<official-title display="yes">To incentivize the hiring of United States workers in the Commonwealth of the Northern Mariana Islands, and for other purposes.</official-title>

<section commented="no" display-inline="no-display-inline" id="H365D39124EC4484199A1FDEAA724E382" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Northern Mariana Islands U.S. Workforce Act of 2018</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HD627C15EAA2F44A6AEAC7FBBC9271237" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H2DCA81C28FA84A0C989463E09DAEF496"><enum>(1)</enum><text display-inline="yes-display-inline">to increase the percentage of United States workers (as defined in section 6(i) of the Joint Resolution entitled <quote>A Joint Resolution to approve the <quote>Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America</quote>, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806</external-xref>)) in the total workforce of the Commonwealth of the Northern Mariana Islands, while maintaining the minimum number of workers who are not United States workers to meet the changing demands of the Northern Mariana Islands’ economy;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HBB42C89C6DD54DD0BC2251826E9EC404"><enum>(2)</enum><text display-inline="yes-display-inline">to encourage the hiring of United States workers into such workforce; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF6BACC26F1DC4C8288A6E2C707BA1F73"><enum>(3)</enum><text display-inline="yes-display-inline">to ensure that no United States worker—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H8544DAEE6F164F39BDAC81AA3079470C"><enum>(A)</enum><text display-inline="yes-display-inline">is at a competitive disadvantage for employment compared to a worker who is not a United States worker; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF14876D1772347FEAE0B2F1AC426DE0F"><enum>(B)</enum><text display-inline="yes-display-inline">is displaced by a worker who is not a United States worker. </text></subparagraph></paragraph></section> <section commented="no" display-inline="no-display-inline" id="H687F64F1E81F45989F9EA81FB50E86D6" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Transitional provisions</header> <subsection commented="no" display-inline="no-display-inline" id="HE291B89EA613416583978691D0428A7F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 6 of the Joint Resolution entitled <quote>A Joint Resolution to approve the <quote>Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America</quote>, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H646F1507F0DF43EE91236E80CBDA7F43"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H5ABA908146874BA2970218761E9CC70D"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>2019</quote> and inserting <quote>2029</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8DC5C0E74A0A4C63B5D9E93874AE1675"><enum>(B)</enum><text display-inline="yes-display-inline">by amending paragraph (6) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H8B45ED5C11C54350981CC25488721579" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="HCF4C7C1D36DE475BB7BD24E01C00DBF7"><enum>(6)</enum><header display-inline="yes-display-inline">Fees for training united states workers</header> <subparagraph commented="no" display-inline="no-display-inline" id="HB45C1D4CE1244B2CA318A888548CEAC3"><enum>(A)</enum><header display-inline="yes-display-inline">Supplemental fee</header> <clause commented="no" display-inline="no-display-inline" id="HCF1CEAD0DD31494496ADE0E5E2986BFD"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In addition to fees imposed pursuant to section 286(m) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(m)</external-xref>) to recover the full costs of adjudication services, the Secretary shall impose an annual supplemental fee of $200 per nonimmigrant worker on each prospective employer who is issued a permit under subsection (d)(3) during the transition program. A prospective employer that is issued a permit with a validity period of longer than 1 year shall pay the fee for each year of requested validity at the time the permit is requested.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HEA08BC8F3FFF425892B5505F8C04811D"><enum>(ii)</enum><header display-inline="yes-display-inline">Inflation adjustment</header><text display-inline="yes-display-inline">Beginning in fiscal year 2020, the Secretary, through notice in the Federal Register, may annually adjust the supplemental fee imposed under clause (i) by a percentage equal to the annual change in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics.</text></clause> <clause commented="no" display-inline="no-display-inline" id="HD4182168E0114D48A99FE2A1F63C2814"><enum>(iii)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">Amounts collected pursuant to clause (i) shall be deposited into the Treasury of the Commonwealth Government for the sole and exclusive purpose of funding vocational education, apprenticeships, or other training programs for United States workers.