			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to clarify that section 230 of such Act does not prohibit
			 the enforcement against providers and users of interactive computer
			 services of Federal and State criminal and civil law relating to sexual
			 exploitation of children or sex trafficking, and for other purposes.</official-title></form>
	<legis-body id="H44BBC86814A841E985D789189450233F" style="OLC">
 <section id="H3C051799343448BBA214DE2D1150B644" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Allow States and Victims to Fight Online Sex Trafficking Act of 2017</short-title></quote>.</text> </section><section id="H2123A82095794306B717961E9CED63AA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
 <paragraph id="HD963F00E2DDB47D4B60E97C87DE4AB1E"><enum>(1)</enum><text>Section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>; commonly known as the <quote>Communications Decency Act of 1996</quote>) was never intended to provide legal protection to websites that facilitate traffickers in advertising the sale of unlawful sex acts with sex trafficking victims.</text>
 </paragraph><paragraph id="H710F75F7F6BA4CF19BA21A3CEA42F5A5"><enum>(2)</enum><text>Clarification of such section is warranted to ensure that such section does not provide such protection to such websites.</text>
			</paragraph></section><section id="HB52CAE54FB19469B9A9B2379E10E4342"><enum>3.</enum><header>Ensuring ability to enforce Federal and State criminal and civil law relating to sexual
			 exploitation of children or sex trafficking</header>
 <subsection id="H3A31FBB070B64C7FBA163C12DA0F2F50"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>) is amended—</text> <paragraph commented="no" id="HA6C684EC680243CDA83531C0D9CC1A99"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="H85639C439D9D4BB8B61C7BE761136DFF"><enum>(A)</enum><text>in paragraph (4), by striking <quote>; and</quote> and inserting a semicolon;</text> </subparagraph><subparagraph id="H9E930D33E8D94289A84E5FF4CC832649"><enum>(B)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </subparagraph><subparagraph id="HF997D3BAC5FD4AC8B4E402279B4AD28A"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H51FD73D07B5B4F429E485F92491A9E47" style="OLC"> <paragraph id="HC37216745CA344FDB11F82791D21BCDD"><enum>(6)</enum><text display-inline="yes-display-inline">to ensure vigorous enforcement against providers and users of interactive computer services of Federal and State criminal and civil law relating to sexual exploitation of children or sex trafficking, including through the availability of a civil remedy for victims of sex trafficking.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H2A954D646C9646F19F4D832A5BE0F829"><enum>(2)</enum><text>in subsection (e)—</text> <subparagraph id="HF65D662E843C48268BD9F7C3CFB56165"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="H34E9C727A7F24B21A98202832507760F"><enum>(i)</enum><text>by inserting <quote>section 1591 of such title (relating to sex trafficking),</quote> after <quote>title 18, United States Code,</quote>;</text> </clause><clause id="HBF8B4253357E4926B122FBB4B3D4186F"><enum>(ii)</enum><text>by striking <quote>impair the enforcement of section</quote> and inserting the following:</text>
							<quoted-block display-inline="yes-display-inline" id="H3B00B19D64CD402BB6819ECA117E380A" style="OLC">
 <text>impair the enforcement of, or limit the availability of victim restitution under—</text><subparagraph id="H3300DBCB8C1D42909302F65A25FCB9C0"><enum>(A)</enum><text display-inline="yes-display-inline">section</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </clause><clause id="H7C099E5206C846ABA04838DEED159D40"><enum>(iii)</enum><text>by striking <quote>statute.</quote> and inserting the following:</text>
							<quoted-block display-inline="yes-display-inline" id="H502E09C57DFE41ACB00045CB730D6FCD" style="OLC">
 <text>statute; or</text><subparagraph id="H4F69B56AFDF045BE8BF0C80E02BCE6FA"><enum>(B)</enum><text display-inline="yes-display-inline">any State criminal statute that prohibits—</text> <clause id="HFFEEBC1A9EF5453485B8B08230BB3572"><enum>(i)</enum><text>sexual exploitation of children;</text>
 </clause><clause id="H5C7B09DEC6154F49853A7ECBE472C1E0"><enum>(ii)</enum><text>sex trafficking of children; or</text> </clause><clause id="H6A469513A31C412CB5B99D68A342260C"><enum>(iii)</enum><text>sex trafficking by force, threats of force, fraud, or coercion.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="H183DF917E19341BB900DB4A6FBFCE717"><enum>(B)</enum><text>in the second sentence of paragraph (3), by striking <quote>No cause of action</quote> and inserting <quote>Except as provided in paragraphs (1)(B) and (5)(B), no cause of action</quote>; and</text> </subparagraph><subparagraph id="H32FA1F3E4D544CBBBC3E01E26D7D8E5E"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H083CEFF09A5D4032A969543493721312" style="OLC">
