		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clarence Gideon Full Access to Justice Act</short-title></quote> or the <quote><short-title>Gideon Act</short-title></quote>.</text>
		</section><section id="id451092E188DD4EFB94D8113CFFA5B6E5"><enum>2.</enum><header>Defender Office for Supreme Court Advocacy</header>
 <subsection id="id61765B68F60145F89021089793879E89"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/201">Chapter 201</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/3006A">section 3006A</external-xref> the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0715EA1FA935458D91BBB673521CC1A9" style="USC">
					<section id="idCF1E7B50B5004ECFAC8B7020226E56D7"><enum>3006B.</enum><header>Defender Office for Supreme Court Advocacy</header>
 <subsection id="idF7EB80257ACC476D88298BD29B2FED4A"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph id="id43539B0E75B34C4EAE1D022838939865"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Board</term> means the Board of Directors established under subsection (d) for the Office;</text>
 </paragraph><paragraph id="idDF43DC079F0344E884B1401DAF622F70"><enum>(2)</enum><text>the term <term>consult</term> includes, with respect to covered cases—</text> <subparagraph id="idF0A79DF65E5B4B238CC8CAA8207157E3"><enum>(A)</enum><text>giving advice;</text>
 </subparagraph><subparagraph id="idD27E6B1120734D98AF0E76544C7C491E"><enum>(B)</enum><text>drafting or editing briefs;</text> </subparagraph><subparagraph id="id7391C746227D42778F83393B31B74966"><enum>(C)</enum><text>providing assistance with moot courts; and</text>
 </subparagraph><subparagraph id="id7DAC40420B624BBF87A25A6516E9C0E9"><enum>(D)</enum><text>organizing or coordinating the drafting, editing, and filing of amicus curiae briefs;</text> </subparagraph></paragraph><paragraph id="id22E7751F1E7645A0B97655D8035C72BE"><enum>(3)</enum><text>the term <term>covered case</term> means a noncapital case involving an issue of Federal criminal statutory or constitutional law;</text>
 </paragraph><paragraph id="id2B1793462C044A76B2B982CE6AB4C7C7"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>Director</term> means the Director of the Office selected in accordance with subsection (e); and</text> </paragraph><paragraph id="id5D4489BBE1E24B1EAD7CCC9451A22975"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>Office</term> means the Defender Office for Supreme Court Advocacy established under subsection (b).</text>
 </paragraph></subsection><subsection id="id385730715a61447ebd74ee9014d50985"><enum>(b)</enum><header>Establishment; purposes</header><text>There is established in the District of Columbia a private nonmembership nonprofit corporation, which shall be known as the Defender Office for Supreme Court Advocacy, for the purpose of—</text>
 <paragraph id="id7E2EF214C4D04F0CB15FF092DB1E3AA8"><enum>(1)</enum><text>advocating on behalf of individuals in covered cases before—</text> <subparagraph id="id0C146319DA184FB9A61A4D494099B8CE"><enum>(A)</enum><text>the Supreme Court of the United States; and</text>
 </subparagraph><subparagraph id="id6E0ADD8E465649C29AA7E8B2701FEB77"><enum>(B)</enum><text>when resources permit, the highest court of a State; and</text> </subparagraph></paragraph><paragraph id="id1A1CE871B38843FFAF64308CEDE5C490"><enum>(2)</enum><text>providing assistance to attorneys advocating on behalf of individuals in covered cases described in paragraph (1).</text>
 </paragraph></subsection><subsection id="id3C14CAD5E98549E99F2604863D77C610"><enum>(c)</enum><header>Principal office</header><text>The Office shall maintain its principal office in the District of Columbia.</text> </subsection><subsection id="id190fd25fc0b848f3bdf600791b3bf06a"><enum>(d)</enum><header>Board of Directors</header> <paragraph id="id23F845C2BEC64112843ECEFAEC4E4B53"><enum>(1)</enum><header>In general</header><text>The Office shall have a Board of Directors consisting of 18 voting members—</text>
 <subparagraph id="idAF0893F2F537414ABC80759E03D7ECAC"><enum>(A)</enum><text>6 of whom shall be Federal Public Defenders or Executive Directors of Community Defender Organizations described in section 3006A, elected by the Federal Public Defenders and the Executive Directors of Community Defender Organizations in each district;</text>
 </subparagraph><subparagraph id="idA28577BAB3D2478A93F1B823C435A86F"><enum>(B)</enum><text>6 of whom shall be attorneys from a panel described in section 3006A(b), elected by the panel attorney district representatives; and</text>