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HEC17E8C486E64A1EAB4608E9F70654DC"><enum>(iv)</enum><header display-inline="yes-display-inline">Fraud prevention and detection fee</header><text display-inline="yes-display-inline">In addition to the fees described in clause (i), the Secretary—</text> <subclause commented="no" display-inline="no-display-inline" id="HDC93914A871B41A4A768451995778D42"><enum>(I)</enum><text display-inline="yes-display-inline">shall impose, on each prospective employer filing a petition under this subsection for one or more nonimmigrant workers, a $50 fraud prevention and detection fee; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H25C8FDF57BE74DB9947D22D976EF47AE"><enum>(II)</enum><text display-inline="yes-display-inline">shall deposit and use the fees collected under subclause (I) for the sole purpose of preventing and detecting immigration benefit fraud in the Northern Mariana Islands, in accordance with section 286(v)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(v)(2)(B)</external-xref>).</text></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HFC73F3AA369B449CBB1448A69B1FD9B3"><enum>(B)</enum><header display-inline="yes-display-inline">Plan for the expenditure of funds</header><text display-inline="yes-display-inline">Not later than 120 days before the first day of fiscal year 2020, and annually thereafter, the Governor of the Commonwealth Government shall submit to the Secretary of Labor—</text> 
<clause commented="no" display-inline="no-display-inline" id="HEA7E6719CEBC4895A1E5A08D63D78171"><enum>(i)</enum><text display-inline="yes-display-inline">a plan for the expenditures of amounts deposited under subparagraph (A)(iii);</text></clause> <clause commented="no" display-inline="no-display-inline" id="HA0C188DFF4A1464DB8FB6316D45CA7D4"><enum>(ii)</enum><text display-inline="yes-display-inline">a projection of the effectiveness of such expenditures in the placement of United States workers into jobs held by non-United States workers; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H4E861A49411D485DB19B512D848608BD"><enum>(iii)</enum><text display-inline="yes-display-inline">a report on the changes in employment of United States workers attributable to expenditures of such amounts during the previous year.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HD78C2F41AB2544D89234B4667C618A8C"><enum>(C)</enum><header display-inline="yes-display-inline">Determination and report</header><text display-inline="yes-display-inline">Not later than 120 days after receiving each expenditure plan under subparagraph (B)(i), the Secretary of Labor shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="HF3AE59A84AD645C1ACED462664D9A148"><enum>(i)</enum><text display-inline="yes-display-inline">issue a determination on the plan; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HC661ED57F49C493385E6D3B9617B0156"><enum>(ii)</enum><text display-inline="yes-display-inline">submit a report to Congress that describes the effectiveness of the Commonwealth Government at meeting the goals set forth in such plan.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H1013A394C0A64D37A165B734368CF051"><enum>(D)</enum><header display-inline="yes-display-inline">Payment restriction</header><text display-inline="yes-display-inline">Payments may not be made in a fiscal year from amounts deposited under subparagraph (A)(iii) before the Secretary of Labor has approved the expenditure plan submitted under subparagraph (B)(i) for that fiscal year.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD8BE6181E6FA4A47800F87CB3559F1E2"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H39269F18E1094B069C715BA1341D8E3B" style="OLC"> 
<paragraph commented="no" display-inline="no-display-inline" id="HA23F6BD30E8B4DE184B9402EDFFEE70B"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than December 1, 2027, the Secretary shall submit a report to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources of the Senate</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="">Committee on Natural Resources of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HD0ED00B1A22C492D897C2193D24EC34C"><enum>(A)</enum><text display-inline="yes-display-inline">projects the number of asylum claims the Secretary anticipates following the termination of the transition period; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7A01B45295D74FE4BDF6E8B0756BB9EC"><enum>(B)</enum><text display-inline="yes-display-inline">describes the efforts of the Secretary to ensure appropriate interdiction efforts, provide for appropriate treatment of asylum seekers, and prepare to accept and adjudicate asylum claims in the Commonwealth.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H511803B49C5F4974ABA0D385F853E59E"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d)—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H372D61073D784F6EA3429641DB1BFF19"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) through (5) as paragraphs (3) through (6), respectively;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H43FB49A0B96C443184BE5BF3870214CB"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H9EB4E81FBA5D47108021B089B99AC5AC" style="OLC"> 
