			 actions at sensitive locations, to clarify the powers of immigration
			 officers at sensitive locations, and for other purposes.</official-title></form>
	<legis-body id="H14536B347C734751917A5D3DF51608A1" style="OLC">
 <section id="H61FE6D3EC7504B1FA687AD0A0BB823CB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Sensitive Locations Act</short-title></quote>.</text> </section><section id="H0CA74FD6B82048AD8BDA8456CFA59CEC"><enum>2.</enum><header>Powers of immigration officers and employees at sensitive locations</header><text display-inline="no-display-inline">Section 287 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H1CBA3FEC935D43CBACFFE45CFA46D2B8" style="traditional">
				<subsection id="H3192E212485746898EC4ABABBD20FA0A"><enum>(i)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="HF63DBABD624B4B9B8A03B00DA2B432C1"><enum>(1)</enum><text>In order to ensure individuals’ access to sensitive locations, this subsection shall apply to any enforcement action by—</text>
 <subparagraph id="HCC8B18DB712143CCB86473752AFC7079" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">officers or agents of the Department of Homeland Security, including officers and agents of U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection; and</text>
 </subparagraph><subparagraph id="H60980A1B53B94442809BAA006CD9FD1D" indent="up1"><enum>(B)</enum><text>any individual designated to perform immigration enforcement functions pursuant to subsection (g).</text> </subparagraph></paragraph><paragraph id="H1DFE8A846DD74B54A1B3944BE2301D3B" indent="up1"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H6CC5DCF6EACE4F9EB9499C18E4EEBC68"><enum>(A)</enum><text>An enforcement action may not take place at, be focused on, or occur within, 1,000 feet of, a sensitive location, except—</text>
 <clause id="H8150CAD489784E4492384F0CC2499336" indent="up1"><enum>(i)</enum><text>under exigent circumstances; and</text> </clause><clause id="H37AA02425D20456BB4C51DD1BFEB00B3" indent="up1"><enum>(ii)</enum><text>if prior approval is obtained.</text>
 </clause></subparagraph><subparagraph id="H1DCED670F5EC4A2AB1E6B87BAAD83BD8" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If an enforcement action is taking place under exigent circumstances, and the exigent circumstances permitting the enforcement action cease, the enforcement action shall be discontinued until such exigent circumstances reemerge.</text>
						</subparagraph></paragraph><paragraph id="H5FE54692A89D4E95AFC714EAC459649D" indent="up1"><enum>(3)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H0FA8FA3EE8064CFFB7DE1C55A8662996"><enum>(A)</enum><text>When proceeding with an enforcement action at or near a sensitive location, individuals referred to in subparagraphs (A) and (B) of paragraph (1) shall make every effort—</text>
 <clause id="HF831D9BA82AD4DC484BE481BEA59BA92" indent="up1"><enum>(i)</enum><text>to conduct themselves as discreetly as possible, consistent with officer and public safety;</text> </clause><clause id="HD3FDEF4059C24721852936C337761529" indent="up1"><enum>(ii)</enum><text>to limit the time spent at the sensitive location; and</text>
 </clause><clause id="HDB4B3A7AD0404030B55EC94B4CA1724F" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">to limit the enforcement action to the person or persons for whom prior approval was obtained.</text> </clause></subparagraph><subparagraph id="H19AD41544FB6407897CD1E3D693D19D3" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If, in the course of an enforcement action that is not initiated at or focused on a sensitive location, individuals referred to in subparagraphs (A) and (B) of paragraph (1) are led to or near a sensitive location, and no exigent circumstance and prior approval with respect to the sensitive location exists, such individuals shall—</text>
 <clause id="H4E1B8E592BDA4466865570332EC870C8"><enum>(i)</enum><text>cease before taking any further enforcement action;</text> </clause><clause id="H5115D0003D344D9FB3D52CDAF013834D"><enum>(ii)</enum><text>conduct themselves in a discreet manner;</text>
 </clause><clause id="HB8C70D285BB34F89B8D2747EE7FE3A0A"><enum>(iii)</enum><text>maintain surveillance; and</text> </clause><clause id="HE3024BEE548C4BA789A4C4D42996AABB"><enum>(iv)</enum><text>immediately consult their supervisor in order to determine whether such enforcement action should be discontinued.</text>
