		</section><section id="idd634e2e3-b709-4999-ad3e-dbacbcba9fb0"><enum>3.</enum><header>Establishment of Surface Transportation Board as an independent establishment</header>
 <subsection id="idf3dbe4f9-9889-4d6e-8918-631b7c7b87dc"><enum>(a)</enum><header>Redesignation of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/7">chapter 7</external-xref> of title 49, United States Code</header><text display-inline="yes-display-inline">Title 49 is amended—</text> <paragraph id="id1034E685FC81464B895984E0AB6BCE23"><enum>(1)</enum><text>by moving chapter 7 after chapter 11 in subtitle II;</text>
 </paragraph><paragraph id="idA0E418C9B1084E35B61636E309391804"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating chapter 7 as chapter 13;</text> </paragraph><paragraph id="id7162575FE9DF4E24BC00DE9C215F6FF6"><enum>(3)</enum><text>by redesignating sections 701 through 706 as sections 1301 through 1306, respectively;</text>
 </paragraph><paragraph id="idD6716F68093944838A449925AA38AC57"><enum>(4)</enum><text>by striking sections 725 and 727;</text> </paragraph><paragraph id="idAC305D11177C4BE0B6E8962296A52DBC"><enum>(5)</enum><text>by redesignating sections 721 through 724 as sections 1321 through 1324, respectively; and</text>

 <subsection id="idb0d7fd4a-ed84-4f7d-a4ce-64a113acdb96"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Surface Transportation Board is an independent establishment of the United States Government.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="id5fb86eea-4448-455a-a9d5-2d436139f1c0"><enum>(c)</enum><header>Conforming amendments</header> <paragraph id="idf1c44d83-6bea-4d8a-b807-6274a960569e"><enum>(1)</enum><header>Administrative provisions</header><text display-inline="yes-display-inline">Section 1303, as redesignated by subsection (a)(3), is amended—</text>
 <subparagraph id="ide2890772-9173-4e4b-a851-e7dd9346ea62"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsections (a), (c), (f), and (g);</text> </subparagraph><subparagraph id="id7eea1cce-8647-48cc-99d0-72835b4acc17"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subsections (b), (d), and (e) as subsections (a), (b), and (c), respectively; and</text>
 </subparagraph><subparagraph id="id8630b3e8-6d41-4b01-b9ba-5f550f1fcf43"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id1f24da1b-df67-471e-b2ea-c3ca29d3cd84" style="OLC"> <subsection id="idbd496178-2ef5-4fb5-aa3e-b511eefd1cd8"><enum>(d)</enum><header>Submission of certain documents to Congress</header> <paragraph id="id2B2D75B2AEC44B459E17401B8BD3A6F9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Board submits any budget estimate, budget request, supplemental budget estimate, or other budget information, legislative recommendation, prepared testimony for a congressional hearing, or comment on legislation to the President or to the Office of Management and Budget, the Board shall concurrently submit a copy of such document to—</text>
 <subparagraph id="idB57B32ACD08C4B6199C33CAF6396A923"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>; and</text> </subparagraph><subparagraph id="id88046A21C1D6412C822172324617F018"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>.</text>
 </subparagraph></paragraph><paragraph id="idF3F70A87696E431A97885409D8B6AA39"><enum>(2)</enum><header>No approval required</header><text display-inline="yes-display-inline">No officer or agency of the United States has any authority to require the Board to submit budget estimates or requests, legislative recommendations, prepared testimony for congressional hearings, or comments on legislation to any officer or agency of the United States for approval, comments, or review before submitting such recommendations, testimony, or comments to Congress.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="id6a034243-f601-4ffe-8b33-635f35b2c8ea"><enum>4.</enum><header>Surface Transportation Board membership</header>
 <subsection id="iddccf81f2-40bf-40a8-933f-6d5b55c60760"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1301(b), as redesignated by subsection 3(a), is amended—</text> <paragraph id="id65bd70d0-4e66-4016-8529-fa662d6062fc"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
 <subparagraph id="id62945a96-d3b0-4070-b40e-2723b01704ca"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>3 members</quote> and inserting <quote>5 members</quote>; and</text> </subparagraph><subparagraph id="ide5e6f1c7-8459-4db9-b78a-04ffa8566bf4"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>2 members</quote> and inserting <quote>3 members</quote>; and</text>
 </subparagraph></paragraph><paragraph id="id17fbca55-7d6b-462f-824c-70e1da2603ba"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idb13c34bd-82ba-4707-8759-20321c173b44" style="OLC"> <paragraph id="idaa39df52-2175-43a8-9346-895179e9daa9" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">At all times—</text>
 <subparagraph id="id592E65E4DD8F418297EFAD5408E143FB"><enum>(A)</enum><text display-inline="yes-display-inline">at least 3 members of the Board shall be individuals with professional standing and demonstrated knowledge in the fields of transportation, transportation regulation, or economic regulation; and</text>
 </subparagraph><subparagraph id="id9BDAD96B96724D8E9D4C21347BD764F5"><enum>(B)</enum><text display-inline="yes-display-inline">at least 2 members shall be individuals with professional or business experience (including agriculture) in the private sector.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idc1029cd8-1562-499f-9270-9d6e5642d07e"><enum>(b)</enum><header>Repeal of obsolete provision</header><text display-inline="yes-display-inline">Section 1301(b), as amended by this section, is further amended—</text> <paragraph id="idb9b6fdef-ef27-4fe7-8ce1-200af57d0788"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (4);</text>