<paragraph commented="no" display-inline="no-display-inline" id="H958FECC482704288A6C32653B94EAFB0"><enum>(2)</enum><header display-inline="yes-display-inline">Protection for united states workers</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0C54F472B353415FB61A5B761E24E2B2"><enum>(A)</enum><header display-inline="yes-display-inline">Temporary labor certification</header> 
<clause commented="no" display-inline="no-display-inline" id="HF5B92D3131C043D9BDA5A75366B620B6"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning with petitions filed with employment start dates in fiscal year 2020, a petition to import a nonimmigrant worker under this subsection may not be approved by the Secretary unless the petitioner has applied to the Secretary of Labor for a temporary labor certification confirming that—</text> <subclause commented="no" display-inline="no-display-inline" id="H0B2545A86CFD4890A0B5F5663C53B83C"><enum>(I)</enum><text display-inline="yes-display-inline">there are not sufficient United States workers in the Commonwealth who are able, willing, qualified, and available at the time and place needed to perform the services or labor involved in the petition; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H58796520CC6A467BA981CA369CCF1962"><enum>(II)</enum><text display-inline="yes-display-inline">employment of the nonimmigrant worker will not adversely affect the wages and working conditions of similarly employed United States workers.</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H5E903816DAD249FEA95A96F7E9727B49"><enum>(ii)</enum><header display-inline="yes-display-inline">Petition</header><text display-inline="yes-display-inline">After receiving a temporary labor certification under clause (i), a prospective employer may submit a petition to the Secretary for a Commonwealth Only Transitional Worker permit on behalf of the nonimmigrant worker.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0F35C6182B95405FBA59F64F81114BB5"><enum>(B)</enum><header display-inline="yes-display-inline">Prevailing wage survey</header> 
<clause commented="no" display-inline="no-display-inline" id="H86BE2A96F89C4A5689CE9A6A9D04A321"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In order to effectuate the requirement for a temporary labor certification under subparagraph (A)(i), the Secretary of Labor shall use, or make available to employers, an occupational wage survey conducted by the Governor that the Secretary of Labor has determined meets the statistical standards for determining prevailing wages in the Commonwealth on an annual basis.</text></clause> <clause commented="no" display-inline="no-display-inline" id="HE1007AE35EB74903AF8F95C81D82D13F"><enum>(ii)</enum><header display-inline="yes-display-inline">Alternative method for determining the prevailing wage</header><text display-inline="yes-display-inline">In the absence of an occupational wage survey approved by the Secretary of Labor under clause (i), the prevailing wage for an occupation in the Commonwealth shall be the arithmetic mean of the wages of workers similarly employed in the territory of Guam according to the wage component of the Occupational Employment Statistics Survey conducted by the Bureau of Labor Statistics.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H416BDAB963844051AC39C6C2C0F465F6"><enum>(C)</enum><header display-inline="yes-display-inline">Minimum wage</header><text display-inline="yes-display-inline">An employer shall pay each Commonwealth Only Transitional Worker a wage that is not less than the greater of—</text> <clause commented="no" display-inline="no-display-inline" id="H7EE5CF6A16D749B880D74C294975662A"><enum>(i)</enum><text display-inline="yes-display-inline">the statutory minimum wage in the Commonwealth;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HCA87B9A3F6CE4F519B3A005DD55C90CD"><enum>(ii)</enum><text display-inline="yes-display-inline">the Federal minimum wage; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HC7E09F8D2E4A456385159CB80BED5883"><enum>(iii)</enum><text display-inline="yes-display-inline">the prevailing wage in the Commonwealth for the occupation in which the worker is employed.