioner described in subsection (d)(3)(B).</text>
 </subsection><subsection id="H68ECE5BB64B945B587F5340E969BFCBC"><enum>(f)</enum><header>One opportunity</header><text>A youth may only file a petition for expungement or sealing under this subchapter once and the decision of the district court on the petition shall be final and is not appealable.</text>
 </subsection><subsection id="H23C2E722D1C44D67B97C3F14457CB91C"><enum>(g)</enum><header>Online forms for petitions</header><text>The Director of the Administrative Office of the United States Courts shall create and make available to the public, online and in paper form, a universal form to file a petition under this section, and establish a process under which indigent petitioners may obtain a waiver of any fee for filing a petition under this section.</text>
 </subsection><subsection id="HA144EAB83D2745129FA19F0006C03061"><enum>(h)</enum><header>Making available standard forms for court orders</header><text>The Director of the Administrative Office of the United States Courts shall create and make available to the Chief Judge of every Federal district standard expungement and sealing orders that empower the petitioner to seek destruction of records in accordance with the order.</text>
							</subsection></section><section id="H25CF07C9685E40F1997749E4ECD85080"><enum>3632.</enum><header>Expungement and sealing for youth</header>
 <subsection id="HD6F354234F5B44B9B93469F19EFF739F"><enum>(a)</enum><header>Expungement petition eligibility</header><text>A youth may petition a district court of the United States for expungement—</text> <paragraph id="HB55AFFB3A5794613B315FEADD3407AFE"><enum>(1)</enum><text>of the record of any misdemeanor or nonviolent felony drug conviction 3 years after the youth has completed every term of imprisonment related to that misdemeanor or nonviolent felony drug conviction;</text>
 </paragraph><paragraph id="H67C089FCD22C47A28783C81777A1503F"><enum>(2)</enum><text>of the record of any person who has not attained the age of 18 at the time of committing the conduct resulting in conviction for any misdemeanor or nonviolent offense 3 years after the person has completed every term of imprisonment related to that misdemeanor or nonviolent offense conviction; and</text>
 </paragraph><paragraph id="HACD56FD18CCF4F20A08177F852A67B29"><enum>(3)</enum><text>of the record of an arrest or prosecution for any nonviolent offense on the date on which the case related to that arrest or prosecution is disposed of.</text>
 </paragraph></subsection><subsection id="H22DC6D0090964122A9684DDAB4F3E235"><enum>(b)</enum><header>Sealing petition eligibility</header><text>A youth may petition a district court of the United States, for sealing—</text> <paragraph id="H38D385C0B743484597DEE48F8EF9F006"><enum>(1)</enum><text>of the record of any nonviolent conviction 5 years after the youth has completed every term of imprisonment related to that nonviolent conviction;</text>
 </paragraph><paragraph id="H144FD2C9827143E19E12FD79D9FA336B"><enum>(2)</enum><text>of the record of any person who has not attained the age of 18 at the time of committing the conduct resulting in conviction for any offense 10 years after the person has completed every term of imprisonment related to that offense conviction; and</text>
 </paragraph><paragraph id="HC9297E4E78CB4FFB8EB000099CA302D8"><enum>(3)</enum><text>of the record of an arrest or prosecution for any nonviolent offense on the date on which the case related to that arrest or prosecution is disposed of.</text>
 </paragraph></subsection><subsection id="H45F7A2FEF5904476AF5A3E4728AEDC02"><enum>(c)</enum><header>Notice of opportunity To file petition</header><text>A youth shall be informed of the eligibility to, procedures for, and benefits of filing an expungement or sealing petition—</text>
 <paragraph id="H55485EB2B10F439BB44830277FCBD4C3"><enum>(1)</enum><text>by the District Court on the date of conviction;</text> </paragraph><paragraph id="H8846DDF98D834B0DA509D92FD425FB95"><enum>(2)</enum><text>by the Office of Probation and Pretrial Services on the date the youth completes every term of imprisonment; or</text>
