				</section><section id="id8f53c13fd0c8475e93e738afbadd9697"><enum>2.</enum><header>Extension of temporary office of bankruptcy judges in certain judicial districts</header>
					<subsection id="id1a233eca6b194311bcc2de8abcaff0d7"><enum>(a)</enum><header>Temporary office of bankruptcy judges authorized by the Bankruptcy Judgeship Act of 2005</header>
 <paragraph id="idB1DF585A923A43F6880AA6481B470589"><enum>(1)</enum><header>Extensions</header><text>The temporary office of bankruptcy judges authorized for the following districts by subsection (b) of the Bankruptcy Judgeship Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) are extended until the applicable vacancy specified in paragraph (2) in the office of a bankruptcy judge for the respective district occurs:</text>
 <subparagraph id="id69e6eb47e3ab4171b5b20ae61dc24035"><enum>(A)</enum><text>The district of Delaware.</text> </subparagraph><subparagraph id="id14b3cbc1b31044649d5c77ce9a344403"><enum>(B)</enum><text>The southern district of Florida.</text>
 </subparagraph><subparagraph id="id48eb17b9cab64655a62bc57dc3788653"><enum>(C)</enum><text>The district of Maryland.</text> </subparagraph><subparagraph id="id5bd7c71576694905ad802681ae56e34f"><enum>(D)</enum><text>The eastern district of Michigan.</text>
 </subparagraph><subparagraph id="idbdc3dc5a0e564df29b4fefb683bc12ec"><enum>(E)</enum><text>The district of Nevada.</text> </subparagraph><subparagraph id="id5f46ebf81d3f401a863793ba92937d23"><enum>(F)</enum><text>The eastern district of North Carolina.</text>
 </subparagraph><subparagraph id="id494071d6ee7a4b7d9a1586c4baef64c2"><enum>(G)</enum><text>The district of Puerto Rico.</text> </subparagraph><subparagraph id="id02415dbbcffd4340b3f8b7661751907c"><enum>(H)</enum><text>The eastern district of Virginia.</text>
							</subparagraph></paragraph><paragraph id="id15BD133CE74F488CBCBCDAE21D3BD27B"><enum>(2)</enum><header>Vacancies</header>
 <subparagraph id="idE039F38F156C43AFB25A0086A73871AD"><enum>(A)</enum><header>Single vacancies</header><text>Except as provided in subparagraphs (B), (C), and (D), the 1st vacancy in the office of a bankruptcy judge for each district specified in paragraph (1)—</text>
 <clause id="ide1418091e25f45949a617a06ce25d7f7"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause><clause id="id4fb290e6c2d4488c978f66d2c9557923"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text>
 </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph><subparagraph id="id375c9588a7db45b5865ff7055d85e890"><enum>(B)</enum><header>District of Delaware</header><text>The 1st, 2d, 3d, and 4th vacancies in the office of a bankruptcy judge for the district of Delaware—</text>
 <clause id="idbdbc1cf255af484ca2e8fa659f3c8817"><enum>(i)</enum><text>occurring 5 years or more after the date of the enactment of this Act, and</text> </clause><clause id="id9478f57c54c34ee2983051b1f2d771ad"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text>
								</clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph><subparagraph id="idce7d49b958634bda83858044f49427af"><enum>(C)</enum><header>District of Maryland</header>
 <clause id="idC8A6E947A6D943C79978647F92E02CD6"><enum>(i)</enum><text>The 1st vacancy in the office of a bankruptcy judge for the district of Maryland—</text> <subclause id="ida0fcea99d5084f9c8dbbb349a480abd9"><enum>(I)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text>
 </subclause><subclause id="ida9c879609447468e929090a981afd8d1"><enum>(II)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </subclause><continuation-text continuation-text-level="clause">shall not be filled.</continuation-text></clause><clause id="id80be1a91cef848b1922d08826bbdc9c1"><enum>(ii)</enum><text>The 2d and 3d vacancies in the office of a bankruptcy judge for the district of Maryland resulting from the death, retirement, resignation, or removal of a bankruptcy judge, shall not be filled.</text>
 </clause></subparagraph><subparagraph id="idF1636EDE4B084EDCB8927B8BDEE1528D"><enum>(D)</enum><header>Southern district of Florida</header><text>The 1st and 2d vacancies in the office of a bankruptcy judge for the southern district of Florida—</text> <clause id="id93b71bb268f84205a3115b8bbcf2f307"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text>
 </clause><clause id="idFF0C0BABA582420DB11393544293B22E"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph></paragraph><paragraph id="iddaf2d60b57b44bc88037eed9a56444d4"><enum>(3)</enum><header>Applicability of provisions</header><text>Except as provided in paragraphs (1) and (2), all other provisions of subsection (b) of the Bankruptcy Judgeship Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) and section 2 of the Temporary Bankruptcy Judgeships Extension Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) remain applicable to the temporary office of bankruptcy judges referred to in paragraph (1).</text>
						</paragraph></subsection><subsection id="idD32C28585DE34E33A5FB556D2E190917"><enum>(b)</enum><header>Temporary office of bankruptcy judges extended by the Bankruptcy Judgeship Act of 2005 and the
			 Temporary Bankruptcy Judgeships Extension Act of 2012</header>
