 <subsection id="idAFB70262BF5E4F7E8FC83B456B0A1876"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="id5631064F311143AEA9A7C9A1CA81C7AA"><enum>(1)</enum><text>the restrictions on crude oil exports from the 1970s are no longer necessary due to the technological advances that have increased the domestic supply of crude oil; and</text>
 </paragraph><paragraph id="idA564B6B827C04B0C999BBB79FCEB4A30"><enum>(2)</enum><text>repealing restrictions on crude oil exports will contribute to job growth and economic development.</text> </paragraph></subsection><subsection id="idD40F1BE76870433F948B4893071E9300"><enum>(b)</enum><header>Repeal of Presidential Authority To Restrict Oil Exports</header> <paragraph id="idC010489DEB584F45A6D8698A17FB7D50"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 103 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6212">42 U.S.C. 6212</external-xref>) is repealed.</text>
					</paragraph><paragraph id="id4138DB5398FB4FC2BA5AAAE8985E3278"><enum>(2)</enum><header>Conforming amendments</header>
 <subparagraph id="id2C470941DE8C489682DFBD06664F6AAC"><enum>(A)</enum><text>Section 12 of the Alaska Natural Gas Transportation Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/15/719j">15 U.S.C. 719j</external-xref>) is amended—</text> <clause id="id0ADF9E3144BC46CEA952520860CB8A3A"><enum>(i)</enum><text>by striking <quote>and section 103 of the Energy Policy and Conservation Act</quote>; and</text>

 </subparagraph></paragraph></subsection><subsection id="idD2B126EBD502423884839C4CE4304ED6"><enum>(d)</enum><header>Repeal of limitations on export of OCS oil or gas</header><text>Section 28 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1354">43 U.S.C. 1354</external-xref>) is repealed.</text> </subsection><subsection id="id60E577F1CF254080B96A5F962A6464CC"><enum>(e)</enum><header>Termination of limitation on exportation of crude oil</header><text>Section 7(d) of the Export Administration Act of 1979 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2406">50 U.S.C. App. 2406(d)</external-xref>) (as in effect pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>)) shall have no force or effect.</text>
				</subsection><subsection id="id17D00444733E4446A3852235F3DAAE7E"><enum>(f)</enum><header>Clarification of crude oil regulation</header>
 <paragraph id="id09961FF28CB94C2E9B7C400764272A2C"><enum>(1)</enum><header>In general</header><text>Section 754.2 of title 15, Code of Federal Regulations (relating to crude oil) shall have no force or effect.</text>
 </paragraph><paragraph id="id2ACD2AFA88724526B7A3DA9759D540FC"><enum>(2)</enum><header>Crude oil license requirements</header><text>The Bureau of Industry and Security of the Department of Commerce shall grant licenses to export to a country crude oil (as the term is defined in subsection (a) of the regulation referred to in paragraph (1)) (as in effect on the date that is 1 day before the date of enactment of this Act) unless—</text>
 <subparagraph id="id4D8E38CFB701494097B62F6C66F0098E"><enum>(A)</enum><text>the country is subject to sanctions or trade restrictions imposed by the United States; or</text> </subparagraph><subparagraph id="id9DC2480517AB4F86BD7A4E4C847FEA2B"><enum>(B)</enum><text>the President or Congress has designated the country as subject to exclusion for reasons of national security.</text>
						</subparagraph></paragraph></subsection></section><section id="idAA2459EE8F66457388A0810F5E1E13D9"><enum>1004.</enum><header>Coal exports</header>
 <subsection id="id17579136017A4FE5A3BCBA6E456EA1E6"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> <paragraph id="id944D4BE48FA3447A847C1C4218EBF706"><enum>(1)</enum><text>increased international demand for coal is an opportunity to support jobs and promote economic growth in the United States; and</text>
 </paragraph><paragraph id="idEDAB3AE20F8B405B8FC77BCAF2C7E70C"><enum>(2)</enum><text>exports of coal should not be unreasonably restricted or delayed.</text> </paragraph></subsection><subsection id="id916D2B15593C40888D964017EF1C31A6"><enum>(b)</enum><header>NEPA review for coal exports</header><text>In completing an environmental impact statement or similar analysis required under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for an approval or permit for coal export terminals, or transportation of coal to coal export terminals, the Secretary of the Army, acting through the Chief of Engineers—</text>
 <paragraph id="idEF5AB79205644C68A906E523E32DAF76"><enum>(1)</enum><text>may only take into account domestic environmental impacts; and</text> </paragraph><paragraph id="id3C51FE012CD64BC0830C439E3C3E3D9C"><enum>(2)</enum><text>may not take into account any impacts resulting from the final use overseas of the exported coal.</text>
					</paragraph></subsection></section></title><title id="idD03D72E8F65B49D6A28799213CAA7B1E" style="OLC"><enum>II</enum><header>Improving North American energy infrastructure</header>
			<subtitle id="idD3C472458493410D935DA14BA973074D" style="OLC"><enum>A</enum><header>North American energy infrastructure</header>
 <section commented="no" id="H0C873352E3924F08B6582AF26DDCC2E9"><enum>2001.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that the United States should establish a more uniform, transparent, and modern process for the construction, connection, operation, and maintenance of oil and natural gas pipelines and electric transmission facilities for the import and export of oil and natural gas and the transmission of electricity to and from Canada and Mexico, in pursuit of a more secure and efficient North American energy market.</text>
 </section><section id="H8A99C7DD7E4B472080AF4EE973A3FDC3"><enum>2002.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph commented="no" id="H89EEB9F13F4F454E9EB009AB7064AF1A"><enum>(1)</enum><header>Cross-border segment</header><text>The term <term>cross-border segment</term> means the portion of an oil or natural gas pipeline or electric transmission facility that is located at the national boundary of the United States with either Canada or Mexico.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEE2BAB8532854116826B88FD44CC5EEF"><enum>(2)</enum><header>Electric Reliability Organization</header><text display-inline="yes-display-inline">The term <term>Electric Reliability Organization</term> has the meaning given the term in section 215 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o</external-xref>).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id909CAC89191F4E71B06B137A8FB614F5"><enum>(3)</enum><header>Independent System Operator</header><text display-inline="yes-display-inline">The term <term>Independent System Operator</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text>
 </paragraph><paragraph id="H48DE74F4F0F245B485D857078EF19F07"><enum>(4)</enum><header>Modification</header><text>The term <term>modification</term> includes a reversal of flow direction, change in ownership, volume expansion, downstream or upstream interconnection, or adjustment to maintain flow (such as a reduction or increase in the number of pump or compressor stations).</text>
 </paragraph><paragraph id="H9EC7F4B49936470FB7267D52490BDDB6"><enum>(5)</enum><header>Natural gas</header><text>The term <term>natural gas</term> has the meaning given the term in section 2 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717a">15 U.S.C. 717a</external-xref>).</text> </paragraph><paragraph id="H9E3C6DDF006B4E259807C1FC3558630F"><enum>(6)</enum><header>Oil</header><text>The term <term>oil</term> means petroleum or a petroleum product.</text>
 </paragraph><paragraph id="id29CD66451611416EADBA9187CEBDBBCC"><enum>(7)</enum><header>Regional entity</header><text>The term <term>regional entity</term> has the meaning given the term in section 215 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o</external-xref>).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H011E3B8EB01F499DB2BC356CFB06FD7F"><enum>(8)</enum><header>Regional Transmission Organization</header><text>The term <term>Regional Transmission Organization</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text>
					</paragraph></section><section id="HE2E2AD4FA9DC4AE29CDB02DBDD89A0B7"><enum>2003.</enum><header>Authorization of certain energy infrastructure projects at the national boundary of the United
			 States</header>
 <subsection id="H4F92DFFFA01D4C59AE53F753FC835AE3"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Except as provided in subsection (c) and section 2007, no person may construct, connect, operate, or maintain a cross-border segment of an oil pipeline or electric transmission facility for the import or export of oil or the transmission of electricity to or from Canada or Mexico without obtaining a certificate of crossing for the construction, connection, operation, or maintenance of the cross-border segment under this section.</text>
					</subsection><subsection commented="no" id="HAA59BE0B46EF408D8996F482D108358B"><enum>(b)</enum><header>Certificate of crossing</header>
 <paragraph id="H8FA0212FE337412DA2DF3424035D3690"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 120 days after final action is taken under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to a cross-border segment for which a request is received under this section, the Secretary of Energy, in consultation with appropriate Federal agencies, shall issue a certificate of crossing for the cross-border segment unless the relevant official finds that the construction, connection, operation, or maintenance of the cross-border segment is not in the national security interest of the United States.</text>
 </paragraph><paragraph id="H54F4819622E147C8BBDA89561933FE34"><enum>(2)</enum><header>Additional requirement for electric transmission facilities</header><text display-inline="yes-display-inline">In the case of a request for a certificate of crossing for the construction, connection, operation, or maintenance of a cross-border segment of an electric transmission facility, the Secretary of Energy shall require, as a condition of issuing the certificate of crossing for the request under paragraph (1), that the cross-border segment of the electric transmission facility be constructed, connected, operated, or maintained consistent with all applicable policies and standards of—</text>
 <subparagraph id="HACFA3CC57986496391F6E3F68A5959FB"><enum>(A)</enum><text>the Electric Reliability Organization and the applicable regional entity; and</text> </subparagraph><subparagraph commented="no" id="H9F85281874C143FBAEFD4210DA71A7BA"><enum>(B)</enum><text display-inline="yes-display-inline">any Regional Transmission Organization or Independent System Operator with operational or functional control over the cross-border segment of the electric transmission facility.</text>
 </subparagraph></paragraph></subsection><subsection id="HF8CDC652BE3D4BD0B95B9FE0FAD9A97C"><enum>(c)</enum><header>Exclusions</header><text display-inline="yes-display-inline">This section shall not apply to any construction, connection, operation, or maintenance of a cross-border segment of an oil pipeline or electric transmission facility for the import or export of oil or the transmission of electricity to or from Canada or Mexico—</text>
 <paragraph id="H13D6631832144E4DA32829E5D250D12F"><enum>(1)</enum><text display-inline="yes-display-inline">if the cross-border segment is operating for that import, export, or transmission as of the date of enactment of this Act;</text>
 </paragraph><paragraph id="H9DA6B238E797474FA5FD1D37DCC30D40"><enum>(2)</enum><text>if a permit described in section 2006 for that construction, connection, operation, or maintenance has been issued;</text>
 </paragraph><paragraph id="H653CB05EEEBE4A90A6C73E9BFBB21D3B"><enum>(3)</enum><text display-inline="yes-display-inline">if a certificate of crossing for that construction, connection, operation, or maintenance has previously been issued under this section; or</text>
 </paragraph><paragraph commented="no" id="HC0ED32518E9B400F8B6808FC8E31BBD0"><enum>(4)</enum><text display-inline="yes-display-inline">if an application for a permit described in section 2006 for that construction, connection, operation, or maintenance is pending on the date of enactment of this Act, until the earlier of—</text>
 <subparagraph commented="no" id="H4F3E4AA88DD64CF3921399696F320787"><enum>(A)</enum><text>the date on which the application is denied; or</text> </subparagraph><subparagraph commented="no" id="H54FD0F77D9544E799FBA616F3F48A43A"><enum>(B)</enum><text>July 1, 2016.</text>
							</subparagraph></paragraph></subsection><subsection id="HB144992532D94FAD8DA4FFCC599ED067"><enum>(d)</enum><header>Effect of other laws</header>
 <paragraph id="HC4ED25047D2348BCA515235E3425366C"><enum>(1)</enum><header>Application to projects</header><text>Nothing in this section or section 2007 affects the application of any other Federal law to a project for which a certificate of crossing for the construction, connection, operation, or maintenance of a cross-border segment is sought under this section.</text>
 </paragraph><paragraph id="HD4819824E752402A8A2081102E499AFC"><enum>(2)</enum><header>Effect on Natural Gas Act</header><text>Nothing in this section or section 2007 affects the requirement to obtain approval or authorization under sections 3 and 7 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b</external-xref>, 717f) for the siting, construction, or operation of any facility to import or export natural gas.</text>
 </paragraph></subsection></section><section id="HBE2CF367D644466C930DC4ACFCB0323C"><enum>2004.</enum><header>Importation or exportation of natural gas to Canada and Mexico</header><text display-inline="no-display-inline">Section 3(c) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b(c)</external-xref>) is amended—</text> <paragraph id="id64FFCDA191E047C69716A04081A5BB61"><enum>(1)</enum><text>by striking <quote>(c) For purposes</quote> and inserting the following:</text>

 <subsection id="H834A78F4C29C46099F1D95BBF636CEAD"><enum>(a)</enum><header>Repeal of Requirement To Secure Order</header><text display-inline="yes-display-inline">Section 202 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824a">16 U.S.C. 824a</external-xref>) is amended by striking subsection (e).</text> </subsection><subsection id="H0D6180497B424394A7E7EA8346D5DFF6"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="H33D31A239A604D7ABE70BD2796D3309B"><enum>(1)</enum><header>State regulations</header><text>Section 202(f) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824a">16 U.S.C. 824a(f)</external-xref>) is amended in the last sentence by striking <quote>insofar as such State regulation does not conflict with the exercise of the Commission's powers under or relating to subsection 202(e)</quote>.</text>
 </paragraph><paragraph id="H965AE4FCDE554B7A8E9ABEC718F9C4E2"><enum>(2)</enum><header>Seasonal diversity electricity exchange</header><text display-inline="yes-display-inline">Section 602(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/824a-4">16 U.S.C. 824a–4(b)</external-xref>) is amended in the first sentence by striking <quote>the Commission has</quote> and all that follows through the period at the end of the last sentence and inserting <quote>the Secretary has conducted hearings and finds that the proposed transmission facilities would not impair the sufficiency of electric supply within the United States or would not impede or tend to impede the coordination in the public interest of facilities subject to the jurisdiction of the Secretary.</quote>.</text>
 </paragraph></subsection></section><section id="HFF2740F375B6464687BF60C513533428"><enum>2006.</enum><header>No Presidential permit required</header><text display-inline="no-display-inline">No Presidential permit (or similar permit) required under Executive Order 13337 (<external-xref legal-doc="usc" parsable-cite="usc/3/301">3 U.S.C. 301</external-xref> note; 69 Fed. Reg. 25299 (April 30, 2004)), Executive Order 11423 (<external-xref legal-doc="usc" parsable-cite="usc/3/301">3 U.S.C. 301</external-xref> note; 33 Fed. Reg. 11741 (August 16, 1968)), section 301 of title 3, United States Code, Executive Order 12038 (43 Fed. Reg. 3674 (January 26, 1978)), Executive Order 10485 (18 Fed. Reg. 5397 (September 9, 1953)), or any other Executive order shall be necessary for the construction, connection, operation, or maintenance of an oil or natural gas pipeline or electric transmission facility, or any cross-border segment thereof.</text>
 </section><section id="H2CEBEAE3179B4DB09D068F785834F541"><enum>2007.</enum><header>Modifications to existing projects</header><text display-inline="no-display-inline">No certificate of crossing under section 2003, or permit described in section 2006, shall be required for a modification to the construction, connection, operation, or maintenance of an oil or natural gas pipeline or electric transmission facility—</text>
 <paragraph id="H2AF364A3839E445EA1387C0DBC1C02B9"><enum>(1)</enum><text>that is operating for the import or export of oil or natural gas or the transmission of electricity to or from Canada or Mexico as of the date of enactment of this Act;</text>
 </paragraph><paragraph id="H564880DE0B1441419EF6145AE56E9745"><enum>(2)</enum><text display-inline="yes-display-inline">for which a permit described in section 2006 for such construction, connection, operation, or maintenance has been issued; or</text>
 </paragraph><paragraph id="HE3495172BDDC48DCA1C55663EF842616"><enum>(3)</enum><text display-inline="yes-display-inline">for which a certificate of crossing for the cross-border segment of the pipeline or facility has previously been issued under section 2003.</text>
					</paragraph></section><section id="HAB95489EF19140998E3BD540014DDEEA"><enum>2008.</enum><header>Effective date; rulemaking deadlines</header>
 <subsection id="H18E91D6133444505A02992D57D55DC00"><enum>(a)</enum><header>Effective date</header><text display-inline="yes-display-inline">Sections 2003 through 2007, and the amendments made by those sections, shall take effect on January 1, 2016.</text>
 </subsection><subsection id="H5666073BC5FB4DBFAD5C55F69D65ED5C"><enum>(b)</enum><header>Rulemaking deadlines</header><text>The Secretary of Energy shall—</text> <paragraph id="HE2F0DDDAA3A045C287D4CC92ADD4E936"><enum>(1)</enum><text>not later than 180 days after the date of enactment of this Act, publish in the Federal Register notice of a proposed rulemaking to carry out the applicable requirements of section 2003; and</text>
 </paragraph><paragraph id="H2CD592535693481CA98E9262F71B6EB9"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this Act, publish in the Federal Register a final rule to carry out the applicable requirements of section 2003.</text>
						</paragraph></subsection></section></subtitle><subtitle id="id061C20A254FD467BACA04C021278C623" style="OLC"><enum>B</enum><header>Keystone XL permit approval</header>
 <section id="id990A69CF1CB24269914CEAC21CD43B48"><enum>2011.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="idBF30DE6D130644729C6BE727702C4617"><enum>(1)</enum><text>building the Keystone XL pipeline will provide jobs and economic growth to the United States; and</text>
 </paragraph><paragraph id="id6C3F717E9E1F4406BB5DC451293D0B5B"><enum>(2)</enum><text>the Keystone XL pipeline should be approved immediately.</text> </paragraph></section><section id="id03C132537275407CB66CD27EC45FB8BA"><enum>2012.</enum><header>Keystone XL permit approval</header> <subsection id="id09EC4535F290442D986CAF07B33788DB"><enum>(a)</enum><header>In General</header><text>Notwithstanding Executive Order 13337 (<external-xref legal-doc="usc" parsable-cite="usc/3/301">3 U.S.C. 301</external-xref> note; 69 Fed. Reg. 25299 (April 30, 2004)), Executive Order 11423 (<external-xref legal-doc="usc" parsable-cite="usc/3/301">3 U.S.C. 301</external-xref> note; 33 Fed. Reg. 11741 (August 16, 1968)), section 301 of title 3, United States Code, and any other Executive order or provision of law, no presidential permit shall be required for the pipeline described in the application filed on May 4, 2012, by TransCanada Corporation to the Department of State for the northern portion of the Keystone XL pipeline from the Canadian border to the border between the States of South Dakota and Nebraska.</text>
 </subsection><subsection id="ida4054c98ef364a4cab82cd6d8b02ad3f"><enum>(b)</enum><header>Environmental Impact Statement</header><text>The final environmental impact statement issued by the Secretary of State on January 31, 2014, regarding the pipeline referred to in subsection (a), shall be considered to satisfy all requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text>
 </subsection><subsection id="id2a88738de1aa4d3db8440731c510c6c1"><enum>(c)</enum><header>Critical habitat</header><text>No area necessary to construct or maintain the Keystone XL pipeline shall be considered critical habitat under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) or any other provision of law.</text>
 </subsection><subsection id="idd7764a495d374c41a1696baa8a61d7c3"><enum>(d)</enum><header>Permits</header><text>Any Federal permit or authorization issued before the date of enactment of this Act for the pipeline and cross-border facilities described in subsection (a), and the related facilities in the United States, shall remain in effect.</text>
 </subsection><subsection id="idff72c688ab18430a9f37c538d914999d"><enum>(e)</enum><header>Federal judicial review</header><text>The pipeline and cross-border facilities described in subsection (a), and the related facilities in the United States, that are approved by this section, and any permit, right-of-way, or other action taken to construct or complete the project pursuant to Federal law, shall only be subject to judicial review on direct appeal to the United States Court of Appeals for the District of Columbia Circuit.</text>
