 <section id="H07DA9929D47D41D8B049DDCAFE94FEA0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electricity Reliability and Forest Protection Act</short-title></quote>.</text> </section><section id="H8A38C7AE9300409DA0C72CE2B3AE6BE4"><enum>2.</enum><header>Vegetation management, facility inspection, and operation and maintenance on Federal lands containing electric transmission and distribution facilities</header> <subsection id="H1A02CA3A22CB49D69A91BD6CC8DD7272"><enum>(a)</enum><header>In general</header><text>Title V of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761</external-xref> et seq.) is amended by adding at the end the following new section:</text>

					<section id="HEBECCB7E34C646639D5841CF8BC77556"><enum>512.</enum><header>Vegetation management, facility inspection, and operation, and maintenance relating to electric
			 transmission and distribution facility rights-of-way</header>
 <subsection id="HF3D25A22C2CF4505A1A169DB233FC87B"><enum>(a)</enum><header>General direction</header><text>In order to enhance the reliability of the electricity grid and reduce the threat of wildfires to and from electric transmission and distribution rights-of-way and related facilities and adjacent property, the Secretary, with respect to public lands and other lands under the jurisdiction of the Secretary, and the Secretary of Agriculture, with respect to National Forest System lands, shall provide direction to ensure that all existing and future rights-of-way, however established (including by grant, special use authorization, and easement), for electrical transmission and distribution facilities on such lands include provisions for utility vegetation management, facility inspection, and operation and maintenance activities that, while consistent with applicable law—</text>
 <paragraph id="H9CCC7EC8088E450FACBF97BFB2155B0C"><enum>(1)</enum><text>are developed in consultation with the holder of the right-of-way;</text> </paragraph><paragraph id="HFF81477899EC489E87FCC34952388E4D"><enum>(2)</enum><text display-inline="yes-display-inline">enable the owner or operator of a facility to operate and maintain the facility in good working order and to comply with Federal, State and local electric system reliability and fire safety requirements, including reliability standards established by the Electric Reliability Organization as defined under <external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref> and plans to meet such reliability standards;</text>
 </paragraph><paragraph id="H5E1A7273FF5E42F688120C927FDE5A89"><enum>(3)</enum><text>minimize the need for case-by-case or annual approvals for—</text> <subparagraph id="H8319E8D2A8164BE9A9CA606A3DFD1736"><enum>(A)</enum><text>routine vegetation management, facility inspection, and operation and maintenance activities within existing electrical transmission and distribution rights-of-way; and</text>
 </subparagraph><subparagraph id="H6BB05B1958164F25B76E294A0AABADB6"><enum>(B)</enum><text>utility vegetation management activities that are necessary to control hazard trees within or adjacent to electrical transmission and distribution rights-of-way; and</text>
 </subparagraph></paragraph><paragraph id="H752DD31D8D3C4603B6C1E2B842989A95"><enum>(4)</enum><text display-inline="yes-display-inline">when review is required, provide for expedited review and approval of utility vegetation management, facility inspection, and operation and maintenance activities, especially activities requiring prompt action to avoid an adverse impact on human safety or electric reliability to avoid fire hazards.</text>
							</paragraph></subsection><subsection id="H46D0C2B0A79445869CB6DDFD74335B4C"><enum>(b)</enum><header>Vegetation management, facility inspection, and operation and maintenance plans</header>
 <paragraph id="H37C803D290994BF58C084ADC98BD1A1A"><enum>(1)</enum><header>Development and submission</header><text>Consistent with subsection (a), the Secretary and the Secretary of Agriculture shall provide owners and operators of electric transmission and distribution facilities located on lands described in such subsection with the option to develop and submit a vegetation management, facility inspection, and operation and maintenance plan, that at each transmission or distribution owner or operator’s discretion may cover some or all of the owner or operator’s transmission and distribution rights-of-way on Federal lands, for approval to the Secretary with jurisdiction over the lands. A plan under this paragraph shall enable the owner or operator of a facility, at a minimum, to comply with applicable Federal, State, and local electric system reliability and fire safety requirements, as provided in subsection (a)(2). The Secretaries shall not have the authority to modify those requirements.</text>
 </paragraph><paragraph id="H4E289035D6D84A929C28A6D2AEA9245E"><enum>(2)</enum><header>Review and approval process</header><text>The Secretary and the Secretary of Agriculture shall jointly develop a consolidated and coordinated process for review and approval of—</text>
 <subparagraph id="HB7822FFE69A04C92B392999406C54725"><enum>(A)</enum><text>vegetation management, facility inspection, and operation and maintenance plans submitted under paragraph (1) that—</text>
 <clause id="HF7F849390C0C4C939B3773ADA51BA6AD"><enum>(i)</enum><text display-inline="yes-display-inline">assures prompt review and approval not to exceed 90 days;</text> </clause><clause id="H77DF1195A6514984B356C192DE298944"><enum>(ii)</enum><text display-inline="yes-display-inline">includes timelines and benchmarks for agency comments to submitted plans and final approval of such plans;</text>
