section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Better Buildings Act of 2015</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HAB776A762E9C466996681B3DC4A43A92" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Energy efficiency in Federal and other buildings</header><subsection commented="no" display-inline="no-display-inline" id="HE1F07AFFACE842D396B1B971D31D5A0E"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HB10E12AF6F4F4C32A9092EEC353BB69D"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H51A06A9F82DB435FB8B8D119FFCC031B"><enum>(2)</enum><header display-inline="yes-display-inline">Cost-effective energy efficiency measure</header><text display-inline="yes-display-inline">The term <term>cost-effective energy efficiency measure</term> means any building product, material, equipment, or service, and the installing, implementing, or operating thereof, that provides energy savings in an amount that is not less than the cost of such installing, implementing, or operating.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD9D739029D7E4E8981C2CB86372C3C5E"><enum>(3)</enum><header display-inline="yes-display-inline">Cost-effective water efficiency measure</header><text display-inline="yes-display-inline">The term <term>cost-effective water efficiency measure</term> means any building product, material, equipment, or service, and the installing, implementing, or operating thereof, that provides water savings in an amount that is not less than the cost of such installing, implementing, or operating.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDEB0308567CF4468BF9F49957577DC98"><enum>(b)</enum><header display-inline="yes-display-inline">Model provisions, policies, and best practices</header><paragraph commented="no" display-inline="no-display-inline" id="H54A5593876B64F9399894071D6B8575E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator, in consultation with the Secretary of Energy and after providing the public with an opportunity for notice and comment, shall develop model commercial leasing provisions and best practices in accordance with this subsection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD591539EE7C546CF8784BB366B45661D"><enum>(2)</enum><header display-inline="yes-display-inline">Commercial leasing</header><subparagraph commented="no" display-inline="no-display-inline" id="H9523B4FB428F4FB9A28850F65CFB0311"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The model commercial leasing provisions developed under this subsection shall, at a minimum, align the interests of building owners and tenants with regard to investments in cost-effective energy efficiency measures and cost-effective water efficiency measures to encourage building owners and tenants to collaborate to invest in such measures.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6DFEB249011C430DBB1AF9E23BF4B8A4"><enum>(B)</enum><header display-inline="yes-display-inline">Use of model provisions</header><text display-inline="yes-display-inline">The Administrator may use the model commercial leasing provisions developed under this subsection in any standard leasing document that designates a Federal agency (or other client of the Administrator) as a landlord or tenant.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE5C53554CE74E2C854D63A2804CB5D7"><enum>(C)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">The Administrator shall periodically publish the model commercial leasing provisions developed under this subsection, along with explanatory materials, to encourage building owners and tenants in the private sector to use such provisions and materials.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1F2B90D07DF4149909CB3064F4BB651"><enum>(3)</enum><header display-inline="yes-display-inline">Realty services</header><text display-inline="yes-display-inline">The Administrator shall develop policies and practices to implement cost-effective energy efficiency measures and cost-effective water efficiency measures for the realty services provided by the Administrator to Federal agencies (or other clients of the Administrator), including periodic training of appropriate Federal employees and contractors on how to identify and evaluate those measures.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53C67DFA73774FB3B877133AF9FCBDDC"><enum>(4)</enum><header display-inline="yes-display-inline">State and local assistance</header><text display-inline="yes-display-inline">The Administrator, in consultation with the Secretary of Energy, shall make available model commercial leasing provisions and best practices developed under this subsection to State, county, and municipal governments for use in managing owned and leased building space in accordance with the goal of encouraging investment in all cost-effective energy efficiency measures and cost-effective water efficiency measures.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H15E9504E55044082865EDB8146E405C0" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Separate spaces with high-performance energy efficiency measures</header><subsection commented="no" display-inline="no-display-inline" id="HD45DC43A4B9A44A08991C3742FB9A8B0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle B of title IV of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17081">42 U.S.C. 17081 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB105C16241154BE486AAF01C10B39977" style="OLC"><section commented="no" display-inline="no-display-inline" id="HABC786244B154A6281C02552E27B5783" section-type="subsequent-section"><enum>424.