 <paragraph id="id02B6D9E30B7E45DCA0842B0078337FDB"><enum>(1)</enum><header>Extensions</header><text>The temporary office of bankruptcy judges authorized by section 3 of the Bankruptcy Judgeship Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) and extended by subsection (c) of the Bankruptcy Judgeship Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) and further extended by section 2 of the Temporary Bankruptcy Judgeships Extension Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) for the district of Delaware and the district of Puerto Rico are extended until the applicable vacancy specified in paragraph (2) in the office of a bankruptcy judge for the respective district occurs.</text>
						</paragraph><paragraph id="idBD564AC64A184017991226569922A71F"><enum>(2)</enum><header>Vacancies</header>
 <subparagraph id="id6CE57E9F69294528ACC092E437C4707D"><enum>(A)</enum><header>District of Delaware</header><text>The 5th vacancy in the office of a bankruptcy judge for the district of Delaware—</text> <clause id="id181766e99fd747a5b55fb5c07aac06a6"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text>
 </clause><clause id="idb454b0b4fda84c04aa229024d46e2cfb"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph><subparagraph id="id8940964a925846e9b95359e1801d470e"><enum>(B)</enum><header>District of Puerto Rico</header><text>The 2d vacancy in the office of a bankruptcy judge for the district of Puerto Rico—</text>
 <clause id="id5000b25952d941aaa33a34d70bfcf86b"><enum>(i)</enum><text>occurring more than 5 years after the date of the enactment of this Act, and</text> </clause><clause id="id550afb057d3747739e3d08be733fc821"><enum>(ii)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text>
 </clause><continuation-text continuation-text-level="subparagraph">shall not be filled.</continuation-text></subparagraph></paragraph><paragraph id="idbf1680b35d684b74a081b7019f4bf547"><enum>(3)</enum><header>Applicability of other provisions</header><text>Except as provided in paragraphs (1) and (2), all other provisions of section 3 of the Bankruptcy Judgeship Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), subsection (c) of the Bankruptcy Judgeship Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note), and section 2 of the Temporary Bankruptcy Judgeships Extension Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/28/152">28 U.S.C. 152</external-xref> note) remain applicable to the temporary office of bankruptcy judges referred to in paragraph (1).</text>
						</paragraph></subsection></section><section id="idd9db494c1a9e486d83a78291be04c60b"><enum>3.</enum><header>Temporary office of bankruptcy judge authorized</header>
 <subsection id="id55ced1c621fd4a949b97f64edc2eba6f"><enum>(a)</enum><header>Appointments</header><text>The following bankruptcy judges shall be appointed in the manner prescribed in section 152(a)(1) of title 28, United States Code, for the appointment of bankruptcy judges provided for in section 152(a)(2) of that title:</text>
 <paragraph id="id32f005baed0241e5a97abe1e545b9aca"><enum>(1)</enum><text>Two additional bankruptcy judges for the district of Delaware.</text> </paragraph><paragraph id="idde8ae3df24894b8cbef23604f2e6bf92"><enum>(2)</enum><text>One additional bankruptcy judge of the middle district of Florida.</text>
 </paragraph><paragraph id="id65f55469dd7f438e9e473aa7d48186a9"><enum>(3)</enum><text>One additional bankruptcy judge for the eastern district of Michigan.</text> </paragraph></subsection><subsection id="id23522f4af0e841bda236d21a9f0695b7"><enum>(b)</enum><header>Vacancies</header> <paragraph id="id42d2b0a2e75343de83894de39c59855f"><enum>(1)</enum><header>District of Delaware</header><text>The 6th and 7th vacancies in the office of a bankruptcy judge for the district of Delaware—</text>
 <subparagraph id="id422567d22cc843da84c73e63df3e4d2a"><enum>(A)</enum><text>occurring 5 years or more after the appointment date of the bankruptcy judge appointed under paragraph (1) to such office, and</text>
 </subparagraph><subparagraph id="idca4e243542094b5bb3849f5eb169828f"><enum>(B)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </subparagraph><continuation-text continuation-text-level="paragraph">shall not be filled.</continuation-text></paragraph><paragraph id="id6269c821c0b34992afdcfc926c0d5421"><enum>(2)</enum><header>Middle district of Florida</header><text>The 1st vacancy in the office of a bankruptcy judge for the middle district of Florida—</text>
 <subparagraph id="idd59be274c17149a4a2afc443ac2dca02"><enum>(A)</enum><text>occurring 5 years or more after the appointment date of the bankruptcy judge appointed under paragraph (1) to such office, and</text>
 </subparagraph><subparagraph id="idf494375820b941e1a4ba07eb50e354a1"><enum>(B)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </subparagraph><continuation-text continuation-text-level="paragraph">shall not be filled.</continuation-text></paragraph><paragraph id="id386c65e4f7a04d54bb9de6befdb9cc1c"><enum>(3)</enum><header>Eastern district of Michigan</header><text>The 2d vacancy in the office of a bankruptcy judge for the eastern district of Michigan—</text>
 <subparagraph id="id64d80f592d7443b0b10518dddb12c0aa"><enum>(A)</enum><text>occurring 5 years or more after the appointment date of the bankruptcy judge appointed under paragraph (1) to such office, and</text>