					</subsection></section></subtitle></title><title commented="no" id="id3DCD312B5CDF4C14B42E7A1446676B8D" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">Outer Continental Shelf leasing</header>
 <section commented="no" display-inline="no-display-inline" id="idA7DBBBBD74EF4D828E01E0F3F5C62F79" section-type="subsequent-section"><enum>3001.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that the United States has enormous potential for offshore energy development and that the people of the United States should have access to the jobs and economic benefits from developing those resources.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id84DC00AD4EB94CD69BCAC960D5D9F949" section-type="subsequent-section"><enum>3002.</enum><header display-inline="yes-display-inline">Extension of leasing program</header>
 <subsection commented="no" display-inline="no-display-inline" id="id6939C62465454732A21586918372CE2B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (c), the Draft Proposed Outer Continental Shelf Oil and Gas Leasing Program 2015–2020 issued by the Secretary of the Interior (referred to in this title as the <quote>Secretary</quote>) under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>) shall be considered to be the final oil and gas leasing program under that section for the period of fiscal years 2015 through 2020.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id3976DF4A5BA6481F9816BF403F210251"><enum>(b)</enum><header display-inline="yes-display-inline">Final environmental impact
 statement</header><text display-inline="yes-display-inline">The Secretary is considered to have issued a final environmental impact statement for the program applicable to the period described in subsection (a) in accordance with all requirements under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id2CC28F5C145847729A1E3D47B1DA63E1"><enum>(c)</enum><header>Exceptions</header><text>Lease Sales 214, 232, and 239 shall not be included in the final oil and gas leasing program for the period of fiscal years 2015 through 2020.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id9F008F949DD042B28F148507F43AB0F4" section-type="subsequent-section"><enum>3003.</enum><header display-inline="yes-display-inline">Lease sales</header>
 <subsection commented="no" display-inline="no-display-inline" id="id5F6ECC0885C54EE7A549F289D1EE36E3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, not later than 180 days after the date of enactment of this Act and every 270 days thereafter, the Secretary shall conduct a lease sale in each outer Continental Shelf planning area for which the Secretary determines that there is a commercial interest in purchasing Federal oil and gas leases for production on the outer Continental Shelf.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idDF36D959B0294423B4C301F7476EF6B0"><enum>(b)</enum><header display-inline="yes-display-inline">Subsequent determinations and
 sales</header><text display-inline="yes-display-inline">If the Secretary determines that there is not a commercial interest in purchasing Federal oil and gas leases for production on the outer Continental Shelf in a planning area under this section, not later than 2 years after the date of the determination and every 2 years thereafter, the Secretary shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id8A0D9703C22D4463B4393B6A2AD3D81C"><enum>(1)</enum><text display-inline="yes-display-inline">make an additional determination on whether there is a commercial interest in purchasing Federal oil and gas leases for production on the outer Continental Shelf in the planning area; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E510B218E3E4E54A7E4370B789F0EC5"><enum>(2)</enum><text display-inline="yes-display-inline">if the Secretary determines that there is a commercial interest under paragraph (1), conduct a lease sale in the planning area.</text>
 </paragraph></subsection><subsection id="IDd624b06cf82c4930a4c0ec90ca41b2c3"><enum>(c)</enum><header>Protection of State interest</header><text>In developing future leasing programs, the Secretary shall give deference to affected coastal States (as the term is used in the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>)) in determining leasing areas to be included in the leasing program.</text>
 </subsection><subsection id="IDd7e88daa36e24b36bcadf33936b67fe2"><enum>(d)</enum><header>Petitions</header><text>If a person petitions the Secretary to conduct a lease sale for an outer Continental Shelf planning area in which the person has a commercial interest, the Secretary shall conduct a lease sale for the area in accordance with subsection (a).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id664AD54CE99244488632273A92B81F66"><enum>3004.</enum><header>Applications
 for permits to drill</header><text display-inline="no-display-inline">Section 5 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1334">43 U.S.C. 1334</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id539EB49753C74A6890477705DF4C91DD" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id5F81B317EA3747ED89E503E8909B2A30"><enum>(k)</enum><header>Applications
				for permits To drill</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id5008C471FF894E699B4ECB8ED604E7F1"><enum>(1)</enum><header>In
 general</header><text>Subject to paragraph (2), the Secretary shall approve or disapprove an application for a permit to drill submitted under this Act not later than 20 days after the date on which the application is submitted to the Secretary.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCD467A1CE8E4015892AA4C6B65632B6"><enum>(2)</enum><header>Disapproval</header><text>If the Secretary disapproves an application for a permit to drill under paragraph (1), the Secretary shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idE69F5844521043A4893807E36BCEAA11"><enum>(A)</enum><text>provide to the applicant a description of the reasons for the disapproval of the application;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFFFF976287B042DD986B1DD7B76C00EB"><enum>(B)</enum><text>allow the applicant to resubmit an application during the 10-day period beginning on the date of the receipt of the description described in subparagraph (A) by the applicant; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98F52C1ADA8B416897B6D322E5529FF9"><enum>(C)</enum><text>approve or disapprove any resubmitted application not later than 10 days after the date on which the application is submitted to the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id21FB044B09FA4381ACDE0C7B91E3A78C"><enum>3005.</enum><header>Lease sales
			 for certain areas</header>
				<subsection id="idCFE6B5BB90234189969CDE19C66891B4"><enum>(a)</enum><header>In
 general</header><text>As soon as practicable but not later than 1 year after the date of enactment of this Act, the Secretary shall conduct Lease Sale 220 for areas offshore of the State of Virginia.</text>
				</subsection><subsection id="id8D14EB5FC64149F0B6DF6F26841D3484"><enum>(b)</enum><header>Compliance with
 other laws</header><text>For purposes of the lease sale described in subsection (a), the environmental impact statement prepared under section 3001 shall satisfy the <act-name parsable-cite="NEPA69">requirements of the National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text>
				</subsection><subsection id="IDd080402b59bf48c588cd88278c124e1e"><enum>(c)</enum><header>Energy projects
			 in Gulf of Mexico</header>
 <paragraph id="ID6b0b9d1305e84aa59152ded763a858b1"><enum>(1)</enum><header>Jurisdiction</header><text>The United States Court of Appeals for the Fifth Circuit shall have exclusive jurisdiction over challenges to offshore energy projects and permits to drill carried out in the Gulf of Mexico.</text>
					</paragraph><paragraph id="ID78a2df2d14e94515a1be79d3276fd74b"><enum>(2)</enum><header>Filing
 deadline</header><text>Any civil action to challenge a project or permit described in paragraph (1) shall be filed not later than 60 days after the date of approval of the project or the issuance of the permit.</text>
					</paragraph></subsection></section></title><title id="idF57F0D34B3E74A7F8AD54D6348A4B6BE" style="OLC"><enum>IV</enum><header>Utilizing America's onshore resources</header>
 <section id="H589AC4CD73374602A9C56359F303A5E2"><enum>4001.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="id46635867190446AE9C8327BF5636D297"><enum>(1)</enum><text display-inline="yes-display-inline">current policy has failed to take full advantage of the natural resources on Federal land;</text>
 </paragraph><paragraph id="id62E6BC5CDC2846B7A1BDBBE768574AE5"><enum>(2)</enum><text display-inline="yes-display-inline">the States should be given the option to lead energy development on all available Federal land in a State; and</text>
 </paragraph><paragraph id="id4E6844D9ABDE4756A29E43AC3ABE9FED"><enum>(3)</enum><text display-inline="yes-display-inline">the Federal Government should not inhibit energy development on Federal land.</text> </paragraph></section><section id="id74535C1309DF42C2933A9C1B907D8E3E"><enum>4002.</enum><header>State option for energy development</header><text display-inline="no-display-inline">Notwithstanding any other provision of this title, a State may elect to control energy development and production on available Federal land in accordance with the terms and conditions of subtitle A and the amendments made by subtitle A in lieu of being subject to the Federal system established under subtitle B and the amendments made by subtitle B.</text>
			</section><subtitle id="id3BA14AF0BBD34D969A42801452AAB427" style="OLC"><enum>A</enum><header>Energy development by States</header>
 <section id="idAFC999BBA6954FE7AAEF1006DD0FA5E7"><enum>4011.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="id4e7a6dd01e46484fa052409da519efa4"><enum>(1)</enum><header>Available Federal land</header><text>The term <term>available Federal land</term> means any Federal land that, as of the date of enactment of this Act—</text>
 <subparagraph id="id58f4890f1dfc4660b7a783c50e40d616"><enum>(A)</enum><text>is located within the boundaries of a State;</text> </subparagraph><subparagraph id="id4dedb1f42d984e879f2b7971d0f0efcd"><enum>(B)</enum><text>is not held by the United States in trust for the benefit of a federally recognized Indian tribe;</text>
 </subparagraph><subparagraph id="idf392d68c4e4f4f0da5ff44526234c377"><enum>(C)</enum><text>is not a unit of the National Park System;</text> </subparagraph><subparagraph id="idb3e75f920df0414e82d2e600f05475e9"><enum>(D)</enum><text>is not a unit of the National Wildlife Refuge System; and</text>
 </subparagraph><subparagraph id="id45596cda462c43e4bf384e6eb60184b6"><enum>(E)</enum><text>is not a congressionally designated wilderness area.</text> </subparagraph></paragraph><paragraph id="id0143c684a802465fbd6b7bfd7e8694c2"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
 </paragraph><paragraph id="idb55788f2149c44b1bb5341b58cf4804e"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means—</text> <subparagraph id="id04c88b66333841669e412a8f58326660"><enum>(A)</enum><text>a State; and</text>
 </subparagraph><subparagraph id="idfce5e9fe1dcb4cb4ae38e3eef9315f51"><enum>(B)</enum><text>the District of Columbia.</text> </subparagraph></paragraph></section><section id="id0cae2f4e4e094d2faeed99f2907d9c48"><enum>4012.</enum><header>State programs</header> <subsection id="id36a81a19fe8340d6bc0d134d2645d7d3"><enum>(a)</enum><header>In general</header><text>A State—</text>
 <paragraph id="idabd2aa6df78c41e989f3f7c089d88a06"><enum>(1)</enum><text>may establish a program covering the leasing and permitting processes, regulatory requirements, and any other provisions by which the State would exercise the rights of the State to develop all forms of energy resources on available Federal land in the State; and</text>
 </paragraph><paragraph id="id96e054816b5d4f04bb55215b01c12f9b"><enum>(2)</enum><text>as a condition of certification under section 4013(b) shall submit a declaration to the Departments of the Interior, Agriculture, and Energy that a program under paragraph (1) has been established or amended.</text>
 </paragraph></subsection><subsection id="id128cd7228dd54cbfb0aecfd673db31ff"><enum>(b)</enum><header>Amendment of programs</header><text>A State may amend a program developed and certified under this subtitle at any time.</text> </subsection><subsection id="ide816bdb6ef3e4486a324a3c602d10d38"><enum>(c)</enum><header>Certification of amended programs</header><text>Any program amended under subsection (b) shall be certified under section 4013(b).</text>
					</subsection></section><section id="idbfadabca15094e538fb97178b9065153"><enum>4013.</enum><header>Leasing, permitting, and regulatory programs</header>
 <subsection id="id6fbf4ebac2704189864717312b39a41c"><enum>(a)</enum><header>Satisfaction of Federal requirements</header><text>Each program certified under this section shall be considered to satisfy all applicable requirements of Federal law (including regulations), including—</text>
 <paragraph id="id20de6a4dd3f24d079f9770468968b830"><enum>(1)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text> </paragraph><paragraph id="idb85dd4910a9d47e59f135dd087423bff"><enum>(2)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text>
 </paragraph><paragraph id="id1ca6818964644197bbe5cd10ad9787db"><enum>(3)</enum><text>the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>).</text> </paragraph></subsection><subsection id="idb4abc023a30f40a5880d9b3138502db3"><enum>(b)</enum><header>Federal certification and transfer of development rights</header><text>Upon submission of a declaration by a State under section 4012(a)(2)—</text>
 <paragraph id="id8ae08fc4917a48049932b1ea1d44245d"><enum>(1)</enum><text>the program under section 4012(a)(1) shall be certified; and</text> </paragraph><paragraph id="id6d5554cad80f4eee89833aa73975379c"><enum>(2)</enum><text>the State shall receive all rights from the Federal Government to develop all forms of energy resources covered by the program.</text>
 </paragraph></subsection><subsection id="idfd89e3b305514553a424fac60fb3a123"><enum>(c)</enum><header>Issuance of permits and leases</header><text>If a State elects to issue a permit or lease for the development of any form of energy resource on any available Federal land within the borders of the State in accordance with a program certified under subsection (b), the permit or lease shall be considered to meet all applicable requirements of Federal law (including regulations).</text>
 </subsection></section><section id="id0bc223639e444b4092844783ac74dbfa"><enum>4014.</enum><header>Judicial review</header><text display-inline="no-display-inline">Activities carried out in accordance with this subtitle shall not be subject to Federal judicial review.</text>
 </section><section id="id52ac64baaec043e682181d6b11898b8f"><enum>4015.</enum><header>Administrative Procedure Act</header><text display-inline="no-display-inline">Activities carried out in accordance with this subtitle shall not be subject to subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text>
				</section></subtitle><subtitle id="HFD6A318ADCD7418B9E84F3BC16A22926"><enum>B</enum><header>Onshore oil and gas permit streamlining</header>
				<part id="id07C546B85FC948D782B36186F2BEEF4C" style="OLC"><enum>I</enum><header>Oil and gas leasing certainty</header>
 <section id="HA58F116FC1DE42B6896593CC937BFF97"><enum>4021.</enum><header>Minimum acreage requirement for onshore lease sales</header><text display-inline="no-display-inline">Section 17 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226</external-xref>) is amended—</text> <paragraph id="idE807921109974F45B4A4F981DA256E24"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="subsection" style="OLC">Sec.</header-in-text> 17. (a) All lands</quote> and inserting the following:</text>

 <paragraph id="idB6F963679D064057AD225BD7FAF96101"><enum>(1)</enum><header>In general</header><text>All land</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="id7032b954404642dfaa7f11af0447f535"><enum>(2)</enum><text>in subsection (a), by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idDD554307F4FD45F8B5430FFF11E271F4" style="OLC">
								<paragraph id="idFB2A4BB8F4D5418F81560D831452044A"><enum>(2)</enum><header>Minimum acreage requirement for onshore lease sales</header>
 <subparagraph id="id547E456F7E1E443293F68AE811963568"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In conducting lease sales under paragraph (1)—</text> <clause id="id5283F6F591AE4CDEA447F96A92678AE2"><enum>(i)</enum><text display-inline="yes-display-inline">there shall be a presumption that nominated land should be leased; and</text>
 </clause><clause id="idFD7EEAB6E9CF48BCBE08825A57E2FB68"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary of the Interior shall offer for sale all of the nominated acreage not previously made available for lease, unless the Secretary demonstrates by clear and convincing evidence that an individual lease should not be granted.</text>
 </clause></subparagraph><subparagraph id="idEFB25E100AF9499B89FD25168B9C66B3"><enum>(B)</enum><header>Administration</header><text display-inline="yes-display-inline">Acreage offered for lease pursuant to this paragraph—</text> <clause id="id6801479A9F8A444F9FB5ACCC93350A84"><enum>(i)</enum><text display-inline="yes-display-inline">shall not be subject to protest; and</text>
 </clause><clause id="idE46DB6AC23594B7397B8565FE7A0827D"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be eligible for categorical exclusions under section 390 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15942">42 U.S.C. 15942</external-xref>), except that the categorical exclusions shall not be subject to the test of extraordinary circumstances or any other similar regulation or policy guidance.</text>
 </clause></subparagraph><subparagraph id="HDF527CC7B1004A8199197DF2B9659922"><enum>(C)</enum><header>Availability</header><text>In administering this paragraph, the Secretary shall only consider leasing of Federal land that is available for leasing at the time the lease sale occurs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H443C2C1BB3A147C0B8FD49456B9D18F8"><enum>4022.</enum><header>Leasing certainty</header><text display-inline="no-display-inline">Section 17(a) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(a)</external-xref>) (as amended by section 4061) is amended by adding at the end the following:</text> <quoted-block id="H7AA50B7365654CF4ADC15C01AE4743CC" style="OLC"> <paragraph id="H0A21C736A1C64468A098EA92B020E9A6"><enum>(3)</enum><header>Leasing certainty</header> <subparagraph id="HC9EACF8A874A4BC6826F7EE101D87977"><enum>(A)</enum><header>In general</header><text>The Secretary of the Interior shall not withdraw any covered energy project (as defined in section 4051 of the <short-title>American Energy Renaissance Act of 2015</short-title>) issued under this Act without finding a violation of the terms of the lease by the lessee.</text>
 </subparagraph><subparagraph id="H5B5C6410C4CF469AA8656C4EA980EE08"><enum>(B)</enum><header>Delay</header><text>The Secretary shall not infringe on lease rights under leases issued under this Act by indefinitely delaying issuance of project approvals, drilling and seismic permits, and rights-of-way for activities under the lease.</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H86520A8E1D684EFF86950BA85B032D73"><enum>(C)</enum><header>Availability for lease</header><text>Not later than 18 months after an area is designated as open under the applicable land use plan, the Secretary shall make available nominated areas for lease using the criteria established under section 2.</text>
								</subparagraph><subparagraph id="H20E006DC4D57436EA660998B311BC97B"><enum>(D)</enum><header>Last payment</header>
 <clause id="idF8F65ADCEACC4C7EA42D4161EFE41AB8"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary shall issue all leases sold not later than 60 days after the last payment is made.</text>
 </clause><clause id="HBBCF0FE8569C4A1792B3DEAD4FDF319E"><enum>(ii)</enum><header>Cancellation</header><text>The Secretary shall not cancel or withdraw any lease parcel after a competitive lease sale has occurred and a winning bidder has submitted the last payment for the parcel.</text>
									</clause></subparagraph><subparagraph id="H8813BE3F2F58410CBA07CDB8D1E0CD07"><enum>(E)</enum><header>Protests</header>
 <clause id="idDDDC5E8194444AA3BC064B8C5177CDEE"><enum>(i)</enum><header>In general</header><text>Not later than the end of the 60-day period beginning on the date a lease sale is held under this Act, the Secretary shall adjudicate any lease protests filed following a lease sale.</text>
 </clause><clause id="id8040E654475E4ACFBDAB7D1B8CB41FAA"><enum>(ii)</enum><header>Unsettled protest</header><text>If, after the 60-day period described in clause (i) any protest is left unsettled—</text> <subclause id="id1CFB51E9FDF9441A8595E08DA7B3F39B"><enum>(I)</enum><text>the protest shall be considered automatically denied; and</text>
