<section id="HD440BD21D3B54B2CB51121713A640AA1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broader Options for Americans Act</short-title></quote>. </text></section> <section id="H0C294B7013EB441E880DC7D8DB10FA17"><enum>2.</enum><header>Premium tax credit allowed with respect to unsubsidized COBRA continuation coverage</header> <subsection id="HCEC04186EA78417D95488C27C6917171"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(f)</external-xref> of the Internal Revenue Code of 1986 is amended—</text>
<paragraph id="H4DCAE7E0B8374135A945A75F175822C6"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after <quote>in section 9832(b))</quote> the following: <quote>offered in the individual health insurance market within a State (within the meaning of section 5000A(f)(1)(C)), or any unsubsidized COBRA continuation coverage,</quote>, and</text></paragraph> <paragraph id="HBBA951DEF90A4F4EB98CD02AF2EA3106"><enum>(2)</enum><text>by striking paragraph (1) and by redesignating paragraphs (2), (3), (4), and (5) as paragraphs (1), (2), (3), and (4), respectively. </text></paragraph></subsection>
<subsection id="H802A955F2DB84724B1926429BF681CB3" indent="up1"><enum>(b)</enum><header>Certification of unsubsidized COBRA continuation coverage</header><text display-inline="yes-display-inline">Section 36B(g) of such Code is amended by redesignating paragraph (9) as paragraph (10) and by inserting after paragraph (8) the following new paragraph:</text> <quoted-block style="OLC" id="H9FBAAD433133481EB1B777B0ACEB4EE7" display-inline="no-display-inline"> <paragraph id="H1C7642C56A9846569A00D2800904C4A3"><enum>(9)</enum><header>Special rule for unsubsidized COBRA continuation coverage</header><text display-inline="yes-display-inline">In the case of unsubsidized COBRA continuation coverage—</text>
<subparagraph id="H63B54DEBCB1544FF9A4102937B85C23D"><enum>(A)</enum><text display-inline="yes-display-inline">subsection (d)(1) shall be applied by substituting <quote>COBRA continuation coverage which is certified by the plan administrator (as defined in section 414(g)) of the group health plan</quote> for <quote>health insurance coverage which is certified by the State in which such insurance is offered</quote>, and</text></subparagraph> <subparagraph id="H044574D7A6A4421F8B5FAC127C278CA7"><enum>(B)</enum><text display-inline="yes-display-inline">the requirements of paragraph (8) shall be treated as satisfied if the certification meets such requirements as the Secretary may provide.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H0D4F1D1691D445758A2CB24A1C240C82" indent="up1"><enum>(c)</enum><header>Unsubsidized COBRA continuation coverage</header><text>Section 36B of such Code is amended by adding at the end the following new subsection: </text> <quoted-block style="OLC" id="HE653A88CABCA493291E14985655B29EC" display-inline="no-display-inline"> <subsection id="H94F91EE42F474C319E93E8A26794EA9B"><enum>(h)</enum><header>Unsubsidized COBRA continuation coverage</header><text display-inline="yes-display-inline">For purposes of this section—</text>
<paragraph id="H30A6ED2D81E64EC084EDECDB960CD58A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>unsubsidized COBRA continuation coverage</quote> means COBRA continuation coverage the payment of applicable premiums (as defined in section 4980B(f)(4)) for which is solely the obligation of the taxpayer.</text></paragraph> <paragraph id="HDE7F7EC337C54AE2BC52C40B23CD27D7"><enum>(2)</enum><header>COBRA continuation coverage</header><text>The term <quote>COBRA continuation coverage</quote> means continuation coverage provided—</text>
<subparagraph id="H4606C6F844FD4837B01DC41D054FA741"><enum>(A)</enum><text>pursuant to part 6 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 (other than under sections 602(5) and 609), title XXII of the Public Health Service Act, section 4980B (other than subsection (f)(1) thereof insofar as it relates to pediatric vaccines), or section 8905a of title 5, United States Code,</text></subparagraph> <subparagraph id="HA2C463A9C89944AFBF0C32A269FDEAAB"><enum>(B)</enum><text>under a State law or program that provides coverage comparable to coverage described in subparagraph (A), or</text></subparagraph>
<subparagraph id="H5ABF78FC96C0419BB7495D1E05A2AABE"><enum>(C)</enum><text display-inline="yes-display-inline">under a group health plan that is a church plan (as defined in section 414(e)) and is comparable to coverage provided pursuant to section 4980B.</text></subparagraph><continuation-text continuation-text-level="paragraph">Such term shall not include coverage under a health flexible spending arrangement.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7729EDF8E6D841198DEF2847DFC5AD11"><enum>(d)</enum><header>Conforming amendment</header> <paragraph id="HD1E803C171F84E68BFA32BC5DA408B4A"><enum>(1)</enum><text>Section 36B(d)(2)(A) is amended by inserting <quote>COBRA continuation coverage or</quote> after <quote>other than</quote>.</text></paragraph>
<paragraph id="HAC6495E7351F4483B32C66A6783C5D3A"><enum>(2)</enum><text>Section 36B(g)(6) of such Code is amended by striking <quote>subsection (f)(5)</quote> and inserting <quote>subsection (f)(4)</quote>. </text></paragraph></subsection> <subsection id="H8A47391685C44A199C1D38163A151454" indent="up1"><enum>(e)</enum><header>Amendment of section <enum-in-header>36B</enum-in-header> as amended by American Health Care Act of <enum-in-header>2017</enum-in-header></header><text display-inline="yes-display-inline">Whenever in this section an amendment is expressed in terms of an amendment to <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B</external-xref> of the Internal Revenue Code of 1986, the reference shall be considered to be made to such section as amended by the American Health Care Act of 2017 and in effect for months beginning after December 31, 2019.</text></subsection>
<subsection id="H61160E7294544A909F69350A0A769001" indent="up1"><enum>(f)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section are contingent upon the enactment of the American Health Care Act of 2017 and shall apply (if at all) to months beginning after December 31, 2019, in taxable years ending after such date.</text></subsection></section> </legis-body> <endorsement display="yes"> <action-date date="20170602">June 2, 2017</action-date> <action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement> </bill>
