<section id="d32624e171" identifier="/us/bill/115/hr/1306/tI/s101" style="-uslm-lc:I650143"><num value="101">SEC. 101. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  In this title:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e177" identifier="/us/bill/115/hr/1306/tI/s101/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Council creek land</inline>.—</heading><content>The term “<term>Council Creek land</term>” means the approximately 17,519 acres of land, as generally depicted on the map entitled “Canyon Mountain Land Conveyance” and dated May 24, 2016.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e185" identifier="/us/bill/115/hr/1306/tI/s101/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Tribe</inline>.—</heading><content>The term “<term>Tribe</term>” means the Cow Creek Band of Umpqua Tribe of Indians.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e193" identifier="/us/bill/115/hr/1306/tI/s101/3" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph></section>
<section id="d32624e202" identifier="/us/bill/115/hr/1306/tI/s102" style="-uslm-lc:I650143"><num value="102">SEC. 102. </num><heading>LAND TO BE HELD IN TRUST.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e206" identifier="/us/bill/115/hr/1306/tI/s102/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Subject to valid existing rights, including rights-of-way, all right, title, and interest of the United States in and to the Council Creek land, including any improvements located on the land, appurtenances to the land, and minerals on or in the land, including oil and gas, shall be—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e214" identifier="/us/bill/115/hr/1306/tI/s102/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>held in trust by the United States for the benefit of the Tribe; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e218" identifier="/us/bill/115/hr/1306/tI/s102/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>part of the reservation of the Tribe.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e222" identifier="/us/bill/115/hr/1306/tI/s102/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Survey</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Secretary shall complete a survey to establish the boundaries of the land taken into trust under subsection (a).</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e230" identifier="/us/bill/115/hr/1306/tI/s102/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Effective Date</inline>.—</heading><content>Subsection (a) shall take effect on the day after the date on which the Secretary records the agreement entered into under section 104(d)(1).</content></subsection></section>
<section id="d32624e239" identifier="/us/bill/115/hr/1306/tI/s103" style="-uslm-lc:I650143"><num value="103">SEC. 103. </num><heading>MAP AND LEGAL DESCRIPTION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e243" identifier="/us/bill/115/hr/1306/tI/s103/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and legal description of the Council Creek land with—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e251" identifier="/us/bill/115/hr/1306/tI/s103/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Energy and Natural Resources of the Senate; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e255" identifier="/us/bill/115/hr/1306/tI/s103/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Natural Resources of the House of Representatives.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e259" identifier="/us/bill/115/hr/1306/tI/s103/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Force and Effect</inline>.—</heading><content>The map and legal description filed under subsection (a) shall have the same force and effect as if included in this title, except that the Secretary may correct any clerical or typographical errors in the map or legal description.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e267" identifier="/us/bill/115/hr/1306/tI/s103/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Public Availability</inline>.—</heading><content>The map and legal description filed under subsection (a) shall be on file and available for public inspection in the Office of the Secretary.</content></subsection></section>
<section id="d32624e276" identifier="/us/bill/115/hr/1306/tI/s104" style="-uslm-lc:I650143"><num value="104">SEC. 104. </num><heading>ADMINISTRATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e280" identifier="/us/bill/115/hr/1306/tI/s104/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Unless expressly provided in this title, nothing in this title affects any right or claim of the Tribe existing on the date of enactment of this Act to any land or interest in land.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e288" identifier="/us/bill/115/hr/1306/tI/s104/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Prohibitions</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e295" identifier="/us/bill/115/hr/1306/tI/s104/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Exports of unprocessed logs</inline>.—</heading><content>Federal law (including regulations) relating to the export of unprocessed logs harvested from Federal land shall apply to any unprocessed logs that are harvested from the Council Creek land.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e303" identifier="/us/bill/115/hr/1306/tI/s104/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Non-permissible use of land</inline>.