 <section id="HBF5CD64854E047ECAACC657CD8D68DD2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans 2nd Amendment Protection Act</short-title></quote>.</text> </section><section id="H64D42C1FFFBA443193A5753D2CEB7F4A" section-type="subsequent-section"><enum>2.</enum><header>Conditions for treatment of certain persons as adjudicated mentally incompetent for certain purposes</header> <subsection id="H377D55AFA5774D9CB54168FC65C97C5E"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/55">Chapter 55</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/5501A">section 5501A</external-xref> the following new section:</text>

					<section id="H5D882D93A3634D40AA80B055EAD83816"><enum>5501B.</enum><header>Conditions for treatment of certain persons as adjudicated mentally incompetent for certain
 purposes</header><text display-inline="no-display-inline">Notwithstanding any determination made by the Secretary under section 5501A of this title, in any case arising out of the administration by the Secretary of laws and benefits under this title, a person who is mentally incapacitated, deemed mentally incompetent, or experiencing an extended loss of consciousness shall not be considered adjudicated as a mental defective under subsection (d)(4) or (g)(4) of section 922 of title 18 without the order or finding of a judge, magistrate, or other judicial authority of competent jurisdiction that such person is a danger to himself or herself or others.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HB84E8F5DFA9E4EA3AF26B13F51DB8B64"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 55 of such title is amended by inserting after the item relating to section 5501A the following new item:</text>