 </paragraph><paragraph id="iddc1a21a2-fd72-4198-a32a-94880e3c9a7d"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (5), (6), and (7) as paragraphs (4), (5), and (6), respectively; and</text> </paragraph><paragraph id="id1535069e-1d58-4202-8e06-d22b0d6ee380"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4), as redesignated, by striking <quote>who becomes a member of the Board pursuant to paragraph (4), or an individual</quote>.</text>
 </paragraph></subsection></section><section id="id94450662-929f-42ea-a5cc-9a494d64d220"><enum>5.</enum><header>Nonpublic collaborative discussions</header><text display-inline="no-display-inline">Section 1303(a), as redesignated by subsections (a) and (c) of section 3, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id372e9b11-1445-49e0-8c58-60686bbaf3a6" style="OLC">
				<subsection id="idf9bb0fa3-7551-4d79-9f00-63fc540eef87"><enum>(a)</enum><header>Open meetings</header>
 <paragraph id="id6b3dfc1e-ba61-4479-a52a-a3f29b472b7c"><enum>(1)</enum><header>In general</header><text>The Board shall be deemed to be an agency for purposes of section 552b of title 5.</text> </paragraph><paragraph id="id30aac8ca-7020-4739-9414-2628ab20d2ba"><enum>(2)</enum><header>Nonpublic collaborative discussions</header> <subparagraph id="id5f43fb27-83f6-44b4-9958-23a45dc11116"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 552b of title 5, a majority of the members may hold a meeting that is not open to public observation to discuss official agency business if—</text>
 <clause id="id59012fa4-9ec8-48e4-a43d-c2e3a9bb540e"><enum>(i)</enum><text>no formal or informal vote or other official agency action is taken at the meeting;</text> </clause><clause id="id0e832dae-66fb-4707-bbe1-bbdb50fb6d58"><enum>(ii)</enum><text>each individual present at the meeting is a member or an employee of the Board; and</text>
 </clause><clause id="idc37c3a28-6b1e-46d3-ba5e-f803687be2a5"><enum>(iii)</enum><text>the General Counsel of the Board is present at the meeting.</text> </clause></subparagraph><subparagraph id="id3798eb01-ff28-46d8-9e39-a912bf3929a4"><enum>(B)</enum><header>Disclosure of nonpublic collaborative discussions</header><text>Except as provided under subparagraph (C), not later than 2 business days after the conclusion of a meeting under subparagraph (A), the Board shall make available to the public, in a place easily accessible to the public—</text>
 <clause id="id7d25b896-a117-4283-b31d-44641016f6b7"><enum>(i)</enum><text>a list of the individuals present at the meeting; and</text> </clause><clause id="id20e7cd21-fad0-43e5-8ee0-b200a22a020f"><enum>(ii)</enum><text>a summary of the matters discussed at the meeting, except for any matters the Board properly determines may be withheld from the public under section 552b(c) of title 5.</text>
 </clause></subparagraph><subparagraph id="id383B8107D2954310A5B8331F4B7FF252"><enum>(C)</enum><header>Summary</header><text>If the Board properly determines matters may be withheld from the public under section 555b(c) of title 5, the Board shall provide a summary with as much general information as possible on those matters withheld from the public.</text>
 </subparagraph><subparagraph id="idff324666-1cc6-4a0a-9c58-218e703d5527"><enum>(D)</enum><header>Ongoing proceedings</header><text>If a discussion under subparagraph (A) directly relates to an ongoing proceeding before the Board, the Board shall make the disclosure under subparagraph (B) on the date of the final Board decision.</text>
 </subparagraph><subparagraph id="idd906fa00-039b-4f53-aaf8-e9b5651fdddd"><enum>(E)</enum><header>Preservation of open meetings requirements for agency action</header><text>Nothing in this paragraph may be construed to limit the applicability of section 552b of title 5 with respect to a meeting of the members other than that described in this paragraph.</text>
 </subparagraph><subparagraph commented="no" id="idbb7d3a0f-cddc-4a6e-90d1-4003b2759c2a"><enum>(F)</enum><header>Statutory construction</header><text>Nothing in this paragraph may be construed—</text> <clause commented="no" id="idadecf259-b55f-49c9-9466-9dc2dfd06d38"><enum>(i)</enum><text>to limit the applicability of section 552b of title 5 with respect to any information which is proposed to be withheld from the public under subparagraph (B)(ii); or</text>
 </clause><clause commented="no" id="id2dfc6264-8c21-4058-aad4-e5f62cd81d24"><enum>(ii)</enum><text>to authorize the Board to withhold from any individual any record that is accessible to that individual under section 552a of title 5, United States Code.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id7180e03020f748e5a22407aa8a3f0d00"><enum>6.</enum><header>Reports</header>
 <subsection id="id8F49576C5C3B4F9F86E018A9A175F8CF"><enum>(a)</enum><header>Reports</header><text display-inline="yes-display-inline">Section 1304, as amended by section 3, is further amended—</text> <paragraph id="id2a0106b32e734e4aab3c2302f1fc1ae1"><enum>(1)</enum><text>by striking the section heading and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1589db2048c24c189e7a0e6757419e38" style="USC">
						<section id="idfe51d91aab95480cb45659882d20fa91"><enum>1304.</enum><header>Reports</header></section><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id323b4c443f19461ab0af1c72211d203f"><enum>(2)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">Annual report.—</header-in-text></quote> before <quote>The Board</quote>;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24025bd4-a42f-420e-8cef-c3b43bf78faf"><enum>(3)</enum><text>by striking <quote>on its activities.</quote> and inserting <quote>on its activities, including each instance in which the Board has initiated an investigation on its own initiative under this chapter or subtitle IV.</quote>; and</text>