 </paragraph><paragraph id="H7059974B0E324F6FA917845C4A4B71AF"><enum>(3)</enum><text>if the arrest or prosecution does not result in a conviction, then by the Department of Justice on the date the case is disposed of.</text>
 </paragraph></subsection><subsection id="H0FBD6384CBF44E7CA1F206C57DF86499"><enum>(d)</enum><header>Grant of petition</header><text>If a court grants a petition under this section—</text> <paragraph id="H534CA4D3B9954537BB20C0152BFD148B"><enum>(1)</enum><text>the person to whom the record pertains may choose to, but is not required to, disclose the existence of the record, and the offense conduct and any arrest, juvenile delinquency proceeding, adjudication, conviction, or other result of such proceeding relating to the offense conduct, shall be treated as if it never occurred;</text>
 </paragraph><paragraph id="H5707E5CB10F6494C8F549AF00BBC22F1"><enum>(2)</enum><text>the court shall destroy each paper and electronic copy of the record in the possession of the court;</text>
 </paragraph><paragraph id="HBC8A01FFFCE84C578D1CB1C45B89EFE3"><enum>(3)</enum><text display-inline="yes-display-inline">the court shall issue an expungement or sealing order requiring the destruction of any paper and electronic copies of the record by any court, law enforcement officer, law enforcement agency, treatment or rehabilitation services agency, or employee thereof in possession of those copies;</text>
 </paragraph><paragraph id="H0BC719593A8D4244B00027712E591C9F"><enum>(4)</enum><text>any entity or person listed in paragraph (3) that receives an inquiry relating to the record shall reply to the inquiry stating that no such record exists; and</text>
 </paragraph><paragraph id="HBF343742977A47FDB66731ABFCEAAB42"><enum>(5)</enum><text>except as provided in subsection (f), no person shall not be subject to prosecution under any civil or criminal provision of Federal or State law relating to perjury, false swearing, or making a false statement for failing to acknowledge the record or respond to any inquiry made of the petitioner or the parent relating to the record, for any purpose.</text>
								</paragraph></subsection><subsection id="H6778DF5FAF2F48A4A7D60C2CA131B623"><enum>(e)</enum><header>Civil actions</header>
 <paragraph id="H3E9410F41740497E9810FA68D2C0946D"><enum>(1)</enum><header>In general</header><text>If an individual who has a record expunged or sealed under this section brings an action that might be defended with the contents of the record, there shall be a rebuttable presumption that the defendant has a complete defense to the action.</text>
 </paragraph><paragraph id="HB43B23628B8B4667A5DAF9FB4FD29170"><enum>(2)</enum><header>Showing by plaintiff</header><text>In an action described in paragraph (1), the plaintiff may rebut the presumption of a complete defense by showing that the contents of the record would not prevent the defendant from being liable.</text>
 </paragraph><paragraph id="H79C5D9B758784D3F92C5693E50B3A69A"><enum>(3)</enum><header>Duty to testify as to existence of record</header><text>The court in which an action described in paragraph (1) is filed may require the plaintiff to state under oath whether the plaintiff had a record and whether the record was expunged or sealed.</text>
 </paragraph><paragraph id="HE177C250A3F344BD8F0C86236C7A3F38"><enum>(4)</enum><header>Proof of existence of record</header><text>If the plaintiff in an action described in paragraph (1) denied the existence of a record, the defendant may prove the existence of the record in any manner compatible with the applicable laws of evidence.</text>
 </paragraph></subsection><subsection id="H575EFB543FA740D7A35A64601A1BFC4F"><enum>(f)</enum><header>Attorney General nonpublic records</header><text>The Attorney General shall—</text> <paragraph id="H147E5DD689C64965842B1C2D01AFB253"><enum>(1)</enum><text>maintain a nonpublic database of all records expunged or sealed under this subchapter;</text>
