<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend the Communications Act of 1934 to clarify that section 230 of such Act does not prohibit the enforcement against providers and users of interactive computer services of Federal and State criminal and civil law relating to sexual exploitation of children or sex trafficking, and for other purposes.</official-title>

<legis-body display-enacting-clause="yes-display-enacting-clause" id="H2E55124B8D934082B93BAC2AE6819A4F" style="OLC"> 
<section id="HE19C80CF8D534DC4908D0C4FC9F13785" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Allow States and Victims to Fight Online Sex Trafficking Act of 2017</short-title></quote>.</text> </section> <section id="H3C4A080EAE7B47F489703C1A9DEE2044"><enum>2.</enum><header>Sense of congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HF68A58FF887A4873B2780B7ED34E0A8B"><enum>(1)</enum><text>section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>; commonly known as the <quote>Communications Decency Act of 1996</quote>) was never intended to provide legal protection to websites that unlawfully promote and facilitate prostitution and websites that facilitate traffickers in advertising the sale of unlawful sex acts with sex trafficking victims;</text> </paragraph> <paragraph id="H08FD7534BF52417A86411EDFAF34021B"><enum>(2)</enum><text>websites that promote and facilitate prostitution have been reckless in allowing the sale of sex trafficking victims and have done nothing to prevent the trafficking of children and victims of force, fraud, and coercion; and</text> </paragraph> 
<paragraph id="H9F0116D8BCEE4EAABC07AD902CEB9784"><enum>(3)</enum><text>clarification of such section is warranted to ensure that such section does not provide such protection to such websites.</text> </paragraph></section> <section id="H6F16212A0A2A49269F1C1BA4512FDF39"><enum>3.</enum><header>Promotion of prostitution and reckless disregard of sex trafficking</header> <subsection id="HCAF5A1818DF946FEAB7ED77AA3D40D6E"><enum>(a)</enum><header>Promotion of prostitution</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/117">Chapter 117</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2421">section 2421</external-xref> the following:</text>

<section id="H442BD8C97D1548D38C36CCE1562F6933"><enum>2421A.</enum><header>Promotion or facilitation of prostitution and reckless disregard of sex trafficking</header> 
<subsection id="H1F8DF22D7B4748FD86B44EA41CF0BCBE"><enum>(a)</enum><header>In general</header><text>Whoever, using a facility or means of interstate or foreign commerce or in or affecting interstate or foreign commerce, owns, manages, or operates an interactive computer service (as such term is defined in defined in section 230(f) the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>)), or conspires or attempts to do so, with the intent to promote or facilitate the prostitution of another person shall be fined under this title, imprisoned for not more than 10 years, or both.</text> </subsection> <subsection id="HDC50DD5489A34C11BB9D5383B74697FA"><enum>(b)</enum><header>Aggravated violation</header><text display-inline="yes-display-inline">Whoever, using a facility or means of interstate or foreign commerce or in or affecting interstate or foreign commerce, owns, manages, or operates an interactive computer service (as such term is defined in defined in section 230(f) the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>)), or conspires or attempts to do so, with the intent to promote or facilitate the prostitution of another person and—</text> 
<paragraph id="HC66D2419F1A044FA8484CADD464D30B1"><enum>(1)</enum><text display-inline="yes-display-inline">promotes or facilitates the prostitution of 5 or more persons; or</text> </paragraph> <paragraph id="HDA30DC13B99145B199112B07575A7A14"><enum>(2)</enum><text display-inline="yes-display-inline">acts in reckless disregard of the fact that such conduct contributed to sex trafficking, in violation of 1591(a),</text> </paragraph><continuation-text continuation-text-level="subsection">shall be fined under this title, imprisoned for not more than 25 years, or both.</continuation-text></subsection> 
<subsection id="H44A105B0B4E6474E920A75B8E6B4823A"><enum>(c)</enum><header>Civil recovery</header><text>Any person injured by reason of a violation of section 2421A(b) may recover damages and reasonable attorneys’ fees in an action before any appropriate United States district court. </text> </subsection> <subsection id="H616C912B32AB4F58BC844E2CE34958D7"><enum>(d)</enum><header>Mandatory restitution</header><text display-inline="yes-display-inline">Notwithstanding sections 3663 or 3663A and in addition to any other civil or criminal penalties authorized by law, the court shall order restitution for any violation of subsection (b)(2). The scope and nature of such restitution shall be consistent with section 2327(b).</text> </subsection> 