 </paragraph><paragraph id="id8d1bee09449946a7945dd3f8551834bf"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id14cac30754e24c72a809505f018c6072" style="OLC"> <subsection id="iddaa8f155ee9a45abb297c2ef16dd1ebc"><enum>(b)</enum><header>Rate case review metrics</header> <paragraph id="id6befe952b45c4eeaae2e96a4c8634dd1"><enum>(1)</enum><header>Quarterly reports</header><text>The Board shall post a quarterly report of rail rate review cases pending or completed by the Board during the previous quarter that includes—</text>
 <subparagraph id="id07ae4ce1436d415fb2916623fb62f423"><enum>(A)</enum><text>summary information of the case, including the docket number, case name, commodity or commodities involved, and rate review guideline or guidelines used;</text>
 </subparagraph><subparagraph id="idba8ed5676f044c66aa8c9a108a0e9c42"><enum>(B)</enum><text>the date on which the rate review proceeding began;</text> </subparagraph><subparagraph id="id2d54145b7a9e405c96f21be9c8d4da3f"><enum>(C)</enum><text>the date for the completion of discovery;</text>
 </subparagraph><subparagraph id="idf13a4061ba0647dca5b80133c6f81def"><enum>(D)</enum><text>the date for the completion of the evidentiary record;</text> </subparagraph><subparagraph id="id5f1a441aaeea4c27b87dd55c064935bc"><enum>(E)</enum><text>the date for the submission of closing briefs;</text>
 </subparagraph><subparagraph id="id4af417f8599541fc93df0a340c5edcc3"><enum>(F)</enum><text>the date on which the Board issued the final decision; and</text> </subparagraph><subparagraph id="id5d8ed54b929a48f890834212ada14181"><enum>(G)</enum><text>a brief summary of the final decision;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe5632da78be44cbb8e06fbacd03afec"><enum>(2)</enum><header>Website posting</header><text>Each quarterly report shall be posted on the Board’s public website.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="idc0b3cd6a-937f-45c5-8bc6-7357261e0267"><enum>(b)</enum><header>Compilation of complaints at Surface Transportation Board</header> <paragraph id="id9ab32155-a9a9-4dec-a031-acedd9fd1e61"><enum>(1)</enum><header>In general</header><text>Section 1304, as amended by subsection (a), is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id27b824cf-69f1-484c-97e9-3f4fe80024f3" style="OLC">
						<subsection id="id2e4be6b8-da58-4b5e-a933-8e38f11075bb"><enum>(c)</enum><header>Complaints</header>
 <paragraph id="id47e9fada-0f17-44ca-b85c-af6600c404b7"><enum>(1)</enum><header>In general</header><text>The Board shall establish and maintain a database of complaints received by the Board.</text> </paragraph><paragraph id="id90d18570-3816-4cd8-83de-55aede5065d9"><enum>(2)</enum><header>Quarterly reports</header><text>The Board shall post a quarterly report of formal and informal service complaints received by the Board during the previous quarter that includes—</text>
 <subparagraph id="id9c99b7be626145a7aee28b69188efea9"><enum>(A)</enum><text>the date on which the complaint was received by the Board;</text> </subparagraph><subparagraph id="idde87b225-8184-4245-8332-1379bd561c0f"><enum>(B)</enum><text>a list of the type of each complaint;</text>
 </subparagraph><subparagraph id="id42a88662-d5b0-43ba-a1ab-b15efd0f12ba"><enum>(C)</enum><text>the geographic region of each complaint; and</text> </subparagraph><subparagraph id="idbb27d87b-47c3-483b-b3f6-79b7239900f2"><enum>(D)</enum><text>the resolution of each complaint, if appropriate.</text>
 </subparagraph></paragraph><paragraph id="id187db0ab-f93b-4635-b802-da3aaee2e888"><enum>(3)</enum><header>Written consent</header><text>The quarterly report may identify a complainant that submitted an informal complaint only upon the written consent of the complainant.</text>
 </paragraph><paragraph id="id3d30b48a-5331-4432-be72-c7c07f87e05f"><enum>(4)</enum><header>Website posting</header><text>Each quarterly report shall be posted on the Board’s public website.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section><section id="id2045076b-0ccf-4f27-bbf4-3cec3874c929"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 1305, as redesignated by section 3, is amended by striking paragraphs (1) through (3) and inserting the following:</text>

 <paragraph id="id373ed675-7439-4a5e-a5cd-8e0620837188"><enum>(1)</enum><text display-inline="yes-display-inline">$33,000,000 for fiscal year 2016;</text> </paragraph><paragraph id="id733dbdbe-39af-4039-9c83-504625ba2299"><enum>(2)</enum><text display-inline="yes-display-inline">$35,000,000 for fiscal year 2017;</text>

 <subsection id="id92FCB98BF8C240D696DAE443A3B082A1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Inspector General of the Department of Transportation, in accordance with the mission of the Inspector General to prevent and detect fraud and abuse, shall have authority to review only the financial management, property management, and business operations of the Surface Transportation Board, including internal accounting and administrative control systems, to determine the Board’s compliance with applicable Federal laws, rules, and regulations.</text>