</enum><header display-inline="yes-display-inline">Separate spaces with high-performance energy efficiency measures</header><subsection commented="no" display-inline="no-display-inline" id="H170D18A720844148B44A492498003EAD"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H08EBEE614E014CF7AD9A6E90657E28C1"><enum>(1)</enum><header display-inline="yes-display-inline">High-performance energy efficiency measure</header><text display-inline="yes-display-inline">The term <term>high-performance energy efficiency measure</term> means a technology, product, or practice that will result in substantial operational cost savings by reducing energy consumption and utility costs.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB36DC4EB821F46A59AB6C7976535FC1F"><enum>(2)</enum><header display-inline="yes-display-inline">Separate spaces</header><text display-inline="yes-display-inline">The term <term>separate spaces</term> means areas within a commercial building that are leased or otherwise occupied by a tenant or other occupant for a period of time pursuant to the terms of a written agreement.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7D26C350BE324881B2BE0951DB2D31D7"><enum>(b)</enum><header display-inline="yes-display-inline">Study</header><paragraph commented="no" display-inline="no-display-inline" id="HD083B094526E49A0BD49316A2A320613"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary, acting through the Assistant Secretary of Energy Efficiency and Renewable Energy, shall complete a study on the feasibility of—</text><subparagraph commented="no" display-inline="no-display-inline" id="H6FEA8EE6318C4281BBC1545CB2823567"><enum>(A)</enum><text display-inline="yes-display-inline">significantly improving energy efficiency in commercial buildings through the design and construction, by owners and tenants, of separate spaces with high-performance energy efficiency measures; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1A67119F93EF476E98A7C3473D7384FB"><enum>(B)</enum><text display-inline="yes-display-inline">encouraging owners and tenants to implement high-performance energy efficiency measures in separate spaces.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H62C0A79F4F8B4F2FB1F9FA4E7A8E86C4"><enum>(2)</enum><header display-inline="yes-display-inline">Scope</header><text display-inline="yes-display-inline">The study shall, at a minimum, include—</text><subparagraph commented="no" display-inline="no-display-inline" id="HFC795700B9034113BEE94B88CBFF1A8D"><enum>(A)</enum><text display-inline="yes-display-inline">descriptions of—</text><clause commented="no" display-inline="no-display-inline" id="HFBF910C57E02445FB480678A8A83876D"><enum>(i)</enum><text display-inline="yes-display-inline">high-performance energy efficiency measures that should be considered as part of the initial design and construction of separate spaces;</text></clause><clause commented="no" display-inline="no-display-inline" id="H163F3ABE7E6D47C8A09281F605FD57C6"><enum>(ii)</enum><text display-inline="yes-display-inline">processes that owners, tenants, architects, and engineers may replicate when designing and constructing separate spaces with high-performance energy efficiency measures;</text></clause><clause commented="no" display-inline="no-display-inline" id="H929A045C53464249B6402F9D1963E07F"><enum>(iii)</enum><text display-inline="yes-display-inline">policies and best practices to achieve reductions in energy intensities for lighting, plug loads, heating, cooling, cooking, laundry, and other systems to satisfy the needs of the commercial building tenant;</text></clause><clause commented="no" display-inline="no-display-inline" id="HAEAA2C32A40F449F88804DE9E14285EF"><enum>(iv)</enum><text display-inline="yes-display-inline">return on investment and payback analyses of the incremental cost and projected energy savings of the proposed set of high-performance energy efficiency measures, including consideration of available incentives;</text></clause><clause commented="no" display-inline="no-display-inline" id="H7D2F089CF7A541A49FB50A2C5E01BF6D"><enum>(v)</enum><text display-inline="yes-display-inline">models and simulation methods that predict the quantity of energy used by separate spaces with high-performance energy efficiency measures and that compare that predicted quantity to the quantity of energy used by separate spaces without high-performance energy efficiency measures but that otherwise comply with applicable building code requirements;</text></clause><clause commented="no" display-inline="no-display-inline" id="HD83CF93DB3CD4C80B165C151C974CD38"><enum>(vi)</enum><text display-inline="yes-display-inline">measurement and verification platforms demonstrating actual energy use of high-performance energy efficiency measures installed in separate spaces, and whether such measures generate the savings intended in the initial design and construction of the separate