 </clause></subparagraph><subparagraph id="HF4E305417F3C4068A61DAB7D0BF9C926" indent="up1"><enum>(C)</enum><text>This section shall not apply to the transportation of an individual apprehended at or near a land or sea border to a hospital or healthcare provider for the purpose of providing such individual medical care.</text>
 </subparagraph></paragraph><paragraph id="HB3E7F2E7557243FCA5A327E87FD1C658" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">If an enforcement action is carried out in violation of this subsection—</text> <subparagraph id="HFDA00740394642639F7A67CD6D785791"><enum>(A)</enum><text>no information resulting from the enforcement action may be entered into the record or received into evidence in a removal proceeding resulting from the enforcement action; and</text>
 </subparagraph><subparagraph id="H37690BC65FFC4A0F891C31DC08A552A8"><enum>(B)</enum><text>the alien who is the subject of such removal proceeding may file a motion for the immediate termination of the removal proceeding.</text>
						</subparagraph></paragraph><paragraph id="H6F275A0D1C5E47C2BE95E10632160F34" indent="up1"><enum>(5)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HBDB0E93FE63C4A74A6A8497B0A4F7ECA"><enum>(A)</enum><text>Each official specified in subparagraph (B) shall ensure that the employees under the supervision of such official receive annual training in compliance with the requirements of this subsection and section 239 of this Act and section 384 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1367">8 U.S.C. 1367</external-xref>).</text>
 </subparagraph><subparagraph id="HCA48421EEE1241779C684D6C013F434F" indent="up1"><enum>(B)</enum><text>The officials specified in this subparagraph are the following:</text> <clause id="H645526F9AAA1431FA576E95034819DF2"><enum>(i)</enum><text>The Chief Counsel of U.S. Immigration and Customs Enforcement.</text>
 </clause><clause id="HB81B96BA1B3D4577BFAB6B7F5451C2F7"><enum>(ii)</enum><text>The Field Office Directors of U.S. Immigration and Customs Enforcement.</text> </clause><clause id="HDA14B2D21B3F4FE5ACC4ADC35C0C5D2E"><enum>(iii)</enum><text>Each Special Agent in Charge of U.S. Immigration and Customs Enforcement.</text>
 </clause><clause id="H938E3632BFA24437A11EB89FDC7CBC93"><enum>(iv)</enum><text>Each Chief Patrol Agent of U.S. Customs and Border Protection.</text> </clause><clause id="HE9A1925D108E45A3BC2A348482FFA482"><enum>(v)</enum><text>The Director of Field Operations of U.S. Customs and Border Protection.</text>
 </clause><clause id="HE1564A0D144C45898D1A81D68CA6FC3A"><enum>(vi)</enum><text>The Director of Air and Marine Operations of U.S. Customs and Border Protection.</text> </clause><clause id="HC083B6E659EA40228157AD2678306274"><enum>(vii)</enum><text>The Internal Affairs Special Agent in Charge of U.S. Customs and Border Protection.</text>
							</clause></subparagraph></paragraph><paragraph id="HE0FC200005BA41418F84C115A0A249F4" indent="up1"><enum>(6)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H79C62B9C1F504FCFA721B684A45F36F5"><enum>(A)</enum><text>The Director of U.S. Immigration and Customs Enforcement and the Commissioner of U.S. Customs and Border Protection shall each submit to the appropriate committees of Congress each year a report on the enforcement actions undertaken by U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection, respectively, during the preceding year that were covered by this subsection.</text>
 </subparagraph><subparagraph id="H9B744F833BEA4536BB04959C2125048C" indent="up1"><enum>(B)</enum><text>Each report on an agency for a year under this paragraph shall set forth the following:</text> <clause id="HA0FD44EB530B4A0B942805F7571059D4"><enum>(i)</enum><text>The number of enforcement actions at or focused on a sensitive location.</text>
 </clause><clause id="HDE49924227254815B8827D5F160F2CD7"><enum>(ii)</enum><text>The number of enforcement actions where officers or agents were subsequently led to or near a sensitive location.</text>
 </clause><clause id="HD829BBD36E5E45F69EE55B0F2BF43E5F"><enum>(iii)</enum><text>The date, site, State, and local political subdivision (such as city, town, or county) in which each enforcement action covered by clause (i) or (ii) occurred.</text>
 </clause><clause id="H06BFB52285424C538612102EBC3D7172"><enum>(iv)</enum><text>The component of the agency responsible for each such enforcement action.</text> </clause><clause id="H207F0E5665ED427AB06A2911309F2ACA"><enum>(v)</enum><text>A description of the intended target of each such enforcement action.</text>
