	<legis-body id="H390B041C3A1944DA828C452EFD240F46" style="OLC">
 <section id="H2A4FCC505462470F82EFFBC862A234CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Federal Marijuana Prohibition Act of 2017</short-title></quote>.</text> </section><section id="HF07EFE9DE20D41668C1CB82414C141B2"><enum>2.</enum><header>Application of the Controlled Substances Act to marihuana</header> <subsection id="H5E642D83620246DC9A0C6CEF84073401"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part A of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD83C806F777E442A8F45E175578BF6CE" style="OLC">
					<section id="H5378D0375F304A3B963F76E30FFF5C3A"><enum>103.</enum><header>Application of this Act to marihuana</header>
 <subsection id="HAF4A2F9200AD46C4ADE68D0933298413"><enum>(a)</enum><header>Prohibition on certain shipping or transportation</header><text display-inline="yes-display-inline">This Act shall not apply to marihuana, except that it shall be unlawful only to ship or transport, in any manner or by any means whatsoever, marihuana, from one State, territory, or district of the United States, or place noncontiguous to but subject to the jurisdiction thereof, into any other State, territory, or district of the United States, or place noncontiguous to but subject to the jurisdiction thereof, or from any foreign country into any State, territory, or district of the United States, or place noncontiguous to but subject to the jurisdiction thereof, when such marihuana is intended, by any person interested therein, to be received, possessed, sold, or in any manner used, either in the original package or otherwise, in violation of any law of such State, territory, or district of the United States, or place noncontiguous to but subject to the jurisdiction thereof.</text>
 </subsection><subsection commented="no" id="H2F4E6506AB66461E93D41A042A67495E"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Whoever knowingly violates subsection (a) shall be fined under title 18, United States Code, imprisoned not more than 1 year, or both.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC58DABD8F4DB4090A5E72F0EB66CFD6B"><enum>(b)</enum><header>Table of contents</header><text>The table of contents for the Comprehensive Drug Abuse Prevention and Control Act of 1970 (<external-xref legal-doc="public-law" parsable-cite="pl/91/513">Public Law 91–513</external-xref>; 84 Stat. 1236) is amended by striking the item relating to section 103 and inserting the following:</text>

 <subsection id="HF8DB8C8E4587455086C29FEF3FDCE740"><enum>(a)</enum><header>Removed from schedule of controlled substances</header><text display-inline="yes-display-inline">Subsection (c) of Schedule I of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) is amended—</text>
 <paragraph id="H1FE2794B03064A77B9E1413E531C0D54"><enum>(1)</enum><text>by striking <quote>marihuana</quote>; and</text> </paragraph><paragraph id="H4DE222D04A414B29BAAD88DDF1947B7E"><enum>(2)</enum><text>by striking <quote>tetrahydrocannabinols</quote>.</text>
 </paragraph></subsection><subsection id="H3B7C85B954CB4FBDAC8A2C5D5DBD4E64"><enum>(b)</enum><header>Removal of prohibition on import and export</header><text display-inline="yes-display-inline">Section 1010(b) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960</external-xref>) is amended—</text> <paragraph id="H23227174B3AF429A885AB22571D323E2"><enum>(1)</enum><text>in paragraph (1)—</text>
 <subparagraph id="HB2FCC74069D24673A347250774DDE310"><enum>(A)</enum><text>in subparagraph (F), by inserting <quote>or</quote> after the semicolon;</text> </subparagraph><subparagraph id="H21643D71CAEC4A1286715776223CFC5E"><enum>(B)</enum><text>by striking subparagraph (G); and</text>
 </subparagraph><subparagraph id="HE42CAE5536F04C458FBC3281AE3FBA44"><enum>(C)</enum><text>by redesignating subparagraph (H) as subparagraph (G);</text> </subparagraph></paragraph><paragraph id="H3B20AA0172CF48CEAD534A91105E6F67"><enum>(2)</enum><text>in paragraph (2)—</text>
 <subparagraph id="H98BF6819A47545FF89D8D5EFB9FF0ABE"><enum>(A)</enum><text>in subparagraph (F), by inserting <quote>or</quote> after the semicolon;</text> </subparagraph><subparagraph id="H72D1A877926040D0A814CB0A6A6E2214"><enum>(B)</enum><text>by striking subparagraph (G); and</text>
 </subparagraph><subparagraph id="H2C3D200C0F1F410C9AC34B71963D7DD9"><enum>(C)</enum><text>by redesignating subparagraph (H) as subparagraph (G);</text> </subparagraph></paragraph><paragraph id="HF75BC42810234DFA83E6548EAFFC7E8F"><enum>(3)</enum><text>in paragraph (3), by striking <quote>paragraphs (1), (2), and (4)</quote> and inserting <quote>paragraphs (1) and (2)</quote>;</text>
 </paragraph><paragraph id="H4F0BC8709C064BBA9F32708AC1D53D7B"><enum>(4)</enum><text>by striking paragraph (4); and</text> </paragraph><paragraph id="HAC02D9C56AB542BBB8B433EC8EBE2E9A"><enum>(5)</enum><text>by redesignating paragraphs (5), (6), and (7) as paragraphs (4), (5), and (6), respectively.</text>
 </paragraph></subsection></section><section id="HBFCB34B2EA1947A79C7A539556547112"><enum>4.</enum><header>Conforming amendments to Controlled Substances Act</header><text display-inline="no-display-inline">The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) is amended—</text> <paragraph id="H48E236FCB28744EF810F228B94B34370"><enum>(1)</enum><text display-inline="yes-display-inline">in section 102(44) (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(44)</external-xref>), by striking <quote>marihuana,</quote>;</text>
 </paragraph><paragraph id="H780F21834F7D478FA79AF86E646F33E3"><enum>(2)</enum><text>in section 401(b) (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)</external-xref>)—</text> <subparagraph id="H217BAC76B82444CA9B12A731066BDB82"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="H7628887C76A34C44BA319AAC3750416C"><enum>(i)</enum><text>in subparagraph (A)—</text> <subclause id="H39EDDE71D64649659E4E46BE385F29DA"><enum>(I)</enum><text>in clause (vi), by inserting <quote>or</quote> after the semicolon;</text>

 </paragraph><paragraph id="HA755E2E03BEF443787F8311886D0B2F0"><enum>(6)</enum><text>in section 419(a) (<external-xref legal-doc="usc" parsable-cite="usc/21/860">21 U.S.C. 860(a)</external-xref>), by striking the last sentence;</text> </paragraph><paragraph id="H58E5CD8A8F0B493180DF858696ACCAD1"><enum>(7)</enum><text>in section 422(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/863">21 U.S.C. 863(d)</external-xref>)—</text>
 <subparagraph id="H67AD1923F2824C1D878913D2974CFF44"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>marijuana,</quote>; and</text> </subparagraph><subparagraph id="H7CADD357FE094BDAB01CA1A25863A950"><enum>(B)</enum><text>in paragraph (5), by striking <quote>, such as a marihuana cigarette,</quote>; and</text>
 </subparagraph></paragraph><paragraph id="HCB9B005608A74FBD923F10D31B4CFB81"><enum>(8)</enum><text>in section 516(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/886">21 U.S.C. 886(d)</external-xref>), by striking <quote>section 401(b)(6)</quote> each place the term appears and inserting <quote>section 401(b)(5)</quote>.</text> </paragraph></section></legis-body></bill>
