 <section changed="deleted" committee-id="SSEG00" id="H48E4E4E6266A45F79638DCF36F54E2BB" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Clarification of facility merger authorization</header><text display-inline="no-display-inline">Section 203(a)(1)(B) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824b">16 U.S.C. 824b(a)(1)(B)</external-xref>) is amended by striking <quote>such facilities or any part thereof</quote> and inserting <quote>such facilities, or any part thereof, of a value in excess of $10,000,000</quote>.</text> </section><section changed="deleted" committee-id="SSEG00" id="H657805168AC84B3B8042E573050D567D" reported-display-style="strikethrough"><enum>2.</enum><header>Notification for certain transactions</header><text display-inline="no-display-inline">Section 203(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824b">16 U.S.C. 824b(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

 <paragraph id="H1E7265515BC24B4ABEB36253B02E0770"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H9E87AB4E63B3489C9231ABCDFC98760E"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this paragraph, the Commission shall promulgate a rule requiring any public utility that is seeking to merge or consolidate, directly or indirectly, its facilities subject to the jurisdiction of the Commission, or any part thereof, with those of any other person, to notify the Commission of such transaction not later than 30 days after the date on which the transaction is consummated if—</text>
 <clause changed="deleted" committee-id="SSEG00" id="HFBF89A3EC27A4FCB9B1A8B1AA01633DC" indent="up1" reported-display-style="strikethrough"><enum>(i)</enum><text>such facilities, or any part thereof, are of a value in excess of $1,000,000; and</text> </clause><clause changed="deleted" committee-id="SSEG00" id="H9FB7982863BD4514AC348CA4ABF9C69E" indent="up1" reported-display-style="strikethrough"><enum>(ii)</enum><text>such public utility is not required to secure an order of the Commission under paragraph (1)(B).</text>
 </clause></subparagraph><subparagraph changed="deleted" committee-id="SSEG00" id="H62FC471B73B74A20BD0AA17685CE601E" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>In establishing any notification requirement under subparagraph (A), the Commission shall, to the maximum extent practicable, minimize the paperwork burden resulting from the collection of information.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section changed="deleted" committee-id="SSEG00" id="HA65E3174E0924EC288DAA54C995E023A" reported-display-style="strikethrough"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by section 1 shall take effect 180 days after the date of enactment of this Act.</text></section></legis-body> <legis-body display-enacting-clause="no-display-enacting-clause"> <section changed="added" committee-id="SSEG00" id="iddd093675-9edf-4190-b31d-88bc85ade4d9" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Clarification of facility merger authorization</header><text display-inline="no-display-inline">Section 203(a)(1) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824b">16 U.S.C. 824b(a)(1)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text>

 <paragraph id="idB4368D806910443DA592CC5F329AF53D"><enum>(B)</enum><text>merge or consolidate, directly or indirectly, its facilities subject to the jurisdiction of the Commission, or any part thereof, with the facilities of any other person, or any part thereof, that are subject to the jurisdiction of the Commission and have a value in excess of $10,000,000, by any means whatsoever;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section changed="added" committee-id="SSEG00" id="id4169e2e9-6f3b-4aad-a73b-aaa6e9476afc" reported-display-style="italic"><enum>2.</enum><header>Notification for certain transactions</header><text display-inline="no-display-inline">Section 203(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824b">16 U.S.C. 824b(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

 </section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="idaf5ec59c-4866-46c3-bb71-4a941fbf2a84" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by section 1 shall take effect 180 days after the date of enactment of this Act.</text> </section><section changed="added" committee-id="SSEG00" id="id9FD44FF6FA1E44689303F16FDC5F91CA" reported-display-style="italic"><enum>4.</enum><header>Federal Energy Regulatory Commission report</header> <subsection id="id3B7EC2859AE3483F9C1041F225F93D69"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Federal Energy Regulatory Commission shall submit to Congress a report that assesses the effects of the amendment made by section 1.</text>
 </subsection><subsection id="id81A2BE17561346539FC7EFA7054255DD"><enum>(b)</enum><header>Requirements</header><text>In preparing the report under subsection (a), the Federal Energy Regulatory Commission shall—</text> <paragraph id="id5B819327ABD34682A301292EB1290FF3"><enum>(1)</enum><text>take into account any information collected under paragraph (7) of section 203(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824b">16 U.S.C. 824b(a)</external-xref>) (as added by section 2); and</text>
 </paragraph><paragraph id="id631B03759FED456BA4A151A21F66480C"><enum>(2)</enum><text>provide for public notice and comment with respect to the report.</text></paragraph></subsection></section></legis-body><endorsement><action-date>May 21, 2018</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