 </clause><clause id="HD5D7C9F295C24ADEB6B49BDA1AC659C0"><enum>(vi)</enum><text>The number of individuals, if any, arrested or taken into custody through each such enforcement action.</text>
 </clause><clause id="H828B5B4F7AA240DDA7A0EEF4A9424461"><enum>(vii)</enum><text>The number of collateral arrests, if any, from each such enforcement action and the reasons for each such arrest.</text>
 </clause><clause id="H1C8099A684D242A593142A6FA455A665"><enum>(viii)</enum><text>A certification of whether the location administrator was contacted prior to, during, or after each such enforcement action.</text>
 </clause></subparagraph></paragraph><paragraph id="HBF4C665B502047658CBB9DB503D063AB" indent="up1"><enum>(7)</enum><text>In this subsection:</text> <subparagraph id="HA99201C376274A6EBE6E3CE1ACDF36F2"><enum>(A)</enum><text>The term <quote>appropriate committees of Congress</quote> means—</text>
 <clause id="H38488C4A4A9F4CF999DFF65E125EA396"><enum>(i)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text> </clause><clause id="HA45EB36B69144E99B1BCC4AA45C81D78"><enum>(ii)</enum><text>the Committee on the Judiciary of the Senate;</text>
 </clause><clause id="H5CE951DD1D234D19AB805268BACCB86C"><enum>(iii)</enum><text>the Committee on Homeland Security of the House of Representatives;</text> </clause><clause id="H991F3FDB12E64E29878148BF6388296F"><enum>(iv)</enum><text>the Committee on the Judiciary of the House of Representatives;</text>
 </clause><clause id="H1C60EE01F9AE47818D092D96544BDE56"><enum>(v)</enum><text display-inline="yes-display-inline">the Committee on Appropriations of the House of Representatives; and</text> </clause><clause id="H08FE1EACD1944C7E86DE7A383C2CD3D9"><enum>(vi)</enum><text display-inline="yes-display-inline">the Committee on Appropriations of the Senate.</text>
 </clause></subparagraph><subparagraph id="H70A222EEAF264558917128C7C259C752"><enum>(B)</enum><text>The term <quote>enforcement action</quote> means an arrest, interview, search, or surveillance for the purposes of immigration enforcement, and includes an enforcement action at, or focused on, a sensitive location that is part of a joint case led by another law enforcement agency.</text>
 </subparagraph><subparagraph id="H2552E86B5E914FA0A56211A1872B7834"><enum>(C)</enum><text>The term <quote>exigent circumstances</quote> means a situation involving the following:</text> <clause id="H8017C80543B14D16A8982D7A5D15AFB7"><enum>(i)</enum><text>The imminent risk of death, violence, or physical harm to any person, including a situation implicating terrorism or the national security of the United States in some other manner.</text>
 </clause><clause id="H83A61A1ED0FC45A2ADA689C9DE276665"><enum>(ii)</enum><text>The immediate arrest or pursuit of a dangerous felon, terrorist suspect, or other individual presenting an imminent danger or public safety risk.</text>
 </clause><clause id="H7FD652A9936B420DA28BF876693786ED"><enum>(iii)</enum><text>The imminent risk of destruction of evidence that is material to an ongoing criminal case.</text> </clause></subparagraph><subparagraph id="H18DB40DCB92B44479F9EBE00C66EB1DF"><enum>(D)</enum><text>The term <quote>prior approval</quote> means the following:</text>
 <clause id="H74D5CE6CCDFE442D8E362F2DF3475846"><enum>(i)</enum><text>In the case of officers and agents of U.S. Immigration and Customs Enforcement, prior written approval for a specific, targeted operation from one of the following officials:</text>
 <subclause id="H4DC16FA8CB634113BB1A256630E7A969"><enum>(I)</enum><text>The Assistant Director of Operations, Homeland Security Investigations.</text> </subclause><subclause id="H6DED1955828C4BE6ADDF98AE81320FAA"><enum>(II)</enum><text>The Executive Associate Director of Homeland Security Investigations.</text>
 </subclause><subclause id="H8DE2672E91234C2F96D1357F3A9CAFEB"><enum>(III)</enum><text>The Assistant Director for Field Operations, Enforcement, and Removal Operations.</text> </subclause><subclause id="H471790E2C1944831861E7392E06D9CB0"><enum>(IV)</enum><text>The Executive Associate Director for Field Operations, Enforcement, and Removal Operations.</text>
 </subclause></clause><clause id="H5576CF5BD9CB42198C58F248AE699B9F"><enum>(ii)</enum><text>In the case of officers and agents of U.S. Customs and Border Protection, prior written approval for a specific, targeted operation from one of the following officials:</text>