spaces;</text></clause><clause commented="no" display-inline="no-display-inline" id="HABE687E06CA34B85A48C7D0C16E014E6"><enum>(vii)</enum><text display-inline="yes-display-inline">best practices that encourage an integrated approach to designing and constructing separate spaces to perform at optimum energy efficiency in conjunction with the central systems of a commercial building; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H800E03A2AEE54526B6527A68DCD64F70"><enum>(viii)</enum><text display-inline="yes-display-inline">any impact on employment resulting from the design and construction of separate spaces with high-performance energy efficiency measures; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF219E9F9AB4A4AFEB84016F58AA31A20"><enum>(B)</enum><text display-inline="yes-display-inline">case studies reporting economic and energy savings returns in the design and construction of separate spaces with high-performance energy efficiency measures.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDFCDF3B30A3C4CA5829D05C60CAF2992"><enum>(3)</enum><header display-inline="yes-display-inline">Public participation</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this section, the Secretary shall publish a notice in the Federal Register requesting public comments regarding effective methods, measures, and practices for the design and construction of separate spaces with high-performance energy efficiency measures.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H44AAAFEDB7794D5AB152563BC9EA9381"><enum>(4)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">The Secretary shall publish the study on the website of the Department of Energy.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HFBFD84719B624F388A1A4DADE9153ECC"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Energy Independence and Security Act of 2007 is amended by inserting after the item relating to section 423 the level="section">Sec. 424. Separate spaces with high-performance energy efficiency measures.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="H1F5680666DC445419EA7B558C046B732" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Tenant Star program</header><subsection commented="no" display-inline="no-display-inline" id="HE762822C914C4E439DBA08E7C46DBDAA"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle B of title IV of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17081">42 U.S.C. 17081 et seq.</external-xref>) (as amended by section 103) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3BA5587B59CE43458E6840E826C9D3C4" style="OLC"><section commented="no" display-inline="no-display-inline" id="H612E515641484DA9B0A70DDC6E16D9DD" section-type="subsequent-section"><enum>425.</enum><header display-inline="yes-display-inline">Tenant Star program</header><subsection commented="no" display-inline="no-display-inline" id="HEE088025F5264E078D96D23A7970DE3D"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HEC43F10B03C844B28C60DD9E70BCB760"><enum>(1)</enum><header display-inline="yes-display-inline">High-performance energy efficiency measure</header><text display-inline="yes-display-inline">The term <term>high-performance energy efficiency measure</term> has the meaning given the term in section 424.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC2D41000E9A4AF18545A8CBC2747C9B"><enum>(2)</enum><header display-inline="yes-display-inline">Separate spaces</header><text display-inline="yes-display-inline">The term <term>separate spaces</term> has the meaning given the term in section 424.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H08E7FE07CCC54E23A63070E020279514"><enum>(b)</enum><header display-inline="yes-display-inline">Tenant Star</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency, in consultation with the Secretary of Energy, shall develop a voluntary program within the Energy Star program established by section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>), which may be known as <quote>Tenant Star</quote>, to promote energy efficiency in separate spaces leased by tenants or otherwise occupied within commercial buildings.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HE320EB393F3242809D859732E03E5213"><enum>(c)</enum><header display-inline="yes-display-inline">Expanding survey data</header><text display-inline="yes-display-inline">The Secretary of Energy, acting through the Administrator of the Energy Information Administration, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="HE2B4AF18D86F4C9F9A7D626C0F53A379"><enum>(1)</enum><text display-inline="yes-display-inline">collect, through each Commercial Buildings Energy Consumption Survey of the Energy Information Administration that is conducted after the date of enactment of this section, data on—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9BCF59233B7641429C5433C2E33E4E94"><enum>(A)</enum><text display-inline="yes-display-inline">categories of building occupancy that are known to consume significant quantities of energy, such as occupancy by data centers, trading floors, and restaurants; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6E79B79A2168432196FB278C834DD166"><enum>(B)</enum><text display-inline="yes-display-inline">other aspects of the property, building