 </subsection><subsection id="id40803137A4324B0C91450F71B530F629"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">In carrying out this section, the Inspector General shall—</text> <paragraph id="id98E64D56DE6845509C4CC38C3C523013"><enum>(1)</enum><text display-inline="yes-display-inline">keep the Chairman of the Board, the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>, and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> fully and currently informed about problems relating to administration of the internal accounting and administrative control systems of the Board;</text>
 </paragraph><paragraph id="id07B2B6CE4683489C8CF0FF0C1F97835C"><enum>(2)</enum><text display-inline="yes-display-inline">issue findings and recommendations for actions to address the problems referred to in paragraph (1); and</text>
 </paragraph><paragraph id="id1FB453268D6D4C8E8AD2D2DE271E4DC2"><enum>(3)</enum><text display-inline="yes-display-inline">submit periodic reports to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>, and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that describe any progress made in implementing actions to address the problems referred to in paragraph (1).</text>
 </paragraph></subsection><subsection id="id305502676FB64253B530A786ACEAE759"><enum>(c)</enum><header>Access to information</header><text display-inline="yes-display-inline">In carrying out this section, the Inspector General may exercise authorities granted to the Inspector General under subsections (a) and (b) of <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /6">section 6</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App.).</text>
					</subsection><subsection id="id53217B640FDC44279BE85653135F61D3"><enum>(d)</enum><header>Authorization of appropriations</header>
 <paragraph id="idA101778FAD8B4E3593B4DD1F603EC408"><enum>(1)</enum><header>Funding</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary of Transportation for use by the Inspector General of the Department of Transportation such sums as may be necessary to cover expenses associated with activities pursuant to the authority exercised under this section.</text>

 </subsection><subsection id="id1bb17494-0060-4ce4-949f-ac5c45ac7489"><enum>(b)</enum><header>Expedited handling; rate review timelines</header><text display-inline="yes-display-inline">Section 10704(d) is amended—</text> <paragraph id="idEA5EEBE61328495CAEFE6E639FC302B7"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(d) Within 9 months</quote> and all that follows through <quote>railroad rates.</quote> and inserting the following:</text>

 <subsection id="id671D9F59430C4CAAAE898A49C09C9E73"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id5D78C464C40748419B6E97616939E286"><enum>(1)</enum><text display-inline="yes-display-inline">The Board shall maintain procedures to ensure the expeditious handling of challenges to the reasonableness of railroad rates.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id7a125596-e848-4674-8b74-ccc3723d397b"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id23a627b8-dccc-413e-8efc-03bb0c7debf8" style="OLC"> <paragraph id="idb30a9316-f5ed-4f34-9668-a2c21130233b" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id4a3d29bd-b501-4bf7-b803-7236cc96fa98"><enum>(A)</enum><text>Except as provided under subparagraph (B), in a stand-alone cost rate challenge, the Board shall comply with the following timeline:</text>
 <clause id="idD38992EA10FA40FFB899032B20CB706A" indent="up1"><enum>(i)</enum><text>Discovery shall be completed not later than 150 days after the date on which the challenge is initiated.</text>
 </clause><clause id="id302A2497936E412F830D4A9A86BFEA1A" indent="up1"><enum>(ii)</enum><text>The development of the evidentiary record shall be completed not later than 155 days after the date on which discovery is completed under clause (i).</text>
 </clause><clause id="id1560770612984896A3F364731963E420" indent="up1"><enum>(iii)</enum><text>The closing brief shall be submitted not later than 60 days after the date on which the development of the evidentiary record is completed under clause (ii).</text>
 </clause><clause id="id8086A462D8AD4B0BAE55E03EF361CB85" indent="up1"><enum>(iv)</enum><text>A final Board decision shall be issued not later than 180 days after the date on which the evidentiary record is completed under clause (ii).</text>
 </clause></subparagraph><subparagraph id="id86466A087B3844498B8D7D0618FA0B4D" indent="up1"><enum>(B)</enum><text>The Board may extend a timeline under subparagraph (A) after a request from any party or in the interest of due process.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id9bd2c4e70787467bab35b97d4f817a9b"><enum>(c)</enum><header>Procedures</header><text>Not later than 180 days after the date of the enactment of this Act, the Surface Transportation Board shall initiate a proceeding to assess procedures that are available to parties in litigation before courts to expedite such litigation and the potential application of any such procedures to rate cases.</text>
 </subsection><subsection id="ide8ef2fc2-b773-47ca-a1e3-c5afd356318d"><enum>(d)</enum><header>Expired rail service contract limitation</header><text display-inline="yes-display-inline">Section 10709 is amended by striking subsection (h).</text> </subsection></section><section id="ida94bacb3-50e4-46ee-9ff8-b92c3aeb579c"><enum>12.</enum><header>Investigative authority</header> <subsection id="id33e2b011-32a7-43da-aeb6-30ee957c2901"><enum>(a)</enum><header>Authority To initiate investigations</header><text display-inline="yes-display-inline">Section 11701(a) is amended—</text>
 <paragraph id="id0C0D5A57E3804D62909FED836C3E7163"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>only on complaint</quote> and inserting <quote>on the Board’s own initiative or upon receiving a complaint pursuant to subsection (b)</quote>; and</text> </paragraph><paragraph id="id4D2ECB6E5FCF4E7AB21E1DC3431A9675"><enum>(2)</enum><text>by adding at the end the following: <quote>If the Board finds a violation of this part in a proceeding brought on its own initiative, any remedy from such proceeding may only be applied prospectively.</quote>.</text>