 </subclause><subclause id="idD668A4E3B3974D828FB3D92E924350AB"><enum>(II)</enum><text>the appeal rights of the protestor shall begin.</text> </subclause></clause></subparagraph><subparagraph id="H4C9FCFE2002F4F65A4AE4A836E38BE64"><enum>(F)</enum><header>Additional lease stipulations</header><text display-inline="yes-display-inline">No additional lease stipulation may be added after the parcel is sold without consultation and agreement of the lessee, unless the Secretary considers the stipulation as an emergency action to conserve the resources of the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H67ADD19EF19343499CD9A8068603FA44"><enum>4023.</enum><header>Leasing consistency</header><text display-inline="no-display-inline">A Federal land manager shall follow existing resource management plans and continue to actively lease in areas designated as open when resource management plans are being amended or revised, until such time as a new record of decision is signed.</text>
 </section><section id="H041A87ACA96B4E07B0BE5488E8DA3132"><enum>4024.</enum><header>Reduce redundant policies</header><text display-inline="no-display-inline">Bureau of Land Management Instruction Memorandum 2010–117 shall have no force or effect.</text> </section><section commented="no" display-inline="no-display-inline" id="HDB37C0E7A7EF427C800FD3E98554943C" section-type="subsequent-section"><enum>4025.</enum><header>Streamlined congressional notification</header><text display-inline="no-display-inline">Section 31(e) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/188">30 U.S.C. 188(e)</external-xref>) is amended in the first sentence of the matter following paragraph (4) by striking <quote>at least thirty days in advance of the reinstatement</quote> and inserting <quote>in an annual report</quote>.</text>
					</section></part><part id="idE910B6F763DE448AA10F4893BE7BDCEF"><enum>II</enum><header>Application for permits to drill process reform</header>
 <section id="HABC2BB564A884AC99A7A854F6F10FA3A"><enum>4031.</enum><header>Permit to drill application timeline</header><text display-inline="no-display-inline">Section 17(p) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(p)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text> <quoted-block id="H7D61BDE14BFC45E783F6214FB8D7A23D" style="OLC"> <paragraph id="H6CBDE225E81548CA81E06882AFA92DFE"><enum>(2)</enum><header>Applications for permits to drill reform and process</header> <subparagraph id="id079E98F042FB4020809B65F04972520F"><enum>(A)</enum><header>In general</header><text>Not later than the end of the 30-day period beginning on the date an application for a permit to drill is received by the Secretary, the Secretary shall decide whether to issue the permit.</text>
								</subparagraph><subparagraph id="id6D8FCED803D945C2B32967E5CF377E98"><enum>(B)</enum><header>Extension</header>
 <clause id="id7661E28F611849C9968980BBC0520271"><enum>(i)</enum><header>In general</header><text>The Secretary may extend the period described in subparagraph (A) for up to 2 periods of 15 days each, if the Secretary has given written notice of the delay to the applicant.</text>
 </clause><clause id="idCB817EFAB0BF4E5E8FF7B616C184DDB2"><enum>(ii)</enum><header>Notice</header><text>The notice shall—</text> <subclause id="id1C808DCFB0BA44D68FB3C11237B1BE03"><enum>(I)</enum><text>be in the form of a letter from the Secretary or a designee of the Secretary; and</text>
 </subclause><subclause id="idA5485624B92A411595D12196FA3EBBF7"><enum>(II)</enum><text>include—</text> <item id="id39B027179B3848F597667450C9CF1C09"><enum>(aa)</enum><text>the names and titles of the persons processing the application;</text>
 </item><item id="id6B4E83F815B346989EE01E90C9DC70EB"><enum>(bb)</enum><text>the specific reasons for the delay; and</text> </item><item id="idC708A6EB9197470A8EE4DCA17B04F04F"><enum>(cc)</enum><text>a specific date a final decision on the application is expected.</text>
 </item></subclause></clause></subparagraph><subparagraph id="H75E3FA308F914EA68A89C401E3FA363F"><enum>(C)</enum><header>Notice of reasons for denial</header><text>If the application is denied, the Secretary shall provide the applicant—</text> <clause id="HB55D97A2B7724A26A5F7CD74455D1092"><enum>(i)</enum><text>a written statement that provides clear and comprehensive reasons why the application was not accepted and detailed information concerning any deficiencies; and</text>
 </clause><clause id="H6718F43A49FD40CC9FC04182DB5E4126"><enum>(ii)</enum><text>an opportunity to remedy any deficiencies.</text> </clause></subparagraph><subparagraph id="H426B0C97CE8F475CA1A6E8BB7320C778"><enum>(D)</enum><header>Application deemed approved</header> <clause id="idF95FF65AD4744CA0A8131E8F3E26F5BD"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), if the Secretary has not made a decision on the application by the end of the 60-day period beginning on the date the application is received by the Secretary, the application shall be considered approved.</text>
 </clause><clause id="id241B284940F84D6FB96008F4EAD9CBBB"><enum>(ii)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Clause (i) shall not apply in cases in which existing reviews under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) or Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) are incomplete.</text>
 </clause></subparagraph><subparagraph id="H1A4C6B7EC6614E0684951CB6BFD5F591"><enum>(E)</enum><header>Denial of permit</header><text display-inline="yes-display-inline">If the Secretary decides not to issue a permit to drill under this paragraph, the Secretary shall—</text> <clause id="H93927EFE43C943A4913C4800E82BAB19"><enum>(i)</enum><text display-inline="yes-display-inline">provide to the applicant a description of the reasons for the denial of the permit;</text>
 </clause><clause id="H275234EE7C944A85BC09D151050F1B69"><enum>(ii)</enum><text display-inline="yes-display-inline">allow the applicant to resubmit an application for a permit to drill during the 10-day period beginning on the date the applicant receives the description of the denial from the Secretary; and</text>
 </clause><clause id="HAB2E20F4DBBA47678DA6C517F9DE6159"><enum>(iii)</enum><text>issue or deny any resubmitted application not later than 10 days after the date the application is submitted to the Secretary.</text>
									</clause></subparagraph><subparagraph id="HB0F55CFDF05E4B01B7E26ECB8151FECA"><enum>(F)</enum><header>Fee</header>
 <clause id="H1CA5E982916A4DF497BCCD1658971681"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary shall collect a single $6,500 permit processing fee per application from each applicant at the time the final decision is made whether to issue a permit under subparagraph (A).</text>
 </clause><clause id="id065169F227DD46B0BE23D5CCE0BB1CF4"><enum>(ii)</enum><header>Resubmitted application</header><text display-inline="yes-display-inline">The fee required under clause (i) shall not apply to any resubmitted application.</text> </clause><clause id="H3EA3D267906449ED9A391482D394B57C"><enum>(iii)</enum><header>Treatment of permit processing fee</header><text display-inline="yes-display-inline">Subject to appropriation, of all fees collected under this paragraph for each fiscal year, 50 percent shall be—</text>
 <subclause id="idAECC13CFE6BE467EBC8021294105467F"><enum>(I)</enum><text display-inline="yes-display-inline">transferred to the field office at which the fees are collected; and</text> </subclause><subclause id="id57C8AFE3682D41A788197C05F7A2F55F"><enum>(II)</enum><text display-inline="yes-display-inline">used to process protests, leases, and permits under this Act.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H661F197DFF1340A981B3CB168AB5B342"><enum>4032.</enum><header>Administrative protest documentation reform</header><text display-inline="no-display-inline">Section 17(p) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(p)</external-xref>) (as amended by section 4031) is amended by adding at the end the following:</text> <quoted-block id="HEB29F8B68AD346898932CE6B044E782C" style="OLC"> <paragraph id="H86DA6A861D834A49AA34D288F109C228"><enum>(4)</enum><header>Protest fee</header> <subparagraph id="HFC19EBE601264677B70E2AE7FC82F2CA"><enum>(A)</enum><header>In general</header><text>The Secretary shall collect a $5,000 documentation fee to accompany each administrative protest for a lease, right-of-way, or application for a permit to drill.</text>
 </subparagraph><subparagraph id="H75A8881A59D94AC58A1923CBAC0648AE"><enum>(B)</enum><header>Treatment of fees</header><text display-inline="yes-display-inline">Subject to appropriation, of all fees collected under this paragraph for each fiscal year, 50 percent shall—</text>
 <clause id="id18C8F706A43E42509FF079BE2CF55547"><enum>(i)</enum><text display-inline="yes-display-inline">remain in the field office at which the fees are collected; and</text> </clause><clause id="id370DCAB4595148B29D248DF09F695E6D"><enum>(ii)</enum><text display-inline="yes-display-inline">be used to process protests.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</section><section id="H7BC41E8AF54C4A7AAFD7718D0185E9A7"><enum>4033.</enum><header>Improved Federal energy permit coordination</header>
 <subsection id="H8700079E56044FAD9D92F3499127E410"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id9377E3FF7A6E45B0B873E3C2362E9CC1"><enum>(1)</enum><header>Energy project</header><text>The term <term>energy project</term> includes any oil, natural gas, coal, or other energy project, as defined by the Secretary.</text>
 </paragraph><paragraph id="id3E3F3B44EF2D4673BD50C086F4CC4D13"><enum>(2)</enum><header>Project</header><text>The term <term>Project</term> means the Federal Permit Streamlining Project established under subsection (b).</text> </paragraph><paragraph id="id1AFE82BBD73C4509865A289FBA4B3AB4"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
 </paragraph></subsection><subsection id="H22A96066D813457FABFECDEA7DACE7BD"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a Federal Permit Streamlining Project in each Bureau of Land Management field office with responsibility for permitting energy projects on Federal land.</text>
						</subsection><subsection id="H8A0E8B3E61364CC8B7ECC996C3DAF199"><enum>(c)</enum><header>Memorandum of understanding</header>
 <paragraph id="H1205C9C048A544359CA5B937BC7F7D27"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall enter into a memorandum of understanding for purposes of carrying out this section with—</text>
 <subparagraph id="HE3A465CA4FA14C30A1E2154D634B58FB"><enum>(A)</enum><text>the Secretary of Agriculture;</text> </subparagraph><subparagraph id="H1424684A616A460E823C441221FECFBC"><enum>(B)</enum><text>the Administrator of the Environmental Protection Agency; and</text>
 </subparagraph><subparagraph id="H59BF64F770E942229FA18EAF965E8AD8"><enum>(C)</enum><text>the Chief of Engineers.</text> </subparagraph></paragraph><paragraph id="H47B963F603AD416BA1B266B363105FC7"><enum>(2)</enum><header>State participation</header><text>The Secretary may request that the Governor of any State with energy projects on Federal land to be a signatory to the memorandum of understanding.</text>
							</paragraph></subsection><subsection id="HD375628CE554409C871CB86E4E47D40C"><enum>(d)</enum><header>Designation of qualified staff</header>
 <paragraph id="H1E6535EE2DDF49199D058390CCE6D99B"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the signing of the memorandum of understanding under subsection (c), each Federal signatory party shall, if appropriate, assign to each Bureau of Land Management field office an employee who has expertise in the regulatory issues relating to the office in which the employee is employed, including, as applicable, particular expertise in—</text>
 <subparagraph id="H3E8A2F59375648ECB9F7DB5A3005BE48"><enum>(A)</enum><text>the consultations and the preparation of biological opinions under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>);</text>
 </subparagraph><subparagraph id="H64636A6B2CC841E79F148BC08A85053E"><enum>(B)</enum><text>permits under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>);</text> </subparagraph><subparagraph id="HD9FFB6D499814A24891F67878E89E578"><enum>(C)</enum><text>regulatory matters under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>);</text>
 </subparagraph><subparagraph id="H0140EF2330444349957C9118D6998B54"><enum>(D)</enum><text>planning under the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>); and</text>
 </subparagraph><subparagraph id="H7A4B66C567D2446F95DE73821E447D4D"><enum>(E)</enum><text>the preparation of analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text> </subparagraph></paragraph><paragraph id="HB338333658B34AA89EB24EC6765B706C"><enum>(2)</enum><header>Duties</header><text>Each employee assigned under paragraph (1) shall—</text>
 <subparagraph id="H5F0B13A747A141F186CCB64A1C4FED99"><enum>(A)</enum><text>not later than 90 days after the date of assignment, report to the Bureau of Land Management Field Managers in the office to which the employee is assigned;</text>
 </subparagraph><subparagraph id="H97B913CD75794A4FA9D5CA7871630DFA"><enum>(B)</enum><text display-inline="yes-display-inline">be responsible for all issues relating to the energy projects that arise under the authorities of the home agency of the employee; and</text>
 </subparagraph><subparagraph id="H07E5D246053E4EF1A0CB8A22480EFD67"><enum>(C)</enum><text>participate as part of the team of personnel working on proposed energy projects, planning, and environmental analyses on Federal land.</text>
 </subparagraph></paragraph></subsection><subsection id="H1D19982212B3473795E897ED778B28F6"><enum>(e)</enum><header>Additional personnel</header><text display-inline="yes-display-inline">The Secretary shall assign to each Bureau of Land Management field office described in subsection (b) any additional personnel that are necessary to ensure the effective approval and implementation of energy projects administered by the Bureau of Land Management field office, including inspection and enforcement relating to energy development on Federal land, in accordance with the multiple use mandate of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>).</text>
 </subsection><subsection id="H3DE963558EC340F18545881C66924B02"><enum>(f)</enum><header>Funding</header><text>Funding for the additional personnel shall come from the Department of the Interior reforms under paragraph (2) of section 17(p) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(p)</external-xref>) (as amended by section 4031 and section 4032).</text>
 </subsection><subsection id="HBFD8698C62004859BA2E5CB266867983"><enum>(g)</enum><header>Savings provision</header><text>Nothing in this section affects—</text> <paragraph id="HB46371E3074A48AF9E7A0A3526567965"><enum>(1)</enum><text>the operation of any Federal or State law; or</text>
 </paragraph><paragraph id="H13D3A370990D4781A68D1AD95BEC176E"><enum>(2)</enum><text>any delegation of authority made by the head of a Federal agency any employee of which is participating in the Project.</text>
 </paragraph></subsection></section><section id="H4EB79379351F44BEA7888BEEAAC3376D"><enum>4034.</enum><header>Administration</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Secretary of the Interior shall not require a finding of extraordinary circumstances in administering section 390 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15942">42 U.S.C. 15942</external-xref>).</text>
					</section></part><part id="id0C3CE3DE8DA541A0973FFAA44E9A3D10" style="OLC"><enum>III</enum><header>Oil shale</header>
					<section id="H46273C88F9C84ED2BEEDF80171AE99C9"><enum>4041.</enum><header>Effectiveness of oil shale regulations, amendments to resource management plans, and record of
			 decision</header>
						<subsection id="H3BF93D56DDF6401499FA002B2A0A19EE"><enum>(a)</enum><header>Regulations</header>
 <paragraph id="id2CC4B6AEAB0844BB9331175BF89D7F32"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law (including regulations), the final regulations regarding oil shale management published by the Bureau of Land Management on November 18, 2008 (73 Fed. Reg. 69414), shall be considered to satisfy all legal and procedural requirements under any law, including—</text>
 <subparagraph id="id77CB732A16A84C0C88760AC3A488730F"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text> </subparagraph><subparagraph id="idA111DDE5C8AE4EE18CD9694090A10CF1"><enum>(B)</enum><text display-inline="yes-display-inline">the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text>
 </subparagraph><subparagraph id="idDEB77940076F4D609A0DA9D0436F2DAF"><enum>(C)</enum><text display-inline="yes-display-inline">the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text> </subparagraph></paragraph><paragraph id="id191A4418825349C0937BDD06934B2D1C"><enum>(2)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary of the Interior shall implement the regulations described in paragraph (1) (including the oil shale leasing program authorized by the regulations) without any other administrative action necessary.</text>
							</paragraph></subsection><subsection id="HB7FB0D909F70408B9B6C51D2E308CD50"><enum>(b)</enum><header>Amendments to resource management plans and record of decision</header>
 <paragraph id="idF7555ACC1E5B45438D4CAF8D1875FEEA"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law (including regulations) to the contrary, the Approved Resource Management Plan Amendments/Record of Decision for Oil Shale and Tar Sands Resources to Address Land Use Allocations in Colorado, Utah, and Wyoming and the Final Programmatic Environmental Impact Statement of the Bureau of Land Management, as in effect on November 17, 2008, shall be considered to satisfy all legal and procedural requirements under any law, including—</text>
 <subparagraph id="id58A468F81BE74E9486E9CAEDE07C726F"><enum>(A)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text> </subparagraph><subparagraph id="id7012804752B3415282185C4B3FAF3854"><enum>(B)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text>
 </subparagraph><subparagraph id="id570B217725664DC7ADC99A78E5B3A468"><enum>(C)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text> </subparagraph></paragraph><paragraph id="idA1F441F3B174476C8CA18B438BFC90CE"><enum>(2)</enum><header>Implementation</header><text>The Secretary of the Interior shall implement the oil shale leasing program authorized by the regulations described in paragraph (1) in those areas covered by the resource management plans covered by the amendments, and covered by the record of decision, described in paragraph (1) without any other administrative action necessary.</text>
							</paragraph></subsection></section><section id="H3F936E35E29243D3A2B626CA0296F2B4"><enum>4042.</enum><header>Oil shale leasing</header>
 <subsection id="H127CE9E0763B45ED9E728374FB56BFBF"><enum>(a)</enum><header>Additional research and development lease sales</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of the Interior shall hold a lease sale offering an additional 10 parcels for lease for research, development, and demonstration of oil shale resources, under the terms offered in the solicitation of bids for such leases published on January 15, 2009 (74 Fed. Reg. 2611).</text>
						</subsection><subsection id="HCACA0ECF93C14E60BBD55D6D51987AF7"><enum>(b)</enum><header>Commercial lease sales</header>
 <paragraph id="idF4833B512D8A49B7A84E4C49E132D912"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 1, 2017, the Secretary of the Interior shall hold not less than 5 separate commercial lease sales in areas considered to have the most potential for oil shale development, as determined by the Secretary, in areas nominated through public comment.</text>
 </paragraph><paragraph id="id65CC88951ED94B3DBF6C9898FDB3515B"><enum>(2)</enum><header>Administration</header><text display-inline="yes-display-inline">Each lease sale shall be—</text> <subparagraph id="id23775A403BBF48ADBF635D9DB7874667"><enum>(A)</enum><text display-inline="yes-display-inline">for an area of not less than 25,000 acres; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB31D0870477D49388BB65385A048C454"><enum>(B)</enum><text display-inline="yes-display-inline">in multiple lease blocs.</text> </subparagraph></paragraph></subsection></section></part><part id="idB58A41C196C54069B53153C1C715088E" style="OLC"><enum>IV</enum><header>National Petroleum Reserve in Alaska Access</header> <section id="HA4904D9CB0EF49C0A8872858BBC8324C"><enum>4051.</enum><header>Sense of Congress and reaffirming national policy for the National Petroleum Reserve in Alaska</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
 <paragraph id="HF20AAC32A04B49E6B5E88DEC784D7330"><enum>(1)</enum><text>the National Petroleum Reserve in Alaska remains explicitly designated, both in name and legal status, for purposes of providing oil and natural gas resources to the United States; and</text>
 </paragraph><paragraph id="H1E194E3840214C6DA00C20F16A48A960"><enum>(2)</enum><text display-inline="yes-display-inline">accordingly, the national policy is to actively advance oil and gas development within the Reserve by facilitating the expeditious exploration, production, and transportation of oil and natural gas from and through the Reserve.</text>
 </paragraph></section><section id="H81031AD50DCB4F7FAFFFD9275ECFD258"><enum>4052.</enum><header>National Petroleum Reserve in Alaska: lease sales</header><text display-inline="no-display-inline">Section 107 of the Naval Petroleum Reserves Production Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/42/6506a">42 U.S.C. 6506a</external-xref>) is amended by striking subsection (a) and inserting the following</text> <quoted-block display-inline="no-display-inline" id="idFCB66EBAD7E742C2B21A9AA31C8DDC05" style="OLC"> <subsection id="id058FF0DD758A4783A8627AE96E88947C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct an expeditious program of competitive leasing of oil and gas in the Reserve—</text>