operation, or building occupancy determined by the Administrator of the Energy Information Administration, in consultation with the Administrator of the Environmental Protection Agency, to be relevant in lowering energy consumption;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCA0246461A44424D9259D4D08316FBF3"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to the first Commercial Buildings Energy Consumption Survey conducted after the date of enactment of this section, to the extent full compliance with the requirements of paragraph (1) is not feasible, conduct activities to develop the capability to collect such data and begin to collect such data; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H08B628C880914DD9B71C17E26AFF317B"><enum>(3)</enum><text display-inline="yes-display-inline">make data collected under paragraphs (1) and (2) available to the public in aggregated form and provide such data, and any associated results, to the Administrator of the Environmental Protection Agency for use in accordance with subsection (d).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6AA21803277B49BF935373B64F9D20AD"><enum>(d)</enum><header display-inline="yes-display-inline"> Recognition of owners and tenants</header><paragraph commented="no" display-inline="no-display-inline" id="H527E4618DE2E49E2B42DCB2A5CFF45FB"><enum>(1)</enum><header display-inline="yes-display-inline">Occupancy-based recognition</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which sufficient data is received pursuant to subsection (c), the Administrator of the Environmental Protection Agency shall, following an opportunity for public notice and comment—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3664CB5489E34F218C98F712E72FFCEB"><enum>(A)</enum><text display-inline="yes-display-inline">in a manner similar to the Energy Star rating system for commercial buildings, develop policies and procedures to recognize tenants in commercial buildings that voluntarily achieve high levels of energy efficiency in separate spaces;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCF34E454F08A4A0F885DE4831BB7F251"><enum>(B)</enum><text display-inline="yes-display-inline">establish building occupancy categories eligible for Tenant Star recognition based on the data collected under subsection (c) and any other appropriate data sources; Tenant Star program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title commented="no" id="H36A5D23E23F245A98ABF2A19C0A7B25E" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Grid-enabled water heaters</header><section commented="no" display-inline="no-display-inline" id="H65D6BE9F90FE4D4FAC2F9F12F0EA32BA" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Grid-enabled water heaters</header><text display-inline="no-display-inline">Part B of title III of the Energy Policy and Conservation Act is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H357E0ED8A1FA407C82D3C5A69B40A199"><enum>(1)</enum><text display-inline="yes-display-inline">in section 325(e) (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(e)</external-xref>), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H91C68B677D32448880D5BA1C23CE4252" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H2BA0944D1AC34DE19B41CC13772C3D41"><enum>(6)</enum><header display-inline="yes-display-inline">Additional standards for grid-enabled water heaters</header><subparagraph commented="no" display-inline="no-display-inline" id="H1170058E8C9544D6AAFD922C9142FD03"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="H2C148AEB775F4B77A637B9BEDA5BEE2E"><enum>(i)</enum><header display-inline="yes-display-inline">Activation lock</header><text display-inline="yes-display-inline">The term <term>activation lock</term> means a control mechanism (either a physical device directly on the water heater or a control system integrated into the water heater) that is locked by default and contains a physical, software, or digital communication that must be activated with an activation key to enable the product to operate at its designed specifications and capabilities and without which activation the product will provide not greater than 50 percent of the rated first hour delivery of hot water certified by the manufacturer.</text></clause><clause commented="no" display-inline="no-display-inline" id="H610BA9CFB7634DAB8BC97C67ACAFA2B2"><enum>(ii)</enum><header display-inline="yes-display-inline">Grid-enabled water heater</header><text display-inline="yes-display-inline">The term <term>grid-enabled water heater</term> means an electric resistance water heater that—</text><subclause commented="no" display-inline="no-display-inline" id="H80BCCCAE39594B019AEC34079B97D121"><enum>(I)</enum><text display-inline="yes-display-inline">has a rated storage tank volume of more than 75 gallons;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H567427EB22BE4F55BF06E1A1069BA8A3"><enum>(II)</enum><text display-inline="yes-display-inline">is manufactured on or after April 16, 2015;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H89B7A8AA386643BC8E11E5FB29AAA209"><enum>(III)</enum><text display-inline="yes-display-inline">has—</text><item commented="no" display-inline="no-display-inline" id="HA1FE2B5B3F384CEE9E0D86C4F4F69E11"><enum>(aa)</enum><text