 </paragraph></subsection><subsection id="id44f75f2a411f4563b5f1ffba6970a640"><enum>(b)</enum><header>Limitations on investigations of the Board’s initiative</header><text>Section 11701, as amended by subsection (a), is further amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id465809f3f0cd4ab79a494e8a37433274" style="OLC"> <subsection id="idb6f9c37005964108b212758d19b016a8"><enum>(d)</enum><text>In any investigation commenced on the Board’s own initiative, the Board shall—</text>
 <paragraph id="id51c1737018f34c9eaba462e016c6d1e1"><enum>(1)</enum><text>not later than 30 days after initiating the investigation, provide written notice to the parties under investigation, which shall state the basis for such investigation;</text>
 </paragraph><paragraph id="id112be8f04ffb4562a3e5e12e9a519a7d"><enum>(2)</enum><text>only investigate issues that are of national or regional significance;</text> </paragraph><paragraph id="idFEFCCBD82AD440A4A24DB2B7823C040B"><enum>(3)</enum><text>permit the parties under investigation to file a written statement describing any or all facts and circumstances concerning a matter which may be the subject of such investigation;</text>
 </paragraph><paragraph id="id5f1e433424534b2dad0eeb038386515c"><enum>(4)</enum><text>make available to the parties under investigation and Board members—</text> <subparagraph id="idE8AB7F9C4AC440C6A9CCD15E1DB40169"><enum>(A)</enum><text>any recommendations made as a result of the investigation; and</text>
 </subparagraph><subparagraph id="id19F874E509DF4CE6BF27EFE7382F516F"><enum>(B)</enum><text>a summary of the findings that support such recommendations;</text> </subparagraph></paragraph><paragraph id="id805f910c5b8a49838dc3c186bba37ccb"><enum>(5)</enum><text>to the extent practicable, separate the investigative and decisionmaking functions of staff;</text>
 </paragraph><paragraph id="idcd7e0e760aaf46fcbb19603ecdcdf336"><enum>(6)</enum><text>dismiss any investigation that is not concluded by the Board with administrative finality within 1 year after the date on which it was commenced; and</text>
 </paragraph><paragraph id="idC98D298F4A1C46CCAC4203684493D255"><enum>(7)</enum><text>not later than 90 days after receiving the recommendations and summary of findings under paragraph (4)—</text>
 <subparagraph id="id24A622562B9B42E485A2E5B05D5C6F9B"><enum>(A)</enum><text>dismiss the investigation if no further action is warranted; or</text> </subparagraph><subparagraph id="idBF34709449FC48908810C89027413FAF"><enum>(B)</enum><text>initiate a proceeding to determine if a provision under this part has been violated.</text>
 </subparagraph></paragraph></subsection><subsection id="id619334F7663E4A34B0549465A6A726BD"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id918B500236A04265B5FB1DEA2956F25C"><enum>(1)</enum><text>Any parties to an investigation against whom a violation is found as a result of an investigation begun on the Board’s own initiative may, not later than 60 days after the date of the order of the Board finding such a violation, institute an action in the United States court of appeals for the appropriate judicial circuit for de novo review of such order in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5.</text>
 </paragraph><paragraph id="id7C26DC178AC14664A91629C955F2A4DB" indent="up1"><enum>(2)</enum><text>The court—</text> <subparagraph id="id10673339D71E43ABBD6204EFE2897721"><enum>(A)</enum><text>shall have jurisdiction to enter a judgment affirming, modifying, or setting aside, in whole or in part, the order of the Board; and</text>
 </subparagraph><subparagraph id="id5200C60C19524B18ADEC51A6D0776487"><enum>(B)</enum><text>may remand the proceeding to the Board for such further action as the court may direct.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="id7d477f9357524c80bfb96ca10fc2066c"><enum>(c)</enum><header>Rulemakings for investigations of the Board’s initiative</header><text>Not later than 1 year after the date of the enactment of this Act, the Board shall issue rules, after notice and comment rulemaking, for investigations commenced on its own initiative that—</text>
 <paragraph id="id3F3C6DC966C54875B91B3178820CDA80"><enum>(1)</enum><text>comply with the requirements of section 11701(d) of title 49, United States Code, as added by subsection (b);</text>
 </paragraph><paragraph id="idE06BCCE226764BAFA7A14DBF91DFCDC9"><enum>(2)</enum><text>satisfy due process requirements; and</text> </paragraph><paragraph id="id040DEDB4A2994CC39D1E829D2138C4C1"><enum>(3)</enum><text>take into account ex parte constraints.</text>
				</paragraph></subsection></section><section id="idb8758af4-bd5b-4f4f-bf81-a8ddbfcf8ac9"><enum>13.</enum><header>Arbitration of certain rail rates and practices disputes</header>
 <subsection id="id59f9a93f-99b9-4005-9b13-3998ea01470d"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 117 is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idd82363bb-8bca-4204-8d8d-7472f775ba86" style="USC"> <section id="id87ab0d26-afc8-4d14-9d76-39225d6d52a1"><enum>11708.</enum><header>Voluntary arbitration of certain rail rates and practices disputes</header> <subsection id="idaf64fd4e-dac4-4b8f-a9f7-db60ee6d3db9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the <short-title>Surface Transportation Board Reauthorization Act of 2015</short-title>, the Board shall promulgate regulations to establish a voluntary and binding arbitration process to resolve rail rate and practice complaints subject to the jurisdiction of the Board.</text>