 <subclause id="H9C52D94072F34D10B37D7CEE7CE9132B"><enum>(I)</enum><text>A Chief Patrol Agent.</text> </subclause><subclause id="HD2FB678F1A9F42DDB177B6DACCD5B592"><enum>(II)</enum><text>The Director of Field Operations.</text>
 </subclause><subclause id="HBCF54D009217493E882EB71F4073D6B3"><enum>(III)</enum><text>The Director of Air and Marine Operations</text> </subclause><subclause id="HACF2B7B0DB39407E8157EBDE6B9B436A"><enum>(IV)</enum><text>The Internal Affairs Special Agent in Charge.</text>
 </subclause></clause></subparagraph><subparagraph id="H40566C783B374DC0BAA16BE8B0AD4CDA"><enum>(E)</enum><text display-inline="yes-display-inline">The term <quote>sensitive location</quote> includes all of the physical space located within 1,000 feet of the following:</text> <clause id="HDAE98E4D70B24A1080A6CD342BBAB5AE"><enum>(i)</enum><text display-inline="yes-display-inline">Any medical treatment or health care facility, including any hospital, doctor’s office, accredited health clinic, or emergent or urgent care facility, or community health center.</text>
 </clause><clause id="H628C375A0DBB40F5BC740DCFB133E03B"><enum>(ii)</enum><text>Public and private schools (including pre-schools, primary schools, secondary schools, postsecondary schools (including colleges and universities), and other institutions of learning such as vocational or trade schools).</text>
 </clause><clause id="HD50ED23F52654DB98EFBF73A58446A9C"><enum>(iii)</enum><text display-inline="yes-display-inline">Any scholastic or education-related activity or event, including field trips and interscholastic events.</text>
 </clause><clause id="H3D1B4FE650C346399CA020B7B2B83559"><enum>(iv)</enum><text display-inline="yes-display-inline">Any school bus or school bus stop during periods when school children are present on the bus or at the stop.</text>
 </clause><clause id="H2F9FDC252A8F40F38DF9BA49D529699C"><enum>(v)</enum><text>Locations where emergency services providers provide shelter or food.</text> </clause><clause id="H610B511792E5434B858B84161A1387A2"><enum>(vi)</enum><text display-inline="yes-display-inline">Locations of any organization that—</text>
 <subclause id="HCDD1C2D16FAC42DA8390CDCE29F9BC9D"><enum>(I)</enum><text display-inline="yes-display-inline">assists children, pregnant women, victims of crime or abuse, or individuals with significant mental or physical disabilities, including domestic violence shelters, rape crisis centers, supervised visitation centers, family justice centers, and victims services providers; or</text>
 </subclause><subclause id="H7EF3B2194E784A8E8BC53F36949AA900"><enum>(II)</enum><text>provides disaster or emergency social services and assistance, including, but not limited to, food banks and homeless shelters.</text>
 </subclause></clause><clause id="H51B603A1DFB8457EB0A8EE9DF06CF335"><enum>(vii)</enum><text>Churches, synagogues, mosques, and other places of worship, such as buildings rented for the purpose of religious services.</text>
 </clause><clause id="HAFDE968A88B34D2AB36920C4A3EA5C4C"><enum>(viii)</enum><text>Sites of funerals, weddings, or other public religious ceremonies.</text> </clause><clause id="HAB1EC214C6234833B4CD567B8257AF88"><enum>(ix)</enum><text>Sites during the occurrence of a public demonstration, such as a march, rally, or parade.</text>
 </clause><clause id="H15C54CF19ED34D79AA1E4F675563457B"><enum>(x)</enum><text display-inline="yes-display-inline">Any Federal, State, or local courthouse, including the office of an individual’s legal counsel or representative, and a probation office.</text>
 </clause><clause id="H51A673C3527D4C5DA32D90638C82D249"><enum>(xi)</enum><text>Congressional district offices.</text> </clause><clause id="H8C928291BC7845D6931FEFBE02148584"><enum>(xii)</enum><text>Public assistance offices.</text>
 </clause><clause id="H33F743779A0D4FF7BDC98D5FBC761787"><enum>(xiii)</enum><text>Social Security offices.</text> </clause><clause id="H2C574059059F44519BCD52AD3EEE55FB"><enum>(xiv)</enum><text display-inline="yes-display-inline">Indoor and outdoor premises of departments of motor vehicles.</text>
 </clause><clause id="HB3E09D1DBE1C425AACA77F10BF0EC713"><enum>(xv)</enum><text>Such other locations as the Secretary of Homeland Security shall specify for purposes of this subsection.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