display-inline="yes-display-inline">an energy factor of not less than 1.061 minus the product obtained by multiplying—</text><subitem commented="no" display-inline="no-display-inline" id="HC0407AE13FAD451F99DBD2C97E584055"><enum>(AA)</enum><text display-inline="yes-display-inline">the rated storage volume of the tank, expressed in gallons; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H46C790DA822B4AE899A84E290BF355BB"><enum>(BB)</enum><text display-inline="yes-display-inline">0.00168; or</text></subitem></item><item commented="no" display-inline="no-display-inline" id="HAF9CB1A2FB414804B494D5D9FF70AA4E"><enum>(bb)</enum><text display-inline="yes-display-inline">an equivalent alternative standard prescribed by the Secretary and developed pursuant to paragraph (5)(E);</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H74E82EB0D82B42398D055A43A93E670E"><enum>(IV)</enum><text display-inline="yes-display-inline">is equipped at the point of manufacture with an activation lock; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H7535DBBB7E2E4D02997D500E141C7BD4"><enum>(V)</enum><text display-inline="yes-display-inline">bears a permanent label applied by the manufacturer that—</text><item commented="no" display-inline="no-display-inline" id="H2F8252D696614E9AB91EE789838C2D93"><enum>(aa)</enum><text display-inline="yes-display-inline">is made of material not adversely affected by water;</text></item><item commented="no" display-inline="no-display-inline" id="H219EEEC68CCC412A8FE8126BBD654CE8"><enum>(bb)</enum><text display-inline="yes-display-inline">is attached by means of non-water-soluble adhesive; and</text></item><item commented="no" display-inline="no-display-inline" id="H7DBAD6FFA51D4425BC39F1081F56BFF2"><enum>(cc)</enum><text display-inline="yes-display-inline">advises purchasers and end-users of the intended and appropriate use of the product with the following notice printed in 16.5 point Arial Narrow Bold font:</text><non-statutory-material><para justification="left" para-indent="1"><quote>IMPORTANT INFORMATION: This water heater is intended only for use as part of an electric thermal
			 storage or demand response program. It will not provide adequate hot water
			 unless enrolled in such a program and activated by your utility company or
			 another program operator. Confirm the availability of a program in your
 local area before purchasing or installing this product.</quote>. </para></non-statutory-material></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11887798AA2042919D2936C02EE51C02"><enum>(B)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">The manufacturer or private labeler shall provide the activation key for a grid-enabled water heater only to a utility or other company that operates an electric thermal storage or demand response program that uses such a grid-enabled water heater.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA3EA17FE298A49D79A4DC4101013FCEB"><enum>(C)</enum><header display-inline="yes-display-inline">Reports</header><clause commented="no" display-inline="no-display-inline" id="HECD79789F24944B2B8AACA01266FF5C7"><enum>(i)</enum><header display-inline="yes-display-inline">Manufacturers</header><text display-inline="yes-display-inline">The Secretary shall require each manufacturer of grid-enabled water heaters to report to the Secretary annually the quantity of grid-enabled water heaters that the manufacturer ships each year.</text></clause><clause commented="no" display-inline="no-display-inline" id="HF267DBCD4B694CF1BE1B55CF56D336B4"><enum>(ii)</enum><header display-inline="yes-display-inline">Operators</header><text display-inline="yes-display-inline">The Secretary shall require utilities and other demand response and thermal storage program operators to report annually the quantity of grid-enabled water heaters activated for their programs using forms of the Energy Information Agency or using such other mechanism that the Secretary determines appropriate after an opportunity for notice and comment.</text></clause><clause commented="no" display-inline="no-display-inline" id="H91D51578B64B4346927A124717E88D11"><enum>(iii)</enum><header display-inline="yes-display-inline">Confidentiality requirements</header><text display-inline="yes-display-inline">The Secretary shall treat shipment data reported by manufacturers as confidential business information.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H69484A387CBF4302A5EF4B83F492DE44"><enum>(D)</enum><header display-inline="yes-display-inline">Publication of information</header><clause commented="no" display-inline="no-display-inline" id="H4396BCE9315C435EB016D16942237AB7"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In 2017 and 2019, the Secretary shall publish an analysis of the data collected under subparagraph (C) to assess the extent to which shipped products are put into use in demand response and thermal storage programs.</text></clause><clause commented="no" display-inline="no-display-inline" id="H9B3FC969F8194ACDB5DB02FEC5531F8F"><enum>(ii)</enum><header display-inline="yes-display-inline">Prevention of product diversion</header><text display-inline="yes-display-inline">If the Secretary determines that sales of grid-enabled water heaters exceed by 15 percent or greater the quantity of such products activated for use in demand response and thermal storage programs annually, the Secretary shall, after opportunity for notice and comment, establish procedures to prevent product diversion for non-program purposes.