 </subsection><subsection id="ida2413638-b240-4b36-9e2e-b50a8cbfd547"><enum>(b)</enum><header>Covered disputes</header><text>The voluntary and binding arbitration process established pursuant to subsection (a)—</text> <paragraph commented="no" id="id8a86b8c3-c268-427d-a69f-6ad88525b88c"><enum>(1)</enum><text>shall apply to disputes involving—</text>
 <subparagraph commented="no" id="id9E73BF94A7AF4C1F8D25025BC27FE29B"><enum>(A)</enum><text>rates, demurrage, accessorial charges, misrouting, or mishandling of rail cars; or</text>
 </subparagraph><subparagraph commented="no" id="idEDAA370BD322468D88AC864D0F86273D"><enum>(B)</enum><text>a carrier’s published rules and practices as applied to particular rail transportation;</text>
 </subparagraph></paragraph><paragraph commented="no" id="idc8735bf3-a922-4426-be2b-5b546c124677"><enum>(2)</enum><text display-inline="yes-display-inline">shall not apply to disputes—</text> <subparagraph commented="no" id="id4EF3D896C4D94827B54F2812E36AF355"><enum>(A)</enum><text display-inline="yes-display-inline">to obtain the grant, denial, stay, or revocation of any license, authorization, or exemption;</text>
 </subparagraph><subparagraph commented="no" id="id73F249C8E0B944ABBE5CCAB373B8C9EF"><enum>(B)</enum><text display-inline="yes-display-inline">to prescribe for the future any conduct, rules, or results of general, industry-wide applicability;</text>
 </subparagraph><subparagraph commented="no" id="idD12FDF2062884D6EA8FA24ABD6BFA88E"><enum>(C)</enum><text display-inline="yes-display-inline">to enforce a labor protective condition; or</text>
 </subparagraph><subparagraph commented="no" id="idc46f35af-054f-41b5-bb3e-47ca05a063c1"><enum>(D)</enum><text>that are solely between 2 or more rail carriers; and</text> </subparagraph></paragraph><paragraph commented="no" id="id3C437B7ACF894458A830C099A92E2123"><enum>(3)</enum><text>shall not prevent parties from independently seeking or utilizing private arbitration services to resolve any disputes the parties may have.</text>
							</paragraph></subsection><subsection id="id8448507c-16cd-43d5-be5f-3eda843f4f8a"><enum>(c)</enum><header>Arbitration procedures</header>
 <paragraph id="idf84aab32-d237-4c72-a430-6de1a166cf74"><enum>(1)</enum><header>In general</header><text>The Board—</text> <subparagraph id="id5cb52501-a97a-43ee-8c5f-8f0547b246ae"><enum>(A)</enum><text display-inline="yes-display-inline">may make the voluntary and binding arbitration process established pursuant to subsection (a) available only to the relevant parties;</text>
 </subparagraph><subparagraph id="ida6b996372c16406fb457da5a206c5e63"><enum>(B)</enum><text>may make the voluntary and binding arbitration process available only—</text> <clause id="idB84A9D511FF44137A5A12DB4B5903DEE"><enum>(i)</enum><text>after receiving the written consent to arbitrate from all relevant parties; and</text>
 </clause><clause id="id81E771B1918749E48C79D1C9A163FFD9"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idEA1EBE6F7BE04FBEA5E0191BF8A3ADAA"><enum>(I)</enum><text>after the filing of a written complaint; or</text> </subclause><subclause id="id781A7F19B7404456AF87C4EA3F7C9972" indent="up1"><enum>(II)</enum><text>through other procedures adopted by the Board in a rulemaking proceeding;</text>
 </subclause></clause></subparagraph><subparagraph id="id0fe73365-e808-4989-82e0-de342c57e49e"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to rate disputes, may make the voluntary and binding arbitration process available only to the relevant parties if the rail carrier has market dominance (as determined under section 10707); and</text>
 </subparagraph><subparagraph id="idb26de987-706c-40dc-9b80-72f3b3d99944"><enum>(D)</enum><text display-inline="yes-display-inline">may initiate the voluntary and binding arbitration process not later than 40 days after the date on which a written complaint is filed or through other procedures adopted by the Board in a rulemaking proceeding.</text>
 </subparagraph></paragraph><paragraph id="id508a8978-a987-423f-958c-a68462a6de9a"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Initiation of the voluntary and binding arbitration process shall preclude the Board from separately reviewing a complaint or dispute related to the same rail rate or practice in a covered dispute involving the same parties.</text>
 </paragraph><paragraph id="id75905eee-2f63-4b5f-bab5-44d43dca1a66"><enum>(3)</enum><header>Rates</header><text display-inline="yes-display-inline">In resolving a covered dispute involving the reasonableness of a rail carrier’s rates, the arbitrator or panel of arbitrators, as applicable, shall consider the Board’s methodologies for setting maximum lawful rates, giving due consideration to the need for differential pricing to permit a rail carrier to collect adequate revenues (as determined under section 10704(a)(2)).</text>
 </paragraph></subsection><subsection id="id5fc9d04f-76fa-4b07-9ad7-99735cfb8466"><enum>(d)</enum><header>Arbitration decisions</header><text display-inline="yes-display-inline">Any decision reached in an arbitration process under this section—</text> <paragraph id="id9ddfc268-094d-4685-a19b-8fead591fbb7"><enum>(1)</enum><text display-inline="yes-display-inline">shall be consistent with sound principles of rail regulation economics;</text>
 </paragraph><paragraph id="idF27D2B7449A54033ABBD265D1678D948"><enum>(2)</enum><text display-inline="yes-display-inline">shall be in writing;</text> </paragraph><paragraph id="id538559F4D62E4E34A3713D381C743FE3"><enum>(3)</enum><text display-inline="yes-display-inline">shall contain findings of fact and conclusions;</text>