 </clause><clause id="HC9BBA3444761496D93620FC8981A5909"><enum>(iii)</enum><text>is consistent with applicable law; and</text> </clause><clause id="H5CE8147559F44418AE1A141B18258EE7"><enum>(iv)</enum><text>minimizes the costs of the process to the reviewing agency and the entity submitting the plans; and</text>
 </clause></subparagraph><subparagraph id="H84864104FE93460D90FAF60AB29C1D45"><enum>(B)</enum><text>amendments to the plans in a prompt manner if changed conditions necessitate a modification to a plan.</text>
 </subparagraph></paragraph><paragraph id="H167597F42B1A4671B2D61CE4D5684B3A"><enum>(3)</enum><header>Notification</header><text>The review and approval process under paragraph (2) shall—</text> <subparagraph id="H6E4A83583C7941259328D3C410A6CD7E"><enum>(A)</enum><text>include notification by the agency of any changed conditions that warrant a modification to a plan;</text>
 </subparagraph><subparagraph id="H5B9F8FF4F85A430A8ABCB0748DEE98BE"><enum>(B)</enum><text>provide an opportunity for the owner or operator to submit a proposed plan amendment to address directly the changed condition; and</text>
 </subparagraph><subparagraph id="HCF22088B5CCB4B1F8C8477C4C9820468"><enum>(C)</enum><text>allow the owner or operator to continue to implement those elements of the approved plan that do not directly and adversely affect the condition precipitating the need for modification.</text>
 </subparagraph></paragraph><paragraph id="HE818323F2C1A4C97B395AE200E6ECC4B"><enum>(4)</enum><header>Categorical exclusion process</header><text display-inline="yes-display-inline">The Secretary and the Secretary of Agriculture shall apply his or her categorical exclusion process under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) to plans developed under this subsection on existing transmission and distribution rights-of-way under this subsection.</text>
 </paragraph><paragraph id="H3CCF442878524469AE481AD6064D0000"><enum>(5)</enum><header>Implementation</header><text>A plan approved under this subsection shall become part of the authorization governing the covered right-of-way and hazard trees adjacent to the right-of-way. If a vegetation management plan is proposed for an existing transmission or distribution facility concurrent with the siting of a new transmission or distribution facility, necessary reviews shall be completed as part of the siting process or sooner. Once the plan is approved, the owner or operator shall provide the agency with only a notification of activities anticipated to be undertaken in the coming year, a description of those activities, and certification that the activities are in accordance with the plan.</text>
 </paragraph><paragraph id="H3F300FD5D7FC4116AAA735E386CC85DE"><enum>(6)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H36CBB90C6A2C40D29257C02FB39865E4"><enum>(A)</enum><header>Vegetation management, facility inspection, and operation and maintenance plan</header><text>The term <term>vegetation management, facility inspection, and operation and maintenance plan</term> means a plan that—</text>
 <clause id="H94137ECD24E14E7A82D86B75148658CB"><enum>(i)</enum><text>is prepared by the owner or operator of one or more electrical transmission or distribution facilities to cover one or more electric transmission and distribution rights-of-way; and</text>
 </clause><clause id="HEA2B48CA86B4460DBD4D6B847756006F"><enum>(ii)</enum><text>provides for the long-term, cost-effective, efficient and timely management of facilities and vegetation within the width of the right-of-way and adjacent Federal lands to enhance electricity reliability, promote public safety, and avoid fire hazards.</text>
 </clause></subparagraph><subparagraph id="H8F65503C563645DDA4F6F466F99F38BD"><enum>(B)</enum><header>Owner or Operator</header><text>The terms <term>owner</term> and <term>operator</term> include contractors or other agents engaged by the owner or operator of a facility.</text> </subparagraph><subparagraph id="HD4DC859A91954C36B94C75CD405FC889"><enum>(C)</enum><header>Hazard tree</header><text display-inline="yes-display-inline">The term <quote>hazard tree</quote> means any tree inside the right-of-way or located outside the right-of-way that has been designated, prior to tree failure, by either the owner or operator of a transmission or distribution facility, or the Secretary or the Secretary of Agriculture, to be likely to fail and cause a high risk of injury, damage, or disruption within 10 feet or less of an electric power line or related structure if it fell.</text>
 </subparagraph></paragraph></subsection><subsection id="H24477CC2B5DC4A95B35C1218E92210C9"><enum>(c)</enum><header>Response to emergency conditions</header><text display-inline="yes-display-inline">If vegetation on Federal lands within, or hazard trees on Federal lands adjacent to, an electrical transmission or distribution right-of-way granted by the Secretary or the Secretary of Agriculture has contacted or is in imminent danger of contacting one or more electric transmission or distribution lines, the owner or operator of the transmission or distribution lines—</text>
 <paragraph id="H093786A1EFC34F7699477BD07DDF4334"><enum>(1)</enum><text>may prune or remove the vegetation or hazard tree to avoid the disruption of electric service and risk of fire; and</text>
 </paragraph><paragraph id="H3CF4F287D988487FAB7351B9B7FB0210"><enum>(2)</enum><text>shall notify the appropriate local agent of the relevant Secretary not later than 24 hours after such removal.</text>