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9DD7425D656D40BAB09C15C00247F481"><enum>(E)</enum><header display-inline="yes-display-inline">Compliance</header><clause commented="no" display-inline="no-display-inline" id="HD1E5CCC44F39438CA8AE5B844C0C0218"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subparagraphs (A) through (D) shall remain in effect until the Secretary determines under this section that—</text><subclause commented="no" display-inline="no-display-inline" id="HBC08060B2C7D41789E78E7B10AD2D9E0"><enum>(I)</enum><text display-inline="yes-display-inline">grid-enabled water heaters do not require a separate efficiency requirement; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE31A051AC0484E2B9F881AB20D416C9E"><enum>(II)</enum><text display-inline="yes-display-inline">sales of grid-enabled water heaters exceed by 15 percent or greater the quantity of such products activated for use in demand response and thermal storage programs annually and procedures to prevent product diversion for non-program purposes would not be adequate to prevent such product diversion.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H19883EE727954CFFBAC25B74E27F0BAA"><enum>(ii)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">If the Secretary exercises the authority described in clause (i) or amends the efficiency requirement for grid-enabled water heaters, that action will take effect on the date described in subsection (m)(4)(A)(ii).</text></clause><clause commented="no" display-inline="no-display-inline" id="H6F26D2560F604086A43ADF6C961C175C"><enum>(iii)</enum><header display-inline="yes-display-inline">Consideration</header><text display-inline="yes-display-inline">In carrying out this section with respect to electric water heaters, the Secretary shall consider the impact on thermal storage and demand response programs, including any impact on energy savings, electric bills, peak load reduction, electric reliability, integration of renewable resources, and the environment.</text></clause><clause commented="no" display-inline="no-display-inline" id="H24C553E93D0145A7B5CD7B19C63EF97C"><enum>(iv)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In carrying out this paragraph, the Secretary shall require that grid-enabled water heaters be equipped with communication capability to enable the grid-enabled water heaters to participate in ancillary services programs if the Secretary determines that the technology is available, practical, and cost-effective.</text></clause></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5DD6CF7DDC9B48E5B996F74A6DCEFD03"><enum>(2)</enum><text display-inline="yes-display-inline">in section 332(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/6302">42 U.S.C. 6302(a)</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA3F261284FB84E4BB8C970DE01A66D24"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFFF03F8865E94572818686A5AD74454D"><enum>(B)</enum><text display-inline="yes-display-inline">in the first paragraph (6), by striking the period at the end and inserting a semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCFB92039FFEC4766B2E2148DC200FA3C"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating the second paragraph (6) as paragraph (7);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC22657E1848D4A609CC157BA33A84E1E"><enum>(D)</enum><text display-inline="yes-display-inline">in subparagraph (B) of paragraph (7) (as so redesignated), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0FE43BF5DD2D40FB9BC43A90940A88A3"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB421839B5FFE4A7BB6C86FF3432A6D7A" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H1281F5700E57409EB632F6818FB23076"><enum>(8)</enum><text display-inline="yes-display-inline">for any person—</text><subparagraph commented="no" display-inline="no-display-inline" id="HBDA898D66B034695B89165E4E296C0DD"><enum>(A)</enum><text display-inline="yes-display-inline">to activate an activation lock for a grid-enabled water heater with knowledge that such water heater is not used as part of an electric thermal storage or demand response program;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8CD8348946874664ADB903D9E74222D9"><enum>(B)</enum><text display-inline="yes-display-inline">to distribute an activation key for a grid-enabled water heater with knowledge that such activation key will be used to activate a grid-enabled water heater that is not used as part of an electric thermal storage or demand response program;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF41164ECA3C443E1B382A58E0877016A"><enum>(C)</enum><text display-inline="yes-display-inline">to otherwise enable a grid-enabled water heater to operate at its designed specification and capabilities with knowledge that such water heater is not used as part of an electric thermal storage or demand response program; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCB64F1386CC547EA90F5657C79F1B7A2"><enum>(D)</enum><text display-inline="yes-display-inline">to knowingly remove or render illegible the label of a grid-enabled water heater described in section 325(e)(6)(A)(ii)(V).