—</heading><content>Any real property taken into trust under section 102 shall not be eligible, or used, for any gaming activity carried out under <ref href="/us/pl/100/497">Public Law 100–497</ref> (<ref href="/us/usc/t25/s2701/etseq">25 U.S.C. 2701 et seq.</ref>).</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e318" identifier="/us/bill/115/hr/1306/tI/s104/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Forest Management</inline>.—</heading><content>Any forest management activity that is carried out on the Council Creek land shall be managed in accordance with all applicable Federal laws.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e326" identifier="/us/bill/115/hr/1306/tI/s104/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Agreements</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e333" identifier="/us/bill/115/hr/1306/tI/s104/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Memorandum of agreement for administrative access</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, the Secretary shall seek to enter into an agreement with the Tribe that secures existing administrative access by the Secretary to the Council Creek land.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e341" identifier="/us/bill/115/hr/1306/tI/s104/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Reciprocal right-of-way agreements</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32624e348" identifier="/us/bill/115/hr/1306/tI/s104/d/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>On the date on which the agreement is entered into under paragraph (1), the Secretary shall provide to the Tribe all reciprocal right-of-way agreements to the Council Creek land in existence as of the date of enactment of this Act.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32624e356" identifier="/us/bill/115/hr/1306/tI/s104/d/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Continued access</inline>.—</heading><content>Beginning on the date on which the Council Creek land is taken into trust under section 102, the Tribe shall continue the access provided by the agreements referred to in subparagraph (A) in perpetuity.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e364" identifier="/us/bill/115/hr/1306/tI/s104/e" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="e">(e) </num><heading><inline class="smallCaps">Land Use Planning Requirements</inline>.—</heading><content>Except as provided in subsection (c), once the Council Creek land is taken into trust under section 102, the Council Creek land shall not be subject to the land use planning requirements of the Federal Land Policy and Management Act of 1976 (<ref href="/us/usc/t43/s1701/etseq">43 U.S.C. 1701 et seq.</ref>) or the Act of August 28, 1937 (<ref href="/us/usc/t43/s1181a/etseq">43 U.S.C. 1181a et seq.</ref>).</content></subsection></section>
<section id="d32624e381" identifier="/us/bill/115/hr/1306/tI/s105" style="-uslm-lc:I650143"><num value="105">SEC. 105. </num><heading>LAND RECLASSIFICATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e385" identifier="/us/bill/115/hr/1306/tI/s105/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Identification of Oregon and California Railroad Grant Land</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture and the Secretary shall identify any Oregon and California Railroad grant land that is held in trust by the United States for the benefit of the Tribe under section 102.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e393" identifier="/us/bill/115/hr/1306/tI/s105/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Identification of Public Domain Land</inline>.—</heading><chapeau>Not later than 2 years after the date of enactment of this Act, the Secretary shall identify public domain land in the State of Oregon that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e401" identifier="/us/bill/115/hr/1306/tI/s105/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>is approximately equal in acreage and condition as the Oregon and California Railroad grant land identified under subsection (a); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e405" identifier="/us/bill/115/hr/1306/tI/s105/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>is located within the 18 western Oregon and California Railroad grant land counties (other than Klamath County, Oregon).</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e409" identifier="/us/bill/115/hr/1306/tI/s105/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Maps</inline>.—</heading><content>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to Congress and publish in the Federal Register one or more maps depicting the land identified in subsections (a) and (b).</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e417" identifier="/us/bill/115/hr/1306/tI/s105/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Reclassification</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e424" identifier="/us/bill/115/hr/1306/tI/s105/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>After providing an opportunity for public comment, the Secretary shall reclassify the land identified in subsection (b) as Oregon and California Railroad grant land.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e432" identifier="/us/bill/115/hr/1306/tI/s105/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Applicability</inline>.—</heading><content>The Act of August 28, 1937 (<ref href="/us/usc/t43/s1181a/etseq">43 U.S.C. 1181a et seq.</ref>), shall apply to land reclassified as Oregon and California Railroad grant land under paragraph (1).</content></paragraph></subsection></section>

