			 disseminate information when a law enforcement officer is seriously
			 injured or killed in the line of duty, is missing in connection with the
			 officer’s official duties, or an imminent and credible threat that an
			 individual intends to cause the serious injury or death of a law
			 enforcement officer is received, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HCDD95585B09E48DF95730C6DA41755C2" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="H89FD09728A184304AF901C641DCDBFBE" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rafael Ramos and Wenjian Liu National Blue Alert Act of 2015</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="H2C6342885B584E909D0976AF9564F912" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H9C329ACF6C14438AA720E9F98C0D927D"><enum>(1)</enum><header display-inline="yes-display-inline">Coordinator</header><text display-inline="yes-display-inline">The term <term>Coordinator</term> means the Blue Alert Coordinator of the Department of Justice designated under section 4(a).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35B632B820C64A29AB555C55FF698CBA"><enum>(2)</enum><header display-inline="yes-display-inline">Blue alert</header><text display-inline="yes-display-inline">The term <term>Blue Alert</term> means information sent through the network relating to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H5F81937D6CD04815AC10778A261B0A1F"><enum>(A)</enum><text display-inline="yes-display-inline">the serious injury or death of a law enforcement officer in the line of duty;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1B6991A54CBB4265843EC4B13B39CF69"><enum>(B)</enum><text display-inline="yes-display-inline">an officer who is missing in connection with the officer’s official duties; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC1E488EF7F124FFFA8CF75A6D05A390B"><enum>(C)</enum><text display-inline="yes-display-inline">an imminent and credible threat that an individual intends to cause the serious injury or death of a law enforcement officer.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H435287A2FDD64FA096D32DB0CECDC92B"><enum>(3)</enum><header display-inline="yes-display-inline">Blue alert plan</header><text display-inline="yes-display-inline">The term <term>Blue Alert plan</term> means the plan of a State, unit of local government, or Federal agency participating in the network for the dissemination of information received as a Blue Alert.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC88422FC49AF4F37A2DC66A506111EC5"><enum>(4)</enum><header display-inline="yes-display-inline">Law enforcement officer</header><text display-inline="yes-display-inline">The term <term>law enforcement officer</term> shall have the same meaning as in section 1204 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796b">42 U.S.C. 3796b</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H541A9099C6844B4BA1F362092FC267CE"><enum>(5)</enum><header display-inline="yes-display-inline">Network</header><text display-inline="yes-display-inline">The term <term>network</term> means the Blue Alert communications network established by the Attorney General under section 3.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4BB359CA4D5042CEBF287BC766167423"><enum>(6)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the 50 States, the District of Columbia, Puerto Rico, the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text>
 </paragraph></section><section commented="no" display-inline="no-display-inline" id="HBB0C7F1CDEB9406D8E0331578122F64C" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Blue alert communications network</header><text display-inline="no-display-inline">The Attorney General shall establish a national Blue Alert communications network within the Department of Justice to issue Blue Alerts through the initiation, facilitation, and promotion of Blue Alert plans, in coordination with States, units of local government, law enforcement agencies, and other appropriate entities.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HE4B592C1695046FBBA97EB39AE0C8411" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Blue alert coordinator; guidelines</header>
 <subsection commented="no" display-inline="no-display-inline" id="H0277168256FD42469C0EA3CCF36E399E"><enum>(a)</enum><header display-inline="yes-display-inline">Coordination within department of justice</header><text display-inline="yes-display-inline">The Attorney General shall assign an existing officer of the Department of Justice to act as the national coordinator of the Blue Alert communications network.