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HACF6A715024546EDB3287E4D6842BD70"><enum>(3)</enum><text display-inline="yes-display-inline">in section 333(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/6303">42 U.S.C. 6303(a)</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0436BE08E21946CEB6195E43741FC228"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>section 332(a)(5)</quote> and inserting <quote>paragraph (5), (6), (7), or (8) of section 332(a)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H78DC2162890644BC9DB74127DF06A178"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>signing the contract,</quote> and all that follows through the period at the end and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idD5E19192C99E4E9BB6F306D84AA0ADF1" style="OLC"><quoted-block-continuation-text commented="no" quoted-block-continuation-text-level="paragraph">signing the contract, the following requirements are met:</quoted-block-continuation-text><subparagraph commented="no" display-inline="no-display-inline" id="id5FE72A0827D5484A8EF4FE45348A9595"><enum>(A)</enum><text display-inline="yes-display-inline">The space is renovated for all energy efficiency and conservation improvements that would be cost effective over the life of the lease, including improvements in lighting, windows, and heating, ventilation, and air conditioning systems.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id082D061D7A474F6782A7581967D16D4B"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idB4D2647AEE8642C1BAE7B12ED73BDF67"><enum>(i)</enum><text display-inline="yes-display-inline">Subject to clause (ii), the space is benchmarked under a nationally recognized, online, free benchmarking program, with public disclosure, unless the space is a space for which owners cannot access whole building utility consumption data, including spaces—</text><subclause commented="no" display-inline="no-display-inline" id="idF2D951522B3F4F5E9FC2066C7131E728" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">that are located in States with privacy laws that provide that utilities shall not provide such aggregated information to multitenant building owners; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3A42361CBCD04CF0A74FD29F45E1EE2D" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">for which tenants do not provide energy consumption information to the commercial building owner in response to a request from the building owner.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id5DACC99F3AFF4073A3D472710B74A58E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">A Federal agency that is a tenant of the space shall provide to the building owner, or authorize the owner to obtain from the utility, the energy consumption information of the space for the benchmarking and disclosure required by this subparagraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H06B75791295344278F3A335AA60C4937"><enum>(b)</enum><header display-inline="yes-display-inline">Study</header><paragraph commented="no" display-inline="no-display-inline" id="HBF380BEACF4C4445A00F5E0123DC8D15"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary of Energy, in collaboration with the Administrator of the Environmental Protection Agency, shall complete a study—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3EB6ED2F61DA420F82CD03B71E85DCB3"><enum>(A)</enum><text display-inline="yes-display-inline">on the impact of—</text><clause commented="no" display-inline="no-display-inline" id="H685370A9AA78416092C3652E52B8ED10"><enum>(i)</enum><text display-inline="yes-display-inline">State and local performance benchmarking and disclosure policies, and any associated building efficiency policies, for commercial and multifamily buildings; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H091C79A9DB254E6785D73FD73776A0EA"><enum>(ii)</enum><text display-inline="yes-display-inline">programs and systems in which utilities provide aggregated information regarding whole building energy consumption and usage information to owners of multitenant commercial, residential, and mixed-use buildings;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB759909CD32E4057BED0BF58634DC1A7"><enum>(B)</enum><text display-inline="yes-display-inline">that identifies best practice policy approaches studied under subparagraph (A) that have resulted in the greatest improvements in building energy efficiency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7750C1656AF943CA92A3201BCA6DD2C0"><enum>(C)</enum><text display-inline="yes-display-inline">that considers—</text><clause commented="no" display-inline="no-display-inline" id="HCF0F832A32084EAFB729842420133875"><enum>(i)</enum><text display-inline="yes-display-inline">compliance rates and the benefits and costs of the policies and programs on building owners, utilities, tenants, and other parties;</text></clause><clause commented="no" display-inline="no-display-inline" id="HA2369030D74147CDBB21FC75CF568B87"><enum>(ii)</enum><text display-inline="yes-display-inline">utility