 </subparagraph><subparagraph id="id0591fdc3d3fb42738bd51ab3e3b7e62b"><enum>(C)</enum><text>6 of whom shall be State or local public defenders from geographically diverse States, who shall be elected by the individuals elected under subparagraphs (A) and (B) not later than 6 months after the date of the first meeting of the Board.</text>
								</subparagraph></paragraph><paragraph id="id9CE76384885445E9833FE7DC32731A97"><enum>(2)</enum><header>Staggered terms</header>
 <subparagraph id="id89AF783589AB49D5A000F710CA8BA5A2"><enum>(A)</enum><header>In general</header><text>A member of the Board shall serve a term of 4 years, except that the first members elected to the Board under subparagraph (A) or (B) of paragraph (1) shall be divided into Class A and Class B.</text>
 </subparagraph><subparagraph id="idA087E5F38012453EB1E577A0F2F48F10"><enum>(B)</enum><header>Classes</header><text>Class A and Class B shall each consist of—</text> <clause id="id635A77E4689F420DAB49D215C70822CD"><enum>(i)</enum><text>3 members elected under paragraph (1)(A); and</text>
 </clause><clause id="id6F8725E1D1B3409FAC55D806048F3A1C"><enum>(ii)</enum><text>3 members elected under paragraph (1)(B).</text> </clause></subparagraph><subparagraph id="idE804F534F37448E9BB52F0245D8014F0"><enum>(C)</enum><header>Terms</header> <clause id="id75558316693D4A09A58F28A0B99DC0B4"><enum>(i)</enum><header>Initial terms</header><text>For the initial members of the Board—</text>
 <subclause id="id209147A002C0419D9FCEB798716E1551"><enum>(I)</enum><text>members of Class A shall serve a term of 2 years;</text> </subclause><subclause id="id6133D2F5CDB94CC0819683A9796B98C3"><enum>(II)</enum><text>members of Class B shall serve a term of 4 years; and</text>
 </subclause><subclause id="id1BB32D8A27C04D3783D1762278252D3B"><enum>(III)</enum><text>members elected under paragraph (1)(C) shall serve a term of 4 years.</text> </subclause></clause><clause id="idCAFB1E401A6F487F93396826FA6628EC"><enum>(ii)</enum><header>Subsequent terms</header><text>All subsequent terms shall be for a term of 4 years.</text>
 </clause></subparagraph><subparagraph id="idEC549A6CC2EA43F9B30EC6156C68F5A4"><enum>(D)</enum><header>Membership of each class</header><text>The membership of each class shall be determined by the members of the Board at the first meeting of the Board of Directors.</text>
 </subparagraph><subparagraph id="id910ADFDDB33C44AA947C705E16A0FA3A"><enum>(E)</enum><header>Vacancies</header><text>Interim elections may be held to fill any vacancies.</text> </subparagraph></paragraph><paragraph id="idE5FC9AC25029499982B35562562B6E46"><enum>(3)</enum><header>Bylaws</header><text>The Board shall establish bylaws to govern the operations of the Office.</text>
							</paragraph></subsection><subsection id="idA5465A23F7CD474E9F0A7C909C8F84E5"><enum>(e)</enum><header>Director</header>
 <paragraph id="idE37D4BA1367744969CE3C5035E437BCA"><enum>(1)</enum><header>In general</header><text>The Board of Directors shall appoint a Director for the Office.</text> </paragraph><paragraph id="id007DE4B553B2464BA47A9D23364A83EE"><enum>(2)</enum><header>Requirement</header><text>The Director appointed under paragraph (1) shall not be a member of the Board of Directors.</text>
 </paragraph></subsection><subsection id="id33B89E0D06F54465AE058DBD74C3EA1A"><enum>(f)</enum><header>General requirements for Director</header><text>The Director shall be learned and experienced in the law applicable to Federal criminal appellate practice.</text>
						</subsection><subsection id="id2C1E8A3B28F745CBBD76EBE0DC5BB873"><enum>(g)</enum><header>Functions of the Office</header>
							<paragraph id="idF8EAB061610F49BD812B1273C4E18390"><enum>(1)</enum><header>Grants of petitions for writs of certiorari in the Supreme Court of the United States</header>
 <subparagraph id="idD509C3B3EE3F4DE59BA7010C9C128CBC"><enum>(A)</enum><header>In general</header><text>On the granting of a petition for a writ of certiorari by the Supreme Court of the United States in a covered case, the Office shall—</text>
 <clause id="idAD4A3265BD6F428886D40426BFE98DEA"><enum>(i)</enum><text>consult with any counsel in a covered case in which the defendant was previously represented by counsel appointed under section 3006A; and</text>