 <paragraph id="idEF46931A1B4F40DA8A19848EB7B3516A"><enum>(1)</enum><text display-inline="yes-display-inline">in accordance with this Act; and</text> </paragraph><paragraph id="id1642871696314CA28B3DAB0A2CC8E28E"><enum>(2)</enum><text display-inline="yes-display-inline">that shall include at least 1 lease sale annually in the areas of the Reserve most likely to produce commercial quantities of oil and natural gas for each of calendar years 2015 through 2024.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</section><section id="H464583CE715645C599C91ACECA5A962B"><enum>4053.</enum><header>National Petroleum Reserve in Alaska: planning and permitting pipeline and road construction</header>
 <subsection id="HA0CE2E3CBD0049B389C9856E056741BE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of the Interior, in consultation with other appropriate Federal agencies, shall facilitate and ensure permits, in a timely and environmentally responsible manner, for all surface development activities, including for the construction of pipelines and roads, necessary—</text>
 <paragraph id="H2087AB6F2A6B42FABF27C6055EC3502C"><enum>(1)</enum><text>to develop and bring into production any areas within the National Petroleum Reserve in Alaska that are subject to oil and gas leases; and</text>
 </paragraph><paragraph id="H8072C42568F14F4AAE7DF8C59C4C1DB2"><enum>(2)</enum><text display-inline="yes-display-inline">to transport oil and gas from and through the National Petroleum Reserve in Alaska in the most direct manner possible to existing transportation or processing infrastructure on the North Slope of Alaska.</text>
 </paragraph></subsection><subsection id="H5E0F7CB384A8438F8603A8C64A0B7A1C"><enum>(b)</enum><header>Timeline</header><text display-inline="yes-display-inline">The Secretary shall ensure that any Federal permitting agency shall issue permits in accordance with the following timeline:</text>
 <paragraph id="H40FCEF850EF343BD878BE6FD1D26EA8C"><enum>(1)</enum><text display-inline="yes-display-inline">Permits for the construction described in subsection (a) for transportation of oil and natural gas produced under existing Federal oil and gas leases with respect to which the Secretary has issued a permit to drill shall be approved not later than 60 days after the date of enactment of this Act.</text>
 </paragraph><paragraph id="HC163D1C7E64E457FA164EDD543C43731"><enum>(2)</enum><text display-inline="yes-display-inline">Permits for the construction described in subsection (a) for transportation of oil and natural gas produced under Federal oil and gas leases shall be approved not later than 180 days after the date on which a request for a permit to drill is submitted to the Secretary.</text>
 </paragraph></subsection><subsection id="HC6E738DABE1648D6B75903A99285F8FB"><enum>(c)</enum><header>Plan</header><text display-inline="yes-display-inline">To ensure timely future development of the National Petroleum Reserve in Alaska, not later than 270 days after the date of enactment of this Act, the Secretary of the Interior shall submit to Congress a plan for approved rights-of-way for a plan for pipeline, road, and any other surface infrastructure that may be necessary infrastructure that will ensure that all leasable tracts in the Reserve are within 25 miles of an approved road and pipeline right-of-way that can serve future development of the Reserve.</text>
						</subsection></section><section id="H75769CF4882C42B79AB26F448A3CA9FF"><enum>4054.</enum><header>Issuance of a new integrated activity plan and environmental impact statement</header>
 <subsection id="HB76E93B07D5C4AF9AABE5A40C99E6AD1"><enum>(a)</enum><header>Issuance of new integrated activity plan</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of the Interior shall issue—</text>
 <paragraph id="H36CB89F721994DD79826FE934D3786D7"><enum>(1)</enum><text>a new proposed integrated activity plan from among the nonadopted alternatives in the National Petroleum Reserve-Alaska Integrated Activity Plan Record of Decision issued by the Secretary of the Interior and dated February 21, 2013; and</text>
 </paragraph><paragraph id="HBD7B5028DF614399B31CE1434D6FCAC8"><enum>(2)</enum><text>an environmental impact statement under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) for issuance of oil and gas leases in the National Petroleum Reserve-Alaska to promote efficient and maximum development of oil and natural gas resources of the Reserve.</text>
 </paragraph></subsection><subsection id="HF26460B1FF5A4702A5F77102B299ACEC"><enum>(b)</enum><header>Nullification of existing record of decision, IAP, and EIS</header><text>Except as provided in subsection (a), the National Petroleum Reserve-Alaska Integrated Activity Plan Record of Decision issued by the Secretary of the Interior and dated February 21, 2013, including the integrated activity plan and environmental impact statement referred to in that record of decision, shall have no force or effect.</text>
 </subsection></section><section id="HFD3DEC3DAEDD44A3B7EA16624E0D86B3"><enum>4055.</enum><header>Departmental accountability for development</header><text display-inline="no-display-inline">The Secretary of the Interior shall promulgate regulations not later than 180 days after the date of enactment of this Act that establish clear requirements to ensure that the Department of the Interior is supporting development of oil and gas leases in the National Petroleum Reserve-Alaska.</text>
 </section><section id="H17E753B0BB5F498B9D94BE71D53193DC"><enum>4056.</enum><header>Deadlines under new proposed integrated activity plan</header><text display-inline="no-display-inline">At a minimum, the new proposed integrated activity plan issued under section 4054(a)(1) shall—</text> <paragraph id="H3A1A979EA0514FCF95E1D18C9A4B0DC2"><enum>(1)</enum><text>require the Department of the Interior to respond within 5 business days to a person who submits an application for a permit for development of oil and natural gas leases in the National Petroleum Reserve-Alaska acknowledging receipt of the application; and</text>
 </paragraph><paragraph id="H824D64FA6A9940B49447BC34760D21DE"><enum>(2)</enum><text>establish a timeline for the processing of each application that—</text> <subparagraph id="H252D4A28E01B47C8ACD08DD1959B4307"><enum>(A)</enum><text>specifies deadlines for decisions and actions on permit applications; and</text>
 </subparagraph><subparagraph id="HD0D38936E886447F826B53BC5A42F72E"><enum>(B)</enum><text>provides that the period for issuing a permit after the date on which the application is submitted shall not exceed 60 days without the concurrence of the applicant.</text>
							</subparagraph></paragraph></section><section id="H7A07C25B707C41D5913B0D54BF18DF9D"><enum>4057.</enum><header>Updated resource assessment</header>
 <subsection id="HBA1899DB75BF4B48811C1591EA9FC3AF"><enum>(a)</enum><header>In general</header><text>The Secretary of the Interior shall complete a comprehensive assessment of all technically recoverable fossil fuel resources within the National Petroleum Reserve in Alaska, including all conventional and unconventional oil and natural gas.</text>
 </subsection><subsection id="HF6387DAFCFCA48FDB2124BD48EAF2D40"><enum>(b)</enum><header>Cooperation and consultation</header><text>The assessment required by subsection (a) shall be carried out by the United States Geological Survey in cooperation and consultation with the State of Alaska and the American Association of Petroleum Geologists.</text>
 </subsection><subsection id="H971D452D11694583A23DD7C821C6F6EA"><enum>(c)</enum><header>Timing</header><text>The assessment required by subsection (a) shall be completed not later than 2 years after the date of enactment of this Act.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HE39CD35A36F349F9B22304710A6464AF"><enum>(d)</enum><header>Funding</header><text>In carrying out this section, the United States Geological Survey may cooperatively use resources and funds provided by the State of Alaska.</text>
						</subsection></section></part><part id="id94789001B55441659C81532A41D4A936" style="OLC"><enum>V</enum><header>Miscellaneous provisions</header>
 <section id="H5EA5547DB2BB449BBE80F67832304694"><enum>4061.</enum><header>Sanctions</header><text display-inline="no-display-inline">Nothing in this title authorizes the issuance of a lease under the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) to any person designated for the imposition of sanctions pursuant to—</text> <paragraph id="H661836179CDE45AAA7AA28A37C7B850C"><enum>(1)</enum><text>the Syria Accountability and Lebanese Sovereignty Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/175">Public Law 108–175</external-xref>);</text>

						</paragraph></section><section id="id00763F5BCF0B4D9E88108054FEA17832"><enum>4062.</enum><header>Ensuring consideration of economic impacts of protections for endangered species and threatened
			 species</header>
 <subsection id="idD39E45AB1D154F9E8459D7FA48C9EBB8"><enum>(a)</enum><header>In general</header><text>Section 13 of the Endangered Species Act of 1973 (87 Stat. 902; relating to conforming amendments to other laws, which have been executed) is amended to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="id135cfafc69d04a52be9e38c570e92b22" style="OLC">
								<section id="id0ea47812d86e446d8779a79c5951688e"><enum>13.</enum><header>Ensuring the consideration of the economic impacts of protections</header>
 <subsection id="id60A6CA3893D0430DBEA4272561D428AA"><enum>(a)</enum><header>Consideration of economic costs and benefits</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, any authorization, requirement, or prohibition of, or other restriction on, any action by a Federal agency or other person under this Act shall not apply with respect to a species determined by the Secretary to be an endangered species or threatened species, unless—</text>
 <paragraph id="id8520B2187C2D455BA3E2E1AB96E20A3D"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary has published and submitted to Congress a report that—</text> <subparagraph id="id3A9563CF0989411B990443E06AF23AF8"><enum>(A)</enum><text display-inline="yes-display-inline">describes the application;</text>
 </subparagraph><subparagraph id="id3D4C1B9F086D4A9B93AFEBEDF37ABC88"><enum>(B)</enum><text display-inline="yes-display-inline">sets forth the data considered by the Secretary regarding the economic costs and benefits of the application; and</text>
 </subparagraph><subparagraph id="id5C5B681FE6354E8581335923EF0BAF6E"><enum>(C)</enum><text display-inline="yes-display-inline">determines that the economic benefits of the application exceed the economic costs of the application; and</text>
 </subparagraph></paragraph><paragraph id="id8D2E3ED26D7A4D8F830C02F5B23AE32E"><enum>(2)</enum><text display-inline="yes-display-inline">the application is authorized expressly with respect to that species in a law enacted by Congress after the date of enactment of the <short-title>American Energy Renaissance Act of 2015</short-title>.</text>
 </paragraph></subsection><subsection id="id70BE01D9E5854D3F90A3A28743693B55"><enum>(b)</enum><header>Limitations</header><text>Subsection (a)—</text> <paragraph id="id69af4fab0bb149099cd70c01e8a373ad"><enum>(1)</enum><text>does not affect any authority of the Secretary under this Act—</text>
 <subparagraph id="idC049A492B6B5492A879104463A4D3FB5"><enum>(A)</enum><text>to determine that a species is an endangered species or threatened species and designate the critical habitat of that species;</text>
 </subparagraph><subparagraph id="id899E7E531C854BA3B57B6DAC629D68D4"><enum>(B)</enum><text>to conduct research regarding a species or the critical habitat of that species; or</text> </subparagraph><subparagraph id="id50697FA7992A4935807E6C4B79BF09F6"><enum>(C)</enum><text>to prepare, publish, or revise lists, or conduct reviews, under section 4(c);</text>
 </subparagraph></paragraph><paragraph id="id3CBCF5817C0E407A80AC4A49DE3A35C9"><enum>(2)</enum><text>does not apply with respect to a species if—</text> <subparagraph id="idFB13E8D3C4454AE7A16AA664CBE08F74"><enum>(A)</enum><text>the Secretary—</text>
 <clause id="id8458C17700EF4E1EA3F564E10699F4F6"><enum>(i)</enum><text>determines that prompt application of an authorization, requirement, or prohibition under this Act is necessary to prevent the extinction of the species; and</text>
 </clause><clause id="id072130426BC64EF89E8343FACE67B035"><enum>(ii)</enum><text>convenes a meeting of the Endangered Species Committee to consider that determination, except that for purposes of this paragraph each member of the Committee from an affected State under section 4(e)(3)(G) shall be appointed by the Governor of that State; and</text>
 </clause></subparagraph><subparagraph id="id04BA030ACA3A437999DDC9164AB81F21"><enum>(B)</enum><text>the Committee—</text> <clause id="idCAC419EBDD0B4B1CA5F611C8E1084EB1"><enum>(i)</enum><text>concurs in that determination by not later than 30 days after the date the Secretary convenes the Committee; and</text>
 </clause><clause id="id5722BE78357F42CA96FD7C47BBDE81B8"><enum>(ii)</enum><text>the vote to concur in that determination is unanimous, with all 7 votes in favor; and</text> </clause></subparagraph></paragraph><paragraph id="id515FA8ABF71C409C89BA37E35CE7AC32"><enum>(3)</enum><text>does not affect the application of this Act with respect to a species that is included in the list in effect under section 4(c) on the date of enactment of the <short-title>American Energy Renaissance Act of 2015</short-title>, during the 15-year period beginning on that date of enactment.</text>
										</paragraph></subsection><subsection id="id446FCAE9BFA14E30885306BFC29A2E7F"><enum>(c)</enum><header>Change in status of species</header>
 <paragraph id="id76D844B4687F46C0A925B09DE90123EB"><enum>(1)</enum><header>In general</header><text>A species shall not be treated under this Act as an endangered species or threatened species after the end of the 15-year period beginning on the date the Secretary determines under this Act that the species is an endangered species or a threatened species, unless the Secretary determines under section 4(c)(2), after the end of the 10-year period beginning on that date, that the species should not be changed in status.</text>
 </paragraph><paragraph id="id8739013A6E45411D87AFECF93A981A75"><enum>(2)</enum><header>Application with respect to previously listed species</header><text>In the case of a species included in a list under section 4(c) in effect on the date of enactment of the <short-title>American Energy Renaissance Act of 2015</short-title>, paragraph (1) shall be applied by substituting that date of enactment for the date <quote>the Secretary determines under this Act that the species is an endangered species or a threatened species</quote>.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id283503DD3DC84D099FACD37EF0B8E7F1"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents for the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/15/1531">15 U.S.C. 1531</external-xref> note) is amended by striking the item relating to section 13 and inserting the following:</text>

						</subsection></section></part><part id="H476ECD55D46D40C18EED8AF06C36FD7E"><enum>VI</enum><header>Judicial review</header>
 <section id="H8640BE27567E46A1BA900E06DF0FCDA7"><enum>4071.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text> <paragraph id="HC0F110A49FD343E486330362CBC7C698"><enum>(1)</enum><header>Covered civil action</header><text>The term <term>covered civil action</term> means a civil action containing a claim under section 702 of title 5, United States Code, regarding agency action (as defined for the purposes of that section) affecting a covered energy project on Federal land.</text>
						</paragraph><paragraph id="HBAE876BF35684617966307C7AFA22ED6"><enum>(2)</enum><header>Covered energy project</header>
 <subparagraph id="id673C989F03C04A2EBEEE8D5F8CD11555"><enum>(A)</enum><header>In general</header><text>The term <term>covered energy project</term> means—</text> <clause id="id9FF250840E344801964DB840199D3E18"><enum>(i)</enum><text>the leasing of Federal land for the exploration, development, production, processing, or transmission of oil, natural gas, wind, or any other source of energy; and</text>
 </clause><clause id="id2F3FF2CD24D14FEA801679EF66FBF597"><enum>(ii)</enum><text>any action under the lease.</text> </clause></subparagraph><subparagraph id="id44FE0EFC81CA4A54B47BFDB42A678AC7"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered energy project</term> does not include any dispute between the parties to a lease regarding the obligations under the lease, including any alleged breach of the lease.</text>
 </subparagraph></paragraph></section><section id="HB89120AEC06B4A3893A23D985E478D47"><enum>4072.</enum><header>Exclusive venue for certain civil actions relating to covered energy projects</header><text display-inline="no-display-inline">Venue for any covered civil action shall lie in the United States district court in which the covered energy project or lease exists or is proposed.</text>
 </section><section id="H7BF2C767FD554839A439C83BFC4C0AB1"><enum>4073.</enum><header>Timely filing</header><text display-inline="no-display-inline">To ensure timely redress by the courts, a covered civil action shall be filed not later than the end of the 90-day period beginning on the date of the final Federal agency action to which the covered civil action relates.</text>
 </section><section id="H6C3E7CC069A349D799C26F486085BC1A"><enum>4074.</enum><header>Expedition in hearing and determining the action</header><text display-inline="no-display-inline">The court shall endeavor to hear and determine any covered civil action as expeditiously as practicable.</text>
					</section><section id="HFE17E96232214A4DB16892BBEEAC331E"><enum>4075.</enum><header>Limitation on injunction and prospective relief</header>
 <subsection id="id3E21DD5BFC9245D1A513D39361C9A922"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In a covered civil action, a court shall not grant or approve any prospective relief unless the court finds that the relief—</text>
 <paragraph id="id9ACD1CCF0D954DF9980166BBBADD40E0"><enum>(1)</enum><text display-inline="yes-display-inline">is narrowly drawn;</text> </paragraph><paragraph id="id0181AC4919EC42DFB0EEF84FC84E3B2D"><enum>(2)</enum><text display-inline="yes-display-inline">extends no further than necessary to correct the violation of a legal requirement; and</text>
 </paragraph><paragraph id="id6F7290C5B152465888A375E51D8D0D02"><enum>(3)</enum><text display-inline="yes-display-inline">is the least intrusive means necessary to correct the violation.</text> </paragraph></subsection><subsection id="id374F683D40D847F898063719ED71B8CA"><enum>(b)</enum><header>Duration</header> <paragraph id="id9650CEEDB75840209141DA85855203AF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A court shall limit the duration of preliminary injunctions to halt covered energy projects to not more than 60 days, unless the court finds clear reasons to extend the injunction.</text>
 </paragraph><paragraph id="id9C4E6209BCF8402F9FA947D45CAE9352"><enum>(2)</enum><header>Administration</header><text display-inline="yes-display-inline">In the case of an extension, the extension shall—</text> <subparagraph id="id04D614A984B44296A66E710F24C36064"><enum>(A)</enum><text display-inline="yes-display-inline">only be in 30-day increments; and</text>
 </subparagraph><subparagraph id="id7428AC40FD3A40929791BE244F1C7BF5"><enum>(B)</enum><text display-inline="yes-display-inline">require action by the court to renew the injunction.</text> </subparagraph></paragraph></subsection></section><section id="HCBE248C9C26C4C38A34077A80EDD3920"><enum>4076.</enum><header>Limitation on attorneys’ fees and court costs</header> <subsection id="id291FC000CFD84D7FB98462DBD88983D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Sections 504 of title 5 and 2412 of title 28, United States Code (commonly known as the <quote>Equal Access to Justice Act</quote>), shall not apply to a covered civil action.</text>

			<subtitle id="idF4F891DBD97E4E41BA0287C3F838998A" style="OLC"><enum>A</enum><header>Leasing program for land within Coastal
			 Plain</header>
 <section id="HCEEC8A0576A143DB8994D861D9B58628"><enum>5001.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that development of energy reserves under the Coastal Plain of Alaska, performed in an environmentally responsible manner, will contribute to job growth and economic development.</text>
 </section><section id="id9415C5396B1F4BD1B5E70E7EC29A3B88"><enum>5002.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="H0988321039BB45ADAAA2AE9E2FF4D407"><enum>(1)</enum><header>Coastal plain</header><text>The term <term>Coastal Plain</term> means the area described in appendix I to part 37 of title 50, Code of Federal Regulations.</text>
					</paragraph><paragraph id="H68E0271C25DE4303A35E04AE5E9593F9"><enum>(2)</enum><header>Peer
 reviewed</header><text display-inline="yes-display-inline">The term <term>peer reviewed</term> means reviewed—</text>
 <subparagraph id="HE1BAF497BB9943BC8309FD41F808315B"><enum>(A)</enum><text>by individuals chosen by the National Academy of Sciences with no contractual relationship with, or those who have no application for a grant or other funding pending with, the Federal agency with leasing jurisdiction; or</text>
 </subparagraph><subparagraph id="H3E188AD257A14810A8468AA1801F7196"><enum>(B)</enum><text>if individuals described in subparagraph (A) are not available, by the top individuals in the specified biological fields, as determined by the National Academy of Sciences.</text>
 </subparagraph></paragraph><paragraph id="HC7403449C34A4548916B3E27B9C912C4"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