practices, programs, and systems that provide aggregated energy consumption information to multitenant building owners, and the impact of public utility commissions and State privacy laws on those practices, programs, and systems;</text></clause><clause commented="no" display-inline="no-display-inline" id="H201FE559BF1740A7983820EA78754FA6"><enum>(iii)</enum><text display-inline="yes-display-inline">exceptions to compliance in existing laws where building owners are not able to gather or access whole building energy information from tenants or utilities;</text></clause><clause commented="no" display-inline="no-display-inline" id="HA6E0A1ADFC2A4F459B77423DCD4CEDFF"><enum>(iv)</enum><text display-inline="yes-display-inline">the treatment of buildings with—</text><subclause commented="no" display-inline="no-display-inline" id="H69A05D74EC1A4C8A8510B80CC29E5D94"><enum>(I)</enum><text display-inline="yes-display-inline">multiple uses;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HDF0433C3DD994E6C97747CF367B5259C"><enum>(II)</enum><text display-inline="yes-display-inline">uses for which baseline information is not available; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF2EFC4C68B5A4D8CB7A503A8482C0824"><enum>(III)</enum><text display-inline="yes-display-inline">uses that require high levels of energy intensities, such as data centers, trading floors, and televisions studios;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H5A2B477D38FB4813A5C1A1130177C9C1"><enum>(v)</enum><text display-inline="yes-display-inline">implementation practices, including disclosure methods and phase-in of compliance;</text></clause><clause commented="no" display-inline="no-display-inline" id="H4EAD099AC06E4C028478693995D4CEEA"><enum>(vi)</enum><text display-inline="yes-display-inline">the safety and security of benchmarking tools offered by government agencies, and the resiliency of those tools against cyber attacks; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HDEFCAC9CC2324AE9933196ECA1AEF8E7"><enum>(vii)</enum><text display-inline="yes-display-inline">international experiences with regard to building benchmarking and disclosure laws and data aggregation for multitenant buildings.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB20DF9249A174E62A34BE39FE41B61F0"><enum>(2)</enum><header display-inline="yes-display-inline">Submission to Congress</header><text display-inline="yes-display-inline">At the conclusion of the study, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and Committee on Energy and Natural Resources of the Senate a report on the results of the study.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H84919BBC4AC848EDB9EAE90B35D01699"><enum>(c)</enum><header display-inline="yes-display-inline">Creation and maintenance of database</header><paragraph commented="no" display-inline="no-display-inline" id="H3EDD1B11E34D490383351182FB64AE51"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act and following opportunity for public notice and comment, the Secretary of Energy, in coordination with other relevant agencies, shall maintain, and if necessary create, a database for the purpose of storing and making available public energy-related information on commercial and multifamily buildings, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0F209D4B285B4FAF90344C803AAE0A68"><enum>(A)</enum><text display-inline="yes-display-inline">data provided under Federal, State, local, and other laws or programs regarding building benchmarking and energy information disclosure;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA92AF9478D1A40FB981CBDC782617753"><enum>(B)</enum><text display-inline="yes-display-inline">information on buildings that have disclosed energy ratings and certifications; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC977981DD48948DF82ABFAB93CC29A3C"><enum>(C)</enum><text display-inline="yes-display-inline">energy-related information on buildings provided voluntarily by the owners of the buildings, only in an anonymous form unless the owner provides otherwise.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF015EF1C97F24D04BB4CE461085B71C5"><enum>(2)</enum><header display-inline="yes-display-inline">Complementary programs</header><text display-inline="yes-display-inline">The database maintained pursuant to paragraph (1) shall complement and not duplicate the functions of the Environmental Protection Agency’s Energy Star Portfolio Manager tool.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCBA9DAED0F474FB8AC5A25FD6FE68ECA"><enum>(d)</enum><header display-inline="yes-display-inline">Input from stakeholders</header><text display-inline="yes-display-inline">The Secretary of Energy shall seek input from stakeholders to maximize the effectiveness of the actions taken under this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HBF769B7A2CC64CCBBA01A5D58F514F7A"><enum>(e)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Secretary of Energy shall submit to the Committee on Energy and Commerce of the House of Representatives and Committee on Energy and Natural Resources of the Senate a report on the progress made in complying with this section.</text></subsection></section></title></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