 </paragraph><paragraph id="id76E593B23F764B369E4636702A08AF11"><enum>(4)</enum><text display-inline="yes-display-inline">shall be binding upon the parties; and</text> </paragraph><paragraph id="idD90D0C6FD6AE46F097988E900F5CE564"><enum>(5)</enum><text display-inline="yes-display-inline">shall not have any precedential effect in any other or subsequent arbitration dispute.</text>
							</paragraph></subsection><subsection id="id24679742-4342-49ea-ac3e-99d60cfef510"><enum>(e)</enum><header>Timelines</header>
 <paragraph id="id0f2b126f-e912-40aa-aeae-420fef890067"><enum>(1)</enum><header>Selection</header><text display-inline="yes-display-inline">An arbitrator or panel of arbitrators shall be selected not later than 14 days after the date of the Board’s decision to initiate arbitration.</text>
 </paragraph><paragraph id="idbd22744a-b33c-4c44-84a9-ce86183ac206"><enum>(2)</enum><header>Evidentiary process</header><text display-inline="yes-display-inline">The evidentiary process of the voluntary and binding arbitration process shall be completed not later than 90 days after the date on which the arbitration process is initiated unless—</text>
 <subparagraph id="idD57E6DC2DD894077A94BE548DFA6402F"><enum>(A)</enum><text display-inline="yes-display-inline">a party requests an extension; and</text> </subparagraph><subparagraph id="id03668B2CD6AE4CAFB45CC2AD4E88196A"><enum>(B)</enum><text display-inline="yes-display-inline">the arbitrator or panel of arbitrators, as applicable, grants such extension request.</text>
 </subparagraph></paragraph><paragraph id="id8860b1eb-aea6-4d98-ae57-2a170abf0c72"><enum>(3)</enum><header>Decision</header><text display-inline="yes-display-inline">The arbitrator or panel of arbitrators, as applicable, shall issue a decision not later than 30 days after the date on which the evidentiary record is closed.</text>
 </paragraph><paragraph id="id43db1746-c690-4a75-935c-ffc8c34c7f8a"><enum>(4)</enum><header>Extensions</header><text display-inline="yes-display-inline">The Board may extend any of the timelines under this subsection upon the agreement of all parties in the dispute.</text>
							</paragraph></subsection><subsection commented="no" id="id409650d0-849c-49cd-b67c-292f254e4d77"><enum>(f)</enum><header>Arbitrators</header>
 <paragraph commented="no" id="idcc0e85f5-9f77-4b13-9c42-11084cc81663"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Unless otherwise agreed by all of the parties, an arbitration under this section shall be conducted by an arbitrator or panel of arbitrators, which shall be selected from a roster, maintained by the Board, of persons with rail transportation, economic regulation, professional or business experience, including agriculture, in the private sector.</text>
 </paragraph><paragraph commented="no" id="id5ea2fa87-ca30-494c-95ee-4fec0246aebc"><enum>(2)</enum><header>Independence</header><text>In an arbitration under this section, the arbitrators shall perform their duties with diligence, good faith, and in a manner consistent with the requirements of impartiality and independence.</text>
							</paragraph><paragraph commented="no" id="idB31A384633D24908996AF17E0C2FE040"><enum>(3)</enum><header>Selection</header>
 <subparagraph commented="no" id="ida7318462-41ee-4554-b5b4-e3b20512c178"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the parties cannot mutually agree on an arbitrator, or the lead arbitrator of a panel of arbitrators, the parties shall select the arbitrator or lead arbitrator from the roster by alternately striking names from the roster until only 1 name remains meeting the criteria set forth in paragraph (1).</text>
 </subparagraph><subparagraph commented="no" id="id83b61e62-9bf7-463f-ba9e-937a0f366277"><enum>(B)</enum><header>Panel of arbitrators</header><text>If the parties agree to select a panel of arbitrators, instead of a single arbitrator, the panel shall be selected under this subsection as follows:</text>
 <clause commented="no" id="idD5233FE219614056BD728735E05D01FF"><enum>(i)</enum><text>The parties to a dispute may mutually select 1 arbitrator from the roster to serve as the lead arbitrator of the panel of arbitrators.</text>
 </clause><clause commented="no" id="id567849F1F1B2460C9CEA63756450CB3F"><enum>(ii)</enum><text>If the parties cannot mutually agree on a lead arbitrator, the parties shall select a lead arbitrator using the process described in subparagraph (A).</text>
 </clause><clause commented="no" id="id358cd7cb-ae96-435a-a820-27eac69d6d67"><enum>(iii)</enum><text>In addition to the lead arbitrator selected under this subparagraph, each party to a dispute shall select 1 additional arbitrator from the roster, regardless of whether the other party struck out the arbitrator’s name under subparagraph (A).</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="id34b6bc7f-ab19-413e-ad94-801cb9d1b779"><enum>(4)</enum><header>Cost</header><text display-inline="yes-display-inline">The parties shall share the costs incurred by the Board and arbitrators equally, with each party responsible for paying its own legal and other associated arbitration costs.</text>
							</paragraph></subsection><subsection id="id7f71928b-5e1e-43b8-87e4-7011ef1f02c5"><enum>(g)</enum><header>Relief</header>
 <paragraph id="id22A04B4BA556420BB31A077FBED941FD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the limitations set forth in paragraphs (2) and (3), an arbitral decision under this section may award the payment of damages or rate prescriptive relief.</text>