 </paragraph></subsection><subsection id="HCA1F2B6757804454BF592C9A140B1C12"><enum>(d)</enum><header>Compliance with applicable reliability and safety standards</header><text display-inline="yes-display-inline">If vegetation on Federal lands within or adjacent to an electrical transmission or distribution right-of-way under the jurisdiction of each Secretary does not meet clearance requirements under standards established by the Electric Reliability Organization as defined under <external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>, or by State and local authorities, and the Secretary having jurisdiction over the lands has failed to act to allow a transmission or distribution facility owner or operator to conduct vegetation management activities within 3 business days after receiving a request to allow such activities, the owner or operator may, after notifying the Secretary, conduct such vegetation management activities to meet those clearance requirements.</text>
 </subsection><subsection id="H19F2A2F37D0245769D8BB5A31E3EC380"><enum>(e)</enum><header>Reporting requirement</header><text>The Secretary or Secretary of Agriculture shall report requests and actions made under subsections (c) and (d) annually on each Secretary’s website.</text>
 </subsection><subsection id="H78F1C091BC554DB7935F3E5C5202B996"><enum>(f)</enum><header>Liability</header><text>An owner or operator of a transmission or distribution facility shall not be held liable for wildfire damage, loss or injury, including the cost of fire suppression, if—</text>
 <paragraph id="HBFB2E02B06FC456C8D6729C9A02ACA70"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary or the Secretary of Agriculture fails to allow the owner or operator to operate consistently with an approved vegetation management, facility inspection, and operation and maintenance plan on Federal lands under the relevant Secretary’s jurisdiction within or adjacent to a right-of-way to comply with Federal, State or local electric system reliability and fire safety standards, including standards established by the Electric Reliability Organization as defined under <external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>; or</text>
 </paragraph><paragraph id="H000C01E8F903426491A37FF552B0C568"><enum>(2)</enum><text>the Secretary or the Secretary of Agriculture fails to allow the owner or operator of the transmission or distribution facility to perform appropriate vegetation management activities in response to a hazard tree as defined under subsection (b)(6), or a tree in imminent danger of contacting the owner’s or operator’s transmission or distribution facility.</text>
 </paragraph></subsection><subsection id="H2B569B8BB65A4C7487BA70AE739638B9"><enum>(g)</enum><header>Training and guidance</header><text display-inline="yes-display-inline">In consultation with the electric utility industry, the Secretary and the Secretary of Agriculture are encouraged to develop a program to train personnel of the Department of the Interior and the Forest Service involved in vegetation management decisions on rights-of-way relating to transmission and distribution facilities to ensure that such personnel—</text>
 <paragraph id="HF6109A023A264F14B1F3ED08CB5FDC3D"><enum>(1)</enum><text display-inline="yes-display-inline">understand electric system reliability and fire safety requirements, including reliability standards established by the Electric Reliability Organization as defined under <external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>;</text>
 </paragraph><paragraph id="H1F18947E9FDB41D8A1187CF32FBA75B7"><enum>(2)</enum><text>assist owners and operators of transmission and distribution facilities to comply with applicable electric reliability and fire safety requirements; and</text>
 </paragraph><paragraph id="H3382C616A50E466FBC95FB85425DA0F3"><enum>(3)</enum><text display-inline="yes-display-inline">encourage and assist willing owners and operators of transmission and distribution facilities to incorporate on a voluntary basis vegetation management practices to enhance habitats and forage for pollinators and for other wildlife so long as the practices are compatible with the integrated vegetation management practices necessary for reliability and safety.</text>
 </paragraph></subsection><subsection id="HF2F52CCBA79F4717AD6543971E97BB2D"><enum>(h)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary of the Interior and the Secretary of Agriculture shall—</text> <paragraph id="H2CC03FF9C0DE4F29AC02F14682F0628B"><enum>(1)</enum><text>not later than one year after the date of the enactment of this section, prescribe regulations, or amend existing regulations, to implement this section; and</text>
 </paragraph><paragraph id="HC314A4EB76A242B3BDC73DFDCE2BB6D9"><enum>(2)</enum><text>not later than two years after the date of the enactment of this section, finalize regulations, or amend existing regulations, to implement this section.</text>
 </paragraph></subsection><subsection id="HB9B6E88E78EC41D0B06C630062AA3E13"><enum>(i)</enum><header>Existing vegetation management, facility inspection and operation and maintenance plans</header><text display-inline="yes-display-inline">Nothing in this section requires an owner or operator to develop and submit a vegetation management, facility inspection, and operation and maintenance plan if one has already been approved by the Secretary or Secretary of Agriculture before the date of the enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H1346435D9F2148128F87F1FA519B6FAF"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761</external-xref> et seq.), is amended by inserting after the item relating to section 511 the following new item:</text>