 </paragraph><paragraph id="H2302D6CC07BA4144A4197A38CE367FC3"><enum>(2)</enum><text>disclose, access, or utilize records contained in the nonpublic database only—</text> <subparagraph id="HD45A1D83E9E1417AA295D52C933A5E12"><enum>(A)</enum><text>in defense of any civil suit arising out of the facts contained in the record;</text>
 </subparagraph><subparagraph id="H83CE9F5B438048628997563516932599"><enum>(B)</enum><text>to determine whether the individual to whom the record relates is eligible for a first-time-offender diversion program;</text>
 </subparagraph><subparagraph id="H2247EBCB3BE849B0A802F03B612D22EC"><enum>(C)</enum><text>for a background check that relates to law enforcement employment or any employment that requires a Government security clearance; or</text>
 </subparagraph><subparagraph id="H32CC7F4EEEBE4E94A77271F3DF50CEA1"><enum>(D)</enum><text>if the Attorney General determines that disclosure is necessary to serve the interests of national security; and</text>
 </subparagraph></paragraph><paragraph id="H110AFD979B384ADD8FF9F5EE74AB5039"><enum>(3)</enum><text>to the extent practicable, notify the individual to whom the record pertains of the disclosure unless it is made pursuant to paragraph (2)(D).</text>
 </paragraph></subsection></section><section id="HE86E60CE37A947A9B0BE7BBC4CE00AEA"><enum>3633.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter—</text> <paragraph id="H5D29AB0B7C2147A6A0A6D1B6F789FD29"><enum>(1)</enum><text>the term <quote>youth</quote> means an individual who was 21 years of age or younger at the time of the criminal offense for which the individual was arrested, prosecuted, or sentenced;</text>
 </paragraph><paragraph id="H3E755FB95F834A8FB3696120C724FB3A"><enum>(2)</enum><text>the term <quote>nonviolent felony</quote> means a Federal criminal felony offense that is not—</text> <subparagraph id="HEB9B37670FFC4609BB6CF9BA83FFE3BD"><enum>(A)</enum><text>a crime of violence; or</text>
 </subparagraph><subparagraph id="HA3567390721444E0AFC18784A81A5037"><enum>(B)</enum><text>a sex offense (as that term is defined in section 111 of the Sex Offender Registration and Notification Act);</text>
 </subparagraph></paragraph><paragraph id="H0151307EFCE041D4B8B877CDDBBBEE66"><enum>(3)</enum><text>the term <quote>record</quote> means information, whether in paper or electronic form, containing any reference to—</text> <subparagraph id="H5CCA5166098C46E4B4C3945094669BAA"><enum>(A)</enum><text>an arrest, conviction, or sentence of an individual for an offense;</text>
 </subparagraph><subparagraph id="H5995E7121AC140A1AEFA1C84D650D202"><enum>(B)</enum><text>the institution of juvenile delinquency or criminal proceedings against an individual for the offense; or</text>
 </subparagraph><subparagraph id="HD478FB3B82D84A7A9F88C06BA01CED6E"><enum>(C)</enum><text>adjudication, conviction, or any other result of juvenile delinquency or criminal proceedings;</text> </subparagraph></paragraph><paragraph id="H554B6EE230A74F0E93FE8A5EDBBB28C4"><enum>(4)</enum><text>the term <quote>expunge</quote>—</text>
 <subparagraph id="H13ACBD6AA2904FBCBAA1BB0BF9B1D488"><enum>(A)</enum><text>means to destroy a record and obliterate the name of the person to whom the record pertains from each official index or public record; and</text>
 </subparagraph><subparagraph id="H37A6527CE4D94245A34256A984BB372F"><enum>(B)</enum><text>has the effect described in section 3631(g), including—</text> <clause id="HE7D78C55524B43BF9E646B79486594DA"><enum>(i)</enum><text>the right to treat an offense to which an expunged record relates, and any arrest, juvenile delinquency proceeding, adjudication, conviction, or other result of such proceeding relating to the offense, as if it never occurred; and</text>
 </clause><clause id="HC5644226B9364ED385023BBE027BF8B7"><enum>(ii)</enum><text>protection from civil and criminal perjury, false swearing, and false statement laws with respect to an expunged record;</text>