					</paragraph></section><section id="HE4D9A9EDD42A470F9BC4734F53C5FACF"><enum>5003.</enum><header>Leasing program
			 for land on the Coastal Plain</header>
					<subsection id="HBDBAE460C391476E845DDA6A29ED5710"><enum>(a)</enum><header>In
 general</header><text>The Secretary shall—</text> <paragraph id="H472B4F121D2A4D6E983E24CFE3104AA2"><enum>(1)</enum><text>establish and implement, in accordance with this subtitle and acting through the Director of the Bureau of Land Management in consultation with the Director of the United States Fish and Wildlife Service, a competitive oil and gas leasing program that will result in the exploration, development, and production of the oil and gas resources of the Coastal Plain; and</text>
 </paragraph><paragraph id="HD5E2372BCDC04AB787084D95778183EF"><enum>(2)</enum><text>administer the provisions of this subtitle through regulations, lease terms, conditions, restrictions, prohibitions, stipulations, and other provisions that ensure the oil and gas exploration, development, and production activities on the Coastal Plain do not result in any significant adverse effect on fish and wildlife, the habitat of fish and wildlife, subsistence resources, or the environment, including, in furtherance of this goal, by requiring the application of the best commercially available technology for oil and gas exploration, development, and production to all exploration, development, and production operations under this subtitle in a manner that ensures the receipt of fair market value by the public for the mineral resources to be leased.</text>
						</paragraph></subsection><subsection id="HEA36708901A742399C913BF70CFA0016"><enum>(b)</enum><header>Repeal of
			 existing restriction</header>
 <paragraph id="HA2B5D1F01A26493BA9D45114F2DD53DB"><enum>(1)</enum><header>Repeal</header><text>Section 1003 of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3143">16 U.S.C. 3143</external-xref>) is repealed.</text>
						</paragraph><paragraph id="HDE9AA818F68D48639D854F324ACA9625"><enum>(2)</enum><header>Conforming
 amendment</header><text>The table of contents contained in section 1 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3101">16 U.S.C. 3101</external-xref> note) is amended by striking the item relating to section 1003.</text>
						</paragraph></subsection><subsection id="H5EFFBCEC943E423E910FEBA8057E30D2"><enum>(c)</enum><header>Compliance with
			 requirements under certain other laws</header>
 <paragraph id="HFC7B1D56FAF242128DA22C98CBAAB216"><enum>(1)</enum><header>Compatibility</header><text>For purposes of the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>), the oil and gas leasing program and activities authorized by this section on the Coastal Plain are deemed to be compatible with the purposes for which the Arctic National Wildlife Refuge was established, and no further findings or decisions are required to implement this determination.</text>
						</paragraph><paragraph id="HD4416D92B7134B66A7CF6EE03BB209D9"><enum>(2)</enum><header>Adequacy of the
			 Department of the Interior’s legislative environmental impact
 statement</header><text>The document of the Department of the Interior entitled <quote>Final Legislative Environmental Impact Statement</quote> and dated April 1987 relating to the Coastal Plain prepared pursuant to section 1002 of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3142">16 U.S.C. 3142</external-xref>) and section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) is deemed to satisfy the requirements under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) that apply with respect to prelease activities under this subtitle, including actions authorized to be taken by the Secretary to develop and promulgate regulations for the establishment of a leasing program authorized by this subtitle before the conduct of the first lease sale.</text>
						</paragraph><paragraph id="H1C9784E1F09743A9AE61E03A5403F974"><enum>(3)</enum><header>Compliance with
			 NEPA for other actions</header>
 <subparagraph id="id0E1B144BD58F4B2596C0ADC65BD3F7E4"><enum>(A)</enum><header>In general</header><text>Prior to conducting the first lease sale under this subtitle, the Secretary shall prepare an environmental impact statement under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to the actions authorized by this subtitle not covered by paragraph (2).</text>
 </subparagraph><subparagraph id="id8004A081FD6F45CF877CAF42C985EE6F"><enum>(B)</enum><header>Nonleasing alternatives not required</header><text>Notwithstanding any other provision of law, in preparing the environmental impact statement under subparagraph (A), the Secretary—</text>
 <clause id="id66EBADF2EB8B48A8B81C9695FC5517F3"><enum>(i)</enum><text>shall—</text> <subclause id="idAAE857057056479381FA6951D7C6AC38"><enum>(I)</enum><text>only identify a preferred action for leasing and a single leasing alternative; and</text>
 </subclause><subclause id="idA1290A0A25A14FDA9102228701B74C65"><enum>(II)</enum><text>analyze the environmental effects and potential mitigation measures for those 2 alternatives; and</text>
 </subclause></clause><clause id="id72CF2CC903AA4D1ABD8471182B9616C6"><enum>(ii)</enum><text>is not required—</text> <subclause id="id95F57B5691C74942A255E604A2D3339B"><enum>(I)</enum><text>to identify nonleasing alternative courses of action; or</text>
 </subclause><subclause id="id9C193E016295468080F508A09A837B66"><enum>(II)</enum><text>to analyze the environmental effects of nonleasing alternative courses of action.</text>
 </subclause></clause></subparagraph><subparagraph id="id23EA8DAC006B44AF8C148EF569885C60"><enum>(C)</enum><header>Deadline</header><text>The identification under subparagraph (B)(i)(I) for the first lease sale conducted under this subtitle shall be completed not later than 18 months after the date of enactment of this Act.</text>
 </subparagraph><subparagraph id="id718952BFF59D4AFF90FA0AE038365D0E"><enum>(D)</enum><header>Public comment</header><text>The Secretary shall only consider public comments that—</text>
 <clause id="id7CB2024447FD48B7A8F84B45BDF331FF"><enum>(i)</enum><text>specifically address the preferred action of the Secretary; and</text> </clause><clause id="idD93193ECA0224223AC6BC922E1E063EB"><enum>(ii)</enum><text>are filed not later than 20 days after the date on which the environmental analysis is published.</text>
 </clause></subparagraph><subparagraph id="idCB057CCC4B364F78BD1D5E0D602DFC4A"><enum>(E)</enum><header>Compliance</header><text>Notwithstanding any other provision of law, compliance with this paragraph is deemed to satisfy all requirements for the analysis and consideration of the environmental effects of proposed leasing under this subtitle.</text>
							</subparagraph></paragraph></subsection><subsection id="H954BA9810EA3415B9BBA3753B32F7BCF"><enum>(d)</enum><header>Relationship to
 State and local authority</header><text>Nothing in this subtitle expands or limits State or local regulatory authority.</text> </subsection><subsection id="HAEB553E3D2B24F6AA4FC2028E389768B"><enum>(e)</enum><header>Special areas</header> <paragraph id="HD4F6CC5C6022445687CF9CD32FE0A12D"><enum>(1)</enum><header>In general</header><text>The Secretary, after consultation with the State of Alaska, the city of Kaktovik and the North Slope Borough of the State of Alaska, may designate not more than 45,000 acres of the Coastal Plain as a <quote>Special Area</quote> if the Secretary determines that the area is of such unique character and interest so as to require special management and regulatory protection.</text>
 </paragraph><paragraph id="id3B1AF35099604F348CCF10FBEAC08A35"><enum>(2)</enum><header>Sadlerochit Spring area</header><text>The Secretary shall designate the Sadlerochit Spring area, consisting of approximately 4,000 acres, as a Special Area.</text>
 </paragraph><paragraph id="H9B7866DFFBF54C47B0231F9382AAE725"><enum>(3)</enum><header>Management</header><text>Each Special Area shall be managed to protect and preserve the unique and diverse character of the area, including the fish, wildlife, and subsistence resource values of the area.</text>
						</paragraph><paragraph id="H619ECEB575B844C4963EF2A540F999FC"><enum>(4)</enum><header>Exclusion from
			 leasing or surface occupancy</header>
 <subparagraph id="idCE8B70E6B8BC49FB92AF4CDA39484DA1"><enum>(A)</enum><header>In general</header><text>The Secretary may exclude any Special Area from leasing.</text>
 </subparagraph><subparagraph id="id5BB3F775384244229AA968A67F3CD7FA"><enum>(B)</enum><header>No surface occupancy</header><text>If the Secretary leases a Special Area, or any part of a Special Area, for oil and gas exploration, development, production, or related activities, there shall be no surface occupancy of the land comprising the Special Area.</text>
							</subparagraph></paragraph><paragraph id="H7053B711CDC948619B01B16F4E9D36FC"><enum>(5)</enum><header>Directional
 drilling</header><text>Notwithstanding the other provisions of this subsection, the Secretary may lease all or a portion of a Special Area under terms that permit the use of horizontal drilling technology from sites on leased tracts located outside the Special Area.</text>
						</paragraph></subsection><subsection id="HCBC14435216C45F1BC22F59C85E16C36"><enum>(f)</enum><header>Limitation on
 closed areas</header><text>The authority of the Secretary to close land on the Coastal Plain to oil and gas leasing, exploration, development, or production shall be limited to the authority provided under this subtitle.</text>
					</subsection><subsection id="H59905C01E987411499F4EDD16213FE57"><enum>(g)</enum><header>Regulations</header>
						<paragraph id="H2B2FD71A4FBE4ED593A122F73590A4D6"><enum>(1)</enum><header>In
 general</header><text>Not later than 15 months after the date of enactment of this Act, the Secretary shall promulgate regulations necessary to carry out this subtitle, including regulations relating to protection of fish and wildlife, the habitat of fish and wildlife, subsistence resources, and environment of the Coastal Plain.</text>
						</paragraph><paragraph id="HE664D4A6D20A4CB982C8BD06BC7B5B43"><enum>(2)</enum><header>Revision of
 regulations</header><text display-inline="yes-display-inline">The Secretary shall, through a rulemaking conducted in accordance with section 553 of title 5, United States Code, periodically review and, if appropriate, revise the regulations promulgated under paragraph (1) to reflect a preponderance of the best available scientific evidence that has been peer reviewed and obtained by following appropriate, documented scientific procedures, the results of which can be repeated using those same procedures.</text>
						</paragraph></subsection></section><section id="HAD3516C26530469C9AF147120D1D6657"><enum>5004.</enum><header>Lease
			 sales</header>
					<subsection id="H099B915C965346B898F158CBC3BB3905"><enum>(a)</enum><header>In
 general</header><text>In accordance with the requirements of this subtitle, the Secretary may lease land under this subtitle to any person qualified to obtain a lease for deposits of oil and gas under the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>).</text>
 </subsection><subsection id="H852FB975D36845F0B4CC903F075A2E4A"><enum>(b)</enum><header>Procedures</header><text>The Secretary shall, by regulation and not later than 180 days after the date of enactment of this Act, establish procedures for—</text>
 <paragraph id="HA4CCD3660A294D1E8FCC4C2E0C12BB5D"><enum>(1)</enum><text>receipt and consideration of sealed nominations for any area of the Coastal Plain for inclusion in, or exclusion from, a lease sale;</text>
 </paragraph><paragraph id="HDE337DD2D01E41338C918609A1579593"><enum>(2)</enum><text>the holding of lease sales after the nomination process; and</text>
 </paragraph><paragraph id="H1F6E8575D4FD4A87A404164FC3D8A034"><enum>(3)</enum><text>public notice of and comment on designation of areas to be included in, or excluded from, a lease sale.</text>
						</paragraph></subsection><subsection id="H215ABB374868409EAD23CD31A0FF97CC"><enum>(c)</enum><header>Lease sale
 bids</header><text display-inline="yes-display-inline">Lease sales under this subtitle may be conducted through an Internet leasing program, if the Secretary determines that the Internet leasing program will result in savings to the taxpayer, an increase in the number of bidders participating, and higher returns than oral bidding or a sealed bidding system.</text>
					</subsection><subsection id="H1E6BCDE0E9674F89BD7F1DA8FF25649E"><enum>(d)</enum><header>Sale acreages
 and schedule</header><text>The Secretary shall—</text>
 <paragraph id="id0D7C9B47DC6244B08F5C3BCEBE152AEA"><enum>(1)</enum><text>offer for lease under this subtitle—</text> <subparagraph id="idA80F1641BC874802A02F99793B435860"><enum>(A)</enum><text>those tracts the Secretary considers to have the greatest potential for the discovery of hydrocarbons, taking into consideration nominations received under subsection (b)(1); and</text>
 </subparagraph><subparagraph id="H6E94997C213C4AF0B83BC8F680D20457"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id12C211C05F51413492E683A3AC993050"><enum>(i)</enum><text>not fewer than 50,000 acres by not later than 22 months after the date of the enactment of this Act; and</text>
 </clause><clause id="id1E54151E988C4B8B8B40E8638C10DE76" indent="up1"><enum>(ii)</enum><text>not fewer than an additional 50,000 acres at 6-, 12-, and 18-month intervals following the initial offering under subclause (i);</text>
 </clause></subparagraph></paragraph><paragraph id="H633E40ADA78448A58EEFB0AA0854942B"><enum>(2)</enum><text>conduct 4 additional lease sales under the same terms and schedule as the last lease sale under paragraph (1)(B)(ii) not later than 2 years after the date of that sale, if sufficient interest in leasing exists to warrant, in the judgment of the Secretary, the conduct of the sales; and</text>
 </paragraph><paragraph id="HBF74547A46A8422A9F89D0F37CB21E2F"><enum>(3)</enum><text>evaluate the bids in each lease sale under this subsection and issue leases resulting from the sales not later than 90 days after the date on which the sale is completed.</text>
						</paragraph></subsection></section><section id="HAACA501F97D549EB9681865F089975C9"><enum>5005.</enum><header>Grant of leases
			 by the Secretary</header>
					<subsection id="H93AC2B189EBB4E14AC62D8C7D8855694"><enum>(a)</enum><header>In
 general</header><text>The Secretary may grant to the highest responsible qualified bidder in a lease sale conducted under section 5004 any land to be leased on the Coastal Plain upon payment by the bidder of any bonus as may be accepted by the Secretary.</text>
					</subsection><subsection id="HEDC1CD0D84EB4D4782D2BC8460902F28"><enum>(b)</enum><header>Subsequent
 transfers</header><text>No lease issued under this subtitle may be sold, exchanged, assigned, sublet, or otherwise transferred except with the approval of the Secretary after the Secretary consults with, and gives due consideration to the views of, the Attorney General.</text>
					</subsection></section><section id="H9F190546E3F3429F9C675E1E4BABF97D"><enum>5006.</enum><header>Lease terms and
 conditions</header><text display-inline="no-display-inline">An oil or gas lease issued under this subtitle shall—</text> <paragraph id="HB4638167A1744E1FA3B80BC045F186FC"><enum>(1)</enum><text>provide for the payment of a royalty of not less than 12.5 percent in amount or value of the production removed or sold under the lease, as determined by the Secretary under the regulations applicable to other Federal oil and gas leases;</text>
 </paragraph><paragraph id="HE03CB52A1F0B4B23B4C7D8F3F405247F"><enum>(2)</enum><text display-inline="yes-display-inline">provide that the Secretary may close, on a seasonal basis, portions of the Coastal Plain to exploratory drilling activities as necessary to protect caribou calving areas and other species of fish and wildlife based on a preponderance of the best available scientific evidence that has been peer reviewed and obtained by following appropriate, documented scientific procedures, the results of which can be repeated using those same procedures;</text>
 </paragraph><paragraph id="H247071814A4540A2B0EF661290B366FB"><enum>(3)</enum><text>require that the lessee of land on the Coastal Plain shall be fully responsible and liable for the reclamation of land on the Coastal Plain and any other Federal land that is adversely affected in connection with exploration, development, production, or transportation activities conducted under the lease and on the Coastal Plain by the lessee or by any of the subcontractors or agents of the lessee;</text>
 </paragraph><paragraph id="H436EB2CA30CF4F01BBA4F7CE14FCB20A"><enum>(4)</enum><text>provide that the lessee may not delegate or convey, by contract or otherwise, the reclamation responsibility and liability to another person without the express written approval of the Secretary;</text>
 </paragraph><paragraph id="H73F74A75C0C84834B0C450D9E95EDBDA"><enum>(5)</enum><text>provide that the standard of reclamation for land required to be reclaimed under this subtitle shall be, as nearly as practicable, a condition capable of supporting the uses which the land was capable of supporting prior to any exploration, development, or production activities, or upon application by the lessee, to a higher or better use as certified by the Secretary;</text>
 </paragraph><paragraph id="HC66A155D08F347E69E1DEA96B2BB16F3"><enum>(6)</enum><text>contain terms and conditions relating to protection of fish and wildlife, the habitat of fish and wildlife, subsistence resources, and the environment as required under section 5003(a)(2);</text>
 </paragraph><paragraph id="H966DCE67598246FC860A8081E8D43D8E"><enum>(7)</enum><text>provide that the lessee, agents of the lessee, and contractors of the lessee use best efforts to provide a fair share, as determined by the level of obligation previously agreed to in the 1974 agreement implementing section 29 of the Federal Agreement and Grant of Right of Way for the Operation of the Trans-Alaska Pipeline, of employment and contracting for Alaska Natives and Alaska Native corporations from throughout the State; and</text>
 </paragraph><paragraph id="H1DAF3B2251D94736AA92BD860CAD9A33"><enum>(8)</enum><text>contain such other provisions as the Secretary determines necessary to ensure compliance with this subtitle and the regulations issued pursuant to this subtitle.</text>
					</paragraph></section><section id="HD75A4358295B49F89552AA836ECFD1FB"><enum>5007.</enum><header>Coastal Plain
			 environmental protection</header>
					<subsection id="H5A4CB6285F7A4C46B5AE2E5E73182DE0"><enum>(a)</enum><header>No significant
			 adverse effect standard To govern authorized Coastal Plain
 activities</header><text>The Secretary shall, consistent with the requirements of section 5003, administer this subtitle through regulations, lease terms, conditions, restrictions, prohibitions, stipulations, and other provisions that—</text>
 <paragraph id="H52669ABA69F94757873EEDB94E3B47BD"><enum>(1)</enum><text>ensure the oil and gas exploration, development, and production activities on the Coastal Plain shall not result in any significant adverse effect on fish and wildlife, the habitat of fish and wildlife, or the environment;</text>
 </paragraph><paragraph id="H12D98A8AAC644F3A86BFE0D63E7592DF"><enum>(2)</enum><text>require the application of the best commercially available technology for oil and gas exploration, development, and production on all new exploration, development, and production operations; and</text>
 </paragraph><paragraph id="HEEA321E89ED24C66A78F1A719C810E27"><enum>(3)</enum><text>ensure that the maximum amount of surface acreage covered by production and support facilities, including airstrips and any areas covered by gravel berms or piers for support of pipelines, does not exceed 10,000 acres on the Coastal Plain for each 100,000 acres of area leased.</text>
						</paragraph></subsection><subsection id="HEB1BD611535D4F1981ED5F0A236D15E3"><enum>(b)</enum><header>Site-Specific
 assessment and mitigation</header><text>With respect to any proposed drilling and related activities, the Secretary shall require that—</text>
 <paragraph id="H800019E2E25449FA856DAB981DE3676F"><enum>(1)</enum><text>a site-specific analysis be made of the probable effects, if any, that the drilling or related activities will have on fish and wildlife, the habitat of fish and wildlife, subsistence resources, and the environment;</text>
 </paragraph><paragraph id="HFFC284695E7E41BA9F52977729030DE1"><enum>(2)</enum><text>a plan be implemented to avoid, minimize, and mitigate (in that order and to the extent practicable) any significant adverse effect identified under paragraph (1); and</text>
 </paragraph><paragraph id="H7FF0DDBB12D249E2968AF982D1125B36"><enum>(3)</enum><text>the development of the plan shall occur after consultation with the agency or agencies having jurisdiction over matters mitigated by the plan.</text>
						</paragraph></subsection><subsection id="HDD3576DAC20043209A2A65DD6002275B"><enum>(c)</enum><header>Regulations To
			 Protect Coastal Plain Fish and Wildlife Resources, Subsistence Users, and
			 the
 Environment</header><text>Prior to implementing the leasing program authorized by this subtitle, the Secretary shall prepare and promulgate regulations, lease terms, conditions, restrictions, prohibitions, stipulations, and other measures designed to ensure that the activities undertaken on the Coastal Plain under this subtitle are conducted in a manner consistent with the purposes and environmental requirements of this subtitle.</text>