<subsection id="H8BFDE1EBD9E84635B783142DD7290615"><enum>(e)</enum><header>Affirmative Defense</header><text display-inline="yes-display-inline">It shall be an affirmative defense to a charge of violating subsection (a), or subsection (b)(1) where the defendant proves, by a preponderance of the evidence, that the promotion or facilitation of prostitution is legal in the jurisdiction where the promotion or facilitation was targeted.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="H1BCF7A5BA1734555AE9B93198A9278D7"><enum>(b)</enum><header>Table of contents</header><text>The table of contents for such chapter is amended by inserting after the item relating to section 2421 the following:</text>

<toc-entry level="section">2421A. Promotion or facilitation of prostitution and reckless disregard of sex trafficking.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H9DFCB82A3E4348F1AB18DCBF536E998C"><enum>4.</enum><header>Ensuring ability to enforce federal and state criminal and civil law relating to sex trafficking<editorial></editorial></header> 
<subsection id="H8EC172D6DC094CB58A582665A1FEC811"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 230(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(e)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H9E8F29B0F8AE40F3AAF863FF9663CCA7" display-inline="no-display-inline"> <paragraph id="HDDFD422E46B34098A6DFAC15622CD66A"><enum>(5)</enum><header>No effect on sex trafficking law</header><text display-inline="yes-display-inline">Nothing in this section (other than subsection (c)(2)(A)) shall be construed to impair or limit—</text> 
<subparagraph id="H592B0C7A25564204A56A3F351EE8BDBA"><enum>(A)</enum><text display-inline="yes-display-inline">any claim in a civil action brought under section 1595 of title 18, United States Code, if the conduct underlying the claim constitutes a violation of section 1591 of that title;</text></subparagraph> <subparagraph id="H5F8134B1A3704EF48B815BDBA016C1D3"><enum>(B)</enum><text>any charge in a criminal prosecution brought under State law if the conduct underlying the charge would constitute a violation of section 1591 of title 18, United States Code; or</text></subparagraph> 
<subparagraph id="H803290A81BFB446BA3721070D98F8BE7"><enum>(C)</enum><text>any charge in a criminal prosecution brought under State law if the conduct underlying the charge would constitute a violation of section 2421A of title 18, United States Code, and promotion or facilitation of prostitution is illegal in the jurisdiction where the defendant’s promotion or facilitation of prostitution was targeted. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="HDB0AEAE276E54ED4B567F64BEA237AAB"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date of the enactment of this Act, and the amendment made by subsection (a) shall apply regardless of whether the conduct alleged occurred, or is alleged to have occurred, before, on, or after such date of enactment.</text></subsection></section> 
<section id="H3D667865CC6A4849BFFF6388142653B2" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header>Ensuring Federal liability for publishing information designed to facilitate sex trafficking or otherwise facilitating sex trafficking</header><text display-inline="no-display-inline">Section 1591(e) of title 18, United States Code, is amended—</text> <paragraph id="HC21A9F86EAAA4141B5F7F5CB6F729638"><enum>(1)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (5) and (6), respectively; and</text></paragraph> 
<paragraph id="H23C7932D0A49409DA0A380AE15DEE33E"><enum>(2)</enum><text>by inserting after paragraph (3) the following: </text> <quoted-block style="OLC" id="H28842205140F4EF0BBACA05349665EE5" display-inline="no-display-inline"> <paragraph id="H2F6C2B2F943E4D27B2161950DF95B76F"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>participation in a venture</quote> means knowingly assisting, supporting, or facilitating a violation of subsection (a)(1). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H05E1EE088C16418DBDF93B7FCA40B342" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Actions by State attorneys general</header> 
<subsection id="H3363178B27BE4236B0214A96AD5E9EC8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1595 of title 18, United States Code, is amended by adding at the end the following: </text> <quoted-block style="USC" id="H7D4FB190987D43E695DFC8BA18F2E29F" display-inline="no-display-inline"> <subsection id="HBCE4F0B9F3BC489BAC60172F43019EBF"><enum>(d)</enum><text display-inline="yes-display-inline">In any case in which the attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by any person who violates section 1591, the attorney general of the State, as parens patriae, may bring a civil action against such person on behalf of the residents of the State in an appropriate district court of the United States to obtain appropriate relief. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H35B6CC382C83448C84CA665FFB52489D"><enum>(b)</enum><header>Technical and conforming amendments</header><text>Section 1595 of title 18, United States Code, is amended—</text> <paragraph id="H02373F50126A4EB2B0F5C7CF7433622E"><enum>(1)</enum><text>in subsection (b)(1), by striking <quote>this section</quote> and inserting <quote>subsection (a)</quote>; and</text></paragraph> 
