<congress display="no">115th CONGRESS</congress><session display="no">2d Session</session><legis-num display="no">H.R. 3342</legis-num><current-chamber display="yes">In the Senate of the United States,</current-chamber><action><action-date date="20181011">October 11, 2018.</action-date></action><legis-type display="yes">Amendments:</legis-type></engrossed-amendment-form><engrossed-amendment-body><section id="idc989b3f4d25a4b04836cd8579ed1a4c1" section-type="resolved"><text>That the bill from the House of Representatives (H.R. 3342) entitled <quote>An Act to impose sanctions on foreign persons that are responsible for gross violations of internationally recognized human rights by reason of the use by Hizballah of civilians as human shields, and for other purposes.</quote>, do pass with the following</text></section><amendment><amendment-instruction blank-lines-after="0"><text>Strike all after the enacting clause and insert the following:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic"><section id="id6c9b15ae1a2843398a34dad0a5035d3e" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sanctioning the Use of Civilians as Defenseless Shields Act</short-title></quote>.</text></section><section id="ida59098d13c4d4add83c5de4dbbe5a859"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It shall be the policy of the United States to officially and publicly condemn the use of innocent civilians as human shields.</text></section><section id="idcb4fb9e29aec453ab9ff21a02db73ead"><enum>3.</enum><header>Imposition of sanctions with respect to foreign persons that are responsible for the use of
 civilians as human shields</header><subsection id="id154c61ffff8949d3a04bb91195b5e1ef"><enum>(a)</enum><header>Imposition of sanctions</header><paragraph id="idE16BCAADC69B46D19E12540DE9BC384B"><enum>(1)</enum><header>Mandatory sanctions</header><text>The President shall impose sanctions described in subsection (d) with respect to each person on the list required under subsection (b).</text></paragraph><paragraph id="id119D8149C7594301B10F8CCBC9A0802C"><enum>(2)</enum><header>Permissive sanctions</header><text>The President may impose sanctions described in subsection (d) with respect to each person on the list described in subsection (c).</text></paragraph></subsection><subsection id="ida7fa2660db894cb587e1090f84013adf"><enum>(b)</enum><header>Mandatory sanctions list</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter, the President shall submit to the appropriate congressional committees a list of the following:</text><paragraph id="id3598d4334fd84be2929181a66d7b985f"><enum>(1)</enum><text>Each foreign person that the President determines, on or after the date of the enactment of this Act—</text><subparagraph id="idb9aab62c87b24938b5959523ee7a516d"><enum>(A)</enum><text>is a member of Hizballah or is knowingly acting on behalf of Hizballah; and</text></subparagraph><subparagraph id="idc2558c9c38ba418ebd7b552ae8b7aa64"><enum>(B)</enum><text>knowingly orders, controls, or otherwise directs the use of civilians protected as such by the law of war to shield military objectives from attack.</text></subparagraph></paragraph><paragraph id="id42D48AC09C2F40AA81E49EE372629210"><enum>(2)</enum><text>Each foreign person that the President determines, on or after the date of the enactment of this Act—</text><subparagraph id="idD5D1573D9A29476798ABF24D3815256C"><enum>(A)</enum><text>is a member of Hamas or is knowingly acting on behalf of Hamas; and</text></subparagraph><subparagraph id="id274e206b6aa345189f8d49b4beb08f67"><enum>(B)</enum><text>knowingly orders, controls, or otherwise directs the use of civilians protected as such by the law of war to shield military objectives from attack.</text></subparagraph></paragraph><paragraph id="id0043d58970214a64bc4f160146d5a4e1"><enum>(3)</enum><text>Each foreign person or agency or instrumentality of a foreign state that the President determines, on or after the date of the enactment of this Act, knowingly and materially supports, orders, controls, directs, or otherwise engages in—</text><subparagraph id="id1f98dfe49cde44bdbc70546176728fdc"><enum>(A)</enum><text>any act described in subparagraph (B) of paragraph (1) by a person described in that paragraph; or</text></subparagraph><subparagraph id="idd50f6bdeb3c44b10b4d995be99fba36b"><enum>(B)</enum><text>any act described in subparagraph (B) of paragraph (2) by a person described in that paragraph.