					</subsection><subsection id="H7253997DE1B44F36A6956DFBE8D84574"><enum>(d)</enum><header>Compliance with
 Federal and State environmental laws and other requirements</header><text>The proposed regulations, lease terms, conditions, restrictions, prohibitions, and stipulations for the leasing program under this subtitle shall require compliance with all applicable provisions of Federal and State environmental law and compliance with the following:</text>
 <paragraph id="H68A8B21DE1D64D3DAF5730D3A4789CEF"><enum>(1)</enum><text>Standards at least as effective as the safety and environmental mitigation measures set forth in items 1 through 29 at pages 167 through 169 of the document of the Department of the Interior entitled <quote>Final Legislative Environmental Impact Statement</quote> and dated April 1987 relating to the Coastal Plain.</text>
 </paragraph><paragraph id="H87C3523D6E42453DAED768BCFB414384"><enum>(2)</enum><text display-inline="yes-display-inline">Seasonal limitations on exploration, development, and related activities, where necessary, to avoid significant adverse effects during periods of concentrated fish and wildlife breeding, denning, nesting, spawning, and migration based on a preponderance of the best available scientific evidence that has been peer reviewed and obtained by following appropriate, documented scientific procedures, the results of which can be repeated using those same procedures.</text>
 </paragraph><paragraph id="H9C944B5A7DCF4415886B92CFBC9745FD"><enum>(3)</enum><text>That exploration activities, except for surface geological studies—</text>
 <subparagraph id="idC130993D91D34BFB8A4F2DD4C4B4A6A9"><enum>(A)</enum><text>be limited to the period between approximately November 1 and May 1 each year; and</text>
 </subparagraph><subparagraph id="id041DA88A9932482386A6745675F3EBB2"><enum>(B)</enum><text>be supported, if necessary, by ice roads, winter trails with adequate snow cover, ice pads, ice airstrips, and air transport methods, except that exploration activities may occur at other times if the Secretary finds that the exploration will have no significant adverse effect on the fish and wildlife, the habitat of fish and wildlife, and the environment of the Coastal Plain.</text>
 </subparagraph></paragraph><paragraph id="H67B1B429B4294A80BC4B703D4B667C96"><enum>(4)</enum><text>Design safety and construction standards for all pipelines and any access and service roads, that minimize, to the maximum extent practicable, adverse effects on—</text>
 <subparagraph id="H240110085F5543CB804AFCED37261316"><enum>(A)</enum><text>the passage of migratory species such as caribou; and</text>
 </subparagraph><subparagraph id="HB7589229F64B447991A6A58F3FBAFCCA"><enum>(B)</enum><text>the flow of surface water by requiring the use of culverts, bridges, and other structural devices.</text>
 </subparagraph></paragraph><paragraph id="H21FEE7B66A8247EE9F73761B2862BEFF"><enum>(5)</enum><text>Prohibitions on general public access and use on all pipeline access and service roads.</text>
 </paragraph><paragraph id="HCC97D745E8244639865F57C5C7DC2B55"><enum>(6)</enum><text>Stringent reclamation and rehabilitation requirements, consistent with the standards set forth in this subtitle, requiring the removal from the Coastal Plain of all oil and gas development and production facilities, structures, and equipment upon completion of oil and gas production operations, except that the Secretary may exempt from the requirements of this paragraph those facilities, structures, or equipment that the Secretary determines would assist in the management of the Arctic National Wildlife Refuge and that are donated to the United States for that purpose.</text>
 </paragraph><paragraph id="H310DE4FE719F4A798C7C1F0FA7A309E0"><enum>(7)</enum><text>Appropriate prohibitions or restrictions on access by all modes of transportation.</text>
 </paragraph><paragraph id="HFA6BD4A9EDB24FE88BBD039A52DA0B2A"><enum>(8)</enum><text>Appropriate prohibitions or restrictions on sand and gravel extraction.</text>
 </paragraph><paragraph id="H1D1CC541C9424EB0A6A95497CE171026"><enum>(9)</enum><text>Consolidation of facility siting.</text>
 </paragraph><paragraph id="H6F44EDEAD56F43B6B91A69566EB6CD22"><enum>(10)</enum><text>Appropriate prohibitions or restrictions on the use of explosives.</text>
 </paragraph><paragraph id="HB34D86E8159249A88E5AC5B944A6B160"><enum>(11)</enum><text>Avoidance, to the extent practicable, of springs, streams, and river systems, the protection of natural surface drainage patterns, wetlands, and riparian habitats, and the regulation of methods or techniques for developing or transporting adequate supplies of water for exploratory drilling.</text>
 </paragraph><paragraph id="HB5A63F6AF2BF4E9185DB6C75871D0CA2"><enum>(12)</enum><text>Avoidance or minimization of air traffic-related disturbance to fish and wildlife.</text>
 </paragraph><paragraph id="HCFA38F5804D74163B9AB70FFDC90DF2D"><enum>(13)</enum><text>Treatment and disposal of hazardous and toxic wastes, solid wastes, reserve pit fluids, drilling muds and cuttings, and domestic wastewater, including an annual waste management report, a hazardous materials tracking system, and a prohibition on chlorinated solvents, in accordance with applicable Federal and State environmental law (including regulations).</text>
 </paragraph><paragraph id="HFA52EDEE62CB4900BFB93C53C4BCC4CF"><enum>(14)</enum><text>Fuel storage and oil spill contingency planning.</text>
 </paragraph><paragraph id="H80659B9F8A7446B0A4F12939A36BDFEF"><enum>(15)</enum><text>Research, monitoring, and reporting requirements.</text>
 </paragraph><paragraph id="HE6743F4B1D3F4036B179BBCCE5E9BDBF"><enum>(16)</enum><text>Field crew environmental briefings.</text>
 </paragraph><paragraph id="H736F0FE774C344EE9B67F15F24099ACE"><enum>(17)</enum><text>Avoidance of significant adverse effects upon subsistence hunting, fishing, and trapping by subsistence users.</text>
 </paragraph><paragraph id="H0C21FEFD9F1247F481B3C2DA4A15DDA5"><enum>(18)</enum><text>Compliance with applicable air and water quality standards.</text>
 </paragraph><paragraph id="HC64E2AAEC33D4809BE48C5CBA4E68C22"><enum>(19)</enum><text>Appropriate seasonal and safety zone designations around well sites, within which subsistence hunting and trapping shall be limited.</text>
 </paragraph><paragraph id="H680560504704459EA3CE169AB34F6282"><enum>(20)</enum><text>Reasonable stipulations for protection of cultural and archeological resources.</text>
 </paragraph><paragraph id="H3A64C227FBC04BBE883A10E8A7932175"><enum>(21)</enum><text>All other protective environmental stipulations, restrictions, terms, and conditions determined necessary by the Secretary.</text>
 </paragraph></subsection><subsection id="HC4CA4BA07B1042EE9D2C83A345100B30"><enum>(e)</enum><header>Considerations</header><text>In preparing and promulgating regulations, lease terms, conditions, restrictions, prohibitions, and stipulations under this section, the Secretary shall consider—</text>
 <paragraph id="HE4EBDE875EF64DCDBED5B58644458B58"><enum>(1)</enum><text>the stipulations and conditions that govern the National Petroleum Reserve-Alaska leasing program, as set forth in the 1999 Northeast National Petroleum Reserve-Alaska Final Integrated Activity Plan/Environmental Impact Statement;</text>
 </paragraph><paragraph id="HB64F1BD0EAC841D9B1BED5B35ED2C734"><enum>(2)</enum><text>the environmental protection standards that governed the initial Coastal Plain seismic exploration program under parts 37.31 to 37.33 of title 50, Code of Federal Regulations; and</text>
 </paragraph><paragraph id="HE93D0634E43A410F8E9748A629515B37"><enum>(3)</enum><text>the land use stipulations for exploratory drilling on the KIC–ASRC private land that are set forth in appendix 2 of the August 9, 1983, agreement between Arctic Slope Regional Corporation and the United States.</text>
						</paragraph></subsection><subsection id="H8133B1D0795E4E9AB2467CE3671ED906"><enum>(f)</enum><header>Facility
			 consolidation planning</header>
						<paragraph id="H6193857042664CEEA297E5C7C453722B"><enum>(1)</enum><header>In
 general</header><text>The Secretary shall, after providing for public notice and comment, prepare and update periodically a plan to govern, guide, and direct the siting and construction of facilities for the exploration, development, production, and transportation of Coastal Plain oil and gas resources.</text>
 </paragraph><paragraph id="H102DC6EC58CD4ABCACDCE15A9D0FB757"><enum>(2)</enum><header>Objectives</header><text>The plan shall have the following objectives:</text>
 <subparagraph id="H1C6308F37B02400C83EDBDD7EFB0549B"><enum>(A)</enum><text>Avoiding unnecessary duplication of facilities and activities.</text>
 </subparagraph><subparagraph id="HF0A049A13E3D4F028963BF88850C4BBF"><enum>(B)</enum><text>Encouraging consolidation of common facilities and activities.</text>
 </subparagraph><subparagraph id="H1BB3618984CC4B3EB88B30DFC36194D2"><enum>(C)</enum><text>Locating or confining facilities and activities to areas that will minimize impact on fish and wildlife, the habitat of fish and wildlife, and the environment.</text>
 </subparagraph><subparagraph id="H8EE39787AA8F42368DC29B169DC1DE83"><enum>(D)</enum><text>Using existing facilities wherever practicable.</text>
 </subparagraph><subparagraph id="HE582BF95375E451BAC177087759F094C"><enum>(E)</enum><text>Enhancing compatibility between wildlife values and development activities.</text>
							</subparagraph></paragraph></subsection><subsection id="H790E030EE7F849DDB67863DD45272DCC"><enum>(g)</enum><header>Access to public
 land</header><text>The Secretary shall—</text> <paragraph id="HDC88A4D77F9E4E5B812D5C0375E8459B"><enum>(1)</enum><text>manage public land in the Coastal Plain subject to section 811 of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3121">16 U.S.C. 3121</external-xref>); and</text>
 </paragraph><paragraph id="H41FCA1E97C9F446CBD336C008608AAFC"><enum>(2)</enum><text>ensure that local residents shall have reasonable access to public land in the Coastal Plain for traditional uses.</text>
						</paragraph></subsection></section><section id="H4CD80077515849A9892B2F2B17E80D4C"><enum>5008.</enum><header>Expedited
			 judicial review</header>
					<subsection id="H1D7ABD7D972440E5B7399D7DAAA49310"><enum>(a)</enum><header>Filing of
			 complaint</header>
 <paragraph id="HFE55CD9B7FBD415F8ED468BFDCEEB874"><enum>(1)</enum><header>Deadline</header><text>Subject to paragraph (2), any complaint seeking judicial review of—</text>
 <subparagraph id="HF21A3EC827A0488EAF308E47C315CC5A"><enum>(A)</enum><text display-inline="yes-display-inline">any provision of this subtitle shall be filed by not later than 1 year after the date of enactment of this Act; or</text>
 </subparagraph><subparagraph id="HFE6EE489F6D240A287BA6B27EBAAF293"><enum>(B)</enum><text>any action of the Secretary under this subtitle shall be filed—</text>
 <clause id="H5DE24411B3E94F229DE3C8C5A8081FA3"><enum>(i)</enum><text>except as provided in clause (ii), during the 90-day period beginning on the date on which the action is challenged; or</text>
 </clause><clause id="H1E7808B384E7443C8E9C63954603BA54"><enum>(ii)</enum><text>in the case of a complaint based solely on grounds arising after the period described in clause (i), not later than 90 days after the date on which the complainant knew or reasonably should have known of the grounds for the complaint.</text>
 </clause></subparagraph></paragraph><paragraph id="H7E5D6ECE797049ECBC99804A4AEF895F"><enum>(2)</enum><header>Venue</header><text>Any complaint seeking judicial review of any provision of this subtitle or any action of the Secretary under this subtitle may be filed only in the United States Court of Appeals for the District of Columbia.</text>
						</paragraph><paragraph id="H27E4EE60295148B59DFA107E16700503"><enum>(3)</enum><header>Limitation on
			 scope of certain review</header>
 <subparagraph id="idF5B7DA936BCF4C1EA6424424F51546CA"><enum>(A)</enum><header>In general</header><text>Judicial review of a decision by the Secretary to conduct a lease sale under this subtitle, including an environmental analysis, shall be—</text>
 <clause id="idD4AB6AFA2020415994B6164B64675000"><enum>(i)</enum><text>limited to whether the Secretary has complied with this subtitle; and</text>
 </clause><clause id="id644A6064468241BAB4BB614E43C9ED28"><enum>(ii)</enum><text>based on the administrative record of that decision.</text> </clause></subparagraph><subparagraph id="id50B6EAC32C114E5DB376743F4D74343C"><enum>(B)</enum><header>Presumption</header><text>The identification by the Secretary of a preferred course of action to enable leasing to proceed and the analysis by the Secretary of environmental effects under this subtitle is presumed to be correct unless shown otherwise by clear and convincing evidence.</text>
							</subparagraph></paragraph></subsection><subsection id="HF799C5B5A635430AAF00B6751CB54314"><enum>(b)</enum><header>Limitation on
 other review</header><text>Actions of the Secretary with respect to which review could have been obtained under this section shall not be subject to judicial review in any civil or criminal proceeding for enforcement.</text>
					</subsection><subsection id="H1B68753268484AC991108712A2F09C05"><enum>(c)</enum><header>Limitation on
			 attorneys’ fees and court costs</header>
 <paragraph id="id26001AE780F3420082B2DBCC347928F9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Sections 504 of title 5 and 2412 of title 28, United States Code (commonly known as the <quote>Equal Access to Justice Act</quote>), shall not apply to any action under this subtitle.</text>
 </paragraph><paragraph id="id236F2413E25047A29F66BDD0BA74409E"><enum>(2)</enum><header>Court costs</header><text display-inline="yes-display-inline">A party to any action under this subtitle shall not receive payment from the Federal Government for the attorneys’ fees, expenses, or other court costs incurred by the party.</text>
						</paragraph></subsection></section><section id="HF5DF7546CA324C608ADD3CCEFAEF58E6"><enum>5009.</enum><header>Rights-of-way
			 across the Coastal Plain</header>
					<subsection id="HEAB9508D6D27470AB7D7852293A80570"><enum>(a)</enum><header>In
 general</header><text>The Secretary shall issue rights-of-way and easements across the Coastal Plain for the transportation of oil and gas produced under leases under this subtitle—</text>
 <paragraph id="HDA0E025D03EB4055BD62826B5CBA035E"><enum>(1)</enum><text>except as provided in paragraph (2), under section 28 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/185">30 U.S.C. 185</external-xref>), without regard to title XI of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3161">16 U.S.C. 3161 et seq.</external-xref>); and</text>
 </paragraph><paragraph id="H664AA76E63E546C5B075D9B95478A8EA"><enum>(2)</enum><text>under title XI of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/30/3161">30 U.S.C. 3161 et seq.</external-xref>), for access authorized by sections 1110 and 1111 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3170">16 U.S.C. 3170</external-xref>, 3171).</text>
						</paragraph></subsection><subsection id="H2063209C7D884BEB8A12A8C07730A713"><enum>(b)</enum><header>Terms and
 conditions</header><text>The Secretary shall include in any right-of-way or easement issued under subsection (a) such terms and conditions as may be necessary to ensure that transportation of oil and gas does not result in a significant adverse effect on the fish and wildlife, the habitat of fish and wildlife, subsistence resources, or the environment of the Coastal Plain, including requirements that facilities be sited or designed so as to avoid unnecessary duplication of roads and pipelines.</text>
 </subsection><subsection id="HB380D326112C412EA8B114CC2C128481"><enum>(c)</enum><header>Regulations</header><text>The Secretary shall include in regulations promulgated under section 5003(g) provisions granting rights-of-way and easements described in subsection (a).</text>
 </subsection></section><section id="HBBA175A384BB4584939EEBD11FB06190"><enum>5010.</enum><header>Conveyance</header><text display-inline="no-display-inline">In order to maximize Federal revenues by removing clouds on titles to land and clarifying land ownership patterns on the Coastal Plain, and notwithstanding section 1302(h)(2) of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3192">16 U.S.C. 3192(h)(2)</external-xref>), the Secretary shall convey—</text>
 <paragraph id="HA3779FC01FB24C978D6C7CCEF97113A2"><enum>(1)</enum><text>to the Kaktovik Inupiat Corporation, the surface estate of the land described in paragraph 1 of Public Land Order 6959, to the extent necessary to fulfill the entitlement of the Kaktovik Inupiat Corporation under sections 12 and 14 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1611">43 U.S.C. 1611</external-xref>, 1613) in accordance with the terms and conditions of the Agreement between the Department of the Interior, the United States Fish and Wildlife Service, the Bureau of Land Management, and the Kaktovik Inupiat Corporation dated January 22, 1993; and</text>
 </paragraph><paragraph id="HEBEABD25FEFD46AE8977E0171522DB3E"><enum>(2)</enum><text>to the Arctic Slope Regional Corporation the remaining subsurface estate to which the Arctic Slope Regional Corporation is entitled pursuant to the August 9, 1983, agreement between the Arctic Slope Regional Corporation and the United States of America.</text>
					</paragraph></section></subtitle><subtitle id="id95C9373F916D48B0B01F0179371838F3" style="OLC"><enum>B</enum><header>Native American Energy</header>
 <section id="H6ACD106DB42E478B878A26EECD2234EA"><enum>5021.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="id9E58A97438C5458AB8159E4F04071F34"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal Government has unreasonably interfered with the efforts of Indian tribes to develop energy resources on tribal land; and</text>
 </paragraph><paragraph id="id4530C732E20F45B7A3E16A2CFEED2365"><enum>(2)</enum><text display-inline="yes-display-inline">Indian tribes should have the opportunity to gain the benefits of the jobs, investment, and economic development to be gained from energy development.</text>
					</paragraph></section><section id="id1DFB69C12179406E8C72C23D0E14BD5C"><enum>5022.</enum><header>Appraisals</header>
 <subsection id="HBC80EDE451E14AB2B5644C8D14E794D2"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Title XXVI of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H3FA6EE0CEE8B4A18BC31F8CF405FA251" style="OLC"> <section id="HA0EBB891DE894A3EAE81EC135BFA6CD1"><enum>2607.</enum><header>Appraisal reforms</header> <subsection id="H5317C38E28184414B2C46ACB0C7E52D7"><enum>(a)</enum><header>Options to Indian Tribes</header><text>With respect to a transaction involving Indian land or the trust assets of an Indian tribe that requires the approval of the Secretary, any appraisal or other estimates of value relating to fair market value required to be conducted under applicable law, regulation, or policy may be completed by—</text>
 <paragraph id="H7EBC5761273C49B8B5EFA23FB34F92F7"><enum>(1)</enum><text>the Secretary;</text> </paragraph><paragraph id="HAAB3C918B5F948559A413B0CA4AD38EA"><enum>(2)</enum><text>the affected Indian tribe; or</text>
 </paragraph><paragraph id="HC69794E3607544258F7DF58C674096A9"><enum>(3)</enum><text>a certified, third-party appraiser pursuant to a contract with the Indian tribe.</text> </paragraph></subsection><subsection id="HBB078A2895324D5DBA9D3CF8683F7522"><enum>(b)</enum><header>Time Limit on Secretarial Review and Action</header><text>Not later than 30 days after the date on which the Secretary receives an appraisal conducted by or for an Indian tribe pursuant to paragraphs (2) or (3) of subsection (a), the Secretary shall—</text>
 <paragraph id="HC2371D968FE84CFB9AD9FA41A7CB128D"><enum>(1)</enum><text>review the appraisal; and</text> </paragraph><paragraph id="HCF031023DCEF4139A5C4EB49AF6E7F9A"><enum>(2)</enum><text>provide to the Indian tribe a written notice of approval or disapproval of the appraisal.</text>
 </paragraph></subsection><subsection id="H2604154C625D4C7B815BCFD5E038CD9F"><enum>(c)</enum><header>Failure of Secretary To Approve or Disapprove</header><text>If the Secretary has failed to approve or disapprove any appraisal by the date that is 60 days after the date on which the appraisal is received, the appraisal shall be deemed approved.</text>
 </subsection><subsection id="H68686555285C4FAA86EBF9DE864E12EA"><enum>(d)</enum><header>Option of Indian Tribes To Waive Appraisal</header><text>An Indian tribe may waive the requirements of subsection (a) if the Indian tribe provides to the Secretary a written resolution, statement, or other unambiguous indication of tribal intent to waive the requirements that—</text>
 <paragraph id="id99FFADFF0A33452EB9FFC77FF8020581"><enum>(1)</enum><text>is duly approved by the governing body of the Indian tribe; and</text> </paragraph><paragraph id="id335CAAEBDFDE4F2693029471428D3771"><enum>(2)</enum><text>includes an express waiver by the Indian tribe of any claims for damages the Indian tribe might have against the United States as a result of the waiver.</text>
 </paragraph></subsection><subsection id="H2100EFAAF2EA4D4D96323F7B818C2C4C"><enum>(e)</enum><header>Regulations</header><text>The Secretary shall promulgate regulations to implement this section, including standards the Secretary shall use for approving or disapproving an appraisal under subsection (b).</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block>
