 <section id="HED430B4CE531423096C0EC1C623636A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bankruptcy Judgeship Act of 2017</short-title></quote>.</text> </section><section commented="no" id="HD840C07A1FD44E98B24272039E3D5ADE"><enum>2.</enum><header>Conversion of the temporary office of bankruptcy judge to the permanent office of bankruptcy judge in certain judicial districts</header> <subsection commented="no" id="HFF3751D227294F69A82CE8CBA0AA93AF"><enum>(a)</enum><header>District of Delaware</header> <paragraph commented="no" id="HA1803FAB47C54183A28D7F3BF0B0160A"><enum>(1)</enum><text display-inline="yes-display-inline">The temporary office of four bankruptcy judges authorized for the district of Delaware by section 1223(b)(1)(C) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 197; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 2(a)(1)(C) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 346; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and represented in the amendment made by section 3(1) of this Act, and may be filled.</text>
 </paragraph><paragraph commented="no" id="H0A8F66342B944440A5EEB2256848897B"><enum>(2)</enum><text display-inline="yes-display-inline">The temporary office of bankruptcy judge authorized for the district of Delaware by section 3(a)(3) of <external-xref legal-doc="public-law" parsable-cite="pl/102/361">Public Law 102–361</external-xref> (106 Stat. 966; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 1223(c)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 198; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) and section 2(b)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 347; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and represented in the amendment made by section 3(1) of this Act, and may be filled.</text>
 </paragraph></subsection><subsection commented="no" id="H53EF5578339443F78D899F572F8AC858"><enum>(b)</enum><header>Southern District of Florida</header><text display-inline="yes-display-inline">The temporary office of two bankruptcy judges authorized for the southern district of Florida by section 1223(b)(1)(D) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 197; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 2(a)(1)(D) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 346; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and represented in the amendment made by section 3(3) of this Act, and may be filled.</text>
 </subsection><subsection commented="no" id="HE0645E2188EB456C800106EF7F7E5F98"><enum>(c)</enum><header>District of Maryland</header><text display-inline="yes-display-inline">The temporary office of one bankruptcy judge first appointed as authorized for the district of Maryland by section 1223(b)(1)(F) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 197; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 2(a)(1)(F) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 346; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and represented in the amendment made by section 3(4) of this Act, and may be filled.</text>
 </subsection><subsection commented="no" id="HC4BD538BA6434705897ECCE54760ED5B"><enum>(d)</enum><header>Eastern District of Michigan</header><text display-inline="yes-display-inline">The temporary office of bankruptcy judge authorized for the eastern district of Michigan by section 1223(b)(1)(G) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 197; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 2(a)(1)(G) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 346; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and represented in the amendment made by section 3(5) of this Act, and may be filled.</text>
 </subsection><subsection commented="no" id="HA063AB6C09C74416A2B3DEF85AB9B52A"><enum>(e)</enum><header>District of Nevada</header><text display-inline="yes-display-inline">The temporary office of bankruptcy judge authorized for the district of Nevada by section 1223(b)(1)(T) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 197; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 2(a)(1)(Q) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 346; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and represented in the amendment made by section 3(6) of this Act, and may be filled.</text>
 </subsection><subsection commented="no" id="H4A03542AE61F4F75914F4F6B39458C2D"><enum>(f)</enum><header>Eastern District of North Carolina</header><text display-inline="yes-display-inline">The temporary office of bankruptcy judge authorized for the eastern district of North Carolina by section 1223(b)(1)(M) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 197; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 2(a)(1)(J) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 346; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and represented in the amendment made by section 3(7) of this Act, and may be filled.</text>
			</subsection><subsection commented="no" id="H198FB16EA5C64F588D9263E0DB77BBFB"><enum>(g)</enum><header>District of Puerto Rico</header>
 <paragraph commented="no" id="H167A31DCA52E40499F730FE65EFBFD95"><enum>(1)</enum><text display-inline="yes-display-inline">The temporary office of bankruptcy judge authorized for the district of Puerto Rico by section 1223(b)(1)(P) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 197; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 2(a)(1)(M) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 346; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and represented in the amendment made by section 3(8) of this Act, and may be filled.</text>
 </paragraph><paragraph commented="no" id="H87EB2D791B984FEEAD6FA63274AD6B80"><enum>(2)</enum><text display-inline="yes-display-inline">The temporary office of bankruptcy judge authorized for the district of Puerto Rico by section 3(a)(7) of <external-xref legal-doc="public-law" parsable-cite="pl/102/361">Public Law 102–361</external-xref> (106 Stat. 966; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 1223(c)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 198; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) and section 2(b)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 347; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and is represented in the amendment made by section 3(8) of this Act, and may be filled.</text>