</text></subparagraph></paragraph></subsection><subsection id="id2792792b14534d3b9a8f244a623c6d4c"><enum>(c)</enum><header>Permissive sanctions list</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter, the President should submit to the appropriate congressional committees a list of each foreign person that the President determines, on or after the date of the enactment of this Act, knowingly orders, controls, or otherwise directs the use of civilians protected as such by the law of war to shield military objectives from attack, excluding foreign persons included in the most recent list under subsection (b).</text></subsection><subsection id="id5ed3b82f4b7d4a2a8f78f7657ae820c3"><enum>(d)</enum><header>Sanctions described</header><text>The sanctions to be imposed on a foreign person or an agency or instrumentality of a foreign state under this subsection are the following:</text><paragraph id="idf52963eb7d714c87ad21abff6b9c443f"><enum>(1)</enum><header>Blocking of property</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) to the extent necessary to block and prohibit all transactions in property and interests in property of the foreign person or agency or instrumentality of a foreign state if such property or interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="id32b69cd92d8441a89a0b894a083f8f95"><enum>(2)</enum><header>Aliens ineligible for visas, admission, or parole</header><subparagraph id="idcc2ac02fe697435cb03f8ac870391d63"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien who the Secretary of State or the Secretary of Homeland Security determines is subject to sanctions under subsection (a) is—</text><clause id="idfa53f5323a874429a13811213d3d65f2"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="idb7354a91640e4a09b2b4321cf9349be9"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause><clause id="idddb23d1ba2e241d0b3294730192fca6d"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text></clause></subparagraph><subparagraph id="idccc8664a44cf42cabfd88ef2d6460830"><enum>(B)</enum><header>Current visas revoked</header><text>Any visa or other documentation issued to an alien who is subject to sanctions under subsection (a), regardless of when such visa or other documentation was issued, shall be revoked and such alien shall be denied admission to the United States.</text></subparagraph><subparagraph id="id494a64e931de41ba88623c29a1ff63e6"><enum>(C)</enum><header>Exception to comply with United Nations Headquarters agreement and other international obligations</header><text>The sanctions under this paragraph shall not be imposed on an individual if admitting such individual to the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or with other applicable international obligations.</text></subparagraph></paragraph></subsection><subsection id="id68bccc041f4444e8a0a066cb14f60b4c"><enum>(e)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that knowingly violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed to carry out this section to the same extent that such penalties apply to a person that knowingly commits an unlawful act described in section 206(a) of such Act.</text></subsection><subsection id="idb245138ced804a63ac499fadc3749d17"><enum>(f)</enum><header>Procedures for judicial review of classified information</header><paragraph id="idae360e74f8aa4ff89285a66ec6a63c23"><enum>(1)</enum><header>In general</header><text>If a finding under this section, or a prohibition, condition, or penalty imposed as a result of any such finding, is based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (18 U.S.C. App.)) and a court reviews the finding or the imposition of the prohibition, condition, or penalty, the President may submit such information to the court ex parte and in camera.</text></paragraph><paragraph id="iddcb642f27f6d4daf88de77dfd113adaa"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to confer or imply any right to judicial review of any finding under this section or any prohibition, condition, or penalty imposed as a result of any such finding.</text></paragraph></subsection><subsection id="idf563d34c47434bd39fa14e05892a37d3"><enum>(g)</enum><header>Waiver</header><text>The President may waive the application of sanctions under this section if the President determines and reports to the appropriate congressional committees that such waiver is in the national security interest of the United States.</text></subsection><subsection id="iddd233c2d4f9c4ae2957893c16ed59568"><enum>(h)</enum><header>Regulatory authority</header><paragraph id="id0711d975aa23436b87be82095151c145"><enum>(1)</enum><header>In general</header><text>The President may exercise all authorities under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) for purposes of carrying out this section.</text></paragraph><paragraph id="idad393dd65eb047f995536f0678821eea"><enum>(2)</enum><header>Issuance of regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall prescribe such regulations as may be necessary to implement this section.