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC1D305CD3FF3441F8146260C9B56BEF8"><enum>(C)</enum><text display-inline="yes-display-inline">by amending paragraph (3), as redesignated, to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HF36C50D4EAD545739B9B04DDD1684347" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="H253FEEDA3A04406FAF8AB05AD2F59D7B"><enum>(3)</enum><header display-inline="yes-display-inline">Permits</header> <subparagraph commented="no" display-inline="no-display-inline" id="H0697B2A8CBFA48A7B870512A65F91FB9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish, administer, and enforce a system for allocating and determining terms and conditions of permits to be issued to prospective employers for each nonimmigrant worker described in this subsection who would not otherwise be eligible for admission under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H78478C6F64B64CA68FCA214E1F6441C6"><enum>(B)</enum><header display-inline="yes-display-inline">Numerical cap</header><text display-inline="yes-display-inline">The number of permits issued under subparagraph (A) may not exceed—</text> <clause commented="no" display-inline="no-display-inline" id="H4A694B4DB26A4CDE8CC6F6B4F0CF4A74"><enum>(i)</enum><text display-inline="yes-display-inline">13,000 for fiscal year 2019;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HE9659C569E2D4F8B95A04D6333571E3B"><enum>(ii)</enum><text display-inline="yes-display-inline">12,500 for fiscal year 2020;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HCE1D7731719C426DA46C67AA1D5420D6"><enum>(iii)</enum><text display-inline="yes-display-inline">12,000 for fiscal year 2021;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HF1E78C6D56844FC388B991C9A6867411"><enum>(iv)</enum><text display-inline="yes-display-inline">11,500 for fiscal year 2022;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H7F0F43C3EE6E4C8DA96F93D7A9E4DBD9"><enum>(v)</enum><text display-inline="yes-display-inline">11,000 for fiscal year 2023;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HB5E9665A60834694A9ADF9A78CD274CF"><enum>(vi)</enum><text display-inline="yes-display-inline">10,000 for fiscal year 2024;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H77FB96AA30604E7FA2E41040DCC4BB11"><enum>(vii)</enum><text display-inline="yes-display-inline">9,000 for fiscal year 2025;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H576C860C469A4A0DA4193E2BE1D50D30"><enum>(viii)</enum><text display-inline="yes-display-inline">8,000 for fiscal year 2026;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H305397C04D92495E9B03E405A1119FAF"><enum>(ix)</enum><text display-inline="yes-display-inline">7,000 for fiscal year 2027;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H2BA49EA61B9E4E9E8F2BAEFC8C0D2B3A"><enum>(x)</enum><text display-inline="yes-display-inline">6,000 for fiscal year 2028;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H8B286DF085A841F9B6309C80031DC778"><enum>(xi)</enum><text display-inline="yes-display-inline">5,000 for fiscal year 2029; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H3B1250F35210407FA7D6792EFD58125C"><enum>(xii)</enum><text display-inline="yes-display-inline">1,000 for the first quarter of fiscal year 2030.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H52698FEC552F421CA113F23026CAD418"><enum>(C)</enum><header display-inline="yes-display-inline">Reports regarding the percentage of united states workers</header> <clause commented="no" display-inline="no-display-inline" id="H56514476A89842FF97F1EA3F4EF69133"><enum>(i)</enum><header display-inline="yes-display-inline">By governor</header><text display-inline="yes-display-inline">Not later than 60 days before the end of each calendar year, the Governor shall submit a report to the Secretary that identifies the ratio between United States workers and other workers in the Commonwealth’s workforce based on income tax filings with the Commonwealth for the tax year.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HF255502FFDCF4DCFBB6C64E4389C171D"><enum>(ii)</enum><header display-inline="yes-display-inline">By GAO</header><text display-inline="yes-display-inline">Not later than December 31, 2019, and biennially thereafter, the Comptroller General of the United States shall submit a report to the Chair and Ranking Member of the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources of the Senate,</committee-name> the Chair and Ranking Member of the <committee-name committee-id="">Committee on Natural Resources of the House of Representatives</committee-name>, the Chair and Ranking Member of the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name> and the Chair and Ranking Member of the <committee-name committee-id="">Committee on Education and the Workforce of the House of Representatives</committee-name> that identifies the ratio between United States workers and other workers in the Commonwealth’s workforce during each of the previous 5 calendar years.