 </clause></subparagraph></paragraph><paragraph id="H1B8C58D83134424F89E6E539639BBACA"><enum>(5)</enum><text>the term <quote>seal</quote>—</text> <subparagraph id="HAA3099B71E39409ABE1038F17BFB2AF0"><enum>(A)</enum><text>means—</text>
 <clause id="H8C4D687DA3D84C7081352BCF83180C1B"><enum>(i)</enum><text>to close a record from public viewing so that the record cannot be examined except by court order; and</text>
 </clause><clause id="H924693E9D5FD422DA50E6060F7319482"><enum>(ii)</enum><text>to physically seal the record shut and label the record <quote>SEALED</quote> or, in the case of an electronic record, the substantive equivalent; and</text> </clause></subparagraph><subparagraph id="H876DCCD0DD7042B79AFB7CFADE82C19F"><enum>(B)</enum><text>has the effect described in section 3631(g), including—</text>
 <clause id="HB6229935B55E4256AD7AA66565955278"><enum>(i)</enum><text>the right to treat an offense to which an expunged record relates, and any arrest, juvenile delinquency proceeding, adjudication, conviction, or other result of such proceeding relating to the offense, as if it never occurred; and</text>
 </clause><clause id="H7649E375FB2A495190954CA25E641837"><enum>(ii)</enum><text>protection from civil and criminal perjury, false swearing, and false statement laws with respect to an expunged record;</text>
 </clause></subparagraph></paragraph><paragraph id="HBEF3FAF7B90749E5965A7FFCE61C2EAC"><enum>(6)</enum><text>the term <quote>conviction</quote>—</text> <subparagraph id="HACEDE4DB94B64554B902FC49ECC970E9"><enum>(A)</enum><text>means a judgment or disposition in criminal court against a person following a finding of guilt by a judge or jury; and</text>
 </subparagraph><subparagraph id="H361FB2623C744D0BBC437392F4858018"><enum>(B)</enum><text>for the purposes of this section—</text> <clause id="H399D8467BD3544F7A2DA1FCC030C84D8"><enum>(i)</enum><text>multiple convictions shall be deemed to be one conviction if the convictions result from or relate to the same act or acts committed at the same time; and</text>
 </clause><clause id="H0B456DC07C5447F8AAE6826EFBB35B1E"><enum>(ii)</enum><text display-inline="yes-display-inline">multiple convictions, not to exceed 3, that do not result from or relate to the same act or acts committed at the same time shall be deemed to be one conviction if the convictions result from or relate to the same indictment, information, or complaint, or plea of guilty; and</text>
 </clause></subparagraph></paragraph><paragraph id="HB2666963ABE64948AAFF10D9A4275ACE"><enum>(7)</enum><text>the term <quote>destroy</quote> means to render a file unreadable, whether paper, electronic, or otherwise stored, by shredding, pulverizing, pulping, incinerating, overwriting, reformatting the media, or other means.</text>
 </paragraph></section><section id="HB731BABE134A4957AD679AA42678DC4A"><enum>3634.</enum><header>Reporting</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this subchapter, and each year thereafter, the Attorney General shall issue a public report that—</text>
 <paragraph id="H1FF833C25B6D4C4CA1E48556EBB7F8C2"><enum>(1)</enum><text>describes—</text> <subparagraph id="HC4C31FE17C9B491C8EF54D5B9F403AE3"><enum>(A)</enum><text>the number of expungement and sealing petitions granted and denied; and</text>
 </subparagraph><subparagraph id="H5EC494F276D54B268FB23D29C809D16D"><enum>(B)</enum><text>the number of instances in which the office of a United States attorney supported or opposed an expungement or sealing petition; and</text>
 </subparagraph></paragraph><paragraph id="H61E26515C993497EB4DD08350BE65E0C"><enum>(2)</enum><text>includes any supporting data that the court determines relevant but does not name any petitioner.</text></paragraph></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="HA20C1B1F04654E72A73344183829BBCD"><enum>3.</enum><header>Retroactive Effect</header><text display-inline="no-display-inline">This Act and the amendments made by this Act apply with respect to youth without regard to whether they become involved in the Federal criminal justice system before, on, or after the date of the enactment of this Act.</text>