 </paragraph></subsection><subsection commented="no" id="HF991AD8417DF4837A74F7ECF69601B82"><enum>(h)</enum><header>Eastern District of Virginia</header><text display-inline="yes-display-inline">The temporary office of bankruptcy judge authorized for the eastern district of Virginia by section 1223(b)(1)(R) of <external-xref legal-doc="public-law" parsable-cite="pl/109/8">Public Law 109–8</external-xref> (119 Stat. 197; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and extended by section 2(a)(1)(P) of <external-xref legal-doc="public-law" parsable-cite="pl/112/121">Public Law 112–121</external-xref> (126 Stat. 346; <external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), is converted hereby to the permanent office of bankruptcy judge and is represented in the amendment made by section 3(9) of this Act, and may be filled.</text>
 </subsection></section><section id="HAA9A5BAA04EF45C89C335E1724C95A81"><enum>3.</enum><header>Permanent office of bankruptcy judge authorized</header><text display-inline="no-display-inline">To reflect the conversion of the temporary office of bankruptcy judge to the permanent office of bankruptcy judge made by the operation of section 2, and to authorize the appointment of additional bankruptcy judges, section 152(a)(2) of title 28 of the United States Code is amended—</text>
 <paragraph id="HF2B4515090EC4DE4AC121E874E9D4564"><enum>(1)</enum><text>in the item relating to the district of Delaware by striking <quote>1</quote> and inserting <quote>8</quote>;</text> </paragraph><paragraph id="H26630C71B9D240219F516F21380DEAD7"><enum>(2)</enum><text>in the item relating to the middle district of Florida by striking <quote>8</quote> and inserting <quote>9</quote>;</text>
 </paragraph><paragraph id="HC3C5D88758904F30B7395D3366B4C9E9"><enum>(3)</enum><text>in the item relating to the southern district of Florida by striking <quote>5</quote> and inserting <quote>7</quote>;</text> </paragraph><paragraph id="H2D19460B679D4E64B8E5ABD56B6FB55B"><enum>(4)</enum><text>in the item relating to the district of Maryland by striking <quote>4</quote> and inserting <quote>5</quote>;</text>
 </paragraph><paragraph id="HEE8C2006BF874D9D8975EB3F0D4CAFE6"><enum>(5)</enum><text>in the item relating to the eastern district of Michigan by striking <quote>4</quote> and inserting <quote>6</quote>;</text> </paragraph><paragraph id="HDA769710C6704AE080EC70177EB902B3"><enum>(6)</enum><text>in the item relating to the district of Nevada by striking <quote>3</quote> and inserting <quote>4</quote>;</text>
 </paragraph><paragraph id="H215C8F36721E419B9B7D0A0D6223999A"><enum>(7)</enum><text>in the item relating to the eastern district of North Carolina by striking <quote>2</quote> and inserting <quote>3</quote>;</text> </paragraph><paragraph id="HD9B577F7F8B647D2A543A837F9FF873C"><enum>(8)</enum><text>in the item relating to the district of Puerto Rico by striking <quote>2</quote> and inserting <quote>4</quote>; and</text>
 </paragraph><paragraph id="H95C46E6B82A94BAB8FC696FE45A0AF64"><enum>(9)</enum><text>in the item relating to the eastern district of Virginia by striking <quote>5</quote> and inserting <quote>6</quote> .</text> </paragraph></section><section id="H1663687F47614D89A4F4FD603B0049CC"><enum>4.</enum><header>Bankruptcy Fees</header> <subsection id="H9189A7D751C0416A86CC78ACD4885E23"><enum>(a)</enum><header>Amendments to title 28 of the United States Code</header><text display-inline="yes-display-inline">Section 1930(a)(6) of title 28 of the United States Code is amended—</text>
 <paragraph id="H74167A1079C94574A71674B4B2BB1A27"><enum>(1)</enum><text>by striking <quote>(6) In</quote> and inserting <quote>(6)(A) Except as provided in subparagraph (B), in</quote>; and</text> </paragraph><paragraph id="HE74B0C8D6A9F4375B8BB2B8840967705"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H1ABD1A06B2E945B8AC89C0D43EB05349" style="USC">
 <subparagraph id="id3D5AD98FF9344C10ACAD06DA414E7C05" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In any fiscal year, the quarterly fee payable for a quarter in which disbursements equal or exceed $1,000,000 shall be 1 percent of such disbursements or $250,000, whichever is less, unless the balance in the United States Trustee System Fund as of September 30 immediately preceding such fiscal year exceeds $200,000,000.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection display-inline="no-display-inline" id="H6016B192AB9741F4A6DF316A0C3E223F"><enum>(b)</enum><header>Deposits of certain fees for fiscal years 2018 through 2022</header><text display-inline="yes-display-inline">Notwithstanding section 589a(b) of title 28 of the United States Code, for each of the fiscal years 2018 through 2022—</text>
 <paragraph id="HAC7512F2AE7844A0B3FBB728895BE6A7"><enum>(1)</enum><text>97.5 percent of the fees collected under section 1930(a)(6) of such title shall be deposited as offsetting collections to the appropriation <quote>United States Trustee System Fund</quote>, to remain available until expended; and</text>
 </paragraph><paragraph id="H2E1F0C5DEFEB4588B7A14A2F35CDD85E"><enum>(2)</enum><text>2.5 percent of the fees collected under section 1930(a)(6) of such title shall be deposited in the general fund of the Treasury.</text>
				</paragraph></subsection><subsection id="H3DF9565F76BB40AA9D64B64FB9F27699"><enum>(c)</enum><header>Effective date; application amendments</header>
 <paragraph id="H7BA9D19DB22B4D5EA0F8AD97C1E2EF62"><enum>(1)</enum><header>Effective date</header><text>Except as provided in paragraph (2), this section shall take effect on July 1, 2017, or on the date of the enactment of this Act, whichever is later.</text>
 </paragraph><paragraph id="HA12C509412CB42DDA39AE5E1219CD4DF"><enum>(2)</enum><header>Application of amendments</header><text>The amendments made by this section shall apply to quarterly fees payable under section 1930(a)(6) of title 28 of the United States Code, as amended by this section, for disbursements made in any calendar quarter that begins on or after the effective date of the amendments made by this section.</text>