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC3F4925C08084575AFEE4966833F13DF"><enum>(D)</enum><header display-inline="yes-display-inline">Petition; issuance of permits</header> <clause commented="no" display-inline="no-display-inline" id="H97C3CED5F9C640D38D9DD3F7A462B13E"><enum>(i)</enum><header display-inline="yes-display-inline">Submission</header><text display-inline="yes-display-inline">A prospective employer may submit a petition for a permit under this paragraph not earlier than—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H5043725DDFB846A8930EC3E7B39EB738"><enum>(I)</enum><text display-inline="yes-display-inline">120 days before the date on which the prospective employer needs the beneficiary’s services; or</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H6E78EC47C62B4271968421366490C769"><enum>(II)</enum><text display-inline="yes-display-inline">if the petition is for the renewal of an existing permit, not earlier than 180 days before the expiration of such permit.</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H276DB4C4C31741249F3C091C46785341"><enum>(ii)</enum><header display-inline="yes-display-inline">Employment verification</header><text display-inline="yes-display-inline">The Secretary shall establish a system for each employer of a Commonwealth Only Transitional Worker to submit a semiannual report to the Secretary and the Secretary of Labor that provides evidence to verify the continuing employment and payment of such worker under the terms and conditions set forth in the permit petition that the employer filed on behalf of such worker.</text></clause> <clause commented="no" display-inline="no-display-inline" id="H0DF43BC1E6654A4E9997F6D50B2D3AA8"><enum>(iii)</enum><header display-inline="yes-display-inline">Revocation</header> <subclause commented="no" display-inline="no-display-inline" id="HEF1B7F2996164FC9976CFB2DE9E0F5A3"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in the Secretary’s discretion, may revoke a permit approved under this paragraph for good cause, including if—</text> 
<item commented="no" display-inline="no-display-inline" id="H0CF9C914C8D14841B1151DB12492DCD4"><enum>(aa)</enum><text display-inline="yes-display-inline">the employer fails to maintain the continuous employment of the subject worker, fails to pay the subject worker, fails to timely file a semiannual report required under this paragraph, commits any other violation of the terms and conditions of employment, or otherwise ceases to operate as a legitimate business (as defined in clause (iv)(II));</text></item> <item commented="no" display-inline="no-display-inline" id="H82F9C3920FE246C9B2C2F58987EDDB6D"><enum>(bb)</enum><text display-inline="yes-display-inline">the beneficiary of such petition does not apply for admission to the Commonwealth by the date that is 10 days after the period of petition validity begins, if the employer has requested consular processing; or</text></item> 
<item commented="no" display-inline="no-display-inline" id="H4EDF911A1A7A419A899349C11D9B2B9A"><enum>(cc)</enum><text display-inline="yes-display-inline">the employer fails to provide a former, current, or prospective Commonwealth Only Transitional Worker, not later than 21 business days after receiving a written request from such worker, with the original (or a certified copy of the original) of all petitions, notices, and other written communication related to the worker (other than sensitive financial or proprietary information of the employer, which may be redacted) that has been exchanged between the employer and the Department of Labor, the Department of Homeland Security, or any other Federal agency or department.</text></item></subclause> <subclause commented="no" display-inline="no-display-inline" id="H35F7A48B30734D4683E999A9FF7930CC"><enum>(II)</enum><header display-inline="yes-display-inline">Reallocation of revoked petition</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (C), for each permit revoked under subclause (I) in a fiscal year, an additional permit shall be made available for use in the subsequent fiscal year.</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H3B35DD9A18FD41239A8E7B91D97F88AD"><enum>(iv)</enum><header display-inline="yes-display-inline">Legitimate business</header> 
<subclause commented="no" display-inline="no-display-inline" id="H182B91C1E6D346979904D20E84BB5ED0"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A permit may not be approved for a prospective employer that is not a legitimate business.</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H259533DDE6E54245B728177E6EDACA8D"><enum>(II)</enum><header display-inline="yes-display-inline">Defined term</header><text display-inline="yes-display-inline">In this clause, the term <term>legitimate business</term> means a real, active, and operating commercial or entrepreneurial undertaking that the Secretary, in the Secretary’s sole discretion, determines—</text> 