 </subsection><subsection id="HD2FCE62FC9E54CDBB5B9B09CB8FAEFBA"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13201">42 U.S.C. 13201</external-xref> note) is amended by adding at the end of the items relating to title XXVI the following:</text> <quoted-block display-inline="no-display-inline" id="H043A475C3551424886B37F26E9580DC0" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 2607. Appraisal reforms.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="HE66A1A0A41614A2A8723A7F0BDA1F1F1"><enum>5023.</enum><header>Standardization</header><text display-inline="no-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary of the Interior shall implement procedures to ensure that each agency within the Department of the Interior that is involved in the review, approval, and oversight of oil and gas activities on Indian land shall use a uniform system of reference numbers and tracking systems for oil and gas wells.</text>
 </section><section display-inline="no-display-inline" id="HFA07147D33FF4BAD85AB1598E139EB8C"><enum>5024.</enum><header>Environmental reviews of major Federal actions on Indian land</header><text display-inline="no-display-inline">Section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>) is amended—</text> <paragraph display-inline="no-display-inline" id="id6F188163494947B88D3B6485CA4939EF"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1) by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>The Congress authorizes</quote>; and</text>
 </paragraph><paragraph display-inline="no-display-inline" id="idD8B4C9F898454B54A3E334EEB9A3B05A"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block id="H9A24866D919B4486B088E933EE57F6EA" style="OLC"> <subsection id="HB4F6984E20894A07BBDE9D69CA9953C6"><enum>(b)</enum><header>Review of major Federal actions on Indian land</header> <paragraph id="H54F14EE227B54AEAB2B8158E2FBEDD85"><enum>(1)</enum><header>Definitions of Indian land and Indian tribe</header><text>In this subsection, the terms <term>Indian land</term> and <term>Indian tribe</term> have the meaning given those terms in section 2601 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501</external-xref>).</text>
 </paragraph><paragraph id="id7CEDE5C0217F4E2789B2EC28259C2309"><enum>(2)</enum><header>In general</header><text>For any major Federal action on Indian land of an Indian tribe requiring the preparation of a statement under subsection (a)(2)(C), the statement shall only be available for review and comment by—</text>
 <subparagraph id="id050CD0F9BBFE435FADEA7106EBD2AF96"><enum>(A)</enum><text>the members of the Indian tribe; and</text> </subparagraph><subparagraph id="id8368880C1BE54829AED04D3175513BCB"><enum>(B)</enum><text>any other individual residing within the affected area.</text>
 </subparagraph></paragraph><paragraph id="H3E8D5122997142749E66EF28BA0F8302"><enum>(3)</enum><header>Regulations</header><text>The Chairman of the Council on Environmental Quality, in consultation with Indian tribes, shall develop regulations to implement this section, including descriptions of affected areas for specific major Federal actions.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section commented="no" id="HBF3E2BAC36744BD8B48C3905446BFFC5"><enum>5025.</enum><header>Judicial review</header>
 <subsection commented="no" id="H4109F60313FB4E1FAF45030F06A1058C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" id="H542CFBA3EE2042EA9CD1F0DC7ACA2987"><enum>(1)</enum><header>Agency action</header><text>The term <term>agency action</term> has the meaning given the term in section 551 of title 5, United States Code.</text>
 </paragraph><paragraph commented="no" id="HB2FD8F4DE16146CDAE53D95046CBFF9F"><enum>(2)</enum><header>Energy-related action</header><text>The term <term>energy-related action</term> means a civil action that—</text> <subparagraph commented="no" id="H9A91D860FB2D4954990C52EFC98654D0"><enum>(A)</enum><text>is filed on or after the date of enactment of this Act; and</text>
 </subparagraph><subparagraph commented="no" id="HB6E21CEC9A974B6E844168DD2CA12AC1"><enum>(B)</enum><text>seeks judicial review of a final agency action relating to the issuance of a permit, license, or other form of agency permission allowing—</text>
 <clause commented="no" id="H34CE78872A1F40248149EC5901E3505A"><enum>(i)</enum><text>any person or entity to conduct on Indian land activities involving the exploration, development, production, or transportation of oil, gas, coal, shale gas, oil shale, geothermal resources, wind or solar resources, underground coal gasification, biomass, or the generation of electricity; or</text>
 </clause><clause commented="no" id="H405577944A644BA4A4212C9FD196881C"><enum>(ii)</enum><text>any Indian tribe, or any organization of 2 or more entities, not less than 1 of which is an Indian tribe, to conduct activities involving the exploration, development, production, or transportation of oil, gas, coal, shale gas, oil shale, geothermal resources, wind or solar resources, underground coal gasification, biomass, or the generation of electricity, regardless of where such activities are undertaken.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" id="HE52E92D23945422D9F3CAB8779CFA959"><enum>(3)</enum><header>Indian land</header>
 <subparagraph commented="no" id="idF0820D53A4C34F6994AF265A813AA967"><enum>(A)</enum><header>In general</header><text>The term <term>Indian land</term> has the meaning given the term in section 2601 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501</external-xref>).</text> </subparagraph><subparagraph commented="no" id="idE913B0E5DD4D4D7B9156A396FE2A4E3A"><enum>(B)</enum><header>Inclusion</header><text>The term <term>Indian land</term> includes land owned by a Native Corporation (as that term is defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)) under that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>).</text>
							</subparagraph></paragraph><paragraph commented="no" id="H5EDDF2436BDF495884E1C31C941C9C75"><enum>(4)</enum><header>Ultimately prevail</header>
 <subparagraph commented="no" id="id222358C2BE2143AAA1441308B30781B2"><enum>(A)</enum><header>In general</header><text>The term <term>ultimately prevail</term> means, in a final enforceable judgment that the court rules in the party’s favor on at least 1 civil claim that is an underlying rationale for the preliminary injunction, administrative stay, or other relief requested by the party.</text>
 </subparagraph><subparagraph commented="no" id="idF971165A14F448EEB743C2A7A7C83AF6"><enum>(B)</enum><header>Exclusion</header><text>The term <term>ultimately prevail</term> does not include circumstances in which the final agency action is modified or amended by the issuing agency unless the modification or amendment is required pursuant to a final enforceable judgment of the court or a court-ordered consent decree.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2948269CE33B4C299F2AED28695AB3AB"><enum>(b)</enum><header display-inline="yes-display-inline">Time for filing complaint</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id586346EEB0BF4010BEBA3BDC34538163"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any energy related action shall be filed not later than the end of the 60-day period beginning on the date of the action or decision by a Federal official that constitutes the covered energy project concerned.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6258E5B1D1D4485B8FC7B96ACFAD0610"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">Any energy related action that is not filed within the time period described in paragraph (1) shall be barred.</text>
 </paragraph></subsection><subsection commented="no" id="HCB741CA0C216489D9DBFE643272523E9"><enum>(c)</enum><header>District court venue and deadline</header><text>An energy related action—</text> <paragraph commented="no" id="H113B9B91E7B94C2F9BFD02AB7CD5A71A"><enum>(1)</enum><text>may only be brought in the United States District Court for the District of Columbia; and</text>
 </paragraph><paragraph commented="no" id="H9084A65DD0B6454FADDDFC64CE38A0C1"><enum>(2)</enum><text>shall be resolved as expeditiously as possible, and in any event not more than 180 days after the energy related action is filed.</text>
 </paragraph></subsection><subsection commented="no" id="HF360F50EDB9B4296A7621A29DBDDEAFD"><enum>(d)</enum><header>Appellate review</header><text>An interlocutory order or final judgment, decree or order of the district court in an energy related action—</text>
 <paragraph commented="no" id="id5BDCBEB75A3440A49D77D17B5987891F"><enum>(1)</enum><text>may be appealed to the United States Court of Appeals for the District of Columbia Circuit; and</text> </paragraph><paragraph commented="no" id="idF58C5D5C0CD1406B8E0E2F9B1EFEAFA3"><enum>(2)</enum><text>if the court described in paragraph (1) undertakes the review, the court shall resolve the review as expeditiously as possible, and in any event by not later than 180 days after the interlocutory order or final judgment, decree or order of the district court was issued.</text>
 </paragraph></subsection><subsection commented="no" id="H910C2AC4E3BB40B093F0E5697965C4D2"><enum>(e)</enum><header>Limitation on certain payments</header><text>Notwithstanding section 1304 of title 31, United States Code, no award may be made under section 504 of title 5, United States Code, or under section 2412 of title 28, United States Code, and no amounts may be obligated or expended from the Claims and Judgment Fund of the United States Treasury to pay any fees or other expenses under such sections, to any person or party in an energy related action.</text>
					</subsection><subsection commented="no" id="HBDF3C3706E1B430D904B5B3DA213980B"><enum>(f)</enum><header>Limitation on attorneys' fees and court costs</header>
 <paragraph id="id2AAF1244537446FEA2D4AAB189703094"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Sections 504 of title 5 and 2412 of title 28, United States Code (commonly known as the <quote>Equal Access to Justice Act</quote>), shall not apply to an energy related action.</text>
 </paragraph><paragraph id="idB3CFDC93A7004B96BC5BEB03B5A97A63"><enum>(2)</enum><header>Court costs</header><text display-inline="yes-display-inline">A party to a covered civil action shall not receive payment from the Federal Government for the attorneys’ fees, expenses, or other court costs incurred by the party.</text>
 </paragraph></subsection></section><section id="HFE8AB39B29DC469386AD87457FA26917"><enum>5026.</enum><header>Tribal resource management plans</header><text display-inline="no-display-inline">Unless otherwise explicitly exempted by Federal law enacted after the date of enactment of this Act, any activity conducted or resources harvested or produced pursuant to a tribal resource management plan or an integrated resource management plan approved by the Secretary of the Interior under the National Indian Forest Resources Management Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3101">25 U.S.C. 3101 et seq.</external-xref>) or the American Indian Agricultural Resource Management Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3701">25 U.S.C. 3701 et seq.</external-xref>), shall be considered a sustainable management practice for purposes of any Federal standard, benefit, or requirement that requires a demonstration of such sustainability.</text>
 </section><section commented="no" id="H5AAADF0FC9724F028529456C711590F8"><enum>5027.</enum><header>Leases of restricted lands for the Navajo Nation</header><text display-inline="no-display-inline">Subsection (e)(1) of the first section of the Act of August 9, 1955 (<external-xref legal-doc="usc" parsable-cite="usc/25/415">25 U.S.C. 415</external-xref>) (commonly known as the <quote>Long-Term Leasing Act</quote>), is amended—</text> <paragraph commented="no" id="H0D6690E86E004916B1321CA5E9D38836"><enum>(1)</enum><text>by striking <quote>, except a lease for</quote> and inserting <quote>, including leases for</quote>;</text>
 </paragraph><paragraph commented="no" id="H3FC80834ED904F78AA44392CD658F532"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>25 years, except</quote> and all that follows through <quote>; and</quote> and inserting <quote>99 years;</quote>;</text> </paragraph><paragraph commented="no" id="H85D83565FFCC4D57A31508F483743632"><enum>(3)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph commented="no" id="HCFD9B066A2B7427DBEF539F43A7B6923"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H962D732DFF6A408BACE5C2C350B694B2" style="OLC"> <subparagraph commented="no" id="H95D4B5FEF35D46DBAEA95C9F3F426CB3" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a lease for the exploration, development, or extraction of mineral resources, including geothermal resources, 25 years, except that the lease may include an option to renew for 1 additional term not to exceed 25 years.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="H8E9ABFC039F04FE394FD2296751FB0CB" section-type="subsequent-section"><enum>5028.</enum><header>Nonapplicability of certain rules</header><text display-inline="no-display-inline">No rule promulgated by the Secretary of the Interior regarding hydraulic fracturing used in the development or production of oil or gas resources shall affect any land held in trust or restricted status for the benefit of Indians except with the express consent of the beneficiary on behalf of which the land is held in trust or restricted status.</text>
				</section></subtitle><subtitle id="id9B957CEB16444FA0A10AE21745369E41" style="OLC"><enum>C</enum><header>Additional regulatory provisions</header>
				<part id="id9D29ABBE6DF0498899C32DCB83F10CDC" style="OLC"><enum>I</enum><header>State authority over hydraulic fracturing</header>
 <section commented="no" id="id287749513c5645db86836d86a20f565f"><enum>5031.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that given variations in geology, land use, and population, the States are best placed to regulate the process of hydraulic fracturing occurring on any land within the boundaries of the individual State.</text>
					</section><section commented="no" id="idFD8528C19FE44C27B268EFC664E646E3"><enum>5032.</enum><header>State
			 authority</header>
						<subsection commented="no" id="id4617AA1C870440F188A3FE377AD859FB"><enum>(a)</enum><header>Definition of
 Federal land</header><text display-inline="yes-display-inline">In this section, the term <term>Federal land</term> means—</text>
 <paragraph commented="no" id="id703d7b3172284a4db1f930c9a405d28a"><enum>(1)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>));</text>
 </paragraph><paragraph commented="no" id="id09c56371e7914df7b77a9af0c43d9345"><enum>(2)</enum><text>National Forest System land;</text>
 </paragraph><paragraph commented="no" id="idcf4c00d643194cdf8344e3a9ab045874"><enum>(3)</enum><text>land under the jurisdiction of the Bureau of Reclamation; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide436a19a40b041429880f02e8ca54e36"><enum>(4)</enum><text>land under the jurisdiction of the Corps of Engineers.</text>
							</paragraph></subsection><subsection id="ide7276c6a144f4b819dcec671323ffcf3"><enum>(b)</enum><header>State authority</header>
							<paragraph id="id4a0e854d4c12460aa5a829b5b315f73f"><enum>(1)</enum><header>In
 general</header><text>Notwithstanding any other provision of law, a State shall have the sole authority to promulgate or enforce any regulation, guidance, or permit requirement regarding the treatment of a well by the application of fluids under pressure to which propping agents may be added for the expressly designed purpose of initiating or propagating fractures in a target geologic formation in order to enhance production of oil, natural gas, or geothermal production activities on or under any land within the boundaries of the State.</text>
							</paragraph><paragraph id="idad8e0e1c5cce434998d4a39719443c92"><enum>(2)</enum><header>Federal
 land</header><text>Notwithstanding any other provision of law, the treatment of a well by the application of fluids under pressure to which propping agents may be added for the expressly designed purpose of initiating or propagating fractures in a target geologic formation in order to enhance production of oil, natural gas, or geothermal production activities on Federal land shall be subject to the law of the State in which the land is located.</text>
							</paragraph></subsection></section></part><part id="id40C382B0A521411EA39B9E93477B30E6" style="OLC"><enum>II</enum><header>Miscellaneous provisions</header>
					<section id="idE93809A5B84843E98F79E1C3E7249268"><enum>5041.</enum><header>Environmental
 legal fees</header><text display-inline="no-display-inline">Section 504 of title 5, United States Code, is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idEB22B3340D7B4A4693AA5E2B26D64E74" style="OLC">
							<subsection id="id2EAF6BC4F0D44077BA7DA9CDB0A303C6"><enum>(g)</enum><header>Environmental
 legal fees</header><text>Notwithstanding section 1304 of title 31, no award may be made under this section and no amounts may be obligated or expended from the Claims and Judgment Fund of the Treasury to pay any legal fees of a nongovernmental organization related to an action that (with respect to the United States)—</text>
 <paragraph id="idE6C48EE4860B4A22BFE77F2614D21DA0"><enum>(1)</enum><text>prevents, terminates, or reduces access to or the production of—</text>
 <subparagraph id="id0096804DB91B4E79896294883544D67B"><enum>(A)</enum><text>energy;</text> </subparagraph><subparagraph id="id65317F7CA1DD49438F64D0D2302418D4"><enum>(B)</enum><text>a mineral resource;</text>
 </subparagraph><subparagraph id="id5C6BB2293A47448AA42002FD7FA4DED5"><enum>(C)</enum><text>water by agricultural producers;</text>
 </subparagraph><subparagraph id="id79BC53E9904B467AA84FBFD25CF54FD3"><enum>(D)</enum><text>a resource by commercial or recreational fishermen; or</text>
 </subparagraph><subparagraph id="ID7dcae786e5bf4ee894414732ccd64d2f"><enum>(E)</enum><text>grazing or timber production on Federal land;</text>
 </subparagraph></paragraph><paragraph id="id4DA95F3C2A76414F9DC81C241CB77446"><enum>(2)</enum><text>diminishes the private property value of a property owner; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id807FA8E3AFE147408A6BA993FCF50062"><enum>(3)</enum><text>eliminates or prevents 1 or more jobs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</section><section id="id3C42AF15606245D1BC93A6B3F8E6D683"><enum>5042.</enum><header>Master leasing
			 plans</header>
						<subsection id="idEA6ED528591942048BEE43164782F1CE"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of the Interior, acting through the Bureau of Land Management, shall not establish a master leasing plan as part of any guidance issued by the Secretary.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id30AABDE7FDDF4D59BD55F5DA61B3997F"><enum>(b)</enum><header>Existing master
 leasing plans</header><text>Instruction Memorandum No. 2010–117 and any other master leasing plan described in subsection (a) issued on or before the date of enactment of this Act shall have no force or effect.</text>
						</subsection></section></part></subtitle></title><title id="id5B09CBF6C30346E1BD78FA1144B2E461" style="OLC"><enum>VI</enum><header>Improving America's domestic refining capacity</header>
			<subtitle id="id8DF73099F4EE411EA04EB508D6AF23C4" style="OLC"><enum>A</enum><header>Refinery permitting reform</header>
 <section id="idA5F39A2929A6423EBE86645E35D287F7"><enum>6001.</enum><header>Finding</header><text display-inline="no-display-inline">Congress finds that the domestic refining industry is an important source of jobs and economic growth and whose growth should not be limited by an excessively drawn out permitting and approval process.</text>
 </section><section id="id4cc0d0cd85d944219ac2424f100533ca"><enum>6002.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="id221f6e452ca0446d9b4e5132f412d851"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text>
 </paragraph><paragraph id="idbb17cae5787047e8a84e6c4e50e2276b"><enum>(2)</enum><header>Expansion</header><text>The term <term>expansion</term> means a physical change that results in an increase in the capacity of a refinery.</text> </paragraph><paragraph id="id2e83d3b655534bdb9e71826644332fb7"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text>
 </paragraph><paragraph id="id5861a3b41dd84287a520024edfb3dee2"><enum>(4)</enum><header>Permit</header><text>The term <term>permit</term> means any permit, license, approval, variance, or other form of authorization that a refiner is required to obtain—</text>
 <subparagraph id="idbb668ad7a12d4d2f880ee76d20816b7a"><enum>(A)</enum><text>under any Federal law; or</text> </subparagraph><subparagraph id="id6deef931c0c34e259d4fd1e5edbb9d98"><enum>(B)</enum><text>from a State or tribal government agency delegated authority by the Federal Government, or authorized under Federal law, to issue permits.</text>
 </subparagraph></paragraph><paragraph id="id0e0cf76fdea4405d9ced7eb5de6ae558"><enum>(5)</enum><header>Refiner</header><text>The term <term>refiner</term> means a person that—</text> <subparagraph id="idef4ad33796ff4ecc9120ff2b69cd6674"><enum>(A)</enum><text>owns or operates a refinery; or</text>
 </subparagraph><subparagraph id="id1b4464c8339149538c47230e8e9a8cf3"><enum>(B)</enum><text>seeks to become an owner or operator of a refinery.</text> </subparagraph></paragraph><paragraph id="ida97e2befa13443eebb3a5c8a6b615cd3"><enum>(6)</enum><header>Refinery</header> <subparagraph id="idcc01d3905a8d462bb9a61e6bc4a1ae44"><enum>(A)</enum><header>In general</header><text>The term <term>refinery</term> means—</text>