<title id="d32624e446" identifier="/us/bill/115/hr/1306/tII" style="-uslm-lc:I650178"><num value="II">TITLE II—</num><heading>OREGON COASTAL LAND CONVEYANCE</heading>
<section id="d32624e451" identifier="/us/bill/115/hr/1306/tII/s201" style="-uslm-lc:I650143"><num value="201">SEC. 201. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  In this title:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e457" identifier="/us/bill/115/hr/1306/tII/s201/1" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Confederated tribes</inline>.—</heading><content>The term “<term>Confederated Tribes</term>” means the Confederated Tribes of Coos, Lower Umpqua, and Siuslaw Indians.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e465" identifier="/us/bill/115/hr/1306/tII/s201/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Oregon coastal land</inline>.—</heading><content>The term “<term>Oregon Coastal land</term>” means the approximately 14,742 acres of land, as generally depicted on the map entitled “Oregon Coastal Land Conveyance” and dated July 11, 2016.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e473" identifier="/us/bill/115/hr/1306/tII/s201/3" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph></section>
<section id="d32624e482" identifier="/us/bill/115/hr/1306/tII/s202" style="-uslm-lc:I650143"><num value="202">SEC. 202. </num><heading>LAND TO BE HELD IN TRUST.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e486" identifier="/us/bill/115/hr/1306/tII/s202/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>Subject to valid existing rights, including rights-of-way, all right, title, and interest of the United States in and to the Oregon Coastal land, including any improvements located on the land, appurtenances to the land, and minerals on or in the land, including oil and gas, shall be—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e494" identifier="/us/bill/115/hr/1306/tII/s202/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>held in trust by the United States for the benefit of the Confederated Tribes; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e498" identifier="/us/bill/115/hr/1306/tII/s202/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>part of the reservation of the Confederated Tribes.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e502" identifier="/us/bill/115/hr/1306/tII/s202/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Survey</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Secretary shall complete a survey to establish the boundaries of the land taken into trust under subsection (a).</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e510" identifier="/us/bill/115/hr/1306/tII/s202/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Effective Date</inline>.—</heading><content>Subsection (a) shall take effect on the day after the date on which the Secretary records the agreement entered into under section 204(d)(1).</content></subsection></section>
<section id="d32624e519" identifier="/us/bill/115/hr/1306/tII/s203" style="-uslm-lc:I650143"><num value="203">SEC. 203. </num><heading>MAP AND LEGAL DESCRIPTION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e523" identifier="/us/bill/115/hr/1306/tII/s203/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><chapeau>As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and legal description of the Oregon Coastal land with—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e531" identifier="/us/bill/115/hr/1306/tII/s203/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Energy and Natural Resources of the Senate; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e535" identifier="/us/bill/115/hr/1306/tII/s203/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Natural Resources of the House of Representatives.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e539" identifier="/us/bill/115/hr/1306/tII/s203/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Force and Effect</inline>.—</heading><content>The map and legal description filed under subsection (a) shall have the same force and effect as if included in this title, except that the Secretary may correct any clerical or typographical errors in the map or legal description.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e547" identifier="/us/bill/115/hr/1306/tII/s203/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Public Availability</inline>.—</heading><content>The map and legal description filed under subsection (a) shall be on file and available for public inspection in the Office of the Secretary.</content></subsection></section>
<section id="d32624e556" identifier="/us/bill/115/hr/1306/tII/s204" style="-uslm-lc:I650143"><num value="204">SEC. 204. </num><heading>ADMINISTRATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e560" identifier="/us/bill/115/hr/1306/tII/s204/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Unless expressly provided in this title, nothing in this title affects any right or claim of the Confederated Tribes existing on the date of enactment of this Act to any land or interest in land.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e568" identifier="/us/bill/115/hr/1306/tII/s204/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Prohibitions</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e575" identifier="/us/bill/115/hr/1306/tII/s204/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Exports of unprocessed logs</inline>.—</heading><content>Federal law (including regulations) relating to the export of unprocessed logs harvested from Federal land shall apply to any unprocessed logs that are harvested from the Oregon Coastal land taken into trust under section 202.