<item commented="no" display-inline="no-display-inline" id="H9CA1095B2E3846008F639FB33221C191"><enum>(aa)</enum><text display-inline="yes-display-inline">produces services or goods for profit, or is a governmental, charitable, or other validly recognized nonprofit entity;</text></item> <item commented="no" display-inline="no-display-inline" id="H0E48D528D70F42D8BA288D1051F30292"><enum>(bb)</enum><text display-inline="yes-display-inline">meets applicable legal requirements for doing business in the Commonwealth;</text></item> 
<item commented="no" display-inline="no-display-inline" id="H8B7C8B2B64C54CDBBE8B533F3984A8C5"><enum>(cc)</enum><text display-inline="yes-display-inline">has substantially complied with wage and hour laws, occupational safety and health requirements, and all other Federal, Commonwealth, and local requirements related to employment during the preceding 5 years;</text></item> <item commented="no" display-inline="no-display-inline" id="H2A7AC47E48984004A63FA2BA3394E8B6"><enum>(dd)</enum><text display-inline="yes-display-inline">does not directly or indirectly engage in, or knowingly benefit from, prostitution, human trafficking, or any other activity that is illegal under Federal, Commonwealth, or local law; </text></item> 
<item commented="no" display-inline="no-display-inline" id="H9E6DADEDAA91402B9BE0E9752638A619"><enum>(ee)</enum><text display-inline="yes-display-inline">is a participant in good standing in the E-Verify program;</text></item> <item id="H3AB11403D4F44181A4F38FD39DF6BC04"><enum>(ff)</enum><text>does not have, as an owner, investor, manager, operator, or person meaningfully involved with the undertaking, any individual who has been the owner, investor, manager, operator, or otherwise meaningfully involved with an undertaking that does not comply with item (cc) or (dd), or is the agent of such an individual; and</text></item> 
<item id="HD5CEA327E92F443B97F5889D67BA45E9"><enum>(gg)</enum><text>is not a successor in interest to an undertaking that does not comply with item (cc) or (dd).</text></item></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H07F3FCC6B0E743519B40DEF1A161B6D8"><enum>(v)</enum><header display-inline="yes-display-inline">Construction occupations</header><text display-inline="yes-display-inline">A permit for Construction and Extraction Occupations (as defined by the Department of Labor as Standard Occupational Classification Group 47–0000) may not be issued for any worker other than a worker described in paragraph (7)(B).</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H169A8F8BA90B4EC6BAC61A50297AC1D3"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (4), as redesignated, by inserting <quote>or to Guam for the purpose of transit only</quote> after <quote>except admission to the Commonwealth</quote>;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H75ADFC9447AC4897905C69683272C44C"><enum>(E)</enum><text display-inline="yes-display-inline">in paragraph (5), as redesignated, by adding at the end the following: <quote>Approval of a petition filed by the new employer with a start date within the same fiscal year as the current permit shall not count against the numerical limitation for that period.</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE39D4A0BB1F54018B0DCA7679F80B792"><enum>(F)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H8DD5FDB0869D4B1498159764D04EB010" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="H0B1E84EF905345A6B0C9FC77BE38B67F"><enum>(7)</enum><header display-inline="yes-display-inline">Requirement to remain outside of the united states</header> <subparagraph commented="no" display-inline="no-display-inline" id="H96E17B678AA74F7AAE4339FF13B39096"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B)—</text> 
<clause commented="no" display-inline="no-display-inline" id="HAAF9EAE227804AE1965183C916FB9ABB"><enum>(i)</enum><text display-inline="yes-display-inline">a permit for a Commonwealth Only Transitional Worker—</text> <subclause commented="no" display-inline="no-display-inline" id="HB71714353BEA4DFB8863ECCE4E898A32"><enum>(I)</enum><text display-inline="yes-display-inline">shall remain valid for a period that may not exceed 1 year; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HB3A2B3F11EF849AEA696EAF46F1EB2CF"><enum>(II)</enum><text display-inline="yes-display-inline">may be renewed for not more than two consecutive, 1-year periods; and</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H2BE81294CDCD4AB39B490A8D41B9F5C7"><enum>(ii)</enum><text display-inline="yes-display-inline">at the expiration of the second renewal period, an alien may not again be eligible for such a permit until after the alien has remained outside of the United States for a continuous period of at least 30 days prior to the submission of a renewal petition on their behalf.