 <clause id="id7b43fc574168420087a773d3befe94e9"><enum>(i)</enum><text>a facility at which crude oil is refined into transportation fuel or other petroleum products; and</text> </clause><clause id="idd9967b8f8add4ceb974414a625407832"><enum>(ii)</enum><text>a coal liquification or coal-to-liquid facility at which coal is processed into synthetic crude oil or any other fuel.</text>
 </clause></subparagraph><subparagraph id="id6ba9aaa419de49acac09fc5c1412dbb9"><enum>(B)</enum><header>Inclusion</header><text>The term <term>refinery</term> includes an expansion of a refinery.</text> </subparagraph></paragraph><paragraph id="ide7c6a2225abe403295a17e21f2f2f6f3"><enum>(7)</enum><header>Refinery permitting agreement</header><text>The term <term>refinery permitting agreement</term> means an agreement entered into between the Administrator and a State or Indian tribe under subsection (c).</text>
 </paragraph><paragraph id="id8d83b455adcf40a29b8336fc6519813a"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means—</text> <subparagraph id="idd3e4b0a1a4ab43c784ef33bf1d7f47c6"><enum>(A)</enum><text>a State; and</text>
 </subparagraph><subparagraph id="idd903fb6e4b8d48acbb355a220ce85e6b"><enum>(B)</enum><text>the District of Columbia.</text> </subparagraph></paragraph></section><section id="id3444068284864f5fa3fc27a644d59e94"><enum>6003.</enum><header>Streamlining of refinery permitting process</header> <subsection id="idef469f1930a049c18b358bb969c957f1"><enum>(a)</enum><header>In general</header><text>At the request of the Governor of a State or the governing body of an Indian tribe, the Administrator shall enter into a refinery permitting agreement with the State or Indian tribe under which the process for obtaining all permits necessary for the construction and operation of a refinery shall be streamlined using a systematic, interdisciplinary multimedia approach, as provided in this section.</text>
 </subsection><subsection id="idf87e3ab38aac44d0bfbfdc04592c0952"><enum>(b)</enum><header>Authority of Administrator</header><text>Under a refinery permitting agreement, the Administrator shall have the authority, as applicable and necessary—</text>
 <paragraph id="ide474bc2cfb114bf387b1ce32f314a08c"><enum>(1)</enum><text>to accept from a refiner a consolidated application for all permits that the refiner is required to obtain to construct and operate a refinery;</text>
 </paragraph><paragraph id="idac03fd8f9d8f46c9b3b5602c74057ce8"><enum>(2)</enum><text>in consultation and cooperation with each Federal, State, or tribal government agency that is required to make any determination to authorize the issuance of a permit, to establish a schedule under which each agency shall—</text>
 <subparagraph id="id119727f5c5a44725a71fd08cc4609bdf"><enum>(A)</enum><text>concurrently consider, to the maximum extent practicable, each determination to be made; and</text> </subparagraph><subparagraph id="idb84afe01bc384085bb99ce71531fbc34"><enum>(B)</enum><text>complete each step in the permitting process; and</text>
 </subparagraph></paragraph><paragraph id="id258a92fc0741417d82219a1b02d93d4a"><enum>(3)</enum><text>to issue a consolidated permit that combines all permits issued under the schedule established under paragraph (2).</text>
 </paragraph></subsection><subsection id="id89df3d0984ca41e1967ee4bcc3b3cfa1"><enum>(c)</enum><header>Refinery permitting agreements</header><text>Under a refinery permitting agreement, a State or governing body of an Indian tribe shall agree that—</text>
 <paragraph id="idf63a42bc111a48e6beb76b495424a0ba"><enum>(1)</enum><text>the Administrator shall have each of the authorities described in subsection (b); and</text> </paragraph><paragraph id="id83f6111b329f4cc1981bbd464ba7dad1"><enum>(2)</enum><text>the State or tribal government agency shall—</text>
 <subparagraph id="id1cd21ebbcebd4a278e2e6659a0bec693"><enum>(A)</enum><text>in accordance with State law, make such structural and operational changes in the agencies as are necessary to enable the agencies to carry out consolidated, project-wide permit reviews concurrently and in coordination with the Environmental Protection Agency and other Federal agencies; and</text>
 </subparagraph><subparagraph id="idae7e93a97e974b8898baf7493d4b96c2"><enum>(B)</enum><text>comply, to the maximum extent practicable, with the applicable schedule established under subsection (b)(2).</text>
							</subparagraph></paragraph></subsection><subsection id="idadfda1f550a749daaec1e805473b9170"><enum>(d)</enum><header>Deadlines</header>
 <paragraph id="ida28c4c29566847f8ab1984c5e6fcc933"><enum>(1)</enum><header>New refineries</header><text>In the case of a consolidated permit for the construction of a new refinery, the Administrator and the State or governing body of an Indian tribe shall approve or disapprove the consolidated permit not later than—</text>
 <subparagraph id="id4ad959f6dc264f7c9833c45f7f73c0e9"><enum>(A)</enum><text>365 days after the date of receipt of an administratively complete application for the consolidated permit; or</text>
 </subparagraph><subparagraph id="id0561fe02453a468eabfcffe7aa3b75fd"><enum>(B)</enum><text>on agreement of the applicant, the Administrator, and the State or governing body of the Indian tribe, 90 days after the expiration of the deadline described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id0f8eb8d9d96441f6ba9eafe5089fba07"><enum>(2)</enum><header>Expansion of existing refineries</header><text>In the case of a consolidated permit for the expansion of an existing refinery, the Administrator and the State or governing body of an Indian tribe shall approve or disapprove the consolidated permit not later than—</text>
 <subparagraph id="id1d40a607e99c4f9faaddfbf1184a33ee"><enum>(A)</enum><text>120 days after the date of receipt of an administratively complete application for the consolidated permit; or</text>
 </subparagraph><subparagraph id="id238763d196284db6b3469ed21a3e492a"><enum>(B)</enum><text>on agreement of the applicant, the Administrator, and the State or governing body of the Indian tribe, 30 days after the expiration of the deadline described in subparagraph (A).</text>
 </subparagraph></paragraph></subsection><subsection id="id65fc62a8a2294389ab5e3a98671b5c61"><enum>(e)</enum><header>Federal agencies</header><text>Each Federal agency that is required to make any determination to authorize the issuance of a permit shall comply with the applicable schedule established under subsection (b)(2).</text>
 </subsection><subsection id="idf9c54c3da37e439c8298b7902622fb10"><enum>(f)</enum><header>Judicial review</header><text>Any civil action for review of a permit determination under a refinery permitting agreement shall be brought exclusively in the United States district court for the district in which the refinery is located or proposed to be located.</text>
 </subsection><subsection id="id13287dc53e7f4362b0a2300a65af2830"><enum>(g)</enum><header>Efficient permit review</header><text>In order to reduce the duplication of procedures, the Administrator shall use State permitting and monitoring procedures to satisfy substantially equivalent Federal requirements under this subtitle.</text>
 </subsection><subsection id="id3ec1e4db9eab4dedb544ee95f34d6bbd"><enum>(h)</enum><header>Severability</header><text>If 1 or more permits that are required for the construction or operation of a refinery are not approved on or before an applicable deadline under subsection (d), the Administrator may issue a consolidated permit that combines all other permits that the refiner is required to obtain, other than any permits that are not approved.</text>
 </subsection><subsection id="id679325a61d294a8985609acda589b0e9"><enum>(i)</enum><header>Consultation with local governments</header><text>The Administrator, States, and tribal governments shall consult, to the maximum extent practicable, with local governments in carrying out this section.</text>
 </subsection><subsection id="id684b0b82ce864cfd8ab864f1a100188d"><enum>(j)</enum><header>Effect of section</header><text>Nothing in this section affects—</text> <paragraph id="id878B2F1782524092A969D7540F215E21"><enum>(1)</enum><text>the operation or implementation of any otherwise applicable law regarding permits necessary for the construction and operation of a refinery;</text>
 </paragraph><paragraph id="idd184a958bf4449889869d79df1e15c10"><enum>(2)</enum><text>the authority of any unit of local government with respect to the issuance of permits; or</text> </paragraph><paragraph id="id54ce5e0c499e48c798fb78404d53cb71"><enum>(3)</enum><text>any requirement or ordinance of a local government (such as a zoning regulation).</text>
						</paragraph></subsection></section></subtitle><subtitle id="idD2961084CCC84C5DBF05D90C73E662B0" style="OLC"><enum>B</enum><header>Repeal of renewable fuel standard</header>
 <section id="id30CCC2F84E9947A89A49BBB7C425949D"><enum>6011.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that the mandates under the renewable fuel standard contained in section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)</external-xref>)—</text>
 <paragraph id="idCBB664DE8ECB4EDBA8ED7DDC73B00F34"><enum>(1)</enum><text>impose significant costs on American citizens and the American economy, without offering any benefit; and</text>
 </paragraph><paragraph id="id7D6C4909FA3243BF8D86B7B9186EBE9F"><enum>(2)</enum><text>should be repealed.</text> </paragraph></section><section id="idb7a729644cb1469da9de347878fabf98"><enum>6012.</enum><header>Phase out of renewable fuel standard</header> <subsection id="id7601571F2BFF4A4687B5DD75BCA7BF99"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)</external-xref>) is amended—</text>
 <paragraph id="idC01881C620374B55BE908E0283A37CBB"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text> <subparagraph id="id65A7B96EBF7D4B99BAC62E1FD005FD29"><enum>(A)</enum><text>in subparagraph (A)—</text>
 <clause id="id29CC1A60FA924EF89323E984A205EACA"><enum>(i)</enum><text>by striking clause (ii); and</text> </clause><clause id="idF48DB09FB9D94211984664835E1969D3"><enum>(ii)</enum><text>by redesignating clauses (iii) and (iv) as clauses (ii) and (iii), respectively; and</text>
 </clause></subparagraph><subparagraph id="idBB1751E0CD58416585F6494BEAB25C50"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking clauses (ii) through (v) and inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="id671D81C21BFA4EB4A680DC995CBDB03D" style="OLC">
 <clause id="id5E88ECEB51A44F4A939115CCB917CAC9"><enum>(ii)</enum><header>Calendar years 2014 through 2019</header><text>Notwithstanding clause (i), for purposes of subparagraph (A), the applicable volumes of renewable fuel for each of calendar years 2014 through 2019 shall be determined as follows:</text>
 <subclause id="idBEFC1A921FA24BF1A9EE6A5151C16705"><enum>(I)</enum><text>For calendar years 2014 and 2015, in accordance with the table entitled <quote>I–2—Proposed 2014 Volume Requirements</quote> of the proposed rule published at pages 71732 through 71784 of volume 78 of the Federal Register (November 29, 2013).</text>
 </subclause><subclause id="idC7BB933E9BCB4B429444C1CE76CCA71A"><enum>(II)</enum><text>For calendar year 2016, the applicable volumes established under subclause (I), reduced by 20 percent.</text>
 </subclause><subclause id="id4A38770605AE4615B82A802DB60B73D2"><enum>(III)</enum><text>For calendar year 2017, the applicable volumes established under subclause (I), reduced by 40 percent.</text>
 </subclause><subclause id="id47DEE0D5BE47424785BFF773B5AEDB22"><enum>(IV)</enum><text>For calendar year 2018, the applicable volumes established under subclause (I), reduced by 60 percent.</text>
 </subclause><subclause id="id9ECF0C24D98A46508DA5DC65E0E5310E"><enum>(V)</enum><text>For calendar year 2019, the applicable volumes established under subclause (I), reduced by 80 percent.</text></subclause></clause><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id8F451031DB194110AFAC4516E88B638D"><enum>(2)</enum><text>in paragraph (3)—</text> <subparagraph id="id002D812081B24EDC971501E801420F4F"><enum>(A)</enum><text>by striking <quote>2021</quote> and inserting <quote>2018</quote> each place it appears; and</text>
 </subparagraph><subparagraph id="idDB54A1A3186B45B7A8684AEDF08E4A9B"><enum>(B)</enum><text>in subparagraph (B)(i), by inserting <quote>, subject to the condition that the renewable fuel obligation determined for a calendar year is not more than the applicable volumes established under paragraph (2)(B)(ii)</quote> before the period; and</text>
 </subparagraph></paragraph><paragraph id="id737CC9F2689046CC9502FDA1CC3414A4"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id3AA033EF506246608941688EC699B3B4" style="OLC"> <paragraph id="id5451607099334709982066F94F0B29EB"><enum>(13)</enum><header>Sunset</header><text>The program established under this subsection shall terminate on December 31, 2019.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id0168f26809784f5487119852f1ef5f72"><enum>(b)</enum><header>Regulations</header><text>Effective beginning on January 1, 2020, the regulations contained in subparts K and M of part 80 of title 40, Code of Federal Regulations (as in effect on that date of enactment), shall have no force or effect.</text>
					</subsection></section></subtitle></title><title id="id99C8EF89DE4649128F463CA2F2C4CD7E" style="OLC"><enum>VII</enum><header>Stopping EPA overreach</header>
 <section id="id0D4ED00D901C4283924F7EC6D4A016A1"><enum>7001.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="idA681C573B5ED4F51A62039D957ADD696"><enum>(1)</enum><text display-inline="yes-display-inline">the Environmental Protection Agency has exceeded its statutory authority by promulgating regulations that were not contemplated by Congress in the authorizing language of the statutes enacted by Congress;</text>
 </paragraph><paragraph id="idde1ded47ff9145e3903091d50d2e380f"><enum>(2)</enum><text>no Federal agency has the authority to regulate greenhouse gases under current law; and</text> </paragraph><paragraph id="id9894CC6A6E6146E5A33562B11DFDC25A"><enum>(3)</enum><text>no attempt to regulate greenhouse gases should be undertaken without further Congressional action.</text>
				</paragraph></section><section id="id51358CF685EF432AB354D5A548CB39E3"><enum>7002.</enum><header>Clarification of Federal regulatory authority to exclude greenhouse gases from regulation under the
			 Clean Air Act</header>
				<subsection id="id5f2ec9cc5d9a4924b5a5ba0cfa810068"><enum>(a)</enum><header>Repeal of Federal climate change regulation</header>
 <paragraph id="id0857C173B64A4FCD8F496B4AAC14AE1C"><enum>(1)</enum><header>Greenhouse gas regulation under Clean Air Act</header><text>Section 302(g) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7602">42 U.S.C. 7602(g)</external-xref>) is amended—</text> <subparagraph id="id240E0F2D61E54098AB40484DF6E7DEDA"><enum>(A)</enum><text>by striking <quote>(g) The term</quote> and inserting the following:</text>

 </subparagraph></paragraph><paragraph id="id62534d2160174ee491fd060fa9ba5258"><enum>(2)</enum><header>No regulation of climate change</header><text>Notwithstanding any other provision of law, nothing in any of the following Acts or any other law authorizes or requires the regulation of climate change or global warming:</text>
 <subparagraph id="id5FE1A63A4AA448C1A265B3067EB0A7A8"><enum>(A)</enum><text>The Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>).</text> </subparagraph><subparagraph id="idC02ED9CC4BF040EABB566ECDE3056129"><enum>(B)</enum><text>The Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>).</text>
 </subparagraph><subparagraph id="id3EE3A37F866140C5A5CF7D81C69DD765"><enum>(C)</enum><text>The National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text> </subparagraph><subparagraph id="idD996683FDF204CFF811E3742ECC1CB20"><enum>(D)</enum><text>The Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text>
 </subparagraph><subparagraph id="idA9EE799B9EF34BE9A608010F96559A99"><enum>(E)</enum><text>The Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>).</text> </subparagraph></paragraph></subsection><subsection id="id2C489355154440A2A1A9A8374DC33889"><enum>(b)</enum><header>Effect on proposed rules of the EPA</header><text>In accordance with this section, the following proposed or contemplated rules (or any similar or successor rules) of the Environmental Protection Agency shall be void and have no force or effect:</text>
 <paragraph id="idE385606A61F14DAFA52FB278CDCC7D56"><enum>(1)</enum><text>The proposed rule entitled <quote>Standards of Performance for Greenhouse Gas Emissions From New Stationary Sources: Electric Utility Generating Units</quote> (published at 79 Fed. Reg. 1430 (January 8, 2014)).</text>
 </paragraph><paragraph id="id2007631D84124A7AB64FA815D530D2D6"><enum>(2)</enum><text>The proposed rule entitled <quote>Carbon Pollution Emission Guidelines for Existing Stationary Sources: Electric Utility Generating Units</quote> (published at 79 Fed. Reg. 34829 (June 18, 2014)).</text>
 </paragraph><paragraph commented="no" id="idAA14CAF1237A4BE9AC492202CDC40E4C"><enum>(3)</enum><text>Any other contemplated or proposed rules proposed to be issued pursuant to the purported authority described in subsection (a)(2).</text>
					</paragraph></subsection></section><section commented="no" id="idA84FB44C31E64C09A3EAA918357972BA"><enum>7003.</enum><header>Clarification of authority</header>
 <subsection commented="no" id="idD850EF09CCCC4A6194470A04D289CB32"><enum>(a)</enum><header>In general</header><text>Neither the Secretary of the Army, acting through the Chief of Engineers, nor the Administrator of the Environmental Protection Agency shall—</text>
 <paragraph commented="no" id="id16B19428155A44B1B6DA02A7DF3198FB"><enum>(1)</enum><text>finalize the proposed rule entitled <quote>Definition of Waters of the United States Under the Clean Water Act</quote> (79 Fed. Reg. 22188 (April 21, 2014)); or</text> </paragraph><paragraph commented="no" id="idC933E83AFFAC40B6AA650EEAF7019E38"><enum>(2)</enum><text>use the proposed rule described in paragraph (1), or any substantially similar proposed rule or guidance, as the basis for any rulemaking or any decision regarding the scope or enforcement of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>).</text>
 </paragraph></subsection><subsection commented="no" id="idF4031C232BB7488FA7753671E519A02D"><enum>(b)</enum><header>Rules</header><text>The use of the proposed rule described in subsection (a)(1), or any substantially similar proposed rule or guidance, as the basis for any rulemaking or any decision regarding the scope or enforcement of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) shall be grounds for vacation of the final rule, decision, or enforcement action.</text>
				</subsection></section><section id="id5305AAE1B5D94FE89B558E63B53AE78E"><enum>7004.</enum><header>Jobs analysis for all EPA regulations</header>
 <subsection id="ide0fa1789f3ba4b6fb32749250826c3a9"><enum>(a)</enum><header>In general</header><text>Before proposing or finalizing any regulation, rule, or policy, the Administrator of the Environmental Protection Agency shall provide an analysis of the regulation, rule, or policy and describe the direct and indirect net and gross impact of the regulation, rule, or policy on employment in the United States.</text>
 </subsection><subsection id="id4C4B723ECE1D4BDBB002797F143B9EAD"><enum>(b)</enum><header>Limitation</header><text>No regulation, rule, or policy described in subsection (a) shall take effect if the regulation, rule, or policy has a negative impact on employment in the United States unless the regulation, rule, or policy is approved by Congress and signed by the President.</text>
				</subsection></section></title><title id="id9EFDC43C04F740C98B95410135E35413" style="OLC"><enum>VIII</enum><header>Debt freedom fund</header>
 <section id="idE19B258A5E9C4547B875F75C381F789A"><enum>8001.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="id8FDF98A1965D41858D6E55B937649EF1"><enum>(1)</enum><text>the national debt being over $17,000,000,000,000 in 2014—</text>
 <subparagraph id="id87ACDED6F25446BB91B3A5F03E0BF6F6"><enum>(A)</enum><text>threatens the current and future prosperity of the United States;</text> </subparagraph><subparagraph id="id5BA7EE6E26E348DB8A369DC1BCA389FC"><enum>(B)</enum><text>undermines the national security interests of the United States; and</text>
 </subparagraph><subparagraph id="idD0B9464697B44E8B89DEF2BAF1A462BC"><enum>(C)</enum><text>imposes a burden on future generations of United States citizens; and</text> </subparagraph></paragraph><paragraph id="id87303A09F44848C7BD494F7F726932BC"><enum>(2)</enum><text>revenue generated from the development of the natural resources in the United States should be used to reduce the national debt.</text>
 </paragraph></section><section id="idA3D5095987C04A8BB7154122FB5F5D2B"><enum>8002.</enum><header>Debt freedom fund</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, in accordance with all revenue sharing arrangement with States in effect on the date of enactment of this Act, an amount equal to the additional amount of Federal funds generated by the programs and activities under this Act (and the amendments made by this Act)—</text>
 <paragraph id="idF03FC85B422547B0BCB60EE77F8E47CE"><enum>(1)</enum><text display-inline="yes-display-inline">shall be deposited in a special trust fund account in the Treasury, to be known as the <quote>Debt Freedom Fund</quote>; and</text> </paragraph><paragraph id="idA8C157B3969D41518D3B529FFE488A0E"><enum>(2)</enum><text display-inline="yes-display-inline">shall not be withdrawn for any purpose other than to pay down the national debt of the United States, for which purpose payments shall be made expeditiously.</text></paragraph></section></title></legis-body></bill>