 </subparagraph><subparagraph id="id6a7ed6f4d83f45b893fe00b432cba646"><enum>(B)</enum><text>resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</text> </subparagraph><continuation-text continuation-text-level="paragraph">shall not be filled.</continuation-text></paragraph></subsection></section><section id="id0e4752c653484ea39cb5674f93ea272a"><enum>4.</enum><header>Bankruptcy fees</header> <subsection id="id0D65DE56F8A84CDE84333B054290C9C9"><enum>(a)</enum><header>Amendments to title 28 of the United States Code</header><text display-inline="yes-display-inline">Section 1930(a)(6) of title 28, United States Code, is amended—</text>
 <paragraph id="id7136C2014D594F0E9949DA60101FF8C6"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(6) In</quote> and inserting ‘‘(6)(A) Except as provided in subparagraph (B), in’’; and</text> </paragraph><paragraph id="idD80B14F37F8B4F0D9BD227E0808A7A91"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
							<quoted-block changed="added" display-inline="no-display-inline" id="idD58F1BF6787F4A0589DC59484D5ED623" reported-display-style="italic" style="OLC">
 <subparagraph id="idB3469D83A90242C2B29D9400E3A91727" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">During each of fiscal years 2018 through 2022, if the balance in the United States Trustee System Fund as of September 30 of the most recent full fiscal year is less than $200,000,000, the quarterly fee payable for a quarter in which disbursements equal or exceed $1,000,000 shall be the lesser of 1 percent of such disbursements or $250,000.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id955659af4135450498a1d5707b05f186"><enum>(b)</enum><header>Deposits of certain fees for fiscal years 2018 through 2022</header><text>Notwithstanding section 589a(b) of title 28, United States Code, for each of fiscal years 2018 through 2022—</text>
 <paragraph id="id87fd1338a5ea40a2ac8dec51c55c3181"><enum>(1)</enum><text>98 percent of the fees collected under section 1930(a)(6) of such title shall be deposited as offsetting collections to the appropriation <quote>United States Trustee System Fund</quote>, to remain available until expended; and</text>
 </paragraph><paragraph id="id492219fb98dd417f8fd7b524bd90ebd8"><enum>(2)</enum><text>2 percent of the fees collected under section 1930(a)(6) of such title shall be deposited in the general fund of the Treasury.</text>
 </paragraph></subsection><subsection id="idB782FA1D2A4149899347E156EC183EEA"><enum>(c)</enum><header>Application of amendments</header><text>The amendments made by this section shall apply to quarterly fees payable under section 1930(a)(6) of title 28, United States Code, as amended by this section, for disbursements made in any calendar quarter that begins on or after the date of enactment of this Act.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="id0350C2B784904672B6F0C9D381F9CDF5" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Clarification of rule
			 allowing discharge to governmental claims arising from the disposition of
			 farm
			 assets under chapter 12 bankruptcies</header>
					<subsection commented="no" display-inline="no-display-inline" id="idA657EF833598442DA359D2A00F7E1C99"><enum>(a)</enum><header display-inline="yes-display-inline">In
 general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/12">chapter 12</external-xref> of title 11, United States Code, is amended by adding at the end the following:</text>
						<quoted-block changed="added" display-inline="no-display-inline" id="idAAF4ED3797CB4B9B921B88B95C9199A5" reported-display-style="italic" style="USC">
							<section commented="no" display-inline="no-display-inline" id="id37c021b192544305a5166c063934c6ab" section-type="subsequent-section"><enum>1232.</enum><header display-inline="yes-display-inline">Claim by a
				governmental unit based on the disposition of property used in a
			 farming
				operation</header>
 <subsection commented="no" display-inline="no-display-inline" id="idb6b48fbe61f247c18ba0acc30a341d8c"><enum>(a)</enum><text display-inline="yes-display-inline">Any unsecured claim of a governmental unit against the debtor or the estate that arises before the filing of the petition, or that arises after the filing of the petition and before the debtor’s discharge under section 1228, as a result of the sale, transfer, exchange, or other disposition of any property used in the debtor’s farming operation—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idEA83854FEEC84B9BA9F68E174C25016A"><enum>(1)</enum><text display-inline="yes-display-inline">shall be treated as an unsecured claim arising before the date on which the petition is filed;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id482A97B838CF44B4ABB28E878D6056D1"><enum>(2)</enum><text display-inline="yes-display-inline">shall not be entitled to priority under section 507;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEE142D31921047DCB1259AA5F7D12A7A"><enum>(3)</enum><text display-inline="yes-display-inline">shall be provided for under a plan; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64026E87096C4E59AB74FA90F5D93557"><enum>(4)</enum><text display-inline="yes-display-inline">shall be discharged in accordance with section 1228.