 </clause><clause id="id9594905830AC47A7BEAFF2BB17FEDDDA"><enum>(ii)</enum><text>when resources permit, be available to consult with counsel in any other covered case.</text> </clause></subparagraph><subparagraph id="id9964BE4233074A8D90EB220BCAE5A72D"><enum>(B)</enum><header>Arguing case</header><text>In any covered case, an attorney described in clause (i) or (ii) of subparagraph (A) may—</text>
 <clause id="id9C2ECF44D89A4B1C935D620E552A1059"><enum>(i)</enum><text>advocate on behalf of an individual before the Supreme Court of the United States; or</text> </clause><clause id="idBAD03AC7E8ED41D2942B997F60A385B1"><enum>(ii)</enum><text>permit the Office to advocate on behalf of an individual before the Supreme Court of the United States.</text>
 </clause></subparagraph></paragraph><paragraph id="id5FBB3330AE8B4795BD6756ED2F08321E"><enum>(2)</enum><header>Filing of amicus curiae briefs</header><text>The Office may file an amicus curiae brief—</text> <subparagraph id="id8F3EFBEFE5434FBBBE1C98A1C8F2B933"><enum>(A)</enum><text>in any covered case in the Supreme Court of the United States; and</text>
 </subparagraph><subparagraph id="id5CD98F79DC764E89841062A01E3D1216"><enum>(B)</enum><text>when resources permit, in a covered case in the highest courts of States.</text> </subparagraph></paragraph><paragraph id="id2DC511DC724342438FAA85C038268CB3"><enum>(3)</enum><header>Call for the views of the Office; leave to participate in oral argument</header><text>In any covered case—</text>
 <subparagraph id="id0B887D89F4CD4F8EACEA0453F0C70A51"><enum>(A)</enum><text>upon request by the Supreme Court of the United States—</text> <clause id="idF2AFE1307FC44AE2A89706319086CB29"><enum>(i)</enum><text>the Office may provide the views of the Office on the covered case; and</text>
 </clause><clause id="id236C11666E1D42ADB2ABA5943DBB314E"><enum>(ii)</enum><text>an employee of the Office may participate in oral argument as amicus curiae; and</text>
 </clause></subparagraph><subparagraph id="id3E0644143ACA49FA88FACFF860273ED0"><enum>(B)</enum><text>upon request by the highest court of a State, and when resources permit—</text> <clause id="idA4D6BEF54D244459942F261A1FD86AB2"><enum>(i)</enum><text>the Office may provide the views of the Office on the covered case; and</text>
 </clause><clause id="idEFD99C38CD604B93942718881B547090"><enum>(ii)</enum><text>an employee of the Office may participate in oral argument as amicus curiae.</text>
 </clause></subparagraph></paragraph><paragraph id="id9A5C68A9A62F4F599516B72E1E15B8BB"><enum>(4)</enum><header>Monitoring court decisions and filing petitions for certiorari</header><text>The Office may—</text> <subparagraph id="id725A7ECC60154C67B9A56F5C2ED3B408"><enum>(A)</enum><text>monitor issues in covered cases—</text>
 <clause id="id6E6AA4442B7F40248CDE2F5B3CD2CE0C"><enum>(i)</enum><text>on which the courts of appeals of the United States are divided; or</text> </clause><clause id="id4E92D764DA89478E88A421C64AD2EAFE"><enum>(ii)</enum><text>that involve significant Federal criminal statutory or constitutional issues; and</text>
 </clause></subparagraph><subparagraph id="id776B9C91FB6246F3AFD206009F6A1030"><enum>(B)</enum><text>draft, edit, and file a petition for certiorari in the Supreme Court of the United States on behalf of an individual seeking review by the Supreme Court of the United States of a covered case.</text>
 </subparagraph></paragraph><paragraph id="id8471B5B3B38348758344101E677B9E4F"><enum>(5)</enum><header>Training</header><text>The Office may provide training to carry out the purpose and functions of the Office.</text> </paragraph><paragraph id="idD3169C23A62845F4BE9E0622B1582B9C"><enum>(6)</enum><header>Other functions</header><text>In addition to the functions described in paragraphs (1) through (5), the Director may allocate any funds made available to the Office for any other function that the Director determines is necessary to carry out the purposes of the Office, including, when resources permit, advocacy in a covered case before the highest court of a State.</text>
 </paragraph></subsection><subsection id="id8A2EC74C2BD9448D8D57BA0DF92144CB"><enum>(h)</enum><header>Employees</header><text>The Director, subject to general policies established by the Office, has the authority to appoint and remove such employees of the Office as the Director determines necessary to carry out the purposes of the Office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id98EA8593130A4D0C983F6E57904A2DB7"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/201">chapter 201</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/3006A">section 3006A</external-xref> the following:</text>