</text></paragraph></subsection><subsection id="id19ff2754e01e465f9acbeebc29a9339d"><enum>(i)</enum><header>Rule of construction</header><text>Nothing in this section may be construed—</text><paragraph id="id9b1a41ef4c29475b8314307767f2739e"><enum>(1)</enum><text>to limit the authorities of the President pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) or any other relevant provision of law; or</text></paragraph><paragraph id="ide2f02b40b7b2494ba1ccf56b1fd9bbe6"><enum>(2)</enum><text>to apply with respect to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091</external-xref> et seq.), or to any authorized intelligence activities of the United States.</text></paragraph></subsection></section><section id="idb11e41420ed044eab160912256f8735b"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id23e139db287648769ac506682c04bfcd"><enum>(1)</enum><header>Admitted; alien</header><text>The terms <term>admitted</term> and <term>alien</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="id1e01cfc17fb24a17a2a3d5e5ca25dc48"><enum>(2)</enum><header>Agency or instrumentality of a foreign state</header><text>The term <term>agency or instrumentality of a foreign state</term> has the meaning given that term in section 1603(b) of title 28, United States Code.</text></paragraph><paragraph id="id6e07c1984e604468aa3f19cc6c028535"><enum>(3)</enum><header>Appropriate congressional committees</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0443FAF813E941E690670EEBC6343F8F"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, and the Committee on the Judiciary of the Senate; and</text></subparagraph><subparagraph id="id897046f282ee4f9cb0a203208ea5fefb"><enum>(B)</enum><text>the Committee on Financial Services, the Committee on Foreign Affairs, and the Committee on the Judiciary of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idcffb4b10c3b943cf8c2225d1b9c7dc07"><enum>(4)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means—</text><subparagraph id="id93A1C0390DD2413F9D223AF2C479FFD4"><enum>(A)</enum><text>any citizen or national of a foreign state, wherever located; or</text></subparagraph><subparagraph id="id75766B6F7B9A4383A1B959B4888DD7B2"><enum>(B)</enum><text>any entity not organized solely under the laws of the United States or existing solely in the United States.</text></subparagraph></paragraph><paragraph id="id97b95d33ff8f49fe97ba02b4cae7a446"><enum>(5)</enum><header>Hamas</header><text>The term <term>Hamas</term> means—</text><subparagraph id="id7aacd66f8c5a47139c54e134f43316ed"><enum>(A)</enum><text>the entity known as Hamas and designated by the Secretary of State as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); or</text></subparagraph><subparagraph id="id17b97b0005d0409eb33389326ad4531e"><enum>(B)</enum><text>any person identified as an agent or instrumentality of Hamas on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Asset Control of the Department of the Treasury, the property or interests in property of which are blocked pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="id9766244f7ab54e5e9c985b06a2f346d0"><enum>(6)</enum><header>Hizballah</header><text>The term <term>Hizballah</term> means—</text><subparagraph id="idfecc08f2795142ada20346abd272c59e"><enum>(A)</enum><text>the entity known as Hizballah and designated by the Secretary of State as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); or</text></subparagraph><subparagraph id="idd673e2bce23745e5a2a93b89c89c8055"><enum>(B)</enum><text>any person identified as an agent or instrumentality of Hizballah on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Asset Control of the Department of the Treasury, the property or interests in property of which are blocked pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="id0ac8b72e57dd4c7891fab3b11fa43123"><enum>(7)</enum><header>United States person</header><text>The term <term>United States person</term> means any United States citizen, permanent resident alien, entity organized under the laws of the United States (including foreign branches), or any person in the United States.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="idaa77b1f2608f48abadcef120d0c2e681" section-type="subsequent-section"><enum>5.</enum><header>Sunset</header><text display-inline="no-display-inline">This Act shall cease to be effective on December 31, 2023.</text></section></amendment-block></amendment></engrossed-amendment-body><title-amends><official-title-amendment>Amend the title so as to read: <quote>An Act to impose sanctions with respect to foreign persons that are responsible for using civilians as human shields, and for other purposes.</quote>.</official-title-amendment></title-amends><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