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e583" identifier="/us/bill/115/hr/1306/tII/s204/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Non-permissible use of land</inline>.—</heading><content>Any real property taken into trust under section 202 shall not be eligible, or used, for any gaming activity carried out under <ref href="/us/pl/100/497">Public Law 100–497</ref> (<ref href="/us/usc/t25/s2701/etseq">25 U.S.C. 2701 et seq.</ref>).</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e598" identifier="/us/bill/115/hr/1306/tII/s204/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Forest Management</inline>.—</heading><content>Any forest management activity that is carried out on the Oregon Coastal land shall be managed in accordance with all applicable Federal laws.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e606" identifier="/us/bill/115/hr/1306/tII/s204/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Agreements</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e613" identifier="/us/bill/115/hr/1306/tII/s204/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Memorandum of agreement for administrative access</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, the Secretary shall seek to enter into an agreement with the Confederated Tribes that secures existing administrative access by the Secretary to the Oregon Coastal land and that provides for—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32624e621" identifier="/us/bill/115/hr/1306/tII/s204/d/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>access for certain activities, including—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d32624e625" identifier="/us/bill/115/hr/1306/tII/s204/d/1/A/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>forest management;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d32624e629" identifier="/us/bill/115/hr/1306/tII/s204/d/1/A/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>timber and rock haul;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d32624e633" identifier="/us/bill/115/hr/1306/tII/s204/d/1/A/iii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">(iii) </num><content>road maintenance;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d32624e637" identifier="/us/bill/115/hr/1306/tII/s204/d/1/A/iv" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iv">(iv) </num><content>wildland fire protection and management;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d32624e641" identifier="/us/bill/115/hr/1306/tII/s204/d/1/A/v" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="v">(v) </num><content>cadastral surveys;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d32624e645" identifier="/us/bill/115/hr/1306/tII/s204/d/1/A/vi" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="vi">(vi) </num><content>wildlife, cultural, and other surveys; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d32624e649" identifier="/us/bill/115/hr/1306/tII/s204/d/1/A/vii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="vii">(vii) </num><content>law enforcement activities;</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32624e653" identifier="/us/bill/115/hr/1306/tII/s204/d/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>the management of the Oregon Coastal land that is acquired or developed under <ref href="/us/usc/t54/ch2003">chapter 2003 of title 54, United States Code</ref>, consistent with section 200305(f)(3) of that title; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32624e661" identifier="/us/bill/115/hr/1306/tII/s204/d/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>the terms of public vehicular transit across the Oregon Coastal land to and from the Hult Log Storage Reservoir located in T. 15 S., R. 7 W., as generally depicted on the map described in section 201(2), subject to the requirement that if the Bureau of Land Management discontinues maintenance of the public recreation site known as “Hult Reservoir”, the terms of any agreement in effect on that date that provides for public vehicular transit to and from the Hult Log Storage Reservoir shall be void.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e665" identifier="/us/bill/115/hr/1306/tII/s204/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Reciprocal right-of-way agreements</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32624e672" identifier="/us/bill/115/hr/1306/tII/s204/d/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>On the date on which the agreement is entered into under paragraph (1), the Secretary shall provide to the Confederated Tribes all reciprocal right-of-way agreements to the Oregon Coastal land in existence on the date of enactment of this Act.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d32624e680" identifier="/us/bill/115/hr/1306/tII/s204/d/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Continued access</inline>.—</heading><content>Beginning on the date on which the Oregon Coastal land is taken into trust under section 202, the Confederated Tribes shall continue the access provided by the reciprocal right-of-way agreements referred to in subparagraph (A) in perpetuity.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e688" identifier="/us/bill/115/hr/1306/tII/s204/e" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="e">(e) </num><heading><inline class="smallCaps">Land Use Planning Requirements</inline>.—</heading><content>Except as provided in subsection (c), once the Oregon Coastal land is taken into trust under section 202, the Oregon Coastal land shall not be subject to the land use planning requirements of the Federal Land Policy and Management Act of 1976 (<ref href="/us/usc/t43/s1701/etseq">43 U.S.C. 1701 et seq.</ref>) or the Act of August 28, 1937 (<ref href="/us/usc/t43/s1181a/etseq">43 U.S.C. 1181a et seq.</ref>).</content></subsection></section>