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HC02D247FE6B4493E95830A46C146694C"><enum>(b)</enum><header display-inline="yes-display-inline">Duties of the coordinator</header><text display-inline="yes-display-inline">The Coordinator shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H58EB06733C4E471F833A60F591FF0A55"><enum>(1)</enum><text display-inline="yes-display-inline">provide assistance to States and units of local government that are using Blue Alert plans;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H982E0D89036C45D3AEEA803555928FBF"><enum>(2)</enum><text display-inline="yes-display-inline">establish voluntary guidelines for States and units of local government to use in developing Blue Alert plans that will promote compatible and integrated Blue Alert plans throughout the United States, including—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H98784A16641247109EC2C126D27A3481"><enum>(A)</enum><text display-inline="yes-display-inline">a list of the resources necessary to establish a Blue Alert plan;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0B37D655AB3745E58D434F2EFEE42378"><enum>(B)</enum><text display-inline="yes-display-inline">criteria for evaluating whether a situation warrants issuing a Blue Alert;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBDE9066D60FC44689DBB6D9EE2ED6BFD"><enum>(C)</enum><text display-inline="yes-display-inline">guidelines to protect the privacy, dignity, independence, and autonomy of any law enforcement officer who may be the subject of a Blue Alert and the family of the law enforcement officer;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0DEF682946D94872AE7BC0648D4F41E0"><enum>(D)</enum><text display-inline="yes-display-inline">guidelines that a Blue Alert should only be issued with respect to a law enforcement officer if—</text> <clause commented="no" display-inline="no-display-inline" id="HC9749B9C43664C8399D2371A40686195"><enum>(i)</enum><text display-inline="yes-display-inline">the law enforcement agency involved—</text>
 <subclause commented="no" display-inline="no-display-inline" id="H96BC89A2E5DA4B5CB01B11578D42C94C"><enum>(I)</enum><text display-inline="yes-display-inline">confirms—</text> <item commented="no" display-inline="no-display-inline" id="H67F979AFE1EB48E8A064DCB2E5B55963"><enum>(aa)</enum><text display-inline="yes-display-inline">the death or serious injury of the law enforcement officer; or</text>
 </item><item commented="no" display-inline="no-display-inline" id="H3C5216E5F9A44FDCBC1DD8B8AE9CB767"><enum>(bb)</enum><text display-inline="yes-display-inline">the attack on the law enforcement officer and that there is an indication of the death or serious injury of the officer; or</text>
 </item></subclause><subclause commented="no" display-inline="no-display-inline" id="HB247D9FE75D246EC8ACF872177507155"><enum>(II)</enum><text display-inline="yes-display-inline">concludes that the law enforcement officer is missing in connection with the officer’s official duties;</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB65DDDE6CF024A659BDB3CAB88544C87"><enum>(ii)</enum><text display-inline="yes-display-inline">there is an indication of serious injury to or death of the law enforcement officer;</text> </clause><clause commented="no" display-inline="no-display-inline" id="H3725279A05284307BFD22FCCF885870F"><enum>(iii)</enum><text display-inline="yes-display-inline">the suspect involved has not been apprehended; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H3F2236FD390F4363B9006B423F40A884"><enum>(iv)</enum><text display-inline="yes-display-inline">there is sufficient descriptive information of the suspect involved and any relevant vehicle and tag numbers;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7E536E4AA76C40F8841B7BA02CCB0E7F"><enum>(E)</enum><text display-inline="yes-display-inline">guidelines that a Blue Alert should only be issued with respect to a threat to cause death or serious injury to a law enforcement officer if—</text>
 <clause commented="no" display-inline="no-display-inline" id="HD2DE78C1C6AA401CB094750BD6E6C9FE"><enum>(i)</enum><text display-inline="yes-display-inline">a law enforcement agency involved confirms that the threat is imminent and credible;</text> </clause><clause commented="no" display-inline="no-display-inline" id="H5A5DB034C645450B905E21CBAB133CEC"><enum>(ii)</enum><text display-inline="yes-display-inline">at the time of receipt of the threat, the suspect is wanted by a law enforcement agency;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H04FAC35888494C99A1CC060F2F87DA54"><enum>(iii)</enum><text display-inline="yes-display-inline">the suspect involved has not been apprehended; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="H2C722B2D980B4F39BDA627B4F9C626A6"><enum>(iv)</enum><text display-inline="yes-display-inline">there is sufficient descriptive information of the suspect involved and any relevant vehicle and tag numbers;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7EEAC51451DB4731A723003383684772"><enum>(F)</enum><text display-inline="yes-display-inline">guidelines—</text> <clause commented="no" display-inline="no-display-inline" id="H9FE28C38464E4BEB90A9383CD6A68CE2"><enum>(i)</enum><text display-inline="yes-display-inline">that information should be provided to the National Crime Information Center database operated by the Federal Bureau of Investigation under section 534 of title 28, United States Code, and any relevant crime information repository of the State involved, relating to—</text>
