<title id="HCFB9EB4CD91F49CFA18D92BC49E24D36" style="OLC"><enum>I</enum><header>Cow Creek Umpqua Land Conveyance</header> 
<section id="H854CD2D9D81443C88130E8016F83C372" section-type="subsequent-section"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H6A8101F0393C4601AAED1672401EBD60"><enum>(1)</enum><header>Council creek land</header><text>The term <term>Council Creek land</term> means the approximately 17,519 acres of land, as generally depicted on the map entitled <quote>Canyon Mountain Land Conveyance</quote> and dated May 24, 2016.</text> </paragraph>
<paragraph id="H3CA18E139A9E4ED9AA245E04711F0139"><enum>(2)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Cow Creek Band of Umpqua Tribe of Indians.</text> </paragraph> <paragraph id="H08E36B2BBE4C42788608492B4EF44709"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section>
<section id="H5ABE736D61BE428993913867BD9068EC"><enum>102.</enum><header>Land to be held in trust</header> 
<subsection id="HA9ED6374DA744BF5A794B983E428F041"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, including rights-of-way, all right, title, and interest of the United States in and to the Council Creek land, including any improvements located on the land, appurtenances to the land, and minerals on or in the land, including oil and gas, shall be—</text> <paragraph id="H6A5A904FA56248F6B1E4158DD6BDF4C4"><enum>(1)</enum><text>held in trust by the United States for the benefit of the Tribe; and</text> </paragraph>
<paragraph id="HE72F31CA641C4D86A96EE7D6518B85EB"><enum>(2)</enum><text>part of the reservation of the Tribe.</text> </paragraph></subsection> <subsection id="H4502A606F79D41B69849BC0E8411F912"><enum>(b)</enum><header>Survey</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall complete a survey to establish the boundaries of the land taken into trust under subsection (a).</text> </subsection>
<subsection id="H9D38D74108BC4945B432C74FB17F0730"><enum>(c)</enum><header>Effective date</header><text>Subsection (a) shall take effect on the day after the date on which the Secretary records the agreement entered into under section 104(d)(1).</text> </subsection></section> <section id="H4D02CA4C665B4A19B462F12DE55CE78A"><enum>103.</enum><header>Map and legal description</header> <subsection id="HCBCF187A249945CC8765831A1C1DCEA6"><enum>(a)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and legal description of the Council Creek land with—</text> 
<paragraph id="H81948CFB5D2D4CD0A10330BF82BBDE05"><enum>(1)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </paragraph> <paragraph id="H48CA923B5F1145A1929748C6B71B783E"><enum>(2)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </paragraph></subsection>
<subsection id="H71C1B7638D2A42498865A0315A50F09A"><enum>(b)</enum><header>Force and effect</header><text>The map and legal description filed under subsection (a) shall have the same force and effect as if included in this title, except that the Secretary may correct any clerical or typographical errors in the map or legal description.</text> </subsection> <subsection id="H8D1850D0610C42FFBBE262FA059DA3DA"><enum>(c)</enum><header>Public availability</header><text>The map and legal description filed under subsection (a) shall be on file and available for public inspection in the Office of the Secretary.</text> </subsection></section>
<section id="H5F900FF7FBB1413582DA1E263AE2DD3C"><enum>104.</enum><header>Administration</header> 
<subsection id="H41165C93740C487EB1ABAF96CA462715"><enum>(a)</enum><header>In general</header><text>Unless expressly provided in this title, nothing in this title affects any right or claim of the Tribe existing on the date of enactment of this Act to any land or interest in land.</text> </subsection> <subsection id="H77FA8ECCF7014277BE72E25E45B20E22"><enum>(b)</enum><header>Prohibitions</header> <paragraph id="H88F9BE28FD854F7394CF1D2C30F089A0"><enum>(1)</enum><header>Exports of unprocessed logs</header><text>Federal law (including regulations) relating to the export of unprocessed logs harvested from Federal land shall apply to any unprocessed logs that are harvested from the Council Creek land.</text> </paragraph>