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id011b1306207647d8a6ad92670831c1a1"><enum>(b)</enum><text display-inline="yes-display-inline">For purposes of applying sections 1225(a)(4), 1228(b)(2), and 1229(b)(1) to a claim described in subsection (a) of this section, the amount that would be paid on such claim if the estate of the debtor were liquidated in a case under chapter 7 of this title shall be the amount that would be paid by the estate in a chapter 7 case if the claim were an unsecured claim arising before the date on which the petition was filed and were not entitled to priority under section 507.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id11f39b05d9424b3187c9099d63d21547"><enum>(c)</enum><text display-inline="yes-display-inline">For purposes of applying sections 523(a), 1228(a)(2), and 1228(c)(2) to a claim described in subsection (a) of this section, the claim shall not be treated as a claim of a kind specified in subparagraph (A) or (B) of section 523(a)(1).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idf4be0309eeb5422eabdd99bbd16084fc"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idAD0C82777EF14F169E749E91FDCEDDDB"><enum>(1)</enum><text display-inline="yes-display-inline">A governmental unit may file a proof of claim for a claim described in subsection (a) that arises after the date on which the petition is filed.</text>
 </paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="idD9E66072777B492D82A93CBEFE0E0D02" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">If a debtor files a tax return after the filing of the petition for a period in which a claim described in subsection (a) arises, and the claim relates to the tax return, the debtor shall serve notice of the claim on the governmental unit charged with the responsibility for the collection of the tax at the address and in the manner designated in section 505(b)(1). Notice under this paragraph shall state that the debtor has filed a petition under this chapter, state the name and location of the court in which the case under this chapter is pending, state the amount of the claim, and include a copy of the filed tax return and documentation supporting the calculation of the claim.</text>
 </paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id2FC80012D41C4AC294C70F0DD9ED8732" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">If notice of a claim has been served on the governmental unit in accordance with paragraph (2), the governmental unit may file a proof of claim not later than 180 days after the date on which such notice was served. If the governmental unit has not filed a timely proof of the claim, the debtor or trustee may file proof of the claim that is consistent with the notice served under paragraph (2). If a proof of claim is filed by the debtor or trustee under this paragraph, the governmental unit may not amend the proof of claim.</text>
 </paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="idC2CAB5EB7DBA4E0CA27860ECA44DAAB0" indent="up1" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">A claim filed under this subsection shall be determined and shall be allowed under subsection (a), (b), or (c) of section 502, or disallowed under subsection (d) or (e) of section 502, in the same manner as if the claim had arisen immediately before the date of the filing of the petition.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id3D2DE52D12A041ED846B278DFB747315"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and
			 conforming amendments</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id042C0AE581C746B8875005D317B3F6AC"><enum>(1)</enum><header display-inline="yes-display-inline">In
 general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/12">chapter 12</external-xref> of title 11, United States Code, is amended—</text>

						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD8E4F860280448268E001DB715F8972A"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
 date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to—</text> <paragraph commented="no" display-inline="no-display-inline" id="idD6D776C6CD2146959E54A444DB9E3FC1"><enum>(1)</enum><text display-inline="yes-display-inline">any bankruptcy case—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id94A15EA35368421D8E4CB48F41E4DB9E"><enum>(A)</enum><text display-inline="yes-display-inline">that is pending on the date of enactment of this Act;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99DD2D7DF71F49BCBCC81FC21BDDDED0"><enum>(B)</enum><text display-inline="yes-display-inline">in which the plan under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/12">chapter 12</external-xref> of title 11, United States Code, has not been confirmed on the date of enactment of this Act; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0A103D270F4242AF952075EA02048121"><enum>(C)</enum><text display-inline="yes-display-inline">relating to which an order of discharge under section 1228 of title 11, United States Code, has not been entered; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9C21991F67DD4C2B830C90C116FAC434"><enum>(2)</enum><text display-inline="yes-display-inline">any bankruptcy case that commences on or after the date of enactment of this Act.</text></paragraph></subsection></section></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