 <paragraph id="H69B07A289AE14AA4BC8D56FDB059B665"><enum>(5)</enum><header>No effect on civil law relating to sexual exploitation of children or sex trafficking</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to impair the enforcement or limit the application of—</text> <subparagraph id="HBB7BE3F01F1F456AAB85F1918C84A738"><enum>(A)</enum><text>section 1595 of title 18, United States Code; or</text>
 </subparagraph><subparagraph id="HB068C9C2C439419F8B062A5EBE17E278"><enum>(B)</enum><text display-inline="yes-display-inline">any other Federal or State law that provides causes of action, restitution, or other civil remedies to victims of—</text>
 <clause id="HA3CCBD36E12643FEA688D1A81BCAFB07"><enum>(i)</enum><text>sexual exploitation of children;</text> </clause><clause id="HA314648035C04A0FB1D7C18855E39ABC"><enum>(ii)</enum><text>sex trafficking of children; or</text>
 </clause><clause id="HAC533BAC47E14704BCD9FD43C1C1361D"><enum>(iii)</enum><text>sex trafficking by force, threats of force, fraud, or coercion.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection><subsection id="H6F81214BE54040FAA822F397B61FE277"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date of the enactment of this Act, and the amendment made by subsection (a)(2)(C) (and, to the extent it relates to such amendment, the amendment made by subsection (a)(2)(B)) shall apply regardless of whether the conduct alleged occurred, or is alleged to have occurred, before, on, or after such date of enactment.</text>
			</subsection></section><section id="H2402B6C7B55F4C36BB7A63C3AD8FE6E2"><enum>4.</enum><header>Ensuring Federal liability for publishing information designed to facilitate sex trafficking</header>
 <subsection id="HEC0DDAE37E4546AE8229BE07959DD283"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1591 of title 18, United States Code, is amended—</text> <paragraph id="H45E468E2299F4562AAA740DDBC68C97D"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f);</text>
 </paragraph><paragraph id="HD130308746FF46AE954E14FBB57D5401"><enum>(2)</enum><text>in subsection (f), as redesignated by paragraph (1), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H993565F97F8B4E1A99D23F4A71FA82CC" style="USC"> <paragraph id="HB7D3370CD36E478FB4356727C2E086DE"><enum>(6)</enum><text display-inline="yes-display-inline">“The terms <quote>information content provider</quote> and <quote>interactive computer service</quote> have the meanings given those terms in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>).</text>
 </paragraph><paragraph id="H52978D0685094F70A6E8752089DB7016"><enum>(7)</enum><text display-inline="yes-display-inline">The term <quote>participation in a venture</quote> includes knowing or reckless conduct by any person or entity and by any means that furthers or in anyway aids or abets the violation of subsection (a)(1).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HB67A99E1326142E18DE95994F18D0A01"><enum>(3)</enum><text>by inserting after subsection (d) the following:</text> <quoted-block display-inline="no-display-inline" id="H7659B44D96B042F5BAFF455BB0A7B7F9" style="USC"> <subsection id="HACD24B7BF1B34D94AA35E69865DF7379"><enum>(e)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="H1EB45A1EC52649709527C830220116EC"><enum>(1)</enum><text>Whoever, being a provider of an interactive computer service, publishes information provided by an information content provider, with reckless disregard that the information provided by the information content provider is in furtherance of an offense under subsection (a) or an attempt to commit such an offense, shall be fined in accordance with this title or imprisoned not more than 20 years, or both.</text>
 </paragraph><paragraph id="H5D1D2E53903C418B803AFE669E1F74F8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Nothing in paragraph (1) shall be construed to require the Federal Government in a prosecution, or a plaintiff in a civil action, to prove any intent on the part of the information content provider.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HE957E67F7C7A48E68733CFE2DD3A1C5D"><enum>(b)</enum><header>Clerical amendments</header><text display-inline="yes-display-inline">Such section is further amended by striking <quote>subsection (e)(2)</quote> each place it appears and inserting <quote>subsection (f)(2)</quote>.</text> </subsection></section></legis-body></bill>