<paragraph id="H1D4469DEDF4E43E19E543BC3E5C57829"><enum>(2)</enum><header>Non-permissible use of land</header><text>Any real property taken into trust under section 102 shall not be eligible, or used, for any gaming activity carried out under <external-xref legal-doc="public-law" parsable-cite="pl/100/497">Public Law 100–497</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701</external-xref> et seq.).</text> </paragraph></subsection> <subsection id="HE4EE3097E8CB4FAEAF8DD2263DDFCE43"><enum>(c)</enum><header>Forest management</header><text display-inline="yes-display-inline">Any forest management activity that is carried out on the Council Creek land shall be managed in accordance with all applicable Federal laws.</text> </subsection>
<subsection id="H4DA7932A78AD416BBCA61482861E3044"><enum>(d)</enum><header>Agreements</header> 
<paragraph id="HBD31F9EDC149448FA4ABCAED758264C0"><enum>(1)</enum><header>Memorandum of agreement for administrative access</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall seek to enter into an agreement with the Tribe that secures existing administrative access by the Secretary to the Council Creek land.</text> </paragraph> <paragraph id="HD218FBE7353B4A16B6C7DFD46790F448"><enum>(2)</enum><header>Reciprocal right-of-way agreements</header> <subparagraph id="HBA5B6AD0287446C4AB9EA61D16324391"><enum>(A)</enum><header>In general</header><text>On the date on which the agreement is entered into under paragraph (1), the Secretary shall provide to the Tribe all reciprocal right-of-way agreements to the Council Creek land in existence as of the date of enactment of this Act.</text> </subparagraph>
<subparagraph id="H704124A8B84E451B80E8EF31ECE70316"><enum>(B)</enum><header>Continued access</header><text>Beginning on the date on which the Council Creek land is taken into trust under section 102, the Tribe shall continue the access provided by the agreements referred to in subparagraph (A) in perpetuity.</text> </subparagraph></paragraph></subsection> <subsection id="H24E09089E40F46DEBFC6EFE2B264F33A"><enum>(e)</enum><header>Land use planning requirements</header><text>Except as provided in subsection (c), once the Council Creek land is taken into trust under section 102, the Council Creek land shall not be subject to the land use planning requirements of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.) or the Act of August 28, 1937 (<external-xref legal-doc="usc" parsable-cite="usc/43/1181a">43 U.S.C. 1181a</external-xref> et seq.).</text> </subsection></section>
<section id="H71CCE0AB63C543D0BB673EBB5133640C"><enum>105.</enum><header>Land reclassification</header> 
<subsection id="H5CBC5B6C14534396A13F5164CA87C3E0"><enum>(a)</enum><header>Identification of Oregon and California railroad grant land</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture and the Secretary shall identify any Oregon and California Railroad grant land that is held in trust by the United States for the benefit of the Tribe under section 102.</text> </subsection> <subsection id="H7D6B741A5C0641FBA51975A29A92090C"><enum>(b)</enum><header>Identification of public domain land</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall identify public domain land in the State of Oregon that—</text> 
<paragraph id="HB94B550D073647EDA61595F7D55E3F80"><enum>(1)</enum><text display-inline="yes-display-inline">is approximately equal in acreage and condition as the Oregon and California Railroad grant land identified under subsection (a); and</text> </paragraph> <paragraph id="H33F3321C33514E419B19F741C61EE378"><enum>(2)</enum><text display-inline="yes-display-inline">is located within the 18 western Oregon and California Railroad grant land counties (other than Klamath County, Oregon).</text> </paragraph></subsection>