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H00942ECDC1DF4FA285A2B1BF17FE8A9C"><enum>(B)</enum><header display-inline="yes-display-inline">Long-term workers</header><text display-inline="yes-display-inline">An alien who was admitted to the Commonwealth as a Commonwealth Only Transitional Worker during fiscal year 2015, and during every subsequent fiscal year beginning before the date of the enactment of the <short-title>Northern Mariana Islands U.S. Workforce Act of 2018</short-title>, may receive a permit for a Commonwealth Only Transitional Worker that is valid for a period that may not exceed 3 years and may be renewed for additional 3-year periods during the transition period. A permit issued under this subparagraph shall be counted toward the numerical cap for each fiscal year within the period of petition validity.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HCB9A499A540A441990E7387381C10C7F"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H81C6F4BDCE5F4CED8C657078AD0E619F"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H36FDD875F82E4946A6F70F470C41DB85"><enum>(1)</enum><header display-inline="yes-display-inline">Commonwealth</header><text display-inline="yes-display-inline">The term <term>Commonwealth</term> means the Commonwealth of the Northern Mariana Islands.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE76A69EFF373497AB76A11518FACB923"><enum>(2)</enum><header display-inline="yes-display-inline">Commonwealth only transition worker</header><text display-inline="yes-display-inline">The term <term>Commonwealth Only Transition Worker</term> means an alien who has been admitted into the Commonwealth under the transition program and is eligible for a permit under subsection (d)(3).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H85488E6DB74645EE89AD6B59DE7050AC"><enum>(3)</enum><header display-inline="yes-display-inline">Governor</header><text display-inline="yes-display-inline">The term <term>Governor</term> means the Governor of the Commonwealth of the Northern Mariana Islands.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H74691AD05987496B8FEBF72B2779FE8C"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE8560786A5F44F8EB52E2869B0126755"><enum>(5)</enum><header display-inline="yes-display-inline">Tax year</header><text display-inline="yes-display-inline">The term <term>tax year</term> means the fiscal year immediately preceding the current fiscal year.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H1C7CCB2DD17147B085D9F253A66D90B2"><enum>(6)</enum><header display-inline="yes-display-inline">United States worker</header><text display-inline="yes-display-inline">The term <term>United States worker</term> means any worker who is—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HD17E4D861E14428F96D09399EB2A1FD2"><enum>(A)</enum><text display-inline="yes-display-inline">a citizen or national of the United States;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFD21CE332FE04C78BD0B0FB50973F680"><enum>(B)</enum><text display-inline="yes-display-inline">an alien who has been lawfully admitted for permanent residence; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H37420B1ABF3145539F68FF1AEA2EDFB3"><enum>(C)</enum><text display-inline="yes-display-inline">a citizen of the Republic of the Marshall Islands, the Federated States of Micronesia, or the Republic of Palau (known collectively as the <quote>Freely Associated States</quote>) who has been lawfully admitted to the United States pursuant to—</text> 
<clause commented="no" display-inline="no-display-inline" id="H606CF52CD9F64BEFBF166C9E54677CDE"><enum>(i)</enum><text display-inline="yes-display-inline">section 141 of the Compact of Free Association between the Government of the United States and the Governments of the Marshall Islands and the Federated States of Micronesia (<external-xref legal-doc="usc" parsable-cite="usc/48/1921">48 U.S.C. 1921</external-xref> note); or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HAC8F35E0292844308811A0B7C5373431"><enum>(ii)</enum><text display-inline="yes-display-inline">section 141 of the Compact of Free Association between the United States and the Government of Palau (<external-xref legal-doc="usc" parsable-cite="usc/48/1931">48 U.S.C. 1931</external-xref> note).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H27807CC7CCCC49FA83540FE3F9D164BE"><enum>(b)</enum><header display-inline="yes-display-inline">Rulemaking</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H881A2F8CB06342308427A65FD178BD40"><enum>(1)</enum><header display-inline="yes-display-inline">Secretary of homeland security</header><text display-inline="yes-display-inline">Notwithstanding the requirements under section 553(b) of title 5, United States Code, the Secretary of Homeland Security shall publish in the Federal Register, not later than 180 days after the date of the enactment of this Act, an interim final rule that specifies how the Secretary intends to implement the amendments made by subsection (a) that relate to the responsibilities of the Secretary.