 <subclause commented="no" display-inline="no-display-inline" id="H26E1825E1F1B483E9711435701295B3B"><enum>(I)</enum><text display-inline="yes-display-inline">a law enforcement officer who is seriously injured or killed in the line of duty; or</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="H713B704BAB9846B3B06CAE3B6EE18E7B"><enum>(II)</enum><text display-inline="yes-display-inline">an imminent and credible threat to cause the serious injury or death of a law enforcement officer;</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="H1D74C840CC5B412FA985B844ABA0C1E8"><enum>(ii)</enum><text display-inline="yes-display-inline">that a Blue Alert should, to the maximum extent practicable (as determined by the Coordinator in consultation with law enforcement agencies of States and units of local governments), be limited to the geographic areas most likely to facilitate the apprehension of the suspect involved or which the suspect could reasonably reach, which should not be limited to State lines;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H786FF15C0534423FB803372037BFD1A9"><enum>(iii)</enum><text display-inline="yes-display-inline">for law enforcement agencies of States or units of local government to develop plans to communicate information to neighboring States to provide for seamless communication of a Blue Alert; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HA1E3AD18F04945628546CE5F997AE2A7"><enum>(iv)</enum><text display-inline="yes-display-inline">providing that a Blue Alert should be suspended when the suspect involved is apprehended or when the law enforcement agency involved determines that the Blue Alert is no longer effective; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDCB321544F6540F88A2EB46282C564D2"><enum>(G)</enum><text display-inline="yes-display-inline">guidelines for—</text> <clause commented="no" display-inline="no-display-inline" id="HBF32D331863544318BB4B25A6278D907"><enum>(i)</enum><text display-inline="yes-display-inline">the issuance of Blue Alerts through the network; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H1801E86B3FFA49AC88E0D9123B577D98"><enum>(ii)</enum><text display-inline="yes-display-inline">the extent of the dissemination of alerts issued through the network;</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF905ADA0D0324BFC94C50F8F874C773B"><enum>(3)</enum><text display-inline="yes-display-inline">develop protocols for efforts to apprehend suspects that address activities during the period beginning at the time of the initial notification of a law enforcement agency that a suspect has not been apprehended and ending at the time of apprehension of a suspect or when the law enforcement agency involved determines that the Blue Alert is no longer effective, including protocols regulating—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H7629B99F60A44D69BC344D8A055FE4AB"><enum>(A)</enum><text display-inline="yes-display-inline">the use of public safety communications;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H35D6C13EBB52405B9C40ADD4E8213C57"><enum>(B)</enum><text display-inline="yes-display-inline">command center operations; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0680FCEB266C4F9BB44CF9E809A6AD0C"><enum>(C)</enum><text display-inline="yes-display-inline">incident review, evaluation, debriefing, and public information procedures;</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0E352119D98F4343A94CB0CE0491843F"><enum>(4)</enum><text display-inline="yes-display-inline">work with States to ensure appropriate regional coordination of various elements of the network;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53688230BE844FE3B257F302EA14B61B"><enum>(5)</enum><text display-inline="yes-display-inline">establish an advisory group to assist States, units of local government, law enforcement agencies, and other entities involved in the network with initiating, facilitating, and promoting Blue Alert plans, which shall include—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H1257E6DD06E1420F8C5BA858447871FA"><enum>(A)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, representation from the various geographic regions of the United States; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF0105D7B66534CDFAD0C3F0FD9A27C11"><enum>(B)</enum><text display-inline="yes-display-inline">members who are—</text> <clause commented="no" display-inline="no-display-inline" id="H921C3787CA04464E84BE3552CB5B2C6F"><enum>(i)</enum><text display-inline="yes-display-inline">representatives of a law enforcement organization representing rank-and-file officers;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HA7E634D215D44E93893AAD3E572BA875"><enum>(ii)</enum><text display-inline="yes-display-inline">representatives of other law enforcement agencies and public safety communications;</text> </clause><clause commented="no" display-inline="no-display-inline" id="H96159E60E900473BB852814B59732818"><enum>(iii)</enum><text display-inline="yes-display-inline">broadcasters, first responders, dispatchers, and radio station personnel; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="HFF6DF3BC050D40FB92F35B495215F72D"><enum>(iv)</enum><text display-inline="yes-display-inline">representatives of any other individuals or organizations that the Coordinator determines are necessary to the success of the network;</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H05318175787B494AACEE13A9BD2EB573"><enum>(6)</enum><text display-inline="yes-display-inline">act as the nationwide point of contact for—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HEA40C5FE3AA6475CB880728F298A5E68"><enum>(A)</enum><text display-inline="yes-display-inline">the development of the network; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEB6C09DFA79342D6A186D4D29BD6497A"><enum>(B)</enum><text display-inline="yes-display-inline">regional coordination of Blue Alerts through the network; and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC300DFBEC6174B4C852FF3BFD8F78670"><enum>(7)</enum><text