 </paragraph><paragraph id="id5be727cf-ccca-4887-a5f6-3f8e5a5cfc1c"><enum>(2)</enum><header>Practice disputes</header><text display-inline="yes-display-inline">The damage award for practice disputes may not exceed $2,000,000.</text> </paragraph><paragraph id="idf3141f11-56d0-497c-8677-190059c1c612"><enum>(3)</enum><header>Rate disputes</header> <subparagraph id="id1F6584FF144C4B01BBDF39B2A5AD78F0"><enum>(A)</enum><header>Monetary limit</header><text>The damage award for rate disputes, including any rate prescription, may not exceed $25,000,000.</text>
 </subparagraph><subparagraph id="idE164537F267C49DDAE36C2720139B998"><enum>(B)</enum><header>Time limit</header><text>Any rate prescription shall be limited to not longer than 5 years from the date of the arbitral decision.</text>
 </subparagraph></paragraph></subsection><subsection id="ide8b55536-4573-4dda-bda8-ecd11629b705"><enum>(h)</enum><header>Board review</header><text display-inline="yes-display-inline">If a party appeals a decision under this section to the Board, the Board may review the decision under this section to determine if—</text>
 <paragraph id="id548d59f3-49bd-48b6-8c2e-aa2442831c6b"><enum>(1)</enum><text display-inline="yes-display-inline">the decision is consistent with sound principles of rail regulation economics;</text> </paragraph><paragraph id="id689A8FDCB8BC44FABC582FB19AD4C01C"><enum>(2)</enum><text display-inline="yes-display-inline">a clear abuse of arbitral authority or discretion occurred;</text>
 </paragraph><paragraph id="id866D67621D584712B114DA1D920F5EFC"><enum>(3)</enum><text display-inline="yes-display-inline">the decision directly contravenes statutory authority; or</text> </paragraph><paragraph id="idc240e0ed-d7e8-44a8-a237-4b66a179a0be"><enum>(4)</enum><text display-inline="yes-display-inline">the award limitation under subsection (g) was violated.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id2b4f878d-d0f5-4d52-89dd-789b7c148821"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents for chapter 117 is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id014d1141-1ebd-4e76-a63a-3d8d7494b502" style="OLC"><toc><toc-entry bold="off" level="section">11708. Voluntary arbitration of certain rail rates and practice disputes.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="id814ecc9b-74e1-4413-8c20-9a75b37cf8df"><enum>14.</enum><header>Effect of proposals for rates from multiple origins and destinations</header> <subsection id="idD4B5262D5B464B9F9F563FD0777D3E53"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Comptroller General of the United States shall commence a study of rail transportation contract proposals containing multiple origin-to-destination movements.</text>
 </subsection><subsection id="id42D14975E7234148A0FF392A9DD60DB5"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after commencing the study required under subsection (a), the Comptroller General shall submit a report containing the results of the study to—</text>
 <paragraph id="idC99BF77F5399464AB1191CAA02586A91"><enum>(1)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>; and</text> </paragraph><paragraph id="id54CC30EF127D490C87B883380046FDE9"><enum>(2)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>.</text>
				</paragraph></subsection></section><section id="id04b1d157-9b96-483d-97a3-164c3222aae7"><enum>15.</enum><header>Reports</header>
 <subsection id="idAFCCEF36B9194189A4EF206DBE57DC80"><enum>(a)</enum><header>Report on rate case methodology</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Surface Transportation Board shall submit a report to the congressional committees referred to in section 14(b) that—</text>
 <paragraph id="id3718c3ba-a64c-4197-9138-8cc10b24c646"><enum>(1)</enum><text display-inline="yes-display-inline">indicates whether current large rate case methodologies are sufficient, not unduly complex, and cost effective;</text>
 </paragraph><paragraph id="idce01b7b4-54d7-47f3-9577-e2442d639df2"><enum>(2)</enum><text>indicates whether alternative methodologies exist, or could be developed, to streamline, expedite, and address the complexity of large rate cases; and</text>
 </paragraph><paragraph id="id5ACCE11827FB49B2A2CA9784A967AA7D"><enum>(3)</enum><text>only includes alternative methodologies, which exist or could be developed, that are consistent with sound economic principles.</text>
 </paragraph></subsection><subsection id="ide9df8b3d-0451-4383-935c-8b3c9894a764"><enum>(b)</enum><header>Quarterly reports</header><text display-inline="yes-display-inline">Beginning not later than 60 days after the date of the enactment of this Act, the Surface Transportation Board shall submit quarterly reports to the congressional committees referred to in section 14(b) that describes the Surface Transportation Board’s progress toward addressing the issues raised in each unfinished regulatory proceeding, regardless of whether the proceeding is subject to a statutory or regulatory deadline.</text>
 </subsection></section><section id="idC3B1910C9ABA4622813CE1F05B49FCD1"><enum>16.</enum><header>Criteria</header><text display-inline="no-display-inline">Section 10704(a)(2) is amended by inserting <quote>for the infrastructure and investment needed to meet the present and future demand for rail services and</quote> after <quote>management,</quote>.</text>
 </section><section commented="no" id="id1267d786-6aa6-4745-91b1-1838d95cdd69"><enum>17.</enum><header>Construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to affect any suit commenced by or against the Surface Transportation Board, or any proceeding or challenge pending before the Surface Transportation Board, before the date of the enactment of this Act.</text></section></legis-body></bill>