<subsection id="H36F5D434C9D14C4E80029C18DB56A430"><enum>(c)</enum><header>Maps</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to Congress and publish in the Federal Register one or more maps depicting the land identified in subsections (a) and (b).</text> </subsection> <subsection id="H1AC054276DF74541A4BD766AA46573A3"><enum>(d)</enum><header>Reclassification</header> <paragraph id="H1FA1FCA089DA482BAAFE00165C36CB33"><enum>(1)</enum><header>In general</header><text>After providing an opportunity for public comment, the Secretary shall reclassify the land identified in subsection (b) as Oregon and California Railroad grant land.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE0C78C49BEE5431DB3442F59A23F2CF0"><enum>(2)</enum><header>Applicability</header><text>The Act of August 28, 1937 (<external-xref legal-doc="usc" parsable-cite="usc/43/1181a">43 U.S.C. 1181a</external-xref> et seq.), shall apply to land reclassified as Oregon and California Railroad grant land under paragraph (1).</text> </paragraph></subsection></section></title> <title id="HDBC0EDBAA614486DBAD200A8095D0354" style="OLC"><enum>II</enum><header>Oregon Coastal Land Conveyance</header> <section id="HF84F894A915B4FA8B2535C510381AE97"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="HCBA4A77A54E54DAAACB810095D2CBF92"><enum>(1)</enum><header>Confederated tribes</header><text>The term <term>Confederated Tribes</term> means the Confederated Tribes of Coos, Lower Umpqua, and Siuslaw Indians.</text> </paragraph> <paragraph id="H0CB026F7B6AC431CA9B7DCBEFF263BC5"><enum>(2)</enum><header>Oregon coastal land</header><text>The term <term>Oregon Coastal land</term> means the approximately 14,742 acres of land, as generally depicted on the map entitled <quote>Oregon Coastal Land Conveyance</quote> and dated July 11, 2016.</text> </paragraph>
<paragraph id="H5ACD396900BC4507BB04C876724BCB0D"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section> <section id="HA7474FD9E6FB49F08DA47C0B3FC30508"><enum>202.</enum><header>Land to be held in trust</header> <subsection id="H1EFE48973DCB4F8A90485DD1C0AEDFFB"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, including rights-of-way, all right, title, and interest of the United States in and to the Oregon Coastal land, including any improvements located on the land, appurtenances to the land, and minerals on or in the land, including oil and gas, shall be—</text> 
<paragraph id="H88D0910B216F4B92938E4ABF6E1F408C"><enum>(1)</enum><text>held in trust by the United States for the benefit of the Confederated Tribes; and</text> </paragraph> <paragraph id="H9449029FD57F4512BA7868B5BFA256B6"><enum>(2)</enum><text>part of the reservation of the Confederated Tribes.</text> </paragraph></subsection>
<subsection id="H7BB849C266EC4363A5EAD7B5E3315F9B"><enum>(b)</enum><header>Survey</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall complete a survey to establish the boundaries of the land taken into trust under subsection (a).</text> </subsection> <subsection id="H46007C4C18F345C3A9BEEE59769CBE95"><enum>(c)</enum><header>Effective date</header><text>Subsection (a) shall take effect on the day after the date on which the Secretary records the agreement entered into under section 204(d)(1).</text> </subsection></section>
<section id="H8AEEDABEACFA41DD8153EB89C147AC26"><enum>203.</enum><header>Map and legal description</header> 
<subsection id="H3784250321344FBC8857AC101A527147"><enum>(a)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and legal description of the Oregon Coastal land with—</text> <paragraph id="H25CC184F7BF24767A404E9FD2E845E43"><enum>(1)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </paragraph>
<paragraph id="H465444025EF242769B79D3A65CF326C6"><enum>(2)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </paragraph></subsection> <subsection id="HFD0EC48C039148AD82BCA41466036152"><enum>(b)</enum><header>Force and effect</header><text>The map and legal description filed under subsection (a) shall have the same force and effect as if included in this title, except that the Secretary may correct any clerical or typographical errors in the map or legal description.</text> </subsection>

<subsection id="H7D1B6353DB3D463E8B1F9092C2DC6687"><enum>(b)</enum><header>Prohibitions</header> 
<paragraph id="HE147CEBACE2C4774A0EC0C305A8DC0D0"><enum>(1)</enum><header>Exports of unprocessed logs</header><text display-inline="yes-display-inline">Federal law (including regulations) relating to the export of unprocessed logs harvested from Federal land shall apply to any unprocessed logs that are harvested from the Oregon Coastal land taken into trust under section 202.</text> </paragraph> <paragraph id="H5A645BC8B534449392613EE645B0AAC2"><enum>(2)</enum><header>Non-permissible use of land</header><text>Any real property taken into trust under section 202 shall not be eligible, or used, for any gaming activity carried out under <external-xref legal-doc="public-law" parsable-cite="pl/100/497">Public Law 100–497</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701</external-xref> et seq.).</text> </paragraph></subsection>