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HBCDC926F3CD84E59BD6E702FB2FFED4B"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary of labor</header><text display-inline="yes-display-inline">Notwithstanding the requirements under section 553(b) of title 5, United States Code, the Secretary of Labor shall publish in the Federal Register, not later than 180 days after the date of the enactment of this Act, an interim final rule that specifies how the Secretary intends to implement the amendments made by subsection (a) that relate to the responsibilities of the Secretary.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H460EACD7F7E14C8BBCBBB92F54255C62"><enum>(3)</enum><header display-inline="yes-display-inline">Recommendations of the governor</header><text display-inline="yes-display-inline">In developing the interim final rules under paragraphs (1) and (2), the Secretary of Homeland Security and the Secretary of Labor—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H0F1BA1E19C9C4A5BB53AA3DC2CFB6114"><enum>(A)</enum><text display-inline="yes-display-inline">shall each consider, in good faith, any written public recommendations regarding the implementation of this Act that are submitted by the Governor of the Commonwealth not later than 60 days after the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFDD72F7E6D7644DE885E13B5E1B09845"><enum>(B)</enum><text display-inline="yes-display-inline">may include provisions in such rule that are responsive to any recommendation of the Governor that is not inconsistent with this Act, including a recommendation to reserve a number of permits each year for occupational categories necessary to maintain public health or safety in the Commonwealth.</text></subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H32DE6F82D43147F685E9DEAAD544BC3A"><enum>(c)</enum><header display-inline="yes-display-inline">Department of the Interior technical assistance</header><text display-inline="yes-display-inline">Not later than October 1, 2019, and biennially thereafter, the Secretary of the Interior shall submit a report to Congress that describes the fulfillment of the Department of the Interior’s responsibilities to the Commonwealth of the Northern Mariana Islands—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H4C23BBA89EC94DD8A5DE814D7CCF4E74"><enum>(1)</enum><text display-inline="yes-display-inline">to identify opportunities for economic growth and diversification;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB52B372DE3F74651A52D13950DAD2F84"><enum>(2)</enum><text display-inline="yes-display-inline">to provide assistance in recruiting, training, and hiring United States workers; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8A20E490B7B047FB8448809D97CD8CAD"><enum>(3)</enum><text display-inline="yes-display-inline">to provide such other technical assistance and consultation as outlined in section 702(e) of the Consolidated Natural Resources Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/48/1807">48 U.S.C. 1807</external-xref>).</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H4777AAAEEB9B451D9295B815F4DDD889"><enum>(d)</enum><header display-inline="yes-display-inline">Outreach and training</header><text display-inline="yes-display-inline">Not later than 120 days after the date on which the Secretary of Labor publishes an interim final rule in the Federal Register in accordance with subsection (b)(2), the Secretary shall conduct outreach and training in the Commonwealth of the Northern Mariana Islands for employers and workers on the foreign labor certification process set forth in section 6 of the Joint Resolution entitled <quote>A Joint Resolution to approve the <quote>Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America</quote>, and for other purposes</quote>, as amended by subsection (b), including the minimum wage requirement set forth in subsection (d)(2)(C) of such section.</text></subsection> 
<subsection id="HC5A88B0544184BECA9574784BFCCDAE3"><enum>(e)</enum><header>Effective date</header> 
<paragraph id="HC49D55BB5E864AD5AFBB1DFE8EAD5989"><enum>(1)</enum><header>In general</header><text>Except as specifically otherwise provided, this Act and the amendments made by this Act—</text> <subparagraph id="H8DC9D90AB033460A8E1342D4C8708D07"><enum>(A)</enum><text>shall take effect on the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph id="H9BBB2B71EA9443BBB0366E91F72B2524"><enum>(B)</enum><text>shall apply to petitions for Commonwealth Only Transitional Workers filed on or after such date.</text></subparagraph></paragraph> <paragraph id="H9E4AFAE936F5494EAF493A2A10EB0A04"><enum>(2)</enum><header>Authority of secretary of homeland security</header><text>The Secretary of Homeland Security, in the Secretary’s discretion, may delay the effective date of any provision of this Act relating to Commonwealth Only Transition Workers until the effective date of the interim final rule described in subsection (b), except for provisions providing annual numerical caps for such workers.</text></paragraph></subsection></section>