<paragraph id="HAE8341C34F2C4B92A187BF4C47B355A6"><enum>(2)</enum><text>in subsection (c), in the matter preceding paragraph (1), by striking <quote>this section</quote> and inserting <quote>subsection (a)</quote>. </text></paragraph></subsection></section> <section id="H4C481C1CBE164ACC910580144F8E831B"><enum>7.</enum><header>Savings clause</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to limit or preempt any civil action or criminal prosecution under Federal law or State law (including State statutory law and State common law) filed before or after the day before the date of enactment of this Act that was not limited or preempted by section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>), as such section was in effect on the day before the date of enactment of this Act.</text> </section> 
<section id="H79EF3C6F244B4C8383EEEF1A19FF09A9"><enum>8.</enum><header>GAO Study</header><text display-inline="no-display-inline">On the date that is 3 years after the date of the enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to the Committees on the Judiciary of the House of Representatives and of the Senate, the Committee on Homeland Security of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate, a report which includes the following:</text> <paragraph id="H0732415B69AE496095A4926CEA128210"><enum>(1)</enum><text display-inline="yes-display-inline">Information on each civil action brought pursuant to section 2421A(c) of title 18, United States Code, that resulted in an award of damages, including the amount claimed, the nature or description of the losses claimed to support the amount claimed, the losses proven, and the nature or description of the losses proven to support the amount awarded. </text></paragraph> 
<paragraph id="HC18997F87DFF46B884CE6FC596FE2849"><enum>(2)</enum><text>Information on each civil action brought pursuant to section 2421A(c) of title 18, United States Code, that did not result in an award of damages, including—</text> <subparagraph id="HCB7E58BE307A478E8F3D7A943A0ED3E4"><enum>(A)</enum><text display-inline="yes-display-inline">the amount claimed and the nature or description of the losses claimed to support the amount claimed; and </text></subparagraph> 
<subparagraph id="H3D6C6172AEA242E5BA718894AAD086EB"><enum>(B)</enum><text>whether the case was dismissed, and if the case was dismissed, information describing the reason for the dismissal. </text></subparagraph></paragraph> <paragraph id="HF01A3A5C3B704F5BB7E8664730BEAACA"><enum>(3)</enum><text>Information on each order of restitution entered pursuant to section 2421A(d) of title 18, United States Code, including—</text> 
<subparagraph id="H92790C97F6CC43BC991E8349807EA535"><enum>(A)</enum><text>whether the defendant was a corporation or an individual; </text></subparagraph> <subparagraph id="H9E3C5FD50E9945C899FF8FF5B484E9A6"><enum>(B)</enum><text>the amount requested by the Government and the justification for, and calculation of, the amount requested, if restitution was requested; and </text></subparagraph> 
<subparagraph id="H588CBD82170E45BBAE0A84B0211315F5"><enum>(C)</enum><text>the amount ordered by the court and the justification for, and calculation of, the amount ordered. </text></subparagraph></paragraph> <paragraph id="H73BE9D54D6E54096BF545C9768A2A7D7"><enum>(4)</enum><text>For each defendant convicted of violating section 2421A(b) of title 18, United States Code, that was not ordered to pay restitution—</text> 
<subparagraph id="H98AA534F36E84F559974C2025BF7114B"><enum>(A)</enum><text>whether the defendant was a corporation or an individual;</text></subparagraph> <subparagraph id="H0F9A878266874E2894D38371FE3D7345"><enum>(B)</enum><text>the amount requested by the Government, if restitution was requested; and</text></subparagraph> 
<subparagraph id="HFA06CA5F6C194629913D3907BCFC9F74"><enum>(C)</enum><text>information describing the reason that the court did not order restitution. </text></subparagraph></paragraph></section> </legis-body> <attestation><attestation-group><role>Speaker of the House of Representatives.</role></attestation-group><attestation-group><role>Vice President of the United States and President of the Senate.</role></attestation-group></attestation> </bill>