<section id="d32624e705" identifier="/us/bill/115/hr/1306/tII/s205" style="-uslm-lc:I650143"><num value="205">SEC. 205. </num><heading>LAND RECLASSIFICATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e709" identifier="/us/bill/115/hr/1306/tII/s205/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Identification of Oregon and California Railroad Grant Land</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture and the Secretary shall identify any Oregon and California Railroad grant land that is held in trust by the United States for the benefit of the Confederated Tribes under section 202.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e717" identifier="/us/bill/115/hr/1306/tII/s205/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Identification of Public Domain Land</inline>.—</heading><chapeau>Not later than 2 years after the date of enactment of this Act, the Secretary shall identify public domain land in the State of Oregon that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e725" identifier="/us/bill/115/hr/1306/tII/s205/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>is approximately equal in acreage and condition as the Oregon and California Railroad grant land identified under subsection (a); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e729" identifier="/us/bill/115/hr/1306/tII/s205/b/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>is located within the 18 western Oregon and California Railroad grant land counties (other than Klamath County, Oregon).</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e733" identifier="/us/bill/115/hr/1306/tII/s205/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Maps</inline>.—</heading><content>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to Congress and publish in the Federal Register one or more maps depicting the land identified in subsections (a) and (b).</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d32624e741" identifier="/us/bill/115/hr/1306/tII/s205/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Reclassification</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e748" identifier="/us/bill/115/hr/1306/tII/s205/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>After providing an opportunity for public comment, the Secretary shall reclassify the land identified in subsection (b) as Oregon and California Railroad grant land.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e756" identifier="/us/bill/115/hr/1306/tII/s205/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Applicability</inline>.—</heading><content>The Act of August 28, 1937 (<ref href="/us/usc/t43/s1181a/etseq">43 U.S.C. 1181a et seq.</ref>), shall apply to land reclassified as Oregon and California Railroad grant land under paragraph (1).</content></paragraph></subsection></section>

<section id="d32624e776" identifier="/us/bill/115/hr/1306/tIII/s301" role="instruction" style="-uslm-lc:I650143"><num value="301">SEC. 301. </num><heading>AMENDMENTS TO COQUILLE RESTORATION ACT.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  Section 5(d) of the Coquille Restoration Act (<ref href="/us/pl/101/42">Public Law 101–42</ref>; <ref href="/us/stat/103/92">103 Stat. 92</ref>, <ref href="/us/stat/110/3009">110 Stat. 3009</ref>–537) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e794" identifier="/us/bill/115/hr/1306/tIII/s301/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (5) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">“(5) </num><heading><inline class="smallCaps">Management</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">“(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Subject to subparagraph (B), the Secretary, acting through the Assistant Secretary for Indian Affairs, shall manage the Coquille Forest in accordance with the laws pertaining to the management of Indian trust land.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">“(B) </num><heading><inline class="smallCaps">Administration</inline>.—</heading><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><heading><inline class="smallCaps">Unprocessed logs</inline>.—</heading><content>Unprocessed logs harvested from the Coquille Forest shall be subject to the same Federal statutory restrictions on export to foreign nations that apply to unprocessed logs harvested from Federal land.</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading><inline class="smallCaps">Sales of timber</inline>.—</heading><content>Notwithstanding any other provision of law, all sales of timber from land subject to this subsection shall be advertised, offered, and awarded according to competitive bidding practices, with sales being awarded to the highest responsible bidder.”</content></clause></subparagraph></paragraph></quotedContent>;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e845" identifier="/us/bill/115/hr/1306/tIII/s301/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (9); and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d32624e853" identifier="/us/bill/115/hr/1306/tIII/s301/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (10) through (12) as paragraphs (9) through (11), respectively.</content></paragraph></section>