<subsection id="HE6AFB5E978504F6F9E9410DADD687B52"><enum>(c)</enum><header>Forest management</header><text>Any forest management activity that is carried out on the Oregon Coastal land shall be managed in accordance with all applicable Federal laws.</text> </subsection> <subsection id="H2E4A0BD9234943C4B570D175455021FE"><enum>(d)</enum><header>Agreements</header> <paragraph id="H2E70ADDDDDED40C9944FD3726B9151CE"><enum>(1)</enum><header>Memorandum of agreement for administrative access</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall seek to enter into an agreement with the Confederated Tribes that secures existing administrative access by the Secretary to the Oregon Coastal land and that provides for—</text> 
<subparagraph id="HC00AFB0EE6274000AB75DF65518C281F"><enum>(A)</enum><text>access for certain activities, including—</text> <clause id="H5A1C4931EA164D7FB011834999E09251"><enum>(i)</enum><text>forest management;</text> </clause>
<clause id="H3FCBDB21040547F886B2462117BB0766"><enum>(ii)</enum><text>timber and rock haul;</text> </clause> <clause id="H6DFB094D0B0B438EB3EF9197C7B7965A"><enum>(iii)</enum><text>road maintenance;</text> </clause>
<clause id="HBDA43C5D47A942EABA0C7429EE591CCA"><enum>(iv)</enum><text>wildland fire protection and management;</text> </clause> <clause id="H729F2FAADC3042BEA1E0E1944205A098"><enum>(v)</enum><text>cadastral surveys;</text> </clause>
<clause id="H3F1AE0022D914BCB991FAB1C5180FEFB"><enum>(vi)</enum><text>wildlife, cultural, and other surveys; and</text> </clause> <clause id="H24131C06505E437DA21576634E4BC482"><enum>(vii)</enum><text>law enforcement activities;</text> </clause></subparagraph>
<subparagraph id="H73DC3488448C41949E32CA885727254C"><enum>(B)</enum><text>the management of the Oregon Coastal land that is acquired or developed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/2003">chapter 2003</external-xref> of title 54, United States Code, consistent with section 200305(f)(3) of that title; and</text> </subparagraph> <subparagraph id="HAD0EC2389BB741FE96DAFBCF629D224C"><enum>(C)</enum><text>the terms of public vehicular transit across the Oregon Coastal land to and from the Hult Log Storage Reservoir located in T. 15 S., R. 7 W., as generally depicted on the map described in section 201(2), subject to the requirement that if the Bureau of Land Management discontinues maintenance of the public recreation site known as <quote>Hult Reservoir</quote>, the terms of any agreement in effect on that date that provides for public vehicular transit to and from the Hult Log Storage Reservoir shall be void.</text> </subparagraph></paragraph>
<paragraph id="H50632A39382F4A3DAEE69226737923C4"><enum>(2)</enum><header>Reciprocal right-of-way agreements</header> 
<subparagraph id="H85D769D21B464EC8A9926C7780D61DAB"><enum>(A)</enum><header>In general</header><text>On the date on which the agreement is entered into under paragraph (1), the Secretary shall provide to the Confederated Tribes all reciprocal right-of-way agreements to the Oregon Coastal land in existence on the date of enactment of this Act.</text> </subparagraph> <subparagraph id="HC79EC82FF6E74DBCA8FD15834F2F8280"><enum>(B)</enum><header>Continued access</header><text>Beginning on the date on which the Oregon Coastal land is taken into trust under section 202, the Confederated Tribes shall continue the access provided by the reciprocal right-of-way agreements referred to in subparagraph (A) in perpetuity.</text> </subparagraph></paragraph></subsection>
<subsection id="HFCE45370AA2641AFBA238FC7D1301D22"><enum>(e)</enum><header>Land use planning requirements</header><text display-inline="yes-display-inline">Except as provided in subsection (c), once the Oregon Coastal land is taken into trust under section 202, the Oregon Coastal land shall not be subject to the land use planning requirements of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.) or the Act of August 28, 1937 (<external-xref legal-doc="usc" parsable-cite="usc/43/1181a">43 U.S.C. 1181a</external-xref> et seq.).</text> </subsection></section> <section id="HF191BEBCAC4542A9802074A6D6B894D1"><enum>205.</enum><header>Land reclassification</header> <subsection id="H3A28BC4FF536497E8DB9F47BFB4FDB93"><enum>(a)</enum><header>Identification of Oregon and California railroad grant land</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture and the Secretary shall identify any Oregon and California Railroad grant land that is held in trust by the United States for the benefit of the Confederated Tribes under section 202.</text> </subsection>