display-inline="yes-display-inline">determine—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H33CD352ED3F14E68A9AF04E2B828710B"><enum>(A)</enum><text display-inline="yes-display-inline">what procedures and practices are in use for notifying law enforcement and the public when—</text> <clause commented="no" display-inline="no-display-inline" id="HCF35B7A0107B49ABBE6859FB995A8CEF"><enum>(i)</enum><text display-inline="yes-display-inline">a law enforcement officer is killed or seriously injured in the line of duty;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H07267D4E6AA1428D947B0BAF9EE8B4E0"><enum>(ii)</enum><text display-inline="yes-display-inline">a law enforcement officer is missing in connection with the officer’s official duties; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="HF765FC0A18154A1C8D68B4197A56C024"><enum>(iii)</enum><text display-inline="yes-display-inline">an imminent and credible threat to kill or seriously injure a law enforcement officer is received; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAC1951C47B5E4A2399A6802525861063"><enum>(B)</enum><text display-inline="yes-display-inline">which of the procedures and practices are effective and that do not require the expenditure of additional resources to implement.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB0B973E9E32B4A16ABF83DF880EA2749"><enum>(c)</enum><header display-inline="yes-display-inline">Limitations</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H88211821222E469E8AB73BF58EE4B2BC"><enum>(1)</enum><header display-inline="yes-display-inline">Voluntary participation</header><text display-inline="yes-display-inline">The guidelines established under subsection (b)(2), protocols developed under subsection (b)(3), and other programs established under subsection (b), shall not be mandatory.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAC12344B0E6649B1BE62254556429AD7"><enum>(2)</enum><header display-inline="yes-display-inline">Dissemination of information</header><text display-inline="yes-display-inline">The guidelines established under subsection (b)(2) shall, to the maximum extent practicable (as determined by the Coordinator in consultation with law enforcement agencies of States and units of local government), provide that appropriate information relating to a Blue Alert is disseminated to the appropriate officials of law enforcement agencies, public health agencies, and other agencies.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H077DF441273241A8B1025B44E179EBDB"><enum>(3)</enum><header display-inline="yes-display-inline">Privacy and civil liberties protections</header><text display-inline="yes-display-inline">The guidelines established under subsection (b) shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H26B29278CEC74E85883D179F9129C581"><enum>(A)</enum><text display-inline="yes-display-inline">provide mechanisms that ensure that Blue Alerts comply with all applicable Federal, State, and local privacy laws and regulations; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD2A247DDBA944A048DB04FB2E400BB9D"><enum>(B)</enum><text display-inline="yes-display-inline">include standards that specifically provide for the protection of the civil liberties, including the privacy, of law enforcement officers who are seriously injured or killed in the line of duty, is missing in connection with the officer’s official duties, or who are threatened with death or serious injury, and the families of the officers.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H123E5CB0C95349879D6B6F5B2076E0E7"><enum>(d)</enum><header display-inline="yes-display-inline">Cooperation with other agencies</header><text display-inline="yes-display-inline">The Coordinator shall cooperate with the Secretary of Homeland Security, the Secretary of Transportation, the Chairman of the Federal Communications Commission, and appropriate offices of the Department of Justice in carrying out activities under this Act.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H384C843324CA47E4A21727C14B9E7FCF"><enum>(e)</enum><header display-inline="yes-display-inline">Restrictions on coordinator</header><text display-inline="yes-display-inline">The Coordinator may not—</text> <paragraph commented="no" display-inline="no-display-inline" id="H53066FA1914040348257EE7B24E7DBF7"><enum>(1)</enum><text display-inline="yes-display-inline">perform any official travel for the sole purpose of carrying out the duties of the Coordinator;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H43E3D71C67FB4A57A8C59453E12FE5EA"><enum>(2)</enum><text display-inline="yes-display-inline">lobby any officer of a State regarding the funding or implementation of a Blue Alert plan; or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3F64BCC2BE0D40FFBA7400309244C1FB"><enum>(3)</enum><text display-inline="yes-display-inline">host a conference focused solely on the Blue Alert program that requires the expenditure of Federal funds.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H44635A560AE74FE1AE62B64C153F43A4"><enum>(f)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Coordinator shall submit to Congress a report on the activities of the Coordinator and the effectiveness and status of the Blue Alert plans that are in effect or being developed.</text></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