<subsection id="HCCA9C93A16314D1FB53540611842E7D5"><enum>(b)</enum><header>Identification of public domain land</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall identify public domain land in the State of Oregon that—</text> <paragraph id="H642FB30017E24F1DB50F5B37C81D17EE"><enum>(1)</enum><text display-inline="yes-display-inline">is approximately equal in acreage and condition as the Oregon and California Railroad grant land identified under subsection (a); and</text> </paragraph>
<paragraph id="H80DBCF42BC8A47F0A86C76F9349508B7"><enum>(2)</enum><text display-inline="yes-display-inline">is located within the 18 western Oregon and California Railroad grant land counties (other than Klamath County, Oregon).</text> </paragraph></subsection> <subsection id="H2324D158A8C2478BAA143801425D03D6"><enum>(c)</enum><header>Maps</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to Congress and publish in the Federal Register one or more maps depicting the land identified in subsections (a) and (b).</text> </subsection>
<subsection id="H2AFEE04190AB4CB398A1A83CA1F20780"><enum>(d)</enum><header>Reclassification</header> 
<paragraph id="H5D280BB61EA34CC4B1EE9FEB7CB97751"><enum>(1)</enum><header>In general</header><text>After providing an opportunity for public comment, the Secretary shall reclassify the land identified in subsection (b) as Oregon and California Railroad grant land.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE48A7091B76B4FCC905E0F723EB9983D"><enum>(2)</enum><header>Applicability</header><text>The Act of August 28, 1937 (<external-xref legal-doc="usc" parsable-cite="usc/43/1181a">43 U.S.C. 1181a</external-xref> et seq.), shall apply to land reclassified as Oregon and California Railroad grant land under paragraph (1).</text> </paragraph></subsection></section></title>
<title id="H74F70AE8752E45A0B5E15A6E4666E559" style="OLC"><enum>III</enum><header>Amendments to Coquille Restoration Act</header> 
<section id="HB36C0081CAB740AABC5E89EB99A0CBD7"><enum>301.</enum><header>Amendments to Coquille Restoration Act</header><text display-inline="no-display-inline">Section 5(d) of the Coquille Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/42">Public Law 101–42</external-xref>; 103 Stat. 92, 110 Stat. 3009–537) is amended—</text> <paragraph id="H0B132D0113D74CF99FD724D8A3BD66E9"><enum>(1)</enum><text>by striking paragraph (5) and inserting the following:</text>

<paragraph id="H3089479F4DE34832A133974545229C0A"><enum>(5)</enum><header>Management</header> 
<subparagraph id="H3F3F0F95DA9D40FF9E66EF92B6B73F73"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Secretary, acting through the Assistant Secretary for Indian Affairs, shall manage the Coquille Forest in accordance with the laws pertaining to the management of Indian trust land.</text> </subparagraph> <subparagraph id="H623A242C54ED46069B159DA00FE13622"><enum>(B)</enum><header>Administration</header> <clause id="HBF71C37092D64B5B9FC505F7D6E0DDA7"><enum>(i)</enum><header>Unprocessed logs</header><text>Unprocessed logs harvested from the Coquille Forest shall be subject to the same Federal statutory restrictions on export to foreign nations that apply to unprocessed logs harvested from Federal land.</text> </clause>
<clause id="H7991EACBC138444CB2269D990244BB20"><enum>(ii)</enum><header>Sales of timber</header><text>Notwithstanding any other provision of law, all sales of timber from land subject to this subsection shall be advertised, offered, and awarded according to competitive bidding practices, with sales being awarded to the highest responsible bidder.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="H2E16864A3EDB4F24BF3BE7AEB135EF1F"><enum>(2)</enum><text>by striking paragraph (9); and</text> </paragraph>
